8:32 – 9:01•Eric Phillips

All right, good evening, everyone. Thank you for being here tonight. It is October 19th, 2026. It is 6.01 p.m. on Monday. I'm going to call tonight's Call to City Council meeting to order. And once again, welcome those joining us tonight. First on the agenda is going to be an invocation, which tonight will be offered by Richard Landauer. Did I say that correctly? All right, sir. Of His Story Church, which is located just across the creek. So with that, please stand for the invocation, and we'll follow that with the Pledge of Allegiance. And thank you.

9:50•Eric Phillips

Thank you, sir. We appreciate that invocation very much. I appreciate you guys being a part of our community. All right. Next on the agenda is roll call. Madam Clerk.

10:09 – 12:03•Eric Phillips

All right. Thank you, Madam Clerk. All council members are present. Next is conflict of interest declaration. Are there any members who have a conflict of interest to declare relating to anything on tonight's agenda? All right, seeing none, we're going to move on to special presentations. We'll start with annual report for Treasure Valley Community College. Madam Clerk just confirmed we did not hear back of their emails. OK. All right, moving on. Next is going to be a, and just FYI, they are supposed to have a annual presentation, so we'll probably have that on the next agenda once we reach ba

15:29•Eric Phillips

Any questions from counsel? Thank you. Next up, thank you, Jean, will be Sven Olson on ALPRs.

17:34•Eric Phillips

All right. Thank you. Can we hold it down, please? Thank you. Anything from Council?

17:39 – 18:01•Mike Dittenber

Mr. Mayor, I have a question for Mr. Olsen. Mr. Olsen, I appreciate your passion in this issue. Safety of our city is of utmost concern. If the city was to take a change in direction, would you be willing to support a permanent levy for the tune of about $5 million a year to support additional law enforcement officers?

18:06•Eric Phillips

Thank you. Anything else from council? Thank you, Sven. Oh, sorry. Council President Register.

18:11•Diana Register

Real quick. On the LPR cameras, I don't know if you can answer this or maybe the chief. Do they respond to calls?

18:32 – 19:06•Diana Register

I keep hearing that about the financial part of these cameras. and how if we get rid of them, we're going to have trouble with having to replace them for, I guess, patrol staff. And I think it's gotten a little bit muddy that the cameras are supposed to be tools. They're not police officers. So these are two different things. We can spend our money on police officers or we can spend our money on technology, but the technology is not doing the same job. Is that correct? Okay. I just wanted to be sure about that.

19:10 – 19:57•Eric Phillips

Thank you, council, president, register. Anything else from council? Thank you, sir. As always, those that participate in public input, thank you. Also, you can always reach out to us if you have any questions. You can contact the mayor's office, and we'll try and forward that information. Next on the agenda is approving the consent calendar. These are routine items that are grouped together to be approved in one motion. Unless a councilor moves for one or more of the items, to be removed from the consent calendar, considered separately. First, are there any motions to amend the consent calend

19:59 – 20:51•Eric Phillips

Thank you, Councillor Dittenberg. Motion from Councillor Stoddick, second from Councillor Dittenberg. All right, Madam Clerk. All right, that is unanimous, 6-0. The first agenda item under Old Business is an action item in public hearing for the case number VAC26-00003, which is a petition for vacation of right-of-way. This application will be rescheduled to a future date, and the hearing will not happen tonight for those that were here for that. The next under Old Business is a proposed ordinance permitting city councilors Request items to place on council meeting agenda the city attorney Our

23:54•Eric Phillips

Thank you. Any questions from council? Councillor Dittenberg.

23:58•Chris Allgood

Can you hear your light on first? It doesn't matter. Go ahead. Not in a hurry.

24:02 – 24:13•Mike Dittenber

Oscar, thank you very much. I appreciate the presentation. So in doing your research and looking out there, how many other cities around the valley do something similar?

24:41•Mike Dittenber

And the city has received this favorably. I mean, is there any grievances with adding this to their code?

25:12 – 26:09•Mike Dittenber

So I'm going to make a statement, and then I'm going to refer to a section in the ordinance here. And then I want you to kind of tell me what you think. So when we run for office, we make all these promises to the citizens. We're going to do this. And so this may then elevate the level of a commitment a city council member makes to their community and you combine that with the last sentence in statement three that says nothing in this section shall be construed to prohibit a council member from working with staff to draft agenda items supporting material prior to submitting a draft agenda for

27:07 – 27:19•Mike Dittenber

That's not the intent So basically the communication between city council members and staff is already occurring and so enacting this you don't see any sort of additional burden on staff I believe so.

27:19•Eric Phillips

Thank you Thank You councillor didn't burke else okay Thank You Oscar.

27:27 – 27:52•Chris Allgood

So and just I just wanted to expand on the removal or deferral so if there is something that comes up on the agenda and And some of the council members feel it's politically motivated, whatever, and want it removed. You're saying we could take a vote before we have the discussion to have that item removed? Is that the way you're interpreting that?

28:16•Eric Phillips

Anything else from council? Thank you, councilor. All good. Going once, going twice. All right. Do we have a motion for the ordinance?

28:34 – 28:59•Chris Allgood

Mr. Mayor. All right, Councilor Alcott. Were you going to go? I will move to approve Bill No. 50, Ordinance No. 3784, amending 020107 of the Caldwell City Code to establish guidelines for agenda-setting powers of the Mayor and Council with request to move it for this passage by title only and approve the summary for publication.

29:01 – 29:45•Eric Phillips

All right, that's a motion and a second. Any discussion? All right, seeing none, Madam Clerk. The motion carries, 6-0. Thank you. All right, the next, or the last item of old business, last meeting, Councilor Stoddick was on a trip, and he reached out and talked to, wanted to talk about cameras in the city, you know, he'd mentioned that it was a follow-up kind of from the Axon contract discussion. I know we had a brief conversation on cameras tonight. So, Councillor Stoddart. Thank you.

29:47 – 32:12•Chuck Stadick

Again, I apologize. I was out of state. I couldn't make the meeting, but I've only missed, I think that was the second one in nine years. So I've made just about every one of them. Anyway, I was a little concerned about the, uh, uh, some of the conversations that we had or that you folks had, uh, during the camera session. And one item, the first, there was a gentleman that got up and he was quoting scripture, which to me was just unconscionable because he definitely took it out of context relative to Psalm 51. You know, it talked about that's when David was on the run because King Saul wanted

32:13 – 32:33•Eric Phillips

Those cameras, I don't know when they were installed. They've been here for some time. I don't know if it was during DVCC, but there's several people who have access. I don't, but the police department, the real-time information center currently does have access. That was one of the things that we... brought up a while back where they were given all the public areas access to those, so they have those right now.

32:34 – 40:25•Chuck Stadick

Okay, so you didn't add any at all after you took office? I think that one, maybe. That one? Sorry, those are all different. Just the one? Yeah. Okay, all right. The other thing that crossed my mind, too, is all the people that are complaining about these scammers When you look at all the cameras that are in the department stores, the grocery stores, Amazon, Google, your cell phone, recently MapQuest, it doesn't seem like anybody complains about that one. They probably track the public closer than these cameras would. And again, it's just beyond me that nobody complains about that one. To me,

40:25•Eric Phillips

Mr. Mayor. I appreciate it Thank You councillor static Councilor Denver.

40:30 – 41:41•Mike Dittenber

Mr. Mayor, Councilor Stoddart, I appreciate your comments, but you said something that reminds me. You know, we just passed a resolution to get something on the agenda, so I'm thinking about my first item to get on the agenda. Can we get a map of this building and where all the cameras are in this building? I'm looking at you, Oscar, because I think you're the person that's going to review my request. Because I see one, two, three, four cameras in this salon. And I would suspect there's two or three out front. So that would put us at 7, 8, 9, 10. Outside would probably be 14 or 15. And the hal

41:45 – 42:28•Eric Phillips

All right, thank you, Councillor Dentonburg. Anything else from council? All right, moving on to new business. And we'll get that to you, Councilor Dittenberg. First agenda item under new business is discussing a possible e-bike ordinance. First we're going to hear from Parks and Rec Director, or sorry, Morgan, would you please come forward, or the both of you? And just so you know, this is something that we've been looking at for a little bit. I know Parks and Rec too, they'll talk about that. They've been discussing this too, and we did have an couple of incidents tonight that kind of really

44:11 – 44:27•Eric Phillips

That's really all I have other than... Any questions from council before we move on to our Parks and Rec director? Councillor Dittenberg? Oh, sorry. All right, thank you. Tiffany.

45:43 – 49:48•Geoff Williams

Thank you, Mr. Mayor. The Parks and Rec Commission, as Tiffany knows, has been having this conversation almost since their inception this year. And the admission, even in Parks and Rec, is an ordinance in and of itself is not going to necessarily make a difference. Just because you have a law doesn't mean everybody's going to follow it. We're walking in a fine line here, too, because in a state where it's not required to wear a helmet on a motorcycle, we don't want to require, and it doesn't. necessarily here. But we've got to be careful we don't infringe upon rights. But what I like about wha

49:48 – 50:07•Diana Register

Mr. Mayor Thank You council Williams councillor council president register Yeah, so Morgan I guess do you know if the police department was consulted when this was written Yes, they were could I could I ask you a cup just a couple questions about it.

50:11 – 50:48•Diana Register

Yeah, thank you. Very quick. It's my understanding that part of the reason this ordinance was coming into play was because the police department felt like they couldn't enforce anything because they didn't have anything to fall back on. Like if somebody was consistently unsafe or whatever it was that was going on that they didn't have a law basically to be able to refer back to. to be able to, I don't know, cite somebody's a good term or not. Is that accurate or are you, is the police department in support of this?

50:52•Diana Register

Okay, so this ordinance actually benefits the police department to be able to do some? It does. Okay, all right. I appreciate that. Thank you. Thank you.

51:01 – 51:41•Eric Phillips

And just for clarity real quick, thank you, Chief. We appreciate that and the police department for being an active part of this. This was first talked about in the Treasure Valley Partnership. mayors and commissioners all across treasure valley seeing these accidents play out and their police departments asking for the ability to yes you know punitive measures aren't going to always correct things but you know hopefully we start in this direction especially in combination with what you mentioned but that's where it originally came from i gave it to robin i mean development reach out to police

51:42 – 52:12•Diana Register

I just want to say that with these kinds of things, we're talking about tools and giving police departments tools. This is another example of a tool for a police department to be able to do what it is that they need to do. But I wouldn't do this and then discourage the education and everything else. I think they can sort of work simultaneously. And then if at some point we get to a point where Maybe this ordinance needs to be changed or modified. That would be something, too. But I do think we need to give the police department what they're asking for with this.

52:13 – 52:31•Eric Phillips

Absolutely. Thank you, Council President. And that's what our hope is, to get it passed sooner than later, because we know we have the monthly meetings and stuff. But also combine that. I'm absolutely in agreement with Council Williams on classes, training, and public awareness. And I thank the police department once again. Councilor Stoddart. Thank you, Mr. Mayor. I'm just curious.

52:32 – 53:00•Chuck Stadick

City of Eagle has been on top of this for some time and very critical of how they need to police is that did we do any Heading conversations with them at all on what they've come forward with on their ordinance the City of Eagle I'm not aware of if there was any communication with any other communities regarding this ordinance specifically since Robin was the one that did draft it and like I said, she did pull from

53:58 – 54:23•Chuck Stadick

We just want everybody to be aware of you know the boundaries Yeah, the reason I ask is they've received quite a bit of criticism on being a little bit too overreactive on this That's the reason I asked so I I like counselor Williams comments that you know we need to be proactive too and and come up with solutions that help everybody, not just police departments.

54:24 – 54:53•Eric Phillips

Thank you. Thank you, Councillor Stoddart. And that would be kind of the follow-up between Parks and Rec, police department teaming up and looking at some options in combination with the things that Councillor Williams mentioned. So I think we'll find the right healthy balance, but we want to make sure that we give our police that mechanism if there is issues going on out in the community, especially what we've seen lately. All right, are we interested in bringing that forward at a future meeting? Mr. Mayor, real quick.

54:53 – 55:09•Scott Tilmant

Councillor Tillman. Just had a quick question for legal. Has this been reviewed by you already? And quick question, has Justin reviewed this yet, considering we have him in our midst?

55:32•Scott Tilmant

So before we brought this forward, it would be thoroughly reviewed. That would be my only concern.

57:28•Scott Tilmant

Okay. Then I only had one other question that you might know or Chief might know. Do you know if Nampa has anything similar to this? Just for continuity across the city since we are so close.

57:41 – 57:55•Eric Phillips

We'll follow up, but that's the plan is everyone to kind of mirror that. Once again, that came from the Ada County starting to pass that, and then it's spread across the valley, especially because it's such a prolific issue and kids are getting hurt on them. Right.

57:56•Scott Tilmant

Just figured it would be nice if we had some continuity.

58:02•Eric Phillips

All right, so we don't have a meeting yet, but at a future meeting, unless council disagrees tonight, we'll look at a... Mr. Mayor, I have... Sorry, council, all good.

58:09 – 59:06•Chris Allgood

Go ahead. And I don't know whether the chief or his designee can answer this. Back in my day, there was an exemption if the vehicle you operated was less than 50 cc's, you weren't required to have a driver's license. At that time... Bikes and emotes were not an issue has the state updated the code To because I see a lot of juveniles riding emotes not pedal bikes. I see them on the sidewalks on the street Are we able to enforce that with a no driver's license? Okay, yeah that may be something we need I see a lot of kids on the emotes versions and and they're riding on the sidewalks and and they

59:09 – 59:39•Eric Phillips

We will, thank you, Councilor Allgood. We'll research that and get that back, that information back to you. Anything else? All right, thank you. Thank you for the staff tonight. Next on the agenda is a public hearing to consider conveyance of real property, commonly known as Usook Park, to the Canyon County Ambulance District for clarification. It's a part of the park, not the entire park. And with that, can we go ahead and move to staff?

1:00:59•Eric Phillips

Anything from council? Do we want to have Chief Cohen come up next?

1:01:05 – 1:01:35•Eric Phillips

I'm sorry, we'll have him for the public hearing. But yeah, we'll have him next. Any questions for the city attorney? All right, thank you. All right, now we're going to go and open up the public hearing. There was no one signed up to testify, but I imagine County Ambulance District Chief would like to come up. Sorry, paramedics. Thank you for being here tonight. It was very exciting. We've been working on this for a while. It's a great new addition, hopefully, to the south side of Caldwell. So without further ado.

1:02:14 – 1:02:43•Eric Phillips

process to build a station but step one obviously is to find the property and this is where we found something so we're excited to to move forward definitely council all right nothing from council thank you okay thank you and just to confirm there was no one else signed up so i'm going to go ahead and close the public hearing any questions from council this is the time or i'd entertain a motion mr mayor

1:03:35 – 1:03:58•Eric Phillips

Thank you for that additional information. And, yes, this is exciting for them to be able to collaborate. We do have a light tube that's going to go out on Ustick, so it'll be able to activate, I believe, for both when we get that signal up, just to warn folks it's a very busy road. Once again, we thank them for bringing this forward, and we look forward to the future on this. Councillor Tillman.

1:03:58 – 1:04:59•Scott Tilmant

This may be a question for legal or for chief. A couple of residents had come up to me and expressed an interest when we were talking about this. They had heard about it. Right now there's, looking at the detail of the map that's included with this in detail A, shows a notch out, but then it shows an easement access down at the bottom. What they're curious about is there are two handicapped parking spots and approximately 10 to 12 spots that run down that side. Now is that what that notch out is allowing for? And then we're only taking up a couple of those spots for like a easement ramp to get

1:05:15 – 1:05:26•Scott Tilmant

It's that side on Oregon. But there is going to be probably two or three that are taken up with a ramp for vehicle access along that back easement, correct? That should be all that's lost?

1:05:44 – 1:05:57•Scott Tilmant

Okay, and I'm just looking at what they show. If you see the orange easement access around the fire station, there's a small square that's sitting out on Oregon. I'm just wondering if that's going to be included in that ramp access to the backside.

1:06:28 – 1:06:40•Eric Phillips

Thank you, Councillor Tomah. Any other discussion? If not, do I have a motion? Councillor Allgood.

1:06:41 – 1:07:00•Chris Allgood

Mr. Mayor, I move to sponsor bill number 52, ordinance number 3785, transferring property to the Canyon County Ambulance District with a request to move for its passage by title only and approve the summary for publication. And again, This is a wonderful idea. I'm very glad it's happening.

1:07:02 – 1:07:40•Eric Phillips

Thank you for the motion, Councilor Allgood, and the second from Councilor Dentonburg. Any discussion on the motion? If not, Madam Clerk. All right, that motion carries. Congratulations. We're looking at a great new facility down the south side of Caldwell. It's very important, especially as our city continues to grow south and west. All right. Next item on the agenda, we'll consider a resolution authorizing engineering services for the design of a new dewatering facility at the wastewater treatment plant by Keller Associates Inc. for 4.5 million staff.

1:08:45•Chuck Stadick

Tony, will this cover future developments also? I mean, are we thinking ahead on what our capacities are going to be?

1:09:45•Eric Phillips

Thank you, Councilor Stoddick. Councilor Allgood.

1:09:48 – 1:10:09•Chris Allgood

Yeah, Tony. I know you've been working on this for several years, you and your staff, trying to determine what would be most appropriate there. And so my question is, like I said, I know you guys are experienced. You know what I'm talking about. You've been working on it for years. What is Keller going to do for us that you and your staff haven't done already? Because I know you've been on it a long time.

1:11:37•Eric Phillips

Thank you appreciate that Thank You councillor all good guns are Denver Thank You Tony.

1:11:43 – 1:12:17•Mike Dittenber

I appreciate the update. I did get to see the the dewatering plant a couple different times I think you have an old belt press and you brought in some new equipment that we went out and sampled a couple years ago But I think this also correct me if I'm wrong Not only is this saving us a considerable amount of money seventy eighty percent in the in the tonnage of stuff we're taking to the sewer. But it also keeps our drivers off the road and in the plant more. And it also saves wear and tear on equipment that we're using to push these biosolids around on the lot. Is that a correct statement?

1:12:18 – 1:12:31•Mike Dittenber

Okay. And then finally, don't we have a product then when we're done that is much more environmentally safe and usable in the community rather than being something that's hauled to the landfill?

1:13:59 – 1:14:17•Mike Dittenber

Mr. Mayor, one more question, if you will. So you talked about Maine. How many days storage capacity do we have at our current facility? If there was something similar with Canyon County landfill or Clay Peak landfill where they didn't take biosolids, how many days storage capacity do we have?

1:14:52 – 1:15:05•Eric Phillips

All right. Thank you, Councillor Dittmer. Anything else from Council? If not, do we have a motion? And thank you. Appreciate all the hard work you guys do out there. And if you haven't toured, please tour the facility. It's quite complex. Councillor Dittmer.

1:15:05 – 1:15:17•Mike Dittenber

Mr. Mayor, I make a motion that we approve the resolution authorizing engineering services for the design of a new sewer dewatering facility at the wastewater treatment plant by Keller and Associates for the amount of $4,446,670.

1:15:21 – 1:16:12•Eric Phillips

Thank you for the motion. Do I have a second? Second. Motion from Councillor Dittmer, second from Councillor Williams. Any discussion on that motion? Seeing none, Madam Clerk. All right, that motion carries six to zero. The next item under new business is an action item and public hearing for case number ZON26-00003, Applicant Orton Engineering on behalf of Prometheus Group LLC is requesting a rezone of an 18-acre parcel from C3 general commercial to C4 service commercial with a development agreement. There's going to be a public hearing. First, we're going to hear from the applicant or the re

1:26:22 – 1:26:40•Chuck Stadick

Councilor Stoddick. Mr. Mayor, question for legal. Oscar, if we make this change in this revision, will it open Pandora's box on all the other developments that we've had that have been applied for but haven't been approved yet?

1:27:36•Eric Phillips

Okay, thank you. Thanks. Thank you, Councillor Stoddick. All right, thank you. We'll hear from staff next. Thank you.

1:37:41 – 1:38:33•Eric Phillips

heard all public testimony um and thank you and i stand for questions thank you for that any questions from council all right thank you thank you all right next we're going to open up the public hearing besides our initial or mr orton um in favor there's jennica and monty do you wish to speak or just have signed up in favor just in favor okay All right. There is no neutral and there is no opposed. So with that, we're going to close the public hearing. All right. Any discussions from council? Councilor Williams.

1:38:33•Geoff Williams

Thank you, Mr. Mayor. Oscar, I want to come back to you about the D.A., We're learning that DAs don't have as much teeth as we thought they did. Is that fair to say?

1:39:46 – 1:40:36•Geoff Williams

And yet you saying that really feeds into my hesitation here, not knowing what could potentially be developed there. is the mystery. And once we approve a zone change, we're more or less committed to what would be included in that zone and within that DA when, if it's five or who knows, 10 years down the road, a lot changes, which is why our master plans change and which is why we're required to update them. And I can't tell you what USIC's going to look like in 10 years. We've been doing a lot of negotiation uh, with ITD about you stick. And so I'm really hesitant to make any change right now

1:40:38•Eric Phillips

Anything else from council? All right. Do we have a motion? Council.

1:40:45 – 1:41:12•Chris Allgood

Yeah. Um, Katie, you said, uh, a real mouthful with all of the different land uses and the different, some required SUPs, et cetera, et cetera, et cetera. If we were to make a motion on this, how do we include everything you said there to make sure that we have special use permits for a lot of this stuff that you mentioned?

1:41:48 – 1:42:25•Chris Allgood

Okay. And for legal? Thank you, Oscar. Going back to Councillor Williams' discussion, so planning and zoning has put in a number of things as far as the uses of this property. If we were to approve this with the direction that planning and zoning has given us, can we enforce those uses? Again, under Councilman Williams' discussion, are we going to end up five years down the road not being able to enforce that? Am I making sense there?

1:45:07 – 1:45:30•Geoff Williams

Mr. Mayor, the intensity is what concerns me. I don't know how intense I want to be on that Euston corridor, And frankly, we don't know who's going to own that property in three or four years, and they might come back to us with a request for a DA amendment, and that's where we get into a little less discretion. And that's why I'm hesitant and at this point not willing to approve it.

1:45:31•Eric Phillips

Councilor Williams, thank you. Council President Register.

1:45:35 – 1:46:04•Diana Register

I agree with Councilor Williams. I think this is kind of an odd place for such an intense zone Can I see the list of things that could be put there under C4 again? I don't suppose you have like a side by side or anything like that between what we can do now versus what we could do if it's approved? Or is that? Oh, sorry.

1:46:07 – 1:46:41•Diana Register

Oh. So you were talking about some of the more intense units or uses, I'm sorry, under the C4. And I was kind of trying to look through it. It was a different slide, I think, from this. And it had, maybe it was that slide, I don't know, like storage units, things like that. That was all stuff that I saw there.

1:48:09•Diana Register

Okay. Well, I still agree with Councilor Williams. It's kind of an odd place for any intense uses, especially for the amount of time. Thank you.

1:48:23 – 1:48:40•Eric Phillips

Anything else from council? All right. Would the applicant like to come up for a rebuttal? I'm going to open it back up. Just. legal spoke with the clerk and we're going to open it back up. I'm going to open the public here back up, do the amount of questions and give the applicant a chance for rebuttal.

1:51:49•Eric Phillips

All right, go ahead and close the hearing. Back up for any discussion. Council, Councilor Williams.

1:51:54 – 1:52:42•Geoff Williams

Yeah, I was just going to... respond we don't have to give a reason for a change of zone either if we choose not to do it because we don't think it's in the best interest of the city and I saw trucking terminals and parking lots and I saw things on that list that I don't want on Ustick and so to see them in there is what gives me pause and yeah things are changing pretty rapidly here with development agreements it seems like and so It would be easier for me to consider this request if I knew what was going in there. If I knew this is why we wanted the zone change so we could put this in there.

1:52:45•Eric Phillips

Anything else from council? Any further discussion? Do we have a motion?

1:55:12 – 1:55:50•Geoff Williams

So, Morgan, If the C3 is intended to be more commercial than industrial and this is opening the door for industrial then this does not fully comply with what our comp plan is. And because we don't know what might be there it could be incompatible. But once we approve a zone change to zone C4 that XPO trucking terminal could end up there and be consistent with zone four, I'm sorry, C4.

1:57:29 – 1:57:58•Geoff Williams

So to be clear, you're telling me that industrial is not included in this mixed use land? So what we're asking for in this zone change is to include industrial. And so I go back to this does not comply, this significantly doesn't comply with our comp plan as it is now.

1:58:25 – 1:58:39•Eric Phillips

Thank you, staff, and thank you, Councillor Williams. All right, are we ready to make a motion? Is continuance an option? What would Council like to do? Councillor Williams.

1:58:39 – 1:59:06•Geoff Williams

Mr. Mayor, I'll... This is action item number five, right? Six. Six. My apologies. I move to deny bill number 17, ordinance 3751 associated with NNN 26. Oh. Do I need glasses too, Councilman Stillmont? I move to deny bill 25, ordinance number 3759 associated with ZON 2603 with the request

1:59:15 – 2:00:34•Eric Phillips

A motion I'm sorry on the basis that it doesn't comply with our current comp plan for c3 designation Second all right a motion for a denial of the application request and a second any discussion Seeing none madam clerk All right, for those in the audience, that was a motion and a second for denial, and it carries six to zero. All right, the next item is an action item and a public hearing for case number ANN26-00003. Applicant John Evans on behalf of Nancy Patricia Todd is requesting annexation of a three-acre parcel to allow access to city water and no other development is planned for the sit

2:03:46 – 2:04:01•Eric Phillips

Thank you. And just for clarification, this is 3.03 acres. is located on the west side of 10th, approximately 2,260 feet north of the intersection with Karcher here in Colville. Thank you. Anything? Council? Council, all good.

2:04:02 – 2:04:13•Chris Allgood

Hey, John. Very good to see you, sir. Good to see you. So does Mrs. Todd want to connect immediately? Is that her desire, is to get all these connections as soon as they're available?

2:06:29•Eric Phillips

Thank you, Mr. Evans, and thank you for your service to your community. We do have wonderful staff. Speaking of staff, we'll bring our staff up next.

2:11:55•Eric Phillips

Thank you for that. Anything from council? Councilor Allgood.

2:12:01•Chris Allgood

So just get this to the point. So the applicant is just doing what we asked them to do. Counselor, all good.

2:12:13 – 2:12:35•Eric Phillips

Thank you for clarifying that. Counselor, all good. All right, nothing else from the council? We didn't have anyone to sign up, but I'm just going to open the public hearing real quick, and I'm going to close it. Obviously, Mr. Evans already spoke. Any questions from council or any motions? Councillor Dillman.

2:12:37 – 2:12:51•Scott Tilmant

Mr. Mayor, I move to sponsor bill number 17, ordinance number 3751 associated with ANN 26-3 with request to move for its passage by title only and approve the summary for publication.

2:12:52 – 2:13:34•Eric Phillips

Second. And a second. Any discussion on that motion? Madam Clerk? All right, that motion carries. Congratulations. All right, the next item is an action item in public hearing for case number ANN-260010, the applicant Josh Schroeder of Suminium. Is that the correct way to say it? Development Group, on behalf of Wild Oak LLC, is requesting an annexation with the development agreement

2:20:47•Eric Phillips

Thank you. Any questions? That's all good.

2:20:52 – 2:21:21•Chris Allgood

Yeah, just a quick question. I'm reading this, and I could be reading it wrong. I just want to make sure I understand. So in the development agreement, it says you want to get rid of the The conditional use that says you can't have Sunday events. Proposed operating hours are Sunday through Saturday, 10 a.m. to 11 p.m. with no outdoor music. But it says with no outdoor music on my packet. But it looks like you have a situation set up for outdoor events.

2:22:22•Chris Allgood

And for the benefit of our clerk, would you identify yourself, please?

2:22:32•Eric Phillips

Thank you, Councilor Allgood. All right, thank you. Staff.

2:28:40 – 2:28:53•Geoff Williams

Thank you, Mr. Mayor Garlin. Thank you. You're getting extra work tonight. Yes. This is interesting because we're not actually approving whether a wedding venue will be built here. It is being built here.

2:29:01 – 2:29:19•Geoff Williams

So it's annexation and our designation of what the zone would be in that annexation. This is very interesting to me. I guess I should have asked the applicant, maybe you know, are you currently on a well? Do you have any water solution? So you've currently dug a well for the site, but you want to access...

2:29:24 – 2:29:47•Geoff Williams

Yeah, this is really unique. And I'm really curious why we didn't get more public input. But again, it's already approved. Even if people were to come in and say, we're completely against having this in our backyard, if we deny the annexation, they continue to build.

2:30:22 – 2:30:40•Scott Tilmant

Thank you, Mr. Mayor. Two things real quick. Does staff have any problem with them building under county code? Is there going to be an issue between our code for their building and county's code?

2:31:12•Scott Tilmant

Okay, and that's only for the event building. The rest of any buildings or anything that's built would fall under us?

2:31:36•Scott Tilmant

Okay, and then my last question, Mr. Mayor, the 20-foot buffer... That's our requirement not the county's correct.

2:32:07•Eric Phillips

Tell me anything else from council Council president register.

2:32:12 – 2:32:42•Diana Register

Sorry just a quick question for Morgan. I Have some concerns about how close this is to a residential neighborhood in the noise that kind of thing However, I don't see anybody here to speak to that But I guess just my question for you, maybe this is going to be more curiosity They have a special use permit through the county to have a wedding venue here, correct? Once we, if we annex them, do they then have to get a special use permit through us?

2:33:25 – 2:33:49•Diana Register

Well, I, and I understand what you're saying and I guess I'm just trying to sort of wrap my brain around if we annex them and then all of a sudden we're in charge of that lot. So we, we could, I mean they could build a building and not have a wedding venue there right. They could put up a building and. They could still finish building their building but they don't have to have approval to have a wedding venue once we annex them. We're just adopting whatever the county had.

2:35:06 – 2:35:38•Diana Register

Well, the only thing that I saw in the packet was an email about the noise, um, from one person. And so I wish too that the public would come and speak so that we could hear more from the residents in that area, how they're going to be affected with this. But, um, Initially I was thinking about the Sunday one and maybe restricting the hours on Sunday But I'm not sure how much of a difference it makes if there's events all week long anyway, so I Don't know.

2:35:38 – 2:35:51•Chuck Stadick

Thank you Thank You council president register counselors thought it Thank You mr. Mayor so just to be clear They're gonna be charged for city services, but the property taxes go to the county is that correct?

2:36:08•Chuck Stadick

So did we ever have any conditions where somebody in the county wanted city services, we supplied them, but they still paid county taxes?

2:36:37 – 2:37:20•Eric Phillips

Okay, thank you. Thank you, Councilor Stoddart. All right, anything else? Give us just a second. Yeah All right, we're gonna move I didn't have anyone that signed up to speak for the clerk For but we're gonna go and open the public hearing Councilman give an opportunity to speak or just move forward Yes, mr. Mayor, I think you'd offer the applicant a chance for rebuttal yes again, but I don't know if applicant or

2:37:25•Eric Phillips

Yeah, go ahead and come forward. Thank you.

2:40:41 – 2:40:54•Eric Phillips

Thank you. Any questions from council? All right, we'll go ahead and close the public hearing. That was the rebuttal portion, and move on to council questions or motions.

2:41:01 – 2:41:56•Geoff Williams

This is, again, this is interesting because it's already being built, but it's commercial. We get to annex something commercial into the city, so having another commercial property on our tax rolls instead of the county's is the bad thing. As far as the Sunday, I was just thinking if this was a church going in there, Sundays would be louder than it would be if they were indoor and I know how loud churches can be. So I don't even see a problem with the two bicycle request unless we expect the entire bridal party to be riding their bicycles in. Just two of them. Venue that could I don't know do

2:41:56 – 2:42:28•Mike Dittenber

I was going to say the same thing we either annex them into the city and we their taxpayer dollars into the city or we let them have a venue in the county and Pay their taxes to the county so I think this is a good thing the other thing that this brings up too is If I'm reading this map right this is a property that is completely surrounded by city property and this is a single enclave that has not been annexed and this is a

2:42:30 – 2:42:50•Eric Phillips

Reason why we ought to be looking more seriously about enclaves and what they offer so Which is infill and that's a good good point made councillor didn't were just a clarification They'll still pay county taxes, but also be paying city taxes, correct?

2:42:50 – 2:43:18•Mike Dittenber

Mr. Mayor councillor Denver I Sponsored bill number 24 ordinance number 35 37 58 associated with annexation 26 zero zero zero zero one zero With request to move by its passage by title only and approve the summary for publication some motion from councillor Denver Second and this is for approval for clarity and a second from councillor Williams any discussion on the motion Seeing none madam clerk

2:43:27 – 2:43:40•Eric Phillips

Congratulations. I wish this had been around when I got married. It looks like a wonderful facility you're going to have. And I could almost ride my bike there. Maybe it's the grooms who want to ride the bikes.

2:44:13•Eric Phillips

All right. Okay. Do we have a motion for that?

2:44:51•Mike Dittenber

Then I'll make a motion that we annex, approve the annexation of ANN 26-03. Second.

2:44:59•Eric Phillips

Motion for approval of annexation. And a second by Councillor Tillmont. Any discussion on that motion? Yes.

2:45:22 – 2:45:42•Eric Phillips

Madam Clerk. All right, that motion carries. Thank you. And the other housecleaning item for... Mr. Mayor. Item number nine?

2:45:45•Eric Phillips

Mr. Mayor. It's going to be item number 10?

2:45:49•Scott Tilmant

Number nine, I move to approve ANN 26-10. Second.

2:45:56 – 2:46:42•Eric Phillips

Our motion and a second. Motion from Councilor Tillman, second from Councilor Williams. Any discussion? Seeing none, Madam Clerk. All right, that motion carries. Congratulations. Bicycle rides could be a thing, I'm telling you. Next item on the agenda is a public hearing to consider adopting the city of Caldwell historic Preservation plan that was recently completed by Logan Simpson I Mean a long time Good evening Morgan visa.

2:54:35 – 2:55:16•Eric Phillips

Thank you, and you made some good points, especially talking about preserving Caldwell, right? We have so many great things here. Obviously, we have a lot of new stuff, but in our downtown core, down to the college and other areas, Very important things that we want to make sure that we do preserve. And thank you all for your service. The city is volunteer work, but it's much appreciated. And couldn't do it without folks like yourself. So thank you. And working with our staff, obviously. Anything from council? All right. Entertain a motion.

2:55:18 – 2:56:15•Geoff Williams

I was going to say Councilman Dittenberg and I serve as liaisons on this commission, and I'm really thankful to Chairwoman Bradshaw and her team who do some really behind-the-scenes work so that things aren't forgotten and things are covered. They do things that we might not think to do, And I appreciate you bringing this to us and all of the contributions that you make. And so having said that, if there are no other comments, I move that we approve the plan. Here we are. Adopt the City of Caldwell Historic Preservation Plan that is presented to us

2:56:16 – 2:56:59•Mike Dittenber

Historic Preservation Commission second a motion to adopt the plan in a second council Williams and councillor Denver any discussion I'd like to echo councillor Williams sentiment I think if we didn't have this historic Commission we would look back and go what happened to our city and what happened to the things that we take for granted. And we get to watch the commission from month to month address those issues that help preserve the rich history of this city. And so I appreciate the work that you do on the historic commission.

2:57:01 – 2:57:38•Eric Phillips

Any further discussion? I think we all echo those words. So thank you for all the hard work, and I appreciated the meeting we had together. Madam Clerk. All right, that motion carries. Thank you for being here tonight. Next item on the agenda is considering ordinance dissolving the downtown decorative local improvement district LID 24-1.

2:57:47 – 2:58:06•Mike Dittenber

Mr. Mayor, I guess I don't have any problem with the local improvement district going away, but do we have somebody who can give us a summary? Did it run its course? Is it out of time? Is there no more interest in it? Are we not decorating the downtown? Why are we letting it expire?

2:59:05 – 2:59:21•Mike Dittenber

I sponsor ordinance... 37 85 bill 51 dissolving the downtown decorative local improvement district LID 24-1 With request with request to move for its passage by title only and approve the summary for publication.

2:59:21 – 3:00:01•Eric Phillips

That's a motion Second and a second from councillor Tillman any discussion on that motion Seeing none madam clerk And just for clarification, this is to dissolve the downtown decorative local improvement district, LID 24-1, and that motion carries. All right, the next agenda items are two annexations, items number 13 and 14, into the Colwell Municipal Irrigation District, including Chestnut Heights Subdivision Phase 2 and Cedars Subdivision Phase 5. Do we have a motion for any questions?

3:00:08 – 3:00:33•Chris Allgood

I move the sponsor ordinance number 3787, bill number 53, annexation of Chestnut Heights subdivision, phase 2, and ordinance number 3788, bill number 54, annexation of Cedars subdivision, phase 5, into the Cobble Municipal Irrigation District with a request to move for its passage by title only and approve the summary for publication. 3:01:56 – 3:04:36•Geoff Williams

Thank you, Mr. Mayor. Yeah, I've got a handful of things here today, but I'll try to make them brief. First of all, shout out to Officer Preston Rock of the Caldwell Police Department. The High Desert Harley Davidson and Learn to Ride at High Desert presented Preston with second place in an event he competed in. He only lost to his instructor. And I told him that was probably a smart thing to do, but he's, I think, one of our newest motor officers. And it's kind of fun to see Caldwell showing up in positive ways. And like I said, shout out to Officer Rock. Fire Department really needs kudos. T

3:04:39•Geoff Williams

Okay. Have it your way. But it's nice to see us being recognized for the positive and a lot of good things to recognize in Caldwell. Thank you, Mr. Mayor.

3:04:50 – 3:05:20•Eric Phillips

Thank you that and just clarification we will I'm going to text our social media and public information Group and get that out because that is very good information, especially as people are looking I'm sure to make space Also, there's Facebook marketplace and other things in case you have any value to that, but Thank You councillor Williams We'll get that information counts are all good Not to be redundant, but it is time to vote again Lots of important stuff on the ballot, please take the time to go vote and

3:05:21 – 3:05:32•Chris Allgood

I always vote early voting. It's so much easier than waiting for the polls to open on the 3rd. I just encourage everybody to vote and take part in your community.

3:05:34 – 3:05:52•Eric Phillips

100%. Thank you, Councilor Allgood. I believe there's even a Saturday early voting. Yeah. Yeah. So for those that are very busy during the week, early voting is amazing here in Canyon County. They've done a wonderful job. including a Saturday. So thank you for bringing that up. Councillor Denver.

3:05:52 – 3:07:41•Mike Dittenber

Uh, thank you, Mr. Mayor. Uh, just a couple of things, uh, for those of you attended, uh, this last weekend's event on the Plaza Freedom Brewfest. Uh, thank you very much for, uh, supporting our veterans. Uh, the veterans, uh, do, uh, the veterans hall does a good job in our community and, uh, they deserve whatever support that we can give them to make sure their doors are open. Uh, Also, kudos to the fire department. Every time I drive down Fifth Street, that building that they're building over there is beautiful. Not only is it a beautiful building, but it also looks like it would match some

3:07:42 – 3:11:57•Eric Phillips

avoid interfering with last year's Winter in Wonderland and in turn it turned around and interfered with this year's so we had a pretty energetic meeting with LTAC expressing our concerns on behalf of not just our own sanity but all the downtown businesses and the community because you're right it has taken for some time and that's a challenge where those type of projects are a little bit out of our control but luckily when you have the title of mayor you can whoever's in that position right can go have a conversation and Try to be as collaborative, but very insistent that we need this done in

3:12:03•Scott Tilmant

I move that we enter into executive session pursuant to Idaho Code 74-2061B and D. Second.

3:12:11 – 3:12:29•Eric Phillips

Motion and a second. Madam Clerk. Council President signed out, but motion carries. We are in executive session.
