on real estate facilities and housing will convene. Clerk will call the roll.
Here, pursuant to the open meeting law, any person may make an audio or video recording of this public meeting or may transmit the meeting through any medium. Attendees are therefore advised that such recordings or transmissions being made, whether perceived or unperceived by those present and are deemed acknowledged and permissible. We have one individual who signed up for citizens input, which is number one. If you would like to come down to the table, state your name and address for the record.
Okay, well, I will say in response that I'll go on the record saying I had no idea that you were coming tonight or going to speak on this. Because ironically, it was one of the things I was going to bring up tonight. I have the information from the CDA, the book here, and we will be discussing this topic. So with that, thank you.
Number two on the agenda, minutes from March 12th, 2026. Motion to approve. All in favor? Aye. Any opposed? Motion passes. Number three is a resolution to convene with the administration, directors of the operations, to present a definitive action plan for the repair of the Pearl Street and Third Street parking garages, which was tabled on March 12th, 2026. Motion to lift from the table.
All in favor? Aye. Any opposed? Passes, unanimous. Now, I know there's been things that have changed along the way since this resolution was written. However, anyone who has related to the parking garages, please come down at this time. State your names and addresses.
Thank you all for being here. I think first perhaps we'll discuss the Third Street garages because I know that they're in the process of being repaired. I guess we just want information as to where are you in the project, what's the projected end date, and any other pertinent information surrounding the repair of that garage.
Any councilors have questions before, like Councilor Kadeem?
Thank you. So can we just talk about the delay? So the initial, I guess the initial project schedule, well, we didn't see the project schedule. I guess you communicated that it was September originally, right? So we have a slip of three months now? Right now. When did you receive that notification?
So what do we I guess in in terms of operational so originally and I forget I don't know if it was the March 12th meeting or one of the meetings that predates that I I got notes I just don't have the day on this one so we had mentioned that the garage we're going to the garage the 3rd Street garage was going to remain open so that's completely closed it is completely closed okay so what what's the financial impact of the project itself and So I know we've got folks not that were in the third street main level, right? Street grade parking. That's now on the street. So can we just talk about wha
So you had to find 206. Correct. Correct. All city employees. So then 50, you're saying 50 were in the garage that moved over to the street level?
So we displaced 50 employees? 58. 58 from that location?
Are we still charging the employees that were displaced?
And the employees are paying the same amount, or are they seeing a reduced rate?
So the three month delay, so you're saying December, we're through, that's the substantial completion or? Unfortunately, yes. So what's the impact with regards to the parking so that?
Do you know what those are off the top of your head? Yes.
So when, when did you start having conversations with people incorporated and why they deny us the, uh, the lot space?
So last Tuesday was is that the first time we were notified that the project was slipped to the end of the summer.
I guess I'm not trying to make an issue out of it, but if we're communicating internally, right, I guess when I hear somebody saying we're communicating internally, we've got weekly meetings. and then you're telling me that you just found out last Tuesday about December and we knew about that.
When did you find out about the December slippage?
So you found out last Tuesday or two weeks ago?
How often are you having project meetings with the, who is it, Tyenbon, who's doing the work?
So you're doing weekly meetings with the OPM and Tyenbon?
So what's the contract read in terms of liquidated damages? Do we know?
Yeah, I'm just curious, you know, from the OPM is fine with this slippage. To me, it's just strange. You came in, you did a feasibility study coming in and I get a parking garage it's a renovation when you start chipping away you're going to find some stuff but i don't know that i've ever been on a program where you you're starting to see a slip every single month without any people anybody pushing back saying hey let's i think that's a fair point from what i understand part of the problem is when they've done their assessment work through the x-rays and everything the spots they've found have
My issue and my concern is the sense of urgency associated with this building itself, right? So when you start talking about building projects and liquidated damages, you can't just start throwing $500 or whatever the liquidated damages is for that amount part of the contract just to say because they've slipped on the days. You've got to prove that there's expenses associated with it. I argue, right, and I think we would all agree that we're losing revenue because we've got individuals who are being displaced and we've got meters that are being tagged. So I'm just curious to how much revenue w
So let me just ask one question. Are we being aggressive in terms of the project management? I think so. That's my question. Absolutely. Because it's one thing to just rely on the OPM and the... the architect to hold the GC accountable, but then if you've got the architect who hasn't, you know, was supposed to do this x-rays, I don't know what the scope of service was for time, right? So I'd be curious to see what that scope of service read, and to your point, and I take you at face value, you know, when we start saying that, you know, they wouldn't have known reasonably, right? Okay, I'm assu
My question to you is, based on the agreement we had with tie and bond, we gave them a scope of service. Did they fulfill the scope of service that we expected them to do in terms of the X ring, whether they got a third party contractor to go in there? Did they do at the locations that we were looking to get them to do? Is it the pillars? Is it the overheads? I know nothing about parking garages. Right. I know nothing about the mesh that goes in there. I know there's rebar. I know none of that works. I'm not a professional in that. That's why we rely on those folks. I just want to make sure th
And I recognize that. And I can appreciate that. I'm just curious to what the liquid damage liquidated damages number is to begin with number one right and right off the as a minimum we should know what the impact is for a three-month slippage right that that should have been expressed to the contract the gc the architect and the opm in terms of every month that we have a slippage right and i don't know what the lead time is for rebar or whatever it is and then and i know the cement is readily available but If the lead time's there and a delay on rebar and it's a one for one and that's just go
But one of the one of the other what do you do you know how much we're losing a month?
I'll work with Stephanie to make sure that never asked that question.
But I don't that should be right off the top of your head every time you're going into a construction meeting with the GC and the designer and the OPM every month is costing the city of Fall River X amount of dollars. You should have that you should be memorized by now. I don't understand why we don't have those numbers.
So explain that to me. So I'm not following. So who is not being responsive to the city and then is it costing us more money?
And then when, how many days would you estimate that was, I would say probably about a week and a half or so. Okay, so we'll start looking at liquided a liquid data damages, time bonds on the hook for at least a week and a half for not being responsive. I hope we got that documented.
Okay. So that's my expectation as one city councilor, right? So every project that comes before us, we should know what the liquid data damages are. We should be managing these projects, and we should understand that while it's not on money, it is the taxpayer money. This is what we're here for, right? It is on money.
That's just the expectation that I have in terms of managing projects and delays. And I fully understand that there are going to be slippages in project schedules for unforeseens. But, you know, when you start getting to three months, you know, it's... No, this is substantial.
Yeah, there's not much more I can add to what Councillor Cadine brought up, but I guess maybe just going back a little bit, Al, to March, where you had the meeting. Unfortunately, I couldn't make it, but I did read the minutes, and I was just curious. And it might have been already suggested or talked about, discussed. So you went out so much then you then went out to bid for like, was it in April, you sent the for the like, see, my concern is what, what I first saw in this one, when what you were saying, was the the x ray part of this. And, you know, I think we're talking about the third part
Yeah. And so I guess my I'm upset about the fact is that that wasn't picked up, the issues with the x-ray and the rebar and the concrete and the structural problems that they were causing. They found them, but it didn't happen before the whole project took place.
the issues as you, like you said, as we went along, we found more problems with it. And again, I'm not laying any of the, I'm just curious about how that happens, and for a project like this, now it's delayed, Um, until, until December and council could deem again, brought up a good point about, um, you know, what, what is the actual, uh, you know, uh, deficit we're facing, uh, as far as revenue goes and the fact that we're, um, displacing, uh, we had to displace 208 folks. Uh, 10 people went to people link 16, went to the Belmont 10 hit, uh, 10 have already been denied by people link for the
The chamber, okay. And maybe I missed it, but did they accept the extension? Yes, they have. And the others that you said are getting tagged for the meters?
Right. But I guess, and I think you're right, Mr. Thomas, saying that we're not going to know what the damages are until probably all this is over as far as what we're going to get. And I know that that's going to be caught up with insurance folks, because I sold insurance way back, and I know how long it can take. But I'm just upset about the fact that we didn't know going into it. And, you know, like a surgeon. Before they do any kind of surgery on anything, on a person or whatever, here we are on a parking garage, which is very important to the city and to us. that we didn't know the exact
And just say, just hypothetically, which I don't like to do, what if? What if it does? What if it does go beyond December?
And just so, Stephanie, you said that what happens if, like I want to know, what are the thoughts about that if nothing, if we don't get it done by December 31st?
Okay, but what are we thinking internally about that?
Give me some some kind of concerns about off street parking. That's what you're talking about.
Okay, right. Yeah, right. I think I think there's more to it.
So we're in just one other thing. Again, I'll end it with this. But it just also goes back to where, you know, sometimes like Gateway cities like us have a bad rap about with our own projects and how we can't get them up and running and get it done quick enough. And this is just like another example of it. And I'm not trying to be unfair to everyone, no one here at all, but it's still, that happens a lot in gateway cities like ourselves.
Oh, I'm not talking about this. No, so I mean, it does happen.
I'm just saying it just, it just happens to just go happens like that. It's just I've been here long enough to see it, where it just it does it occurs more often than in like, you know, in the private sector. That's all. So I yield. Thank you.
Thank you. So in the statement where you you mentioned that the top level, they found out that that was more severe than we anticipated. That level was completely closed, right? So we knew that was the biggest issue.
But that's what I'm struggling with. Right. So if you told me that you are now x raying, you know, the first level on the second level, and you're not finding, you're now finding things that you didn't anticipate, to tell me you're finding things on the third level, when we had that shutdown, when we I mean, building Commissioner came here and told us he thought it was going to be it was going to collapse several times public safety issues, right? Like, so it's just hard for me to wrap my head around around that. So two final questions. So we can move on, because I know there's other things th
I guess my only recommendation, and Attorney Thomas just mentioned this, that we want the project to be... in a situation where we're not going to have to deal with this in a month or two months later. So when you start talking about value engineering, I can understand value engineering when you're going out for construction documents and you say, you know what, I don't want this type of flooring. I want a different type of flooring. I can understand that. But when you're talking about a parking garage, which is solely concrete, meshing, rebar, waterproofing, I'm struggling to figure out what
But that's not what we called for. So I guess, you know, you represented it. We're still on the budget, right? So that would mean if you came to me saying we're still on the budget, that means we're getting everything that we specced out.
Yeah, I don't understand the bargaining chip. There's no bargaining chip. The bargaining chip is that we want the parking garage the way we scoped it out.
All right. So if you're going to get that, if we can figure out exactly what the cost impact is going to be over the three months with the unexpected changes. If you can get us the initial project schedule that was submitted and then the update, I guess all the updated project schedules. I'm not sure how often they give you an updated. I know you should have at least two, right, the initial and then an updated schedule, if you can get that to the council. I'd appreciate that.
Okay, just a quick follow-up because we do have things. So, Mr. Hathaway,
Oh, reality is reality, and we need to face reality.
So when we get to that point and they say the project's substantially complete, we want to get paid, we say no, you're not getting paid until it's complete because it's not where it should be and where we want it to be. Is that close?
Or until the insurance is settled as well.
okay just a quick question go ahead so i know i'm portuguese but i don't do any cement stone work uh pouring cement and cold weathers you can do it it's a different mix to do it i defer to columbus they have cold weather they have cold weather and they have blankets and we there will be a time and date that we'll we'll have to say we can't go any further but at this point they've done pours into january so so i guess that's why i'm a little concerned so the december we No concerns with that, and I guess the quality of the cement for cold weather cement versus... Quality is the same.
No, but that creates the need for the cold weather cement. I asked the question, I already knew the answer.
i yelled i'm sorry okay um again conversations in my head yeah we have two other things we want to get to and we're very very limited so i guess um at this point what i'm going to say is we're not going to do you do our usual and wait six months for to be updated so we'll have a another meeting sooner than later to get answers and to discuss this further because i recommend mid-november think that's a good recommendation so yeah so i guess we can say that's a reasonable time frame a month from now that you should have more answers we should be closer to uh being able to answer all the question
All in favor? Aye. None opposed? I know some of you are gonna stay at the table because we are going to, number four is a resolution to convene to discuss all city-owned real estate. Under all tonight is going to be the Bank Street Armory and the administration building. So this was tabled on March 12th. Motion to lift from the table was made. Seconded. All in favor? Aye. Any opposed? No one opposed. If I could ask, we'll talk about the Bank Street Armory first. If I could ask the two to come down.
Can we turn AC on? It is hot. Man, I feel like I'm gonna pass out.
So I guess I'm going to, oh, so if you can identify yourselves, I'm sorry for the record.
Thank you. So I'm just going to preface this with a few months ago we met. We discussed a lot of issues. One was temporary heat for the building, which I'd love to know if anything has been discussed, looked at, if we've considered it, and where we are. Winter is coming. So that's going to be on the table tonight to discuss. But I'd like to know, first of all, where the historical commission is with this building, the grant, et cetera. Has the grant money been bought?
And what are we hoping to find out from this study? Because I know there's different types of studies, obviously. I know one was, you know, best use of the building could be involved in the study, etc. So exactly what, I guess we go to what is the scope of this particular funding?
Oh, you actually have in front of you, $283,000 from CPC. When was that issued? Do you know on the 283 for?
Yeah, and at our last meeting, that subject came up, and we asked then that, please, get that done and get that vegetation off that building. So that would be, and that's something coming up tonight. What are we doing? When is it going to be done? I mean...
So I guess the reason I asked, and what $85,000 was for the feasibility study?
So not to delay the process. So again, the concern is we're talking about FY 26, we're in 27. You're talking October 13th to get a feasibility just to have a discussion. We were talking about vegetation that is now looking like full-grown trees that are coming out of the side of the Bank Street Omri. So we talked about a spring clean-out March 12th to 26th. Not sure where that is. So if we can just get an update on where this all stands. And I'd actually like an update on all municipal building projects. and the timeline where we are. I'm just getting a little frustrated. It seems like every p
whim of grant funding applications and i recognize that it's not just for the bank street armory but i we had a conversation that we don't want it to be another police station right so we want to keep this we want to come up with a a plan for this but if we don't take care of it in the meantime at least the minimum of weather proofing it keeping it with temporary heat and all that other stuff we're going to have another police station on our hands so um i just not satisfied with the turnaround time on our project so you know the expectation needs to be a little bit more aggressive in terms of
No, not really. I just maybe, so, After the vote was turned down for that developer to take over, Alex, and maybe, Rick, you can answer the question, there was a meeting, I think I was in the ordinance committee, and I think the past chairman talked about that there would be a barrage of grants and federal funding that we were going to receive on the historical part, on your side of it, and that the repairs to that particular building be happening quickly. But it doesn't seem to, it hasn't seemed to have happened. I'm just curious what, and I know it's difficult.
I get it. It takes a lot from our side as well. And this is definitely a partnership. It just hurts me to see that building not up to where it was and where I remember it and where everybody remembers it. I get it. But I, it just, you know, we turned down, uh, these developers and I get why I understand why we do it. Um, but we wouldn't have had this problem. It'd be, it'd be different, much different than what, probably what the public would, some folks want to use it for. And if they want to use it for public use, I'm all for that too. There's just, like Councillor Kadim just said, it's almo
It would make too much sense for us to do that.
Yeah. So I guess what I'm going to say is, so at our last meeting, we requested, please get us the information we need. Tell us how much it's going to cost for temporary heating. Tell me which type of temporary heating you might be using. Get the vegetation done. And here we are a few months later, and it's the same conversation we had a few months ago. So I will say, this is going to get tabled. This is going to be put on the next agenda in one month. And in one month, we're going to want to know. It's fine to say you need funding. How much? What? And that's the point. We asked. And you were
Can I just add one thing? Sure. You folks can leave. Just for the list, can we just get an update on Center Fire Station? Yes, thank you. So construction documents were supposed to be completed in April, and if you'd just update us. We don't need to talk about it today. I can brief you. Yeah, just an email. Okay.
So I would accept a motion to table on this item at the moment.
Yeah, that's true. It's under the same category. Okay, now I do want to touch on the school administration building. um i did bring with me this actually dates back to 2021. um historic preservation applicant was ken pacheco from the school department the amount awarded was 220 000 the project description secure an existing condition survey repair the four chimneys from roof penetration to termination and begin the design and restoration of the 78 windows of this historic structure so this goes all the way back and if you look i didn't bring my glasses and this is the fine print so i'm going t
Okay, so how are we gonna get confirmation and get everybody on the same page? Because apparently that's a problem.
Is there a lead time on the windows, and when do we have this conversation? This goes back to 2021 again. Here we are. I wasn't far off about six or seven years for projects.
And is there a reason why we can't work collaboratively with the school committee? Like why wouldn't we attend?
yeah listen i i think we're all on the same page everybody wants those windows replaced so i don't understand why it takes six years to replace windows right so the average situation so so the average citizen that wants to replace their windows in their home i know they're not waiting six years if they've got funding for it so what i know is that the plan that was initially put in counselor that they did not have the funds for the cost
So what does $280,000 cover? Just the purchase of the windows? Does it have anything to do with installation?
Okay, well, third time today. We'll be back in a month.
We'll be back in a month. But we have procured the windows. So the windows, 78 windows have been placed on order. Using CPA money? CPC funds. Okay.
and we get the proper extension so that the money stays in place.
Motion to table. Seconded. Everybody in favor? Aye. Aye. Motion to adjourn?
Motion to adjourn. Second. Second. All in favor?
Aye. Committee on real estate facilities and housing is adjourned. Thank you, everybody.
As far as city council, public hearing will now be called to order. It is 6-10 on Tuesday, October 13th. Madam Clerk, roll call, please.
Councilor Kamara is not going to be joining us. He did have a commitment this evening. He's not going to be attending this meeting tonight. Pursuant to the open meeting, Laura, any person may make an audio or video recording of this public meeting or may transmit the meeting through any medium. Attendees are therefore advised that such recordings or transmissions are being made, whether perceived or unperceived by those present, and are deemed acknowledged and permissible. Motion to open the public hearings has been made by Councilor Raposo, seconded by Councilor Cannula. All those in favor? A
Thank you, attorney. So I know, calling all other proponents wishing to speak. Hearing none, calling all opponents wishing to speak on this item. Calling all opponents? Hearing none. Item number two, Ryan Rechmini of 293 Linden Street, Farver, Mass., doing business as Knight's Quality Service Station Co. for a license to operate an auto repair shop license at 260 Linden Street on lot M26-46 in the assessor's plan. Calling all proponents? Hearing none, calling all opponents? Hearing none, item three, curb removal. Fall River Armory, Massachusetts Military Division, the National Guard, Commonwea
Pursuant to the open meeting Lauren a person make an audio or video recording of this public meeting or may transmit the meeting through any medium attendees are therefore advised that such recordings or transmissions of being made whether perceived run perceived by those present in a deemed acknowledge and permissible. We do have citizens input before us tonight, but before I go to citizens input, Councillor Pereira, do you have a resolution? No. Councillor Peckham, I'm sorry. Councillor Peckham, would you like to come up, or do you want to stay there? Okay, yeah, no problem. The floor is yours, Councillor.
Do you want to recognize the citation for us? Let me go ahead with it. Okay. I had a neighbor, he moved a couple of years ago, a young man named Mason. And the reason for the city citation is he came up to me a few years ago with the idea of a dog park at the location of the old Kennedy Park pool. And fast forward a few years, I took Mason on a tour of the government center. Yeah, much better, thank you.
The drive in this young man is unbelievable. If we had more young kids this age in an era where a lot of our crime in the city is being committed by juveniles, we need more kids like Mason. So I recognize Mason with the city citation just for that reason. Don't give up because you have my support with the dog park. I think that's a wonderful idea. I know the mayor probably hasn't written you back, but join the club. So I will reach out to him to see what's going on. With that being said, I would like to recognize Mason, the City of Fall River, Massachusetts City Council official citation. Be i
Oh, please don't. Next item on our agenda is citizens input. Going to sign up a number of individuals did sign up to speak. First person to sign up to speak, Todd, I think it's Chalpero, if I say that correct? Salpietro. Salpietro of 397 South Main Street, Fall River. This is regarding drug use on South Main Street. If you can just, you can sit right there and just face the council. You have three minutes. This one? Yeah, you can face them. Yep.
And it's a 24-hour issue. Thank you. Councillor in seat six, Councillor Peckham.
Thank you, Council President. I want to thank you. Your business is a huge asset to the city. My daughter, when she was younger, bought a trumpet from you guys. And you've been here. You dedicated your business here, which we scream for all the time. We want people to do that. I can tell you that I've been in constant communication recently with the chief. And I obviously can't say publicly what the conversation was, but there is, I call it a T, and it's South Main Street, and it runs all the way up to the rail trail behind Walmart. And that seems to be one of our biggest issues is I don't wan
DJ, I have also talked to the chief and he was sending cops out there consistently to keep checking. I had talked to Al Alvarez about it. And one of the problems is that people will go in to Seven Hills to get stuff and then they don't leave. I also talked to Nikki Fontaine, because what I was told was Seven Hills is responsible for people when they're in the building, not when they're outside of the building. And Nikki Fontaine said she knew the people that ran that, that she would talk to them. They can't hang around there after. And if you go behind Seven Hills building or behind Alvaro's,
I mean, I think it's a balance because you want to try to help people. But at the same time, you don't want to enable people. And I feel Fall River has lots of services for people. And sometimes I wonder, are we enabling people where they're not hitting rock bottom to get the help that they need?
I know it's even gone down further, even towards the library, there's been problems there, to the point that Jerry Donovan, who owns property down there, has offered to give the police department one of his storefronts where they could just stop in and out, and they would have a location there so that they could better circulate the whole South Main, North Main area. So it's not like people aren't working on things. They're inundated.
Especially there. You have a lot of young people that are going to learn how to sing. It's young children. And parents are afraid. I don't blame them. But thanks for coming down and sharing that, TJ. Thank you.
Next person to sign up to speak is Seth Aiken, 641 Gardner's Neck Road, Swansea, regarding... uh the harm reduction and crime laws or motion away second made by council of cannula seconded by council of peckham discussion all those in favor opposed the eyes have it mistaken thank you good evening
Um, motion away of the rules has been made by council of Kadeem seconded by council of can you all those in favor? I pose the eyes habit.
Good evening. Good evening, sir. One question I have is, who's paying for these things?
Not that I know of. Okay, because I had asked that question during council council canyons meeting, and I was told that no money goes to the harm reduction through the city. But like Council Deon just said, indirectly, it's all tax money. Total disagreement with it. Council forever just said she wonders if we're enabling. We might as well shoot it for him. just can't i can't we got so many issues and it's we actually feed the fire um this needs to end we got diabetics that can't afford their medication but we're giving out stuff for people to shoot dope make that make sense to me i appreciate
Yeah, so my two questions are, the first one is, so I feel like some of this, again, I'm not an attorney, but in the legal world, that a lot of this may lend itself to intent. Would that be an accurate question or statement? And intent can make a difference.
So then I guess I'll follow that up with my other question being, in the bags that STAR hands out, not only do they provide everything you need, short of the narcotic, of course, they also provide, if you don't know as a person how to do it, They provide step-by-step instructions on how to use everything in that bag and administer an illegal substance to yourself. Now, to me, that pushes it into the end zone.
Yeah, two. Here you go. If you can read, this is how you do it. That's right. To me, that's just, I don't know. The first time I ever heard about that, and that was months ago, that just floored me. Me too. So, yeah. So I would like to think legally there's something we can do. Because, you know, I get it. There was a time when people who had addictions were demonized. And no, they shouldn't have been demonized. But like everything else, the pendulum swings. You go from here on the continuum to here. And when you get to here is where we become very lenient. I don't think that's helping anybody
Thank you, Constance. Seven consular prayer.
I look at this in a bit of a different way. I agree that, you know, the grant is to supply people with clean syringes so that they don't get sick or get hepatitis. But again, I wonder if that's enabling or really assisting. What really gets me mad when I found out about this, I called some of the locations, Star, Stepping Stone, Seven Hills, the Diabetes Association. You're giving somebody 12 syringes. You can't return them. Where are you going to return them? Some places you can return between certain hours. You think they're returning them? They're not returning them. They're all over the ci
In seat one, Counselor Kadeem. Thank you. So, Attorney Aiken, I appreciate all the information that was given to us. I think it's useful information. I do just want to say, aside from what you're stating, everybody's outrage on these harm reduction bags is mind boggling to me because When it was brought to my attention and then in the forever reporter, I said to myself, we've had conversations about harm reduction bags in the city of in council meetings, right at subcommittee meetings. And there has been nobody with outrage. I disagree with them wholeheartedly. So forever love for a civic net
Yeah, my colleague wants to speak, but I just want to remind everybody we're in citizen's input, and we do have a resolution on our agenda which we could deliberate tonight, but Councilor in seat seven, Councilor Perez.
I just want to add on to what Councilor Kadeem said about the money that was appropriated, and at one point when, I think career number two, when Jaisal Correa was mayor, We had purchased, or the city had purchased, or through some grant or through that funding, machines that we had. I want to say Globe Street and Flint, or maybe it was the North End, two fire stations that had these machines. You could bring back your needles, they'd melt them down, and then you could dispose of them, even if somebody was a diabetic and had syringes. But all of a sudden, those machines, I heard that they brok
Maybe we should invite the DA's office as well.
With that idea. Thank you, Mr. President.
Thank you very much, Mr. Aiken. I appreciate your time. Next person to sign up to speak is Ryan Duarte. The address given is USA. If you could just have your address for the record, Mr. Duarte. And before we do, there will be a motion to waive the rules.
So made motion to waive the rules has been made by Council of Peckham. Is there a second second second by Council or opposed? There was a discussion on the on the on the motion to waive the rules. Hearing none. All those in favor. Opposed. Council in seat three. Roll call on roll call, please.
This is a motion to waive the rules to allow him to speak. Oh, yes, yes.
There's no motion to waive the rules failed. Mr. Duarte, the roles of the council are if you're out of the city, there needs to be a motion to waive the rules and the council needs to allow you to speak. And unfortunately, that did not happen. You can certainly continue to send letters and emails to us, but that was the will of the body.
Topic is drug use and bags. Motion to waive the rules. Motion to waive the rules have been made by Councillor Peckham. Is there a second? Second. Seconded by Councillor Rapposo. All those in favor? Aye. Opposed? The ayes have it.
Next person to sign up to speak is Jennifer Dutra of 91 Greenleaf Street, Fall River, regarding safety concerns on Arruda's Lane.
I just say if they were supposed to get an answer within 30 days, that the council send a letter to the administration, to the law department, to the engineer, planner, that they come together, have a meeting, and let us know an update on this within two weeks by our next meeting. They've had 30 days. Let them come up with what it is. You can't tell people you're going to do something in a certain amount of time and you don't do it.
Madam Clerk, has this got out of committee yet? Council Vice President?
Yeah, so Public Works did have the meeting, and you were in attendance, I believe, at that meeting. Yes, yes. It's there that they said to give them the 30 days for, it was the city engineer and the legal department to come together and form some decision. They were supposed to give their response back to the chair of Public Works, who would schedule a subsequent meeting. That's where it was left that night.
Madam Vice President, are you give you yielded the floor. Yes, OK. Thank you. Council and C3 consulate Daniel.
Thank you. As you know, I was at that meeting. I'm a member of that committee. I did pull the transcript. They did say 30 to 45 days. I know you want to be on the low end of that. We are still within the range that they provided to you. So I just did want to clarify that that it was 30 to 45 days. I do have the transcript here.
So what was the 30 days for? What are they looking at? This has been months. So this just didn't go to public works. This was in my committee for months. There's been hundreds of emails, literally, phone calls. I've been down there with the media. What are they figuring out? Did they tell you what they need to figure out?
Yeah, well, this has been months, literally. I couldn't get anybody to talk about it for the first month or two, but I was working with you guys. It's kicking the can down the road. That's what this is. And ultimately, I want to apologize to you and your neighborhood for this. And the reason for that is you guys are the victims of political favors. That's what I was told, that that road was done for political favors for decades. And one day, the mayor woke up and said, I'm done doing political favors, and he left you guys stranded. That's not right. We had the fire department down there, what,
We're in citizen's input. Let's just get to the bottom.
I was told by Ann, the mayor, and everybody that I've talked to that it was a political favor for a political party that lived on the water. If you know it differently, you've been around for 30 years.
Please tell me. Let's respect each other. I do respect her.
She's got comments while I'm talking. She needs to respect me.
Understood. Counselor, you still have a floor.
Counselor, it's time to retire. With that said, we need to move this forward. I'm sick of talking about it. What committee does it go to next? So, Council President, I would like an answer by tomorrow from the administration as to what is going on with this, where it sits, and exactly where it stands. Because if we don't, we're going to be here in three months talking about the same issues.
Councilor Peckham is requesting through hopefully an acknowledgment of a colleague or so to get an answer tomorrow. Madam Clerk, if you could please send a communication tomorrow to our Corporation Council, Copy Councilor Peckham, and members of the Council, hopefully we can get an answer.
Thank you. Add Corporation Council Rumsey to that list of people that told me this was a political favor. Public record, please. Understood. Thank you, Council. You yield? I yield.
Mr. President, did you say the entire Council? If not, can you make sure the chair of the committee has cc'd on that? Yes.
Which would be Council of Camara. We'll make sure that we copy Council of Camara on this as well. Thank you, Mr. Chair.
Real quick. I mean, I've been contacting you guys periodically. Yes. Last time I think I talked to you was like a week and a half ago. And it's, you know, we still do have time, but I'm, I'm a little worried about it, too. I really am. But I'm not going to give up. So and I know everybody here won't. But I'll, again, I'll be in touch with you guys very shortly.
Next person to sign up to speak is Mike O'Regan, FD 1314, regarding the fire department. Mr. O'Regan, as you just come down, if you just state your address or the address in full room for the record, please.
1198 Newhall Street, Fall River. Thank you. Mr. O'Regan, thank you. Thank you.
Next item on our agenda. Somebody raise their hand. Thank you. Next item on our agenda is a resolution for the capital improvement plan to be approved by the city council was referred in March. And before us, council has questions. It was pretty much here. It would be just a cleanup item at this point. We can hold discussion. We don't need a referral at all. Any questions? No. I know you had a lengthy discussion to our Vice President in our Real Estate and Facilities Committee. So I know a lot of this was discussed. It was a very thorough meeting. So I don't know if the Councils have any quest
Yeah, just out of curiosity, has there been any amendments to the Capital Improvement Plan since? Because I know we had discussed in public safety regarding the fire department looking at proper equipment and what have you. So I think since it was originally written to now, we've had a few discussions of things that the council was looking to get added or modified. So maybe some update on that would be great.
Please introduce yourself for the record.
Okay. That makes sense. I yield. Thank you. Anything further? No? Thank you.
Item number three, transfers and appropriations. Mr. Oliver, thank you. Any questions on transfers and appropriations? Hearing none, is there a motion?
OK. I yield. Thank you. Thank you. Anything further?
The committee on finance has been made by council repos of seconded by council of Peckham.
All those in favor, I oppose the ice habit.
We're gonna roll right into full council. What time is it? 7 10 Chelsea. As far of a city council meeting will now be called to order. The time is 7 10 on Tuesday, October 13th. Madam clerk, roll call please.
Here. If everybody in the chamber can please rise for a moment of silent prayer, and I'd like to acknowledge Councilor Cannual.
Thank you, Mr. President. If we could just have tonight's moment of silence for Mario Luciola, who served almost two decades on the Fort River Planning Board and the Fort River Conservation Commission.
Thank you, Councilor. Thank you. And a salute to the flag.
I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.
Pursuant to the open meeting, Laura, any person may make an audio or video recording of this public meeting or may transmit the meeting through any medium. Attendees are therefore advised that such recordings or transmissions are being made whether perceived or unperceived by those present and are deemed acknowledged and permissible for the record. Councilor Kamara did inform us this afternoon that he will not be able to make it this evening to our council meeting as indicated prior to the meeting. Madam Clerk, good evening.

Motion to adopt has been made by Councilor Hart. Is there a second? Seconded by Councilor Pereira. Is there discussion? Councilor in seat 3, Councilor Canuel.
Thank you. I want to start by saying that I support housing development in Fall River. We need investment and we need more housing options and I want to see these projects succeed. But I also believe that we have a responsibility to make sure these agreements deliver the greatest possible benefit to our residents. When we consider TIF and TIE agreements, we should be looking at more than just the development itself. We should be asking what the city is giving up in tax revenue and what our community is getting in return. All three agreements before us tonight follow the same structure. An 80%
Thank you, Councilman. Seat 1, Councilor Kadeem.
Thank you. I appreciate my colleague and C3's comments. I whole highly support them with regarding the affordable housing. I actually filed the resolution, I think it was like 2025, to have the administration come down before us to start discussing affordable housing and putting a mandate that at least 10 to 20% would be affordable housing for new development as we move forward. So we haven't had any conversation about that. So resolution was filed. It's just sitting in the lost files. And so I don't disagree. I think we need to revisit that. I think there's some significant conversations that
Thank you, anything further? There's a motion on the floor to adopt. The resolution has been made and seconded. Hearing no further discussions, roll call please.

so the administration reached out to me and while they are also going to be doing a presentation if they haven't done so already before the real estate committee there is a number of questions because they're we're trying to understand the pro forma the financial impact on it i know counselors including myself have a number of questions about what makes sense if it does make sense to sell it and whatnot so um the chief the city administrator reached out to me maybe about a week ago and asked that the full council have the ability to get a full presentation on The entire project the performers

So just for clarification, do they already have a proposed amendment to send to Ordinance at this point?
sorry for the record uh this would be for the uh committee on ordinance not finance that i just said so no i said it okay so the motion is to refer to the committee on ordinance has been made and seconded the discussion council reposal what was your question just a clarification do you have already proposed ordinance to put in front of us or we have to wait for the meeting to see it I have no idea.
Okay. Through you, Mr. President, to the clerk, can we get a clarification? Because obviously, as the chairman of ordinance, I'd like to see it before we actually have a meeting. So if we can get some clarification on that, that would be great. I yield.
Anything further? Hearing none, motion to refer to the Committee on Ordinances and Legislation has been made and seconded. All those in favor? Aye. Opposed? The ayes have it.

Thank you, Madam Vice President. So first I want to say to my esteemed colleague, who I care about very much in C1, who made a comment during citizens input that we needed to pay better attention to what is being said and what is discussed before us. And I agree with him. I need to pay better attention. But there's one thing I got to say that I wasn't fully aware of up until last week when a former reporter approached me and had a discussion about what's in the harm reduction bags. And our council vice president spoke when Ms. Buchanan was here several months ago about what's going down on the
This is a sterocup. Sterocup. A cooker. A cooker. Oh, that's a cooker. It's a cooker. It comes in the kit. come up with the upgraded package. Now I find out today, full disclosure, and I'm sorry if my presentation isn't right because I'm learning a lot about this, but I'm totally flabbergasted when the reporter came to my office and said, are you aware of what's going on? And I says, I'm absolutely not. And truthfully, shame on me if we talked about this and I wasn't listening. I gotta do better, but we all have to do better, but this has to stop. How under any circumstance does a human being
Can I just ask a question while he's going on? Sure. Do they ask for your ID, any information, anything?
No. No. You can go get a bag. So just to be clear, for the record, I didn't go get bag number two because the person I sent to get bag number one was asked the question, what do you need it for? And they were, I don't know. But you have like two kits. You can have the all, you know, whatever you're smoking kit, and then you have the cleanup kit. And I just can't even believe that you can walk into a place on South Main Street when you've got people like TJ's Music and Alvaro's and all these businesses down there and you can get all of this for free.
I'm sorry, I don't mean to keep interrupting you, but so you walked into Seven Hills, there was no conversation about the type of drugs you use, what you need, any...
I didn't walk into Seven Hills. I sent somebody to Seven Hills because, I mean, if I showed up, they're probably going to know who I am, I'm going to probably have a hard time... I would have gave you both bags, to be honest. But here's what needs to happen.
No, I'm just curious, and the reason I ask, I'm just curious if there's any follow-up with additional... So for my state, I don't know, it's one thing to give the bags. But if you're also trying to give them some additional services, right, so mental health services, or any type of rehab services, I'm just curious if that follows the
two bags yeah and here's the thing i have questions i think we all have questions right because none of this makes any complete sense to me in all under any way shape or form it doesn't make any sense so i don't know if they check anybody in i don't know what they ask for questions i don't know and i don't think anybody knows what kind of follow-through they have all i know is i can walk down the street on south main street and i can get crack pipes for free OK, I could get things to cut it up and then put it in my nose for free. And I got questions. And for anybody who doesn't have questions
Is there anything that you want before he puts that up?
I'm just kidding. He didn't go to the place that gives the instructions.
I didn't go, and to be clear, Madam Vice President, I did try calling STAR. I did leave a message with their executive office. This was late on Friday. It was a long weekend. To their respects, they have not called me back. I'm sure that they will. But I didn't, this isn't just about Seven Hills, right? No. This is about finding out what is going on everywhere. And if this council can act, and I'm talking about, I'm not talking about like piddly fines.
if the ordinance committee has to meet if we're not satisfied with the answers let's go let's let's let's have some strict laws and regulations that are followed and given to our police department to get out there and do and i would like to add so months back when i spoke on it i saw the contents of a bag somebody called me said listen i went and i got a bag i'm afraid to bring it to city council because i'll probably get arrested because i'm a law-abiding citizen but i want you to see it I drove to their house, they came out, showed me the contents of the bag, and I was just as flabbergasted
It's ironic that we're talking about these bags. I know that when Helen Regal told me about it, she was out of her mind. But somebody called me just yesterday, because this had been on the news, that they're having a puff and paint party where you can go and smoke your marijuana or smoke whatever you want to smoke. And you're going to puff and paint, and liquor will be for sale. But I thought that you couldn't just go to an establishment like that. And that's going to be happening in Fall River again on some place on South Main Street. But I thought that that was not legal.
Yeah, there's no social. Well, but it was it was on they showed me the they sent me the puffin and paint.
Well, then I suggest we send the invitation to the police department so that they can go be there that night.
We'll drop in. We'll ignore the puff piece.
I don't know what they're painting. But it was a puff and paint. And you had to buy your own liquor. I've heard of restaurants, you bring your own booze, you bring a bottle of wine. But I didn't even know you could buy liquor from someone. up just something else you know not if they don't have a liquor license to sell you well yeah exactly so i was like i have no idea who's doing this with that i yield uh councilman thank you so i appreciate my colleague with the follow-through on the resolution i think it's you know a conversation needs to take place um i don't know that my mind's going to be
rush to judgment, we should probably have a conversation with the organizations that are providing these bags and trying to get a better understanding of what the intent is, right? So if there's wraparound services, then I think we need to have those conversations. And I just think we've got to be careful how, like if we're coming hot out of the box, Seven Hills is not going to show up, right? There's no incentive for them to show up and we can do what we're going to do. Apparently, we've already got statutes that would say that that's against the law. What I would say, and anybody who has kid
I'm just curious how they allow you, and that's part of the conversation I want to have, just to walk in, grab a bag without any information. And maybe they know if you ask for information, they're not going to go in there. But I think at some point, there's got to be an exchange to be able to help that individual with some type of services. without a yield.
Yeah, well, thank you for bringing this up tonight. I know it's been out there before, and there's really not much more I have to add than what Councilman C-1 just said. But yeah, I would find it pretty, just being in the social service uh, industry for the past 22, 23 years, I would be very alarmed if that, if you're just allowed to go in there and get all that, there's gotta be some kind of, uh, recommendation from some social service agency to these particular, but you're doubting that there's not, there's nothing that's, that's a problem. Uh, that's a very big problem. Um, so yeah, I, I ca
Thank you, councillor. You yield? I yield, yeah. Thank you. Council in seat seven, councillor Pereira.
I know that they didn't ask for name or whatever, but I'm really surprised you wouldn't even ask for an ID for somebody's age. So does that mean somebody 17 or 16 could go in? if they you know look a little bit older like not even an age requirement I don't know I just kind of concerning they could be giving them out to younger people with that I yield thank you anything further Council and C3 consulate annual
Thank you. The only thing I want to add, half the stuff I saw there is stuff I've seen in homeless encampments that have been cleaned up and things like that. I didn't know what half of those were, but the quantity specifically of the needles that they're handing out in one bag that you can go back and get tomorrow, that explains a lot that I see from these cleanups. And that's all I want to add.
Thank you, Councilman. Seat 1, Council of King.
I just don't want to, I'm not trying to take away from the issue, right? But that bag you presented, you could probably buy, with the exception of the needles, right? The needles are separate. Everything you just presented, you could probably get for $3 at the local store, right? So if you're a homeless person who's just a panhandler, you can get that in two minutes, walk to a store, and get a glass tube, a charboi, baking soda, matches. You can all get that with short money, right? I recognize that giving it out for free is not one thing, but it's not like it's going to cost them $50 at Stop
Anything further? No. The resolution has been made and adopted. There are no further discussions. All those in favor? Aye. Opposed? The ayes have it.

The only one that I have a question on is 23, the armory with all of the curb removal that they want. Does anybody know why they need that? I thought they were looking at closing that place, and now are they going to be doing something else there?
Just for the rehab? Just for the rehab? Okay.
Motion to take items 21 through 24 together has been made and seconded. All those in favor? Aye. Opposed? The ayes have it. Is there a motion to adopt? Thank you. Um, Mr. President, um, a lot of calls, a lot of people wondering when this is going to resume. It was, uh, listed as a temporary suspension of services. And I've had discussions with the health department and I've had discussions with the veterans department and I don't see this getting restored in the time that it should be. So I'd like to get them to, uh, the committee I chair to discuss this further and establish what are those barriers so that we can move forward and get this going again. A lot of people depend on this.
Thank you. Thank you. You yield? I yield. Thank you for the resolution. Councilman, seat four. Council Vice President Dionne.
So just a little bit of background here first. Or actually, let me comment first. I find this completely, completely unnecessary, ridiculous. It's always our vulnerable populations that get kicked to the curb. There's no reason for a veteran, an elderly person, or somebody who isn't capable of getting themselves to a grocery store or medical appointment to not have that option. The background would be prior to the VSO that we have now, before he got here, I had found out that at the time, one of the trucks they were using to transport had over 200,000 miles on it. It wasn't dependable anymore.
Thank you. Councillor in seat seven, Councillor Pereira, followed by Councillor in seat six.
I would ask if that vehicle is registered, the van, and if it has gotten the lettering on it that it was supposed to get. Because the tires were flat from it just sitting there and nobody using it. They were supposed to be lettering it. Is it lettered yet?
I didn't notice if it was lettered. I was there one more word about the condition and no, there were no flat tires. It is ready to go. Just waiting to be driven.
And they do have drivers. And the other driver that they had said he would come back as soon as you let him know what the hours were going to be because they kept switching hours. But I have been inundated with calls from veterans and from seniors waiting to get to a grocery store and not being able to. I mean, I don't want to bring everybody, but I have had to give a couple of people a ride because I felt bad. They had no way to get there. It's no excuse. But it was a good resolution to file, Council. Ken, you'll appreciate it. With that, I yield.
Thank you. Councilor in seat six, Councilor Peckham.
I wasn't on the council, but I had heard a rumor. Didn't we accept two vehicles from the Bristol County Sheriff's Office as a donation for our Veterans Service Department? Does anybody recall that?
It is my understanding that we did from when Sheriff Hodgson was sheriff. Yeah.
Madam Clerk, can we find out where those vehicles are? I would like to know. I would like to see the donations slip from the Bristol County Sheriff's Office to the City of Fall River, and then I would like to see where those vehicles ended up afterwards. Because we're sitting here talking about vehicles and rides. You know what this is? A lack of leadership, like I keep saying over and over again. How this man can sit upstairs on the sixth floor and know that his elderly and his veterans aren't getting rides to the supermarket? I mean, is that leading with heart? Is that what we call it? We're
i can't volunteer to drive a car how about the mayor on the sixth floor can he come down and drive the vehicle to bring these veterans and seniors to their appointments grocery stores i don't know maybe the sherries in the morning one of the two he can probably bring him somewhere to eat Can I tell you? No, I'm talking.
Councillor in seat six has the floor. Go ahead.
I just wanted to clarify something you said.
Yeah, it's fine. One of my biggest pet peeves is being cut off, and I think that's quite apparent at this point. Go ahead.
So while I'm talking, just keep your mouth shut. I was giving him a point of order. Sorry, he doesn't take point of orders.
Yeah, I don't need a point of order. I take point of orders all the time. Let's just let Councillor finish, please.
With that being said, I want to know what the bans are. Understood. I yield. Thank you.
Thank you. Councillor in seat eight, Councillor Raposo.
So I applaud my colleague to file the resolution. And just for the council edification, at the next council meeting, I did file a resolution as well. Because I think there is a problem with the program overall. I mean, the whole scope of the situation that we do need to look in. But I do agree with Council Canyal. The groceries situation is probably the immediate thing that needs to be addressed. But then I think the ordinance committee will look at the program as a whole to see what can be modified and changed and improved. I yield.
I'm going to give a point of order, even though the point of order wasn't given. What I was going to say.
You have to, in order to say point of, hold on. In order for you to get a point of order, you have to say point of order. I did say point of order. You were interrupting the counselor, and it got messy.
Well, I didn't want him to be upset. I said, do you mind if I give a point of order? Don't tell me I don't give you point of orders. He didn't want to give a point of order.
All right. He doesn't give point of orders.
Well, but I wanted to ask permission to give a point of order, because he seems to be touchy tonight. That's all. The point of order that I wanted to give is the fact that some of the drivers... Councillor Pereira has the floor. SOME OF THE DRIVERS, ONE OF THE CONCERNS WERE THAT BECAUSE THE DRIVERS WERE NOT CITY EMPLOYEES, WE WERE NOT COVERED LIABILITY-WISE, WHICH I DON'T UNDERSTAND BECAUSE YOU CAN 1099 THEM OR MAYBE YOU CAN EVEN HAVE THEM AS PART-TIME EMPLOYEES WHERE YOU DON'T HAVE TO PAY EVERYTHING AND THEY WOULD BE COVERED BY US. but that was one of the rationales of why they stopped it, be
Consular in seat four, Council Vice President Deon.
No, I was just gonna reiterate that the problem isn't lack of vehicles, that's the sad part. And it isn't lack of money, it's lack of drivers for whatever reason. And I just find it deplorable that, how long has this been shut down now? A month? For about a month. A month. In a month, you don't even advertise for somebody to drive? So that was just simply, we don't have drivers, oh well, end the program, we'll see you in what, what did they say, January 1st? That's ridiculous. It's inexcusable, it's ridiculous. Hire whoever you need to hire. I don't care if it's part-time 1099, if it's full-ti
Anything further, Councilman Seedate, Councilor Raposo?
Yeah, I guess my, it's kind of a rhetorical question, I guess, but there was a social media post, I think it was in the Council of Aging, that was looking for emergency volunteers to run the program, and I guess my greater question is that we don't know what came of that, but... there's a whole question of liability i'm completely confused about um which i think needs to be clarified so i don't know mr president through you to the clerk can we just get an update where we're at with this program as a whole council just just an update because i think it happened it's been announced and we know n
