Most cancers are not detectable to the touch and 90% of breast cancers are not inherited. I was diagnosed at 47 with zero family history and no problems of which I was aware. More women are being diagnosed in their 40s, and one in ei

1:06:22 – 1:06:44•Angie Henderson

Thank you. Next will be Kim Unertl speaking on agenda number 93, 1497 in support. I know we have a ADA mic there. Is it on? It's on, yes, go ahead.

1:08:45 – 1:09:02•Angie Henderson

All right, next is Trina Huell speaking on agenda item 30. This is resolution 2264 in opposition. Ms. Huell will be followed by John Bull and Adam Nicholson. Go ahead, you're recognized.

1:10:52 – 1:11:04•Angie Henderson

Thank you. Next is John Bull speaking on agenda item 69. This is ordinance 1585. Go ahead, you're recognized.

1:12:46 – 1:12:57•Angie Henderson

Thank you, Mr. Bull. Now last for public comment is Adam Nicholson speaking on agenda item 93, ordinance 1497 in support, go ahead.

1:14:14 – 1:14:51•Angie Henderson

Thank you. That concludes our public comment time. All right, before we get into section I regarding rules of procedure, we do have somewhat of a timing matter and we have some of our rules related to the capital improvement budget that mentioned some very specific times and dates and looks like we may need to engage that. And so for that purpose, I'm going to recognize planning and zoning chair Horton, you're recognized sir.

1:15:06 – 1:15:25•Angie Henderson

Okay. All right. So there is a... a request to suspend the rules, rule 15.1 relative to the CIB and the council member submission date. Moving that date, could you restate that Mr. Horton?

1:15:28 – 1:15:52•Angie Henderson

Till November 9th. Is there any objection to a suspension of the rules to take up this matter? Okay, seeing none, special counsel, do we need to vote on this or are we just stating the proposal of the chair and calling it good? If you could advise, please, sir, go ahead.

1:16:06 – 1:16:44•Angie Henderson

All right. So just to restate that again, the rules specify October 31st. But in support of, as I understand it, kind of staff the process and to give members ample time, Chair Horton is proposing that the rules be suspended such that that date will now be November 9th. Is there any objection from the body to that change to the rules? Okay. We will then say that the rules have been suspended for that purpose and the planning department and our staff will be in touch with members. Is there anything else, Mr. Horton, you want to share at this time?

1:16:55 – 1:18:20•Angie Henderson

Okay. Planning department... December 16th to December 31st. Okay, that being typically effectuated just by email, right? To be shared with the body. That's correct. Okay, that's rule 15.2 that specified that specific date of December 16th. But again, as we are shifting the other date a week or so, we're going to shift this across the holidays. Is there any objection to the suspension of the rules such that the planning department's deadline to send that to council per rule 15.2 would be December 31st. Okay, seeing no objection, the Rule 15.2 is suspended for purposes, those specific purposes

1:18:21•Jason Spain

Thank you, Madam President. Committee report, please.

1:18:23 – 1:18:43•Angie Henderson

For the report of the rules, confirmations, and public elections committee, Chair Sepulveda, you're recognized. Thank you, Vice Mayor. Rules voted six in favor, zero against, zero not voting as substituted. Okay. And then did you all take up, I think there was an additional substitute that had a typographical issue?

1:18:43•Jason Spain

Yes, there was a late filed substitute to correct a typo.

1:18:45•Angie Henderson

Okay, okay. And that's the one that you're reporting. Okay, thank you for the clarification. All right, back to you, Mr. Spain.

1:18:53•Jason Spain

I will move approval to bring up the substitute.

1:18:55•Angie Henderson

Okay. All right. There is a motion to approve. Is there a second? Okay. Back to you.

1:19:00•Jason Spain

I will move to suspend the rules to consider the late filed substitute, which corrects the typographical error.

1:19:06 – 1:19:29•Angie Henderson

Okay. So members have received the substitute. There is as well a late filed substitute that has a minor typographical. No. It's just the late sub, okay. Is there any objection to a suspension of the rules for that purpose so that the sponsor can offer the substitute? Seeing no objection, the rules are suspended. Go ahead, sir.

1:19:29•Jason Spain

Move approval of the substitute, which as we've already discussed, just corrects a slight topographical error.

1:19:36 – 1:20:04•Angie Henderson

Second, is there any discussion on this substitute? This is just the motion to substitute at this juncture. Seeing none, all in favor of the motion to substitute, please say aye. Any voting no or abstaining? All right, do you wish to renew your motion to approve as substituted? So moved. Okay, is there a second for that motion? All right, is there any discussion at this juncture? Mr. Spain, you have the floor, sir, if there's anything you wanna share.

1:20:05 – 1:20:54•Jason Spain

I'm happy to give a brief explanation. This rule change comes to us from finance and basically separates the way the council will consider initial resolutions and capital spending plans. Right now, those two things are combined into a single resolution, but they're actually separate items. Initial resolution is required by law, authorizes the issuance of bonds, is published in a newspaper of general circulation, gives citizens the right to protest. Whereas, as you all know, CSP allocates funding to specific capital projects. We have specific rules about how we address CSPs. There's automatic d

1:20:56 – 1:23:32•Angie Henderson

Appreciate the explanation. Is there any discussion on this proposed change to Rule 21? Okay, seeing none, we will move to the vote. We'll try it first by voice. This requires 27 votes for changing our rules, okay? All in favor of the motion to amend our rules with this substitute, please say aye. Aye. Anybody no? Any abstaining? All right, this rule change has passed. All right, next, we are moving into our public hearings, two resolutions and many more bills, sections J and K of our agenda. And I'll just share this information first for both sections as it applies to all the public hearing.

1:23:33•Jacob Kupin

Thank you, Madam President. Committee reports, please.

1:23:35•Angie Henderson

All right. For the report of the Government Operations and Regulations Committee, Chair Eastlick. Oh, I'm sorry, sir. Wrong button. Go ahead.

1:23:44•Jeff Eslick

Thank you, Vice Mayor. GovOps voted eight in favor, zero against, one not voting.

1:23:49•Angie Henderson

Okay. All righty. With that committee report in, do you seek to open the public hearing?

1:23:53•Jacob Kupin

I seek to open the public hearing, please.

1:23:55 – 1:24:30•Angie Henderson

Okay. I declare the public hearing open for Councilmember Coopan's Resolution 2293. Would all members of the public hear in support of this resolution? Please raise your hand. Thank you. Would all members of the public here in opposition to this resolution, please raise your hand. Seeing no one here in opposition, does the person here in support seek to be recognized or speak? You would like to speak? Okay, you can go to the public podium, please, sir. Go ahead, you're recognized.

1:26:10•Angie Henderson

All right. Thank you. Is there anyone else seeking to be recognized? I declare the public hearing closed. And it's back to you for a motion on your bill. Thank you, Madam President. Move approval with a brief comment, please. All right. Is there a second?

1:26:21 – 1:26:59•Jacob Kupin

All right. Go ahead, sir. Thank you. And I can't add much more than Mr. Rasmussen just did. But these are buildings that were affected by the bomb, as you heard. And Second Avenue, as you know, DTC is by right for STR. And the reason it's coming before us is just because of Riverfront Park picking up that 100 feet from park rule. So I'm very careful to work with neighborhoods in other areas as far as where we put short-term rentals, acknowledging our need for housing. But this is a building that has had that right before, obviously has experienced a great trauma and tragedy. And so I urge my c

1:27:00•Angie Henderson

All right, is there any further discussion on this resolution? Oh, okay, Ms. Suarez, you're recognized. Go ahead.

1:27:28 – 1:28:04•Angie Henderson

Any further discussion? Seeing none, all in favor, please say aye. Any voting no? and any abstaining in addition to Ms. Suarez? Nope, all right. That resolution has been adopted. All right, next is agenda item two, resolution 2026-2294, sponsors Webb, Spain, Evans-Segal, and Huffman. This is a resolution establishing the Rivergate Infrastructure Development District. Council Member Webb, you're recognized. Committee reports. For the report of the Budget and Finance Committee, Chair Spain.

1:28:05•Jason Spain

Thank you, Madam President. Budget and finance recommended approval. 10 in favor, zero against, zero not voting.

1:28:10 – 1:28:27•Angie Henderson

Okay, and for the report of the Transportation and Infrastructure Committee, Chair Evan Siegel. Or Vice Chair Allen, do you see the report regarding 2294, Rivergate Infrastructure Development District?

1:28:31•Angie Henderson

Let the record show, Chair peeked your head in and gave you the nod. Go ahead, ma'am. Thank you. Thank you.

1:28:36•Burkley Allen

Transportation and infrastructure voted seven in favor, zero against, and one not voting. Okay.

1:28:42 – 1:29:39•Angie Henderson

Got it. All right. With those reports in, it's back to you, Ms. Webb. I'd like to open the public hearing. All right. I declare the public hearing open for Council Member Webb's resolution 2294, establishing the Rivergate Infrastructure Development District. Would all members of the public hear in support of this bill? Please raise your hand. Thank you. Would all members of the public here in opposition to this bill please raise your hand? Seeing no one here in opposition, does the person here in support seek to be recognized? She is shaking her head no. And so with that, I will declare the pu

1:29:45 – 1:30:58•Angie Henderson

Seeing none, all in favor, please say aye. Any voting no or abstaining. All right, council has adopted this resolution. Next, section K, bills on public hearing. First among those, we can take agenda items three and four together as they are companions to each other, Ms. Gadd. But just for purposes of the record, agenda item three is ordinance BL 2025-703, sponsors Gadd, Horton, and Allen. This is an ordinance to amend Title 17, the Metro Code of Law. This is an ordinance of the Metro government. By applying a historic landmark overlay district for property located at 4301 Harding Pike, 296 fe

1:31:07 – 1:31:32•Angie Henderson

All right, there is a motion to defer both 703 and its companion 704 to the first meeting in March. Okay, it's properly seconded. Is there any discussion on that deferral motion? Yes, ma'am.

1:31:47 – 1:34:23•Angie Henderson

I apologize if I misspoke. We were speaking about 703 and it's companion 704. I apologize if in referencing back, I may have looked at that three and thought it to be an eight. Maybe I need to get my glasses updated. Thank you for the clarification, Ms. Lee. Is there any further discussion on the motion to defer both these bills to the first meeting in March? Seeing none, all in favor, please say aye. Aye. Any voting no, any abstaining? All right, these have been deferred. Next is agenda item five, ordinance BL2026-1395, sponsor Welsh. This is an ordinance to amend title 17, the Metro Code of

1:34:30 – 1:35:06•Angie Henderson

Yes, ma'am. I declare the public hearing open for Ms. Lee's bills 1400 and 1401. Would all members of the public hear in support of these bills? Please raise your hand. Thank you. Would all members of the public hear in opposition to these bills? Please raise your hand. Seeing no one here in opposition, do the persons here in support seek to be recognized or speak? All right. Go ahead and come on forward. You are recognized.

1:35:32 – 1:35:51•Angie Henderson

Thank you. With that, seeing no one else seeking to be recognized for the public hearing. Okay, I declare the public hearing closed. And it's back to you, Ms. Lee, for a consolidated motion, if you wish, on these bills. I would like to move approval with a comment, please.

1:36:24 – 1:36:37•Angie Henderson

All right, is there any further discussion on this motion to approve both these bills on their second of three readings? All right, Ms. Evans, you're recognized.

1:36:39 – 1:37:30•Erin Evans

Thank you, Vice Mayor. until the speaker came to the podium, I probably wouldn't have, this would have just passed me by and I would have voted like everyone else. But I guess just to flag for the council member is that I have an existing Meritage subdivision in my community. And so one thing to kind of put on her radar is that this particular project that I have had in my district has had a lot of problems related to HVAC installation and not being done properly. And now as the community has been around for several years, there's been issues that have in some cases fallen outside of the warra

1:37:31•Angie Henderson

All right. Is there any additional discussion? Ms. Lee, you're recognized again.

1:38:34 – 1:40:57•Angie Henderson

All righty, is there any additional discussion on the motion to approve these companion bills on their second of three readings? Seeing none, all in favor, please say aye. Aye. Any voting no? Okay, any abstaining? Okay, again, these are on their second of three readings, so no votes and abstentions at this time are, Okay, and on we go. All right. Thank you, Madam Chair. These have passed their second of three readings. Next is agenda item eight, Ordinance BL2026-1433, sponsors Stiles and Allen. This is an ordinance amending chapters 2.240, 6.28, and 7.08, and Title 17 of the Metro Code of Laws

1:42:39 – 1:42:52•Angie Henderson

All right, that concludes the report of the Planning Department on behalf of the Planning Commission. This have been disapproved. And so with that concluded, it is back to you for a motion on your bill, Ms. Stiles.

1:42:52 – 1:43:33•Joy Styles

I'd like to move for approval with a brief comment, please. All right, is there a second? It's seconded, go ahead, ma'am. So some of the concerns that the planning table just mentioned, we have addressed in an amendment for Title II so that adults... day services could also be expedited the same way that childcare can. So that was an amendment that is present for us this week. So that was not done when we had originally presented this bill to planning. So that is an update. So things are more in line. And so I'd like to move for approval. The reason why I'm doing this, daycare is a pejorative

1:43:36•Angie Henderson

Did you already move approval before you were speaking about the bill? I apologize. So you've already moved approval and gotten a second. I apologize, ma'am. Go ahead.

1:43:43 – 1:44:30•Joy Styles

No worries. The reason why I did this in the first place was because daycare is a pejorative term within childcare, the childcare world. And so I just wanted to make sure that all of our language was in keeping with what is being used in that industry. It's something that has come up. I went to a conference, spoke on a panel earlier this year with the United Way, with the Alice Conference, and it was something that came up several times, making sure that daycare was no longer being used because childcare is a lot more comprehensive in terms of the educational needs that are taking place for ch

1:44:31•Angie Henderson

All right. Um, you have the floor. Do you wish to offer, um, one or the other of the amendments of which you spoke?

1:44:39 – 1:44:55•Joy Styles

Uh, yes, please. Okay. So, um, The amendment for Title II is the one that I mentioned that makes it so the administrator can allow for the adult day services to be expedited just like daycare would be as well.

1:44:55 – 1:45:38•Angie Henderson

So would you please make a motion and clarify which? I'd like to move that amendment for Title II. Okay, so it's Amendment 1. Amendment 1, yes. So there is a motion to amend with Amendment 1. Is there a second for that motion? Okay. Okay. Is there any further discussion on the motion to amend with Amendment 1? Ms. Allen, do you seek to be recognized on Amendment 1? Okay, so not on Amendment 1 at this time. Does anyone seek to be recognized specifically on the motion to amend with Amendment 1? Okay, Ms. Lee on Amendment 1? I had a question. Yes, ma'am.

1:45:45•Angie Henderson

My fear is...

2:36:45 – 2:36:56•Angie Henderson

Hang on. Let's... Go ahead. So there is a motion to defer two meetings. It's properly seconded. Now, if you want to speak on that deferral, please continue. Thank you.

2:36:56 – 2:37:40•Ginny Welsch

I heard that second in my head. I feel like there are too many unanswered questions. And my fear is that this is actually backdoor surveillance. I really would like it spelled out if the use for some of this computer aided Information is actually fuses So I think that a deferral will help us get those questions asked and again I would like to see the old contracts that under this make sure Compare the language and see what's changed so that we can put the community's mind at ease that this does not have actually a nefarious purpose and I feel like the administration has not been totally forthc

2:37:40 – 2:37:59•Angie Henderson

All right, there is a motion to defer two meetings, which would mean that it would be taken up again at the first meeting November Per this deferral motion it is properly seconded and so we are on to discussion specifically on the deferral motion Councilmember Spain on the deferral.

2:38:01 – 2:38:39•Jason Spain

Thank you, madam president. I'm opposed to the two meeting deferral. I appreciate the sponsors concerns But respectfully those questions have been asked and answered in various committees already This agreement which is an existing agreement ended at the end of July. So we are operating under a a good faith extension, I guess you'd say, of that contract at this point. If this is not renewed, Department of Emergency Communications has said they'll have to go back to a pad and paper basically to handle dispatch to make sure that NFD and MNPD are getting to where they need to go to take care of o

2:38:39•Angie Henderson

All right, on the deferral motion, Mr. Nash, you're recognized, sir.

2:39:40•Angie Henderson

All right. So discussion continues on the deferral, specifically the two-meeting deferral. Ms. Porterfield, you're recognized.

2:39:49 – 2:41:30•Delishia Porterfield

Thank you, Vice Mayor. I stand in support of the two-meeting deferral. I thank Council Member Welch for bringing it. I was debating bringing a deferral myself, so thank you for doing the hard work on that, Council Member Welch. I did ask the question. We were notified in committee that the contract was up, and I did ask the question about what does that mean and how do they continue to operate. I did not hear an answer about that. pencil and paper, so we may have, there may have been some crossed wires or some, we may have heard different information, but that's not the information that I hear

2:41:31 – 2:41:42•Angie Henderson

All right, is there any further discussion on the two meeting deferral motion? Mr. Benton, go ahead, sir.

2:41:44 – 2:42:02•David Benton

Could I ask somebody maybe at the front desk, is there any guarantee that we will continue to have the current system we have? A guarantee that we'll have service with CAD because we're so big of a city. If we don't have it, it's gonna be disastrous. So I just need the guarantee that we're okay.

2:42:02 – 2:42:27•Angie Henderson

So the question relative to the two meeting deferral proposal is to the administration to confirm if they will be able to continue to operate under this sort of good faith extension. Okay, Mr. Rosenberg, do you, oh, from the legal department, if you would please introduce yourself. Go ahead, you are recognized.

2:42:45 – 2:42:59•Angie Henderson

All right, Mr. Benton, does that fully answer your question? Okay. All right. Ms. Welsh, do you seek to be recognized again on the deferral? I see you in the queue here. Okay, go ahead, ma'am.

2:43:00 – 2:44:15•Ginny Welsch

I would like to ask the legal department, I suppose, if I could, if they could actually produce the contract that supposedly expired on June 30th. I understand a community member asked the interim director of DEC and they said they didn't have the contract and they couldn't produce it. I would really like to see that contract to see what the language was. And I also have a bit of a concern because this yet again is another, if we don't do this, everything's going to go to hell in a handbasket. This seems to be the way we do a lot of things with the administration, especially in terms of things

2:44:16 – 2:45:47•Angie Henderson

All right. Is there any further discussion on the two meeting deferral motion? Okay, seeing none, all in favor of a two meeting deferral, please say aye. All against, please say no. Yeah, I agree. Mr. Clerk, would you please put it on the boards? I cannot determine that by voice. Thank you, Mr. Clerk, please show the vote. All right, the motion to defer two meetings fails with 10 votes in favor and 24 against. We are back on the motion to approve as amended. Is there any further discussion on the motion to approve? Okay, Ms. Porterfield, you're recognized. Thank you, move for a one-meeting def

2:45:52•Angie Henderson

Why is it not a valid motion? Special counsel.

2:46:15•Delishia Porterfield

Thank you. Would a date change not be a change to the motion since it's one meeting instead of two?

2:46:22 – 2:47:04•Angie Henderson

Okay, thank you. Rules on debate, Ms. Sepulveda, or as a point of order? I have a motion. Okay, go ahead, ma'am. Move to defer one meeting with re-referral to committee. Okay, all right. That is a proper motion. So now there is a motion to defer one meeting with a re-referral. Could you clarify Ms. Sepulveda to both committees or just one perhaps? Both committees. Okay, with a re-referral to both committees. Is there a second for that motion?

2:47:06 – 2:47:17•Angie Henderson

All right, so we are on to debate for the motion to defer with a re-referral to committees. Ms. Welsh, you are recognized.

2:47:18 – 2:48:02•Ginny Welsch

Thank you, Vice Mayor. I have two questions. One is why the existing contract is not on the government website. And my understanding is that the existing contract that expired in June did not have CAD in it. So we were told that was a separate thing. So again, I would like to really see these contracts. and know what's going on and make sure that we know exactly what it is we're getting into. Motorola is not the best partner in the world. They were major supporters of Project 2025. And as one of our public commenters spoke earlier about, They also support ICE and Border Patrol. So they're not

2:48:02 – 2:49:12•Angie Henderson

Ms. Welsh, did you want me to address the question specifically regarding the contract being online? Okay, all right. Metro Legal, can you respond regarding Ms. Welsh's question? The current contract, which you mentioned having expired on June 30th, can that be found online? If not, why please? Macy Amos from Metro Legal. I am certain that the contract is online. I will find it and send it to you tonight. Okay. Ms. Amos, if you would please send it to Special Counsel Wilson so he can send it to the entirety of the body, that would be great. Okay, next in the queue for discussion on, again, the

2:49:14 – 2:49:56•Delishia Porterfield

Thank you, Vice Mayor. I stand in support. No surprise that I'm standing in support of this. I just asked my colleagues to support. You know, this is splitting the baby. If you felt like two meeting deferral was too long, this is just a one meeting deferral. I understand the concern about, you know, what if Motorola pulls out? It's highly unlikely that they're gonna pull out. They want the contract. They wanna keep doing business with Metro, so they're not gonna pull out and stop offering these services. So I do think that this gives us more time to investigate this a little bit more and to ge

2:49:57 – 2:51:19•Sandra Sepulveda

Council Member Sepulveda, Madam Chair, you're recognized. Thank you, Vice Mayor. I obviously stand in support of the one-meeting deferral. I'm hearing that their last contract that's on the website is from 2009. So I think it's important to have the contract. Also, apparently we've been operating without a contract since June or July. So I think one meeting deferral just to get all our ducks in a row is not unreasonable. I think just for... my own sake and some of our colleagues that have some concerns. I think an amendment with specific language to name a specific ordinance, I think would be

2:51:22•Angie Henderson

All righty, on the deferral motion, Mr. Huffman, go ahead, sir.

2:51:25 – 2:52:14•Jordan Huffman

Thank you, Vice Mayor. I just want to reiterate what Chair Spain had highlighted before and what Metro Legal has highlighted. We are essentially at the beck and call of a company that provides a service not only for this department, but for this city. Public safety is our number one interest here in Nashville. It should be and it's up to us to protect the public. If we don't have a system such as this, it would be pure anarchy, unfortunately. The ability to not be able to tell someone where to go in an emergency is something that keeps me up at night even thinking about that. I would urge my c

2:52:15 – 2:52:27•Angie Henderson

All right, discussion continues on the deferral motion, Mr. Spain. Okay, we'll go to Mr. Nash. You're recognized, sir.

2:53:31•Angie Henderson

Council Member Spain on the deferral, sir. Go ahead.

2:53:35 – 2:53:55•Jason Spain

Thank you, Madam President. Just to follow up on what my colleague said, we heard in committee that it would take 18 to 24 months to replace the Motorola system with a new vendor. So that's just not a realistic solution. We need to move forward to make sure we maintain the service we have with our current vendor. So I hope that you'll vote down the deferral and move forward tonight. Thank you.

2:53:57•Angie Henderson

Is there any further discussion on the motion to defer one meeting with a re-referral to both committees? Ms. Benedict, you're recognized.

2:54:08 – 2:55:17•Emily Benedict

Thank you, Vice Mayor. Colleagues, I rise in support of the deferral. I think as a body, our job is to make things better. right, to make law better, to make agreements better. And I don't feel comfortable right now having not reviewed the existing contract because it's not available. And the fact that we could get it later tonight is great, but that's not before a vote right now. And so I'd like to review that. I'd like to see if there's things that we can improve upon that. We've already seen an amendment to this resolution since the last meeting. If there's things that we can do to improve

2:55:18•Angie Henderson

All right, is there any further discussion on the deferral motion? Okay, Ms. Ellis.

2:55:45 – 2:56:09•Angie Henderson

To whom would you like me to address that question? The administration or either legal. Okay. I'm just going to address it to the administration table, whether that's the mayor's office or legal. What would the hypothetical backup plan be? Would Motorola not extend in good faith for two more weeks? Yes. Okay. Mr. Rosenberg, you're recognized.

2:56:20•Angie Henderson

Ms. Ellis, does that fully answer your question?

2:56:25 – 2:57:42•Angie Henderson

Okay, all right. Seeing no further discussion on the deferral motion and an abundance of caution, Mr. Clerk, would you please load the vote for the one meeting deferral? With re-referral, I guess. Clerk, please show the vote. The motion to defer one meeting fails with 14 in favor of the deferral, 20 votes against and zero abstentions. And so that reverts us to the approval motion and discussion continues. Is there any further discussion on the motion to approve? Council Member Porterfield.

2:57:43•Delishia Porterfield

Thanks, Vice Mayor. How many, does this just need to pass with a simple majority or does it need 21 votes or how many votes are needed?

2:57:49•Angie Henderson

Special counsel, is there a specific vote requirement for this type of resolution?

2:58:05 – 2:58:18•Angie Henderson

It's just a simple majority. Thank you. Okay. Okay, is there any further discussion? Council Member Allen, you're recognized.

2:58:18 – 2:59:01•Burkley Allen

Thank you, Madam Chair. We had a speaker at the beginning of the meeting that asked if their statement was, could we add a sentence that says anything that would be acquired that is subject to Section 13808, which is the surveillance section, would have to comply with that section. And so I would like to ask legal to respond. If something is subject to 1308, it would have to comply with that. section, is there any circumstance where it's a small enough addition to the contract that it would slide under or by passing this resolution, if there is an addition made later that is subject to that, c

2:59:02•Angie Henderson

All right, so as I understand the question, if this were to pass and there were to be a future,

2:59:13 – 2:59:40•Burkley Allen

Amendment to the contract. Is that what you're saying? So I mean the question there is language in the amendment that refers to improvements or refinements or enhancements or whatever and I Appreciate concerns about surveillance and if we can assure people that the language is tight enough that that is that we have covered that without needing to add the language that was suggested I would I would appreciate knowing that Then we can make that statement.

2:59:40 – 3:00:10•Angie Henderson

Would you like me to address that to the legal department? Yes, I think legal or administration. Ms. Woodward, do you want to take that question for Metro Legal? Or Mr. Rosenberg, would you rather respond? Go ahead, sir.

3:00:42•Angie Henderson

And Ms. Allen, could you just sort of clarify your timeframe? It seems like you're speaking into the future about a future concern. Are you talking about like right now? Thank you for that question. Yeah.

3:00:52 – 3:01:34•Burkley Allen

Again, just trying to be responsive to things that we hear during public hearing. The statement was made there that the language, and I need to look at the proposed amendment, said... This agreement may not be used for the provisions of product services necessary to enable them to maintain support, secure, and enhance computer aid and dispatch functionality, including upgrades. I think that was the question. Could upgrades include that? I hear you saying no, because it would require a public hearing. And so that assures us that we know what we're restricting this to. computer-aided dispatch on

3:01:55•Angie Henderson

All right. Does that answer your question? Okay. Ms. Evans-Segal, you're next in the queue. Go ahead, ma'am.

3:02:05 – 3:03:31•Quin Evans Segall

Thank you, Madam President. I just wanted to rise to explain that I'm going to vote to support this tonight. I think there was a robust conversation in public health and safety also tonight on the floor that think makes clear some of the concerns. But I also just want to say we wouldn't be here if three years into this term we were still not getting things way, way later than we should be on a contract where this apparently they could just stop servicing us tomorrow and we'd be on pen and paper. And this contract just came to us how recently ago and how long was it expired before it came befor

3:03:32 – 3:05:39•Angie Henderson

Thank you. Council Member Johnston, you're recognized. Previous question. All right. Ms. Johnson has called the question. This requires a second. Okay. Non-debatable and requires two-thirds of those voting. If you want to call the question, you want to end debate and move to the vote, we'll try it first by voice. Please, in number, not in volume. All those in favor of calling the question, please say aye. All those who do not wish to call the question, please say no. I believe the ayes have it. Roll call, okay. That roll call request needs two seconds, three seconds. Okay, three, got them. Mr.

3:05:40•Sandra Sepulveda

Thank you, Vice Mayor. I know I'm last. I only have a quick question. I have a question for the administration, whether FUSES and CAD have been integrated.

3:05:56 – 3:06:08•Angie Henderson

Okay, let's see. We're on a motion to approve as amended, so I will consider that a proper question, because we're not talking about deferrals anymore. To the administration, Mr. Rosenberg.

3:06:26 – 3:06:57•Sandra Sepulveda

Is our current CAD that is being considered, has it been integrated with fuses? Ms. Sepulveda, here in Nashville or you're saying in general? The one that we're considering in our current contract, want to know if it has already been integrated with Fuses or does it have the possibility of being integrated with Fuses for its enhancement? Does it have the functionality? Correct.

3:07:07 – 3:07:27•Angie Henderson

We do not use fuses in Nashville Thank you All right, is there any further discussion on the motion to approve as amended Okay, I'm seeing none mr. Clerk if you would please load the vote I

3:08:09 – 3:08:57•Angie Henderson

All right, is there a second? Properly moved and seconded. Is there any discussion on this resolution? Seeing none, all in favor, please say aye. Aye. Any voting no, any abstaining? Okay, Mr. Prepti will be recorded as an abstention. All right, you have adopted this resolution. Next is agenda item 41, resolution 2026-2305, sponsors Spain and GAD. an initial resolution determining to issue general obligation bonds to the Metropolitan Government of Nashville and Davidson County in an aggregate principal amount not to exceed $544,720,000, also known as the capital spending plan for the report of

3:11:16•Jason Spain

Thank you, Madam President. Just a point of order. Do we do a committee report on this one or is it an automatic deferral by rule?

3:11:22•Angie Henderson

You do take a committee report because it was discussed in committee, but the 8.1 will apply, so we just request the report. Go ahead, sir.

3:11:30•Jason Spain

Got it, thank you. Committee reports, budget and finance recommended one meeting deferral, nine in favor, zero against, one not voting.

3:11:35 – 3:12:15•Angie Henderson

All right, and by rule, as this is the capital spending plan and with that motion, this is deferred one meeting and will be taken up again at the second meeting in October. Okay. Agenda item 43, or rather resolution 2026-2307 sponsors Spain, Horton, Welsh, Gatton, Huffman, a resolution authorizing grants not to exceed $1,392,032 from the Barnes Fund for affordable housing to certain nonprofits for the express purpose of rehabilitating affordable or workforce housing. 3:12:15•Jason Spain

Thank you, Madam President. Committee reports, budget and finance recommended approval, nine in favor, zero against, one not voting.

3:12:20 – 3:12:38•Angie Henderson

Okay, and for the report of the Planning and Zoning Committee, Chair Horton, or Vice Chair Harrell, perhaps. For the report of the Planning and Zoning Committee for the resolution regarding the Barnes funds, it was 2307, resolution. Vice Chair Harrell.

3:12:39•Deonté Harrell

3:13:15 – 3:13:27•Angie Henderson

Okay, that's fine. Y'all may abstain at the time and then we'll just record it then. All good. All in favor, please say aye. Any voting no. And any abstaining aside from Ms. Gamble and Ms. Allen. Any additional abstentions?

3:13:28•Burkley Allen

Okay, you all will be recorded as abstentions.

3:14:18 – 3:14:33•Angie Henderson

Okay. And did you take up the amendment, Ms. Sepulveda, and have a recommendation on that? You did not. Okay. So the recommendation of the committee was two-meeting deferral. Is that correct? Okay, back to you, Council Member Cortez.

3:14:33•Mike Cortese

Yes, Vice Mayor. Move for two-meeting deferral.

3:14:35 – 3:15:26•Angie Henderson

Okay. There's a motion to defer two meetings. It's properly seconded. Is there any discussion on the deferral motion? Seeing none, all in favor, please say aye. Any voting no or abstaining? Rules voted, five in favor, zero against, zero not voting. Okay.

3:17:52•Erin Evans

Back to you, Ms. Evans. Thank you, Vice Mayor. I just wanted to find out if we could move to invoke Rule 12.3 for anyone voting in the affirmative.

3:18:02 – 3:18:13•Angie Henderson

Yes. So you would like to make a motion to approve with 12.3 applied? Yes, ma'am. Such that everybody voting in the affirmative will be listed as a co-sponsor. It's properly seconded. Go ahead.

3:18:13 – 3:18:55•Erin Evans

Thank you. I appreciate everybody's support of this one. This one, if you don't know Jerry Vandiver, chances are if you're a district member, you will eventually get to know him. He is really well known with his songwriting career, but also with his work with Walden's Puddle to be able to help foxes that have mange and other ailments kind of be restored to the original versions of their fluffy selves. And he's done a tremendous amount of work in Davidson County. And with his recent spotlights and various publications, wanted to make sure that we also had a chance to recognize him. And I apprec

3:18:56•Angie Henderson

All right. Is there any further discussion? Ms. Stiles, you're recognized.

3:19:01 – 3:19:24•Joy Styles

Thank you very much. I wanted to thank the sponsor for doing this resolution for Jerry. He is very active and he is very well known in the music community. He's an amazing songwriter and it's great that his heart covers a multiple variety of interests and is passionate about every single one. So thank you very much. Thank you.

3:19:25•Angie Henderson

All right, seeing no further discussion, all in favor, please say aye. Any voting no or abstaining?

3:19:35 – 3:20:08•Angie Henderson

3:20:13 – 3:22:11•Terry Vo

Thank you, I move to approve with a brief comment. Go ahead. Thank you so much. I'm really excited to be able to celebrate Filipino American History Month in our city because it's really important to take every opportunity we can to recognize a community whose history, culture, and contributions are important to the part of the story of America and of Nashville. And an estimated 4,000 Filipino Americans live here in Davidson County. and they contribute to our community in so many ways, and I really wanted to highlight one tonight. This year, the National Rondalia Project, which is the first of

3:22:11 – 3:22:51•Angie Henderson

Thank you. Thank you. Is there any further discussion on this resolution? Seeing none, all in favor please say aye. Any voting no or abstaining. All right, you have adopted this resolution. All right, that concludes our resolutions and now we're in section N of our agenda, bills on introduction and first reading. By rule, all items on first reading shall be voted on at the same time unless requested otherwise by the primary sponsor or by two other members. Do any items need to be removed from the collective first reading vote? Council Member Harrell, did you have something, sir?

3:22:52 – 3:23:04•Angie Henderson

Okay, agenda item 90 will be removed from the first reading vote. Thank you, sir. Council Member Kupin, you're recognized.

3:23:05•Jacob Kupin

Thank you, Madam President. I need to remove item 64 and item 89, please.

3:23:13 – 3:24:17•Angie Henderson

Okay, 64 will be removed. And then say again the second one, please, sir. 89. 89. Okay, got it. All right, so you've heard the items that have been removed from the collective vote. Is there a motion for approval of all items remaining on first consideration? Okay, properly seconded and so without objection. Okay, you have approved all items on first reading with those three exceptions and we'll go back to those items in agenda order. Okay, first was agenda item 64, ordinance BL2026-1580, sponsor Coopin. This is an ordinance amending titles two, six, and 16 of the Metro Code of Laws to establi

3:24:17•Jacob Kupin

Thank you, Madam President. I'd like to move to approve on first and then defer second reading to the first meeting in December with a brief comment.

3:24:26•Angie Henderson

Okay, is there a second for that motion?

3:24:30 – 3:25:10•Jacob Kupin

Okay, go ahead, sir. Thank you, appreciate a lot of folks in the administration and different departments working on this piece of legislation. There are a number of areas downtown that have popped up these little food truck vendor things that have become safety issues. the food safety issues, there's french fries being stored on the ground, et cetera, et cetera. Not great situations. And they're kind of working through a loophole in the code right now. And so we wanted to kind of clean that up and create some clear regulations around it. But the legislation does need some more time for some a

3:25:10 – 3:26:53•Angie Henderson

All right. You've heard an explanation from the sponsor of his motion to pass on first reading and defer second reading to the first meeting in December. Is there any further discussion? Seeing none, all in favor, please say aye. Any voting no or abstaining? All right. This will be taken up again in December. Next on first reading. is Agenda Item 89, Ordinance BL-2026-1605, Sponsor Coupon. This is an ordinance of Mentalis 17, the Metro Code of Laws, zoning ordinance of Metro Government by changing from IR to MUANS zoning for property located at 1326 3rd Avenue North, approximately 70 feet sout

3:26:54•Deonté Harrell

Thank you Madam Vice Mayor, so I want to move substitute for this Okay, let's first get it before us sir with an approval motion. I want to move for approval Okay, go ahead sir.

3:27:03•Angie Henderson

Now you can move this up. So I like to move the substitute Okay, anything you want to share about what the substitute does?

3:27:10 – 3:27:22•Deonté Harrell

Yes, so this is attached to the main bill it restricts the number of units and then also there is a language in regards to the materials.

3:27:23 – 3:27:42•Angie Henderson

Okay, all right. Is there any further discussion on the motion to substitute? Seeing none, all in favor, please say aye. Any voting no or abstaining? Okay, so the substitute is on. If you just renew your motion, please, sir, to pass on first as substituted.

3:27:42•Deonté Harrell

So I don't want to pass. I want to defer as substituted.

3:27:51•Deonté Harrell

All right, so we'll move forward passing this one.

3:27:53 – 3:29:21•Angie Henderson

On first, do you want to defer the next reading? No. No. Okay, so the motion is a motion to approve on first reading as substituted. Correct. Okay, I heard a second. Any discussion on that? Seeing none, all in favor, please say aye. Any voting no or abstaining? All right, this has passed its first reading as substituted. Next, okay, that concludes the first reading matters. And now we're on to a second reading matters that were not... on consent earlier section o of our agenda first in that section is agenda item 92 this is ordinance bl 2026-1450 sponsors cortez ellis and suara this is an ordi

3:29:21•Jason Spain

Thank you, Madam President. Budget and finance, I recommend approval of the substitute, 10 in favor, zero against, zero not voting, and approval of the bill as substituted, 10 in favor, zero against, zero not voting.

3:29:29 – 3:29:53•Jeff Preptit

all right and for the report of the public health and safety committee chair prep t you're recognized thank you madam vice mayor uh the committee considered the uh substitute and voted nine in favor zero against zero not voting to approve um the committee did not um undertake a review of the late filed substitute and then we uh voted to approve the bill as substituted with the first substitute eight in favor zero against one not voting okay

3:29:55•Angie Henderson

All right, with those committee reports in, it's back to you for a motion, sir.

3:30:00 – 3:30:12•Mike Cortese

Thank you, Vice Mayor. Can we move the bill for a one meeting deferral without the substitute, just as is? I would like to move the original bill for a one meeting deferral. to the next meeting.

3:30:12 – 3:30:28•Angie Henderson

Okay. There is a motion to defer one meeting. Is there a second for that motion? Second. Okay. So we're on to discussion on the one meeting deferral motion. Chair Prepti, do you seek to be recognized?

3:30:30 – 3:31:25•Jeff Preptit

Thank you, Madam Vice Mayor. I rise in favor of the motion to defer one meeting. And I also want to state on the record, like I did within committee, thanking the sponsor for his leadership and for his collaborative work on this topic in particular. This has been an emerging threat that we've been able to identify over the past couple of months. As I stated in committee, I attended a seminar with the Institute for Constitutional Advocacy and Protection through Georgetown Law, talking directly about how bad actors online will utilize AI to target our youth, to extort them, either to get them to

3:31:26 – 3:32:13•Angie Henderson

Is there any further discussion on the one meeting deferral motion? Seeing none, all in favor please say aye. Any voting no or abstaining? All right, this has been deferred. One meeting will be taken up again at the second October meeting. Next is agenda item 93, ordinance BL 2026-1497, sponsors Sepulveda, Welsh, Evan Siegel, Benedict, Suara, Gadd, Ewing, Horton, Porterfield, Vaux, Parker, Bradford, and Harrell. This is an ordinance to amend chapter 12.12 of the Metro Code of Laws relative to right turn on red, reporting requirements regarding roadway safety and other related clarifications. C

3:32:14•Sandra Sepulveda

Thank you. I know there's a couple of amendments. I'll let them move them, and I'll speak on those, and then I'll come back to the bill.

3:32:23 – 3:32:52•Angie Henderson

All right, okay, so we are on to discussion. Oh, I'm sorry, yes, ma'am, we need to get your committee reports. The report of the Transportation and Infrastructure Committee. Why am I not seeing this here? Okay, we got a re-referral in here. I'm sorry, Chair, go ahead, ma'am. You're fine.

3:32:54 – 3:33:18•Quin Evans Segall

On amendment one was not moved in committee. Amendment two, the committee voted five in favor, three against, zero not voting. Amendment three, the committee voted zero in favor, seven against, one not voting. Amendment four, the committee voted eight in favor, zero against, zero not voting. And as amended with amendments two and four, the committee voted eight in favor, zero against, zero not voting.

3:33:18•Angie Henderson

Okay, thank you for that report. And at this time, Ms. Sepulveda, do you seek the floor or are we just on to discussion?

3:33:31 – 3:36:09•Sandra Sepulveda

Go ahead, ma'am. I'll say briefly. I want to say thank you to everyone from the community who has spoken on this topic in favor and against. It has really helped, you know, drive the substitute So we have heard from community members where this has directly affected them. The reason the substitute is created the way it is is because it uses the manual on uniform traffic control devices for streets and highways, which is a national standard. And so I would encourage you all to keep it as substituted. This is the way many of our peer cities use our data and statistics. We have seen the cities th

3:36:10•Angie Henderson

All right. We're on to discussion. First in the queue is Council Member Eastlake. You're recognized, sir.

3:36:16 – 3:38:38•Jeff Eslick

Thank you. How did we get here? A member in this body decided to do something and looking for a bill that would let them say they did it. This is how we got here. Not a request from NDOT. Not a finding that right on red is killing people. But a determination to push past the data, past the experts, past the people who have to live with it. The department that owns the signals opposed the original draft, overly broad. That's what they said. More than 700 intersections. The mayor asked for a pilot. We did not get a pilot. We got a substitute written so the same idea could survive. 59 corners now

3:38:40•Angie Henderson

All right, Council Member Kupin, you are recognized.

3:38:45 – 3:41:41•Jacob Kupin

Thank you, Madam President. And I wanna say deep thanks to the sponsor of this bill. She's come to community meetings and I know she and I share a deep care for pedestrian safety in our city. And I think we are both as many others frustrated with the lack of action on this front. As the downtown council person, I think it's important to note, because we hear a lot about businesses, that I also represent 24,000 residents downtown, 24,000 people downtown who have thoughts and opinions on this, many of whom were not here over the two decades' worth of studies and information. Cited and I think a

3:41:44•Quin Evans Segall

Yes, point of parliamentary inquiry. Yes, I think this is an inquiry. Does the council member mean amendment one, which did not have a committee recommendation or does he mean amendment two, which did?

3:41:56 – 3:42:32•Jacob Kupin

Can you clarify, Mr. Coopin? I can, thank you, thank you, Chair, and thank you, Madam President. So originally in committee, I had moved Amendment 2, which I was supportive of. I learned earlier this afternoon that that Amendment 2 would, due to its scope from Metro Legal's perspective, trigger a re-referral back to traffic and parking and a potential disapproval, et cetera, et cetera. So given that scope, and there were some data discrepancies in it as well, didn't want to move forward with that. But still, Amendment 1 was something that I did want to move forward with. So we didn't discuss t

3:42:33•Angie Henderson

Do you want to follow up and inquire if the amendment itself needs a committee report? Special counsel, can you address that parliamentary inquiry, please?

3:42:51 – 3:44:28•Angie Henderson

Okay. So you have made a motion to amend with Amendment 1. Is there a second? Okay. Is there anything additionally you want to say on that? Okay. So... There is a motion to amend with Amendment 1, which you've heard does not have a committee report, but you've heard the explanation of that from the sponsor of the amendment, and so we are on a debate for the motion to amend with Amendment 1. So we already have a pretty deep queue here. Do folks want to raise their hand if they want to speak specifically on Amendment 1, or do we wanna try to kind of clear the queue. I think this is gonna be sort

3:44:28 – 3:45:13•Quin Evans Segall

Thank you, Madam President. I rise. I'm opposed to this amendment. The council member could have gotten a recommendation in committee, even if he didn't want to move it today. And he had plenty of time to find out that this was going to be an issue before it came to committee. We had a robust discussion around Amendment 2. NDOT was available to answer questions. We talked about the MUTCD. We talked about all ABCD, ABCD. Six factors right on red plus discretionary ones and how they worked with the amendment. We were not able in committee to have that discussion around this amendment and this am

3:45:14•Angie Henderson

All right. Debate continues on the motion to amend with amendment one. Next is council member Nash. You're recognized, sir.

3:45:38 – 3:46:33•Angie Henderson

Are you seeking clarification of what Amendment 1 is in fact? Okay, Amendment 1 amends section three of the bill where it previously said there were 59 Ms. Special Counsel, would you like to respond for Amendment 1? Oh, Section 6, sorry. striking 59 intersections that were in Ms. Sepulveda's substitute and it says the signalized intersections where multiple crashes between a pedestrian or cyclist in a motor vehicle have occurred or a single crash between a pedestrian and a motor vehicle during the right turn since 2021 and effectively, yeah, it reduces it to 18 intersections from 59. That's ef

3:47:11 – 3:47:41•Angie Henderson

Okay. All right. So we are on the motion to amend with amendment one. You heard me read it, but effectively 59 is passed. stricken and it becomes 18 intersections. You can find this in your amendments packet on Legistar. I'm gonna add you, Ms. Gadd, to the discussion. Next in the queue is Councilmember Allen. Mr. Coopin, I'll add you towards the end again. Go ahead, Ms. Allen. I'm sorry. Go ahead. Okay.

3:47:41 – 3:49:50•Burkley Allen

Thank you, Madam President. I rise in support of this amendment. I appreciate what the sponsor has done to get this issue back on the forefront and to get us moving on doing important things to reduce traffic fatalities and specifically to pedestrians and cyclists. My understanding of Amendment 1 is that it does follow the MUTCD criteria. There's six, A, B, C, D, E, F. And that was where the original list of 59 intersections was derived from. What MUTCD says is a no turn on red sign should be considered when an engineering study finds that one or more of the following conditions exist. And the

3:49:51•Angie Henderson

All right. We continue debate on the motion to amend with Amendment 1. Next is Council Member Porterfield. You're recognized.

3:49:58•Delishia Porterfield

Thank you, Vice Mayor. I have a question to legal. Why did this not require a mandatory referral back to TMP when the other amendment did? It's my understanding that the other amendment did.

3:50:08•Angie Henderson

Do you want to address that to legal or special counsel? Can you address that?

3:50:13•Delishia Porterfield

If special counsel can't answer it, I don't care.

3:50:46 – 3:51:01•Delishia Porterfield

Okay, but amendment one was not considered at traffic and parking, correct? The amendment that we are addressing right now was not considered before the traffic and parking committee. Is that correct? That is correct.

3:51:04 – 3:52:23•Delishia Porterfield

Okay. Thank you. Um, I'm rising in opposition of this. Um, it's pretty frustrating. This undermines our process. We have a process in which things go before committee and that's when we do robust debate is actually in committee. So then when we come back to this floor, We can talk about what happened in committee. We can still have some form of a debate, but we're able to move forward. It's quite interesting that people that as a body, many of us focus on process and making sure that we are following those processes. And when it's convenient, we use that to undermine the legislation for moving

3:52:24•Angie Henderson

All right, Council Member Sepulveda on Amendment 1. Go ahead, ma'am.

3:52:30 – 3:55:32•Sandra Sepulveda

Thank you, Vice Mayor. I'm gonna rise in opposition of this. I understand what the District Council Member is trying to do. I also wanna mention that there have been a number of community members who worked on the amendment on the research that has gone through these data points, right, on Connect Downtown and these Vision Zero projects, et cetera, there are community members who took the time to be a part of this process, and I don't want to undermine that. I also wanna mention that it is more than just those six data points that went into this. NDOT considered not just MUTCD, they also consi

3:55:34•Angie Henderson

All right, thank you. On the motion to amend with amendment one, next in that queue is Council Member Gadd, you're recognized ma'am.

3:57:08 – 3:57:19•Angie Henderson

All right, Mr. Kupin, you are next in the queue, but then we have Mr. Horton and Mr. Spain. Do you seek to speak at this time? Okay, go ahead.

3:57:20 – 4:00:20•Jacob Kupin

Yeah. Thank you, Madam President. And then first I wanted to address something about, I can see how it would look disingenuous and sneaky and shady and maybe like I was trying to slip something through or bait and switch. That's not my intention. I was very confident and excited about the approach that I was taking yesterday. As we know, our wonderful council office team is doing the Lord's work with less people than they probably need and with a lot of stuff from all of us. And so I did not receive these amendments till late Sunday with a Monday deadline. So there was not time to then get Met

4:00:20•Angie Henderson

All right, next in the queue on Amendment 1 is Councilmember Horton, Mr. Chair, and after that is Councilmember Spain. Go ahead, sir.

4:02:29•Angie Henderson

Right. The only person remaining in the queue on Amendment 1 in particular is Council Member Spain. You're recognized.

4:02:36 – 4:04:44•Jason Spain

Thank you, Madam President. Colleagues, this is one of those bills where I feel like I've debated both sides of it in my head, and I don't think I've been right yet. I appreciate what the sponsor is trying to do, that she's trying to solve a real problem. I also appreciate that this substitute has a significant impact on the sponsor of this amendments district. And I think we owe it to him to take that into account. We've already heard a lot about everybody's favorite bedtime reading these days, the MUTCD and the six criteria. It seems to me that the one that NDOT seems to be hanging their hat

4:04:46 – 4:05:49•Angie Henderson

Okay. Special Counsel, did you want to... Okay, all right, so can you just share, special counsel, we're on debate about the motion to amend with Amendment 1, but you're moving a deferral. Is that an appropriate motion at this juncture? A motion to defer would be an appropriate motion on the entire. Okay, that just jumps over the amending motion. Thank you for the clarification. Okay, so what we have before us is a motion to defer one meeting with a re-referral to budget and finance and transportation and infrastructure. It's properly seconded. We still have a very deep queue, but we are now o

4:05:49•Emily Benedict

Was this referred to Budget and Finance currently, or is that a new request based on this motion?

4:06:07•Emily Benedict

Thank you. So I don't know where I am in the queue, but I would ask that the motion be amended to also go to Public Health and Safety Committee.

4:06:18•Angie Henderson

Mr. Spain, are you willing to amend your motion to that effect?

4:06:23 – 4:07:41•Angie Henderson

Okay, all right, it is a one meeting deferral and a referral to three different committees, all right. Okay, so at this juncture on the motion to defer, we have a queue that is, you don't, you do wanna speak on the door? Okay, all right, so we're gonna go back and... We're gonna retain this queue for the initial motion of approval, okay? And the subsequent motions, we're just doing by hand. And so if folks want to speak on the deferral motion specifically, if you would please raise your hand, okay? Ms. Ellis, anyone else on the deferral motion? Ms. Hill, okay. Ms. Ellis, you're recognized on t

4:07:57•Angie Henderson

So if these- We have not passed the CSP. The CSP was deferred one meeting.

4:08:11 – 4:08:24•Angie Henderson

Like, are we gonna discuss that while we're- That can be taken up in budget. Do you have an inquiry specific to the fiscal note? But then we're talking about a deferral motion here, so-

4:08:35 – 4:08:52•Angie Henderson

Ms. Ellis, so we're on a deferral motion. If, if, if you wanna ask to the fiscal impact or I would encourage you to speak to special counsel because there's a fiscal note on this bill and fiscal matters could be taken up relative to the re-referral. So don't.

4:09:26 – 4:09:54•Angie Henderson

Okay. So you want to kind of speak operationally where that funding comes from? Is that what you would like to know? Okay. Special counsel, can you speak to where 150K of signage money... would be pulled from. And I presume you want to know the answer to that question so you can determine how you're gonna vote on this deferral motion. That is exactly right. Okay, that's a bit of a stretch. So I'm gonna just remind everybody if you could answer promptly, special counsel, thank you.

4:10:04 – 4:10:27•Angie Henderson

I would presume NDOT has a signage bucket in their budget. generally. There's a sign shop. They do signs responsive to traffic and parking commission changes. So we can clarify that in the future if it is referred to committee. Okay, again, we are on the deferral. Ms. Hill, specifically on the deferral motion. Yes, ma'am.

4:10:58•Angie Henderson

Mr. Kupin on the deferral specifically. Go ahead, sir.

4:11:01 – 4:11:38•Jacob Kupin

Thank you, Madam President. I'm conflicted on this because I feel like we're starting to lose the plot here a little bit. I think that most of Councilman Sepulveda's bill, I think, is kind of, you know, the nine-month study and is kind of on the rails. And then what got us off track was an amendment in my district. So I'm torn because, you know, again, I'd prefer to have, you know, the district the amendment in my district, but also if this is going to go into six different directions, then we might have to defer it. So I think that that's, again, I prefer that we can just get this amendment p

4:11:38 – 4:12:37•Angie Henderson

We're no longer on the motion to amend. We are on a deferral motion. Ms. Benedict on the deferral. Go ahead, ma'am. Thank you. Previous question. All right, there is nobody else on the list to like talk about this deferral. So anybody else wanna talk about the deferral? No, good, okay. We're gonna vote on the deferral. All in favor of the motion to defer one meeting with the re-referred to referral to those three committees, please say aye. Any voting no. Any... Abstaining the ayes have it. This is deferred one meeting and re-referred into three committees. All right Next it's agenda item 94 o

4:12:38•Joy Styles

Thank you very much. I would like to move for approval.

4:12:42 – 4:12:59•Angie Henderson

I have a substitute but Okay, you've got to move approval first to get the bill before us before you can offer that. Yeah. Okay. Is there a Second on the motion to approve Okay It's before us and it's back to you miss styles. You still have the floor.

4:13:00 – 4:13:49•Joy Styles

Thank you very much so I put forth a substitute for this meeting that takes the desire for a study that was in the previous substitute by CM Ellis and combines it with the original request that I had for us to require annual surveys for our employees to give us feedback. I think we're all very well versed at this point. This stems from what happened last year with our Department of Emergency Communications. I think that the surveys that we did last year, they gave us good insight. I think this is a good way to split the baby. There's a study and we're also asking for support. There was a quest

4:13:51 – 4:14:07•Angie Henderson

And council said that there were no issues in regards to state law. Ms. Stiles, I have been reminded that you needed to request your committee reports. Oh, committee reports. And so for the report of the Government Operations and Regulations Committee, Mr. Eastlick on 15...

4:14:08 – 4:14:37•Jeff Eslick

On the Stiles substitute, two in favor, seven against, zero non-voting. Should I read the rest? Yes, sir. The Ellis substitute, six in favor, two against, one not voting. Overall, with the substitute from Ellis, seven in favor, two against, zero not voting.

4:14:38 – 4:14:59•Angie Henderson

all right i appreciate that committee report after which subsequently you would have made a motion to approve which you already have and it has been properly seconded you have the floor and within that time you may be getting to making a motion to substitute or not but you've got i'm not sure where your time is at this point but um Mr. Clerk, yeah, okay.

4:15:00•Joy Styles

All right, go ahead, ma'am. Okay, great. I would like to move the substitute, if I may, with a brief comment, I guess.

4:15:08 – 4:15:30•Angie Henderson

All right, are you proposing to move substitute one, your substitute? Yes, please. Okay, there's a motion to substitute with substitute one. Is there a second for that motion? Okay, there is a proper second now. Go ahead. on the substitute. Thank you very much.

4:15:30 – 4:17:22•Joy Styles

So again, my substitute takes the desire to have a study done on how to do a survey, what is the appropriate amount of time in which we can distribute surveys and also still request that we implement an annual survey process. I think we have heard enough from employees. They do not trust our HR department. So to put this solely in our HR department's hands to come up with a solution is not wisdom and it does not support our employees. I'm fearful that the study is going to take a lot of time and then the hope will be that people will forget about it. Then we get to the budget and we're trying

4:17:23 – 4:17:36•Angie Henderson

Thank you. Okay. So we're on the motion to substitute with Substitute 1 offered by Ms. Stiles. First in the queue for debate on that is Council Member Ellis. You're recognized.

4:18:44•Angie Henderson

All right. Council Member Suarez on the motion to amend with substitute one, you're recognized.

4:20:50•Angie Henderson

Council Member Evans, you're recognized. Oh, I'm so sorry. I apologize. Go ahead, ma'am.

4:20:56 – 4:23:08•Erin Evans

Thank you, Vice Mayor. So I'm not going to belabor the point, but I think ultimately you can see that having disparate processes in Metro government across departments is not a workable, viable solution. And we see this frequently in departments. And especially those of you who have been committee chairs. Chances are you have heard from departments that have fallen under your committees who are trying to elevate issues that may not fall under the typical civil service processes. If there are civil service commissions, that there are issues that need to be raised. Sometimes there there is just

4:23:09 – 4:23:20•Angie Henderson

Thank you, Ms. Evans. Council Member Welsh, you're recognized. And I'm getting slow on the buttons. You're good to go, ma'am. We're all getting slow. It's after 10.

4:23:22 – 4:25:24•Ginny Welsch

Thank you, Vice Mayor. I want to reiterate many of the comments that my colleague CM Evans made. I am in support of this first substitute. I think that one of the biggest problems that we have in Metro is that I hear from Metro workers is that they have a fundamental sense of distrust with HR. and they don't feel comfortable going to HR directly. And one of the problems I see with the second substitute is that it puts more power into HR itself in having control over this process. And the first substitute relies on a third party whose expertise is in doing this type of surveys. That's what we w

4:25:25 – 4:25:45•Angie Henderson

Thank you. Council, let's see. Ms. Stiles, I had presumed that you were kind of, you've already spoken on the substitute. So I'm gonna come back to you at the end because it's your sub. And then Ms. Ellis, you're recognized.

4:26:58•Angie Henderson

All right, Ms. Stiles, anything else you wanna say on your substitute in particular? Okay, we'll wrap it up.

4:27:11 – 4:29:31•Joy Styles

I appreciate my colleague for believing that there's a methodology of doing this that I think if we were perhaps under other leadership would make sense. But I think to CM Welsh's commentary regarding employee trust, we continue to ignore, it feels like, the fact that our employees constantly come to us. I don't know about you, but I'm kind of the, employee whisperer now, so when anything goes wrong, I get an email or I get a phone call from different employees in different departments. And when I get a chance to talk to them, it is, I don't trust HR, I don't believe they're gonna do a good jo

4:29:32 – 4:31:26•Angie Henderson

All right. There's no one else seeking to be recognized for discussion on the motion to substitute. with substitute number one by Ms. Stiles. I am too tired to call this by voice. So Mr. Clerk, if you would please load the vote on the motion to substitute with substitute one, please. Mr. Clerk, are all the votes in? All votes are in. Mr. Clerk, please show the vote. All right, the motion to substitute with substitute one fails with 12 votes in favor, 19 against, and two abstentions. That puts us back on the motion to approve on second reading, okay? And so at this juncture, the discussion cont

4:31:31 – 4:31:42•David Benton

Yes. Thank you, Vice Mayor. There was a lot of discussion in this, and it was very spirited and exciting, scary, a little bit of everything.

4:31:45 – 4:32:45•David Benton

Yes. Okay. And inside the halls and everywhere else. But... Yeah, I was nervous. But the bottom line is there was a lot of questions that just are we following our guidelines and rules and what's the best practice to make this thing work the best way with it we can. And it seemed to boil down to that all these departments are a little bit different. And that our first substitute was a kind of a one size fits all. And then the other allows some flexibility in there to where it might conform better with different departments. And that's why I lean this direction is because in the second substitu

4:32:45 – 4:33:09•Angie Henderson

Mr. Benton, you may move that substitute if Ms. Ellis sees fit. She's still in the queue, but we could get on moving. She's shaking her head. I would like to move the second substitute. Okay, there's a motion to substitute with substitute two. Is there a second? Ms. Ellis is the second, okay. So we're on debate on the second, substitute now, not the bill more generally.

4:33:09 – 4:33:32•David Benton

So. And just one last little thing is after all that vigorous discussion, it was an overwhelming decision by our committee to go with Ms. Ellis's version of the substitute. So if that helps anybody with your decision making process tonight, since your coffee has run out officially.

4:33:33•Angie Henderson

Thank you, Mr. Benton. Ms. Allen, do you seek to be recognized on the motion to amend with substitute two? Okay, you're recognized. Thank you, Madam Chair.

4:33:43 – 4:34:13•Burkley Allen

I appreciate the efforts here. I think it is important to get these surveys right and we're all working towards the same goal. So I'm confident we'll get there. Could probably our council clarify in the analysis, there was a statement that the bill as originally written before these substitutions was inconsistent with both the civil service regulations and the charter with regard to the responsibilities of the HR department. Do either of these substitutes or both of these substitutes solve that problem? Special counsel?

4:34:40•Angie Henderson

All right, is that it, Ms. Allen? Okay, next in the queue, Council Member Ellis, you're recognized.

4:35:48 – 4:37:35•Angie Henderson

Thank you, Ms. Ellis. Mr. Huffman on substitute two. Go ahead, sir. Previous question. Okay. Is there a second? Okay. Mr. Huffman has called the question. This is non-debatable. It cries two-thirds of those voting. If you are in favor of calling the question, you want to end debate. If you vote no, you want to continue debate. All in favor of the previous question, please say aye. Those against the previous question, please say no. Or no. Okay. Anyone? Okay, a few, the ayes have it. The question is called. So we will be voting on the second substitute. Let's try it first by voice. If we can't

4:37:38•Joy Styles

That was actually from earlier, but I guess I'll take a second.

4:37:41•Angie Henderson

No, you don't have to take this opportunity. I'll take it. Okay. All right.

4:37:46 – 4:38:59•Joy Styles

I'm up now. Okay. I keep hearing over and over again that somehow we are unable to figure out how a third party that actually spends their time creating these surveys doesn't know how to create surveys for fire or police or any other department. That's not an issue. That's what their wheelhouse is. I think it's silly that we're using that as any of our arguments. I continue to be concerned. I hope that this doesn't die a slow death. I hope that Council Member Ellis is going to stay on HR and make sure the survey study gets done and comes back and it's gonna come to committee and we're gonna he

4:39:00 – 4:39:12•Angie Henderson

All right, is there any further discussion on the motion to approve on second reading as substituted with substitute two? Seeing none, all in favor please say aye. Aye. Any voting no?

4:39:13 – 4:40:00•Angie Henderson

Okay, any abstaining? The ayes have it, this is on second of three readings. So this has passed its second reading. Next is agenda item 95, ordinance BL2026-1526, sponsors Druffle, Ellis, Evans, Allen, Weiner, Johnston, Stiles, Gamble, Webb, and Benton. 4:40:42 – 4:41:04•Angie Henderson

Okay. Is there a second for that motion? Is there any discussion on that motion? Seeing none all in favor. Please say aye. Aye Any voting no or abstaining? Okay, this will be taken up again at the second meeting in November. Next is agenda item 97, ordinance BL 20. Point of inquiry or order?

4:44:47 – 4:45:25•Angie Henderson

Any voting no, any abstaining? All right. Procedurally, are we in order with the public hearing request and all that? Okay, all right, all good, thank you. 4:46:08 – 4:47:06•Angie Henderson

It's a second of three readings. All right, that concludes our second reading items. Now, section P of the agenda, bills on third reading that were not on consent. First among those is agenda item 109, ordinance BL2026-1511, sponsor Harrell. This is an ordinance to amend Title 17, the Metro Code of Laws, a zoning ordinance to the Metro government by changing from RS-10 to R-10 zoning for property located at 4465 Harrell. Laverne Couchville Pike Approximately 97 feet south of Rockland Trail. This is five point zero one acres Councilmember Harrell you're recognized sir Okay, I have a note here Y

4:47:48 – 4:48:06•Angie Henderson

Okay, so Mr. Harrell, it's back to you. I heard you saying motion to approve just to get it before us, at which point you're gonna, okay. All right, so there's a motion to approve. Is it seconded? Okay, now there is a motion to substitute. Is there a second for that? Anything you wanna share about the substitute?

4:48:25 – 4:48:47•Angie Henderson

All right, thank you. Mr. Harrell, anything else you want to say on the motion to substitute? All right, any discussion? Seeing none, all in favor of the substitute, please say aye. Aye. Anybody no or abstaining? Okay, and so now that the bill has been substituted Do you seek to make your deferral motion at this juncture?

4:48:48 – 4:50:02•Angie Henderson

So I like to move to defer to November 17th Okay, there's a motion to defer the bill as substituted to the meeting of November 17th and that way your companion bill's gonna track along with that. I heard the second, is there any discussion? Seeing none, all in favor, please say aye. Any voting no or abstaining? Okay, so this has been deferred to the second meeting of November. Next is agenda item 110, Ordinance BL2026-1518, Sponsors, Toombs, Evans, Siegel, Gadd, and Allen. This is an ordinance amending the Metro Code of Laws Title 10, Section 10.20.360, solid waste generator fees to clarify fe

4:50:11 – 4:50:52•Angie Henderson

I promise that I will take that up before the meeting concludes, but I don't think it's really appropriate at this juncture. I just know folks will be rushing out right at the end. I understand, but I will get the clarification before we adjourn. Okay, if you have my commitment in that regard. Okay, so... 1518 is withdrawn. Agenda Item 111, Ordinance BL2026-1536, Sponsor Spain, Coop and Toombs, GAD, Ellis, Suarez and Voe. 4:50:53•Jason Spain

Thank you, Madam President. Move approval.

4:50:55•Angie Henderson

All right. There is a motion to approve. It's properly seconded. Is there any discussion? Okay. Council Member Eastlick, you're recognized, sir.

4:51:06 – 4:53:37•Jeff Eslick

Thank you. It's fitting that we vote on this on the same day I got an email about the new tax statements being en route to our mailboxes. I'm not here to argue the validity of this bill. I'm here to speak on behalf of the taxpayer. From my perspective, the intent of this bill is clear. This is a weak attempt to quell some of the anger over increased property taxes that were pulled from the residents. These are not free or federal grants, they are property tax dollars intended to be distributed back to business owners with a nice name. We collect the tax, we put it in the general fund, the bill

4:53:46•Angie Henderson

Before a roll call, what do I need to do here, special counsel? I gotta get like three.

4:54:06 – 4:54:17•Angie Henderson

All right, do you intend to vote now, Mr. Eastlick? I do. So we're gonna go on the boards anyway, okay? All right, so Ms. Stiles on discussion. Go ahead, ma'am.

4:54:19 – 4:54:56•Joy Styles

Thank you very much. Some of the comments that Council Member Eastlick made, I agree with it. I think this is a a dog and pony show. It sounds really nice. It's meant to make people feel good, but $300,000 is a joke. It isn't going to really help constituents and small businesses throughout this county. If there was a real effort, we would have put real money in this fund in the budget to take care of businesses. And I think business owners are very clear that this administration doesn't really care about them. I'm gonna vote yes, because even a small amount of money, I'd rather say yes to tha

4:54:57 – 4:56:31•Angie Henderson

All right, is there any further discussion? Seeing none, Mr. Clerk, knowing that there will be a no vote, and this is on its third and final reading, would you please load the vote for 1536? Mr. Horton, do you seek to vote? He indicates that he has voted. Are you showing the vote? Okay, all votes are in. Mr. Clerk, please show the vote. All right, this ordinance has passed its third and final reading with 28 votes in favor, four against, and zero abstentions. As there was a point of clarification requested by Ms. Gad, I'm gonna let either special counsel and or legal share that. Okay, all righ

4:56:54•Angie Henderson

All right. And did someone have a point of personal privilege? Oh, Ms. Johnson has one as well. Ms. Johnson, go ahead, ma'am.

4:57:40 – 4:57:56•Angie Henderson

Special counsel, if you want to respond to that. I mean, I think as we've switched to Legistar, obviously transferring that may be a factor there, but we can certainly elevate the concern. Special counsel, anything else you want to say in that regard? Ms. Suarez, you asked for a point of personal privilege.

4:58:16 – 4:58:27•Angie Henderson

Thank you, Ms. Amos. We appreciate you. Best wishes. Take care. All right. We are adjourned. We will meet again on Tuesday, October the 20th. Go vote early next week. Take care.
