Good evening, it's 6.02 PM. This is the McKinney City Council regular meeting. It's Tuesday, September the 15th. Thank you for being here with us this evening, and those of you watching on TV, we appreciate your time as well. We will call the meeting to order. 6.03 PM, our first order of business is the Pledge of Allegiance.

1:06 – 2:46•Bill Cox

Tonight we have two proclamations to read. So when I... Call the topic if you are in the audience for that particular proclamation. You're more than welcome to come up. So this proclamation is Good Neighbor Day. Good Neighbor Day. Whereas a commitment to caring for others is one of the highest expressions of humanity, fostering understanding, kindness, and mutual respect that strengthens families, neighborhoods, and communities. Neighborhoods play a vital role in creating a sense of belonging, bringing people together through shared experiences, support, and connection. The city of McKinney re

5:17 – 6:42•Bill Cox

Our next proclamation is puppy mill awareness day. You get extra credit if you come down here. All right. A puppy mill is a large-scale commercial dog breeding facility where profit is prioritized over the physical and emotional well-being of the dogs. Breeding dogs in these facilities are frequently confined in cramped, unsanitary wire cages with inadequate food, clean water, proper ventilation, exercise, or necessary veterinary care. Observing puppy mill awareness day encourages residents to look beyond the appeal of a puppy in a window, recognize the plight of parent dogs trapped in commerc

7:32 – 7:49•Bill Cox

Okay, next item will be the opportunity for anyone in the audience to address the City Council on non-public hearing items. These would be items on the agenda that do not have a public hearing. We do not have anyone signed up. Ms. Drain, is that correct?

8:40 – 9:00•Bill Cox

OK, you're with it. You're the applicant. Yes, sir. We just wanted to make sure you knew how to get down here. Thank you, Carson. We appreciate that. OK, we will move on. The next item will be our consent agenda. Do we have questions on the consent agenda or motions?

9:03•Rick Franklin

I'll make a motion to approve the consent agenda. Hold on. Hold on.

9:33•Bill Cox

Councilman Cloutier, nothing like a well-oiled machine. No, sir. When I was a boy. 0898.

10:03 – 10:31•Bill Cox

OK. On our consent agenda, we have one item to pull down, and that is 26.0898, resolution authorizing the city manager to execute a contract for park services to the Park Hill of Frisco for architectural and engineering services related to the design of North Recreation Center, North Apex. So other than that, do we have questions, comments, pull downs, or motions?

10:34•Rick Franklin

I'll make a motion we approve the remainder of the consent agenda.

10:38 – 11:21•Bill Cox

A motion by Mayor Prochambe Franklin to approve the consent agenda, which consists of items 26-0879 through and including 26-0901. And also in that motion is a pull down of item 26-0879. Motion by Mayor Pro Tem Franklin, second by Councilwoman Feltus. Is there any discussion? Please cast your vote. All right, the consent agenda has been approved. Mr. Grimes, who is going to address 26-0898?

12:18 – 12:36•Bill Cox

OK. Any questions of this design of Apex North? Anyone? Ms. Jackson, thank you, Ms. Kincaid. And the consultants, thank you for being here also. So do we have a motion to approve?

12:36•Patrick Cloutier

Mr. Mayor, I move that we approve this agenda item as presented by Ms. Jackson and Ms. Kincaid.

12:41 – 13:01•Bill Cox

We have a motion by Councilman Cloutier to approve the item as presented by staff and a second by Michael Jones. Any discussion? Please cast your vote. All right, that motion carries.

13:02 – 13:27•Bill Cox

Thank you both. Okay, that concludes our consent agenda. We'll now move to our regular agenda in public hearing items. The first item will be 26-011-SUP2. This is a public hearing to discuss a specific use permit to allow for fuel sales at 711. This is northwest corner of Bloondale Road and Hardin Boulevard. Mr. Raley. Mr. Raley.

15:35•Geré Feltus

What's the distance to the proposed residential property?

16:17•Geré Feltus

And then for the properties to the south, what is the distance there?

16:32•Patrick Cloutier

Yeah, because the outline of the structure looks pretty close to those homes across Bloomsdale. But then when you look at where the pumps are going to be located, it does add some distance there.

17:04 – 17:35•Patrick Cloutier

With the common area space being little bit of strip of land to the north of those homes that are on the south is that what you're referring to as common area that's right that's where they're pulling the measurement because that's the residential zone right on that south side okay and then lucas i think Forgive me if I'm wrong, but I think that the new 380 bypass or something is going to be swooping in pretty close to this neighborhood and pretty close to this site. Is that fair to say? Yes, it's quite close.

17:55•Bill Cox

Any other questions or comments for Mr. Raley? Lucas, thank you very much. Is there an applicant here?

19:23•Michael Jones

So you say you do most of the 7-Elevens in this area?

19:29•Michael Jones

There's a couple coming around this area, like just to the south of there also. I was just wondering if you're involved in that one also.

20:13 – 20:38•Bill Cox

Thank you. Anyone else? Thank you. Thank you. We appreciate you being here. This item does have a public hearing component. If you're here tonight to address the city council on this proposed 7-11 at Hardin and Bloondale. Seeing no one signed up. Mr. Rain, is that correct? All right. We will move on to motions or questions.

20:39•Rick Franklin

I'll make a motion to close the public hearing and approve this item.

20:44 – 21:28•Bill Cox

Second motion by Mayor Pro Tem Franklin to close the public hearing and approve the item as per staff recommendation Second by Councilman Cloutier is there any discussion? Please cast your vote That motion carries about vote of seven in favor and zero against Your sup has been approved Ready to go back there. Thank you. Next item, 26-0014, SUP 3. This is a public hearing to consider a specific use permit for a 711. This is at the northeast corner of Wilmoth Road and Taylorburg Drive. Mr. Raley. Thank you.

21:51•Patrick Cloutier

Do we need a motion on this, or could we just move on?

21:58•Bill Cox

Yeah. Okay. Okay. Thank you, Lucas. Is there applicants not here?

22:06•Michael Jones

This is what I was talking about, but he redrew it, so never mind.

22:10 – 22:26•Bill Cox

OK. So we have a recommendation from staff to table this indefinitely. But if you are here tonight to address the council on this proposed 711 at Wilmoth and Taylor Burke, seeing that we have no one signed up.

22:26•Geré Feltus

I'll make a motion that we close the public hearing and table this item indefinitely.

22:31 – 23:43•Bill Cox

I'll second. We have a motion by Councilwoman Feltus and a second by Councilman Jones to table the item and close the public hearing and table the item indefinitely. Any comment? I did have one comment. If you have submitted comments to City Council online via our online portal, please know that those have been received and do become part of the record of the City Council. We've received a number of online comments regarding this item. So please know that your comments do go to or are considered as part of our agenda item. We have a motion and a second. Is there any discussion? Please cast you

25:07•Bill Cox

Thank you, Lucas. Do we have an applicant from MISD?

26:21 – 27:12•Patrick Cloutier

Yeah, I do. Thanks for being here, Mr. Suttle. I had a question from a nearby resident. Now, first, my opinion, I think it would be a well-accepted opinion. This is a very eclectic area with some office. I think you've got the old changed place over there. You got the Motel 6. You got the Strip Center just over there to the west. And this used to be, you know, per my memory, DAEP, which was an activated school that had cars coming in every day and stuff. It strikes me that this one that we see all the time is much less activated. But yet you said there's going to be some employees that are hav

27:42 – 27:53•Patrick Cloutier

Right. And typically those are not things that have daily accessing. It's like you've got the air conditioner in there, you need it now, but It's not a heavy traffic use.

28:02 – 28:19•Bill Cox

Anyone else? Very good. Thank you. This is a public hearing item. If you come to nine and would like to address the City Council on this proposed rezone, seeing no one has signed up, we will entertain a motion.

28:19•Geré Feltus

I'll make a motion that we close the public hearing and approve this item.

28:23 – 28:47•Bill Cox

If a motion by Councilwoman Feltus to approve to close the public hearing and approve the item as per staff recommendation. I'll second. Second by Mayor Pro Tem Franklin. Is there any discussion? Please cast your vote. All right, that motion carries by a vote of seven in favor and zero against.

28:47•Rick Franklin

Mr. Mayor, I'm going to have to step down and assign them.

28:50 – 29:19•Bill Cox

Okay. Next item is 26-0098Z2, a public hearing to consider. A rezone of a property from AG to L1 Light Industrial District. This is on the north and east sides of O'Meal Road, 1,700 feet west of Airport Drive and 2,000 feet south of Harry McKillop Boulevard. Mr. Riley. Thank you.

30:54 – 31:07•Patrick Cloutier

Lucas, where I see Harry McKillop there, is that the basic location of the future Spur 399? That's right. Okay.

31:11•Bill Cox

Lucas, thank you. Thank you. Appreciate it. Is there an applicant here?

32:12•Patrick Cloutier

Sam, one question I've got is I can see what's on the east, the north, and the south. Excuse me, the west, north, and south. I don't see what's on the east. What is in that parcel on the east right now? Do you know?

32:31•Michael Jones

Sam, currently are you just looking to develop a shell and then look for a tenant, or you got something pre-planned there yet?

34:23 – 34:36•Bill Cox

Thank you for being here, Mr. Franklin. This is a public hearing item. Thank you. If you've come tonight, I would like to address the City Council on this proposed free zone. Since we have no one signed up, we will entertain a motion.

34:37•Patrick Cloutier

Mr. I move that we close the public hearing and approve this item.

34:41 – 35:26•Bill Cox

I have a motion by Councilman Cloutier to close the public hearing and approve the item as per staff recommendation. Second by Councilman Lynch. Is there any discussion? Please cast your vote. That motion carries by a vote of 1, 2, 3, 4, 5 in favor and one against. The item is approved. Next item, 26-0902, amendments to Chapter 150 Unified Development Code, City of McKinney, through amendment of Article 3 subdivision regulations.

35:31•Bill Cox

These are ordinance revisions for Chapter 150. Ms. Baker.

38:18 – 38:58•Patrick Cloutier

Jenny, I... I speak for all of us. We appreciate your work on this. This has been a challenging item for this council with some lots over here in the well-developed area of east mckinney that are big and they have the opportunity to divide the lot but this was a real challenge for some of those people to be able to do that and help some more folks live down here and i think it's very fair because it's so hard to build new parks down here and those were some really heavy parkland development fees when you compare it to the rest of the city where you know we've got a lot of green fields who are

39:10 – 39:29•Bill Cox

Anyone else? Other comments? No one? Jeannie, thank you very much. You're welcome. I appreciate it. This item does have a public hearing attached. And if we have anyone here tonight to speak, we do not. So we will entertain a motion.

39:29•Patrick Cloutier

Mr. Mayor, I move that we close the public hearing and approve this item.

39:33 – 40:08•Bill Cox

I'll second. I move a motion by Councilman Ploutier to close the public hearing and approve the item as per staff recommendation. Second by Councilwoman Feltus. Is there any discussion? Please cast your vote. All right, that motion carries. My vote is seven in favor and zero against. Ginny, thank you and your team. We've spent lots of time and energy on this item, so thank you. We appreciate it. Next item is 26-0903. Consider an appointment as an alternate member to the Visit McKinney Board.

40:11 – 40:52•Patrick Cloutier

Does Empress come down, or do I just talk? You know, Jere and I are the liaisons to this board. It's a phenomenally well-functioning board, but They've had two big hits, Katie Scott has now moved over to EDC and the very capable Aaron Werner is moving on to EDC as well. It's been recommended to us that we appoint Jessica Ratton to this. Jessica's been a very long time, very involved member of our city, a great ambassador for our city. So I will eagerly nominate Jessica Ratton to this position.

40:55 – 41:57•Bill Cox

We have a motion by Councilman Cloutier to appoint Jessica Ratton as an alternate member of the Visit McKinney Board and a second by Councilman Jones. Is there any discussion? Please cast your vote. All right, that motion carries. Ms. Fratton has been appointed as an alternate to the Visit McKinney Board. That concludes our regular agenda. We'll now move to public comments on items not on our agenda. And just as a reminder, when your name is called, you'll have two minutes to share your thoughts with us. Please be respectful in your comments. If your actions are disruptive to the meeting, you

46:45 – 47:08•Bill Cox

Thank you, Mr. Chandler. Thank you. Next up is Dash House. No, this gentleman's next. Thank you.

49:31•Bill Cox

Thank you. Thanks, Dash. Next up, Jacob Lucey.

52:04•Bill Cox

Thank you, Mr. Lucey. Next up is Lauren Lynn.

55:28•Bill Cox

Thank you. Thank you. That is our last speaker of the evening. Do we have council comments? Mr. Beller?

57:13 – 58:14•Geré Feltus

I wanted to thank staff because I got a chance to attend the 9-11 Memorial. And it's the 25th year, as many of you know. We've got several memorials. former NYPD, NYFD residents here in the city of McKinney. And it's always interesting to hear their stories about that day. Still truly a profoundly impactful day 25 years later. I put up a post. I remember exactly where I was when I heard about it. And I know it was a life-changing event for the entire nation. But it was great to gather together at our new fire headquarters, which is a beautiful facility. But it was a great program. Just wanted

58:17 – 58:35•Geré Feltus

And so it is remarkable that a city like McKinney now will have three hospitals. Tells you a lot about the growth in Collin County, right? And there's plenty of room for them to come because there are plenty of people who are still moving here. But we, of course, are welcoming them with open arms and excited to see what they're bringing forward.

58:37 – 1:01:15•Patrick Cloutier

You know, it's fun to be able to see what's important to different people in this community. And we all live in our lanes and we all seem to think, you know, what's important to us is important to everybody. And it's not necessarily true. You know, my office has been downtown now for almost 29 years. I started officing there, Mr. Mayor, when I was four. Thank you. You know, in downtown, it's a bit of a mess right now, right? We've got the MPAC under construction. We've got the library still under construction. You know, goodbye, development services. Goodbye to old City Hall. And you're lookin

1:01:20 – 1:02:31•Michael Jones

Yeah. Councilman Beller and Councilman Cloutier and myself, we had the privilege of attending City Day with Leadership McKinney. It's probably one of my favorite events every year that I've been on council. It's because we get to introduce the new Leadership McKinney graduates. There are potential graduates that are coming through to the city council. So we talk about issues that are Anything they want to talk about is an introduction of what we do and how council meetings are ran. And you get to see a great bunch of future leaders of McKinney. And the reason why I'm so proud that we get to do

1:02:34 – 1:05:06•Bill Cox

Nothing. Okay, I would like to start by thanking the city staff and start at the top with City Manager Paul Grimes and what his staff does behind the scenes and in front of the scenes. And when you see people like Lucas Radley stand up here and be as smooth as he is, that doesn't come with a lot of effort and a lot of work. Lucas, we appreciate you and your team. Empress, you and your team make our meetings look so smooth, and we appreciate everything you and your team put together for us. Police and Fire had the opportunity to be with both organizations in the last week or so, and you want to

1:06:22 – 1:06:41•Bill Cox

Thank you, Mr. Grimes. We do not have an executive session, so with that, we would entertain a motion to adjourn. Motion by Councilwoman Feltus. Multiple seconds. First one was by Mayor Pro Tem Franklin. To adjourn the meeting, all those in favor say aye. Aye. Same sign. It is 7-0-9. We are adjourned.
