NEW SPEAKER THANK YOU FOR THAT COMMENT. AND JUST TO RUN THAT TOPIC, I'M LOOKING OVER HERE, REMIND EVERYONE WHO'S HERE AND OR LISTENING, WHEN ARE THOSE TWO MEETINGS, THOSE WORKSHOPS SCHEDULED AND LOCATION?

14:24 – 14:52•Don Penning

It is at the transit station. Okay. Just bring those ideas, again, whoever is listening, and bring those ideas to both those workshops. That would be great. Thank you very much for that comment. It doesn't appear there are any more comments. The public comment period for items from the audience has now closed. Any comments that were received after the close of the public comment period will not be included in the record. All right, moving on, public hearings.

15:00 – 15:36•Don Penning

waive the first reading by substitution of the title and introduce an ordinance approving an amendment to the Glenbrier State Planned Unit Development to establish development standards for 3415, 3465, 4475, and 27745 South MacArthur Drive. Assessors Parcels Numbers 248-040-07. 248-040-05, 248-050-20, and 248-050-02, respectively exempt from the California Environmental Quality Act, also known as CEQA guidelines, section 15183. Staff report, please.

18:53•Don Penning

All right, thank you very much. Prior to opening up public comments, are there any clarifying questions from Commission?

19:05•Gurtej Atwal

So what's the current zoning of these parcels?

19:19 – 19:54•Gurtej Atwal

So is it possible to pull the dimensions where it was mentioning the setbacks? So are they all one-acre lots? No. Sorry, go ahead. No, I'm sorry. The top two, they are one-acre lots? Correct. okay so the setback for one acre and fifteen thousand they kind of the rear setback uh seems to be same so normally is that the process

20:17•Gurtej Atwal

So does that mean after this is implemented, so no development review permit will be needed for in-development?

20:37•Gurtej Atwal

Okay, but the building permit would still be required?

20:45 – 21:21•Don Penning

All right, thank you. No more, no further clarifying questions. I would like to formally open up the public hearing. And once again, if you do decide to come up here, please sign in on the podium. First of all, are there any speaker cards submitted for item 6A? No speaker cards. No speaker cards. Are there any members of the public who did not submit a speaker card that would like to speak on item 6A? Show of hands from the audience. No show of hands. Are there any public comments received by email for item 6A? No email. Are there any public comments received via Zoom for item 6A?

21:24 – 21:58•Don Penning

No comments. Okay, so now the public hearing for this item is now closed. Any comments that were received after the close of the public comment period will not be included in the record. We'll bring it back up here for commission discussion. I just got a, just one thing, and we kind of briefly talked about it yesterday, but now this, what's being proposed here is actually just kind of following the same format as most of the residential areas in Tracy, is that correct?

22:37•Don Penning

Thank you for that. And do you anticipate any more of these coming through us? Are there any more areas out there that had the same exact condition, if you will?

23:10 – 23:27•Don Penning

So one last question then. So the City of Tracy, your team actually took the initiative and took care of this without getting any information from the property owners. You just kind of follow the same format as everything else. Okay. Okay. Thank you very much. Anything else?

23:30 – 23:49•Nasir Boakye-Boateng

I would like to learn a bit more about the way the plant unit department is structured. I'm particularly interested in 27745. It has a quite unusual shape, and I want to understand what the extension is, why we are crossing multiple streets with that shape.

24:20 – 24:42•Nasir Boakye-Boateng

Okay. So just to confirm, this is actually what the correct demarcation for that lot crossing multiple streets, going parallel to a different street, all of that is, what is that? And is this something that will be cleaning up? Separately, is it a ministerial function that we are doing?

25:09•Nasir Boakye-Boateng

Okay, thank you. I just wanted to clarify that. Thanks.

25:15•Don Penning

I'll definitely entertain a motion if there's more questions.

25:26 – 26:04•Nasir Boakye-Boateng

Chair, I'd like to move to recommend that the Planning Commission adopt a resolution making the recommendation for the City Council to waive the first reading by substitution of the title and introduce an ordinance approving an amendment to the Glenborough Estates planned unit development to establish development standards for 3415, 3465, 4475 and 27745 South MacArthur Drive ACCESSES PARCEL NUMBERS 248-040-07, 248-040-05, 248-050-20, AND 248-050-02, RESPECTIVELY, EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT SEQUEL GUIDELINES SECTION 15183. I SECOND THAT MOTION.

26:23•Don Penning

All right. We have a motion that's been seconded. Roll call vote, please.

26:36 – 27:14•Don Penning

All right. Thank you very much. Moving on. Item 6B. Conduct a public hearing and upon its conclusion, adopt a resolution recommending that the City Council take the following actions. waive the first reading by substitution of the title and introduce an ordinance adding section 10-08-4242 to the Tracy Municipal Code regarding short-term rentals exempt from CEQA pursuant to CEQA guidelines section 15061 . Once again, staff report.

32:06•Don Penning

All right. Once again, thank you, Christina. Prior to going out to the public, any clarifying questions from anyone up here? Any commissioners?

32:49 – 33:25•Jose Chavez

I have a question for staff. Under application requirements, it's stated that a maximum of two vehicles per booking shall be permitted and must remain off street. I know, having driven through town, there are a decent amount of Airbnbs that are on private properties that are gated, some along Schulte, some along Central. Will the city get involved if someone decides to book this event or book this Airbnb and bring like three vehicles or four vehicles that are within the gated property but not parked along the street? How do we enforce the maximum of two vehicles?

33:39 – 34:16•Don Penning

Thank you. All right. No further clarifying questions. Thank you. I would like to open up the public hearing. And once again, please sign in before speaking at the podium up here. Are there any speaker cards submitted for public comments on item 6B? No speaker cards. Looking out in the audience, are there any members of the audience that would like to comment on item 6B who did not submit a speaker card? No show of hands. Are there any public comments received by email for item 6B? No emails received. Are there any public comments via Zoom for item 6B?

34:19 – 34:34•Don Penning

All right. Well, then we will close the public hearing. The public hearing for this item is now closed. Any comments that were received after the close of the public comment period will not be included in the record. We'll bring it back to Commission for discussion.

34:40•Don Penning

So if this does go through, what I didn't see on here, and I just want to just clarify this, does this apply to ADUs as well that are on property?

35:09 – 35:20•Don Penning

And second question, who will be enforcing? Let's say this goes through, right? And we recommend the council approve it. Who's going to be enforcing this throughout the city?

35:37•Don Penning

Let's say to even take a look. You know, how does that work?

35:48•Don Penning

Thank you. And again, the reason I ask that, again, I'm not sure who's watching or listening, but there's just some questions that kind of popped in my head. And so I want to just kind of ask that in public.

36:25 – 36:43•Don Penning

Actually, I'm glad you said that. You bring up a good point. And maybe you don't know this. I'm not sure. But does VRBO, Airbnb, if someone calls and says, hey, I want to rent my house on the weekends, are they obligated to call the city of Tracy, these temporary rental vacation places?

37:08•Don Penning

Yeah. It just kind of popped in when Danielle was saying that. It kind of just brought a little something in my head, so I wanted to ask that.

37:32•Don Penning

All right. Thank you very much. Go ahead.

37:37 – 38:06•Nasir Boakye-Boateng

Speaking about the compliance part, we already, I think from the staff report, there may be some homeowners in the city that will immediately go into noncompliance as soon as this comes into force. So how are we going to make sure we're able to bring them to compliance so that we don't retroactively, you know, get people into trouble?

38:42•Nasir Boakye-Boateng

So there's a grace period within which all of this will happen, and that will take care of that.

39:00•Nasir Boakye-Boateng

So from adoption to enforcement is one month. That's a period for that. Thank you.

39:43 – 40:06•Nasir Boakye-Boateng

Thank you. A couple others. For the standards and regulations F4, It says that all guest parking shall be provided off-street with a minimum of one off-street parking space per rental unless otherwise indicated by zoning. Are we requiring parking for property owners to be able to support short-term rentals?

40:32 – 41:10•Nasir Boakye-Boateng

Okay. That clarifies that. Thanks. So it means that if anybody wants to go into this business, they should have at least one parking space. Okay. Another clarification is there was this revenue component. If you look at, it's talked about the tax revenue, and we expect that it will have an impact on the tax revenue for the city. Is that our primary measure of success? ARE THERE OTHER IMPACTS THAT WE ARE CONSIDERING FOR THIS CODE CHANGE?

41:46•Nasir Boakye-Boateng

Okay, thanks. Those are my questions, sir. All right.

42:07•Gurtej Atwal

So is it a state law? Yes. So 31 days, then it becomes a long-term rental. Okay, thank you.

43:25 – 44:02•Jose Chavez

Chairman, I would like to move to recommend that the Planning Commission adopt a resolution making a recommendation for the City Council to waive the first reading by substitution of the title and introduce an ordinance adding section 1080 regarding short-term rentals exempt from the California Environmental Quality Act, CEQA, pursuant to CEQA guidelines section 15061 . I will second that.

44:02•Don Penning

We have a first and a second. Roll call, please.

44:18 – 44:50•Don Penning

All right, moving on. Item 7, regular agenda. We do not have one. And item 8, once again, well, items from the audience, please sign in before speaking. We invite members of the public to use Zoom to comment under items from the audience for items, again, that are not on the agenda. By logging on to Zoom using the link provided. Are there any speaker cards submitted for public comments from the audience? No speaker cards. No speaker cards. Once again, looking out in the audience, show of hands. No show of hands for items that are not on the agenda. Any comments received via Zoom?

44:53 – 45:05•Don Penning

No comments via Zoom. A public comment period for items from the audience is now closed. Any comments that were received after the close of the public comment period will not be included in the record. Final director's report.

47:24•Don Penning

All right. Thank you. We will bring it back up here. It's 741, so I have about 36 minutes I need to kill so I can win this trophy.

47:37 – 47:55•Don Penning

Just real quick, I wanted to just once again, I've said it before, I'll say it again. You know, Steph, you guys do such a great job. YOU KNOW, YOU TAKE YOUR TIME, YOU TAKE DILIGENCE, THE STAFF REPORTS ARE ALWAYS VERY WELL RECEIVED, VERY, YOU KNOW, VERY COMPREHENSIVE, AND I JUST REALLY APPRECIATE THAT. YOU KNOW, I'VE SAID IT BEFORE AND I'M SURE I'LL SAY IT AGAIN, BUT THANK YOU VERY MUCH FOR ALL THE HARD WORK YOU GUYS PUT INTO THIS.

47:59 – 48:11•Nasir Boakye-Boateng

JUST WANT TO RECOGNIZE THAT BEING ABLE TO GET THE HOUSE ELEMENT APPROVED IS AN IMPORTANT MILESTONE, SO CONGRATULATIONS AND VERY THANKFUL TO ALL THOSE WHO PUT IN THE HARD WORK TO MAKE THAT HAPPEN.

48:18 – 48:35•Don Penning

Now, he was asking me a question about streets. They don't come through planning. Just want to make sure in case anyone saw that whisper. It wasn't. All right. If nothing else, I'd like to make a motion for adjournment. We have a motion. It's been seconded. Roll call vote, please.
