I have a very quick one. There'll be 6.8.

37:14 – 37:55•Michael Clauzel

6.8 city manager is item 6.8 going to be considered no mayor at this time the 6.8 actually i was going to staff is requesting to table it for a future date all right so 6.8 will be removed and tabled and we'll come back at a future date when it's prepared and ready to go all right we will now open the consent calendar to public comment is there anyone present in the council chambers who would provide a public comment on the consent calendar items Right. 42:54•Michael Clauzel

Questions, comments, or concerns from the Council?

43:05•Chinyere Jack

I have a quick question about the $10,000 allocation. That funding is available, correct?

43:15 – 43:28•Michael Clauzel

All right. Seeing that there's no additional concerns from the council, we will now open Item 7-1 for public comment. Members of the public, Please step forward and provide your comments on 7-1.

49:27 – 49:43•Michael Clauzel

Thank you, sir. Is there anyone else present in the council chamber who would provide a public comment on item 7-1? All right. Seeing none, Madam Clerk, is there anyone online who would provide a public comment on item 7-1?

59:12 – 59:25•Michael Clauzel

So seeing there's no further online comments, We will now close the public comment period and bring the item back to the council for any final thoughts, comments, and their direction and action. Items on the table for discussion, council.

59:29 – 1:00:12•Chinyere Jack

Saying that we do have the funding of, can you hear me? Seeing that we do have that funding available and one of the areas that really need improvement is our downtown area. And I would really like to see a mural go up in the downtown area. So that is something that I really would like to support and to have that art because when we drive around my area, it looks beautiful. We come into downtown, it looks dead. So any project that will improve the area that will bring light to these residents of our downtown area and also kind of like revitalize the business owners in that area. I am 100 in su

1:00:15 – 1:01:41•Gabriela Hernandez

Yeah, I have a comment. I echo what Chi Chi said. I am in support of more murals and more art, not only murals, but other things, right, for the city. So when I was a chair of the Parks, Recreation, Beautification Commission, I did bring up the mural idea, and I know that Ms. Alves also did and was working diligently on securing murals. some funds and the grants also submittal and we had been speaking about it but we I believe we parted ways on that so I am in favor for the arts and I hope that you know in the future we can maybe even potentially fundraise as well. I know that I was fundraisin

1:01:41 – 1:02:17•Kendra Mora

Co-founder of VIP this weekend, so I love their work, and I know that they're great advocates in Not only Patterson, but the rest of Senesau County, so thank you guys Just to let you guys know I completely support this I am super excited to see the murals go up and be downtown and I as I've noticed to Fernando I'd love to see a program put in place and for an annual sponsorship, application, committee, all those things. So if there's any way to do this moving forward, I'd love to see that.

1:02:19 – 1:02:41•Carlos Roque

I just want to thank Ms. Alves for her commitment and advocacy for this $10,000 for this mural. I know she's been advocating this since I started council during the ARPA funding, and it's been a long process, and I'm really in support of this so we could get this mural up and running. So thank you for your leadership and your advocacy for this. Thank you, Ms. Alves.

1:02:43 – 1:03:18•Michael Clauzel

And I also want to echo the comments of the council. Siobhan, you've done an amazing job pushing this forward. And I'm going to do something that I have never done before. I am actually going to call for the motion to approve. Yeah, sorry. I would like to place a motion on the table to approve $10,000 in city funding to VIP for the development and installation of a community mural. Do I have a second? I have a second. It requires a roll call vote from the council. Mayor Pro Tem Roke. Aye. Council Member Mora. Aye. Council Member Jack.

1:03:21 – 1:03:33•Michael Clauzel

And your mayor votes proudly aye. The motion to approve the allocation of $10,000 in city funding to VIP for the development and installation of a community mural goes with a 5-0 vote. Congratulations.

1:03:34 – 1:03:46•Chinyere Jack

And I want to say, Siobhan, thank you for your tireless work. And I really do appreciate a community member that is committed to beautifying our city. So let's do it.

1:03:50 – 1:04:01•Michael Clauzel

We'll take happy moments when we can get them, that's for sure. All right, item 7-2, Centennial Park Project Update and Design Direction. Staff Report, Director of Engineering Services, Rodriguez.

1:21:06•Michael Clauzel

Questions, comments, or concerns from the council?

1:21:11 – 1:21:31•Gabriela Hernandez

Ms. Tiffany, you just mentioned the playgrounds. Is that phase one or phase two? Phase two. So we would, so if I understand this clearly, we're receiving input for phase two that could take potentially like how long?

1:21:46 – 1:21:59•Gabriela Hernandez

And I've seen you in action with the dots out there. So good job for that. But so shouldn't parks be doing some outreach more than engineering? Or how does that?

1:22:14•Gabriela Hernandez

Gotcha. Okay. That's all the questions I have for now. Thank you so much.

1:22:22 – 1:22:44•Kendra Mora

I just have a couple questions. First is... What design phase are we actually in for 1B? For 1B, we're about 30%. Okay. And to confirm, we are not going out to bid for 1A until we have funding? Correct. Okay. Thank you.

1:22:49•Chinyere Jack

What is your preparation to make sure we have access to the next level, which is in December?

1:23:37 – 1:24:20•Carlos Roque

I do have a couple questions. So up to now, how much money have we spent on this current project going forward? How much have we spent so far up to this point? on consulting. And I don't mind, I like the project. However, like I mentioned on my previous statement a while back, for me a priority is this is great. We have a sports park that I don't want to start another project, and we're not going to have the funding to finish it. We're going to have a lot of different scattered projects throughout the whole city, and none of them gets done. What are we looking to finalize? So the first phase a

1:24:33•Carlos Roque

And so my question is, how much money have we spent so far up to now on Volton?

1:25:28 – 1:25:40•Carlos Roque

So we're looking at about half a million dollars just to get the basic conceptual plan. Correct. Now, how long have we been working on this? How long have we been working on this project?

1:26:14•Carlos Roque

We're looking at almost half a million dollars. Two years later, we're nowhere near finalizing.

1:26:35 – 1:27:42•Carlos Roque

And so pretty much what I'm getting at is we're almost two years, two and a half years later. And how long is it really going to take to even get the first face off the ground? When I feel, my opinion is half a million dollars. we could have adopted those half a million dollars into the sports park, additional parks that we have already started. For me, it's like, if this is my money, why am I spending all this extra money where we haven't even got off the ground? I think we should finish the projects that we have started, and then look into this. Me personally, like I mentioned on a previous

1:28:28 – 1:29:37•Carlos Roque

Um, I mean, this is like I said, for me, just an opinion. I'm only one. I still believe we could use better tax dollars in finishing up projects that we're already currently working on. We have big issues coming up here, like I said before, on infrastructure or water, which is a big, and I just feel this is gonna take, we've been two and a half years now. By the time we get off the ground, what, another two, three years, maybe, if we're lucky, and then to finalize the project, how much is it gonna cost us to finalize the whole project? What are we looking at? What are those numbers? Phase one

1:29:39 – 1:30:11•Gabriela Hernandez

Sorry, I have another concern. You spoke about the noise from pickleball, so... Pickleball is unusual because the paddleboard and the ball impact is short and a repetitive pop. So I do know and I've researched that there are a lot of cities in the state of California and even throughout the US that have sued over that repetitive motion and the noise, even with a 10-foot fence. So are there any safeguards that we can implement or, like,

1:30:34 – 1:30:49•Chinyere Jack

Thank you. Can you go back to the slide with the cost? Yes. Council member Moore, right there it is. So the $400,000 that we've already spent, where is that money coming from? From the general fund?

1:31:01•Carlos Roque

And moving forward, where all this additional funding is going to come from? General funds, CFDs, or I don't know, where are these additional, where are we going to get this additional funding from?

1:31:18 – 1:31:39•Carlos Roque

I really love that. Hopefully we do move forward and get this, you know, we're third time applying for it. And what has changed? What factors are going to change? Because I know they base it on certain, what's called scale, right? You have to figure out if you meet certain criteria. What do you think is going to make the difference this time versus the last two? What makes a stronger case now?

1:32:18•Carlos Roque

Do we have a slide of the first survey that went out from the RECS department that you guys submitted, and to see where that is?

1:32:33 – 1:33:02•Chinyere Jack

I'm going to ask one more question, just as we apply for the grant. So looking at the cost, so we're looking between $40 to $50 million. Can you give me an idea, besides the $5 million, that's the grant we're going to have to write? So that will leave us about $45 million. Can you give me an idea where we plan to get this money from? Just a general idea.

1:33:48 – 1:33:59•Carlos Roque

So we're only banking right now on just grant funding to get this started. And if we don't have a plan B? Do we have a plan B? I mean, if we don't get this grant funding, what's going to happen?

1:34:04•Carlos Roque

Well, that's the thing. We're going to keep looking and looking and fire, you know, two years, three years down the line. And it's like, I just.

1:34:13 – 1:34:32•Chinyere Jack

So I just want to remember, let me take it. So strategically, just give us a little plan. So the first phase, we're looking at six million, right? Assuming we get the grant. So that takes us six million. So what is our next plan? other than grants.

1:38:27 – 1:39:09•Chinyere Jack

Fernando, I mean, we're not disputing the project itself. There's no question about that. When you see figures, can you go back to that page with the money dollar sign on it? See, when we're looking at the funding, right, like we have water project right now, trying to get chromium-6 out of our water. That's a priority. I mean, that's 100% priority. So I don't have any problem with the project. My question is about the funding. Where we are going to get 40 to 50M dollars to fund the project. I mean, I love everything that we need to do downtown area. But I'm looking at that money. I'm trying to make sure we know where that funding.

1:41:00 – 1:41:24•Carlos Roque

Okay. I have another question. You mentioned, all right, old Patterson. Yeah. What's old Patterson? We've got North Park, South Park. We've got Gaza Park. We've got different parks. I'm saying it's $5 to $7 million. I don't mind. But if you have the money, allocate them there, my opinion. Second thing is, you said, you just mentioned right now, you're looking at every avenue for funding. And I'm asking you, what's your plan B?

1:42:05 – 1:42:26•Carlos Roque

You also mentioned direction from council. To my direction, last time I mentioned, I asked you if you could provide me the priorities on the last bond. What would be a priority for us as a council? I don't think, I don't know if anybody, this information was brought. What was your priority as a council from the previous bond that we were going to have a $5.8 million? Did you guys ever discuss this with Fernando? Because I sure didn't.

1:42:30•Kendra Mora

And this was definitely not one of mine.

1:42:33 – 1:42:48•Carlos Roque

That wasn't one of mine, because I made this a priority. It's like we need to see what's a priority as a council, and I have different things that I would like to move forward. Incorrect. Hold on, one more question, please. Could you finance, could you let us know how much money do we have in our general fund now?

1:43:22•Carlos Roque

So we have, just for me to understand, less than $1 million right now on general funds?

1:43:40 – 1:43:51•Carlos Roque

So we have less than $1 million, and yet we still want to dump money on this project. I wouldn't have other priorities myself. I just, sorry, I just wanted to get that information out there.

1:45:00 – 1:45:20•Kendra Mora

I have a quick question. With that said about the ARPA funding, can that... ARPA funding that was allocated for this get reallocated or is it specifically for this? Did you have to put anything in place stating it was just for this or can we reallocate it?

1:45:29 – 1:45:45•Kendra Mora

So we're being, with that said, this is funded with ARPA funds. Yes. So can we reallocate that money, or is it specific? Is it stated that it's specific for this project?

1:46:01•Chinyere Jack

Can you remind us again, what was the total cost for the design?

1:46:12•Gabriela Hernandez

And there are no more funds being spent on the sign, correct?

1:46:22 – 1:47:46•Gabriela Hernandez

I just want to make a few points. Fernando, you mentioned there was outreach and everyone's mentioned outreach, but when you guys brought back the surveys, pickleball and tennis ball courts were all the way down to like number 14 and number 22. So that's just my issue that you guys say that you guys take council direction and community direction, but obviously you guys didn't at this point from what I've seen from the surveys that you guys did. A COUPLE MAYBE YEARS AGO. YOU DO SAY THAT YOU BROUGHT THIS TO THE PARKS RECREATION COMMISSION. THAT'S ONLY LIKE FOUR TO FIVE PEOPLE ON A GOOD DAY. USUA

1:47:50•Michael Clauzel

Any further comments or concerns from Council before we move to public comment?

1:47:55 – 1:48:42•Carlos Roque

One last one. I just want to say, Tiffany, I really appreciate all your hard work, and I'm sorry it's not me coming at you. It just, for me, is where's the money really going to come from? It's not that I don't want this project. It has nothing to do with that. I think it's a good project. It's just, for me, if we don't have the money, how are we going to build this project? And that's just what it comes down to, is I don't think good or bad, I'm just worried about the money. Where are we gonna get this money to? And I wanna identify what our community needs are versus the wants. That's the di

1:48:43 – 1:49:08•Kendra Mora

One last question. So when can we bring this back to discuss moving forward? So if we move forward with design, we complete design, how can we bring this back to discuss maybe suspending it at that point? So when can we do that? Because I have multiple concerns about this project.

1:50:44 – 1:51:01•Kendra Mora

We just need to have some pretty hard conversations before we go out to bid, before we start a project that's going to have a corner of it completed. We just need to have a hard conversation about the whole entire project before we move forward with construction on anything.

1:51:02 – 1:51:27•Carlos Roque

Absolutely. One other question is, how did this, how could this work? This is just me and my opinion, where we could somewhat table it and just move to finish what we have working on right now. And if we don't get the grant funding, right, we just table the project because we're going to be dumping money and more staff time, more money. What would be the best way to motion that?

1:53:21 – 1:53:36•Gabriela Hernandez

Quick question. What type of grant is it? So that grant can be used for like Council Member Roque said to finish the sports park or to finish any other pending parks? Yes.

1:54:07•Chinyere Jack

That would not be a smart thing to compete against yourself, because we want to get one.

1:54:41 – 1:55:12•Michael Clauzel

So now I have a question for the city attorney. Given the council's direction that they have provided through their statements, do you feel it would be more appropriate to just table this and bring it back with a more appropriate motion on the table? Because I believe that they may even want to just terminate the project completely after the design is done. and not move forward with these other proposed elements and next steps.

1:56:25•Michael Clauzel

All right, that being said, we will go ahead and open up item 7-2 for public comment. Are there any persons present in the council chamber with a public comment on item 7-2?

2:06:55•Michael Clauzel

You're a minute over, so if you could please wrap up your comments, I'd appreciate it. Thank you.

2:08:23•Michael Clauzel

Thank you. Thank you. Is there anyone else present in the council chambers who wishes to provide a public comment? Step forward, please, sir.

2:10:07•Gabriela Hernandez

It was not. Can you clarify where those funds came from, ARPA? Could you clarify what ARPA funds are, please, for his knowledge?

2:11:52•Gabriela Hernandez

JUST TO CLARIFY FOR OSCAR, JUST TO CLARIFY FOR OSCAR, ALSO, I WASN'T ON COUNCIL. ALSO, I WASN'T ON COUNCIL. COUNCIL MEMBER JACK WASN'T ON COUNCIL. COUNCIL MEMBER JACK WASN'T ON COUNC

2:12:15•Kendra Mora

So I think that's what we're trying to do. So these are ARPA funds. I think that everyone's okay with finishing designs with the ARPA funds, but what we need to look at...

2:12:35•Kendra Mora

If we can get grants, I think we're all in agreement, but to fund this with taxpayer money, I definitely think we're not.

2:12:45 – 2:12:58•Michael Clauzel

Thank you, sir. Is there anyone else present in the council chamber who wishes to provide a public comment on item 7-2? Seeing none, Madam Clerk, is there anyone online who wishes to provide a public comment on item 7-2?

2:20:19 – 2:20:31•Michael Clauzel

All right. Seeing that there's no further public comment, we'll close the public comment period and bring the item back to the council for their direction and action. Items on the table for a motion.

2:20:46 – 2:21:26•Michael Clauzel

Is it okay if I leave it in generalities, the motion? Like the staff recommended proposed park elements and stuff? Because I have a motion ready to go. If everybody's okay with the recommendations, I can put a motion on the table. We have a general kind of consensus of head nods before I throw it out there? Council Member Hernandez? Yeah. Yeah? Okay, all right. I'm going to put the motion on the table then. Do I have a motion to approve the staff-recommended proposed park elements and next steps, authorized community engagement activities, and survey for additional elements to inform the final

2:21:41•Michael Clauzel

But that's, they recommended the 12 foot.

2:21:48•Michael Clauzel

No, I didn't even put a phase on it. I just said, so let me read it again.

2:21:56 – 2:22:22•Michael Clauzel

Yeah, I just put a blanket for everything as they went through it. I made sure I was writing, so per the recommendation. So I'm going to read it to you again. just to make sure we're encapsulating everything. The motion to approve the staff recommended proposed park elements and next steps, authorized community engagement activities, and the survey for additional elements to inform final design decisions.

2:22:23•Gabriela Hernandez

I have a question. So we're motioning for this to be approved? For these elements?

2:22:40•Michael Clauzel

Yeah, 1, 2, 3, where it has that arrow, it says staff recommendation. So we're approving that.

2:22:47•Gabriela Hernandez

And so the basketball court is planned to be constructed as part of phase 1b. Is commentary outside of the motion.

2:23:07•Chinyere Jack

Yeah, so that's like you said, it's not part of the ground in the current. Yeah, I'll second that.

2:23:14 – 2:23:29•Michael Clauzel

Okay, so we have a motion in a 2nd, and that requires a roll call of the Council here. Pro. Tim. Okay. So recommendation may Council member more. Councilmember Jack?

2:23:35•Michael Clauzel

And your mayor votes aye. The motion fails with a 3-2 vote. Okay. And now we can move on to the next agenda item, correct?

2:23:48•Michael Clauzel

Do you guys want to bring a different motion?

2:24:35 – 2:24:59•Kendra Mora

So what I'd like to do, if possible, since there's so many community members that's concerned with the design, Tiffany, can we do some two-two-ones and talk about this and see where we're at and then possibly bring it back to council for approval or changes? Okay.

2:24:59•Gabriela Hernandez

Can I also propose that the surveys include the schools? Thank you.

2:25:06 – 2:25:44•Michael Clauzel

Yeah. I think there's so many. That's why I was saying what I said early on, half an hour ago, right, was like it's way too complicated of an issue. Council is very undecided as to what they want to do. We should bring it back for two two ones Get direction from the council as to exactly where they want to go so we can bring an appropriate motion forward That is what we need to do. I know I haven't spoken much when I'm speaking now, and that's what needs to happen So I would appreciate it if we just we can we can let it die and then make that recommendation to the city manager to create the tw

2:25:46 – 2:26:04•Michael Clauzel

Okay, so on behalf of the council, if it's okay with everybody, I would like to direct the city manager to create 2-2-1 meetings to go over this entire situation so we can bring back an appropriate motion for consideration of the city council at a future date. And the 3-2 vote stands.

2:26:05 – 2:26:23•Chinyere Jack

I have a question, though. So what would change from your recommendation, regardless of the 221? What would change on this phase that you already brought forward? What is going to change having the 221?

2:27:09 – 2:27:21•Carlos Roque

I've got a question. Sorry. So what happens if just two, two, ones, we come up with an idea? It's like, oh, I think we could go this route. Could they come back again and change somewhere at the staff report? No.

2:27:33 – 2:27:50•Chinyere Jack

Yeah. That was the reason why Council Member Roque asked that question. Because when we go back to 221, we're still going to come back to this. So that's why I was asking what would change going back into 221. We're still going to end up at the same presentations.

2:27:50 – 2:28:30•Michael Clauzel

Yeah, because all this does is move the project forward to complete the design elements and to be able to go out and do public surveys and things like that so we get the community input that the community is asking for. That's all this motion would have done. But that being said, we are where we are, right? It's a 3-2 vote for denial. And, you know, it's 940 at night, so unless the council has anything else to provide input on, the decision has been made and we need to move forward. But I'm really disappointed because I think that all we were doing with that motion was just approving them to w

2:28:31 – 2:29:08•Carlos Roque

No, I agree with you. The only thing I would change is maybe when things come up like this, maybe we should be ahead of the game. I'm thinking you would have those two-to-ones before we get to this point and see what options we have before we're here at the dais and seeing what decision are we going to make. I personally feel like we would be at this point where we kind of want to proceed just because we don't lose those $500,000. But if we would have been informed before of all this, maybe have those two-to-ones, we shouldn't be asking, let's have those two-to-ones just to see we could fully

2:29:12 – 2:29:41•Michael Clauzel

Any last comments before I move on to the next agenda item? Okay. Off we go. Item eight one public hearing approved first reading and introduction of ordinance number eight ninety one reading by title only waiting for the reading and ordinance of the City Council of city of Patterson approving amended and restated development agreement between the city of Patterson and Central Valley Sierra associates. And South cord management LLC for catalyst cannabis dispensary staff report deputy city attorney Richard.

2:33:13•Michael Clauzel

All right. Thank you very much. I really appreciate it. Making it short and sweet. Is there a member of the council who has questions, comments, or concerns for this item?

2:33:28•Michael Clauzel

All right. And your mayor has no comments at this time. We will now put item 8.1 out for public comment. Is there anybody present in the council chamber who has a comment on item 8.1?

2:36:24 – 2:36:36•Carlos Roque

I just want to say, compared to this litigation that we're settling now, it's way better than the one we had previous, an account, was it about two years ago, maybe a year ago? So it's a way better outcome than last time.

2:36:37 – 2:36:50•Michael Clauzel

Thank you. Agreed. Is there anyone else present in the council chamber who wishes to provide a public comment on item 8.1? All right. Seeing none, Madam Clerk, is there anyone online who wishes to provide a public comment on item 8.1?

2:37:00 – 2:37:14•Michael Clauzel

All right. Seeing no further public comment in the council chambers or online, we'll now close the public comment period and bring the item back to the council for their direction and action. Any further questions, comments, or concerns before we move forward?

2:37:17 – 2:37:47•Michael Clauzel

All right, perfect. Do I have a motion to approve first reading and introduction of ordinance number 891, reading by title only, waiving further reading, in ordinance of the City Council of the City of Patterson, approving the amended and restated development agreement between the City of Patterson and Central Valley Sierra Associates and South Cord Management, LLC, for a Catalyst Cannabis Dispensary. All right, we have a motion. Do I have a second? The motion has been seconded and requires a roll call vote from the council. Mayor Pro Tem Roque? Aye. Council Member Mora?

2:37:50 – 2:38:39•Michael Clauzel

Your mayor votes aye as well. The motion to approve first reading and introduction of Ordinance 891, reading by title only, waiving further reading, in ordinance of the City Council of the City of Patterson, approving the amended and restated development agreement between the City of Patterson and Sierra Valley Sierra Associates, or Central Valley Sierra Associates and South Cord Management, LLC, catalyst cannabis dispensary passes with a 5 0 vote city staff reports adopt resolution number 2026-62 establishing the data center community advisory committee select the committee structure and appo

2:47:39•Michael Clauzel

Questions, comments, and concerns from the council?

2:47:48•Michael Clauzel

All right. And then from the mayor, we'll go ahead and open item 9-1 to public comment. Is there anyone present in the council chambers who wishes to provide a public comment on item 9-1?

2:54:13•Michael Clauzel

Thank you and thank you for what you do. Is there anyone else present the Council chambers who was by the public comment on item 9.1.

2:56:24 – 2:56:37•Michael Clauzel

Thank you, sir. Anyone else present in the council chambers wish to provide a public comment on item 9-1? I see none. Madam Clerk, is there anyone online who wishes to provide a public comment on item 9-1?

3:06:22 – 3:06:50•Michael Clauzel

Got it. Okay. And with that, we will go ahead and close public comment and bring the item back to the council for their direction and action city council. I request humbly that I be able to guide us through this because there are many different parts of what we need to decide. And so I think it's best just to take them one at a time so that I can write up the motion properly so we can get it passed as efficiently as possible. Is that okay? Or do you guys have general comments you want to make before we get started?

3:06:52•Gabriela Hernandez

Do you say that we could come back to this?

3:06:58•Michael Clauzel

That's for the appointment of the council members.

3:07:34 – 3:08:22•Michael Clauzel

Is everybody okay with proceeding? Okay. I feel it's important that all of us be on the same page. So page 182 of the agenda, and we're going to start off with committee purpose and scope. Does anybody have any issues with the committee purpose and scope as recommended? I just want to make sure we're going through it one thing at a time. I have a consensus to move forward with committee purpose and scope as recommended in the staff report. Okay. All right. Now we're going to go over the committee structure options, right? So let's, decide on the committee size, what would the council like to d

3:08:29•Carlos Roque

We're currently at five or seven, correct?

3:08:44 – 3:08:56•Carlos Roque

My opinion would be at least maybe just seven, just because of our experience when we have certain committees, people don't really show up sometimes. So maybe the more, the better. Whoever shows up, at least we could create a quorum.

3:08:58•Kendra Mora

So you're saying seven community members? At least, yeah. And two council members? I think so.

3:09:08 – 3:09:29•Michael Clauzel

Okay, I'm just typing it up. Okay, public member eligibility. Are we gonna go with the recommendation or how do we feel about that?

3:09:31 – 3:09:43•Kendra Mora

So I've brought this up before that a couple of our commissions are open to everybody that's within city limits and outside, and then some of them aren't. So why?

3:10:18 – 3:10:37•Kendra Mora

I don't know if I'm open to outside of city, well, Patterson residents, but I think city clerk, didn't we have a discussion about changing that at some point for all of the commissions about putting it to the availability to the surrounding countryside as well?

3:10:50•Michael Clauzel

Okay, so how do we feel about that? Are we going to go with the recommendation, which is limit all public seats to city residents?

3:11:02•Kendra Mora

I'm going to say I would vote for anyone within our zip code. That's pretty much where I think is fair. Can we limit it like that?

3:11:19•Kendra Mora

It just seems completely, I mean, because you don't live within the city, you live on Sycamore, you don't get to participate. That doesn't seem...

3:11:54•Kendra Mora

Yeah, that's not what we're trying to do here. So anyway, that's my opinion.

3:11:59 – 3:12:29•Gabriela Hernandez

I'm open to a radius. I think I am open to a radius. I stand by what I said. I think I am open to a radius, and I think those were my words. And for the record, I have a lot of friends. So that's ludicrous to say that I wanted my friend on there. So with that said, I think I'm open to a radius just because the data center can come next door to Grayson or Wesley or Newman. So I'm open to a radius if we're talking about this in a smart manner.

3:13:20•Carlos Roque

That's fine with me, as long as we get qualified people in our committee to help us make the right decisions to move forward, I'm okay with it.

3:13:32•Michael Clauzel

All right, guys, give me a second. Okay, so what do we want the radius to be?

3:14:02•Kendra Mora

So do we want to put a mile radius on it now?

3:14:06 – 3:14:37•Michael Clauzel

Well, that's what I have set up. So if you guys want to just do a mile radius. Thank you, Chief. I actually was liking the music at this point. I was really feeling it. I'm pretty disappointed you went out there and put a stop to it. Okay. Three miles. We'll start there. Is everybody okay with three miles? Three comes up in the Bible a lot, so why don't we just go with three?

3:14:53•Michael Clauzel

Sphere of influence? Okay. I will change the language. Okay, you guys start discussing appointment method options.

3:15:10•Kendra Mora

So is this the same process that we use for the other commissions?

3:15:32 – 3:15:43•Michael Clauzel

Okay, so council appoints all public members by majority vote after an open application period, yes? Straight down with the recommendation, right? Okay, start talking about meeting schedule.

3:15:50•Kendra Mora

I'm not sure if that's enough, but I also don't want to overextend, so I do like the when necessary or as scheduled.

3:16:47 – 3:17:09•Michael Clauzel

So with the recommendation? Are we okay? I want to make sure I have consensus where I start writing this stuff up. Okay, duration.

3:17:13•Kendra Mora

WE NEED TO MAKE SURE THAT THE COMMITTEE ALSO EXTENDS. SO I WOULD SAY THE ALTERNATIVE OPTION IS WHAT I WOULD VOTE FOR.

3:17:22•Michael Clauzel

OKAY. SUNSET ONLY UPON FINAL COUNCIL ACTION.

3:17:33•Kendra Mora

IF WE HAVE OTHER EXTENSIONS WE NEED TO BE COVERED.

3:17:37 – 3:17:57•Michael Clauzel

OKAY. And just to make sure that we're paying attention to what the public gives us on feedback during public comment, do we have any location direction? I'll let the City Attorney speak.

3:18:46•Kendra Mora

No, I agree. This needs to be around just like all the other commissions.

3:18:51 – 3:19:17•Michael Clauzel

Perfect. Okay. We don't need to provide any input there. Vacancies and removals. The recommendation is members would serve at the pleasure of City Council. The City Council may remove a member for any reason by majority vote. A public member vacancy would be filled by council appointment. Unscheduled vacancies are subject to notice and waiting period requirements of government code section 54974. Is everybody okay with that language?

3:19:18•Kendra Mora

Is it the same as the other commissions?

3:19:25 – 3:19:40•Michael Clauzel

Okay, so nodding of heads, we're okay with that? This is going to be the longest motion ever. Are we going to authorize legal staffing or not?

3:20:02 – 3:20:15•Kendra Mora

Is there a way to mitigate that with minutes? It just seems that it would be a little pricey to have you at every meeting or someone at every meeting.

3:20:39•Michael Clauzel

Hold on, guys. Oh, start discussing who we want to appoint.

3:20:48•Carlos Roque

If I could stay out of it, I would want to be appointed at this. Not at this one. Just because of my work, I've been out of business. I can't.

3:21:20 – 3:21:39•Michael Clauzel

I'm typing. Since you don't want to be in it, why don't you kind of get them going?

3:21:54 – 3:22:15•Michael Clauzel

Do we want to punt? I'm putting everything in there. Literally, I'm just going to read this whole damn thing. I spent the time to type it up, so it's going to all be in there.

3:22:51•Gabriela Hernandez

And we did discuss how long, right, the commitment is, six months?

3:23:31 – 3:24:08•Michael Clauzel

Okay. who wants to be on this, or do you guys want to table that? Yes. Okay, so I think the last thing on there is the authorization for the city clerk to recruit applicants for public member seats using an application period of 20 days. Do I have to put that in there? Probably, huh?

3:24:11 – 3:25:02•Michael Clauzel

Okay. I'm almost done. Almost there. Am I missing anything? I don't think so. All right. Okay, any further discussion before we move forward for a vote on literally the longest motion to adopt I've ever typed up? We're good?

3:25:05 – 3:26:20•Michael Clauzel

Do I have a motion to adopt resolution number 2026-62, establishing the data center community advisory committee, adopt the committee purpose and scope recommendations, adopt the following committee structural recommendations, committee size of seven voting members consisting of five community members and two council members, limit all public seats to the sphere of influence of the city of Patterson. Council will appoint all public members by majority vote after an open application period. Establish a meeting schedule of one regular meeting each month with special meetings when necessary. Suns

3:26:30•Gabriela Hernandez

Yes, nine total. Yes, okay. YES, NINE TOTAL.

3:26:39 – 3:26:57•Michael Clauzel

I WILL NOT. GUARANTEE YOU THAT. I DON'T HAVE TO SAY IT AGAIN AT THE END EITHER? DO I NOT HAVE TO REPEAT ALL THAT? OKAY, BUT WE ARE GOING TO CORRECT THE RECORD. NINE VOTING MEMBERS CONSISTING OF SEVEN COMMUNITY MEMBERS. and two council members, my apologies. It is 10.30.

3:27:00•Gabriela Hernandez

And the city staff, correct? Say that again? And the city staff, correct?

3:27:14 – 3:27:41•Michael Clauzel

Okay, so we have a motion. Do I have a second? Okay, the motion has been 2nd and requires a roll call vote for the from the Council Mayor Pro Tem. Okay. Council member Moran Council member Jack. I remember Hernandez and your mayor votes. I have the motion to adopt resolution number 2026. Dash 62, establishing the data center community advisory committee passes with a 50 votes as amended. As amended right gotcha.

3:27:41•Chinyere Jack

Was it amended? I will continue amended.

3:27:46•Michael Clauzel

All right, City Council items. Council Member Hernandez.

3:27:50 – 3:28:04•Gabriela Hernandez

None. The Shaw Committee, Senators Homeless Alliance Commission move to meet every other month. So we are to meet next month, and I will come back with some information. Thank you.

3:28:08 – 3:28:19•Chinyere Jack

Well, there was a meeting today. Next meeting, I'll be able to give you an update. Sounds good.

3:28:22 – 3:28:36•Michael Clauzel

Mayor Pro Tem. Nothing to report as well. All right. As for myself, the Stanislaus County Mayor's meeting will occur next Wednesday and Stancock meeting will occur at scheduled time in the middle of the month. Other matters?

3:29:03•Michael Clauzel

That takes my comment off the board. Okay.

3:29:08 – 3:34:00•Carlos Roque

And as for me, I'm sorry, I was really planning to let this go. But based on what I have witnessed, experienced, and the evidence I have reviewed, I have reached to a very serious conclusion. The conduct I have seen does not reflect the standard of leadership I believe Patterson deserves. I did not reach that conclusion lightly, and I'm not saying it because of a political disagreement or personal conflict. I am saying it because an elected official is entrusted with responsibility to lead with integrity, respect, accountability, and honesty. When those standards are compromised, remaining sil

3:34:05 – 3:35:42•Kendra Mora

Yeah, I want to follow up with a couple things. And I'm sorry, you guys, I know it's late. But unfortunately, with the events of last week, this is the first opportunity we have had to kind of come back and revisit some of the comments and give some clarity to those comments. So for the record, to the contrary of what's being circulated, the ABS project was not a bad project at all. In fact, it was structured exactly like the Chevron project that the city previously executed and was presented to me by staff in that context with the same sentiment. I myself have all of this documented in writin

3:36:11 – 3:37:02•Kendra Mora

Second serious allegations. have been made publicly suggesting that this project was detrimental to the city and that council members engaged in improper conduct related to it. I'm even seeing allegations of backdoor deals. To your knowledge, has the city received any tangible evidence from anyone sustaining those allegations? Again, no, I'm not aware of any specific evidence that would support those allegations having and I have not independently investigated any of those allegations myself and finally to your knowledge has the city made any formal findings that this council or Any individual

3:37:28 – 3:38:10•Kendra Mora

So I think what has been established is an important distinction between and needs to be on the public record that allegations and opinions have been made, but the city has no formal findings substantiating them. So with that said, I am formally requesting that the city makes a distinction clear to the public and promptly. I would like a factual clarification be published on the city's website, social medias, and provided to the Patterson Arrogator immediately. The public is absolutely entitled to disagree with this council and criticize our decisions, but the public also deserves to know the

3:39:12•Kendra Mora

So you're saying what do we need to do then?

3:39:28•Kendra Mora

I mean, I think we'd have to- I would definitely get an estimate.

3:39:40•Carlos Roque

A quick question, just what would be cheaper for us to do? Do a third party or submit a submittal to the grand jury and get started?

3:40:17•Carlos Roque

Should we bring it back to the table and discuss it as a closed session item?

3:41:06 – 3:41:38•Chinyere Jack

I think we need to take a break. Almost 11 o'clock. We need to discuss this. We need to discuss it before we start directing staff right now. So that is something that we need to have a conversation over. And if there's any question on the ABS, we need to go back to the report and read through it together. And then if there's some clarification that we need, we can proceed from there.

3:41:44 – 3:42:02•Carlos Roque

I'm good with whatever the council decides to go. I just wanted to explain myself. I have nothing to hide. I've been here for 40 years. I truly value honesty, loyalty, and integrity. And I don't have nothing to hide. So whatever investigation needs to be done against me, I'm an open book.

3:42:05 – 3:42:48•Gabriela Hernandez

Just to clarify, I believe that even if any of us submit it to the grand jury, they can or cannot pick up on it, correct? So it doesn't constitute, like, it doesn't automatically get investigated. It's reviewed. It's up to them to take it or not. That's correct. I think because it has been brought up multiple times, it's like beating a dead horse. I feel like it constitutes to to it being investigated since we had a couple witnesses say that council members insert themselves.

3:44:23 – 3:45:54•Chinyere Jack

So do we have a publicist for the city? Because if we don't have one, we need one. I just, now that we brought this up, let me make a statement. I don't think it's for any of us to be on social media responding. TO ANY INFORMATION ON BEHALF OF THE CITY. I THINK IF ANYTHING, THERE SHOULD BE SOMEONE FROM THE CITY THAT PICKS UP ON INFORMATION ON SOCIAL MEDIA. NO COUNCIL MEMBER SHOULD BE DOING THAT BECAUSE THERE'S LANGUAGES THAT WE SHOULD BE USING AND FURTHERMORE, WE CANNOT PUT THE CITY IN HARM'S WAY. GOING ONLINE AND RESPONDING TO ALLEGATIONS OR INFORMATION BEING PUT OUT THERE IS TOTALLY UNACCEPT

3:45:57 – 3:47:33•Michael Clauzel

Anything else for other matters? Seeing none, now I'll add in my 50 cents. I want to state for the record, quote unquote, that the primary source of the information utilized by my attorney in the investigation to my censure came from the report that you commissioned. It came from independent witnesses. It came from Jessica's resignation letter. And it came from a Google search into ABS and its prior dealings. That was the primary source of the information. And so, I submit that to be used. And as the attorney said, what did she say? It's so late. Other than the sustained findings by the invest

3:47:39 – 3:47:51•Michael Clauzel

Okay, great. Well, we'll move for adjournment. May the Lord bless our sheriffs, our firefighters, and all our first responders. May God bless you and the city of Patterson. This meeting is adjourned.
