APPROVAL OR ALTERATION OF AGENDA FOR – October 13, 2026. (Non-action item).

GENERAL PUBLIC COMMENT FIRST – Up to three-minute time limit per person on matters not listed on the Agenda.

Topics of public comment shall be limited to matters within the authority of the Governing Board. Action will not be taken on the matters considered during this period.

DISCLOSURE OF EX-PARTE COMMUNICATIONS AND POSSIBLE CONFLICT OF INTEREST

FOR POSSIBLE ACTION – Emergency Items.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to approve, amend and approve or reject the newly proposed Nye County Water District Water Resource and Protest Policy developed by Schroeder Law at the request of Mr. Lach.

Approval of the proposed policy will not impose any unbudgeted expenses on the Nye County Water District.

FOR DISCUSSION ONLY – Discussion, deliberation, and possible direction to staff on the findings from Schroeder Law regarding the requested White Paper concerning groundwater contamination associated with historic nuclear testing at the Nevada National Security Site.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to approve, amend and approve or reject a proposal from GCW Inc. to provide engineering design services for up to three Rapid Infiltration Basins that will also function as floodwater detention basins, in accordance with the requirements of grant R25AP00577 awarded by the U.S. Department of the Interior.

Approval of the proposal in the amount of $286,663.00 will not require the expenditure of additional unbudgeted District funds.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to consider a presentation by Balanced Rock Power regarding a proposed solar project on private land in Amargosa Valley and to: A) Support or: B) Oppose the proposed project.

This item will not impose any unbudgeted expenses.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to consider placing a public notice to the Nye County Water District website about the status of Nevada Hydrographic Basin 162.

All data used in the notice is provided by the Nevada Division of Water Resources and the notice will be updated as new basin pumpage inventory data is released by the Division. This item will not impose any unbudgeted expenses.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to: A) review a progress report on the contract’s actions to date and: B) approve, amend and approve or reject Change Order #1 for Marcus G. Faust, P.C. (MGFPC) to extend the agreement for one additional year to expire November 1, 2027.

The contract amount of $60,000 is a previously budgeted expense.

FOR POSSIBLE ACTION – Discussion, deliberation, and possible action to approve, amend and approve or reject a proposal from UES Professional Solutions 30, LLC to conduct a feasibility study and provide engineering in support of the Nye County Water District Water Infrastructure and Pipeline Project – Phase 1.

The contract amount of $44,825.00, while unbudgeted, is available within the appropriate expenditure line.

PRESENTATION – Presentation from Nevada resident Joel Epstein regarding a water generation machine concept, including an overview of the technology and its potential application to water resource development in Nye County.

The presentation will be limited to ten (10) minutes.

PRESENTATION – Update from BEC Environmental and Nye County Water District staff on the status, progress and key milestones of programs funded through grant revenues.

FOR POSSIBLE ACTION – Discussion and deliberation to set the date, time and location of the next Water District Governing Board meeting for Tuesday, December 8, 2026 at 10:00 a.m. at the Pahrump Commissioners Chambers.
