I know I'm getting a reputation for hurrying things along and being on time. So it's 5 o'clock, so Linda, everyone, let's have a seat. I'm calling you out, yeah. I know I will. I regret a lot of things I say. Sebastian, you're going to join us? Okay, thanks. Okay. We'll let him get up here, and then we will do what I always say is my favorite part of any meeting, and that's going to be our prayer and pledge. And tonight we have Father Shaparo. Am I pronouncing that correctly? Okay. I just thank you for being here, and if you would come up and say the prayer and also lead us in the pledge, we'd

Thank you. Thank you, Father. And by the way, Father's with Grace Episcopal Church here in Nampa. Thanks again for being here and doing that for us. Okay, we, Madam Clerk, I believe we're ready for roll call.

Okay, we have a couple of things that are not, well, probably on the agenda. We're going to do a public forum first, and then we have a couple of... One is, well, I guess the muscular dystrophy is on there with the boots, but we also have a very, very important presentation to do right after that. We're going to do the public forum first. This is where our non-agenda items have a five-person limit. We have a three-minute limit. Any individual that comes up, of course, please state your name and your address. And so we'll get started with those. So, Madam Clerk?

You know, what I tell these folks here when I forget their name, if it's a guy, it's just Sam, and if it's a girl, it's just Sue. But I won't call you Sue. And by the way, I don't have a vote, of course, unless there is a tie. But as far as especially the start time, that will be looked at closely. Okay. All right. Next, please, Madam Clerk.

Okay, thank you Melissa sue and you know our director of the chamber Mitch Manetti's back there, so you You can talk to him a little bit too about this You're welcome, okay, mr. Mayor our next speaker is Jill hallows Good evening council

Thanks. Is that Madam Clerk or anyone else? Okay. All right, we're ready to move on. And so we're going to, first of all, start with our Nampa Fire Department presentation, the annual feel-the-boot drive for muscular dystrophy, and firefighter Ivy Denon, who I heard may be chief someday. Anyway, she is Ash. I understand you run the show, is that right?

Do you think the traffic has changed since 1954?

Mayor? Yes? Who should we make checks out to?

QR code works. Yeah, I pre-wrote it, but that's fine. Oh, okay.

The youngest council member, and he writes checks.

Here's the problem, Mayor. I've done away with cash and I've regressed to checks.

Firefighter, I'll let you come up and get this money. Then we'll go ahead and move on. Yeah, yeah, yeah.

The best part of this checkbook is I don't know how to balance it. I just know how to write from it. I don't know what the back portion's for.

Okay, while we're doing that, she's clicked into money. I think this is maybe his first appearance, but we have a second attorney here for the city of Nampa, Blair Larson, and I appreciate him filling in tonight for Preston, so thank you. And by the way, you're dressing, I think, a little sharper than what he dresses. Well, thank you very much, Mayor.

Challenge on the soup front. No. Yes. Thank you. I made it out to the chief directly. No. Thank you.

Did you just turn your credit card over? Yes. Not yet.

They need a tap. Can I tap something on the boot?

Okay, just a couple more things I want to say before we go on further here. I want to just congratulate a couple council members. Sebastian Griffin is now officially a lawyer against our federal media. He passed the Idaho Bar. And I guess from federal news, you need to kind of pass the bar before you can be titled an attorney or lawyer. Is that correct? For right now. We'll see how it progresses. Okay.

The other thing is I want to give – I've got to be a little careful with this one. But Councilman Rodriguez, Police Chief Huff has told me he has opened the doors like you cannot imagine to – so many forums to at least speak to the issue and educate on this public safety levy. So thank you. Thank you, sir. Thank you, Mayor.

All right. Just a couple other things, too. I just got received word today that Napa, for the first time by Walnut Hap, has been said to be the 23rd safest city in the nation out of 180 cities. Boise is number nine. I'll have to give them credit there, but only two cities in the state of Idaho, and Napa is one of them. So, Blue, thank you for what you're doing. Okay, I think we're ready to move ahead, so I'm going to have Luis Granados. I'm sorry, I probably just fouled that name up more than once today, Luis. COME ON UP, IF YOU WOULD, AND JUST COME TO THE MIC AT THIS POINT IN TIME. I'M GOING

And I guess she's been at that for two years. And so just appreciate your service in that area. And I know you work closely with individuals like Louise here as far as what they're accomplishing. So, Louise, what I'm going to do here, I'm going to read a little bit. Most of this is off your website. I want you then at the end to actually tell these folks what this is all about and anything else that you would like to say. So I get this correctly. Okay. I'm going to put my glasses on and read through a few things. Luis Granados, Executive Director of Breaking Chains Academy of Development. Orig

Dean, you can come up and put an arm around his shoulder. Give me a second shot. Yeah, need a little support sometimes. Okay.

Usually you're made those things when you're not there.

Louise, we're going to have a photo, so if you come up here, anyone that you would like to have join you in this photo? Okay. And I'm just looking back at our blue again in there. Blue, is this not something when individuals like this, their lives are changed, and then they're affecting so many other lives? I mean, what's better than having support of that sort?

Come on, come on, come on. I'm going to stand behind Amy.

Boy, you're even going to let Representative Cornelius come up? Okay.

Mayor Bruner. I also want to say, Jeff, Jeff, Jeff Cornelius, over here, sir. I want to thank Jeff Cornelius for running this through to the government, to Governor Little. So thank you. Thank you very much.

And also Pastor Keith and... Probably Gene. I know there were several people that wrote letters in support of Luis and the community members that matter. And that's just a small example of our community and what we do together. We help each other out in Nampa. So thank you for supporting Luis and what he does at Breaking Chains.

Okay, that was special, wasn't it? And Louise, you don't need to feel obligated. It gets a little boring down the line, so anybody that's... Thanks. By the way, at about 11 o'clock, be thinking of us, okay? Okay, we'll let a little bit of clearance here, and then we'll move on. Council, are there any proposed amendments to the agenda?

Mayor Brunner? Yes. I would like to pull 16A off of the consent to be discussed, please.

You'd like to pull that off? 16A. Everyone get a chance to look at that, please. Take a look. Would you like for that to be then on the main action item?

I'd just like to pull it off to discuss it separately from the consent agenda.

We'd move to item number two. Okay. All right.

Okay, so currently we are removing 16A from the consent agenda. Is that correct? Okay, and so we just need to adopt then the action item as far as we need a motion in a second.

Second. All in favor say aye. Aye. Okay, now we'll move to consent agenda. Okay. Discuss this item. So moved. second second any discussion all in favor say aye aye all right moving along staff communications need to go to what one one six a first okay then staff can make thank you see it's so nice to have a clerk that knows what she's doing So I appreciate her very much. So we'll go to 16A and then we'll go to communications. Thank you. Thank you, Daniel.

Mr. Mayor? Yes. So, Daniel, you probably have heard me talk about this before with fiber companies working in our town. Um, I, I still have heartburn from a particular fiber company and the damage I feel like they've done that's not been repaired in our town. I still drive around and see areas they've tore up our streets and, and I'm, I'm concerned about this because I don't feel like this agreement is written with enough teeth and it's protect us and our citizens. We've had multiple citizens come in and complain about what's happened to them as well. And, um, Recently within the last three co

Mayor, just a follow-up. Yes. So, Daniel, I disagree with following up with the fiber providers, and that's why I still have heartburn about this. My personal house, I had several thousand dollars worth of damage done. They basically... told me to jump off. They showed up a crew with a bag of dirt and filled one hole in my yard and that's the last I saw of them and it was several thousand dollars worth of damage. They bored underneath my driveway. My driveway sank in the rain because all the rain ran in there and it cracked the slab all the way across and I'm responsible to fix that. This is j

Yes, Councilman. Just to follow up, because they're required to carry insurance and they have a performance bond in place, how would a citizen like Councilman Reynolds be able to tap into that? Do they have to go through their own homeowner's insurance and subrogate it? Or do they go through the city to file a claim? Because that's the point of having insurance policy.

I think it would be well to have the staff prepare information to file a claim if there is an issue, because I would think to call the city first.

Okay, good deal. Mayor Bruner. Yes, Councilman, did you have a follow-up, Councilman? Yes. Okay, go ahead, Councilman Rodriguez.

Daniel, here's the problem. The problem is that we have first was TDS, and then there were three others that followed, now this one. And they tear up yard, and they tear up again.

Okay, please don't interrupt me. So now we're going to have more damage to each yard, irregardless of what this company does. They're asking us to give them the right-of-way. Now, I get it that that's what they're supposed to be doing, but I don't feel comfortable with so many of these Internet providers that come in through our city, damaging the property that was already fixed from another one from the previous incident. So I think we need to kind of put a little hold on or present a better packet to us so we can start saying yes and make sure that we have access to those who are responsible

And I think what he was clarifying as well, from my understanding, is this is different than TDS because it'll run through the main corridors rather than through neighborhoods or lawns. Is that correct? Because I need clarification as well. So it would be different in the sense of rather than tearing up yards. But it destroys the roads, too, and they need to be sure they get repaired if there is an issue.

Any other discussion from this side of the room? Okay. Legal, Blair, is there anything you would like to add?

Do we need to increase the requirement on insurance? Is $2 million sufficient per occurrence or does it need to be more? Does the performance bond need to be more than $40,000? Because as the attorney stated, we have the mechanism to be able to go after these things and you're letting people know how to go through the claim process and potentially through their own subrogation process. But are the dollar amounts sufficient for the issues that we've had arise so far?

So clarification, Daniel, I thought I was pretty much hearing that because of state, our hands are tied. Is that correct to a certain extent?

Okay. So, counsel, I guess I need your opinion as far as how we move ahead. So, I mean, this is an action item. Authorize Mayor to sign non-exclusive public right-of-way license agreement with Columbine Telephone Company, Inc. for use of public right-of-way for fiber optic installation. Approved by our city attorney.

Mayor? Yes. I just need one clarification from Councilman Reynolds because I think he has direct experience with this. Was the claim amount sufficient? Did you file a claim? Was there something that we should be doing in this contract to enhance that from your experience?

Well, I feel like the city is the one allowing them to do this, and so there's some liability there at some point. And it's taxpayer-owned roads and things that this is happening to. My particular problem was I could have hired an attorney, basically what they told me. And it would have cost me probably more than just fix it myself. But we're looking at the tune of $10,000. And it adds up quick. And I don't want to have that burden put on our taxpayers. So I would like to make a motion that we table this item until we have some more clarification from our attorney, if they could please researc

Okay, and just a quick discussion. What do you see, legal Blair, as a timeline when we can actually come up with some of this information that has been requested?

So, Councilman, what's your choice here? What are you desiring?

Mayor, for clarification from our attorney, please. Okay. Is there anything in this agreement that you see that stands out from your knowledge base that we need to change?

Okay, we have a motion and a second. Any further discussion? Okay, roll call, please.

Okay. Thank you. So we are needing now is communications. Madam Clerk, are we good for that? Okay. We're going to start with 4-1 police staff communications. Salvation Army update, please.

Good. Any questions for the lieutenant? Thank you. Appreciate you filling in. Okay, our second, and I believe Rodney, is Rodney not going to present on this, is he, or is he going to be online to present? Okay. Okay, you are a trooper, my man. He has a flu, and thank you for not being here to share it. Okay, Planning and Zoning Staff Communications, and this is our Director, Rodney Ashby, please.

Thank you. Any questions for Rodney? Yes, Mayor. Okay. Councilman? In terms of the annexation for Midway Park, is that contingent on the other approvals of any other properties?

Any other questions? Okay. Thank you. And you're going to hang in here for that final public hearing? All right. Go take a nap. All right. Okay. 4.3, Development and Service of Staff Communications, Mobile Food Vendor License Update. Mark Stirrer. Thank you, Mark, for all your work you've been doing on this.

Thank you, Mark. I just have a few comments, if I could, just for preparation for staff while they're making those revisions. If it would have gotten brought forward tonight, Mark, I would have been a no. And the reason being, even after the changes, I know you had emailed them to me right before this council meeting, and thank you for that. So I was running through it. A few things that I want to point out from my perspective, whether it's tonight or in November, still give me pause. The overnight language I think is going to be an issue. The one food truck per parcel was something that stood

They need to uphold the law so if the law ends up being they shouldn't be there overnight, so be it. But I think punishing the property owner's Because we've overreached is one thing, and punishing them for unhealth, sanitation, obstruction of view issue is a whole other. So those were the eight I flagged. You know where I stand on it. I'm just giving you a warm heads up for November. I won't be supportive if that remains to be there.

Mark, the food truck vendors that you did speak with, were they okay with changes if we moved to a food truck park instead of just having it be anywhere in the city?

Okay. Mark, so how do you want the council to proceed as far as communication and so on as far as before our November 2nd meeting? How would you like for them to communicate or meet with you in person?

Any other questions or discussion? Okay, thank you so much. Okay, we're five minutes after six, so we are not going to move on to new business. We'll move on to public hearings. And so our first public hearing. Now I will read this and then we'll have the applicant come forward, please. Action item, annexation and zoning to RS 8.5 single family residential zoning district and a potential development agreement on one parcel. And I'm not going to read all the numbers addressed as 4302 East Locust Lane for Anthony and Sarah Fine. Original concept, annexation to connect to city sewer system. And y

I'm sorry. Did you give your full name? I'm sorry.

Okay. You can go ahead and have a seat, and then we may bring you back up later. Does that forward mean you have a question, Council President?

Just a clarification. Yes, sir. Looking at the information in our PAC, it couldn't determine if there's a second resident, proposed, or is this staying as one residence on the property? Yeah, single property.

Thank you. Okay, thank you very much. Candace, is this yours? All right, here we go.

Any questions for Candace? Okay. Madam Clerk has said there's no one that has signed up as far as to publicly testify. Is there anyone that has not signed up that would like to testify regarding this issue?

Seeing none, any other comments from our applicants? Mayor? Yes. I do just have one question for them if one of them wants to come up or not or anything along those lines. So the application, the title is specifically for annexation to access sewer. Do you have a well currently on site and you're aware you're going to have to abandon that as well?

We did not. We weren't aware of that, no. We're going to have Daniel Badger come up and maybe help with that surprise. They do not have to abandon the well.

Part of the very first condition says any wells on site need to be abandoned.

Illegal. Do we need anything from Blair? Age 357.

Can you go back one slide, please? Recommended conditions of approval. Any on-site wells no longer proposed for use on the property shall be abandoned and or removed in accordance with local and state regulations.

Thank you. I just had clarification, so now you have clarification. I think we're all good to go. Thank you. Blood pressure go up at all?

A little bit. We like to help the heart rate a little bit. Okay, here we go. Do we have a motion to close public hearing? So moved. Second. All in favor say aye. ANY COUNCIL DISCUSSION? OTHERWISE, WE'LL DO IT. DO PLEASE HAVE A MOTION. MAYOR, I MOVE TO APPROVE.

THANK YOU. UNLESS YOU WANT MORE ENTERTAINMENT, YOU'RE FREE TO GO. ALL RIGHT. Number 262, action item, annexation and zoning to RS4, single-family residential zoning district. and a potential development agreement and a subdivision preliminary plat for Emberwood Subdivision addressed as 5712 Holmdale Road for SD Land Consulting representing James and Renee Dorenkamp. Original concept, 46 single family detached lots and 12 common lots on approximately 8.98 acres. And our favorite applicant is here. Okay.

You'll just have a little penalty because you went one minute in and over, but that's okay.

You're always perfect on those things. Thank you, Mayor. Any questions for Sabrina? I do, Mayor.

Sabrina. Yes. How does... R is for equal medium density.

Do you follow up, Mayor? Yes. So if you could pull up the diagram of the plat, it's showing all the apartments and houses. You have, okay, to the east, I believe, those lots look smaller than the others. So that's 13 to 25. What is the distance between each residence?

No, and I'm not talking about setback. From the space between each residence. You're talking about the sides?

Okay, thank you. You're welcome. Council President? Thank you, Mayor.

And so their improvements are going to... I can't see on the screen what the street is, but... there's connectivity.

Just a follow-up item. Sabrina, have you and I talked about this project?

I haven't directed you on any issue on this project?

Do I have a conflict of interest in voting on this project from your perspective?

I'm assuming a discussion a little bit, a previous discussion earlier in council meeting regarding conflict of interest. Yes.

Well, I think I've been accused of having conflict of interest on multiple projects based on the speech, and I thought it would be appropriate to ask the applicant if I have a conflict of interest and if we've done any business.

Sabrina, can you guess what I'm going to say? Oh, I hope something good. The open space was amazing. You crushed it. Thank you for that. I appreciate the attention to detail and having it centrally located. A small tot lot. I don't love tot lot. I know. I was like, oh. I love the pathways. I love that you put as much of the green space, not just on the sides and putting it, you know, wherever it made sense for your community development, but actually what's going to be good for the citizens that live there. Oh, thank you so much.

You always do great. And it creates a space where people want to hang out and be a community, which is what we're striving for. So I appreciate that. Thank you. I appreciate you.

Sabrina, thank you. My question is, you mentioned just below this build here, there's a dairy. Is that a working dairy there?

They do have a dairy cow at the entrance. No, just kidding.

Anyone else have any questions or comments? Sabrina, good job as usual. The only concern I do have, and I know there's City of Caldwell, so maybe it shouldn't carry as much weight, but it still does for me. Lots 11 through 19 were brought up by Councilmember Rodriguez. Right now we have nine lots sharing space with five neighboring lots. Is there any way that the developer can reduce four of those lots so it's one neighbor to one neighbor rather than two neighbors to one neighbor?

I even gave you an inch on the most northern eastern portion. There's two that overlap, and I think the trailer park is that curved portion.

The rest are the remaining parcels. 11 and 12, I would recommend converting into one. 13 and 14, 15, 16, 17, 18, and then 19 standalone, because then it's neighbor, neighbor, neighbor, neighbor, neighbor, five neighbors, and one trailer park sharing in the back. Right. I don't know if you're able to zoom it in there. My only concern is... Once again, when we are thinking about growth and our growing pattern, it feels not conducive to me to force two neighbors behind a single. The rest of the development looks very well thought out, and this was very well thought out. It's just a concern that I

You always do a good sell and, I tell all the other applicants they should hire Sabrina because you do a good job, and I believe you're thoughtful in your development. Thank you so much. That's just one consideration. Okay.

Okay. Counsel, anything further before we go to staff? Okay. Thank you. Okay. Thank you, Sabrina. Terry?

Yes. Okay. Is there a condition that the road out to the main road is installed prior to this plat? Is it on the... No, it was my question too.

Thank you. As part of the conditions of approval, there should be that if they're going to install over the 30 lot rule, maybe that's in the standard agreement. I'm rusty on it.

Okay. And that's because our code is basically, that's a standard item for you guys to check.

So it doesn't necessarily need to be on the screen. Correct.

Terry, Sabrina mentioned this is going to start probably around 2028, if I heard that correctly. Um, Do we know if there's any other, aside from this project, if there's any other road improvements that are scheduled for that section of the road? Hello, Daniel.

Thank you, Daniel. Mayor, can I ask Daniel a question before you sit down?

Do you know, are there school builds in this area in the next two years, new schools?

Before Daniel sits down a third time, anybody have any questions?

Good. So my understanding from Madam Clerk is there's no one who has signed up for public testimony. Is there anyone interested in speaking on this development? This is a lady that's here most council meetings. I'm always amazed how... You're an amazing citizen. Okay.

Thanks, Margie. Anyone else interested in discussing? Mayor? Yes.

Just another quick question for staff now that I'm thinking about it. Was anyone in the city of Caldwell given notice? I know that the neighboring properties, maybe to the east, were they mail letting them know about the public hearing or was it only to city residents?

Okay, Sabrina, would you like to come up and make any comments or answer any questions? And I'm sure you have Councilman Griffin's worked out by now.

Could we potentially make a few larger lots and scale back some of the green space and connect down southerly to add more housing units? My thought is maybe one day those lots will all redevelop into apartments, maybe. But in the meantime, to have the potential of conflicts between not only neighbor to neighbor, but 2v1 just is something that I consistently tried to avoid. I think our council has consistently tried to avoid. And if there is area with 0.5% of that green space, maybe scaling down, maximizing on the one side, scaling down on the other to allow for more units that direction, small

I can't, I can't make, I wouldn't, I'm one of six. So what's that? What's a half a percent? How much land are we talking about? Any idea?

I was going to say, if, you know, Councilman Griffin would have gotten his architectural degree with it rather than the bar, you could have handled this by now.

You know, I'm bored now that school's done. Might as well go back, huh?

One lot? Yeah. Okay. And, of course, our requirement is a minimum of 15% as far as green space. So that would be tough. Okay. Any other questions for our applicant? I move to close public hearing. Second. Is there a second? Yeah. Did I hear a second? Any further discussion? Okay. Roll call. All in favor? Aye. Thank you. I got that look. All right.

May I make a motion to approve as stated on the screen?

Just for the record, this subdivision is planned for Valley View School District. And these children would attend... Lakewood Elementary, and the middle school is Summit View Middle School and Ridgeview High School. Lakeview Elementary is approaching capacity of over 700 students. Ridgeview High School has officially exceeded its building capacity. This would require $17,920 more for the police to staff and to have police available. And we're looking at just these 49 homes. when it was mentioned several times that the dairy subdivision is just about finished. And where are those students going

we're just keeping on piling it on and uh councilwoman and correct me anyone that would like so but i think that's more of a state uh direction that we are not to consider which is crazy to me also as far as school populations in in these type of considerations so uh mayor yes and just for a comment prior to a vote uh

We're going to see, as the valley grows and Nampa grows and Caldwell continues to grow towards us, a lot of abutting properties between the City of Nampa and the City of Caldwell. I would be hot mad if the City of Caldwell approved a project and put three or two neighbors behind one of our larger lot properties. I think it's a trend that we need to start creating now. Conversations between staff needs to be happening now and the development community needs to be happening now. So Sabrina, you always do a great job. I don't disagree even with the zoning designation on the other side. I think it

So I'll be a no, Mayor. So, Mayor? Yes. I'd like to respond. If we want certain things from the development community... and we want plats a certain design in a certain way, then we should have it in our ordinance.

And that's why I'm stating it now. If it's not in our ordinance, then adding it or expecting an applicant to make adjustments at this late hour is inappropriate. I mean, it's asking for money, and then we're turning around and saying no. So it's just important that if we have ideas, we need to share them with staff, and we need to work it out through our workshops, which we've had, is all I'm trying to bring to light, versus examining if it meets it. I mean, I didn't see the second exit. They pointed out where the second exit was going to tie. It only would happen. I'm just trying to use it as

Mayor, if I could, the only counter that I have to that That's what the point of the public hearing process is. This is our final stage to say, are we going to give it the City of Nampa stamp of approval for the electeds rather than staff, not to look at maybe the letter of the law, but the spirit of the law of what the community looks like. I'm taking the opportunity now to state, as one council member in Sabrina, I can count pretty well you're going to get an approval tonight. I look at this as an opportunity for staff to know Maybe we should ask applicants to not put two or three to one and

And let me just state that, you know, I think a lot of these folks may not even be aware. We've been talking about analytics to see if actually growth is paying for growth and on any – Any annexation or whatever the case is, it's been taken longer than we were hoping. We're getting some confirmation from Clearwater Analytics. Looks like it may be February or March. But I'm in agreement with the Council President. It's just not fair to developers at this point in time. They need to be made aware if we are having an ordinance change or something of that sort before they actually put in their app

one will be communicated to so they can make a decision before they even apply whether it makes sense or if they feel like they can get a passage from a council so okay any other uh mr mayor yes um can i get uh legal to give us a synopsis of what we are basing our decisions off of for land use and also where schools come into consideration what we're told uh in the law so what

In light of that, I'll strike my comment about the schools, but I'm still concerned that we're not covering our police department.

Mayor? Nothing from the audience, please.

Yes. In regard to my comments, I'll cite to Napa City Code 10-2-3.C.3, the proposed amendments are or would be in the interest of the public and reasonably necessary. I don't feel that putting two to one is in the interest of the public or reasonably necessary. So if there is an argument that I'm off base, I'm trying to put us back on base.

Thank you. Okay. Any other comments? Okay. Do we have a motion to close public hearing? Thank you for letting me know. How long ago was that? Okay. All right. So we already have a second. So all in favor, say aye. We have a motion. We're already there. Okay. Let's do it. Roll call. Thank you all. Thank you, Madam clerk for keeping me in line.

What's new, huh? Uh, And what I do is I come out right at the front. I try to. This will be a yes, and mainly for the reasons I stated. I agree with Councilman Griffin that this ordinance needs to be looked at very closely. But also, I don't think it's fair to an applicant to come and do all this work and so on and then have a project that they're following what ordinance we have in place and then denying them. So in this case, it will be a yes.

Okay. Can we do one more public hearing or do we need a break, counsel? You need five minutes? Okay. Five-minute break, please. We are ready for our third public hearing.

Can anyone hear me out there? Because we are reconvening. I know the future commissioner cannot. I know Senator Lakey is having a challenge with his hearing. Okay. All right. You just wish you were back up here still, right? All right. Here we go. We're ready for 6-3, and I will try to keep, I tell you, I'm losing it a little bit as far as where we're at on things, so hopefully I get this one a little better this time. Here we go. Reconsideration of City Council denial of comprehensive plan map amendment from industrial to commercial for a 2.6-acre portion annexation and zoning to IL Light Ind

Mr. Hatch, our time is up. Are we okay for now? Yep. All right, all right. So we will have our, any questions for Mr. Hatch, though, before he sends the councilman?

Thank you, Merritt. Can you give us an example of the types of businesses that you're envisioning in this flex space? Let's see.

I'm looking down the lines here. Any other questions or comments? Okay, I believe we're ready for staff. Candice, your second round here? Okay.

And it's just point of clarity. These individual units are the 31. Are they individually owned? Do you know or is it so like if somebody were to make it a change to one of these properties, would they have to come back before city council?

Daniel or who's who's answering this one, Mark? Okay, Christy. Third time.

No questions, council, otherwise we'll go to public testimony. I understand we have one individual that has signed up to testify. Madam Clerk?

Just a little closer, Molly, to the mic. Thanks.

I'm just not familiar with the address. Are you close to this proximity of this?

Thank you for presenting. Is there anyone else that's interested in presenting? Okay, come on up, sir. And then I see another hand, so...

As usual. Good job. Just anyone else would like to voice their opinion? Crystal, do you mind on that microphone there? Is that working? Director of Traffic, future Director of our Public Works, Crystal Craig. I think you're the main one who would have airport representation since you've been over our traffic for several years. Any concerns at all with this project as far as from an airport standpoint?

Okay, appreciate it. Okay, Mr. Hatch, if you'd come back up and if you can respond, especially to Patty's comments, I think if you can concern as far as businesses going in there, not only now, but potentially in the future.

Mayor? Yes. My question may be more for Fire Marshal Effinger. For clarification, really just wanting the clarification in the record comment in terms of change of use occupancy concern about you know what happens once the buildings are built etc can you walk through tenant changes uh use changes within a multi-use complex

Great. Thank you. I think that just brings light and clarification to the concern as far as the scrutiny that the light industrial, the project will go through over time, not just on the initial. So thank you. Thank you, mayor.

Council, any further questions for our applicant or staff? If not, we need an motion to close public hearing. Thank you. All in favor, say aye. Aye. Thank you, Mr. Hatch. Okay, council discussion and then potentially a motion. Mayor, I move to approve the project as stated on the screen. Okay, you can arm wrestle over that one. Who'd you get? Okay, all right. Okay, roll call, please.

Okay, all of you that were for that hearing, I take it you're all here for the next one. Okay, here we go. Ready or not, huh? Okay, I get to read in 6-4. And I think we're going to get Rodney back on here. See how the pitcher down here without his beard? I think he needs to update that. There he is. Okay. Okay, annexation and zoning to RS4, single-family residential, RMH, multifamily residential, and BC community business zoning districts and master plan community with a development agreement for Lone Star for parcels 00 Smith Avenue and 000 Lone Star Road for Lone Star 110, LLC, and Challenge

So I'll stop. Any questions, Council? Thank you, Stephanie. Thank you. Any questions for our applicant? Not seeing any at this point in time. Okay, we will move on then. And Rodney, how's your voice? You're on. Yeah, if you didn't get any better than that, we're...

That open green space is beautiful. I can't wait to see that over there.

Irregardless of the direction that the vote might go this evening, is there anything that we can do with the county for a request to change maybe a development agreement or to allow for a lighting? I know one's the highway district, one's actually the county's requirement for the lighting. If it doesn't go this way, is this all or nothing? Are we not going to be able to have lighting in the park? If

So at a later date, we need to request a variance from that. We can do so potentially. Potentially. After November 3rd, especially. Is the commissioner still here? Good deal. Thank you.

In regard to this development, from a similar developer, I think there's a couple perspectives I'm trying to keep. Because I was supportive of the Adora project for a number of reasons. But one of the biggest heartaches that we've had with that project has been the delay in accessing the roadways. Because they've shut down Flamingo. It was supposed to open back up in August. And that won't open up again until potentially December, if not later. In terms of developing out these roadways, what is the current plan for developing or expanding or adding to these roadways, whether it be a roundabout

For immediate closures, would Smith be closed during this development? Would Lone Star be closed during this development? Would a portion of Middleton or Midway be closed during this development?

And then in regard to the... Now thinking, because people are either going to go north or they're going to go east, that comment stood out to me. When running down Smith, Smith has a future development to put in the light installation and expand the roadway, similar with... Middleton, no. So Midland and Smith and Midland and Davis.

So we don't think there'll be a significant impact to Midland per se, more so Middleton and Midway.

Thank you. And then one final one for Rodney, just off the coattails, that comment. Final? Final. Okay. In regard to our decision tonight for annexation, are we getting a second or third bite of the apple for preliminary plat or final plat? Or is our decisions tonight the last time we'll have this brought forward before us outside of a consent agenda?

This is a comment, Mayor, not a question. Council, if there are development agreements that we're going to be requesting tonight, I would encourage that we are extremely specific in our verbiage. I'm having similar heartaches with the Adura. We've already hashed this out before about berms and about roadways because we've left ambiguity. If there are going to be specific things, for example, having that preliminary plaque come before city council rather than planning and zoning or along those lines, I think we should be very specific on so it's not left up in the air or for a different interpr

Yes. Just a quick. So you talk about all these intersections that are going to be constructed and made better, apparently. So is the money that's going to fund these intersections going to come from taxpayers, from the developers or from grants?

Yeah, any other questions for Daniel, Rodney, or otherwise you still have a little more presentation, Rodney. I do.

excuse me mayor yes Rodney can you clarify though for me it seems like a year and a half two years ago there was a workshop ahead of or timing wise with the southwest area plan work that covered encouraging master plan communities and council there was presentations before council on encouraging the master plan communities and making that available. Is this application in concert with or congruent to what council saw before and approved or knew the direction going? I'm just trying to bring past issue forward for this one and need a little bit of a reminder.

Mayor, follow up. So, Rodney, is this project in congruent with those plans and those discussions and council's direction from a year and a half, two years ago?

I have a question. I don't know if you can answer this or if this is for Doug. When you're talking about these master plan communities and this community, can you tell me, is this paying for itself? How is this affecting our city, the impact of this community plan? Where are we looking at? We were hoping to get analysis for stuff this large, and we don't have that. So We need that.

You want Doug to take that on, Rodney? I'm looking to Doug. I thought, yeah, he just woke up, so we're good. Okay.

Just a follow-up. So we have no real answer on the impact of this community or any of these master plan communities until January. Okay, thank you.

Yes. So Rodney question, where the school district owns two different parcels, one for elementary, one for high school. If this project's approved and staged over several years, and then the school district comes forward with plans to build on those sites, that's not going to impact the school district from being able to build is the approval of the master plan community.

But in terms of they'd still be able to build a high school, having a master plan community approved is not going to impact or restrict them on building a high school. What I'm getting at is you have neighbors and people living there in the community and then one day the sign goes up, Napa School District is building a new high school and people go, I didn't know about the high school. I wouldn't have lived next to a high school. So what I'm trying to, I guess, have on the record and some communication is the school district has already chosen high school site and an elementary site. That's a

No, I understand, but there's ways to note in the master plan community's documents and so forth that there's an acknowledgement that the Napa School District has plans for school sites. Yeah, very good point. Okay, thank you.

Surprise. Big surprise. In regard to the Southwest Area Plan, when we look at the Community Mixed Use Midway slash Lone Star District, the permitted zoning districts would be BC, BN, RML, RP, and this is considering RMH. What is the difference for the City of Nampa to approve RMH in this area rather than RML? And was it ever intended to have RML because it wasn't placed in the plan that was approved?

So in terms of, and I know you worked heavily on this Rodney, uh, is RML more conducive with the area than RMH is for this specific site? Because that's what the plan calls for. Um, To even get to the point of the plan being approved, it was slightly controversial, and now we're seeing the fruits of it. So if we're going to stick with the plan or not stick with the plan, I just want to know your thoughts in terms of planning and why those zones potentially weren't called out, or if you feel that one would be better than the other.

Thank you. Anyone else? Rodney, thank you very much. Way to hang in there. Not feeling well. Okay, good job. Okay, I think we're ready for public testimony. Probably no one signed up, is there? No, I'm glad.

Okay, let me, Senator Lakey, come on up, and let me just kind of say, most of you are aware, at least I've read them all, and I am pretty confident the council has read most of the submittals, most, of course, not being in favor of this development. And I think Rodney has also summarized them well. Each and every one of you that have signed up, and there may be more before we're done here, have the total right to speak for three minutes. Of course, you'll give your name and your address. The one thing that I have always asked, I've taken some criticism for it. But if someone speaks before you,

Any questions for Mr. Lakey? Yes. So under the Southwest Area Plan, under this application, I believe you testified before the county, and Nampa is prevented from going west of Midway. Is that correct?

Thank you for the clarification. Any other questions? Okay. Madam Clerk, let's call up the next two. So, in other words, we'll have one speak and then one just standing behind, so we can kind of keep it moving here, if you would, please.

Yeah, stay close. I'm not good at checking text, and I've had individuals that are listening that said they had not been able to hear. So stay close to that mic, please.

Sorry, Bill. Mr. Bell, could I interrupt just for one second? In that email, how did I respond?

Make sure he buys it, if that's okay. I just wanted to clarify. Yeah, absolutely, absolutely. Thank you, sir.

Just a minute. I need the audience to not respond in any way, shape, or form, okay, especially with voices. Thank you.

Thanks, Mr. Bell. I'm sorry, Mr. Bell. Question from Councilman. Yes, sir.

You don't think that you ruined the area because you moved here? Because that's your comments. That's your comments. That anything else, your comments. So I'm trying to get a clarification. Your comments are or were, as I understood, that anything new. would be terrible for the area.

But you were afforded that choice because the city provided the approval of the neighborhood that you're in. Is that correct?

I appreciate that. I just wanted the clarification. Thank you. Okay. You're very welcome. Thank you, Mr. Bell. Thank you.

Yes, questions? I'll say, Commissioner, because I am a betting man and I think I know how November will go for you. Thank you. Irregardless of tonight's vote, while you are on the commission, will you help us with the Midway Park getting lighting to that site?

Councilman, from previous, and it's lights. Are the damaged birds in the area?

So you still want lights? Sorry, Belinda. I personally would like lights in the parking lot because I drive by late at night and see what's happening there. So I'm one of the frequent calls saying that there's an issue going on in those parking lots at night.

I won't. Everybody in the room. No, no, no. Go sit down. Not campaigning. All right. Okay. Yeah. You think I got to throw something or just hit him with water? Okay. Okay, I think we're ready. Name and address, please. Larray Sizer, 12418. Okay, go ahead. Say it one more time, then she'll call the next person.

Okay, very good. Now we're ready. Thanks.

Thank you. Mayor, just for the sake of preserving the record, LaRae, did I in any way insinuate how I was going to vote in my email response to you?

And for the 42 emails that I did respond to, I didn't insinuate how I was going to vote prior to the hearing?

LaRae? I said five words to you, didn't I? Hello, Lurie, thank you for your information.

Thank you so much. I want to go ahead and try to come here. And keep your promise. Keep coming to council meetings. Oh, I will. All right.

Any questions for Mr. Wheeler? Yes, question. So, Mr. Wheeler, comment here just a moment ago as far as why did Why did you go out and buy a large piece of ground to build your house? Why did you move to this area, or why are you moving to this area?

And so with that principle, somewhere you got approval to be able to build what you're building on your land, I assume. Correct. Did anybody have the opportunity to say no to you?

I'm just trying to get the clarification. People, you don't need to comment. He has a lot of questions. I'm just trying to understand.

Cam? Yes. Okay, I need to clarify this. Please. You own that property. That's your property. Correct. Why didn't you build 400 houses or 1,000 houses out there on your property that you could have made a heck of a profit?

Mrs. Schumacher. Mayor yes, so I guess this question question is and I have a question for you.

Councilman Reynolds. Thank you. I mean this question in the most sincere way, so please don't think that I'm mocking you. I would like to know your opinion on analytics when they come back. If they come back favorable for the city of Napa of growth paying for growth, would your opinion be different?

Thank you for your answer. Appreciate it.

Yeah, hold on, Linda. Come on back. I think you're going to be called upon. We're going to start with Council President Bills, please.

Well, Linda, I appreciate your comments. They're forthright. The part that I'm concerned that people are not making the connection is that the legislature, a few years ago, changed the funding formula through two House bills. And through that process, City Council asked our Finance Director to go back and to look at Where would we be had the legislature not changed Idaho code? We would have taxed an additional $26.6 million over the last four and a half years. That $26.6 million would be fixing infrastructure, funding police, etc. Now, some would say, I'm glad my taxes didn't raise. I'm gettin

Linda, so I was going to agree with Mr. Heinemann on one of his statements about that people that created the demand are the ones who should pay for growth. I can agree with that statement. And that would happen if it wasn't for House Bill 389. If you really look at that mechanism, new construction growth, we don't get those monies anymore like we used to. So that's a problem. The people that created the demand... they came here, they get a free ticket. The people that were here, they're the ones paying for all the people coming here. That's the problem with the legislative bill that was ran.

So I would encourage you to call Chief Huff tomorrow. I'm sure he'll be happy to take your call. And ask him if City Council has let him down. We haven't done that.

No, no, no. We are here to— I'm going to stop just a minute. He finishes. He's badgering her. We have tried to call— He finishes and then you're on. We have tried to hire officers over and over and over, as I'm sure our lieutenant can attest to, and we're trying to hire officers. They're hard to hire, and we keep losing them for higher salaries. IT'S A BUMMER. I'M ALL FOR THE LEVY LIKE YOU ARE. WE NEED PUBLIC SAFETY. I CAN AGREE WITH YOU ON THAT ITEM.

AND WE'RE NOT SUPPOSED TO TALK ABOUT WHERE WE ARE ON THE LEVY.

I am trying to politely object that this is out of control. We are here to listen to their opinions, not to badger and question them and where they're from. They're here to give their opinions, and it is our job to listen and not badger them. And I think this has gotten out of control tonight. And I respect all of you, and I'm sorry, but this needs to stop, and we need to allow them to give their opinions. Thank you.

Anybody that knows Linda Steele, she knows she can handle herself.

It's okay. And, Linda, I just might add that... I'd be happy to go to coffee with you anytime because I think it would be a robust discussion and it would be fun. Yeah, I don't know about the fun part, but okay.

I have a different idea of fun. By the way, Linda Steele and others have – and it's their choice because the only thing we can do is educate, not advocate. But she has decided to advocate. But she is probably the main responsible for 100-plus –

signs out there let's say that can mayor i don't i'm you can correct me on this legal but you don't have to answer questions that the council members ask you you just get to give your opinion i don't mind i know you don't i think i think she kind of enjoys it sometimes actually oh she likes it

Okay, we're moving on. Linda was the last one that was signed up. Is there anyone? Ooh, okay. Oh, boy, that was the wrong question. Okay, earlier I said 11. We're moving for midnight. How many more do we have as far as want to speak? And these are where you're saying something new, right? Okay, so we're going to take an eight-minute break, and then we'll be back. This is on. We are reconvening. Okay, everyone, I need everyone to have a seat. If you want to be a part of this, please. Social hour was at 5 o'clock, so let's go. How are you? Good to see you again. Hello, Ms. Sherrill.

Okay, so we're gonna go, uh, one, one, one more time. How many, yeah, show me, uh, hopefully there's not as many hands as I saw last time. One, two, three, four, five, six, seven, eight, nine. Okay. Becky, you're going last, Mark. Okay. Okay. Anyway, Becky, you're going to go first. I am an old-timer. Ladies go first. The men will have to wait last. So once Becky's done, we're going to start on this side. Furthest up, ladies. Until we get done with the ladies, then we'll start with the men. So remember, we need name and address. And I mean, it's almost 10 o'clock, so I am repeating this. Pleas

Go home and tuck those kids in, okay? All right. Okay, over here, ladies. Okay, we're coming. And who's the next lady next to her? Okay, just go right behind her, please.

Virginia Ernsberger, 12172 South Hunters Point Drive, Nampa, Virginia.

Thank you. Come on up, and then whoever's the next lady of mine is Patty, you're up. Okay, so you can just come up to the front row, okay?

I think that's good. Thank you. Patty, you're up next.

That's because it's way past his bedtime and mine.

Is he? Yeah. Okay. Oh, he's just watching you, though. Okay.

Okay, we're not going to go back and forth, by the way. All right. This is not the time for it. I will just make one little comment about the lights. We need all in favor of birds, but guess what? We have a lot of illegal activity, drug deals going on because there's no lights in Midway Park. So I guess we pick between the birds or if drugs get distributed.

I know that. That's what I'm saying is. But you're okay with lights as long as they're the right type.

Yes. I would just like to make a comment. Likely not very popular. It's supporting councilman Bill's. I've sat here and I hear things that I absolutely agree with from the citizen side and things that I absolutely agree with, with Councilman Bill's perspective. One of the things that I have written down three different times when it's brought up was serving the developers or playing for the same team. Even tonight, I think you're going to hear Councilman Bill scrutinize the developers because he has a unique perspective as a developer on what they do correctly and incorrectly. While I may or m

Let me just second that. Thank you, Councilman. Then we'll move on. But Councilman Beals, I've served with him on council in so many different capacities. As most of you know, when the tragedy happened with Mayor Hogeboom, this man stepped up like none other and took that on. And anybody that questions his integrity as far as what he does, as far as what other developers or whatever, but I don't also always agree with him. But as far as to not have his knowledge and so on that we have as far as the city of Nampa, I'm just saying I will stand up for this man day in and day out. I repeat, don't

Thank you. Thank you. Who's the next two? Do we have two more ladies that wanted to speak? Any more ladies? Cheryl, I think you're up.

Thanks, Cheryl. Okay, are we ready for men? Not sure I am, but go ahead. Okay, so no one on this side? Okay, you're last. Mark's last, so okay. No, this gentleman will go this side first. Yeah, you're good. You're on. You come on up, sir. Have a seat, please.

The time is up. All right. Thank you, sir.

Is there anyone before Mark? Because he for sure is going last. Okay, Mark, you're up. I'm not going to ask again, by the way, is anyone interested in, okay, so this will be it.

You finished well. Okay. Stephanie, ladies, who's going to do this one? Who's going to do this? Okay. This is the applicant rebuttal. We have five minutes, actually. And you're still smiling. So you've got your traffic man up here, too.

Yeah, Rodney's not here, so do we have anyone? Mark, are you able to do that? Okay, we'll stop your time until we get this. Thank you. All right, what's another three or four minutes, right?

Thanks, Emily. I'm going to have you pause. And if there are questions, Council, for... For Emily or John or Stephanie, whoever? Is your mouth empty yet? Anybody else on this side have any questions? Yeah, go ahead.

Emily, thank you for that. So if I'm understanding correctly, the first phase is going to be in five years from now.

You have a map of what you think that the phasing will be, how many phases there are, which is coming first, commercial, residential?

Okay. You don't have a question? Mark the time and date, please. Okay. Okay. Anyone else from council? No one else? Okay, boy, we took it easy on you, Emily. Thank you. You bet. Thank you very, very much. Thank you for everyone's patience. Mayor, I move to close public hearing.

Okay. All in favor, say aye. Aye. Council discussion? Motion?

Mayor, I have a question for probably Crystal.

Crystal, it's about time we got her up and talking.

Maybe Daniel, but knowing that timeframe now, can we get a better scope as to what infrastructure improvements could potentially be in that timeframe? Because we're talking now 2031 to 2035.

So something like this wouldn't potentially trigger the city to look closer at this intersection should this pass. It wouldn't trigger something for you guys to look at it closer and want to do improvements sooner.

Daniel, did you have something to add at all? Okay.

Yes. I'll kick it off with my comments. My very first thought is, while this may not be in my district, the development, it's in Councilman Rodriguez's district, all those trips come through my district. Whether you go east, you're going to hit me when you hit Middleton, or north when you hit Orchard. I think the traffic is a major and serious, serious concern. You feel the traffic and growing pains at every direction. No fault to the current council. I don't even blame the previous councils, and I definitely don't blame Crystal. I think we're all working with a boom and an explosion in Nampa

I have a question for you. I've asked you this before in other hearings. Cheryl Higley always gives us interesting things to ponder. She does her research. Can you respond to her statement? I'm trying to find your side, her side, the middle somewhere. Can you respond to that?

There was a portion of her presentation that talked about how we were doing something wrong. And that's the part that I'm always concerned about. I'll see if I can find it. And I have to... I don't want to ask you. I'll have to look it up, Rodney. Let's take a minute. The other thing, let's see, Rodney. Did you say this was a 20-year build-up? Is that what I heard?

starting at 2031 to 2035. that's if the market and the economy councilman do you need to look some things up we move to someone else and come back go ahead all right anyone else uh have a comment do you have any no debbie do you want to go councilwoman jengla thank you mayor um

As Rodney spoke earlier in this meeting, he was talking about the meetings that we had to discuss master plan communities and how we could implement those as we move forward. It does allow for us as... And I was on council at the time, so I was a part of those discussions. And I love master plan communities for the fact that it does allow us to plan ahead. We can look at larger pieces of property rather than having individual... different communities that we're just annexing it and bringing in. You've seen it and they just don't flow together. But when you do a master plan community, it's a lo

Councilwoman Scott, do you have any comment? Then we'll go back to you, Councilman.

Yes, thank you. I have a couple of concerns about this. First of all, I get really concerned when the public comes and says, we don't listen to you. We do. I listen to you. I guess I can't talk for everybody else, but I listen to you and I hear you. And I hear every single neighbor that has come out and said, no, no, no, please don't. And you have great reasons for that. And for those of you that are from one of the, as our governor calls them, one of the cow states, California, Oregon, Washington. Thank you for coming out. Thank you for giving us the warnings that have happened in your states

Councilman, are we ready? I am. Not quite yet, Councilman Rodriguez. We're back to Councilman Reynolds.

Rodney? I think the comment was density doesn't meet the criteria. I'm trying to figure out what that meant.

So I The plan is compatible or incompatible?

There's a long list of what I observed here. If you notice, when Todd Lakey spoke at the very beginning, he mentioned 1024, and that is the annexations. And so, therefore, we have the ability to say yes or no based on the requirements that are on for those annexations. In hearing him and then hearing you, you all said the same thing. Density, public safety, environment, best suited for this area, fiscal impact, I have yet to hear that yet, for the taxpayers. Is it reasonable and necessary? No. Is it landlocked? Yes. There's only two ways in and two ways out because west is blocked, south is bl

You have more comments? So do I. Go ahead and let's continue with discussion then.

Mr. Mayor, just my comments I wrote down here. I know that Councilwoman Scogg was talking about, we talk about dense subdivisions to protect farm ground, but I'll say that I've said it many times, I'll say it again. dense subdivisions to protect farm ground. And if you don't believe that, drive out Orchard in Canyon County, and there's tons of nice new homes, but they're sprawled out on acreed lots, and they're individual well and septic, and they're just eating farm ground left and right. So density does protect farm grounds. Farm ground, I believe that. I feel like we need commercial hubs in

I feel that you need some direction. The surrounding area is RS 8.5. I would like to, if this is ever brought back, see RS 8.5 if possible with neighborhood business or neighborhood community business, if it ever gets to that point. So if you're trying to poke into the mind of what could go there, that would likely be what I would be in favor of if the time came. In terms of we need to... Pack it densely in to avoid sprawl and take up our farmland. I would actually agree with that. What I challenge on the other side of the coin is, but we also need to be willing to say stop. Midway is where I'

Councilor Rodriguez, are you still ready to make a motion? I'm ready, sir. Okay, let's do it, please. Could you pull up the screen for the motion? Or I can just wing it. Mark, can you get the screen for the motions, please?

I move to deny annexation and zoning to RS4, single-family residence, RMH, based on, well, do you want me to read the whole thing or just go to the code?

Legal, what do you want him to do? Can you just go ahead and read the dark areas here?

There's not. I will reference code for the denial, which supports the denial, is 1024I1 and 10243, so regarding the denial.

Are we aligned there, Councilman? Yes. Okay, and I'm getting a nod in affirmative from our legal that they are consistent. You okay with that, Rodney?

Okay. So we have a motion. We have a second. Do we have any further discussion, Council? If not, we're ready for roll call, please.

Okay, I encourage you all to stay. We got about 10 more action items. Thank you, Emily. Thank you, John. Thank you.

We're going to go ahead and move on. Action items. So we are gonna move to I've had a request that we move five nine up to the top because we do have someone here It's been waiting for five nine. So we're gonna start with five nine Okay, I need I got folks folks Folks folks. I love you. I love you all but we need to go out the foyer to socialize Okay, so we can keep the councilman. Yeah. Yes. Yes, Commissioner I keep the These action items get them completed, please So we're moving to 5-9. I'll read that. Authorize mayor to sign agreement for hookup of North Shore Estates subdivision to the ci

I have a question on this. Okay. So this sounds to me like, from what I read, that... They will get to hook up, but they don't have to be annexed. So they will be paying no taxes. Is that correct?

Follow-up? Mayor, so Daniel, so they're going to pay regular sewer to use our our sewer and our plant and our water, but they're not going to pay any other city of Nampa taxes.

Thank you. Council President. Mayor, thank you. Building permits, are they issued by the county or by the city?

Okay, we have a motion and a second. Any further discussion? Clarify the motion.

Mitch Minetti, 16740 North Gentry Drive, Nampa. I just wanted to say congratulations and welcome to Stephen. And also this decision here was important and Robin Sellers is still online at 1110 at night listening for this.

And thank you to City Council. Did you say kudos to Morgan too? Okay. I just didn't want you to be on our bad list. Okay. We've already hit 5-9. We're moving to 5-10. Authorize Public Works Administration to submit an application for additional funding from the Nampa Auditorium District for the Nampa Civic Center Auditorium Remodel and Upgrade. So moved.

So the way I read this, this is another $250,000 ask on top of the $500,000 I already gave. Is that correct?

That's my understanding. But do we need confirmation on that? Jay? Jay, you're here.

Jay knows it's not the last time, at least I'll be asking. So go ahead, sir.

Mayor? Yes. Can I get clarification on why originally it was only the $250,000? Was there not enough funds in the balance to be able to do the full $500,000 at the time? Or what was the hesitation for the full $500,000?

Was there any deliberation on why it ended up failing originally?

And Jay knows I'm as blunt as they come, but I really feel with taxpayer money, now that we just have the Civic Center, we don't have the Fort Idaho Center. I realize Fort Idaho Center has lots of needs, but I am really strongly an advocate for Auditorium District, which I think this commission is doing a wonderful job. A couple people just told me the other day that go there all the time, that they just feel like they're really coming into their own. But I feel like the Civic Center needs to be paid off in full as much as possible, as long as there's funds coming in from the auditorium distri

I just had a comment before... I guess somebody made a motion already on this. We're still discussing. I want to be a no on this because, I mean, it never hurts to ask, but I want to be a no on this because I feel like they gave above and beyond.

So I'm just curious, where do you think these funds that are coming from the Auditorium District should be going?

I want the Civic Center to be done. I think it's important.

We had agreed to fund that. We talked about it for the last two years. So you'd rather have taxpayers than a hotel?

The way that was presented to us in the auditorium district, it included the Idaho Center, and I think it's fair that they are engaged in that as well.

Okay, I will do just a little argument because the Ford Idaho Center was not a done deal, which CWI, I think, is doing a wonderful job, but that was not a done deal when the auditorium district was passed.

What's the fund balance currently from the collections from the hotel revenues? I think $750,000.

Tell me the difference. Now I'm curious. So you're saying you have a balance. What's the total balance that you've received to date from the hotels total? I wasn't at the last meeting, so I'm going to ask her.

The balance I've been told, Morgan, you're correct. The balance I've told at this point in time is $1.1 million.

Has the, Ford Idaho Center made any requests up to this point? No, they have not. So the funds that are being requested really have only come from the Civic Center? That's correct. Okay, thank you.

Thank you guys for staying. Brian, I mean, and who else was out? We got Morgan and the whole crew, Mitch. Thanks, Jay. Okay, are we ready to go ahead and do a roll call?

Well, yes, as far as the request. I think we've got to visit this issue, though, as a city.

Mayor, can I ask for elaboration on... You asked for what? Asked for elaboration on what we need to address.

Oh, you think it might be better for another time?

Well, while it's hot on his mind, I'd like to hear his thoughts.

I'm looking for him a little bit here, but if he wants to elaborate, he certainly may.

No, I'm liable to say more bad stuff, so...

Okay, so we have two items for unfinished business.
