The next resolution was going to be site plan approval for Sylvester Manor Educational Farm. However, because Benjamin and Liz need to recuse themselves on this and abstain from voting, and Albert is not here today, we have to pull this resolution. We will, however, have a special meeting after our work session tomorrow so that hopefully Albert will be in attendance and we will be able to vote on this with the requisite number of board members allowed to vote. I don't see anyone here representing the applicant. We do have the WMAC report, which said the application is for my members noted that no gear is currently installed and discuss moving the proposed location closer to the owner's dock to avoid obstructing the channel. WMAC reviewed various coordinates and agreed to the new location 41 point zero five three five nine six degrees north and minus seventy two point three five five nine two nine degrees west. And it was approved six to zero. I'll open it up to the public for any comments or questions. Anyone on Zoom? Okay, there's any none. I'll ma
I have the WMAC report, which is the application is for the installation of a new dock and ramp in a private basin. WMAC discussed whether the property truly constitutes a private basin based on survey lines versus deeds. They determined that there is no difference in code requirements between private and public basins. Members confirmed that all the necessary documents and material lists have been provided. WMAC approved the application 501 with one member recusing himself from the vote. So they approved it. We'll open this up to either the applicant or the representative if you wish to speak
Did the board have any questions? No, I did not. It's very straightforward. I did not have any questions on this either. Benjamin?
Nope, it was all thoroughly discussed in the WMAC and all good.
I'll open it up to the public then. Any questions or comments? Anyone on Zoom?
It's been a long time. If you would just state your name for the record for those who... Jerry Glash and Francesca Bang.
if there's no public comments i'll make a motion to close the public hearings second all in favor Shall we move to the next one?
The WMAC report, the applicant is requesting a modification to a pre-existing non-conforming dock in Deering Harbor proposing the replacement of two platforms with a seasonal ramp resulting in a 27% reduction, 68 square feet in coverage area. Some members questioned whether square footage is the correct metric under the current code, while others noted that it serves as effective mitigation for usage. Chairman Williamson noted that he appreciates the reduction in square footage. However, the applicable language in the code refers to linear feet. WMAC approved the application five to one with C
Thank you. Did the board have any questions on this? No, this is another one that I thought was pretty straightforward and I didn't see any issues or complications with the modification.
Yeah, I'm going to go with the fact that this is a reduction of the size of the dock, which is what we're looking for. Be it linear or square, we can maybe go back and rethink that and fix that later. But overall, this is a reduction.
Any questions from the public? Anyone on Zoom? I'll make a motion to close the public hearing. Second. All in favor?
And our last public hearing for the night.
We have some correspondence received on this. I'll ask if you'd like to present it, or if you would like your letter read into the record.
Right? That's that's what I was thinking.
Thank you. I open this up to the public.
I don't know if you've got this on gallery view. It's hard to see, but I've seen them before. This is good information. Right.
Yeah, that's fine. I do have a question for you. I want you to clarify something because in your example where you're in the near shore overlay and you just put in three trees because you want to block a new shed you said that you need a full-blown system yes but that wasn't our intention so if it's being interpreted that way i want to make sure it's corrected because the thought was that for something like that to be able to use drip irrigation you wouldn't have to have a full-blown system you could have drip irrigation with a clock it doesn't say that because that was the intention of it so
Right. Well, and so if I go to the drip irrigation section of the code, it's 82-9 for people who are following along. The section C, So it says specifically drip irrigation system shall be used for non-turp irrigation to establish planting. So I would assume that would be like the tree example. And then we go to see, and it says in the near shore peninsula overlay, a drip system shall require an irrigation permit and meet the following additional standards. And that's like the master valve, a time clock, a rain sensor and a check. So that's what you're considering a full system.
Right. Which aspect of this is telling you you have to tap into, like, that you have to...
So you're saying it's the hose bib outside. You're saying now this has to be plumbed because the rain sensor requires...
Right. So you'd be eliminating the rain sensor, the master valve, I'm assuming? It's the hose bit. Right. That's what I was thinking. OK. And then the check valve is something you can . So it's just the rain sensor because the time clock is whether it's temporary or. So it's really the rain sensor that you want to eliminate. And well, the meter is through the house if there's metering.
So the only thing that wouldn't work in line is the rain sensor. Yeah. She'll be equipped with a master valve, which I thought was the hose bit, the time clock, which you can attach, the rain sensor, which is the question mark, a check valve, and a water meter.
Right. It's just the rain sensor that's problematic. Right? Correct. I just want to make sure.
Right. So your recommendation is somehow we should make it scalable depending on the size of the project. You know, if you have like a full overhaul of someone's lawn and they're putting an extensive plan.
I understand what you're saying, but it's either that or maybe put a dollar amount on it. If you're putting in $500,000 worth of plantings, you need X number of, and I'm just making up numbers, but maybe it's something similar to that.
Yeah, or some footage or something. Okay. That's helpful. Thank you. Because I wasn't sure exactly what was problematic. I didn't want it to I wanted the intention to meet the code.
Thank you. Thank you, Charlie. Anyone else in the physical audience that wishes to speak? Anyone on Zoom? Coming up.
Western Water District, they are looking at the rules and regulations and doing the rewrite on those. They did want to see where this landed, but they are most likely going to continue to have stricter regulations and rules than the code. But this code also prohibits the attachment of an irrigation system to a public water supply. So, it prohibits you hooking up your irrigation to the West neck water district, or to the Heights water district, or to turn Carver's water district. So that is in here.
Yeah, that's why we put it in there. It's in there. We didn't specifically list the water districts because if there are new water districts that show up, we want them to fall under that umbrella.
No, but it's the town code that prohibits you from connecting your irrigation to the West neck water district, the heights or Darren harbors water district.
Okay, what does the board wish to do? Should we. What is this? I would be in favor of closing it and taking the comments and work session. Yes. Yes.
Okay, I will make a motion to close this public hearing. All in favor. Hi. We will now go back into the regular meeting and we have one resolution. Where is Daniel Poulter by Bayshore Drive has petitioned the town of Shelter Island for permission to install a riparian mooring at a location designated as latitude 41. Let me just think about this for a second. I didn't get a chance to look at this, Shelby.
Yes, but do we generally reference the original application coordinates and then we. Award the new coordinates, but that's how we kind of did it.
I mean, I didn't get a chance to talk to you, but I'm just. Every so often this comes up. Just think for a second. I want to just reword this a little.
I always thought we had to, like, omission one plus. But if that's, if you agree with it, then I'll just read it as is.
I just wanted to be sure. Just reference them as revised coordinates. Okay, I like that. Okay.
Whereas Daniel Poulter 5 Bay Shore Drive has petitioned the Town of South Island for permission to install riparian mooring at the revised location designated as latitude 41.053596 degrees north and longitude negative 72.35599 degrees west. And whereas the public hearing was duly held on September 21st, 2026 for all interested persons to be heard in favor of or in opposition to now, therefore, be it resolved with the town clerk is hereby authorized to issue a permit for the aforementioned installation provided that prior to the issuance of such permit, the applicant shall submit to the town cl
