You'd stick it in an envelope. If somebody opened up the envelope, the thing would fly out. Very nice.
I haven't paid a whole lot of attention to anything yet. I've been too busy.
Good evening. It is now 620, and I'm going to go ahead and start the Public Affairs Committee meeting. Take roll. Councilwoman Meyer? Councilwoman Weiss? Present. Okay, thank you. I'm going to ask Ms. Ackerman to step forward. Director Ackerman, we're going to go over the Consolidated Annual Performance Evaluation Report, or CAPA report. And she can go ahead and explain and answer any questions that anyone may have. Does everyone have a copy of the report? It should be in your packets. Adrienne, I'm going to turn it over to you.
I'll open up to any questions. Any of the committee members have any questions first? Okay, anyone on city council? Councilman Falquette.
Well, thanks for addressing my questions about goals. And because it's a five-year plan, would we expect those goals to be linear, 20% per year, or would we expect those goals to be like year three, the thing's going to be done and bam, it's going to be right there?
So the Westin neighborhood, and I see that you have that the percentage of currently it's at 67 percent and only five point only five percent.
That's what I thought, but I thought, let me clarify that again. Also, I wanted to ask on the West End project, is that totally completed? Are all of the funds allocated to everyone or is there still an ability for some of that?
All right, seeing no questions, I'm going to go ahead and end the Public Affairs Committee meeting at 625.
Good evening, everybody. It's 6.30, and we're opening the Municipality and Public Utilities Committee meeting. Would you like to come up?
And again, the age of the last one we did, what was the age of the last one?
90 years as well, yes. So they're both the same age? Yeah. So the expectation of the seepage of water is similar?
If I can interrupt, I think that's Lexington spring with mill, not 97.
You said you're on to write for a grant. What's the probability of getting it? It's high.
Okay. I just wanted there, if you didn't get it, what else was the other alternative? Okay.
Thank you, Councilman Miranda. Mr. Bianchi, if I recall, I think in the past we did something. This will be all new piping then, correct? Yes. Okay. If I recall, I thought we did something in the past where we had like a lining that put in the pipes and it actually sealed it and it was more cost effective. But this will be all new piping replaced.
Mm-hmm. Councilman Diaz. Thank you, Chair.
Mr. Bianchi, worst case scenario, what would happen if we weren't given the grant?
Any additional questions? Thank you, Mr. Mayor. I do appreciate you. And with that, we conclude the utilities.
Do we have one more? There's 159 Diaz. He'll pick it up in a minute.
Okay, it is 6.40 p.m., and we will open the Streets Committee. We'll do a roll call first. Councilwoman Daly?
We're going to discuss, with the assistance of our engineer, Bill 26-156, which is involving the design of a 3,000-long, 11-foot-wide concrete trail along Trimble and Marion Avenue to Millsboro Road. Okay, thank you.
Are there any questions from the committee members? Councilman Miranda.
Okay, so our initial consideration would be to enter a contract that would be for the 175. That's correct. Is any of that applied under the total project cost? Yes. Separate entities. Separate, that's correct.
Just a quick question. So when we're saying permissive sales tax, that is $120,000, what would that look like? What is...
Are there any questions from Council at large? Thank you, Mr. Bianchi. It is 6.44 p.m. and that will conclude the streets committee.
While we're waiting for 6.50 for the public hearing, if you wish to speak in council during public comment period, there is a sign-up sheet in the back of the room back over there. So if you plan on speaking during public comment, please sign up. Thank you.
song or something Okay, I've got 650 or darn close enough. We'll call this public hearing for rezone number 566. I'm sure most are aware, but this is the old CenturyLink or whatever last known phone company you want to use. I think it was about, what, three or four phone companies, titles that were in that building, starting at United and Sprint and CenturyLink. But anyway, this is a rezone. The public hearing for that, turning it into veterans housing. First of all, is there anybody from the public here that would like to make a comment about that? That's what this time period is for. Carl. Y
Council have any questions for Mr. Miller?
First of all, thank you very much for what you're doing. That's very admirable and very good for the community. Along with the area, is there going to be medical services for the folks there? I mean, what kind of stage of senior living? Is it just older? If they need medical, then they have to go somewhere else? Or will that be someplace they can continue on living? Sure.
I first was going to say just thank you. And it's a privilege to have your family doing this. I've worked in the past with trying to assist veterans and finding places to stay. And sometimes that's a very difficult thing as they're aging. So I look forward to this. I also wanted the event space that you're saying that would house about 500 people. I'm always suggesting that there's multi-generational space when these builds take place, when we're doing senior citizens. So there's a lot of things that you have taking place here that I just want to COMPLIMENT YOU ON. I LIKE THE MEDICAL, THE SALO
NEW SPEAKER MR. MILLER, THANK YOU. THIS IS HUGE. I READ THE WRITTEN SOURCE ARTICLE BEFORE COMING TO COUNCIL. SO A LOT OF MY QUESTIONS I HAD WERE ANSWERED. IT ILLUSTRATED WAY MORE ABOUT THIS PROJECT THAN I ever imagine. My initial question was, Councilwoman Meyer did ask that, and that was if there were any supports available, housing managers, stuff like that. One other question I had was, with vets who are under the age of 60, would that qualify them as well if they're not a senior?
Okay, cool. But otherwise, I think it's very exciting. So thank you so much.
Did I say Ms. Davis-Wiesentz? That was my question. Okay. Mrs. Meyer.
Thank you. I've got a statement and then questions for Adrian. I wanted to thank you for doing this. This is a wonderful thing. I know the building's been empty a long time. I'm glad somebody came up with something better than store and lockets. Nothing against store and lockets, but not on Lexington Avenue, please. Um, for Adrian in the back, this went to city planning. Yes. And did they vote on it? And how'd that turn out?
Thank you, Mr. President. Mr. Millard, again, echoing many, what have many said up here, thank you for the investment in our city and our veterans and our low-income families and just the county in general. What you and your foundation, your family's done is just left a legacy and I love it. I just also want to ask a couple questions because obviously when you, it's great, again, not to see the storage units going up. We got enough of those. And I know housing was something that was big on my list. And it's great to see a lot of these buildings go up, but what tends to happen is 10, 15, 20 yea
Thank you, and that was my biggest concern because those can be the high-dollar items. So thank you, and thank you again.
Thank you. I'm very excited for this. Thank you.
Yes. Back to Adrienne. On the zoning classification, I see industrial district as the current where it's written up in the paperwork. And then it says office someplace else.
That's what it is. And we're going to B2.
Thank you for the work that Mill Iron is doing, the foundation, and carrying on the legacy of your dad. I heard him speak once, and it was inspiring to how he started and what he had been doing in the community. And I did meet him once, so it was an honor. So what the affordability would be like for these veterans or seniors? Do you have any idea? Like, would they... Like get help from Metro or something like that?
Because I see a lot of them are not able sometimes to afford it. So that would be so helpful. Thank you.
I just want to add my thanks on, I think this is a really exciting project. I think it might be the only post I have made on my Facebook page that was pretty much universally liked. That's very rare. So congratulations. And a lot of you probably don't know, but Carl is responsible for bringing me to town. He was chairman of the chamber when I came here and And his dad is he was just an amazing man. And so when the announcement was made that they were setting up the foundation, I knew that was going to mean just tremendously transformational things in the community. And I don't think any of us
Any other questions, comments? I guess in closing, I'd like to thank you, Carl, for coming. I think it's a great project the foundation is doing. And having known your dad, I'm sure he would be proud of this project.
Okay, at 7-11, we'd like to call this session of Mansfield City Caucus meeting to order. With that, are there any commit reports, Mr. Diaz?
THANK YOU, MR. PRESIDENT. I JUST WANTED TO SHARE A FEW COMMUNITY UPDATES LEADING UP TO THE NEXT COUNCIL MEETING. BEGINNING WITH THIS FRIDAY, EVERY MONTH IS THE FIRST FRIDAY EVENT, SO A LOT OF DIFFERENT BUSINESSES ARE GOING TO BE HAVING SOMETHING FOR EVERYONE, INCLUDING ROSETTO EVENT CENTER, 101 T COMPANY, THE EVERGREEN BOOK SHOP, WHICH IS PART OF THE LIBRARY, CROSSROADS CITY CENTER, AND BASICALLY A DIFFERENT ONE DOWNTOWN. This Saturday at 7, the Brickyard and the Renaissance Theater is collaborating for a concert called At Last, an evening with Etta James featuring her very own Connie. It will
Are there any other committee reports or community updates from anybody? Okay. Moving on. Mayor, you have anything?
I do have a few things. So first of all, I do want to let everyone know that our goal is not to make everyone mad with traffic right now. I know because I've been caught in it too. There's a lot of projects happening and, So I thought I asked Bob for some timing updates. And so let's start with the shortest one. Obviously, today we've had Diamond Street closed at third. That cuts off our particular north northbound traffic. That is for the water main replacement project. They have been in there all day today. They will be in there again in the morning. They the plan is to open it tomorrow afte
Thank you. With that, we shall proceed with legislation. We will start with Bill 26-149. And that would be Ms. Mount.
Any questions, discussion on 26149? Mr. Falkett?
Yes. One, just for opening in the header paragraph, it's incorrectly noted I-1 Industrial District. That should be, I move that that be stricken and replaced with OS Office Service. Second.
Okay, it's been regularly moved and seconded. Which paragraph are you at?
The opening paragraph, very top opening paragraph. It's the fourth line halfway in.
Section one at the bottom is correct. Did you correct it before the meeting? yes well then it has been correct and it's already handled yes thank you very much then my second question mayor on that is this one was set up for one read one pass one vote everything tonight um if you're changing it for readings is that an impact for somebody that seems like a big change that was also corrected i submitted the legislation with full reads
Is there any timing issue with that, Adrian, from a zoning perspective?
I think there's just a few questions and maybe, you know, we can always change that. And then in two weeks we can move it up to, to vote if so needed. It doesn't mean that that's a hard and fast rule that we have to wait until October the 20th to, to pass it. Ms. Robertson.
Thank you, Mr. President. Does anyone know, I know they talked about going for some historical tax credits. If we hold on this, does anyone know if that's going to impact them at all?
I'm on historic preservation, and they have not approached us with any paperwork. Doesn't mean that they have to, but normally they would go through historic preservation.
Okay. Unless I hear a motion that we change that, I think we'd at least keep it as it is for now. And then in two weeks, if we change it or in four weeks, we wish to change it, we can do so, but.
So as it is not on our forms, because we don't have the corrected forms, that's part of the problem with what Mr. Fouquet was stating. And then mine's the same way. It's showing a boat and it's showing industrial. And so it was the first one.
On what I have here in front of me, it's been corrected. So for what you receive from now on will be the correct form.
I guess that's my question. Cause we normally vote on it the same night for reasons. Um, and it looked like it was here. So that was my assumption. I mean, I'm not, I don't know that it's holding anything up, but I do. I am concerned if it waits a long time, because I think that does, I think they're planning to get moving on. And I guess that's all I'm saying, Mr. Miranda.
Based upon the statements from the mayor, thank you, Mr. President, based upon the statements of the mayor, is there, because I was under the assumption we were voting tonight on it, and I would be fearful of somebody who's embarking on this project of this nature that's substantial to the community that we're not voting. Is there a reason we can't vote tonight on it?
There is no reason why we can't. It's up to the will of council. If you make a motion and a second and an approved, then that's the way it is. Mrs. Meyer.
Thank you, Mr. President. I see the list here. I know many of them were answered, many were not. I guess the question for us really is, is some of these, it's not unanswered yet. And again, the Area Agency of Aging may not have an answer because this is just starting. And I have a concern. The only concern I have is a $26 to $30 million project Are we holding it up because and we may not actually get those answers. I mean, to me, that's the only concern I have. And of course, we don't have anyone here. And so they could have been thinking that it was going for a vote. So they went ahead and le
Mr. Miranda. Mr. President, thank you. I would like to put a motion on the floor based upon the facts that the Mill Iron Foundation is the one putting the request for the rezoning and not the Area Agency of Aging. They're just going to be a managing entity to this. But the Mill Iron Foundation is the one putting together, as you said, a $26 to $30 million project for our community. I would like to put a motion on the floor that we move this to vote this evening. Second.
It's been regularly moved and seconded that we waive further readings on Bill 26-149 and bring it up for a vote tonight during council. And the motion should be before you. And I have a six yes and two no. So the motion does carry. So we will be voting on it this evening. OK. Moving on to Bill 26-150. Thank you, Mr. President.
In reference to this bill, it's for the approval and support of the Consolidated Annual Performance Evaluation Report, which Director Adrian Ackerman went over and declaring an emergency.
At this point, I think we have to do it in council. I'll request that vote where I'm allowed to abstain due to a conflict.
We'll do it during council. Any other questions on 26-150? 26-151, Mr. Falkett.
Thank you, Mr. President. 151, if you don't mind, 152 are both fund transfers. It's over the middle of the year. There's some funds left in a couple of things that would allow the sewer department to buy a dump truck. They're also getting a snow plow package on it. And altogether, it's $175,000 for a dump truck with a snow plow. It'll be used for both streets and the sewer department. And so 151 and 152 are related. And when you get done with questions, I would like to move both of those forward for vote tonight, I guess, in two separate motions.
Is there any other questions, discussion on 26-151 and 26-152?
Can I just make a clarification? It actually will be two dump trucks. So the sewer department will be getting one for the 125. The streets department has already some money to allocate towards this in their non-personnel, but they're running very, very low in personnel this year just because of some staffing things there. So we were asking to move 50 so they could also get a... a dump truck, and that one will have the plow package. Actually, they both will get the plow package. Sorry.
Thank you, Mr. President. I move that Bill 26-151 waive all further readings and be allowed on the floor for vote at council tonight.
Then regularly move and second it, and we wave further readings of Bill 26-151 and bring it forward for a final vote in council this evening. Council should have the motion before you. Motion passes 8-0.
Mr. President, 26-152, I move that that bill be waived of all further readings and be allowed on the floor tonight in council for final passage vote.
Been regularly moved and seconded. We waive further readings of bill 26 dash one 52 and bring it forward for a final vote this evening in council. Motion passes eight to zero. Okay, moving on. Bill 26-153, Mr. Falkett.
Thank you, Mr. President. I believe this 153 and 154 is another pair of fund transfers to allow the purchase of PPE for the fire department. 153 is for 10,139 and 154 is for 3,900. There's some different funds involved. That's why there's two separate motions. And I would also like to move these ahead at the appropriate time.
Is there any questions discussion on one 53 and while we're at one 54, both. Okay. Hearing none. Mr. Falkett. Thank you, Mr. President.
I move that bill 26, one 53 be allowed on the floor for final passage later tonight at council and that we wave off further readings.
been regularly moved in the second and we weigh further readings of bill 26-153 and bring it forward to council this evening for a final vote motion is before you motion passes 8-0 so we will be voting on that one as well
Mr. President, I move that bill 26, one 54 also, uh, wave all further readings and be moved forward for a final vote during council tonight.
Second been regularly moved in second in that we wave further readings of bill 26 dash one 54, bring it forward for a final vote this evening during council motion passes eight to zero. So we will be voting on that one. Also, moving on to Bill 26-155, Mr. Miranda. Thank you, Mr. President.
Vote 26-155, authorizing the Public Works Director to advertise for bids and enter into contracts for certain yearly needs of the city and declaring an emergency.
Is there any discussion on Bill 26-155? Okay. Hearing none, Bill 26-156, Mr. Diaz.
Thank you, Mr. President. Bill 26-156 is authorizing the Public Works Director to enter into a contract to purchase an AG4075R compact utility tractor contract with 72, is that inch? Yes. Blair Moore from AG Pro 2000 for the street department. An amount to not exceed $78,916 in declaring an emergency. Is there any discussion on Bill 26-156?
This was brought up at the Board of Control meeting, and the flare mower is something that allows them to reach in and around guardrails. The current mower is 1990, maybe 1, 2, 3. So it's old, worn out, and it's time to get replaced. That was the story at Board of Control.
Okay. Thanks for the info. Hearing nothing else on 156, moving on to Bill 26-157. Mr. Miranda.
Thank you, Mr. President. 26-157, authorizing the Public Works Director to submit an application for funding for the Southwell Line Replacement Project Phase 2.
Is there any discussion on Bill 26-157? No. Okay. Hearing none, moving on to Bill 26-158. Mr. Falkett.
Thank you, Mr. President. This is a correction. Apparently, we have multiple ordinances for the exact same thing, and we're undoing one of them.
Okay. Is there any questions, discussion on 26-158? Okay. Okay. 26-159, Mr. Diaz. Thank you, Mr. President.
As discussed in the committee meeting, Bill 26-159 is authorizing public works director to enter into a contract or contracts for engineering services relating to the Chumbo Road Trail from Marion Avenue to Millsboro.
Is there any discussion on Bill 26-159? Mr. Diaz?
Thank you, Mr. President. Yes, I'd like to make a motion to dispense of any further readings and move forward for consideration tonight. Second.
Been regularly moved and seconded. We waive further readings of Bill 26-159 and bring it forward for a final vote this evening. Motion passes eight to zero. That concludes legislation. Is there anything else further to come before caucus this evening?
Going back to piece 156, that all does say flare mower, but it should be a flail with an L, not an R. I don't know if that is, if we should just amend that to be correct. I mean, I also don't know that it holds us up from purchasing it either, but.
Okay, we're in regular move in the second, and we amend bill 26-156 to read flail mower.
Well, it's been nice. They sent the picture.
Hang tight while the clerk types the motion.
F-L-N-E-I-L. That's how they do spell it. No flair. Flair sounded good, though.
Everybody should have the motion before you.
It's still there. What? On the second, on down the first one's been changed, but then, or disregard. It's shown that you're changing. It's okay, Howard.
Are we all flare, flaying? Okay, motion passes eight to zero. All right. It's been changed to flail. That concludes legislation. Is there anything further to come before caucus this evening?
Been regularly moved and seconded. We adjourn, close caucus. All in favor signify by saying aye. Aye. Opposed, same. With that, everybody please stand. I'll call this session of Mansfield City Council to order. Please stand for the pledge and remain standing for the prayer.
Amen. Okay, the clerk will now call the roll.
Here. Okay. Unless there is an objection, the reading of the journal and correspondence will be dispensed with. Hearing no objection, we will proceed. Do we have anyone signed up for public comment? OK. Ms. Butler, if you wish to come up to the microphone there. And as we do, when you get there, please state your name and address. And we limit public comment to three minutes. So you may proceed.
Is that all? Okay. Well, thank you for coming. We appreciate your comments. So, thank you. Are there any committee reports?
We will now proceed with legislation. Ms. Staley.
Monday. Thank you, Mr. President. Monday deadline. I move with respect to Bill 26155 that the rule requiring legislation be submitted by Monday at 4 p.m. be suspended and that Bill 26155 be allowed on the floor this evening. Second.
Been regularly moved and seconded. Council should have the motion before you. Motion passes eight to zero. Ms. Daly, suspension of the rules.
Suspension of the rules. I move with respect to all bills that come before council this evening that rule requiring reading on three different days be suspended and that each bill be read one time by title only. Second.
It's been regularly moved and seconded. Council should have the motion. Motion passes eight to zero. Moving on to legislation and bill 26 dash one 49. Ms. Mount.
Second been regularly moved in second and the clerk shall read bill 26 dash one 49.
Is there any discussion on Bill 26-149? Ms. Robertson.
Thank you, Mr. President. I just want to state that I know there was a list of concerns on this, and I don't think that anyone's trying to take those lightly at all. I just feel that given the situation, you know, by moving it forward was the right thing to do tonight, and I appreciate everyone's work on this and thoughts, and I think that these are questions, too, that we can still work on to get some answers to as we move forward because there's some really good questions in here, and I've highlighted several of them.
ANY OTHER DISCUSSION, QUESTIONS, MR. DIAZ?
THANK YOU, MR. PRESIDENT. I DO AGREE WITH COUNCILWOMAN ROBERTSON, AND THIS IS ONCE IN A LIFETIME OPPORTUNITY ABOUT SOMETHING THAT SO MANY PEOPLE HAVE BEEN WANTING FOR A VERY LONG TIME, ESPECIALLY in a building that's been unused for quite some time, I still would have liked to have gotten more information after the September 10th meeting, just so that we had some more questions answered. But overall, that doesn't deter from the fact that I 500% support this project.
Any other questions, discussion on 149? Okay, hearing none, Ms. Mount.
And regularly moved and seconded, Council shall cast their vote for final passage of Bill 26-149. Thank you. Bill passes 8-0. Bill 26-150, Ms. Robertson.
Thank you, Mr. President. I move in respect to Bill 26-150 that it be placed upon the floor for final passage. Oh, be placed upon the floor for consideration, sorry.
Can I have a second? Second. Second. It's been regularly moved and seconded. The clerk shall read Bill 26-150.
Is there any discussion? At this time, Mr. Falkett.
I'll make a motion that I be allowed to abstain.
