Thank you, Madam Clerk. Thank you, Commissioners. Thank you, staff. And most importantly, thank our audience and those who are present and listening on social media or other avenues. Good evening. At this time, City Manager, do we have any additions on emergency basis?
Thank you. City Commission, having heard there are no additions or deletions to our agenda that has been presented, I'll entertain a motion for the approval.
Make a motion that we approve the agenda as stated.
Second. It has been moved by Commissioner McPherson and properly seconded by Vice Mayor McDonald for the approval of the agenda as presented. Call for questions? Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Motion passed by unanimous vote. Next, we have on our agenda presentation, proclamation, public service announcement, public comments, agenda items only. And we'll do our public comments at this time. City Clerk, do we have any public service cards completed?
Thank you, ma'am. And we'll move to the presentation, and I'll have our city manager introduce and present the presenters.
You say you're looking to have a meeting? Yes, 12 Step.
So you're in the planning stages? Yes, we're just planning stages. And you haven't decided on a location?
I know you said the meeting was going to be on the marina, but I didn't know that you were looking to have that be your location. Yeah, yeah, we spoke about it yesterday.
Right now, do you have any partnership with other agencies that provide those types of services?
We've had at least two major audits, and I remember at the last time you was here, you mentioned about a recommendation for a forensic audit. I don't see that in any recommendation in your final report. I'm just wondering if that's one of your recommendations for the city to move forward with a forensic audit.
So did you see anything suspicious or kind of gave you a red flag that that particular type of audit was required or needed?
So at your last presentation, I asked if you could provide us with a list of vendors that would be able to conduct the forensic audit for us, and you said that you would.
Any additional questions from the city commission?
I just want to thank you, Ms. Reyes, for your service. We really appreciate your effort and helping us through this period where we were trying to get to the bottom of some things. Thank you so much.
Next, we'll entertain our consent agenda, which consists of the September 8, 2026, city commission meeting minutes. I'll entertain a motion for that.
It has been moved by Commissioner Cowans-Williams and properly seconded by Commissioner McPherson for the accepting and adoption of the consent agenda item, which consists of the September 8, 2026 City Commission minutes. Call for questions. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Motion passed by unanimous vote. Next, we'll have our old business discussion of existing activities of previously held event, if any. City Manager. Thank you, ma'am. next we have public hearings in our ordinance we have a resolution several resolution first resolution resolution will be read by city attorney
Thank you, City Manager. Could you give us a brief explanation?
At this time, I will publicly open a public hearing for Resolution 2026-63. Do anyone from the public wish to speak on this resolution? Hearing and seeing none, I close the public hearing. City Commission, having had Resolution 2026-63 properly read into the minutes by our city attorney, properly explained by our city manager, what is your preference?
I move that we accept Resolution 2026-63.
It has been moved by Commissioner Mike Pearson and properly second by Commissioners Kyle Williams for the adoption of resolution 2026 dash 63 powerful questions question.
City manager can you clarify the date for the period in question. I just want to make sure that we have a correct date for that particular resolution.
I just thought I heard you say 2025 through 2026. In addition to questions?
Hearing none. Ready for a vote? We'll call Madam Clerk.
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Motion passed by unanimous vote. Thanks. We entertain Resolution 2026-64, City Attorney.
Thank you, City Attorney. City Manager, could you give us a brief explanation?
Thank you, City Manager. At this time, I will open Resolution 2026-64 up for public hearing. Do anyone from the audience wish to speak on this resolution? Hearing of seeing none, I will close the public hearing. city commission having heard resolution 2026-64 properly read into the minutes by a city attorney properly explained by a city manager what is your preference mirror bear i move that we accept resolution 2026-64 It has been moved by Vice Mayor McDonough and properly seconded by Commissioner Kyle Williams for the adoption of resolution 2026-64. Call for questions. Hearing none, are you
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Resolution passes by a unanimous vote. Next, we entertain Resolution 2026-46, City Attorney.
Thank you, City Attorney. City Manager, can you give us a brief explanation?
Thank you, city manager. City commission, having heard resolution 2026-46 properly read into the minutes by our city attorney properly explained by our city manager, what is your preference? move that we accept resolution twenty twenty six dash forty six second it has been moved by Commissioner McPherson and properly second by Vice Mayor McDonough for the adoption of resolution twenty twenty six dash forty six call for questions yes I have a question on page seventy one the bottom where it says
I think we need to clarify that in the specific F
If I'm not mistaken, anyone that is renting either of our facilities are required to have event insurance, correct? And security. Correct.
Is this something that needs to be reviewed?
That's why I don't like the language, because it should be clear exactly what the price is to rent it. Because some people, you know, we already had that problem at the recreation department. When some people want to do something, it's a different price from the other ones. But we need to clean that up. That's not nice. I'm telling you, that's not good.
so the other thing with that would be are we assigning someone to do a head count because I mean clearly if you're gonna charge more you got to be able to say you have more than what you've stated on your application so I
I don't think nowhere on their application does it say how many people you expect to participate. It's just that I'm in the cafeteria. Okay, the only thing they're going to ask you, are you having alcohol or is it part of it or is it just a social gathering? I don't get that with trying to count, no head count to see how much you charge me.
I'm not trying to have no debate, but we do understand that there's caps, you know, when it comes to a structure, how many people are permitted for safety reasons.
I don't know if we can change that language somewhat, but it would be, to me, a little unfair that you would change a price without any notice to anybody. So maybe we can tweak that language some kind of way if we can.
Are we going to have a motion to postpone this resolution or are we going to try to vote it up or down? Are the language going to be okay for it at this point to at least pass the resolution or do we need to see the complete language?
I think the attorney said even if we adopt it, we can go back and address that language through a resolution, correct? Sure, you could.
It's really up to the Commission As I saying right now we're gonna be voting up or down, but I just want to make sure if someone has some problem with moving forward we can lease postpone it to the manager can kind of clean up whatever need to be cleaned up in the language and So at this point, we've had the resolution read into the minutes by our city attorney, properly explained by our city manager. Do anyone want to put any amendments with the including language that says upon approval of whatever language that's going to be added? That should be brought back to us at a later date.
Mayor Babb, I move that we accept resolution, what number is it? 202646. 2026-46, pending any necessary amendments.
So we have an amendment to this resolution pending any language change that need to occur based on our discussion earlier. And we have a motion and a second to that effect. We'll vote on the amendment language to the resolution. Call for questions. Hearing none, are you ready for a vote on the amendment language? roll call madam clerk vice mayor mcdonald yes commissioner calvin williams yes commissioner mcpherson yes commissioner scott yes yes motion passed by unanimous vote now we'll go to the resolution itself and move forward it's already been second And a question had been proposed. yes commissioner calvin williams yes commissioner scott yes mayor babb yes thank you madam clerk thank you commissioners motion passed by unanimous vote next we'll entertain resolution 2026-59 city attorney
City Manager, could you give us a brief explanation?
Thank you, city manager. City Commission, having heard the resolution properly read into the minutes by our city attorney, properly explained by our city manager, what is your preference?
I move that we accept resolution 20, adopt resolution 2026-59.
It has been moved by Commissioner McPherson and properly seconded by Commissioner Vice Mayor McDonough for the adoption of Resolution 2026-59. Call for questions. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Motion passed by unanimous vote. Next, we entertain Resolution 2026-60, City Attorney.
Thank you, City Attorney. City Manager, could you give us a brief explanation?
City commissioners, having heard resolution 2026-6 is properly read into the minutes by our city attorney, properly explained by our city manager, what is your preference?
Moved that we accept resolution 2026-60 as written with any necessary amendments.
It has been moved by Vice Mayor McDonough and proper second by Commissioner Kyle Williams for the adoption of Resolution 2026-61. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you, Madam Clerk. Thank you, Commissioners. Motion passed by unanimous vote. Next, we'll entertain Resolution 2026-61. See the attorney.
Thank you, City Attorney. City Manager, could you give us a brief explanation?
City Commission, having heard resolution 2026-61 properly read into the minutes by our city attorney, properly explained by our city manager, what is your preference?
I move that we adopt resolution 2026-61. Second.
It has been moved by Commissioner McPherson and properly seconded by Vice Mayor McDonnell for the adoption of resolution 2026-601. Call for questions. I have one question. City Manager, could you just give a brief note of what was the addendum changes or addition to this contract for public records?
You just shared that with, what did it go up? 5%, 2% and what was the actual?
Any additional questions? Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you, city clerk. Thank you, commissioners. Motion passed by unanimous vote. Next, we'll entertain resolution 2026-62. City attorney, can you give us, read it for the record.
Thank you, City Attorney. City Manager, could you give us a brief explanation?
City Commissioners, having heard Resolution 2026-62 properly read into the minutes by our city attorney, properly explained by our city manager, what is your preference?
I move that we adopt Resolution 2026-62. Second.
It has been moved by Commissioner Mike Fearson and properly seconded by Commissioner Vice Mayor McDonough for the adoption of Resolution 2026-62. Call for questions. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
I have a question. Yes, I want to make sure. Can we put the language in there that specifically that these funds can be used specifically for nothing but the volleyball team? Yes.
In addition to questions, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you Madam Clerk. Thank you Commissioners. Motion passed by unanimous vote. Next we move to new business presentation by the City Manager of activities of upcoming events if any. And we have four listed here and I have the City Manager present those.
Okay, so are we doing another contract with them or we did have to come back to the table?
Yes. I thought that was the question last meeting that we were – going to look into the status of the contract.
Not this one, let's see, because these people paying $300 quarterly, $1,100 quarterly, whatever, it really ain't making no sense. I mean, a house apartment costs you $18,000 to $2,000 a month. What I'm saying is how much they're paying, $300 a month. No, I'm telling you this is what this contract says.
Oh, no, I'm still receiving payments now. So we need to address the contract.
That is the reason it came up in the audit. We'll add that as a future agenda item, which we can ask for it at our next commission meeting. I didn't just want to put you on hold like that. Okay. I have a question. Thanks, Mayor.
So my question would be for the attorney. Since I do believe that you do review and oversee contracts, so are you able to locate any record regarding?
So since this is from a time way back, about 10 years or more, I just, you know, was wondering if you would have any records. No, ma'am. It's likely expired. And I know you weren't here, you know, during that time.
So I just want to clarify, too, did you say that the person that is currently there is not the person that's on this contract?
Okay. Move to the next item on this list, which...
This is the problem. There's 28 phone tower permits, and the auditor and the finance person says that we only receive a payment from one. And I'm going to tell you, I went back and I read the audit from last year, internal audit, and they stated the same thing that the finance director stated about how much we receive in the company. They got the same company, same amount, but different addresses. You know, she's saying that it's coming off Main Street. And when you go to the audit, it says coming off Monk City Road. So, I mean, that's just a problem. Then we done gave out 28 permits, but we o
So the one that we own is on Mux's Road.
So the other cell towers through the city, the city don't own them? Correct. And who owned those cell towers?
No, I see them. No, who owned the towers themselves? Who received the payment from them? Because they're in the city of Oakland.
Okay, but we may not own them, but we know who owned them. We don't own every piece of property in Boca, but we know who lived there, so we know who owned that property, that zone.
So specifically what I'm saying is The 28 companies came in expert permits to do a sale tower. I mean the To add on to say that what we don't know who own the tower, okay
I think that ain't saying who owns the tower itself. It's just saying what company. They have to sell a tower. Like the tower, you know what I'm saying? Who owns that? Who property is it sitting on? That's what I'm asking. Who property is it sitting on? Because the one that's over there by the old dump, I know the city owns that. And there's one in Main Street, and there's one by the old Highway Patrol office, and there's one on Muck City Road. I'm saying all that's sitting on city property, so we got to know who owned it.
I have a question. Are these permits all active, the ones on this list?
I see some dates dating all the way back to like 2014. Correct. Excuse me.
How can you say it's not active and they got permits? That's when they got the permit. They put it up there. That don't mean that they are not using them.
Right. That's when they requested the permit, when they got ready to put it on the tower. So I'm saying that don't mean that they're not making payments.
which ones are actually up and running i think the bottom line is that um we're looking to see which ones are supposed to be providing revenues to the city and um if a bunch of these on here are inactive then obviously i understand how a permit works You get the permit so that you can perform work, and then when it's done, it's done. But as far as that tower, it continues to operate within the city. So I know that you mentioned about the one that we're only one we're receiving revenues from. So if they're operating within the city, then certainly we should be receiving revenues from the operat
We should be receiving that from all of them, not just that one that we were told about in the previous meeting.
Excuse me, the confusing part is, When the finance person stated that we receiving money from T-Mobile from off Main Street, but when you read the internal audit report, it says, must see the road. The same amount, same name. So if we don't own that one, how did the finance director come up with that name, with that address on her finance report? Report.
So if we're receiving taxes from them, that should tell us who the owners are, correct?
I'm still thinking that we need some clarification because Like Commissioner Scott said, the finance director informed us that we only had one tower that we were receiving revenues from. And so now you're saying there's three and possibly more because, I mean, this list obviously needs to be reviewed and, you know, updated or however you want to say it.
That would be good. I think the other question, too, we had regarding that was to look at what cost comparisons were available with regards to those cell phone towers. So someone was supposed to do some research and look into that so that we can see how we're faring with regards to what we're receiving as revenues and or taxes in that regard.
We can move to the third item on your list.
Next will be the report of the mayor, and it will be brief. myself and the city clerk attended the mayor's uh literacy luncheon that was held last week at the marriott palm beach it was a great event there was a black african-american young who's the author of a book which would be read to students during this initiative. It's done annually. We ask that our, through the city manager, ask that our city staff, those that are able to participate, sign up to be able to read. It's only about 30 minutes on link for each individual reader. It doesn't have to be necessarily at the school. We can volun
Could you just give us a brief update on the storm in 1928, how that program went? I was unable to attend because I had a conflict on that particular day.
Thank you. Next, we'll have the report of the city attorney. Thank you, ma'am. And next, we'll have the report of the city clerk.
I just have one correction if I'm not out of order, which I don't believe I am. On the election in March of 2027, there are three seats that will be available, but only two of them will be for a three-year term. This third seat is only for a one-year term.
This term currently, which was Commissioner Bowling's term.
Commissioner McDonnell, the vice mayor, was appointed. to feel that true up until the next election and yes election is actually March of two thousand twenty six notes on how to try to resist it is the next municipal election so at that next municipal they'll be voted to feel that that's what we get so that's why it's three I need clarification attorneys. My understanding that the appointment for Ms. Commissioner Vice Mayor McDonough was to be appointed until the next minister election cycle which was or will be March of 2027. His term ends, actually, in 28. So his term, that term, will only b
You would have to run again for another three years. If you win in 2028, you have a three-year term.
And why I'm saying that, his term would have ended 2008. I understand what you're saying.
We got a cycle where we have three run and two run, and we're going to offset that cycle. They're going to be three, too. I understand what you're saying, but I'm saying there's still going to be three. If three seats up for election. I understand.
It changes when he quit. So she didn't run, so she has to run in this term. She's going to have to run with Mike Ferguson.
All I'm saying, whoever's running this term, I believe it's only going to be for one year.
Next time, it's just going to be me and your seat. That's it.
That's not my interpretation, but the city attorney said she was looking to it. And that's not the clerk's interpretation either. That's just my personal interpretation of how it should be. You won't, though. Okay, I could be. Okay, go ahead.
Oh, yes. Currently, we have two seats that's on the Parks and Recreation Board. One is due to death, and one is due to one person has missed more than three consecutive meetings, and we've reached out to that person to no avail. However, we would like to open the floor to appoint two additional people appointees to the Parks and Recreation Board to make sure that they have the qualified amount, which is five. And right now we have three. I mean, you still have a quarter, don't you? No, no, no, but we still, the board, it calls for five, though. And even in that, they're going to have to, in th
Okay. Next, we'll entertain future agenda item of the commission, if any, and I'll start with Commissioner McPherson.
Yes, I need to make a motion. That's the only item that I have for future agenda item, as well as the Parks and Recreation Board appointments for the next commission meeting.
It moved and seconded. Questions? Hearing none. You ready for a vote? Roll call, Madam Clerk.
Yes. And my future agenda item would be to have the city manager research and find how much it would cost to do a forensic audit based on the recommendation of our consultant and have that as an agenda item at least for discussion. At a minimum. Second. Been moved and seconded. Call for questions. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
motion passed by majority for one vote and my last one would be to either have the city manager have a workshop on what direction we would take as far as the arena restaurant was going to put it out on be it whether we're going to try to operate a sale of whether we're going to do a public private partnership with someone what direction are we going in so we can begin to get some type of revenue from that building second It's been moved and seconded. Call for questions. Hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yes. Thank you. Motion passed. I now just vote. Next, we'll move to Vice Mayor McDonough. If you have any that you would like to have considered for a future agenda.
So it would be good if we can pin down the cost of a forensic audit. But I heard Ms. Reyes say that she had provided the mayor, I'm sorry, the city manager with a list of vendors. So I would say that we can prepare to vote on who we're going to use for the audit process. we can have that as a future agenda item i'm sorry that's what the same the vendor selection i think that's what i did you know you said find out how much it cost that was part of it which i know we're saying the same thing i'll put it that way we're not saying okay okay i'll leave it at that that's not the same thing but okay
Can I just add one thing to that? I know that the documentation that was that was pointed out as far as Ms. Red said she gave to the city manager that that be included in that package.
And my question would be, what was the difference between that motion and the motion that I presented as far as having a forensic audit on the agenda? I don't know.
Can y'all play the tape back for me? Because you asked her to find out how much it would cost. That was part of it. That's the same thing. You didn't say that, though. Let's not debate that, because you didn't say that.
So you're telling me what I say. But go ahead. OK.
Anybody going to tell them what the difference is? Because I'm telling them that he's not hearing me.
James voted no, so he knows the difference. What was the difference, Commissioner Scott?
Oh, I got the right wording for you. I'm going to vote no for her. Because what y'all saying is just a bunch of what I call happy talk. We're going to break it down when I get it, when my turn comes. I'm going to show you exactly how we're going to pin this down. Because we ain't going to sit up here and play merry-go-round on the street. You say this, and they bring it back when they get ready. We ain't doing that no more. Go ahead. I ain't breaking it down. Go ahead. I'm breaking it down when my turn comes.
been moved and seconded additional questions. Roll call, Madam Clerk.
No. I don't see the difference. It's the same thing with say the brightness before the commission for a future agenda item. It's identical, what I say. Commissioner
Yes, I do. So I would like for us to use for a future agenda item with regards to reviewing upcoming revenue. Let me reword that. we need to have an automatic calculation in place for the increase of city revenues. Especially, I'll preface that by saying there's been like 10, 15 years when we haven't had an increase in the revenues that are coming in. And I don't know what budget can survive by not having increases already built in to... sustain their livelihood. So an automatic calculation for increase in our incoming revenues.
Because the contracts all have different dates, but we need to automatically know that there's going to be an increase for that renewal of that contract. We can't keep. Okay, I see what you're saying.
My question would be, I don't know of what organization that have an automatic increase for it, just blank everything they provide.
Can I make it real plain for you? Don't your bills at the house go up every year? Your bills at the house go up every year. Every year, yeah.
I think that would be bad practice, that's all I'm saying.
In addition to questions. Question, yes. But on each contract, we have to make that decision when we're renewing the contract. The issue being in the past, I think, you know, just trying to get everything, getting all the contracts and being able to review them to make sure that they're up to date. But I think that's a decision that the commissioner make just for information purposes. it are I made the same situation with the tree farm down there what problem is is that's getting the contract yeah what we I mean yeah all of it
Is there a second on that? Second. Questions? My first question would be, you say that we say that we wasn't going to get rid of the cemetery, and I'm not saying we are, but I don't recall ever having a discussion whether or not we're going to keep or not have the cemetery. I don't just want false information.
I don't have a problem with what she's saying. I don't see what she's saying.
Don't we have a motion on the floor? Yeah. I'm sorry.
In addition to questions, hearing none, are you ready for a vote? Roll call, Madam Clerk.
Yeah. Let's just put this in perspective. I'd like to make a motion for RFQ for the forensic audit and RFQ package be available by Monday for the commission to review and brought back to the next commission to be voted on.
Oh, okay. If the RFQ, that means y'all have to put a package together to be sent out for somebody to bid on, right? Correct. So we, as the commission, when you put the package together, we need to review the package and say, okay, we can do that on our e-mail. Yes or nay or yay. And then when you bring it back to the commission, we can vote on it. Is this the package that we're going to use to put out there for somebody to bid? Yes.
OK. I think what I'm saying is the package. I mean, the package is going to be done by the city manager and yourself. Are we doing this viewing it like, okay, yeah, I agree. Not that we're voting to use it or not. You can't even do that. You can't do that either? No, sir. Okay, just bring it back to them. We'll vote on it all at the same time.
Okay. Okay. All right, I'd like to make a motion for RFQ for a forensic audit. And RFQ package be available. I mean, we can't do that one. RFQ be brought back to the next commission maker to be voted on.
It's been moved and seconded. Call for questions.
You still got to put it out. They give you some prices. Here's my thing. If she brings you a bunch of names and they got a bunch of prices on there, you're not going to know who you're hiring. Just because somebody gives you a lowball or you a number, that don't mean they... It may not be what you want.
She can bring that back. She can bring that back. But here's the thing. If they put together a package, that means they know when they advertise it what they're looking for. So when they advertise the position, all right, we're doing a contract. What's in the contract? What type of person on forensic audit are we looking for and what we expect and what it would look like for them to look for? If they do that, then they'll give you a price. If they can't, then I'll say, well, we don't do that. See, what you're doing now is just saying, she's bringing you back a price. She's bringing you back. W
I just want you to say I'm trying to skip across all that.
No, no, no. Monday would have been for us to review the package that they put together, but she said we can't do that. So we have to bring it back to the commission meeting.
They got generic packages that you can just go in and put in different, but I'm just saying it's all right. Whatever you say, that's what it's going to be. Okay, I never said, oh, y'all put a motion.
It's been moved and seconded. We're here for question now. My question is, as I indicated or shared with the Vice Mayor, I don't even see the difference between your motion and the motion I made other than the time frame.
Keith, I'm sorry, but the motion you made was just something that lagged time by. The motion I made was asking for RFQ. That means it's a package that's going to be presented that people can look at and see if that's something they want to do. What you're doing now is just wasting of time. The only thing you're doing is just kicking the can down the road. And I'm just sorry to say that, but that is exactly what you're doing. So I understand you're sincere about what you're doing, but it's still kicking the can down the road. We're trying to just pin this down and move on.
Well, y'all can discuss that. What if we vote on it?
Oh, okay. Okay. She says she needs more time. All right. I understand.
So that still doesn't negate the information that we at the next meeting. Well, she still didn't bring y'all back, whatever y'all want. Okay, I'm just trying to make sure we can get that, and that can be reviewed still prior to bringing the other stuff back. I just want to make sure that that's clear, that's all. Because I would like to see the documents myself. I mean, as far as the.
