We'll call to meeting the June 19th, 2026 meeting of Charlotte City Council. And we will start with welcome to all of you. Welcome to folks who are here in chambers and folks who are joining us online. And then we'll move to introductions. And we'll start over here to my left, audience's right, with Councilmember Masuera-Arias.

Good evening. My name is JD Masuera-Arias, proudly representing East Charlotte District 5.

Good evening, Luana Mayfield, serving you at large.

Allison Craig, Deputy City Manager. Dante Anderson, District 1. Joy Mayo, representing District 3. Good evening, I'm Victoria Watlington, and I have the pleasure of serving you as a member at large. Hi, Sean.

Thank you all, and we will begin our meeting with an invocation, expressions of inspiration, followed by the Pledge of Allegiance. The invocation by Councilmember is intended to solemnize our proceedings. We celebrate the religious diversity of our community, including those without a religious faith. Tonight, Councilmember Graham will give our invocation. Councilmember Graham.

Thank you, Mr. Mayor. Let us pray. Eternal God, we come before you tonight not just as elected officials, but as servants of a city we love, a city that is hurting, a city that is searching, a city that deserves better and is capable of better. We ask tonight for wisdom, wisdom to lead with clarity when the path is unclear, to preach truth when it's uncomfortable, and to act with courage when courage is what this moment demands. We ask for healing for a community shaken by the loss of a four-year-old child stolen from his bedroom by senseless gun violence. We ask for integrity in our police de

Please join us in the Pledge of Allegiance.

I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.

Before we get started, I wanted to... note an unfortunate incident involving one of our sister cities, just for tonight, just to have them in our hearts. Our French sister city, Limoges, suffered a fire over the weekend, destroying its historic city hall completely. We acknowledge this loss and share best wishes for the strength and perseverance of the leaders and people of Limoges in this time of recovery and restoration. Thank you, and now we will continue with the zoning process. The rezoning process begins with applications submitted to planning staff for review. There are two types of cas

Thank you, Chair Wilton. That takes us to deferrals and withdrawals. Looking at the agenda, are there any deferrals or withdrawings on the agenda? And I'll turn it over to planning staff, Holly Kramer, who will read through the list of requested deferrals and withdrawals, if any.

Thank you. So we have three items with requests to defer and one item, item 9. The request to withdraw, is there a motion to defer or withdraw those petitions?

Is there any discussion? All in favor of permitting withdrawal and deferral of those petitions, please raise your hand. Any opposed, please raise your hand. That passes and those are withdrawn in one case and deferred in the other cases. All right, that takes us to the consent agenda, to decisions and the consent agenda. Rezoning petition rezoning petitions items number three through number eight of the consent agenda may be considered in one motion except for those items pulled by a council member please note that these petitions meet the following criteria number one they had no public oppos

Are there any other consent items that council members would like to pull? May I have a motion to approve the following petitions which are. Items number three, four, five, six, and eight that are in the consent agenda will exclude item seven and to adopt the zoning committee statement of consistency for each of these petitions as they appear in our agendas and as the council's own.

Are there any discussion? All right, all in favor, please raise your hand. Any opposed? All right, the motion passes and the consent items except for number seven passed. And now may I have a motion to approve the item that is number seven and to adopt the zoning committee statement of consistency for this petition as it appears in our agenda and on the screen as the council's own. Is there a motion? Okay, discussion and I'll turn it over to Council Member Mayo.

Yes, I'd like to have a member of CDOT come up, please, to talk about number seven and the resolution regarding this. So I'm sure many of us remember last month I was very concerned about our putting a charging station at this location for electric vehicles and the fact that there are no working streetlights at that forest point. drive and there have not. I don't know how long it's been since they've been there, but I know I have made the city aware of that for over a year and a half. So if you could just give a timeline of what we've talked about just so the rest of Council is aware and we're

So just letting my colleagues know that I have, I'm sorry, worked with CDOT extensively as well as our city attorney's office to ensure that there is working street lights at this site. This is something I was very concerned about, particularly as we've had, this would be the third rezoning in that area in three years. So the fact that our team had not noticed that previously was a disappointment. So I hope that we'll be more thoughtful in the future.

Thank you, Council Member Mayo. Council Member Esmir.

Thank you, Mayor Harrington. This one is for the specific use of EV charging stations, is that correct?

So it's not conditioned to just EV charging. So let's say if they were to turn around and in a few years convert it to a gas station, could they?

So they're not putting it explicitly just for EV charging station as part of the conditions. It's all right. Okay. I I think that's where Madam, I mean, Mayor Harrington, we need to separate this out because, and I know, I think it was Monica who sent us the memo on EV charging. And you know, what, what concerns me is that it, EV charging station is not the same as gas station. And we should understand whether our current ordinance creates unnecessary barriers to investment while still protecting our neighborhoods, especially for EV. I don't know how we are preventing EV charging stations just

Thank you. I just want to go back, if I can, to where Councilmember Mayo had started us. Is there a way that I could get some clarity on the areas of the city that are in line for this conversion to solar? I know that we had had a project over the summer, I think, where people were being trained to install those. So I think there is some planning and some intentionality. It was very good work by Councilmember Mayo to be able to To highlight the fact that this was a situation that was lacking in streetlights, I must say, when I've approved things in District 6, I have no knowledge, unless I've

Thank you. And I just want to thank Council Member Mayo. I had not thought to include that in my thought process, particularly around retail uses and appreciating whether we're putting people at greater risk. So thank you. You're welcome.

Thank you, Council Member Owens. Is there any other council member who would like to be heard on this or have questions? All right, hearing no further discussion, there has been a motion and a second in discussion to adopt the zoning committee's statement of consistency for item number seven, which is petition 2026-041 by Owl Services, and adopt the zoning committee's statement of consistency for this petition as it appears in our agendas and on the screen as the council's own. All in favor, please raise your hand. Any opposed? It passes unanimously. That takes us to public hearings. And from

Okay, this is 13, so we've got up here. So there is one person speaking in opposition, so there will be 10 minutes for, 10 minutes opposed. I see Mr. Hall, and I'll now turn it over to the staff. Good evening.

Thank you, Mr. Murray. Mr. Hall. Ten minutes.

Council Member Mayo, question for Mr. Hall. No? Okay. Thank you, Mr. Hall. Thank you. Any response from Mr. Murray?

Thank you, Mr. Murray. Questions, comments from council? Council Member Mayo.

Can we have a member of Stormwater come up? I sent counsel an email Friday about this it's my understanding that there are eight properties that are affected by the stormwater issue and that Charlotte waters requested a permanent easement that you all have confirmation from seven out of the eight property owners for that easement agreement and that we have one who is kind of an outlier. But can you recap this for us, please?

Can you tell us the importance of why this easement, a permanent easement, is needed versus a temporary easement, please?

How much would you say this project would cost Charlotte Water or Stormwater?

Thank you. Council member Mayo council member Mayfield and Owens.

Thank you, mayor. So just a follow-up stormwater has identified the challenges that was noted by the resident.

So you're not able to move forward with the seven to at least create some. Correct. It's critical we get all eight. So it's all or nothing. And in the meantime, staff is comfortable approving the development of another residential property when it has already been identified that eight residential properties are having stormwater challenges.

So with the stormwater piece separate question for you.

So according to our standard, what is the maximum size that could go on a lot of this size? if it were a single family development?

So I will say I have concern and I shared a concern of my colleague. If we already have stormwater issues over there, approving another residential project to go in the area where we are already having challenges that we have not identified a way to address. I have concerns with, I look forward to you all continuing to work together as luckily this is the hearing because if the vote was tonight, I would have trepidation. We're moving forward. So I hope that by the time that's come before us, there's additional conversation where there's an actual plan. and we can figure out a way to not create

Thank you, Mayor. Thank you, Council Member Mayfield. Council Member Owens.

Thank you, Mayor. I want to stay on the same line of questioning, but I just want to explore a little bit. The fact that you've got one outlier, is that because they're not being responsive or they're actively saying no and seeking compensation? Or what's the situation with the one who is holding this up?

Okay. Have you been able to share that information between each other? Is there some outreach that's happening from the developer to...

OK. I want to just put this out here, because I'm having some stormwater issues with neighborhoods within District 6. And it is a situation where folks are turning to the city and saying, is this you? And the city's saying, no, it's you. And it's going through all these neighborhoods. And it can be a real mess. And so I share the thoughts here that I'm not anxious to add another house to that mess. But if you are able to work towards getting acquiescence of the last holdout, you know, it sounds like you've got a plan. And you said January would be so you could have something done with the stor

Okay, so you haven't designed yet. Okay, but thank you. I appreciate that. Thank you, Mayor.

Thank you, Council Member Owens. Council Member Esmeralda.

Thank you. So the I think it might have been the planning staff who mentioned that because the size of the lot is so small, that wouldn't trigger stormwater. Am I correct?

So is that because it wouldn't add to the problem?

But voluntarily, what would they do to make it better? Because it's what protections or what additional protections things they could do to improve the stormwater issue?

I understand. It's a very small, 0.5 acres. So it's a small lot, and they are not contributing to the problem. And even if they were to put any additional protection, it wouldn't necessarily address the underlying problem because it's just so small. Okay, I think that's all I have. Thank you.

Thank you, Council Member Jamiro. Council Member Drakes.

Yeah, I just wanted to mention years ago we went through a long process of evaluating the city's responsibility for stormwater issues. We identified categories. It has to flood the streets, their conditions. Otherwise, stormwater is the problem of the property owner. This is a rezoning situation. The request is to put a one-family, single-family home on a sliver of land, and I don't know that we can predicate our decision on that on solving the stormwater problem. We should seek to solve the stormwater problem But I think the rights of the owner are such that if there is no rezoning objection

Thank you, Council Member Driggs. Are there any other council members who'd like to be heard or have questions on item number 13? Okay, do I have a motion to close the public hearing on item number 13? So moved. Is there a second? Any further discussion? All in favor, please raise your hand. Any opposed? All right, public hearing on item 13 is closed.

That takes some... Mayor, I think that was the most discussion per acre that we've had on a recent...

I'll have Judy sing you the music. You have to do some research.

All right, that takes us to item number 14, petition 2026-034 by Sam's Mart LLC is approximately 7.6 acres located west of I-485, north of Windtree Lane and south of Robinwood Drive, outside of city limits, but closest to Council Member Masuera Arias' district. The site is currently zoned neighborhood 1-A, and the proposed zoning is manufacturing and logistics 1, conditional. Staff does not recommend approval of this petition. The petitioner team will have 10 minutes to speak following collectively, to speak following the staff's presentation. Any opposition will have collectively 10 minutes t

Thank you, Ms. Grant. We have two speakers who are signed up to speak in opposition. And they are Mr. Joseph Cascio and Ms. Sean Thomas. Together, collectively, you've got 10 minutes. And if it's helpful, at five minutes, if necessary, I can let you know where you are. Thank you.

Thank you, Ms. Thomas. Thank you both. Ms. Grant, you have two minutes for rebuttal if you'd like to use it.

Thank you, Ms. Grant. Questions from Council of Stark, since it's closest to Council Member Mishra Arias' district. Let me start with him, and then Council Member Mayo. Council Member Anderson.

Thank you, Mayor Harrington. Thank you, staff. Thank you, Bridget. And thank you, D5 residents, for coming out and speaking. I have a question for city staff. Could you explain how the preservation commitment compares to others that we have seen with other rezoning petitions and with what could potentially occur under the property's existing residential zoning?

Thank you. Ms. Grant, can you explain to us what you've seen in the studies that you've conducted?

Which leads me to a related question. How many trees are we losing with the utility street and everything that's needed to access that billboard site?

And I have a question about the de-restriction. So what is the guarantee that that's in place for the foreseeable future and that another developer doesn't go in and buys it and builds more manufacturing logistics near residential neighborhoods?

Got it. I saw that you thank you for hosting those community meetings. What was the feedback from the community in those meetings? And you said you spoken to the directly impacted neighborhood. What has been their thoughts on this?

And apart from what you've mentioned before in terms of state mandates, right, when it comes to lighting, what other specific enforceable commitments has the petitioner prepared to make regarding the billboard visibility, lighting, long-term preservation of the surrounding wooded area?

Thank you. And my last question to staff, Holly, could staff clarify whether the recommendation for denial is based on demonstrated negative impacts from the proposed billboard or primarily based on the inconsistency with the adopted place type?

Thank you. Council member, Mr. Arias council member mail. Okay.

Yes. Thank you, Mr. Mayor at Ms. Grant. So I just want to understand here. It sounds like effectively the acreage, the 7.6 acres, over approximately 90% of that acreage will be preserved as tree safe. It's 86%. 86%. And the real modification to this parcel is adding a billboard that faces 485? That's correct. What is the distance between the billboard and the residential communities? Let me see if I can do it.

This is quite a unique rezoning I'm not sure that we've seen very minute very many like it on one hand Our tree canopy is so important to us and we have our 2050 action that we're trying to get 50% coverage of canopy by 2050. This would certainly protect a great number of trees and preserve them. It sounds like in perpetuity. And on the other hand, you have residents saying that this would impact their quality of life. So this billboard, is it just a visible billboard or does it have other functions like sound or music or anything that can come emit from it?

Yeah. So just the question for staff, is this something that and I see that staff does not recommend it of course, but can you just say more about that balance of, we have a tree safe, it's really a tree preserve. There's an addition of a billboard facing the highway. Can you say more about staff's position against this?

Thank you. I feel like this is a bit of a conundrum here, because through N1A, additional homes can be built, more traffic, more congestion, more pollution. And in this case, we... you would effectively get a tree preserve in perpetuity for really a rezoning and not for the cost value in terms of dollars that Ms. Grant presented. So this is just a very interesting one. I'm going to be very interested in hearing from the community and speaking to my colleagues about this one because I think this is one that we do have to look at pretty carefully. Thank you, Mr. Mayor.

Thank you, Council Member Anderson. Council Member Ashmer.

Thank you, Mayor Harrington. I agree with my colleagues. This one is pretty unique. I've not seen this in my 10 years on the council. I live pretty close to this site. I'm a resident of Far East. And I'm pretty familiar with this site, and I understand the concerns that's been raised by some of the public speakers, especially around light pollution, and especially now that the signs have these videos you have seen. So it's not just the light pollution. I can see noise and sound effects, right? No sound effects.

So this one is a digital sign. So... It will obviously, after a few seconds, you're going to see new. So there is no noise associated with it.

So it's just the light. But it does have these changing effects. And that does concern me, because we are talking about quality of life. And residents who live close to the site didn't expect this giant sign to come in place and where they have to. If they're outside, I'm sure that that will have an impact on their quality of life. Is there restrictions? I think one of the speakers mentioned having restricted hours. Would that be something that you'd be open to? So it's only like at night, it wouldn't run any ads.

Yeah, and I think one of the speakers asked specifically for the hours and restricting not having any ads during the nighttime. So I would be interested if you were to explore that recommendation. I do appreciate the tree save aspect because that certainly helps us with our tree canopy goals. And it also helps with being a natural barrier to adjacent residential community. And I certainly appreciate that with the growth that we are seeing, this will preserve those tree canopy in perpetuity. So that is certainly very unique, and I appreciate that about this rezoning petition. But the light poll

Yeah, I think that's where I'd suggest you work with the Far East neighborhood and the residents. to see what they would like to have restricted. But I would definitely like us to explore limited hours. That's all I have. Thank you.

Thank you, Council Member Ajmera. Council Member Mayfield.

Thank you, Mayor. Ms. Grant, question for you. What's the height of this billboard? Because I didn't notice, note that. To the maximum height 50 feet 50 feet is the highest it can be but we're 20 feet or more below where the closest residents are so just I'm trying to think about the tree say area and the residents and the potential height of the billboard versus the average height of the trees.

Thank you. Cause I had, I was like, I had a feeling that you would have one of these. So here's what I'm thinking about. I thought about it for a long time before I shared this and what I want to make sure that I'm understanding we have seasons.

During the seasons, leaves fall. During the seasons, there are no leaves. So there is a concern that I have regarding the height. The billboard is going to be a digital billboard, which is going to, if it is promoted properly, will have multiple ads that will cycle through. Is the billboard going to have ads on both sides because you have traffic going both ways or is it a one sided billboard?

One, I have shared with staff on multiple occasions that I do have a concern when we're looking at residential area and rezoning residential to manufacturing, just like I have a concern of rezoning manufacturing to residential. We are losing quite a bit of manufacturing space in the city. I personally, we all have an opinion. You got 11 very distinct opinions up here, manufacturing. should be as far from residential as possible. We haven't had rezoning in this area since 2021. It potentially could open other opportunities. But my greater concern is when we look at ICF and we look at quality of

Thank you, Council Member Mayfield. And finally, Council Member Drakes.

Thank you, Mayor. I think what's clear here is the staff is doing the right thing by pointing out to us this is not consistent with our policy. There is also really no basis in policy for an exception. This is absolutely not addressed. It's too infrequent that we have a situation like this, that we would have a policy around it. So essentially what they're saying is as far as we're concerned, our advice to you is it isn't consistent with your policy. The question that's being put to us is, is it a good deal? So six acres versus making the exception to policy. What if it was 10 acres or three o

Thank you, Council Member Driggs, and because of the proximity to your district, Council Member Monserrat-Arias, I'm going to let you have the final comments. Thank you.

Yes, this is just a request for staff. I live directly next to Independence Boulevard, so billboards galore. However, Next to me, next to town homes, I live in town homes. Next to me, there are a bunch of single family neighborhoods that are being renovated and making little McMansions next to me. So I want to know, and hopefully you can help me get this data, the property values of those homes that are directly next to Independence with, I mean, zero tree safe. I mean, I live right next to a storage unit that beams into my town home. I want to know the property values of those homes in that a

Because I think that's the closest case study we have to an existing area with billboards and those single-family homes nearby.

Thank you, Mayor. Thank you, Council Member Mestrada-Arias. Do I have a motion to close the public hearing? Any discussion of that motion? All in favor, please raise your hand. Any opposed? All right. Public hearing is closed on item 14. That brings us to our final item, which is item 15. And I'm going to recuse myself from presiding over item 15 due to my law partner's representation of the petitioner. And pursuant to North Carolina General Statutes 160A-70, I'll entertain a motion for Council Member Driggs, who's the chair of our Transportation Committee, to act as a temporary chair for this motion. Hearing so moved second any all in favor.

I Have a question for the attorney Good question.

I have a question for an attorney so I just completed and I think most of us if not all of us have our UNC School of Government at this class and in the latest at this class it noted that that we do not have to recuse ourselves from any boat or any part of the meeting, unless it's directly connected to financial benefit, meaning we own a percentage. So in the latest ethics, so three weeks ago, I submitted that many years of my life. So I'm, I just want to make sure moving forward ethically and according to the UNC school of government, We do not have to recuse ourselves. When we ask for a recu

I think that would be helpful because the mayor doesn't vote anyway so I don't see a need for the mayor to have to recuse himself, but I want to just make sure that we have consistency in the conversation.

So I appreciate that. And I can understand if we had 10 members tonight. We have nine, so he wouldn't have to break a tie. And seven could override the veto if we chose to. But I just wanted to make sure for clarification's sake, as we're going through and we're taking these ethics classes, if we're given information and then something comes up that is in alignment with that information, we're either going to adhere to it or not. So it would be helpful.

Thank you. This is not because of my desire to take a break, come back for adjournment, but I'd point out just, and we can discuss this with all of you and with the attorney's office. In addition, because I'm an attorney and law partner, there are some additional ethical concerns that come into play for attorneys in these very narrow circumstances. It's not a consistent issue, but it's It can be an issue, but happy to take that up with anyone who'd like to discuss it. Appreciate the question and appreciate the input from the attorney's office. And I think there's a motion and a second. Yes. Th

Recusal. Chair. No, the chair. This is the chair. Yes, that's right. I recused myself. This is recusal. So this is the question. This is calling the question on the motion to appoint Councilmember Driggs to chair preside over this one item. All in favor, please raise your hand. Any opposed? All right, I will step out and be back for adjournment.

Thank you. Thank you, Mr. Driggs. Just a question here. It says on page 9 that there is no additional trips per day.

I just have questions about—I appreciate the height and reducing the height. I just have questions about the density in that area. I know it has— the infrastructure in place in terms of light signals, et cetera. But it seems like that's quite a few cars coming in and out of there, and especially in a space where the movie theater has been dormant for some time. So it can get very congested over in that area. And I have some questions about traffic and congestion.

Okay. Last question. The height relative to the other commercial buildings that surround that area, is that height in alignment or is it taller than the existing?

Yes. I'm very familiar with this area. That's why I'm asking, because it seems like this would be sort of a bit out of character with the adjoining areas. But I'll leave it to the district rep to ask more questions about it. Thank you. Ms. Ajmera.

Thank you. Mister Carmichael. So the side that we're talking about redeveloping is just the theater or there is a retells you know in the same last year.

Got it. So there will be additional retail as part of this redevelopment?

That's great, because all the retail that's there, it's actually, I mean, it activates the space. So it's good to see that there is a plan to activate the theater space. Yes, ma'am. Yep, that's all I have. I think this is... I was looking at the neighborhood meetings. How many people attended the neighborhood meetings? Were there any opposition?

That's helpful. I think activating the site would be certainly a key plus. And also really so that there is a transition from this existing retail that does exist with restaurants, with shopping, to something that is going to be activated again. There used to be a yogurt place there. I know that's shut down. That's closed for a while now. But I hope we will have that frozen yogurt place again. That's all I have. Thank you.

Thank you, Mr. Driggs. I I have spoken with span and I just want to sort of throw you a lifeline if I can. I can say that your commentary is consistent with my understanding with respect to the neighborhoods concerns. They really are born of trying to ensure. the connectivity and really the walkability of that area. I think you're still working with them if I'm not incorrect. I will just lift up that that's important to me as well. This is pretty close to my neighborhood. This is a place where I do get a lot of inquiry from folks about where we are in terms of connecting to the loop and really

And I will say, you know, just to lift up Hillary Larson, she does yeoman's work to enable folks to feel connected to the decisions that are made and to bring information back from her experiences in talking to you and other developers. It really does represent that area so, so well. So thank you. I appreciate your time.

Thank you. So I also have council member Mayo.

Thank you. Yeah. Quick question. Are you, I heard the part about providing some land to a greenway, but we know with park and rec budget and such I mean, we can give them land, but when something will happen, who knows, are y'all proposing any funding for that in addition?

Move to close if there are no other questions. Move to close. Second.

I have no objection. I have absolutely no objection.
