This board may also hear appeals of decisions made by city staff in administering these ordinances. The general procedure for each case is the board will hear first from city staff who will provide a summary of each applicant's request. Then the applicant or agent will be asked to come forward and advocate for their request. Next, the board will request public comment from anyone who would like to speak in favor or in oppo
Thank you. Okay, the first thing on our agenda is the approval of minutes from our August 27th, 2006 regular meeting.
We have a motion and a second. Do we need a roll call?
Chairman, you're right. Sorry. Member Porter.
Okay. Okay, while we're doing that, we'll announce any citizen's communication that needs to take place before the meeting starts. This is a time for citizens to address the Board of Adjustments on any issues or items on the agenda. It is a violation of the Texas Open Meetings Act for the Commission to respond to, ask questions about, or discuss any items that are not on the agenda. Would anyone like to come up and speak? Seeing none, we will move down to the items for individual consideration. We have... First up, item ZB26-0012, hold a public hearing in consideration of a request for a varia
All right, thank you. Any questions for staff?
That's what I was gonna ask. I drove by, it looked like a new carport, so I figured it was already built.
Thank you. Come on up. Could you please come up and state your name for the record, please?
Wonderful. What would you like to tell us about your project or possibly your hardship for needing a variance?
Sure. Okay, we have any questions for the applicant?
Do we have any other questions for the applicants? No. Okay, thank you so much. At this time, we will open up the public comments for this applicant. If anyone would like to come up and speak in favor of this. Okay, would anyone like to speak in opposition of this? Seeing none, we will close the public comment section and open it up for the board to discuss. Board, do we have any discussion? Or do we have...
Okay, with that being said, Board, do we have any motions we would like to make on this? You know what, I'll motion. I'm gonna motion to approve this. I think where it's situated and driving the neighborhood today, it flows with the neighborhood and flows with some of the other structures I saw around there.
Okay, so do we need to make a... No, we're good. Okay, so we do have a motion and a second. Is that okay with you? All right, can we have a roll call, please?
Aye. Congratulations, your motion is passed. Thank you. Next up, ZB260013, hold a public hearing in consideration of a request for a variance from section 144-5.4c to allow a detached carport to encroach a maximum of two feet into the five foot interior side setback with the R2HL, HD Single Family and Two Family Historic District, Mill Street Historic District, currently addressed at 586 West Mill Street.
Wonderful, do we have any questions for staff?
I've got two. Okay. Okay, so the existing driveway, this is going to not, it's going to be on the existing driveway. It's not going to encroach off of the existing driveway. So we're using the same footprint. Per se. Okay. Second thing is, is it going to be attached to this rear, what they call an office? Is it actually going to have the same roof line or just cover, be attached to it?
Okay. Thank you. All righty. Do we have any other questions for staff? No? Thank you. At this time, we'd like to have the applicant come up and please state your name for the record.
What would you like to tell us about your project and possibly any hardships you might have?
It's gonna cover the roof of the office?
You can have a seat then. All right, at this point we'll open up the public hearing. Would anyone like to speak in favor or in opposition of this? Seeing none, board, do we have any discussions, possibly any motions that would like to be made on this project?
The rendering looks great if you can make it look like AI. Pardon me? No, you have to push the green button. Oh, not the green button.
I was saying that the neighborhood next door didn't oppose, and the rendering from the AI looks nice if you can make it look like the AI. Then it's going to be a nice-looking addition.
Would you like to make the motion to approve the request using the same footprint on the driveway or as submitted? That was gonna be my only question is if we say.
I'll second. We have a motion and a second. Can we have a roll call, please?
Aye. Congratulations, your motion is passed. Sorry, I had to ask. I was like, I want to make sure we're right. All right, item three, CS260301. Hold a public hearing in consideration of a request by Pax Terra LLC for an alternative sign plan to allow a proposed freestanding monument sign structure to deviate from the established sign standards for a property within the M1 Light Industrial District currently addressed at 710 North Walnut Avenue.
Can you go back to that sign that showed the legal size of the sign versus what they're proposing? There was one that was right next to each other. Yeah, right there. There you go.
But substantially smaller is what I was trying to get.
All right. All right, any other questions for staff?
Is there any particular size that the wall signs can be, or? There's no restrictions. Okay. Yep.
Matt, one more question. The roofing sign, Stevens Roofing, is that part of the current structure, the property itself? Is Stevens Roofing involved in this particular? That sign? Yeah.
Okay, so it's not related to that property at all?
But at that point it's too late because the other signs are already up.
All right, thank you, Matt. You're welcome. If the applicant would like to come up and speak in favor of your project, please state your name for the record.
All right, great. Any questions for the applicant? Mike.
So even if there was just, even if there was six compared to the five we're seeing here, it wouldn't go past the six foot?
All right, any other questions for the applicant? No? Thank you so much. Thank you. At this point, we will open up the public hearing. Anyone who'd like to speak in favor or in opposition of this, please step forward and state your name for the record.
Thank you so much. Okay, we will close the public section. Board, do we have any discussion or possibly any motions that need to be made?
I think it's a great looking sign and I don't have a problem with it personally. I just worry about setting a precedent where we're allowing these larger signs in the city and then once we do it for these guys, then we've gotta do it for everybody type of thing. That's all I would say.
I mean, I don't think it's a bad looking sign at all. And it's not huge. I mean, yes, it's four foot tall and then goes to six foot tall. I think as long as it does not go past the six foot tall or the four foot tall, and we can't consider the concrete below it as part of the sign because they're just utilizing the base that's there. I know change is irrelevant.
It's in the length. Yeah. Because it's 28 foot is the latitude, and then what is the additional? Another 4, so really it's 32?
Thank you. So I was just curious. Behind that's just gonna be the building so it wouldn't really reflect into a.
Okay, do we have a motion? Anyone who would like to make? I'll motion to approve. Okay, and before we have a second, are we going to have a motion to approve as staff submitted or as, because remember they had regulations or specifications in their approval. For the billboard. Yes, where they wanted the other big sign removed within 60 days after. So if you want to restate your motion, you want to approve.
My motion would be to approve as staff has stated.
There we go. Okay, we do have a motion. Do we have a second? I mean, I'm gonna second it just because I think it's a good looking sign. I think that with taking that billboard down, I will approve or second that. So if we can have a roll call on this, Caitlin.
No. I'm sorry, but this evening your motion will not pass with a 50%, correct? Okay. We can discuss with staff after this. With that being said, that was the last item on our agenda this evening. Thank you all for coming out, and I'm going to call this motion quits.
