0:00 – 0:50•Brittany Davis

We are going to allow public comment today. I believe Erin had, while we were getting set up, had said to any member that is sitting in the community today to make sure that you have registered on the topic that you'd like to speak on. We will allow up to three minutes. Ms. Ray has a timer for us, so if you do go over, just, again, we do our best to try and keep everyone at the same level and everything very precise. And then on top of that, if you have a cell phone with you, which I know everyone probably does, please keep that on silent. It echoes really bad up here, so we just want to make

1:28•Brittany Davis

Lisa to move forward just in case we do run a little long and she's not able to make her comment. Are we able to make a notation? Okay, perfect. Thank you. Go ahead, Lisa.

3:03 – 3:21•Brittany Davis

And again, if you are going to be here, the Northeast sector is on the back page, item D. So we will discuss that further. I understand some people have no kids in school today, et cetera, so we'll allow a few this morning if we need to.

5:16 – 6:10•Brittany Davis

Okay, perfect. On that note, we will go ahead and close public comment, which I apologize, I did not read the initial issues or concerns not addressed on the regular agenda will be raised at public comment time. We will move forward to the consent agenda. The commission may request for consent agenda item to be moved to the regular agenda for presentation and public comment. Otherwise, the consent agenda will be considered in one vote. All items on the consent agenda have been recommended for approval by staff with no opposition received to date. Some of the items on the consent agenda may req

6:11•Lyndon Roberts-Galindo

I will make a motion to approve meeting minutes.

6:13 – 7:28•Brittany Davis

Okay, motion from Linden on meeting minutes. Second. Second from Mark. All in favor of approving the meeting minutes from August 17th, 2026? Aye. Okay, so we have 7-0 on meeting minutes. Our second item on the consent agenda is FP26-17, Ural Estates. Am I saying that correctly? Yes. okay perfect um section one which is smd number two request for final plot of url estate section one being the south 136.28 feet of the east 265.8 feet of block 9 and the south 136.28 feet of the of the west of 151.45 feet block 10 JNO, I need some readers this morning, guys. A March subdivision located at East 44t

8:31 – 8:48•Brittany Davis

And what, sorry, I can't read that far. What are the, what's the lot frontage end up being? Is it 52? Yes. Okay. And then, okay, conditions for drainwalk. And have they asked for a waiver on sidewalks?

8:51•Brittany Davis

Any other questions for Austin? Okay. All right. Thank you, Austin. Thank you.

8:58•Lyndon Roberts-Galindo

I'll make a motion to approve as presented. Second.

9:01 – 9:36•Brittany Davis

We've got a motion and a second. All in favor? Aye. All right, 7-0. Okay, we will move on to the regular agenda. Our first item today is subdivision plants. The Planning Commission has final authority for approval. Appeals may be made directly to City Council. Our first item is FP 26-18, Spillway Road Edition, Section 1. This is in the ETJ. A request for final plot of 10.486 acres at 8448 Spillway. Thanks, Austin.

11:46 – 12:08•Brittany Davis

Okay, I've got a few. So first off, in the comprehensive plan review, if I'm not mistaken, spillway, obviously, we discussed this a couple months ago, the future chance of it having connectivity on the other side is very slim. So it is more than likely going to be updated to a local road?

12:26•Brittany Davis

Right. Okay. And refresh my memory on paving width on a major or the different paving width, please.

12:49 – 13:05•Brittany Davis

And the property that's across with the high fence, again, we discussed this a few meetings ago and I don't have my notes with me. I can't remember, were they doing some sort of remodel that flagged, or they did a replant on their own property to add a structure?

13:17•Brittany Davis

Okay. And that was one property owner, and now we're looking at 10? Okay. Okay. Thank you. Any other questions for Austin?

13:42•Brittany Davis

Okay. Sorry, go ahead. I was just going to ask, flip back to the plot, but that was all I needed.

13:48 – 14:08•Kandi Pool

Could you go back to the slide with the lots? Yes. in your recommendation about some of them not being included in, what was that number four down there in your review?

14:14 – 14:25•Brittany Davis

Okay, and can you go through that again? I'm sorry. If they're going to remove the flag lots in general, you're asking them to redo this, or you're just asking them to rename the street so it's not like spillway court?

14:55 – 15:16•Brittany Davis

Okay. And I'm assuming the majority of the people, let's say, if we're looking at it coming out of that development, will most likely go left to get out on the airport road. What is the width of spillway required by the city now? I'm sorry, did you ask for additional footage for the right-of-way?

15:25 – 15:51•Brittany Davis

any other questions for austin all right thank you austin we'll go ahead and open up public comment please if we do we have any public on this russell billy you know the drill good morning russell with skg we would ask for your approval as presented we're good with revising and removing the the flag lots we were just trying to

16:45 – 16:58•Brittany Davis

Thanks, Russell. Any questions for Russell? No? Perfect. Thank you. Okay. Okay. We'll go ahead and close public comment on this and open for discussion amongst members or...

16:59•Lyndon Roberts-Galindo

I'll make a motion to approve as presented.

17:02 – 17:33•Brittany Davis

Second. All right. We've got a motion and a second. All in favor? Aye. Aye. All right. Motion passes 7-0. Our second item on the subdivision plans is RP26-19, first replat of Fair Park Edition, block seven. This is SMD number two. A request to replat lots six and seven of block seven of Fair Park Edition into lots 6A, 6B, and 7A, located at 221 East 41st Street.

18:48•Brittany Davis

Sorry, Austin, can you pull the plat back up, please? Sure. Thank you. Okay, and again, I can't. So we're 100 feet deep, and what's our frontage?

19:08 – 19:19•Brittany Davis

And just out of curiosity, I know that this isn't the item at hand, but so after they do the replat, are we going for a zone change then?

19:25•Brittany Davis

They do? Yes. Even with the replat, it will fit just RS1 if they continue that? Yes, correct.

19:32•Kandi Pool

And did you say that they would all be a Goliad Street address? Is that how this is instead of the 41st?

19:50•Brittany Davis

And again, I'm sorry, I can't read that. It's so small. The dotted line and what does that say on there?

20:26•Brittany Davis

Okay, so does that mean that this needs to be updated?

20:38•Brittany Davis

Okay, sorry, just so we're clear on that. Okay, any other questions for Austin?

21:01 – 21:14•Brittany Davis

Are there other vacant lots, whatever, direct south or west or anything that would, if they stopped and did a private connection that would affect future development in the neighborhood? Or does everything else seem to already have a tie-in?

21:21 – 21:32•Brittany Davis

You know, we look at some of these plats and, you know, people want to develop lots, but then they've got to run a sewer two blocks or anything like that. We just want to make sure that we're not hindering other future development. Thank you.

21:36•Brittany Davis

Okay. If we have no more questions for Austin, we'll open up public comment.

22:44 – 23:08•Brittany Davis

Okay. Any questions for Russell? Actually, Russell, on that, like when it's a private... Maine, is there money, like does the city require the citizen to put away additional money in case there is an issue? Because, I mean, heaven forbid it collapses and the private citizen doesn't have money for repair or anything like that. Just out of curiosity.

23:21 – 24:29•Brittany Davis

for that kind of stuff so but the city doesn't require any kind of thing for that so yes okay perfect thank you thank you any other okay we'll go ahead and close public comment and open up for discussion or emotion In my opinion, I feel like as long as, again, especially if it's new construction, we're not looking at any, hopefully, any needed repairs anytime soon. But, I mean, if the city staff and the owner can come up with an agreeable term on having that be private, I don't see that being an issue. Okay. As long as it's not cutting off any future development, again, it looks like that neig

24:51 – 25:12•Brittany Davis

And now, based on what Russell had asked, that if by chance city engineering cannot come up with, you know, everyone's on the same page as having that private, do we need to make an exception to have those easements removed from the plat, or do we have to do anything with that? I'm just making sure that, again... Having forbid, we don't have an issue for that.

25:28 – 25:55•Brittany Davis

I'm just looking at, I think it's lot B, 6B maybe, the one in the middle. If there were those easements... And it ended up being more in the cities right away or whatever. It just would make the buildability very tight for the applicant. So I just want to make sure that if by chance they can't do what they propose, that they're not stuck within those easements, that we can remove them or whatever they need to do.

26:06•Brittany Davis

Okay, perfect. Thanks, Erin. Okay, other thoughts, discussion?

26:37 – 27:00•Brittany Davis

No, that's a good question. I think some of the Santa Rita homes have an individual. Okay. Perfect. Okay. Any other questions or thoughts? I know, Liz, you're kind of looking at it. Do you have anything to add? Okay. Sorry, killing you out there. Okay, so does anyone want to make a motion or any recommendations?

27:05 – 27:51•Brittany Davis

Okay, got a motion and a second. One from Jennifer, one from Lyndon. All in favor? Aye. Okay, we've got a 7-0 on RP26-19. We're going to move on to conditional uses. The Planning Commission has final authority for approval of conditional uses. Appeals may be directed to City Council. Our first item this morning is CU 26-15, 1706 Shad Road, which is SMD number one. This was presented and tabled by the commission last month in order to obtain a few more bits of information, I believe. So we have a request for approval of a conditional use for short-term rental located at 1706 Shad Road.

29:33 – 29:52•Brittany Davis

Okay. Nicholas, I've got a, and this might be a silly question, but they pass their safety inspection. But if the carport wasn't permitted or inspected, I'm assuming the safety inspection is just making sure that all windows operate, that there's smoke detectors, fire equipment.

30:05•Lyndon Roberts-Galindo

I do have a question on the carport. Was the permit... application done by a previous owner? I see that it's for sale and I'm trying to remember.

30:28 – 30:41•Brittany Davis

Okay. Because I know that was a topic of discussion if it was, because somebody had mentioned, and I can't recall who, but that it was a different owner and there had been all these people there. So we just want to make sure that we're... I thought so too.

30:58•Brittany Davis

Local operator. Okay. Any other questions for Nicholas? Okay. All right. And do we have public comment?

34:28•Brittany Davis

Thank you for your time. I'm so sorry. Can you just state your single member district or your address for the record?

34:38•Brittany Davis

Thank you, ma'am. We appreciate your time this morning.

34:41 – 34:56•Kandi Pool

I do have a question. Yes, ma'am. You said something about the channel and you don't do donuts. Can you elaborate a little bit about that? Are you saying that there is some rules about the use of the waterway?

35:32•Brittany Davis

Again, it's so hard to see some of these photos. Or are they, I'm assuming they're having to do a public drop-in.

35:42•Brittany Davis

And so have they been parking the Sea-Doos that have been zipping around on that boat dock?

36:00•Brittany Davis

Okay. Any other questions for Shannon? Nope. All right. Thank you for your time this morning. Stormy? Bradley?

36:17 – 36:29•Brittany Davis

All right. Thanks, Stormy. Well, I think, you know, again, last month we decided to table it and hoping that you would come as an applicant and answer just some of the questions that

37:23•Brittany Davis

Okay. So it hasn't been operating as an STR. It's been more friends and family.

37:35 – 38:01•Brittany Davis

You know, one thing I always recommend, you know, the lake is probably the most controversial place. is for SDRs. I was aware whenever I... Just based on lot lines, proximity of homes, lack of fencing, those kind of things, just respecting other people's areas when you're in more of a public setting like that. So we always recommend talking to the neighbors, letting them know the plan, giving them contact info.

38:55•Brittany Davis

Okay. Perfect. Any other questions for Stormy?

38:58 – 39:21•Lyndon Roberts-Galindo

Stormy, of course I'd say that and get a frog in my throat. If it was to be approved, do you emphasize on rules and regulations? I know that we can't do anything and you can't do anything about what they do on the lake. because that's for Lake Patrol. But sometimes it's just nice to remind occupants if they're staying there.

39:58 – 41:00•Brittany Davis

Okay, perfect. Thank you, Stormy. Any other questions for Stormy? Okay, thank you. Thank you. Any other, okay, we will go ahead and close public comment and open up for discussion or motion. Again, as I said, the lake is always very, very controversial. A few years back, we had one on Beatty, which I can't remember if it was Beatty Drive or Beatty Circle, but it was very similar, very, very narrow, one way in, one way out. But, you know, we've got to also think that Airbnbs do bring in tax revenue to the city. It brings in, you know, friends and families and, you know, people get to enjoy our

41:12 – 41:38•Lyndon Roberts-Galindo

Well, I mean, the only thing that I can say, too, is I actually do own a property out by the lake, and I have a very large family that comes in and stays. So I utilize that. I don't rent it out, but I let people stay who have kids and so forth. So I can understand where someone may think it's being leased or rented one way, but for the most part, You have to take the benefit of the doubt that they're letting a family member stay there like I do.

41:49 – 42:13•Brittany Davis

Okay, well, and we're going to close public comment. And again, thank you so much, Shannon, for your comments on that. It does, in my opinion, sound like the situation has changed for the applicant versus what it sounded like was occurring prior to the applicant. owning the property herself. So with that, any other discussion?

42:13•Lyndon Roberts-Galindo

Just to be clear, what was your last name?

42:26•Lyndon Roberts-Galindo

So you're planning on removing it from the market if it were to be approved? Sorry. And I was the one that just said, yeah.

43:19•Brittany Davis

Okay, after this, we are closing public comment officially.

43:33•Lyndon Roberts-Galindo

Unfortunately, that's just hearsay for us, and so we appreciate your comment.

43:40•Brittany Davis

All right, public comment on this item is officially closed. No further public comment.

43:45 – 45:05•Kandi Pool

I know that we've had several on Lake Nasworthy, and the ones that have not been approved basically have been on small streets. Not much with the in and out, only one way, that kind of thing. And it bothers me that there's not two entrances or exits and the smallness of the street itself. And that's something that we have considered before. I know that traffic and safety on a small street with a curve is a big deal as such, especially with only seven houses there now. My only other comment would be... The use of it as an STR or family or whatever has brought the complaint that we've heard toda

45:34 – 47:23•Brittany Davis

And again, we see a lot of these, you know, with the lake being annexed into the city forever ago, the streets weren't built to the width that we expect and whatnot. Again, it is a recreational body of water. And, you know, again, just like... If you choose to live on, I say this every time that we have a lake one, if you choose to live on a recreational golf course, you can't stop golfers from parking in front of your fence and having their music. If you live on a lake, you can't force people to not drive by your home on their boat. i do agree that you know there is danger being on the water

48:08•Brittany Davis

All right, any other thoughts? Was that a motion to add that or is that just a comment? I think a comment.

48:17•Brittany Davis

Okay, any other comments or concerns? Anyone like to move forward with a motion?

48:24•Lyndon Roberts-Galindo

I will make a motion to approve with the time to be changed for quiet time to be 10 p.m.

48:35•Brittany Davis

Okay, so we have a motion from Linden. And again, what is the parking?

48:39•Lyndon Roberts-Galindo

And preferably the parking spots be limited.

48:42 – 48:55•Brittany Davis

What is the parking limitation? It should be four. Over in that neighborhood off Shady Point, is there like a, there's not a public area that you can park a boat trailer? Sorry.

49:02 – 49:16•Brittany Davis

So I think that the applicant needs a plan for anyone that has a trailer, so that way it's not blocking the neighbors or interfering with, because it is such a narrow drive, people coming and going.

49:18•Lyndon Roberts-Galindo

So my motion would include limiting the hours until no later than 10 p.m. and limiting the parking to four.

49:32 – 50:14•Brittany Davis

Here's my motion. Okay. Motion from Lyndon with some restrictions. Do we have a second? I'll second that. Okay. Second from Liz. All in favor? Aye. Aye. Are you a nay or a yay? I'm a nay. Okay. So we have a 6-1 on that one. Okay. Thank you all. And thank you for everyone that showed up for that. Okay, our second CU case today is CU 26-17, 115 Hildago, which is SMD number one, a request for conditional use to allow a short-term rental located at 115 Hildago.

51:20 – 51:36•Brittany Davis

Normally, auto turns on for me. You gave me the broken one today. Okay, any questions for Nicholas? No? Okay. Do we have any public comment? No? Well, with that, we'll open for discussion or a motion.

51:40 – 52:22•Brittany Davis

Okay, we'll do a first from Jennifer, and I'm going to call Candy on that one. She got the second. So we have a motion and a second. All in favor? Aye. Aye? All right. seven, zero. Okay, so we are moving on to rezonings and comprehensive plan amendments. The City Council has final authority for approval of rezonings and amendments to the comprehensive plan. Our first item of discussion is Z26-10 2000 Mark Street, and this is SMD number four, a request for a zone change from single family residential zoning district to the RS6 three to four family residential zoning district located at 2000 Mar

1:07:28 – 1:07:51•Brittany Davis

And so, you know, as a commission, I think a lot of us sat back and said, okay, what does this really look like in this neighborhood? And so thank you for the visual. Thank you for the site plan, even though it was a different address. That definitely helped me personally. I'm sure it helped some other people up here too. So what questions do we have for Erin before we open for public?

1:07:51•Liz Albert

Erin, on the picture that you showed us on 44th Street, what zoning, what was that zoned for?

1:08:04•Liz Albert

Okay. But the idea is it's supposed to, is the applicant here today?

1:08:18•Liz Albert

So, but they're saying that they want to build something similar and not identical to what is shown in that picture?

1:08:25•Brittany Davis

Yeah, I think the biggest difference was just because it was a quad, or sorry, a duplex and they were going to make it a triplex.

1:09:09•Liz Albert

Can you show the parking again? Yes, ma'am.

1:09:14•Brittany Davis

Yeah, because I believe you said there was five spots. There's five spots on that lot.

1:09:18•Liz Albert

And what street is that to the east of the parking?

1:09:41 – 1:10:00•Brittany Davis

So if they did three triplexes, they would have to be required 10 spots plus a circle drive? Or can you go back to how many parking spaces? Is it two per unit in our assistance? That is correct, yes. Okay. And the lot size is adequate for at least 10 spaces?

1:10:04 – 1:10:18•Brittany Davis

Okay, perfect. Any other questions for Aaron? Ray, do we have public? Okay, perfect. All right, if we don't have any other questions for Aaron, we'll open up public comment. Oh, sorry. Yeah, go ahead.

1:11:07 – 1:11:42•Brittany Davis

But if they did a duplex, I'm just looking at it as, okay, so you drive around, and I don't know what the frontage on some of these are, but some of the duplexes, you've got, like, very very limited parking this allows circle drive adequate parking hopefully not as much on street parking if somebody had two vehicles right whereas again like with it if you did two duplexes on these lots They could just have a front-facing drive and then a very large backyard technically, right?

1:12:07 – 1:12:26•Brittany Davis

So, and this is just my opinion on this, so even if you did an RS-2, depending on the configuration, it could look like it was a higher density than what this, this looks private, this looks very nice, very well maintained, you know, and again, as adequately parking for the structure type.

1:12:39•Brittany Davis

Thank you. Okay. Let's get some public comment going. Who do we have?

1:12:58 – 1:13:46•Brittany Davis

So we just need to move his public comment to the next item. Okay, perfect. So if there's no other public comment on Mark Street, we will go for closed public comment and open for further discussion or motion. Erin, can you bring back the numbers? And thank you again. I know that took some time, but that's extremely helpful on a taxable basis, especially knowing kind of what we look at as fire and police costs. So that's all the surrounding properties. Can you go to the slide that has the... You had it based on like if this is how much a quadplex, this is tri, or sorry, duplex, single. There w

1:13:50 – 1:14:04•Liz Albert

Okay, I'm jumping ahead here. No, you're good. My question, what we were shown was 622 East 44th. That was just, I guess, a rendering. The picture...

1:14:06•Brittany Davis

That was the photo of the front with the circle drive. That was a project. That is on Forest Street over in Angelo Heights. It's a forest in 44.

1:14:15•Liz Albert

I thought it had 44, so I was like, how are we approving something for 44? Okay. Okay.

1:14:42•Kandi Pool

Aaron, could you go back and show the lot that we're considering on Mars? Yes, ma'am.

1:15:00•Kandi Pool

So the address would be on marks, or is one of them going to be 20th, do you know?

1:15:38 – 1:15:55•Brittany Davis

So, and can you go back to the zoning map you had? This? No, the overall. Thank you. Perfect. So, our red sun is the subject property. Yes, ma'am. And the orange block north of that is?

1:16:08 – 1:17:40•Brittany Davis

So again, I know that everyone is always a little apprehensive when it comes to new zoning and whatnot, but for the public that isn't aware of this, there was a task force team set up in order to create some of these new zoning districts, something that the city needs, something that researchers have come to us saying, you need affordable housing. The way a city grows is by affordable housing. That's how we get businesses to come to St. Angelo if they have places for their employees to live that are affordable. As Aaron said, this is not a HUD project, this is just general affordable housing f

1:17:41•Liz Albert

Erin, do you know, does the applicant plan on renting these properties or selling these properties?

1:18:17 – 1:18:35•Brittany Davis

And again, in order to go to an STR, which is always everyone's question when we look at multiple units, it would have to be on a case-by-case scenario because it's not under an RF zoning. The applicant would still have to come in front of the city and go through all of the correct channels. That is correct.

1:18:57 – 1:19:21•Brittany Davis

Well, especially depending on how he lays it out, if he did something similar to what his other concept was, you know, having kind of almost that little circle drive definitely alleviates some of the flow. But I believe Mark's is a wider street than 20th anyway. It is. Okay. Okay. All right. With that, do we have a motion?

1:19:25 – 1:20:01•Brittany Davis

First by Candy. I'll second. Oh, okay. We got two seconds. All right. All in favor? Aye. Aye. Okay. 7-0. So our next zoning is Z26-11, 622 East 44th Street, which is SMD number two. A request for zone change from the single family residential zoning district to RS6, which is three and four family residential zoning district located at 622 East 44th Street.

1:30:32 – 1:30:45•Brittany Davis

But with that being said, they would be not connected in RS-5, but you could still have the same density in RS-5 because it's infill as RS-6.

1:31:32•Brittany Davis

All right. Any questions on that for Aaron?

1:31:36•Liz Albert

And I guess the plan is exactly the same here. You've already said this, but I'm just making sure.

1:31:46•Brittany Davis

Yeah, since they're deeper technically, I think you could do a quadplex without compromising square footage.

1:32:15•Brittany Davis

So it could be up to eight units? Yes, ma'am. But again, it's in RS5, or sorry, it's in, yeah.

1:32:36•Lyndon Roberts-Galindo

Well, we could do RS2 and only allow them to put a duplex.

1:32:44 – 1:33:32•Kandi Pool

With the comments from the owners surrounding this property and looking at the map that you had about all of the residential, I mean, it's smack dab in the middle of a huge residential area without duplexes or any real commercial or anything else. It may be hard to have a tri or a quad on those two lots. with the look of the neighborhood. I kind of like the RS2 thought process, but I don't have a problem with the infill either being something that can be developed.

1:33:33•Lyndon Roberts-Galindo

But if we did an RS-5, wouldn't that basically mean that that builder could build basically tiny little houses? Yeah, I guess so.

1:33:43•Kandi Pool

To me, that's more negative. Yeah, you're right there.

1:33:49•Lyndon Roberts-Galindo

Whereas RS-2 would still give them the ability to build on it, but just have, if they were those...

1:33:56•Brittany Davis

But they could still appeal the fact that we put RS-2 zoning on it and come back... Or different, correct? Or no?

1:34:26•Brittany Davis

Or, I mean, like, can they bring a, what's the, it has to be a minimum on a comprehensive, or a PD, right?

1:34:39•Brittany Davis

Okay. Okay. I think they would be more appropriate. Well, let's see what our public comment looks like.

1:38:36 – 1:39:15•Brittany Davis

Awesome. Thank you, sir, for your time this morning. All right. Do we have any? Okay. We will go ahead and close public comment. This might be a general question, and Candy might be able to answer this more than anyone. If it's a duplex, it doesn't need to be condoed, and it can be sold as individual units, correct? Okay. If it's a quadplex, tri or quad, it generally needs to be a condo association, correct? And then it's typically sold as a package unit,

1:39:16 – 1:39:30•Kandi Pool

Well, you know, we dealt with the village apartments, and they're all condo, and they're individual units within those buildings. So I would say they can be sold one at a time. Okay.

1:39:30 – 1:40:35•Brittany Davis

Well, because I'm just looking at some other projects that have happened around town. What is it called? The Heart. Like, that one's a condo association. The one that's over our town and country is a condo association. Mm-hmm. one by sunresis is so and then there down holiday there were some individual units built on the left and those were sold individually but then there were quad plexes that had to be sold as a package so i think that's also something that we need to take into consideration you know if it's rs Six, if it's a condo, it would be most likely individual rentals or it would be s

1:40:36 – 1:41:07•Kandi Pool

And, of course, I guess the person that's doing this is not here, but I would wonder if a quad would be a two-story, you know, if the two structures, one on one lot and one on the other, would be two-story, two on top and two on bottom kind of thing, and then you would have a higher... level, which is not conducive or consistent with that neighborhood. Right.

1:41:45 – 1:41:59•Brittany Davis

So in RS, and again, apologies for other questions, because this is new to all of us. In RS-6, can we say you can only do three units versus four, or it just doesn't matter? You cannot. So we cannot put that restriction on there?

1:41:59•Kandi Pool

You cannot condition the zone. They can do a quad or a tri. Correct. Okay. Okay.

1:42:10 – 1:42:38•Liz Albert

Well, I'll just comment. I'd kind of reiterate what Candy said originally. To me, this is a different scenario than the prior one that we approved, given that this lot is just smack dab in the middle of all of these RS1 properties. I would be more inclined, if we were going to approve something, to do RS2. That's just my opinion.

1:42:44 – 1:43:08•Brittany Davis

And again, just to reiterate, we can recommend RS2. The applicant has the ability to come back and we'll first take to city council, see what they say, but they can come back and say, no, that doesn't work for my... business model, I'm going to do a replat and I'm going to do RS5 and have the same density. So that is just, so we're all on the same page. That is an option. That's correct.

1:44:22•Lyndon Roberts-Galindo

So if he doesn't like the recommendation and then it comes back from city council, we still have the opportunity to either deny it or approve it.

1:44:35•Liz Albert

Erin, do you know, it looks like this applicant purchased this property just the beginning of this year. Has this always been a vacant lot, or was there a structure there that was torn down?

1:45:09 – 1:45:50•Brittany Davis

So regardless where we end up, I definitely think for the neighborhood it will be an improvement over vacant homes. Vacant homes lead to vandalism and other issues that we're very well aware of as a community, as well as increasing... the property taxes brought in to the city. So even if we're not all in agreement on what the applicant has submitted, I personally believe that zoning higher than RS1 makes sense for the neighborhood. Again, your walkability to school and whatnot in that neighborhood. I just want to make sure that there's adequate parking off street.

1:45:51 – 1:46:06•Kandi Pool

That wasn't going to be my question. If we approved our S6 and they did quads, then you're talking about That's four on each. So they would have to have 12 spots, right? Yeah.

1:47:35•Brittany Davis

And refresh me again on the subject property lower that we did a PD on that, or that was...

1:48:08•Brittany Davis

Okay. Okay. Other thoughts or motion from anyone?

1:48:27 – 1:49:22•Brittany Davis

So is that a motion or is that a recommendation? Sure, I'll make that a motion. Okay, perfect. Thank you. All right, so we've got a motion denying the current zoning of RS6 and recommending RS2. Second. Okay, we've got a motion and a second. All in favor? Aye. Aye. Sorry, those were you and I. Okay, all right. 7-0 with a recommendation of RS-2 zoning versus RS-6. Our final rezoning case for today is Z26-07-902 West 19th Street, which is SMD number four. A request for approval, the zone change for the neighborhood commercial zoning district to three and four family residential are a six for .63

1:50:00•Brittany Davis

Okay. And you've got, what, overhead door and then the railroad and industrial? Correct.

1:50:15•Brittany Davis

Oh, it's electrical. But there is a railroad dividing that, okay?

1:51:01 – 1:51:38•Brittany Davis

So my question, and this might be an Aaron question. Ray, can you go back to the, thank you, the zoning division plan. So when we're doing our comp plan amendment and cleanup and all of that, obviously there's, well, I guess it would just be the second lot. Okay, nevermind, single family. Okay. Okay, forget my question. I answered it myself. I just didn't look hard enough. Okay, any questions for Ray? No?

1:51:41•Brittany Davis

All right, come on, Blake. We haven't seen you in a while.

1:52:08 – 1:53:21•Brittany Davis

Okay. Perfect. Thank you. Okay. I'm going to close public comment and open for discussion. Motion? I mean... I think with the fact that it backs currently heavy commercial and it's near a minor collector, I think the higher density zoning on that makes sense. You've got commercial frontage and then it kind of gives you that buffer point into the residential and this is definitely a neighborhood that needs some revitalization and whatnot. So I think this completely makes sense with the vision plan going forward with the city. Any other thoughts? Anyone want to make a motion? I'll move to approv

1:53:25•Brittany Davis

All right, thank you so much. So we are down to six members currently.

2:02:05•Brittany Davis

Is the orange that's designated residential, is that existing? I'm trying to get my...

2:05:01 – 2:05:16•Brittany Davis

Sorry. Can you go down where the orange is? So there's existing residential and then other residential. Is that existing residential? Is that Riverwood Estates or whatever that's called? Do you know what I'm talking about? Or is that further south? I'm just trying to get my bearing.

2:05:40•Brittany Davis

So we haven't actually given that an RS classification yet, whether it's one or... No, no, just residential in concept.

2:18:02 – 2:19:42•Brittany Davis

I think the biggest concern, like, in general from people that have reached out regarding this is the fact of transparency, like, allowing the public some input. You know, as we know with the data center, that was a huge controversy and still remains... bit of a controversy so I think it's just making sure that the public has all the information that they need if there's a town hall set up or something just to explain this so they don't feel like the wool's pulled over their eyes you know that because that that's the biggest feedback over the last and I've been on planning for a very long time

2:21:12 – 2:22:10•Brittany Davis

Well, and I'm not opposed by any means to any of this because, obviously, again... Economic growth is what is going to fund our future as a community You know I do think that you know we need to have some discussions on how things progress Which you guys have been doing a very good job, but I think the notices are a big one And I know it costs money, but prime example was the camp that was proposed it was technically and I know we followed the ordinance of notification, but because of where it was lying and there was a lot of people that felt that they didn't get notified so i think that again

2:24:35 – 2:25:00•Brittany Davis

And again, I think the concept is great, and obviously it's leading us into the future that St. Angela needs to go into. But again, it's just, like I said, unfortunately on our end, the phone calls and the emails that we get is, no one's answering me, and again... We understand that you guys are, but we do have to state that we do get those phone calls. We would be happy to take any questions.

2:25:03•Brittany Davis

Whether it's on this topic or other ones. I think there's too much misinformation.

2:25:07 – 2:25:57•Lyndon Roberts-Galindo

I agree with her on this. The phone calls I mainly get are... Just they don't understand they don't know and maybe a verbiage was used that they didn't quite Understand that there's more than one process to actually get to that. They just think oh my gosh. We're just Everyone's gonna have one in their backyard and there's Misinformation that gets shared constantly. Some of it can be accurate. Some of it can be exaggerated. We all know that. So my biggest complaint that I get is just them not understanding the process and questions and what to ask. They feel like sometimes it's vague in the tra

2:26:59 – 2:27:11•Brittany Davis

And again, we appreciate all the work that staff and all the departments have done, and we know it's not easy. It's just, again, looking at it on our end, we just have to make sure that we're also advising the public correctly.

2:27:11 – 2:28:50•Kandi Pool

Well, I love the concept that we're starting at the bottom. When I say the bottom, the infrastructure, the water lines, the electrical lines, the thoroughfares that might be the best ways to go, and that we're not just selling the whole I never would have liked that idea at all. I like how you separated some of that and showed the different things that could be done. It also kept up with some of the preservations and things like we have some things out there already that need to be kept, which is some of that water ponds and things like that. I think that there's been a major thought process t

2:29:48•Kandi Pool

The county road? No. Down? No, up to... See where the dotted lines are? The northeast road? At the top.

2:30:06 – 2:30:58•Liz Albert

Okay, thank you. Only comment I have, because we're getting close to noon, but I just want to say thank you to the city. I mean, I understand there may be frustrations, but you guys have obviously put a lot of time and effort into this, and I think the only way to have some valuable community input in something like this is to have a plan in place. There's obviously a lot of details to be worked out, and I think there are opportunities for the city to now have valuable input And obviously, this has not been a hasty decision. You guys have put a lot of time and effort. And I think our city, I t

2:31:03•Brittany Davis

And thank you for the informative slides. That definitely is very helpful.

2:31:12•Brittany Davis

Okay. With that, we have more public comment.

2:32:25 – 2:32:39•Kandi Pool

Could you be more specific as what, I mean, just saying this is my property. You're not telling me anything. Can you help her with the little arrow? I want to see what she's talking about. This one right here brings up that circle, and then you can kind of point to where...

2:37:22 – 2:37:36•Brittany Davis

Okay, we will close public comment. And Aaron, I need a little directive as far as what is the expectation of planning right now. So are we... Can you go back to your slide? I think you had a slide.

2:37:40•Brittany Davis

So you guys are recommending approval, and as a commission, we have the option of what? Tabling? Agreeing? Yes.

2:38:47•Brittany Davis

No, I'm just making sure that anyone watching understands, you know, what direction, how this is going to actually play out.

2:38:56 – 2:39:37•Kandi Pool

Do you have any... Rick, do you have any... thought sending this on to city council with a recommendation of some town hall meetings, something to put the concept plan before approval. Are you going to recommend something like that to the council? Are you waiting for them to do that? Or can it come from us or something like that? Because I do believe before we do anything, at least the public ought to know we have a concept plan.

2:40:21 – 2:40:47•Kandi Pool

Well, and I know that at the town hall that I attended, it was appreciative to have the staff there that you could talk to each one. But I think there were many people that said different things, even to Erin or myself. Why didn't we just have this as a presentation that we could answer questions to the whole group and hear them?

2:41:03 – 2:41:49•Liz Albert

I guess my only comment to that would be there's always going to be people against whatever's laid out there, whether it's... Change. Yeah, change in general. Based on what we've heard today, it sounds like this is solely an over-comprehensive plan where the specifics are not set in stone. There's a lot of details to work out, so... If we think that it's best to move forward with the comprehensive plan and then following that have the town halls so that more questions can be answered and moving forward there can be more community input as far as working out the details.

2:41:51 – 2:42:29•Brittany Davis

I mean, again, I like the fact that there's multiple steps in this, that we're not just shoving it forward and saying, okay, let's see what happens. Like it has been thoroughly thought out as far as infrastructure, the way the roads will lay out and whatnot. Again, obviously there's still a lot of questions. I mean, no one can predict really how the future is going to unfold, but at least we have some sort of map that we are attempting to set up to be able to develop from that. So with that being said, do we have a... to move this forward to city council as presented.

2:42:29•Liz Albert

I make a motion to approve as presented. Second.

2:42:33 – 2:42:47•Brittany Davis

Okay, we have a first from Liz, a second from Lyndon. All in favor of moving forward? Aye. So 6-0. Okay. All right, so that passes and on to the director report.

2:44:51•Brittany Davis

So October 27th, I'm assuming it's going to be streamed, but it's not open to the public?

2:47:51•Liz Albert

So do we still have our meeting on the 19th?

2:48:00•Kandi Pool

And then before Concho 29th at the time?

2:48:57 – 2:49:37•Brittany Davis

Well, welcome aboard, guys. Thank you so much. We're excited. We haven't been fully staffed in a very long time. So I'm sure that the rest of your coworkers appreciate that. All right. So with that being said, I am... Let's see. Our next regular meeting of the Planning Commission is scheduled on Monday, October 19th, 2026 at 9 a.m. in the East Mezzazine City Hall, 72 West College Avenue. And I will take a motion for adjournment. I will make a motion to adjourn. Second. All right. First, all in favor? Aye. Aye. All right. See you guys.
