I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. Thank you, everyone. Ms. Siddons, could you please do the roll?

11:14•Andy Thomson

The minutes will reflect that he said, Mr. Director.

11:37 – 12:40•Andy Thomson

POLICIES AND I JUST WANT TO MAKE SURE THAT THAT IS VERY VERY CLEAR THIS IS JUST A BUDGET ITEM BECAUSE WE'RE WORKING ON THINGS A LITTLE BIT DIFFERENTLY IN THE DOWNTOWN SO JUST MORE OF A COMMENT AND A STATEMENT THANK YOU THANK YOU MS. TRUCKER ANY OTHER ANY QUESTIONS FOR STAFF IF NOT WE CAN OPEN UP THE PUBLIC HEARING ANYONE WISHING TO SPEAK ON THIS ITEM PLEASE COME UP TO THE PODIUM STATE YOUR NAME AND ADDRESS AND YOU WILL HAVE UP TO THREE MINUTES I DON'T BELIEVE I HAVE ANY CARDS ON THIS ITEM BUT IF YOU WISH TO BE HEARD ON THIS BY ALL MEANS NOW IS YOUR TIME last call for the public hearing on item

12:53•Andy Thomson

Very good. Next on our agenda is item 7B, resolution number 2026-07-CRA. Ms. Siddons, could you please read the title?

13:16•Andy Thomson

Thank you, Ms. Sittons. Mr. Director, what do you got on this one?

13:35 – 14:16•Andy Thomson

Great. Members, any questions? Not seeing any. This is a public hearing. Anybody wishing to be heard on our schedule for the CRA or for our meetings in 2027, please step to the podium, state your name and address, and you will have up to three minutes. Going once, going twice. In that case, I will close the public hearing and will entertain a motion and a second to adopt resolution number 2026-07-CRA. So moved. Very good. Thank you, Mr. Rucker. Very good. Thank you, Ms. Sipple. Any further discussion? Ms. Siddons.

14:29•Andy Thomson

Great. We are moving right along. We move on to item 7C, resolution number 2026-08-CRA. Ms. Siddons, could you please read the title?

15:05•Andy Thomson

Thank you, Ms. Sins. Mr. Manager, who will be making the presentation on this item?

20:16 – 20:32•Michelle Grau

Okay. Can you touch a little bit more on the $12 million for the railroad pedestrian crossing? And I'd just like to find out also if the CRA through the city can apply for or plans to pursue any federal grant money or FDOT money that might be available?

21:26•Andy Thomson

And I would just add by saying, before I do, why don't we hear from our CFO, Mr. Zerdes?

22:26 – 23:11•Andy Thomson

And let me pile on some more to say that not just federal money is available through grants, but also through appropriations. The reason I know that is I have a publisher's clearinghouse size check from our member of Congress related to a railroad crossing. So we do and can get funds that way. So let's make sure we keep that at top of mind. Did you have any further questions, Ms. Brown? okay and Ms. Drucker you were good okay Ms. Sibyl do you have any questions okay I don't have any questions so this is a public hearing anyone wishing to speak on resolution may I ask one question of course beg

23:12•Jon Pearlman

what the conceptual idea is for that and when you anticipate beginning construction or commencing on that.

23:40•Jon Pearlman

Where do you intend to focus that effort? In which part of the CRA?

25:25 – 25:53•Andy Thomson

uh before anything moves forward in that but this is just uh will just help fund the groundwork this year in helping to further identify that issue okay thank you any further questions for staff seeing none we will open up the public hearing anyone wishing to speak on resolution number 2026-08-cra please step forward state your name and address and you will have three minutes i see mr warner getting up welcome mr warner

28:52 – 29:25•Andy Thomson

thank you Mr. Warner as usual very good questions I'm going to take a crack at each of them first as it relates to the parking and the idea of a permit for residents I think that's a good idea and I think we should it's not going to be a today vote it's not going to affect our vote on the budget today but I think that's something that we can look at the feasibility of that and I'm not sure it's going to be a you permanently can park for a year or whatever at for any length of time but there's probably some way that we can incentivize our residents to be able to park without having to charge th

29:26•Stacy Sipple

Mayor Thompson. I brought that up at my agenda review.

29:55 – 30:53•Andy Thomson

Ms. Grout, I saw a shaking of a head. I think that's general support for that. Checking the feasibility. Okay, good. So second question related to our meeting schedule. I think this year was unique in that we had a series of holidays that fell on Mondays, including religious holidays. We can't hold the meetings on our normal cadence when there's a holiday on a Monday. So we shift them all to a Tuesday. I don't anticipate we're going to be doing as much of that in the following years. We don't try to do it that way. We recognize that that can be a hardship for anybody wanting to participate we

31:36•Andy Thomson

Very good. Thank you, Mr. Caicedo. Good to see you. Mr. Liebelson.

34:30•Andy Thomson

This is a public hearing. Anyone else wishing to speak related to the CRA budget? Mr. Griffith.

34:50•Andy Thomson

Great. We need your name on the microphone, too. Oh, did I?

39:59 – 40:22•Andy Thomson

Thank you, Mr. Bell. Anyone else wishing to be heard relating to the CRA budget? Last call for public comment on the CRA's budget. I will now close the time for public hearing, and I will accept and entertain a motion to adopt resolution number 2026-08-CRA. Do I hear such a motion?

40:26•Andy Thomson

Second. Good. Any further discussion by the CRA? Not seeing any, so Ms. Sittons, please.

40:35 – 41:00•Andy Thomson

yes SIPL yes Thompson yes Drucker yes Grau yes motion passes five votes to zero very good thank you everyone now is the time for public requests I know we just had a series of public comment relating to the budget if you have something else to say related to the CRA now's the time so if you'd like to stand up state your name and address the podium you will have up to three minutes Mr. Bell welcome back

44:14 – 45:43•Andy Thomson

Thank you, Mr. Bell. I know you have more time, or you plan on speaking a little bit more on this subject later, and that's fine. Let me address one of the comments you made. Yeah, you can take a seat. It had to do with one of the last comments you made relating to the last election and what the voters voted on when it came to the police station. I suppose reasonable minds can disagree as to what the voters did or didn't do. But the ballot question simply asked them, should $175 million be borrowed in order to construct a new police station? There was no reference in that ballot language as to

49:13 – 49:24•Andy Thomson

something i'd like to bring up i feel strongly about it thank you thank you mr warner who's next for public comment on this or on public requests go ahead mr griffith

1:03:46 – 1:03:59•Andy Thomson

Very good. Mr. Fernandez, attorney's report. Very good. We will go around the horn on commissioner's reports. I'll start with Mr. Perlman. Do you have a report, sir? No report. Very good. Ms. Sippel.

1:04:09 – 1:04:21•Andy Thomson

I, too, have no report, so we can adjourn our meeting of the CRA. The time is, I believe, it's 1158. Stand by. We'll be back with a workshop meeting of your Boca Raton City Council after a word from our sponsors.

1:10:41•Andy Thomson

1:18:14 – 1:19:07•Andy Thomson

and I would just add to that the that advocacy continues but for those who are paying attention at home if they're interested in finding the history of that advocacy you can look to I think the case you reference was town of Palm Beach versus Palm Beach County where the city of Oak was one of four municipalities that challenged the county on its what they perceived to be double taxation so on this very same issue this is not a not a new issue and for what it's worth to let me add that depending on what the county commission does, that doesn't necessarily end the discussion. The sheriff's offic

1:19:40•Andy Thomson

Sorry, I think we're still on public request anyone else wishing to be heard on anything related to the city book return this request.

1:24:23•Andy Thomson

Mr. Bill, I've given you 30 additional seconds. Okay. Your time has elapsed.

1:24:31•Andy Thomson

Who's next for public request? Mr. Griffith.

1:26:16 – 1:26:36•Andy Thomson

mr warner have you spoken during this portion already because i'm losing track not not on this i have two just quick i mr warner i think you'll get another chance later i'm sorry but i think you this is maybe the third time you've spoken right i i didn't speak on this one well this is this is public requests in our workshop meeting

1:27:26•Andy Thomson

Thank you. Thank you. We will address that. Mr. Ungin, yeah, let's keep going. Public requests, we will provide some answers as best we can at the end.

1:29:12•Andy Thomson

Nobody wants to try to follow that. I will close the time for public requests. Mr. Zervas is noting that he has something to say. Please, Mr. Zervas.

1:30:08 – 1:30:41•Andy Thomson

Thank you, sir. Ms. Sipple?

1:30:49 – 1:31:30•Andy Thomson

That likewise, I likewise have no report. I think it probably behooves us to take maybe a half an hour break before we launch into our next full regular meeting. So pause for just one second. Okay, we'll do that. So I stand corrected. We will continue with our regular meeting right after this, after a brief break while we change over for our scheduled regular meeting. So stand by, we'll be right back, but we will adjourn our meeting of the workshop at 11.40 a.m. Thank you.

1:43:00 – 1:43:14•Andy Thomson

I'm gonna call to order our regular meeting of the Boca Raton City Council. The date, still September 22nd, 2026. The time's now 1155 in the a.m. First order of business is the invocation, which I will ask Council Member Sippel to deliver. Thank you.

1:43:16 – 1:43:39•Stacy Sipple

May we be guided by wisdom, patience, and compassion as we make decisions for our community. Help us listen with open minds, speak with respect, And remember that we are here to serve all of our residents. May our work today strengthen and protect the city that we are privileged to call our home. Amen.

1:43:40•Andy Thomson

Amen. And could everybody please rise if you're able for the Pledge of Allegiance.

1:44:22 – 1:44:42•Andy Thomson

Great. Then we can move on to minutes. We have four sets of minutes for our review and approval. The first is the special meeting on September 8th. The second is our workshop meeting on September 8th. The third is our regular meeting on September 8th. And the last one is our tentative budget hearing on September 8th. Are there any corrections or revisions to those minutes? If not, I'll entertain a motion and a second to adopt them as presented.

1:44:48 – 1:45:16•Andy Thomson

Thank you, Ms. Sippel. Any further discussion? If not, all those in favor of approval of the minutes as presented, please say aye. Aye. Excellent. We can move on then to proclamations and presentations. We have item 6A, community advisory panel report on the police services complex. We will be hearing a presentation today by a member of our community advisory panel, long-serving member of the community advisory panel, if you don't mind me saying so, Ms. Deborah Carmen. Ms. Carmen, take it away. Thank you so much.

1:52:18 – 1:52:31•Andy Thomson

Thank you, Ms. Carmen, for the excellent presentation and comprehensive. Does anyone have any questions for Ms. Carmen related to the community conversations? No, I suppose not. All right. Thank you very much, Ms. Carmen.

1:52:35 – 1:53:14•Andy Thomson

With the conclusion of our proclamations and presentations, which we just did, we can move on to board appointments. The first board appointment that we have for us, let me just be clear here for anyone paying attention at home, the Affordable Housing Advisory Committee, the Community Appearance Board, the Financial Advisory Board, the Sustainability Advisory Board, none of those vacancies had applicants. So we can skip over those and focus instead on the two boards that we have applicants for, those being the Civil Service Board and the Community Advisory Panel. Let's take up the Civil Servic

1:53:21 – 1:53:41•Andy Thomson

okay all any further discussion on that if not all those in favor please say aye aye congratulations miss john for the community advisory panel we had we've heard so far from three of our applicants i believe there may be a fourth here wishing to interview please step forward mr vanderbilt state your name and address you'll have three minutes

1:56:08 – 1:57:03•Andy Thomson

Thank you. Any questions for Ms. Vanderbilt before she leaves? Seeing no questions, we appreciate everybody's interest in serving on the community advisory panel. I was a member years ago. It was a fantastic opportunity. And we have, and I appreciate the fact that we have four applicants for two vacancies. So members, what is your pleasure as it relates to nominations for those two vacancies? I can throw this out there all four people who applied came and interviewed normally we like to give them a chance in the running so we can nominate all four and then we would vote for two commensurate wi

1:57:32 – 1:58:17•Andy Thomson

in the voting jack nixon received four votes kimberly patton received five and mariana demkova hankin received one therefore jack nixon and kimberly patton are appointed to the community advisory panel all right very good thank you all for your interest in serving and there have been times when folks who didn't get selected in their first go-around got selected very shortly thereafter for a different board so please stay interested please continue to articulate your desire to serve because we are happy to have you and want to accommodate you as soon as we can I believe that concludes our board

2:00:51 – 2:01:20•Andy Thomson

2:04:19•Andy Thomson

Thank you, Mr. Bell. I assure you we're not discriminating against the OGs. But are your points a fair one? We appreciate your input. Anybody else for public requests as it relates to the consent agenda?

2:06:51 – 2:07:12•Andy Thomson

Thank you, Mr. Griffith. Anyone else for public comment on the consent agenda items? Consent agenda items. Seeing none, we will close the time for the public hearing on our consent agenda. And I'll ask for a motion and a second to approve the consent agenda as presented.

2:07:18•Andy Thomson

Second from Ms. Sippel. Ms. Sittons, please.

2:07:38 – 2:46:08•Andy Thomson

Okay, I think now may be a good time. We didn't take a break for lunch before, but I think now may be a suitable time for us to take about 30 minutes. I want to get through the consent agenda and the board appointments. So is everybody okay with us taking 30 minutes and then we can reconvene at around 1250? Does that work? All right, I'm seeing something look like they're shaking their heads, so I think we're in good shape. All right, I will be back at 1250, thank you. Welcome back, everybody. And I will second that. Do we have any further discussion on this? No? Ms. Sittons, please.

3:03:18 – 3:03:37•Andy Thomson

Very good. We are moving right along into a series now of related items. We're going to do the presentation on them in combination, but we're going to have to vote on them separately, one at a time. So if you don't mind, Ms. Siddons, take a big, deep breath before we do this. If you could please read the titles of ordinance numbers 5800 through 5805.

3:06:11•Andy Thomson

Thank you, Ms. Sittons. Do you need a cough drop or? No, okay. Well, Mr. Sohaney, I saw a trend developing, or theme rather, with these several ordinances. We'll be making the presentation on these.

3:07:33•Andy Thomson

Very good. I just have a brief question for you, Mr. Beer. How many similar such construction demolition debris contracts does the city have currently?

3:08:02 – 3:08:34•Andy Thomson

Yes, it has. Any other questions for staff? No, well then we will open up the public hearing who wishes to be heard on ordinances numbers 5800 through 5805. Last call for public comment on the C and D contracts. Seeing no such comment, we will close the public hearing and I will entertain a motion in a second. We have to go one by one emotion in a second to adopt ordinance number 5800. Let's start there.

3:08:41•Andy Thomson

Thank you, Ms. Drucker. Any further discussion? Ms. Sittons.

3:08:55 – 3:09:11•Andy Thomson

Very good. Same deal, but with ordinance number 5801, why don't we just make matters easy on ourselves. Somebody say motion, somebody say second, if you don't mind. Good. Excellent. Any further discussion? This is on 5801, Ms. Siddons, please.

3:09:21•Andy Thomson

Great. That takes us to ordinance number 5802, if you don't mind, colleagues.

3:09:29•Andy Thomson

3:18:35 – 3:19:03•Andy Thomson

We will have a chance for public request right after this. Okay. All right, very good. 5807. Anyone wishing to be heard on 5807? Last call. We will close the time for the public hearing. On ordinance number 5807, I'll entertain a motion. Oh, actually, why don't we do this? Mr. Warner asked a question for greater clarification on this. Could we explain a little bit more on what the additions and the subtractions are as it relates to the downtown plan?

3:20:14•Andy Thomson

Thank you, Mr. Timberlake. Any further discussion? Ms. Grau?

3:20:17 – 3:20:35•Michelle Grau

I would just like to have some clarity on the limitations that we can have we have on the TIF funding and explain what portions of the government campus project would be eligible for TIF funding and which would not for instance City Hall and other government buildings that may be a question for Mr. Zervas you want to take a shot

3:21:28•Andy Thomson

Thank you. Any further discussion? Ms. Drucker?

3:22:09 – 3:22:25•Jon Pearlman

Yeah, I just want to say I'm happy to see the removal of the the millions that were going to be deployed for the Brightline platform and also the removal of the 80 million to the TOC and the redeployment of those funds. So I'm happy to see that. Thank you.

3:22:27•Andy Thomson

OK. I don't believe we've had a motion or second on this item yet, have we? No. So assuming all discussion has concluded, I will entertain a motion and a second to adopt ordinance number 5807.

3:22:45•Andy Thomson

VERY GOOD. IS THERE ANY ADDITIONAL DISCUSSION? DOESN'T SEEM LIKE IT. MS. SIZMS.

3:23:01 – 3:23:16•Andy Thomson

That concludes our public hearings for this afternoon, and that moves us on to public requests. So if anyone wishes to be heard on anything related to the city of Boca Raton, now is your opportunity. Please rise, state your name and address, and you will have up to three minutes. Mr. Liebelson, I see you moving in that direction.

3:34:16 – 3:34:33•Andy Thomson

Thank you, Mr. Bell. This is public requests. Anyone else? Seeing none, we will close the time for public requests and we'll move on to introduction of ordinances. The first one up is item 13A, ordinance number 5808. Ms. Sittons, could you please read the title?

3:34:58•Andy Thomson

Thank you, Ms. Siddons. I'll introduce that ordinance, which is number 5808. We can move then to ordinance number 5809. Ms. Siddons, the title, please.

3:35:44•Andy Thomson

Thank you. Who will introduce this ordinance?

3:35:47•Stacy Sipple

I am introducing ordinance number 5, 8, 0, 9.

3:35:52•Andy Thomson

Okay. Very good. That concludes our introduction of ordinances. We can move on then to city manager reports. Mr. Sahini.

3:39:32 – 3:39:43•Andy Thomson

Thank you, Mr. Sohani. Just one point of clarification on the first item you mentioned, which was the appointment for seat C. I don't think you said, when will the application window open? When will the city accept applications then?

3:42:08 – 3:42:34•Jon Pearlman

any further comment on that mr no any other questions for staff as it relates to the manager's report um yeah mr thompson is it breaking with precedent because as miss trucker mentioned she was appointed and then she ran why aren't we appointing somebody to that who can then subsequently run in the election is there a reason

3:42:36 – 3:43:29•Andy Thomson

I can take a crack at that I think it's you can there's nothing saying you can't I think the city manager said a moment ago that council members can make their own decisions on who should be appointed it's not that there's no exclusion for people who are running we just happen to know we will know by that point I think pretty soon thereafter rather who has filed to run and who hasn't so I don't think that there's any impediment to that though it may be a relevant consideration I think we should be able to appoint somebody who can then run possibly I mean I don't think they should be mutually e

3:43:30•Jon Pearlman

Will this be put forth in an ordinance? How will it be laid out in terms of the process?

3:43:37 – 3:44:03•Andy Thomson

Well, I'm going to turn to my city attorney and say in the past, what we've done is we've heard all the applicants in the form of an interview and then nominations are taken among the council or among the applicants. We will narrow it down to a series of nominees and then we will vote in the highest vote getter, assuming they have a majority, would then become the interim council member. So I think that would be embodied either a resolution or an ordinance.

3:45:08 – 3:46:33•Andy Thomson

Okay, I guess that raises an interesting point which is, exclude yourself for the moment, Ms. Drucker. For the other four council members, is there a consensus that going through the appointment process is worth it? Meaning, should we even entertain an appointment? Not saying what category of people could get appointed, just saying, should we do it at all? Because I'd hate to do all of this, have all these people apply, hear out the interviews, just for us as a body to ultimately say, well, we'd actually rather not appoint. Because that will be a lot of time towards a process that won't work.

3:46:33 – 3:46:58•Michelle Grau

um do we have to decide today no okay because I'm sort of on the fence I'm not really sure I mean this is a very important job and it's I mean how many meetings are we going to have between eight meetings that this person's going to have to fill um they're not going to be somebody that I should be able to pick I think it should be what the city of Boca Raton wants it should be going to an election so I'm kind of torn right now

3:46:59 – 3:48:15•Andy Thomson

So there's good news there is that they still get the election. They'll get the election in March. We have to decide whether it's worth having eight meetings worth of potential deadlock votes in the meantime. And that's a perfectly fair point that you're making. I too have said in the past, and I'm sure there's somebody up here who remembers me saying it, I don't tend to like to put my finger on the scale in terms of the election when it comes to an appointed position. That was my view. I stated that years ago. And so I do have a I'm a believer in letting the people decide on the election part

3:48:16 – 3:48:33•Andy Thomson

So the idea then is we hold off on releasing the application window, we allow for additional thought to be had, and we come back, we'll have in our workshop meeting, say, next available workshop, we'll have a discussion on whether appointment process will happen or not. Okay, Mr. Perlman, what say you?

3:48:35•Jon Pearlman

And so can the person that we appoint run for office? Can you review the timeline one more time?

3:48:46 – 3:49:01•Andy Thomson

I believe the timeline was we would be closing the application window at least a week prior to Ms. Drucker's departure. We would then interview candidates on the 9th of November at night without Ms. Drucker's participation because you will have turned into a pumpkin by then, right?

3:49:18 – 3:50:09•Andy Thomson

Okay. So the night of November 9th, we'd interview the candidates. Then November 10th, we would, assuming we're in favor of an appointment, appointing a council member for the period until the election, well, until the swearing in of the candidates that win in the election. So to answer your question, will they be eligible to run? I think that my answer on that, and it's going to be up to each one of us, is maybe. some people may think that that's not the kind of person we would want to have in the interim position of the council members some like you've said may say that you want that perfect

3:50:10•Jon Pearlman

Yeah, as long as we can potentially appoint a candidate that intends to run, I'm fine with that.

3:50:18 – 3:50:40•Andy Thomson

And I guess the question then becomes, are you okay with holding off on the window for the applications for a couple of weeks? Because the question was raised now, folks aren't necessarily sure at the moment if they want to move forward with that. Are we good with holding that off for a couple of weeks until our next meeting and then having a discussion at that workshop? Yes. Mr. Perlman, that was directed to you.

3:50:41•Jon Pearlman

Yeah, I think we can. I mean we can open it sooner. I don't see why we. Why we have to wait. In my opinion.

3:50:49 – 3:51:12•Andy Thomson

well on on that front i will i will agree with council members grau and simple that before we undertake the process let's at least have consensus for sure that an appointment is something we want to do until we hear from that until we hear that at our next workshop there's no point in opening up an application window at all in my view okay does staff have uh okay mr drucker

3:51:39 – 3:51:56•Andy Thomson

So it was invited in a resolution. Right. Okay. All right. This is all under the auspices of the city manager's report. Do we have any further questions on the report? Okay. Mr. Fernandez, city attorney report. Thank you, sir. Mr. Perlman, do you have a report, sir?

3:52:02 – 3:52:29•Stacy Sipple

I would just like to say thank you to Jessica Gray. Saturday was international coastal cleanup and she through Boca Save Our Beaches at South Park Beach or South Beach set up a tent. We did a whole bunch of cleanup. Council member Grail was also there and I just wanted to say thank you for helping to keep our beaches clean.

3:52:33 – 3:52:57•Michelle Grau

Um, I would just like to give a big shout out to the firefighters from station four who responded to that serious accident on 95 last week. And I guess I had learned that during that response, their fire truck was struck and severely damaged. And even despite being involved in a serious accident themselves, these firefighters got other vehicles and immediately went to help the crash victim. So I'm very thankful for their bravery and their service.

3:52:59•Andy Thomson

Thank you, Ms. Grau. Well said. Ms. Drucker?

3:53:04 – 3:54:37•Andy Thomson

The last thing I have, it's very quick. We have the slide for, we have a mayor's MVP this month. We started this a few weeks ago where a lot of the work that a city does in modern society kind of goes unnoticed or unrecognized. and the least we can do is give a shout out to the folks who work at our city that do a fantastic job every day in a different whole series of walks of life this one has to do with workplace safety and John Shipley has worked for the city of Boca Raton for over 20 years predominantly focused on making sure that every day our employees get up and go to work in a place th
