4:10•Edward Frasier III

Thank you very much. Can I get a motion for approval of the agenda?

4:32•Edward Frasier III

Thank you very much. There's a motion on the floor, cast your vote. Motion passes, next item.

4:46•Edward Frasier III

All right, thank you very much. So we'll roll right into a routine action item.

6:26 – 6:56•Edward Frasier III

Thank you very much. All right, so this is a section of our meeting which we're going to approve the routine action items for audience information. This will be one vote to approve all of the items on the routine agenda. So if there's an item on the routine agenda that anyone in the audience would like to hear, come down and we will take it off of the routine agenda. Seeing no one coming down to remove anything off the routine agenda, I'm ready for a motion for those items.

7:05•Edward Frasier III

Thank you very much. There's a motion on the floor, cast your vote. That motion passes, thank you.

7:59 – 8:17•Edward Frasier III

All right, before we get started, I think the applicant's representative and the company she works for and the company I work for sometimes do business together, so I don't have any interest in this application. All right, thank you very much. All right, so name and address for the record and tell us about your application.

8:33•Edward Frasier III

Tell us about your application, what you're trying to get waivers for, and give us some background.

10:21 – 10:46•Edward Frasier III

All right, thank you for that. Let's do this. I'm going to open this application up for a public hearing. Anyone in the audience want to speak on this item? Now's the time to come down and speak on it. All right, seeing no one coming down to speak on this item, I'll close the public hearing, and I'll open up to commissioners for comments, questions, concerns. No comments, no questions, no concerns?

10:52•Tyler Brady

Go ahead, Commissioner. So I'm going to make a motion to approve WS260505 for approval.

11:01 – 11:13•Edward Frasier III

All right, thank you very much. There's a motion on the floor. Cast your vote. I'm sorry, go ahead, Commissioner Mojica.

12:24 – 12:35•Edward Frasier III

No, no, no. Motion's on the floor. We're waiting on votes. All right. All right. That motion carries. Thank you. Thank you.

13:14•Edward Frasier III

All right, thank you very much. Name and address for the record and tell us about your application.

14:01•Edward Frasier III

All right, so you're trying to get reduced setbacks for... what you have on your photo?

18:38 – 18:58•Edward Frasier III

Okay, I think we've got enough. Let me open the application up for a public hearing, and then we can deliberate. Okay, so I'm going to open this application up for a public hearing. Anyone in the audience like to speak on this item? Now's the time to come down and do so. All right, seeing no one coming down to speak, we're going to close the public hearing, and now I'll open it up for commissioners. Commissioner Kolarski?

18:59 – 19:34•Vivian Kilarski

Thank you, Mr. Chair. If you can put both of those, just put them down there. The engineer in the back can get them so I can see your Your prints, yeah, so I can see them side by side. Okay, and that will be good, but hang on a minute. Let me see. Where the car is, point to where that is. Okay, and that is where on your other map. Okay, and what is the one next to it? Is that this one over here?

19:47•Vivian Kilarski

Can we go back to your water? Is that your jet ski?

20:04 – 21:02•Vivian Kilarski

Is that underneath? Okay, is that underneath a carport or anything? No. OK. OK. Yeah, but this here is that there. OK. OK. OK, now I'm a little bit more oriented. Thank you. Continue. So that's the shed, that's the piece that... And where the... That's the structure that doesn't meet the setback or the building separation.

21:13 – 21:46•Edward Frasier III

uh... okay sounds good thank you so much thank you commissioner klarski uh... i have no issues with the application commissioner reutemann yeah i don't think i have any issues with it any indication from any of your neighbors whether they have any issue with this Sir, if you would mind, would you grab the handheld mic so we can keep the record clear?

22:00•Edward Frasier III

All right, thank you very much. All right, go ahead, Commissioner Mojica.

24:15•Tyler Brady

What she's saying is where she's talking about is on the left side of your driveway where your neighbor has the little satellite thing.

25:01 – 25:37•Steve Kirk

thank you sir right so so i got two more commissioners i'll go commissioner kirk and then commissioner brady will end with you thank you mr chairman you don't have a problem with it i'm looking at your property in google earth and the surrounding area i mean you live in a forest up there i think there's a lot of greenery and the fact that anything you planted will probably be run over by your front-end loader when the snow gets cleared out. So I don't have a problem with it. I think it looks good and I'm in full support. Thank you.

25:51 – 26:29•Nelson Stone

Thanks. Before we do the motion, I just want to, for the record, indicate that I see in the photo that both the primary residents, canopy covers and even the tool shed have a metal seamed roof Which is important for fire protection up in the Mount Charleston area due to flying embers So I would also say that we're not looking at the low end of the construction Spectrum we are looking at a high-end Fireproof roof, which I appreciate I you didn't mention that but I did spot that I appreciate that just for the record All right

26:30•Edward Frasier III

Thank you, Commissioner Stone and Commissioner Brady.

26:34 – 27:30•Tyler Brady

All right. Well, I think you did a good job with everything there overall looks clean. And I like that you've upgraded the shed and done all that, too. I was looking at pictures. You made it look better so good work with that it looks like you've also like the mulch and everything on the left side is what it seems like you've improved on it so what i'm going to do here is on item number 16 w6260511 i am going to do a motion to approve and Um, that would be, and it's just all of them. Yeah. So, um, overall, um, AB was one, two and three items, three motion to approve on all items.

27:30 – 27:42•Edward Frasier III

All right. There's a motion on the floor. Cast your vote. That motion passes. Good luck.

28:15•Edward Frasier III

Thank you. Name and address for the record and tell us about your application.

29:42 – 29:59•Edward Frasier III

That is. OK. Thank you very much. So I'm going to open this application up for a public hearing. Anyone in the audience like to speak on this item, now's the time to come down and do so. Seeing no one coming down to speak, I will close the public hearing. And I'll open up to commissioners for questions, comments. Commissioner Kirk?

29:59 – 30:13•Steve Kirk

Thank you, Mr. Chairman. You said a seven foot high wall in the front. Tell me what kind of wall that is. CMU, so block wall? Yes. Solid block, and are you going to have a rolling gate?

30:32•Steve Kirk

Does that match any other property on that street?

30:38•Steve Kirk

I see some wrought iron gates. And I guess across the street they have a cyclone fencing with those slats.

30:49 – 31:26•Steve Kirk

Yeah. So I typically don't like to see a solid wall in the front of a property. So unless I can... Yeah, I mean, all the way up and down the street, I see wrought iron, cyclone fencing. You know, it's just, I know that some people want to build a seven foot high CMU block wall. They think that's good for safety. It's good for privacy, but it's not good for safety.

31:41•Steve Kirk

So you're just going to leave it open with no rolling gate?

31:49 – 32:18•Edward Frasier III

all right so um i don't see any other lights on i i really don't have any issue with the height of the cmu walls on the sides of the residence i agree with commissioner kirk and on the front i would support a smaller three foot cmu wall with wrought iron on top and um i'll leave it for um the commissioners to let's see Any other comments? All right, Commissioner Kowalski, you can take it home.

32:24 – 34:11•Vivian Kilarski

Oh, I'm sorry. Thank you, Mr. Chair. I'm glad you talked to your client, but I am totally in agreement because as soon as I heard you say seven foot and it was CMU solid, I started shaking my head, no, that is not going to happen. I can do... There, I don't know. We had a project on Viking a couple months back where he wanted to do a solid wall, but I don't want to design. So what I want to do is ask you if it's okay to hold this for two weeks. I want you to get with the planner. I want the planner to, there's some properties, and if I have to meet with you, I can to show you the properties th

34:18•Vivian Kilarski

No, I don't want a solid seven-foot wall alongside.

34:38 – 35:32•Vivian Kilarski

That I can live with. Or you can have, like, a bulk wall or a CMU and then the rest wrought iron up to seven feet. Okay, so... We could do that. All right, we can do that. So let me say this, then. Make sure that I'm doing the motion correctly, please. I'm going to move to approve WS26-0512... approving waivers one and waiver two to the up to seven feet And let me ask you, since there's nothing in here about the fence in the front, are we able to add that?

36:07•Vivian Kilarski

Okay, but there's nothing that was talked about a wall in the front, so that's why I'm asking that.

36:13•Steve Kirk

Yeah, that would be, I think, on the east property line, right? So north and south is covered. East and west property line is not covered.

36:21•Vivian Kilarski

The west is already a block wall with wrought iron.

36:24•Steve Kirk

Right. Okay, so you're talking about the east property line, which is not addressed in our... That's correct.

36:30•Vivian Kilarski

That's what I'm saying. Yep. Can we put that in? I just don't want to... put in a condition where there's nothing already in the application.

36:49•Vivian Kilarski

Or would it be three and three because are they allowed to have a six-foot wall in front?

36:59•Vivian Kilarski

So your front is going to be a little bit shorter than your side and your back. Is that okay?

37:13•Vivian Kilarski

Okay, so we're going to do a three and three.

37:17•Edward Frasier III

All right, motion on the floor. Cast your vote.

37:29 – 37:59•Vivian Kilarski

Commissioner Kolarski, you want to restate the motion? Okay. I move to approve WS26-0512, approving waivers one and two with waiver number two Increasing the wall height from six to seven feet. And then the front fence will be a three foot CMU with the three foot wrought iron. Okay, motion on the floor, cast your vote.

38:37 – 38:52•Edward Frasier III

So before we get started, just again, I'm the applicant's representative. She worked for a company I work for. We do business together sometimes. But I have no interest in this property. So you can vote on this. Thank you very much. All right, name and address for the record and tell us about your application.

40:56 – 41:21•Edward Frasier III

Thank you very much. So we're going to open this application up for a public hearing. Anyone in the audience like to speak on this item, now is the time to come down and do so. I see no one coming down. We're going to close the public hearing and I'm going to open to commissioners for questions, comments. I'm fine with the application and there's no lights. So Commissioner Brady, if you want to take us home or have any comments.

41:23 – 41:45•Tyler Brady

um so i just have one question on this one is where there's the retaining wall that goes up there's the driveway up along the top um if a car's dry and snow comes in and it goes two feet high is that along that driveway of that cinder block wall um on the upper part can it will a car be able to see that

42:23 – 42:52•Tyler Brady

Yeah. So it's, I'm actually not having a problem at all with the eight foot retaining wall. I'm not having a problem with that. I'm more throwing out the caution when you drive up that driveway and you're coming up around, My caution is if someone backs back out and they aren't going to see a retaining wall at all there, because there's a lip up at the top side.

43:11 – 43:37•Tyler Brady

Yeah, and that's where my caution is, is that one or two feet when it snows, because there is a lot of snow, and what I'm afraid of is that it's going to get covered with snow, and someone's going to forget about that edge, a guest or something, and they're going to come and come drop eight feet. Do you see where I'm coming at with that? Yeah.

44:19•Tyler Brady

Commissioner Kirk, do you have your light on? Not Kirk. Commissioner Stone? Stone? Comments? Yeah.

44:26 – 45:25•Nelson Stone

Thank you. So I would caution against the Planning Commission directing Public Works improvements from the podium here. I don't like to delve into this too deeply, but maybe I'll go to our Public Works staff and say, site visibility site visibility easements are always required in any egress to any project in the county they review site plans for site visibility easement compliance when there's 12 feet of snow i don't really know how you that applies but a guard rail is usually used for you know high velocity travel or and whatnot so where they whether they hit a guard rail or a block wall I t

45:41•Nelson Stone

So that's an automatic check for you guys specifically?

45:50 – 46:23•Nelson Stone

But it also applies to the edge condition of the asphalt and the edge condition of the driveway. And in this case, it looks like the actual roadway is not up to the edge of the wall. So I would just say our public works staff reviews all plans for traffic safety issues at the direction of the public works director, and they will add whatever mitigation requirements are required to protect life safety. Is that fair to say? Correct. Okay.

46:24 – 46:54•Edward Frasier III

And I thank you for that, staff, and thank you for that, Commissioner Stone. I would agree with that assessment, and I would just ask maybe the county attorney to maybe speak to uh... a level of you know responsibility of the homeowner to protect those folks that are on their property and not really us i mean we can point out maybe something that we might see but that's really not our purview what's before us is just to increase the role i'm sorry increase the retaining wall height will we allow that or not

47:11•Edward Frasier III

I would say that I could approve the application as noted, yeah.

47:16 – 47:38•Tyler Brady

All right, so. Here I am back to, I'm going to make a motion to approve WS260511 with the waivers of changing the retaining height wall to eight feet where three feet of maximum is allowed. Thank you very much. There's a motion on the floor.

47:38 – 47:53•Edward Frasier III

Cast your vote. The motion passes. Good luck.

48:30•Edward Frasier III

Thank you very much. Name and address for the record, and tell us about your application.

54:56 – 55:13•Edward Frasier III

All right. Thank you very much. All right. So we're going to open this application up for a public hearing. Anyone in the audience like to speak on this item? Now's the time to come down and do so. Seeing no one coming down, we will close the public hearing and I'll open up to commissioners for questions and comments. Commissioner Kowalski.

55:14 – 55:39•Vivian Kilarski

Thank you, Mr. Chair. You know, I'm trying to figure out, you got the garage and I see the building separation. So this is a Carport, am I correct? Okay, and you said it's going to match? You need to use a mic, ma'am. Okay, thank you.

56:14•Vivian Kilarski

Okay, now as for your wall in the front, Am I correct? Okay. You have a gate. Where's your gate at?

56:51 – 57:24•Vivian Kilarski

Okay, let me just ask you this. These modifications that you said you're willing to make, did those come about after town board? Okay, so with your proposed stuff, does that require, and I'm asking staff this, does that require a revision of plans, and if that's the case, Have you guys seen it? If not, then I don't know if we really want to be, or I don't know that I want to be.

57:30•Vivian Kilarski

So these changes that she's talking about, would that require revised plans?

57:49 – 58:12•Vivian Kilarski

Okay. And just so you know, whatever Talbot said, they were reading off the, like the hardscape 65, where you said it was 62. They were reading off their paperwork, okay. So it wasn't that they made a mistake, that's just what they were reading. Yeah, so if they're going to require new plans,

58:17 – 58:34•Vivian Kilarski

Okay, hang on a minute. Okay, if they're going to require new plans, I don't know if, well, it's going to be up to the maker of the motion. So I just have a problem if there's new plans that need to be done. I would like to see how that works. So anyway, thank you, Mr. Chair.

58:35•Edward Frasier III

Thank you, Commissioner Kolarski. Commissioner Kirk? Mr. Chairman, thank you.

58:41 – 1:00:04•Steve Kirk

The problem we have is... what you're proposing is not what's in our backup. So we've spent time reading the application and now you've come with something totally different. So we haven't had time to process it and now I'm understanding that the staff hasn't had time to analyze it. So I want to continue this because I'm not going to make, we're not going to design from the dais. I'm not going to argue with you one way or the other about what the code says and whether your percentages are accurate or not. We're going to have the staff do that because that's what they do. and then they'll make

1:00:14•Steve Kirk

You okay with that? So that's two weeks? So that's the 17th?

1:00:22•Steve Kirk

October 20th? Okay. My motion then is to continue this item to the 20th of October.

1:00:29 – 1:00:44•Edward Frasier III

And I would just say, for the record, I liked a lot of the changes you made, especially moving the gate back. That also gives you room to drive up and not be stuck in the street. So with that, I definitely can support the motion to hold. And there's a motion on the floor. Cast your vote.

1:00:52•Edward Frasier III

That motion passes. See you in a couple weeks.

1:01:30•Edward Frasier III

Thank you, staff. Name and address for the record. Tell us about your application.

1:02:35•Edward Frasier III

Thank you very much. You want to give me some more background? Okay.

1:06:01 – 1:06:29•Edward Frasier III

All right, thank you very much. So I'm going to open this application up for a public hearing. Anyone in the audience like to speak on this particular application? All right, seeing no one coming down, we're going to close the public hearing, and I'll open it up to commissioners for questions and comments. And so I can support the application. Appreciate you taking your time and spending your hard-earned money to improve your property. Looks like a good project to me. Commissioner Roikman?

1:06:29 – 1:06:40•Michael G. Roitman, Esq.

Yeah, I spoke with the applicant at length, and I'm very comfortable with this application. Thank you guys for all the hard work out there. With that, I can motion to approve WS260535.

1:06:42•Edward Frasier III

There's a motion on the floor. Cast your vote. Motion passes. Good luck. Thank you very much.

1:13:44 – 1:14:04•Edward Frasier III

Thank you very much. So we're gonna open this application up for a public hearing. Anyone in the audience like to come down and speak on this item? Now's the time to come down and do so. Seeing no one coming down, we're going to close the public hearing. And then I'll open it up to commissioners for comments, questions. Commissioner Kolarski. Thank you, Mr. Chair.

1:14:05 – 1:14:45•Vivian Kilarski

My question is for staff. He's talked about, and looking at this, the width of the driveway, which is 3B, 3C, which are the reductions. HOW DO I SAY THIS? YOU'VE SEEN THEM. DO THEY WORK? I KNOW THEY DON'T MEET CODE. I KNOW THAT MUCH.

1:15:47 – 1:16:08•Vivian Kilarski

okay those those are my questions and and again i want to just say thank you again uh... for taking back a couple of questions i had about some amenities i appreciate you doing that and uh... i think it's a good project thank you thank you commissioner kolarski no other lights um... i can support the application i think we're ready for motions

1:16:22•Edward Frasier III

Thank you very much. There's a motion on the floor. Cast your vote.

1:16:33•Edward Frasier III

Oh, sorry. Yep, that motion passes. Okay, I'm sorry. Go ahead.

1:16:53 – 1:17:05•Edward Frasier III

All right, so motion on the floor. Cast your vote. That motion carries. Good luck.

1:19:42•Edward Frasier III

Thank you very much. Name and address for the record. Tell us about your applications.

1:25:50 – 1:26:07•Edward Frasier III

Thank you very much. Appreciate that. So we're going to open this application up for a public hearing. Anyone in the audience like to speak on this item, now's the time to come down and do so. And I see some people coming down. So thank you very much. So name and address for the record and then put your comments on the record. Thank you.

1:29:17 – 1:29:38•Edward Frasier III

Thank you. Thank you very much. Anyone else in the audience would like to speak on this item? All right, seeing no one else coming down, we're gonna close the public hearing, and I'm gonna open back up to commissioners for questions, comments of the applicant. Yep, go ahead, Commissioner Kowalski. Thank you.

1:29:38 – 1:30:00•Vivian Kilarski

Thank you. Okay, one of the first things that struck me was when I read this is two and a half acres, on a portion of 45 acres. So that tells me that the 45 acres is where?

1:30:19•Steve Kirk

Vivian, excuse me, it's shown on item 27 where the 45 acres.

1:30:30 – 1:30:42•Vivian Kilarski

Okay, thank you. Okay, so that's the 45 acres. And you want to take that little slice. And this is all BLM land, you said?

1:31:38 – 1:31:53•Vivian Kilarski

Okay. So these little white tags are what has been changed in the last couple years? Am I correct? Because I see planned land use, ranch estate.

1:32:15•Vivian Kilarski

Okay, so the one next to it, which is the ranch estate. Correct. And the one above that is the ranch estate.

1:32:32 – 1:33:51•Vivian Kilarski

Okay, because when I look at this, I see tags, but I see different things in my backup. I guess my concern is that we change this now, BLM goes and auctions off again, and we're going to have the same thing happen again where they're going to come in and we keep chipping and chipping and chipping. And I have said that we have nickel and dimed our R&Bs to death. I've said that over the years. You know that. So that kind of really concerns me. I got to find where it's at because I had some notes. That was the first thing was that 45. You staff is there any other things that have come in in this

1:34:34 – 1:35:00•Vivian Kilarski

My major concern is that this 2 1⁄2 acres, well, it's been auctioned off. You're going to have the rest of that being auctioned off down the road, 20 years maybe. I don't know. And I just hate to start the chipping away. I really, really do because you still have homes over there. The only thing is being on Wigwam. Thank you.

1:35:03•Edward Frasier III

Thank you, Commissioner Kolarski. Any other comments, questions on the application?

1:35:10 – 1:35:37•Edward Frasier III

It's a difficult piece when the BLM didn't give us everything, so they only gave us that little piece. suggest to the applicant that those four lots maybe could be two. I get the arithmetic to it that you need those four lots to make it pencil. So I guess I could support the application, but I'll see where the motion goes.

1:36:30•Edward Frasier III

All right, the motion passes. Next item.

1:36:38•Edward Frasier III

Thank you very much. There's a motion on the floor. Cash a vote.

1:37:09 – 1:37:29•Edward Frasier III

thank you very much so i think we come to our last item of tonight which is uh public comments and at this time the floor is open for anyone to make public comments on the record the commission cannot act on any of them seeing no one coming out and make public comments i'm going to close that section of the meeting and adjourn our meeting tonight thank you very much staff
