23:33•Lynn Hurtak

Are there any parcels within a mile that are R3? It's mostly in the New Tampa area. Okay, New Tampa. Thank you.

23:44 – 25:22•Alan Clendenin

Can you, CTTV, can you put the presentation back up? And can you go back to your map where you show the land use? So this is what, I mean, actually go back to the other one where it's existing. This is where I'm having a hard time. I brought this up during my briefing. You know, we look at, regardless of all the stuff of getting in the weeds about this issue, what we're talking about is we're adopting land use policy. We are always comparing neighborhoods and adjacent parcels. And it seems this was very intentional at some point in the past for this massive property. I mean, we're talking abou

25:50 – 26:09•Alan Clendenin

I was just curious why the consistent recommendation when you look at that and it's so uniform. And it just seems oddball to me that it's so uniform. And if there's any other mix, I just can't even imagine that we would have gotten a consistent review from you guys. Danny, do you want to add anything to that?

26:46•Alan Clendenin

Councilman Carlson, you wanted to add something?

26:47•Bill Carlson

Yeah, what was the Planning Commission staff's recommendation? Did they have any advice that was different than the Planning Commission?

26:58•Alan Clendenin

Okay, thank you. Any other questions? Okay, hearing none. Yeah, so they're saying 1971, I think they said. Yeah. Okay, very good. Applicant?

42:26•Alan Clendenin

Councilwoman Hurtick, you had a question?

42:41 – 43:41•Alan Clendenin

Okay, very good. We're going to move on to public comment unless there's any questions. Okay, if you're here to speak to this item, please stand up five at a time. This is going to take some time, so five at a time against the wall. When it's your turn, you can come to the podium, since we have some people who are not familiar with this. The microphone's on the podium. You start always with your name. So if you're gonna speak, always with your name, and then you'll have three minutes. There'll be a green light will come on. That's the beginning of your timer. When the yellow light comes on, th

43:49•Alan Clendenin

Just so you also know the microphone is omnidirectional. You don't have to speak directly into the microphone. You can, you can stand up straight.

46:43•Alan Clendenin

Next speaker, please. Start with your name.

46:52•Alan Clendenin

Yes, say your name again while you're at the podium.

49:52 – 50:15•Alan Clendenin

Thank you. For those of you in the audience, please, the acoustics in here are really good. Back row. The back row that are talking, if you guys need to talk, if you could take it outside to the hall, I'd appreciate it. Because it's crazy how well it is. And when you guys even whispers, it distracts from the folks that are at the podium. We want to be able to give everybody their due. So if you could just, any type of conversation, if you take it out there, that'd be great. Valerie, go ahead.

51:38•Alan Clendenin

Next speaker, please. Start with your name. Speaker, waiver form. Yes. Up here. The gentleman in the cage. Thank you.

52:19•Alan Clendenin

Thank you. Start with your name. You'll have seven minutes.

52:43•Alan Clendenin

So you're not a party. So she's not a party. Okay. I'm sorry. I'm sorry for the interruption. We'll still reset your time from the beginning. Okay. Start with your name, please, and you'll have seven minutes.

1:00:58•Alan Clendenin

Thank you very much. Thank you for your brevity.

1:02:26 – 1:02:37•Alan Clendenin

Yeah, the device, if you put it face up, it'll turn on automatically, and then there's a wheel on the top of the device that you can zoom in and zoom out. All right. We only have three minutes, so go quick with them.

1:05:43 – 1:06:26•Alan Clendenin

Thank you very much. Don't forget your photographs. Okay guys, I'm going to say this one more time. If you're speaking and you're even whispering, we can hear you and it's extremely distracting. So please, if you, if you're doing that and I, and I catch it again, I'm going to rule you out order and ask you to leave council chambers. Okay. Because everybody deserves their time to be heard the time to be heard. Eileen, come on. Nope. Stop talking. I back there. The time to be heard is when you're at the podium and you deserve a hundred percent of our attention. We're at the podium. So please, if

1:08:33•Alan Clendenin

Thank you very much. Next speaker, please.

1:11:48•Alan Clendenin

Thank you very much. Next speaker, please. And if you're here to speak, please line up against the wall now. At least three of you get queued up.

1:13:02•Alan Clendenin

There's a wheel on the top of the device. There you go.

1:15:01 – 1:15:15•Alan Clendenin

Thank you. Next speaker, please. Start with your name, please.

1:18:27 – 1:18:50•Alan Clendenin

Come on up. You have three minutes. Start with your name, please. Hi. My name is John Persia. I am Showman's Rest, WOS 211. The reason we're selling this property... You are the... Owner. Say that again? You're the owner of the property, so that would be inappropriate for you to... I just can't let this lady... Sit down right now. Let this play out. Sure.

1:19:05 – 1:20:00•Alan Clendenin

Okay, we have some online public speakers. Let's see, we've got, no. So Sheila Weiss Evans, are you online? Is she on? Unmute yourself, please. Sheila? Unmute yourself, please. We show you're muted. Sheila, going once, going twice. I'll come back to you after I get to the next two. Melanie Charleston, and I believe maybe Carl and Charleston, are you going to speak together? Is that right? Are you guys online? There's one. Okay. Mr. Charleston, start with your name, please.

1:20:05•Alan Clendenin

I we can hear you. So if you can hear me or you can see that I'm talking to you, I'm giving you, I guess I'll go ahead and begin. Um, start with your name, please. You have three minutes.

1:21:50 – 1:22:22•Alan Clendenin

Thank you, Mr. Charleston. Sheila Weiss Evans, can you hear me? And if you can hear me, please unmute yourself. This is another opportunity. Sheila, going once, going twice. Have a good night, Sheila. Melanie Charleston, if you're online, please show her online now. No? Okay. Okay, then that concludes our public comment. Applicant, would you like a rebuttal?

1:27:32•Alan Clendenin

Thank you very much. Oh, we have much closer councilman here. Texas. Yes. Go ahead.

1:27:36•Bill Carlson

I just want to ask one question. Is Dr. Kimberly here to answer questions or is Dr. Kimberly here?

1:28:01 – 1:28:13•Alan Clendenin

I have a motion to close, and I have a second. Councilwoman Hertek and Councilman Matuskalko. All those in favor say aye. Aye. Opposed? Ayes have it. I'll just move on to discuss.

1:28:15 – 1:29:25•Lynn Hurtak

I would not like to discuss because generally with comprehensive plan We don't need with we don't have to have reasons I'll tell my reason but ultimately There's a lot of things that were talked about tonight that really have no basis in this proceeding at all people's what they do for a community, that does not matter. People who own the property do not matter. What is on the property, that's not what we're looking at tonight. What we're looking at is, is this an appropriate land use for this space? And so my initial question, which was, is there any R3 in this area? The answer was no. Where

1:29:32 – 1:29:54•Guido Maniscalco

And I'll second that, and I'll add here what I'm looking at for the agency review of the city of Tampa objection. It says the city staff finds that the long-term planning vision of the city favors a more conservative, thoughtful, and approach to development around cemetery uses, which is better accommodated under the adopted public, semi-public, future land use designation. I mean, that's right here, so that's it.

1:29:56 – 1:30:43•Alan Clendenin

You know, and I heard folks talk about this as well this evening. And I think I gave you guys a kind of an indication of the lead of where to come, your points to prove to win over my vote and reference the minds we made up. No, I was listening through the entire hearing. And again, I gave you an indication. that you had this square block that was designated for future land use a certain way convinced me why there would be a reason why of changing that. And I did not hear any evidence or any compelling reason or justification to, to carve this block out and, and change that designation. It was

1:30:44 – 1:31:11•Bill Carlson

Yeah, just, just kind of building on what my colleague said. Um, I probably, all my colleagues appreciate the service of the colonel and his family and. everything they've done. Um, um, it's a, that part of it is a very compelling story. And I think we all would wanna just, just for the sake of the service, probably to make this decision for that reason. But ultimately you have to look at, uh, what what's best for the land use in the area. And, um, uh, this just doesn't match.

1:31:13•Alan Clendenin

Okay. Any other discussion before we call for a vote?

1:31:16 – 1:32:51•Charlie Miranda

No, I, I just wanna, you know, listen to both sides and it's, uh, Both have professional people that do this for a living. And both are somewhat different. The one from Rachel Kangas, she speaks about the possibility here or there. The other one does not to some degree. And so they contradict each other to some respect as far as how do I know which is which when two experts can't even come up to an agreement. So that leaves doubt in my own mind as to what do I do now. Do I punt the football? Well, we're not playing football. We're playing land use. And it was mentioned about the three, and the

1:32:52 – 1:33:33•Alan Clendenin

So just to clear things up, it's funny because everybody came down into this hearing with 1 assumption and that was whether there was bodies or you haven't heard 1 person up here discuss that this is all about land use. It wasn't about the fact that the cemetery and not a cemetery. It's about land use and whether this is appropriate change to future land use. And I also think this is a case in point. for the Planning Commission about why we need to carve these functions out a little bit better. You saw the multitude of uses under this public, semi-public land use. It is a classic example of wh

1:33:33 – 1:34:37•Luis Viera

Go ahead. No, no, no, you're you're good. Thank you, sir. And again, thank you for. Allow me to appear virtual that I'm feeling under the weather, but it's funny because councilman Miranda and councilman Carlson talked about the 2. More when I say appeals to emotion, I don't mean that in a negative light, just the issues that have been talked about, which is one, the potential of bodies there that have been discussed. On the other side, the petitioner's stellar presentation and just stating as a person from what I see in this petition, you can tell that this is a person of integrity, decency a

1:34:50 – 1:35:10•Alan Clendenin

Okay. Thank you. Okay. Item number four. We'll let the room clear for a minute. I'll leave here. I'll get through to you. I just wanted to get there by 11. My objective is to be in the hotel by 11. If you guys could quietly leave.

1:35:10•Charlie Miranda

As soon as it quiets down, we're going to start with the next hearing.

1:35:41 – 1:35:55•Alan Clendenin

Thank you. Thank you, thank you, thank you. Okay, in the back. Out. I think there's a TikTok of me saying that. Get out.

1:36:05•Bill Carlson

You know, if you leave for Naples at midnight, it'll only take you three hours instead of five.

1:36:09•Alan Clendenin

1:41:02 – 1:41:18•Charlie Miranda

Good evening. Corey Williams representing the owner at 4707 East Henry. Again, as Ms. McCarthy mentioned, we were just looking to have this property rezoned to the R35 designation as it's consistent with the development just south of our property here at 4707.

2:24:33 – 2:25:12•Naya Young

File number AB2-26-20, ordinance being presented for first reading consideration. An ordinance approving a special use permit, SU2, for alcoholic beverage sales, restaurant, beer, wine, and liquor consumption or premises only, and making lawful the sale of beverages regardless of alcoholic content, beer, wine, and liquor on that certain lot, plot, or tract of land located at 210 East Fowler Avenue, Tampa, Florida, and more particularly described in Section 2, providing that all ordinances or parts of ordinances in conflict are repealed, providing an effective date.

2:25:12•Lynn Hurtak

Okay, I have a motion from Councilwoman Young, and I have a second from Councilman Maniscalco. Roll call.

2:25:43 – 2:26:08•Lynn Hurtak

2:26:09 – 2:26:52•Luis Viera

Yeah, and that's all motion to remove. So this is because station 24 is beginning and everything motion to remove the in person status update. On station 24 scheduled for October 1st, and to replace the current monthly written reports and quarterly in person reports. with in-person construction updates beginning in March of the first week of March of 2027. And then I'll leave it to whoever takes my place or anybody else to see the duration of it based upon the construction status, just so that TFR doesn't have to do that all the time if council is a minimum.

2:26:53•Lynn Hurtak

Okay. So I have a motion from Councilman Vieira. I have a second from Councilman Maniscalco. All those in favor? Aye. Any opposed?

2:27:00•Guido Maniscalco

They did it because they broke ground already on Station 24 this week, so it's all in schedule.

2:27:07 – 2:27:39•Luis Viera

Yes, ma'am. If I may. Yes. Yes, ma'am. Thank you. Y'all should have gotten a letter regarding the renaming of Fire Station 1. Yes, or a street for Franz Warner, Jr and Isaac Royal. So, therefore, I would motion for that to come back with council's consent. On November 19th, I'll be out, but I'm sure it'll get support on council and all that good stuff. And if staff needs more time, that's great. But that would be my motion if I can't wait a 2nd.

2:27:42 – 2:28:07•Luis Viera

Yes, ma'am. Yes, ma'am. A motion for a report from staff on the renaming of either Fire Station 1 or a street renaming near Fire Station 1 for Franz Warner Sr. and Isaac Royal after their tragic murder 45 years ago on November 19th. That is my motion.

2:28:36•Luis Viera

Yeah, I wouldn't do that. But yeah, that's my motion. Thank you.

2:28:39 – 2:29:01•Guido Maniscalco

I'm going to second that. And if any council member is interested, if you go to station one downtown, you can actually still see the bullet holes from that day in the in the front door. And Bill Wade, who is very active, he's retired, but he's very active with the Firefighters Museum, gave me, you know, the tour and everything. But great, great motion. Council member Vieira, I'm happy to support it.

2:29:03•Lynn Hurtak

And so I have a motion from Councilman Vieira, a second from Councilman Maniscalco. All those in favor. Aye.

2:29:11•Luis Viera

And that's it. Thank you, Madam Chair. Thank you, Council.

2:29:16 – 2:29:47•Guido Maniscalco

First, tomorrow is September 25th, 925. So it's unofficially Dolly Parton Day. Oh, yeah. You know, we remember her. All right. I have a motion. More serious stuff. 2:29:47•Lynn Hurtak

I have a motion from Councilman Maniscalco, a second from Councilman Miranda. All in favor? Aye.

2:29:52 – 2:30:09•Guido Maniscalco

Thank you very much. And then the second motion is a request by the Planning Commission setting adoption hearing for TACPA 26-09 and TACPA 26-10. on January 28, 2027 at 5.01 p.m. and direct the legal department to provide the city clerk with the form of notice for advertising the public hearing.

2:30:10 – 2:30:30•Lynn Hurtak
