2:03•Rachel Streitfeld

Good evening, neighbors and friends. My name is Rachel Streifeld, and I'm calling to order the May 2026 meeting of the Northway Village Commission.

2:22 – 2:56•Rachel Streitfeld

Yes, I'm here as well. Let's all stand and say the Pledge of Allegiance. Okay. We're going to move on to the order of business. Does anyone have any additions to the agenda? Anything they'd like to move around and any deferrals?

2:56•Richard Chervony

Madam mayor. Yes. I'd like to pull item 11 D as in David from the consent agenda.

3:05•Richard Chervony

And I'd like to add on their presentations. Joseph Sam is here from Representative Wasabi's office. He wants to do a legislative report.

3:13 – 3:26•Rachel Streitfeld

Great. We will add the legislative update from Representative Wasabi's office as 3D legislative update. Does anyone else have anything that they would like to move around, pull, or add?

3:27•Goran Cuk

Madam Mayor, can we move the item up to the top of the agenda so we have an opportunity to discuss because I believe a lot of residents are here to discuss that item tonight.

3:37 – 4:05•Rachel Streitfeld

This is item 14B. Yep. Absolutely, we can move that up to the top after we hear public comments. So for 14B, I think we'll do all four of our presentations, including the legislative update. We'll do our open forum and our reports, I think. And then we'll take 14B after that, before the consent agenda. Is that okay with everyone?

4:19 – 5:30•Rachel Streitfeld

11B as in boy? Yes. 11B. 11B as in boy. All right. But 11D, we're pulling just to discuss and vote on it separately, right? Okay. Okay. Estado? Okay, can I have a motion on the revised agenda and seconded by Commissioner Acosta? All those in favor say aye. Aye. Anyone opposed? Seeing no opposition, we have our order of business for the evening. And now we get to kick off our presentations. It's so nice to see so many people here. Thanks for joining us, everybody. We're going to kick off our presentations. This is the first of the evening. It is National Public Works Week, and as a vulnerable i

5:32 – 8:35•Rachel Streitfeld

Superintendent Tim. Just short Super Tim for short. Come on up, Tim Smith. Go ahead and hang out there. Yeah, face us. and we're gonna read this proclamation. This is for you and the amazing team that you work with. Whereas public works professionals focus on the infrastructure, facilities, and services that are of vital importance to sustainable and resilient communities, and to public health, high quality of life, and the well-being of the people of North Bay Village. And whereas North Bay Village would not have infrastructure facilities or services without the dedicated efforts of public wo

9:05•Rachel Streitfeld

Tim, thank you so much. Felix, Tim, Howard, Noel. I don't know if they're here. We love you guys so much. Let's get public works up here. Let's take a picture with this proclamation.

10:32 – 11:29•Rachel Streitfeld

Yeah. Okay, so I can't wait to see the Proclamation hanging in our new Public Works building, which is just over the bridge in Little River and is being renovated as we speak. It is going to be the home of our Public Works department, as well as some of our critical tools that we have. We have a vac truck, we've got generators there, All of the equipment that used to live in the parking lot over at Grove by the Bay has been relocated to our new facility. And so that was funded with stormwater bond money, and it is a critical facility for us as we continue to invest in infrastructure operations

12:03•Rachel Streitfeld

Go as high level as you possibly can. And if there are questions from the dais, we'll get into them. But as high level as you can, because we're doing another audit right now.

13:23 – 14:18•Rachel Streitfeld

Thank you very, very much. Does anyone have any questions about our 23-24 audit? Our 24-25 audit is in process. And just so everyone on the dais is aware, I've asked Village staff to get me the draft audit before I leave for Alaska in June so that I can review it and redline it while I'm away. The 23-24 had some substance, not on your side of things, but on our side of the things, there were some really meaningful issues that need to be addressed in the next audit. So that's what we're doing for 24-25. questions comments from the days thank you thank you very much thank you so much yep okay ch

22:44•Richard Chervony

Thank you, Chief. Appreciate for this honor.

27:33 – 28:05•Rachel Streitfeld

What I would like to do photo-wise is like it's amazing to see our whole squad here to support you all. So let's get the entire PD who's here. Everybody come up front. Commissioners are going to stay back here. We're going to do it with everybody together. Okay. That's a good feeling. Yeah. We're staying here for the purposes of this photo. That way, right? Right? Can you see it? You can see us behind them, right, Christina? Yeah?

28:07 – 29:01•Rachel Streitfeld

Chief, step a little bit back. Get together like you work together. Like you're in the range and you've been in the dirt and the mud. Okay. Okay. Such a good vibe. We're gonna stand on chairs back here. All right, now let's do a couple with the winners. And the families. And the families, and the families, yeah. Yes. Yes. Congratulations. Oh, no. Congratulations. Congratulations. Hey, how's it going? Thank you so much. Thank you so much.

30:03 – 30:31•Rachel Streitfeld

okay next up we're getting a legislative update we're going to find out what has been going on in tallahassee mr sams is here on behalf of representative basabe hi welcome good evening may commissioners city staff and residents my name is joseph sams and i'm here on behalf of state representative fabian basabe

35:44 – 37:14•Rachel Streitfeld

Thank you, Mr. Sams. Wonderful update. My favorite part about that update was our two appropriations projects are in strong position to make it through budget conference. So we have two requests totaling $1 million. One is for $250,000 to complete the outfalls, our stormwater inlet outfalls, which are going to keep our streets dry during king tides. And the second appropriations request is for three quarters of a million dollars to help us complete our North Bay Village public safety complex, our village hall, police and fire station. So thank you again, Mr. Sams and Fabian. We love you. Thank

37:19•Rachel Streitfeld

Yeah. Okay. Madam Clerk, go ahead and call the first card.

37:28•Rachel Streitfeld

Well, you got up first, buddy. That's how it works.

44:30 – 44:45•Rachel Streitfeld

I'm shaking my head. There is absolutely not, no. We can talk about it offline, but the attempts to gate Treasure Island go back to the 80s and 90s, sir, and it is completely going to fail. So thank you for your public comment, though.

49:02 – 49:33•Rachel Streitfeld

Is there anyone in the room who did not fill out a card but would like to speak during public comment? Okay. I just want to remind our MBV soccer community that 14B is a discussion item. It's not a public hearing. So we're not going to do another round of public comment on the item. So if there's something that you'd like to share with us about the community center, the soccer facilities, Pickleball, Padel, AFA, I welcome you now to provide public comment.

51:01 – 51:12•Doris Acosta

We have some of the parents that are still finishing up their practice and they're maybe possibly still trying to arrive to this meeting. Would we allow them to have some type of ability to speak if they come?

51:13 – 52:00•Rachel Streitfeld

I think what I'd like to do on that is I'd like to move the meeting forward and accomplish the business that we have. Like I spent an hour last week at the soccer fields communicating with our soccer parents and I'm happy to spend another hour and another hour and another hour answering questions. So we can do a community town hall. We can do a forum. We can get together on a Saturday morning, whatever makes sense. But we have these commission meetings once a month. We have a lot of business to get through and I want to keep things moving. Does anyone else want to make public comment for the r

52:07•Rachel Streitfeld

We need a correction. Do you want to second it and then share the correction?

52:10•Richard Chervony

I will second that and then share the correction.

52:15 – 52:31•Richard Chervony

Uh, I've already spoken with the village clerk and she will be fixing it on page three. At the top of the page, the third line states that the vote was 4-0 with Mayor Streitfeld voting against it. It was a 4-1 vote, not a 4-0 vote.

52:31 – 52:51•Rachel Streitfeld

That's right. I will make the correction. Okay. With the correction, we have a motion and a second. All those in favor, say aye. Aye. Anyone opposed? Seeing none, we have the Resident Services Advisory Board report. Mr. Farahim, name and address for the record, please. Thank you for being here.

53:15 – 53:29•Rachel Streitfeld

Are we presenting the scholarship awards tonight? No. No. I think as part of your report, you're making recommendations for the scholarship recipients?

53:34•Doris Acosta

So they're awarding them, basically, by saying that.

53:52 – 54:10•Rachel Streitfeld

Wait, wait, wait. Hang on a second. I don't recall that this is how we've done this in the past. If you guys are recommending the recipients of the scholarship awards, then that needs to happen on the back end to staff. Who's the liaison for the Resident Services Advisory Board? Can you step in, please? Help us out here?

54:11•Goran Cuk

Yeah, sure. I mean, I'm okay with us talking through the nominations.

54:17•Rachel Streitfeld

Really? Why? We haven't been briefed on any of the applicants. We've never chosen the recipients before. Okay.

54:25•Goran Cuk

We can do it next month as well if you want to share the rest of the updates.

54:27•Doris Acosta

Just not to spoil it for the kids that could be watching, just to know who they are. Okay.

54:32•Goran Cuk

It makes it a little more special. We can push it.

54:34•Rachel Streitfeld

But also the selection. We don't select the recipients of those awards.

54:40•Rachel Streitfeld

Yeah. Okay. So I don't know that it needs to be shared at the commission in this way until we're ready to present the winners.

54:48•Goran Cuk

Okay. That's okay. It was shared on the board meeting.

54:53•Rachel Streitfeld

Yeah, which is fine. But why have him come here and tell us if we're not presenting them? Let's organize the award presentation and present them with the awards.

55:03•Goran Cuk

We can push that to next month and do a formal presentation.

56:15 – 58:04•Rachel Streitfeld

Those sound good. I want to ask staff for help guiding advisory boards toward recommendations, resolutions and recommendations. Okay. So the resident services advisory board, the community enhancement advisory board, the sustainability and resilience task force. These are all advisory boards. They exist to make recommendations to us, the commission. And so an action item from an advisory board should come in the form of a resolution of that advisory board, making a recommendation to the commission, whether it's on a specific program or an initiative, it should come in a legislative vehicle, wh

58:07 – 59:51•Andy Daro

I can go first. I'd like to start by congratulating Pagani Residences on their groundbreaking ceremony this week. They are now joining the likes of Shoma Bay, Continuum, and Tula Residences. Now we have four major projects actively coming out of the ground. I see that as a major milestone for our city and the momentum for our future. I'd also like to congratulate the Lido on receiving its historical designation, preserving it as an important piece of our community and history. Secondly, I've been working closely with our public's director, Steve, as we're working to improve the north side of V

59:53•Rachel Streitfeld

Commissioner Dara, thanks so much. Okay, Commissioner Trevone.

59:59 – 1:01:30•Richard Chervony

Thank you. Commissioner Dara, stop reading my notes. The message I bring this month to the village is one I have shared with the mayor and my fellow commissioners. We have worked tirelessly in bringing development to the village and getting projects in the ground. But now it's time that our dreams, artwork, and promises come to fruition and we see these projects coming up from the ground. Pleased to report the Tula residents, Shoma Bay, Continuum West, and Pagani have all broken ground and are on the way off the ground and zooming to completion. Next on the radar for early 27 is Sunbeams Grove

1:01:31•Rachel Streitfeld

Thank you, Commissioner. Commissioner Acosta.

1:01:34 – 1:05:54•Doris Acosta

Thank you so much. Well, this past May 9th, I was very proud to be part of the bike rodeo here in North Village, actually right here outside of City Hall. Thanks to the work with our police department to help me put it together. They bring these events to our communities, part of their efforts to keep our children safe. And it was a wonderful event. We had a contribution from the. TPO, which came over to help us with many free helmets for both adults and children and helmet fitting. A lot of people are not aware, but helmets do expire. So it's great information provided to the kids. And also t

1:05:56 – 1:06:08•Goran Cuk

Vice Mayor. My main topic of conversation tonight is the community center and soccer program. So in the interest of time to all of our residents here tonight, and thank you all for being here, I will waive my commission report.

1:06:08 – 1:06:26•Rachel Streitfeld

I'm also waiving my commission report in the interest of time and the volume of discussion items that we have on our agenda tonight, which I have been discussing at length and ad nauseum for the last few weeks behind the scenes. So let's keep things moving. Village Attorney's Report.

1:06:53•Rachel Streitfeld

Is there not another item that needs to be discussed? Not this evening, Mayor. Okay. Mr. Village Manager.

1:08:09•Rachel Streitfeld

Before the end of August. Before the end of August, we will be breaking ground on our new Village Hall public fire, public safety complex, fire station, police station.

1:09:43•Rachel Streitfeld

That's fantastic. And the fact that we have a beautiful community center to house that program is transformational. Thank you.

1:10:07•Rachel Streitfeld

Thank you. Thank you. Thank you guys. Absolutely.

1:10:16•Rachel Streitfeld

Okay. All right. Madam Village Clerk, do you have anything to report?

1:10:26 – 1:10:44•Rachel Streitfeld

Okay, excellent. I want to circle back to the manager's report and get a report from Rory on the grand opening ceremony. I want to check in on how sponsorships are going and get an update on how that event is shaping up. Madam Director Torres.

1:14:08 – 1:14:21•Rachel Streitfeld

Thanks so much, Indira, and thanks for all of the time that you're investing in chairing this committee. I really appreciate it. Really disappointed to hear that our soccer family is just saying that this is not going to be a celebratory event. That feels really off-base to me. Thanks.

1:14:24 – 1:15:18•Rachel Streitfeld

Okay. Let's move on to 14B and get into this then, shall we? 14B. Sorry. This is a discussion on the proposed PFL-AFA programming, scholarships, field schedules, summer programs, and kids soccer programs sponsored by the Vice Mayor and Commissioner Acosta. I'll let you guys go ahead and introduce this item. We obviously heard from representatives from our soccer community, lots of neighborhood stakeholders in the room. I've spent a lot of time talking to Coach Kreis, staff, stakeholders, residents, parents. So I think I'm pretty well briefed and I want to sort of see how this goes. So Commissi

1:15:18 – 1:16:38•Goran Cuk

thank you mayor uh so the reason i put this item on the agenda is because i'm part of the soccer group chat with a lot of you that are here tonight and um i was reading through some of the concerns a lot of which we heard tonight by some of our residents like kevin here around around programming and around the soccer program and access to the fields and scholarships so Tonight, my goal with this item is to address all of those components of the program, of the community center, hopefully give all of you a lot of clarity and transparency about access and about the kids soccer program and make s

1:16:39 – 1:17:49•Doris Acosta

I appreciate it. Thank you so much, Vice Mayor. The reason why we brought this up is because we want to make sure that the parents feel heard, but we also want to give some clear answers where we can, right? So I want to defer some of these questions actually to you, Frank. So if you don't mind, I feel like there's some points of clarification that the community has. They've sent several emails. We've all had individual conversations for the most part with the parents. You know, the efforts here are the goal. The good thing, like I always say to the parents and the community is we all here tog

1:17:57•Doris Acosta

How far ago was this accepted. 4 years 4 years ago.

1:18:08•Doris Acosta

What are the... Is there any room for some of the changes? The reason why I'm asking this is because comparing this schedule to the actual schedule the kids have...

1:18:22 – 1:22:54•Rachel Streitfeld

So... When this contract, it's actually a series of contracts that were negotiated with representatives from, we're using the term AFA, but Claudia Tapia is not involved in any of these conversations, neither is Miguel Messi. We're talking about private developers and an organization that has license rights to the AFA brand to run the AFA International Center here in Northwood Village, okay? PFL is our partner in this public-private partnership, also obviously with the school board, right? PFL is Project Football. The schedule was negotiated in 2022. Not a single person on this dais was involv

1:22:56 – 1:23:09•Doris Acosta

Thank you so much for that clarification. The other question I have is about the contract. What is the status with the contract? There's this expectation that the contract should have been signed a while back. Can you go into that?

1:23:10•Rachel Streitfeld

I want to actually give it to the village attorney because she's the charter official who is reviewing this contract and helping our community engagement director with it.

1:23:25•Rachel Streitfeld

It was supposed to be on the agenda this month.

1:23:35 – 1:26:19•Rachel Streitfeld

I want to really make a point here. They're here because a lot of things are changing and they're changing really fast. And adding uncertainty on the crease contract has made life really difficult. for me personally, these last couple of weeks, but I think for all of us. And so we need our staff to support our staff, to support our invested residents. And beyond that, I think WhatsApp is probably one of the toxic places one can spend time, okay? And so I make a choice to not participate in the many, many WhatsApp chats that exist here in the community. But for whatever reason... There's a lot

1:26:19 – 1:26:38•Doris Acosta

Okay, sorry. I have a couple more questions. We don't have to go into 100% detail into everything. But these are just points of clarification. Another question I have heard a lot is, when we have the Treasure Island Park, now that we have the ownership of it on North Treasure Drive, will that become the space for the coach to now have the soccer program in?

1:26:39 – 1:27:44•Rachel Streitfeld

It shouldn't. I'm just going to put this out on the table because these are the conversations. So first of all, let me say this. The park on North Treasure Drive should have been graded and resodded by now. We have known for at least six months that we were going to get ownership of that field. We had a plan to bypass the permitting system, which was a terrible idea. And now we're going to actually go ahead and get permits. The field should have been done a month ago, but it's not, and it'll be done soon. If we want to run the soccer program out of that field, sure. But I think that would be a

1:27:45 – 1:28:25•Doris Acosta

Apparently, there's even an outside league now that is renting the space, advertising already and taking applications from residents. Some of the parents have even sent me their screenshots of this application from that company and they don't have a discount for residents, which is, you know, it's their private, it's their own private program. um the question is would the would our kids be able to apply for the alpha scholarships is it going to be just like okay you're a resident therefore you have 25 spaces or do they have to do trials and it's up to alpha to select whether they accept a chil

1:28:53•Doris Acosta

And is this an annual 25 scholarship or is it going to be including summer camps? We don't know that yet.

1:29:10 – 1:29:26•Doris Acosta

And the last question I have isn't just about something else. It's not even the parents asking. It's just my curiosity. For the FPL bill on running the lights and all of the systems, who's paying that bill? Is that separated from what they use in the fields versus what we use in the community center? Yes.

1:30:01•Doris Acosta

I appreciate answering all these questions.

1:30:04•Richard Chervony

Could you also please explain about why the lights have been on so late at night lately?

1:32:34 – 1:34:12•Rachel Streitfeld

So what Frank and I were told on Friday when we met with Mariano is that the lights are that bright. And that is not... an acceptable answer to me. And I'm really at a loss as to what we have the ability to do now, because I do recall being on this dais when we had community meetings about this facility. And I do recall being on this dais when we approved those agreements. The conversation about the lights was focused on ensuring that Beyond the fields, there would not be light pollution. And I mean, I don't live at the Lexi. I live at Iron Place, which is a half a block away. But when I am qu

1:34:13 – 1:34:54•Rachel Streitfeld

Beyond the field. And I would be shocked if the foot candle measurements of the situation today are consistent with what they should have been when we approved the lighting. So can you comment on that, Madam Village Attorney, at this time? we will look into it and i'll circle back with the village manager and see what we can do okay thanks yeah this is i i really do have a lot of empathy for people who it it does it changes the entire feel of the island um and as someone who you know i've been living on treasure island for for almost a decade now and i don't have any plans to leave it's a diff

1:34:58 – 1:35:39•Goran Cuk

Okay, so yeah, the lighting is a top concern for me too. I went out on the fields and I noticed that the lights are adjustable. I spoke to some of my colleagues in Miami Beach and they have night guards that they have in use at Flamingo Park and some of their other facilities. So I want us to look into that. I also heard that those lights can be set, the brightness can be adjusted on those. They're LED lights, so that can be adjusted. Some of them can be turned off. But we need to explore all of these things because it is important. I live at the Lexi and I've gone down to the sixth floor, the

1:35:41 – 1:35:55•Rachel Streitfeld

It cuts off at 11. And here's the thing. I understand when you have a match, the lights need to be up to FIFA standards, but when you're practicing, they do not need to be. So that's another wiggle room point as well.

1:35:55•Goran Cuk

Definitely. It's going to be very rare that those lights or that field is going to need to be at FIFA standards. So this is an important point we have to look into.

1:36:13 – 1:36:43•Rachel Streitfeld

Teams to go out there and play, practicing is different than matches. So for the matches, they need to be at full capacity. I can understand that. But during a practice session, I don't necessarily know that they need to be at full capacity. And even if they are, because again, I understand there's like a no shadow rule on the field, right? But the technology exists in 2026 to protect the night sky beyond the field itself.

1:36:45 – 1:36:59•Richard Chervony

We're talking about matches and games. Let's be realistic. I don't ever recall having bleachers or any sitting capacity around the stadium. It's basically just the players playing in the stadium.

1:37:04•Richard Chervony

No, I agree with you. Well, but... Some residents believe that it's going to be noisy.

1:37:10•Doris Acosta

Bosses stopping by. They're going to be pulling in.

1:37:13 – 1:37:24•Richard Chervony

They're going to be screaming and hollering. No, there's no screaming and hollering for things. This is not a stadium. This is a practice facility. There's a difference. That's right.

1:37:25 – 1:37:53•Andy Daro

I'd like to backtrack a little bit on the accommodations of our recreational soccer program here. So as the current program is twice a week, they have practice and then once on the weekends as well, correct? So when I look at the 11 by 11 field, if that's what's necessary, there is openings on the weekend. So right now I see the problem being during the week where we do have a 5v5 field available, but not the 11 fields.

1:37:56 – 1:38:18•Andy Daro

There is, however, a possibility that I think, so this is assuming that first AFA, I mean, it is written into the schedule that they're running Academy Monday through Friday. I would question that to see if that is first we can speak with AFA to see if they really are having Academy as drawn out five days a week. If not, there's also rental periods that North Bay Village could rent and include our program.

1:38:18 – 1:38:29•Doris Acosta

They already rented those fields. There's already a company that rented those fields. It's already advertising. It's already asking kids to sign up to it. Two academies. Two academies already.

1:38:30 – 1:38:45•Andy Daro

I'll find one. So the rental field's on the other. So really we're looking, the issue is coming during the week to accommodate two weeknights on what we need as the 11, the 11. There's really no issue on the weekend. Yeah. There's really...

1:38:48 – 1:39:11•Doris Acosta

there's there's there is a weekend issue so so okay well i was just like a change of hours but not necessarily an issue like if we had it at noon instead of 10 it's really hot not only that the kids also their whole day is ruined you as a parent you want to be in and out eight in the morning 10 you're done your day can start at noon your day is done surface that's

1:39:18 – 1:40:04•Goran Cuk

And that's what I was going to suggest. So why don't we, we need to sit down with the parents, the staff, and understand what's the schedule like, understand the requirements of the program, what's the capacity that we have, the amount of kids that we have, and work around that. There is... plenty of opportunity to rent uh in the mornings at nights i i'm hearing that some of it's rented by other academies um we should have the first say on that i i would first of all i would say and then secondly um i i i'm sure we yeah i mean i'm sure we can we can find ways to fund an additional field if nee

1:40:04 – 1:41:16•Rachel Streitfeld

So I have had what I think are productive conversations with Cleve and Kevin and Anthony. And again, I am not holding my breath to have this particular schedule modified. I'm not. I'm managing my expectations. I think that it would be a good idea for the soccer program, for us, to figure out a better way to stagger practices if that Tuesday-Thursday is an absolute... set in stone our soccer program has been running from like 530 to 730 on Tuesdays and Thursdays if it needs to be modified so that certain age groups play at 530 followed by another age group at 630 and another age group at 730 so

1:41:17 – 1:42:08•Andy Daro

If we don't have the 11v11 field on the weekend in the morning, we do have both of the small 5v5 fields on the weekend. So, I mean, two 5v5 fields is a full field, essentially, right? Wow. There's two that are both four and all the fields, actually four of the fields, 5v5 fields are open on the weekend. So I don't see the weekends are an issue. The weekends are not an issue. There's only one field. NBVU's field one, two, three, and four, the 5v5. I'm not talking about the 11v11 field. I think all four of the small fields are open on the weekend. All right. So I'm starting at eight to noon. It

1:42:09 – 1:42:36•Rachel Streitfeld

The tough spot really is the weeknight attorney. But last we spoke about the actual agreements that are executed in place and that control this arrangement today. Is there a forthcoming edit, addendum? Are we making revisions to any of those agreements at any point? The only one that's being amended...

1:43:44 – 1:44:01•Rachel Streitfeld

The school board as well as PFL, right? Correct. So if the schedule is modified, we asked you this at the last meeting, you were going to confirm. If the schedule is modified, if we are able to accomplish a change, it still now has to go for approval at the school board?

1:44:05 – 1:45:48•Rachel Streitfeld

I don't read it that way. Okay. I hope you're right. Yeah. Yeah. Again, PFL was very insistent about the monetization of the fields for their ability to make back their investment. And I am also very, we are all very aware of the limited capacity taxpayer dollars that can be spent on more use of the field. So my kind of bottom line is if we want to rent more flats, We need to go out into the community and identify a sponsor for the soccer program. And so for all of you parents and stakeholders in the room, think about your networks and networks. maybe you can help us go out into the community

1:45:57•Rachel Streitfeld

Cleve, please stop. Thank you. Thanks. Does anyone have any further questions?

1:46:03•Goran Cuk

Frank, what exactly is rented right now? You said that all the fields are rented. Where are we with that?

1:46:24•Goran Cuk

Right. Well, we need to get ahead of it and understand what hours we need for the soccer program and rent those fields out.

1:47:04 – 1:47:16•Rachel Streitfeld

I'm going to literally have you taken out of the room if you keep, like, coming up here and just saying that we're lying to the residents in the context of this meeting. Please stop. It's not for what you said.

1:47:22 – 1:48:05•Doris Acosta

We understand the frustrations. Like I said, we are here trying to not just fix the problem, but be realistic. And I do agree. It might not be the answer we want to hear, but at least we're trying to give answers. Whether it is the right answer or the wrong answer, at least we're trying. And nobody here is hiding. Everybody here is doing their best to try to make it happen. um i'm not happy but at least we're getting answers and trying to get us answers and that's that's really what we're trying to accomplish here yeah i i look like this is really tough i mean i walk the dog and have this conv

1:48:07 – 1:48:47•Rachel Streitfeld

All right. There's one other issue that I want to cover, talking about privatizing public spaces. A local business owner who runs a gym over at the Grandview Palace has asked us if we would entertain leasing the third floor of the community center for a gym. I personally, when I met with her one on one, I said, absolutely not. I know several of you met with her, but the village has now decided to put this question out to the residents to ask if this is something that the residents want. And I know we did a poll. So really, I want to invite you back to just touch base and get some direction fro

1:49:50 – 1:50:03•Rachel Streitfeld

Yeah, that sounds about right. That sounds about right. We're really looking forward to having that space for all types of community events. So does anyone on the dais feel differently?

1:50:05 – 1:50:39•Doris Acosta

I have a question about this space for kids versus teens. Some of the parents were wondering, you know, when we talk about the teen programs versus the younger children programs on the second floor. Like, you remember last year when we had the kids that came in for the internship and their presentation? Yeah. Some of the things that they talked about was having that multi-use rooms for their studies, even for people who are doing business that want to have a meeting. Would that be something that that third floor will be also for teens or would it be just the second floor even for teens?

1:51:18•Doris Acosta

Would parents be able to join their teens in some of these activities? Because there's times that you want to play ping pong with your kids or you want to help them in their studies. Would they have access to this area with their teen?

1:52:22•Doris Acosta

Family's coming for Thanksgiving, bring the uncles, bring your family, play games, you know, get out of the house, that kind of good time, you know?

1:52:28 – 1:52:49•Rachel Streitfeld

I want to make sure that Lily has absolute 100% clarity on the use of the third floor space of the community center. So can someone, I'll move to make the recommendation. that the third floor space on the community center remain open for flexible programming for all ages and very specifically not a gym.

1:52:53•Rachel Streitfeld

Madam Clerk, will you please call the roll?

1:53:47 – 1:53:58•Richard Chervony

depending what the recreational program is. And is there an instructor required that we have to pay for? If we have to pay for the instructor, it gets spread evenly through the participants.

1:53:58•Doris Acosta

Yeah, we may even have seminars at the library. And they charge for seminars at the library. So it depends on what it is.

1:54:05 – 1:54:22•Rachel Streitfeld

Are we going to have some type of resident access so that we know when someone walks into the building for a program that they're a resident? Are people going to be signing up for a profile on some... They are, which is why we got Civic Plus.

1:54:35•Rachel Streitfeld

Please expedite the finalization of that agreement. She cannot do her job until she has access to Civic Plus. Thank you.

1:55:00•Richard Chervony

Motion to approve as requested, except item 11B, which will be on Zoom, and 11B that was pulled.

1:55:08•Rachel Streitfeld

Okay, do we have a second? Second. Okay.

1:55:23•Richard Chervony

I'm going to take 11B first. Zoom with Sheehan.

1:55:30 – 1:55:53•Rachel Streitfeld

11B is deferred to next month. 11D is a resolution of the Commission of North Bay Village, Florida, approving an agreement with PFM Financial Advisors LLC for financial advisory services, waiving competitive bidding, providing for authorization, and providing for an effective date Village Manager rolls in.

1:55:54 – 1:56:32•Richard Chervony

The reason why I pulled this item is very simple. You're requesting here a potential second and third year addendum to this contract. I'm looking at it that this year we do need the assistance because our finance department is a little weak. We're in the process of getting a CFO. We're in the process of getting a controller. We're going to have a full financial team. We already have bond counsel. What's this other PFM bond person doing that we need requirement for second and third year?

1:57:45•Richard Chervony

For this year, I can see it, but are we going to be pulling trenches for the next three years that we require?

1:58:44•Richard Chervony

So if we don't use them that year, we do not have to pay anything on that contract?

1:59:22 – 1:59:38•Goran Cuk

My name is Pete Verona with PFM. So to answer your question, there is no payment if there's not a bond actively being done. We don't have a retainer. So if there's no work that's done in a particular year, you don't owe us anything.

1:59:45•Richard Chervony

Thank you for that clarification. You're welcome.

1:59:52•Rachel Streitfeld

Okay. We have a motion from Commissioner Turboni. Is there a second? Okay. Is there any discussion or maybe there's a question from the village attorney?

2:00:44•Richard Chervony

I understand, but I was looking at it. We're going to have a full financial department, our financial department carrying some of that load as well.

2:00:53•Rachel Streitfeld

We have a motion and a second. Madam Clerk.

2:01:09 – 2:02:52•Rachel Streitfeld

Before we move on, a note on our finance department. There's a new CFO coming next month, and we'll have a controller. I'm really looking forward to having a new CFO. North Bay Village has the highest debt millage of any municipality in Miami-Dade County by 100%. Our debt millage is 1.1 compared to other municipalities that are a 0.17 or a 0.12. We are at 1.1. I've been the mayor for about 18 months. I've instituted some really meaningful changes as far as cover sheets and account numbers and current balances being requirements for all of the checks that I sign. And yet I'm still seeing errors

2:03:01 – 2:03:44•Richard Chervony

Well, you have to realize, first of all, the 1.1 debt millage is going to increase this year. Of course. We're even going to be higher. Yeah. And our general budget millage has to increase as well. Even though we're leaner, we're finally going to have a financial department. Right now we have A CFO, we have no controller. We had a controller, we had no CFO. We were in a vacuum for two years. And I don't want to point the finger, but our acting manager at the time was very weak in finance.

2:03:45•Rachel Streitfeld

Yeah, I don't want to point fingers. I'm trying to set very clear expectations for what the future holds.

2:03:53•Richard Chervony

But don't set expectations of lowering the millage because... No, no, no, no, no, no, no, no.

2:03:58 – 2:04:19•Rachel Streitfeld

The expectation was not that we were going to lower the debt millage. I'm listening to the man as he's talking about pulling down another tranche of $10 million to pay for infrastructure. That's not what I'm saying. I'm talking about specifically within our finance department, tightening it up, making it leaner, less prone to human error, more professionalized and more efficient.

2:04:19•Richard Chervony

I think once you have all the positions filled, you'll have that, especially with the individuals that are coming in.

2:04:26 – 2:05:16•Rachel Streitfeld

Yes. Understood. Okay. All right, let's move along to 13A. These are public hearings. These are ordinances on second reading. We're going to talk about signs right now, signs in the First Amendment. This is 13A, an ordinance of the Mayor and Commission of North Bay Village, Florida, amending Chapter 11 signs, Chapter 15 form-based code, to address current legal requirements, to establish specific standards and regulations, and to consolidate all provisions related to signs, providing for severability, providing for codification, providing for conflicts on an effective date.

2:05:19•Rachel Streitfeld

This is second reading on the sign code.

2:08:40 – 2:08:58•Rachel Streitfeld

You have problems? Okay, great. We'll talk about your problems in just a second. Let me ask a question. You said murals are limited to 1500 square feet. What is the mechanism whereby someone gets approval for a mural on the entire podium wall of a building?

2:09:21•Rachel Streitfeld

But it comes to the commission for approval?

2:09:40 – 2:09:53•Rachel Streitfeld

Craig is saying yes. Craig says yes, it's non hardship based and it does come to the Commission and we have strict criteria to follow so that we're not approving or denying subjectively these murals.

2:10:18•Rachel Streitfeld

Commissioner Schiavone, talk about your problems.

2:10:21 – 2:11:14•Richard Chervony

Section 11.7, temporary signs, political signs, campaign season, which already started. You're only allowed to have signs for 90 days. You're allowed three signs the whole year. After that, you're allowed to have as many signs as you can as long as it doesn't exceed nine square feet. two signs two by three which is a normal large political sign for instance if i would do a campaign sign the word is quite large unless it's very small lettering which doesn't It doesn't really help you. I'm not running for office. That's why I'm using my name. Okay.

2:11:16 – 2:12:02•Richard Chervony

That's what I'm saying. Two signs, three by two or two by three already are the... the requirements with the three signs that's five signs 15 feet apart and you only have a 70 foot frontage you have to be very creative as to how you're going to put this one back here this one up in front you know and if you're on the water to create to create them to be able to put the What you have added is additional signage for campaigns. That's number one. Number two, political signs are only allowed on for 90 days. Qualifying takes place in July. Election takes place in November. That's more than 90 days.

2:12:03•Rachel Streitfeld

My understanding is that it's 90 days tied to an event. So the event could be the primary. The event could be the qualifying date. The event could be the runoff. The event could be the election, right?

2:12:46•Richard Chervony

And you're going to go to a neighbor's house and say, can I put a sign up? Are they supposed to ask you how many square feet is a sign? Because you're only allowed X number of square feet for signage.

2:13:30•Rachel Streitfeld

So the provision still limits the nine to nine square feet before an election?

2:13:46•Rachel Streitfeld

I don't think we should be measuring square feet when we're talking about campaign signs. It's not a logical thing that people are measuring.

2:14:11•Doris Acosta

And you're saying it could also be one huge sign versus three. That is correct. I don't know. Let's think about that.

2:14:19•Rachel Streitfeld

Do you want to defer this again or are you ready to move it?

2:14:23 – 2:14:40•Richard Chervony

I'm not ready to move it because then... I want to know how is the homeowner expected to measure the square feet of the signage? They can be in violation by having either too many signs, that are over the limit of the square footage or one big sign and a little sign.

2:14:40•Rachel Streitfeld

I think they just measure though, right? I mean, you can... Who's going to measure them?

2:14:45•Doris Acosta

I'm more concerned about allowance of a huge sign.

2:15:21 – 2:15:34•Richard Chervony

If you put your picture, if you put your number, if you put your name... You take up space. Take space. And you don't want small print because then you can't read it. I've played literally never made one. Never made one.

2:15:34 – 2:15:48•Rachel Streitfeld

Don't brag about it. So his issue is measuring. He doesn't want people to have to measure and he certainly doesn't want Orlando out there measuring things on people's yards, which I can understand.

2:16:03•Rachel Streitfeld

So let's figure this out and bring it back in June. Right?

2:16:09 – 2:16:37•Richard Chervony

I'm fine with that. Bring it back. The other thing is, what are the fines for those people that are procrastinators and do not remove it within the seven days after the election, both locally and internationally? Outside. Because now we're going into federal and state elections. And people come around, they put signs up, and state and federal are not going to come around the night after to remove signs.

2:17:15 – 2:17:30•Richard Chervony

But if we have a fine for a candidate in our books, And I'm talking about not state or federal. If it's passed, for argument's sake, I don't even have to make it that short in seven days. Say 30 days. There's lots of them that stay there for two and three months.

2:17:40 – 2:17:53•Richard Chervony

Cite the property owner based on the 90 days. And I don't think the 90 days are enough. I mean, I need this worked up a little bit better, Heidi. If you want to, we can do a quick Zoom call and discussion.

2:18:10•Rachel Streitfeld

I don't want to over-regulate speech. I don't want to make it too complicated, and I don't want our Code Enforcement Director to be out there measuring things. Okay.

2:18:24 – 2:18:41•Richard Chervony

You can put a limit on the, let's say for single family homes over four by four sign or three by three sign, I don't care. But then you put limits on, you can have three signs year round, you can have three more political signs, but remove the 15 feet apart from each other because you don't have the room. It's only 70 feet wide, the property.

2:19:17•Richard Chervony

You don't see the next one, but, you know, it's up to you where you place them. That's right. Okay.

2:19:23•Doris Acosta

And you don't care whether the sign is one large one or not. Like, you guys are all good with that.

2:19:29•Richard Chervony

No, there should be a limit for single-family homes, and there should be a limit because I remember Gabrielle and Ash Tesla having the four big signs.

2:20:03 – 2:20:21•Richard Chervony

I mean, let's be realistic. If somebody falls today and opens up a bank account and wants to create signs without getting the signatures and everything else, you're talking about now June, elections in November. You can do that. There's been times when people have done that.

2:20:37 – 2:20:48•Richard Chervony

There's no requirement that you have to qualify to create a sign and put it up. So there's no requirement. You can put the sign anytime you want to run for office. once you fill the proper paperwork.

2:21:02 – 2:21:18•Rachel Streitfeld

I think we're incredibly fortunate that we haven't had a fight about signs or flags here in our community, and I would like to keep it that way. I mean, I'm not going back to 1945. Neither am I.

2:21:18•Richard Chervony

Well, Landon and I have fights over signs.

2:21:21 – 2:21:33•Rachel Streitfeld

Okay, well, that's more personal problems over there. All right, I'm going to move to defer the sign code on second reading to the June meeting. Who seconds? Commissioner Cervone seconded.

2:22:04 – 2:22:59•Rachel Streitfeld

is an ordinance of the Mayor and Commission of North Bay Village, Florida, amending chapter 150, boats, vessels, and houseboats of the village code of ordinances by creating section 150.22, overnight anchoring restrictions to regulate certain overnight anchoring of vessels within the waters of the village, amending section 153.04, schedule of fines and civil penalties to establish a penalty for violations providing for severability codification providing for conflicts on an effective date sponsored by mayor streitfeld and co-sponsored by commissioner acosta this is second reading commissioner

2:23:00 – 2:23:14•Richard Chervony

Schedule A, Section 2.3 says notification by mail. I am ignorant to this, and I admit it. But is mail delivered to a boat that's anchored at sea?

2:23:18•Richard Chervony

What if there's no land address on this vessel and all is sea-related?

2:23:28•Richard Chervony

It doesn't have to be registered. Somebody can bring it, or it's registered in Timbuktu, and they come here and they moor the vessel there. You have no address for them.

2:23:40 – 2:24:07•Rachel Streitfeld

What you have just highlighted is actually a very, very meaningful issue for derelict vessel removal, for law enforcement on the bay. It's an FWC issue. Yeah. So getting vessel registration addresses and notifying owners of vessels based on their address is actually something that probably needs to be handled at the state level, I think.

2:24:08•Doris Acosta

Hopefully this will create database of that.

2:24:11•Rachel Streitfeld

No, this is just a carve out of a statewide preemption.

2:24:14•Doris Acosta

By providing that exact issue. Are you creating the data of what we're having these problems?

2:24:20 – 2:24:50•Rachel Streitfeld

it's not why we're having these problems it makes it makes enforcement on the bay very particularly challenging we don't have another option i'm totally ignorant to it yeah yeah so you can read you can register a vessel anywhere you can register a vessel in the bahamas in barbados in miami um and where that vessel is registered is where it's going to receive the notice right But there's also a posting of the property, which we are not doing.

2:24:58•Richard Chervony

If they receive it. And if there's somebody there to get it. Otherwise, you're pasting it on the vessel.

2:25:15•Rachel Streitfeld

I think the bottom line is we need to approve this tonight.

2:25:22•Richard Chervony

I'm not saying no, but these are questions that came up.

2:25:26 – 2:25:42•Rachel Streitfeld

So these are questions that... Look, there's a law enforcement task force that is working on enforcement of these issues. Miami, Miami Beach, Miami-Dade County, FWC, Carlos and Sam and Picovara, Kenny, they're all over it.

2:25:43•Richard Chervony

I'm not against it. I know. I have these issues.

2:25:49 – 2:26:13•Richard Chervony

And they also talk about the magistrate has a hearing in 10 days. Our magistrate has a meeting once a month, and if each side requests a continuance, it can take three months for it to be heard by our magistrate. Let's be realistic. In three months, the guilty party has absconded and moved elsewhere, and until it comes back into our waters... What can we do about it?

2:26:13•Rachel Streitfeld

Well, the good thing is that they've left, which is accomplishing the whole point.

2:26:18 – 2:26:29•Richard Chervony

For us, immediately, but we have pushed the issue on another city. That's not the whole point. The whole point is solving the issue, not pushing it onto someone else.

2:26:29 – 2:26:48•Rachel Streitfeld

Okay. So let's be realistic here. Okay. So we are adopting this ordinance because Miami Beach has adopted it and Miami has adopted it. And we are protecting our coastline and working collaboratively with those jurisdictions to help us enforce, right?

2:26:50 – 2:27:40•Rachel Streitfeld

Stopping the issue is not a reality. People are still going to try to live on boats at zero expense and not pay taxes and not pay for an anchoring area. That's just going to happen. Now at least we have a way to enforce it and to get them out of here. It's not my job to protect Bay Harbor Islands, but I'm here for them. You know, we've got coastal mayors. We talk to them about this. I've encouraged Isaac. I love Fane-Losman. I was not here. I read about the Fane-Losman years. I had the true pleasure of meeting Fane-Losman in the first week of living here. It was honestly one of the most hilari

2:28:30•Doris Acosta

Can I move to approve? You want to move it, move it. I'm going to move it to approve. Okay.

2:29:02 – 2:29:46•Rachel Streitfeld

13C, an ordinance of the Mayor and Commissioner of North Bay Village, Florida, amending section 8.11, use exceptions of the Unified Land Development Code to provide for temporary use setback modifications, providing for severability, providing for codification conflicts on an effective date. This is second reading. My understanding is that the Planning and Zoning Board did approve this at its meeting earlier this month. And we obviously approved it on first reading. This is Craig. This is you. Have there been any changes since first reading? Were there any recommendations from the Planning and Zoning Board that we should be aware of?

2:29:55 – 2:31:16•Rachel Streitfeld

Yeah, I agree with that. Commissioner Darrow mentioned this during his commission report. The curb, sidewalks, parking spaces at the Coletta lot property where construction staging is happening for Tula, are just the state of the sidewalk and the street is really ratchet. So we need help from our private sector partners, as well as staff to really just, just clean it up. Yeah. Yeah. And I think we also, if possible, you know, the, the guys who run the Marina and the Iron March, If Orlando could do some one-on-one outreach to those two business operators to maybe install more trash cans, make t

2:31:16 – 2:31:41•Richard Chervony

We used to have an off-duty police officer there on weekends when it was really busy to control the littering and the noise and the issues of people being drunk coming off those boats between the Allen Mart and the, I think it's Gator property. Next one. We used to have a police car there on weekends. Off duty.

2:31:42•Rachel Streitfeld

Not a bad idea, especially since there's so much speeding on that street too.

2:31:58 – 2:32:09•Rachel Streitfeld

Or one of our on-duty officers, right? I'm not going to intervene in how they run their squads, right? But that is community policing.

2:32:15•Richard Chervony

I believe the marina was being charged for the off-duty in those days.

2:33:59•Rachel Streitfeld

I would be interested in seeing what type of enforcement happens over the course of this upcoming weekend, too.

2:34:23•Doris Acosta

I was going to say, we asked the Palm Tree to provide that kind of service and added security. Why is it that we cannot do the same for other businesses that are also bringing traffic into the area?

2:34:33 – 2:34:54•Rachel Streitfeld

Palm Tree Club is getting special event permits because they don't have the appropriate certificate of use for what they're operating in that space. And so because they have special event permits, that is the requirement for off-duty police officers. If they had a valid certificate of use to run a club there, they wouldn't have to have off-duty officers. My understanding is the marina is perfectly compliant with the zoning. Okay.

2:35:23•Rachel Streitfeld

We're helping out with traffic and the air and sea show on the beach.

2:35:40 – 2:36:06•Rachel Streitfeld

and then does the boat come back to us to ensure that all is well here yeah okay i just want to i mean i love that our resources are being spread throughout the community because it's you know givers game right right um but i do want to make sure that we can respond to issues here over the course of the weekend always do we are expecting the weather report is it's going to be rough so we're actually assigning two officers to the boat

2:36:59 – 2:37:11•Rachel Streitfeld

Yeah. Okay, so this is 13C. Is this use exceptions for temporary uses? I'm going to move it. Does anyone want to second it? I'll second. Seconded by Commissioner Cervoni. Madam Clerk, please call the roll.

2:37:17 – 2:37:53•Rachel Streitfeld

Yes. vice mayor cook yes it's true anonymous all right a resolution of the mayor and commission of north bay village florida approving an application by pacific norian properties llc to permit a temporary sales center trailer at the property located at 7918 west drive with a front setback of zero feet where 25 feet are required and the side setback of zero feet where 15 feet is required providing for findings conditions and an effective date Staff recommends approval of the use exception. This is on second reading. Planning and Zoning Board voted to recommend approval. Anything else you want t

2:38:08 – 2:38:29•Rachel Streitfeld

Okay, let's do disclosures first and then swear in our witnesses. Starting to my right. Any disclosures? No. No. No. No. Nobody's lobbying us. Love that. Let's do the swearing in of the witnesses. Are there any witnesses? Yeah, you guys are here. You're here. Get sworn in.

2:38:39•Rachel Streitfeld

Okay. Do you need to read rules about quasi-judicial? No. Okay. Great.

2:38:54•Rachel Streitfeld

I don't think so either. But I see that there's a bunch of land use attorneys here, and I want to make sure that they dance for their money. So do you guys want to present?

2:39:52•Goran Cuk

I'm okay with a condensed version of the presentation.

2:39:56•Rachel Streitfeld

Does anyone have any questions of the applicant or staff? No questions. Okay. I haven't moved this yet. I'm going to move it.

2:40:11•Rachel Streitfeld

Let's open a public hearing. Would anyone in the public like to speak?

2:40:27•Rachel Streitfeld

All right. We've got a motion and a second. We did a public hearing. We've got competent, substantial evidence. Let's vote.

2:40:46 – 2:41:26•Rachel Streitfeld

Sell those units, guys. Good luck. We're sending you all the vibes. Thank you. All right. 13E, a resolution of the Mayor and Commission of North Bay Village approving an application by 7940 MBB Partners LLC to permit a temporary sales center trailer at the property located at 7938 and 7940 West Drive with a rear setback of 15 feet where 25 is required. Second side setback of 0 feet where 48 feet is required. That's a really big setback for Providing for findings, providing for conditions in an effective date. Staff recommends approval of the use exception. Mr. Penn is here. Craig Pinder, do yo

2:42:11 – 2:42:49•Rachel Streitfeld

All five of us were present at the groundbreaking for this development. Yeah, I made remarks, were photographed through sand, through a shovel, shouted out the police department. Yes. It was great. So I don't know if there were substantive conversations about whether or not this use exception would be approved. I think it was generally assumed that we were going to approve this use exception. I don't know if anybody wants to challenge what's happening here. I think we're fine. Anything else? Can we just move it? I had a similar conversation.

2:42:57•Rachel Streitfeld

I thought it was a little awkward for you not to be there.

2:43:29•Rachel Streitfeld

Do you need a modified motion, or is the recommendation from the Planning and Zoning Board sufficient for your time frame?

2:43:44•Rachel Streitfeld

Yeah, I mean, did you review the resolution before you?

2:43:57•Rachel Streitfeld

If you have any feedback, we'd love to hear it.

2:44:09•Rachel Streitfeld

We're fighting the second. The motion is made by Commissioner Darrow and seconded by Commissioner Cervoni. Madam Clerk, will you call the roll?

2:44:29 – 2:44:51•Rachel Streitfeld

okay have a great night yes what time is it it's an early one for you it's an early one for all of us frankly it's 8 45 okay yeah no we're not ready for us at happies yet um so i don't have a phone up here today i normally have my My phone is at home. I walked out the door with my phone on the charger.

2:44:52•Doris Acosta

Kind of nice. No, I'm fine. I let you hold it. It makes you feel better.

2:44:56 – 2:45:28•Rachel Streitfeld

No, I'm really liberating. All right. 14 a discussion on the next steps of the stormwater park to be located at West treasure drive sponsored by myself and commissioner Acosta. This is really exciting. I've been dreaming about the Stormwater Park since I moved to Island Place. Who is coming to talk about the demolition and the next steps? Do you want me to just, Mr. Manager, discuss what you and I have discussed?

2:45:35 – 2:49:29•Rachel Streitfeld

she was here earlier we're wearing the same dress i was excited all right i'll yeah because we were matching it was very cute no she's in she's wearing a red dress anyway this is not substantive all right so The stormwater park on West Treasure Drive is not going to be immediately developed, obviously, because it needs to be designed. And it's going to be an engineering project. project basically for how it's designed, which is to say that engineering, stormwater management engineering, is going to drive the design of the park. Christina, our chief resilience officer, has been working with the

2:49:29•Andy Daro

When do we get to demolition? Do we have a permit for such?

2:50:34•Rachel Streitfeld

Hang on one second, because we're going to move it, and then we can discuss it.

2:50:39•Richard Chervony

Well, he's talking about what the proposal said, and there's something that... I read that he did not mention. Which is removal of septic tank would be enough. I was going to ask.

2:50:51 – 2:51:20•Rachel Streitfeld

I don't know. So we don't have... So the general understanding is we do not have septic tanks here. However... It is my experience that there have been zombie septic tanks identified in certain places. I've got our building director nodding behind me. We don't really know a whole lot about what happened in the 1940s and 50s here in North Bay Village. And so the existence of a septic tank, have we done any underground exploration?

2:51:39 – 2:51:51•Rachel Streitfeld

Commissioner, is that amended motion? Is that fine? Yeah. Okay. And I also want to clarify that an arborist will be out there to trim back that black olive and clean it up. This is separate from the demolition contract.

2:51:57•Richard Chervony

Is there any contamination on the property?

2:51:59 – 2:52:23•Rachel Streitfeld

No. There's no there's no well for the septic tank issue that's a TBD but, as far as other signs of contamination now there's there's no history of agriculture or other contaminated uses on the site and it was used as a single family home yeah. yeah. Okay, we have a motion from Commissioner Darrow.

2:52:23•Doris Acosta

We have a second from... Oh, I thought I made the motion, but yes, that's okay. You're seconding it? Yes, I will now.

2:52:29•Rachel Streitfeld

Okay, we have a second from Commissioner Acosta. Any other questions?

2:52:33•Richard Chervony

Supposedly there's a pump station going on that site.

2:52:36•Rachel Streitfeld

The pump station is going in the right-of-way. The electrical and mechanical is going on that site, but the pump station is going in the roadway.

2:52:49•Richard Chervony

And do we have a timeline for that pump station to be planned?

2:52:53 – 2:55:26•Rachel Streitfeld

The timeline on the Treasure Island roads and stormwater plan is in flux. You may recall that we canceled the current BCC scope of work as project manager because it was becoming obstructive. We are getting ready to go out to bid for a new master engineer on a new Treasure Island specific phased project. So it's not the third project. One, it is a new one, right? So initially we hired Black & Veatch. That contract didn't work out because we were paying through the nose for nothing. At that time, Black & Veatch was... removed we were told by our public works director at the time that he was per

2:55:26•Richard Chervony

The pruning of the two trees is going to also come out of stormwater funds?

2:55:31•Rachel Streitfeld

It's the pruning of the one tree, the one black olive tree, and that can come. I don't know if it's going to be. That will come from landscaping.

2:55:47•Richard Chervony

And last but not least, this is a very old home. Yeah. Almost as old as our Galleon Street building. Yeah. Is there any asbestos in it?

2:56:20•Rachel Streitfeld

We got a motion and a second on the demolition contract. Madam Clerk, will you call the roll?

2:56:37•Doris Acosta

I'm so sorry. We have a resident here waiting for 14H. I feel like we should try to accommodate as much as we can so people don't wait around.

2:56:44 – 2:57:07•Rachel Streitfeld

I was not aware. Thank you. I'm so sorry. Discussion and appointment to the Sustainability and Resilience Task Force. We have three applicants here. I have not reviewed these applications, actually. We'll move this one up. Yeah. Yeah, we have a resident here. If any of the applicants are here and want to speak.

2:57:07•Doris Acosta

Oh, I thought it was, sorry. I don't have my glasses. I thought it was Jessica. Oh, okay. So sorry.

2:57:16 – 2:57:29•Rachel Streitfeld

I'm sorry. Okay, we're not going to take it now. I'm going to actually review the application really quickly. All right. Sorry about that. Let's do 14C. Andy, this is you.

2:57:29 – 2:57:44•Andy Daro

All right. It's become a hot one for some reason, but we want to kind of look at this. Is there anybody up here that thinks that North Bay Village shouldn't respect its site plans?

2:57:48•Andy Daro

Correct. Site plans in... Original agreements. Yeah. Does anyone think site plans should be optional?

2:57:58 – 2:59:07•Andy Daro

No. Okay. So we agree we should follow site plans. There was a A poll, a survey that was put out on the Facebook page with like 160 participants that was over 80% of residents in favor of the island walk. Does anyone think that that poll is not an accurate representation? No. Okay. So we would agree that at least 80% of our residents at least want to see the island walk and we agree that site plans should not be optional. Okay. So, and we also, does anyone think that the island walk would not be in the best interest of North Bay Village? Okay, I'll take that as another no. Okay, so in the best

2:59:08•Rachel Streitfeld

What do you mean when you say it's in our site plan? Well, in reference to... Like the village doesn't have a site plan.

2:59:20•Rachel Streitfeld

Let him do his thing. I'm just going to do my thing at the same time.

2:59:24 – 3:00:30•Andy Daro

So in 360's site plan, in their condo docs, it's recorded as a public... It's a public walkway, public access. To my understanding, they were even granted a piece of that extended park in front of what is now the allot property because it was supposed to be in the best interest and public park for the community. So they were given additional benefits, which they have since closed to the community. You know, I think it's clearly in the best interest of the community and the vast majority of residents want to see the island walk. and the site plan calls for an island walk. So I think it's a slip

3:00:33 – 3:02:11•Rachel Streitfeld

Yeah. Andy, I appreciate what you're getting at. I really do. One, we don't waive our ability to enforce anything by not enforcing it. Period. Full stop. Okay. Two, we don't waive our ability to enforce a site plan or a development agreement by not enforcing it. Okay. So we can enforce the Island Walk on the 360 whenever we decide to do so. Right. And the commission could vote today to file a lawsuit against the 360. Okay. I'm going to oppose that vote. I don't think litigating with the 360 is a good waste of our time or is a good use of our time and money. We know that the 360 is tentatively

3:02:13•Richard Chervony

I disagree with you, Rachel. I'm sorry. Excuse me, Andy. We take a vote at this commission and I am tired of taking votes and not enforcing our votes.

3:02:23•Rachel Streitfeld

We have never taken a vote to sue the 360 to open up the island walk.

3:02:27 – 3:03:05•Richard Chervony

We said that they have to open the island walk when we approved them way back when you and I were not even sitting in this commission. They were granted a lot of land. They were granted certain privileges. For that boardwalk. So the commission that was sitting here did have a vision of that island walk open to the public. We have to enforce what we vote for. We voted today for Pagani to have their cell center moved. We have to continue with that statement and not change our minds overnight because elections are coming and people will vote against me.

3:03:05 – 3:04:08•Rachel Streitfeld

this is this is this is not about people voting against me this has nothing to do with that if i had been on the dais when the 360 site plan came before us i would have been a hard no there's no way that that building should ever have been approved the way that it was designed there are six vehicular entrance and egress at the entrance to the island should never have been designed that way all of the ingress and egress to that building should have been on east and west drive but the fact that you have cars coming in and coming out right at the entrance is a disaster so i would never have voted

3:04:09•Andy Daro

I mean, dog poop is not the largest issue that we have to deal with here, you know?

3:04:13 – 3:04:25•Rachel Streitfeld

No, it's not. The issue really is the liability. It's their liability because the island walk back behind 360 is very different than the island walk at the Moda.

3:04:25 – 3:05:11•Richard Chervony

You need back all the land that we gave in front of the building. You're going to have a street running right in front of the damn building, and they're not going to have access to their garage because it's our street. all the greenery, all the greenery in front of eloquence. I'm tired of this crap. I don't want to use the poop. I'm tired of this crap. If we vote a certain way or a commission prior to us voted a certain way, We have to abide by it and we have to enforce it. And if enforcement means litigation, then it's litigation. Sorry. We've been nice about it. We've spoken about it for 20

3:05:12 – 3:05:27•Rachel Streitfeld

No, it's not. It's not. Litigation accomplishes nothing and wastes a lot of money. We got into litigation with the guy who we had a lease with. No, I mean, we waste money litigating. It's the same thing I'm having the conversation with.

3:05:27•Doris Acosta

I think that there's plenty of room to still negotiate with 360. Every building has a different need. It cannot be a blanket statement for everyone.

3:05:34•Goran Cuk

That's what I was going to say. I mean, you both make really good points. And I do agree that the cost of litigating and the time that it would take, it would probably be a court for a year, two years, maybe.

3:05:43•Doris Acosta

They don't have the money for it either.

3:05:46 – 3:06:02•Goran Cuk

My suggestion is what if we tried to negotiate with them and secure their commitment to reopen when the neighboring building opens up? Yeah. I mean, is that, would that be acceptable? I mean, agreed. Will that be acceptable, Commissioner Darrell?

3:06:02 – 3:06:13•Andy Daro

I mean, it's just, it opens it up like, does Continuum not have to open then until NG Prosper Sites gets built? Andy, I appreciate the point that you are making. It's logical.

3:06:13•Rachel Streitfeld

It's like, do we want the Island Walk or not? We do want the Island Walk.

3:06:19•Richard Chervony

I'm not saying it's not a fair question. We have spoken about speaking to Sunbeam to let us open a temporary Island Walk behind their property.

3:06:29•Doris Acosta

They're not going to do that. They're not.

3:06:31 – 3:06:46•Richard Chervony

But we have spoken about that because we wanted to have a continuation. So now we have to wait 30 years that they got on their site plan to develop all their 14 acres or 12 and a half acres before we get our own walk behind the sunbeams.

3:06:46•Doris Acosta

Because we need to get, I think what we need to do is establish a real deadline. For every single building, we're having a problem.

3:06:57 – 3:07:14•Doris Acosta

I agree in that sense. I think it should be a real deadline. We're going to talk to 360. Here's a deadline of a decision. And they also know that we have to reach a decision because I do think that we're also opening ourselves for liability for developers to sue us because we're making it a mandatory thing for them to do, but yet not for the others.

3:07:14•Rachel Streitfeld

OK, well, that's definitely not grounds for a lawsuit. So just careful there with the words that you use and the things that you suggest in a public meeting.

3:07:22 – 3:07:36•Doris Acosta

I'm not suggesting that you do that. I'm just telling you that you're asking people to spend millions of dollars on an island walk. And yet we are not even here. Just us. We're not even having an agreement. And when do we manage to either make it happen or not make it happen?

3:07:36•Rachel Streitfeld

I think that you are confusing two separate issues, but that's not.

3:07:41•Doris Acosta

The bottom line is Andy keeps bringing this up at every meeting. It's not just him. It's the neighbors also.

3:07:47•Rachel Streitfeld

Here's my issue. Commissioner Darrow is the Harbor Island commissioner. Why hasn't he gone to the 360 to talk to these people and come to us with an agreement?

3:07:56•Richard Chervony

Because the vice president of 360 said to me when I said, would you like to meet for a cup of coffee? He says, no, I'll meet you in court.

3:08:03•Rachel Streitfeld

You're not the Harbor Island commissioner. I'm not. Respect me. I'm the Bay Village commissioner of all three islands. You are, but he's the one who lives there. He's the one with the kid in the stroller.

3:08:13 – 3:08:36•Andy Daro

I have no problem. In 360, I would love to come to the next board meeting if I could be invited. I mean, this is fine. I think the island walk is by far in the best interest of our community. And there was nothing, there was no single one issue in North Bay Village that could elevate the image of North Bay Village more than the island walk. That's an opinion, but that is my opinion.

3:08:36•Doris Acosta

That opinion was 40 years back for the island walk.

3:08:37 – 3:09:54•Andy Daro

I think it is the most desired thing, and I think it's what the vast majority of our community want to see. It's in the best interest of our village. It creates better property values. It creates a more livable. It's healthy. We want to share everything. I mean, I don't see that the one down is the only reason, and it's not the dog poop. It's not insecure. It's just the desire to keep poop. property privatized the fortress correct it's just that they want it private they want it forded in it's you know that's the real thing that we're talking about and that wasn't the design or the intent and

3:09:54 – 3:10:29•Goran Cuk

No, no, we can't drop it because I agree with what you said. It's opening access to the bay. And when we have Pagani and that's connected to space and Pagani and Moda, it's going to be amazing. It's going to be beautiful. And all the way down through Al-Ad and 360. So I fully support it. We can't drop the idea of the island walk. It's part of MBB 100. It's the best. It is a huge selling point to our community. It's why we put it in for Continuum and for every other development. So I think, Andy, if you're okay with it, try to go on their next board meeting and see if you could set a deadline o

3:10:30 – 3:11:01•Andy Daro

would be happy to work with 360 to see if we can come up with an amicable solution here to open the island walk in any of the condos that oppose this i would like to to speak with um now i mean that doesn't sure i mean let's just get a date a date to open so sometimes they're talking deadlines i mean we can we can put a uh a future date in test but again you know if nothing gets done by then Then what?

3:11:01•Richard Chervony

You know, if I can offer 28 and they'll say they want to open the boardwalk in 2030. Stop them.

3:13:05 – 3:13:34•Rachel Streitfeld

Why have we not discussed the initiation of a code case in like more seriously on this dais? This feels like, I mean, I understand that it's not the black and white letter of the regulations of the city, but it is a violation of a development agreement and a site plan. Do we have the flexibility in our authority to bring them through code enforcement?

3:13:56 – 3:15:21•Rachel Streitfeld

Yes. would bring them into, first of all, it would initiate enforcement. It would obviously light a fire in terms of a negotiation with staff on an opening date. If negotiations with staff don't move, then there's a special magistrate proceeding. And the special magistrate proceeding is like a trial where they come with all of their evidence as to why they don't have to open it. staff comes with all staff's evidence as to why they do have to open it the special magistrate who is an independent third party makes her ruling and if the special magistrate finds in favor of the village which they m

3:15:24•Richard Chervony

This is a case of mental masturbation. You're playing a game. You're delaying. Delays. More delays.

3:15:32•Rachel Streitfeld

You're not listening to me. No, I'm quite literally providing you a solution that is expedited faster than litigation.

3:15:39•Richard Chervony

Last commission meeting, let's start citing them. Nobody has the gonads to start citing them.

3:15:45•Rachel Streitfeld

I'm supporting a citation. I support a citation.

3:15:51•Rachel Streitfeld

Make the motion for a code enforcement and see how I vote. I mean, there's just no reason to be illogically upset about things that are actually moving forward.

3:15:58 – 3:16:22•Richard Chervony

I am upset. You personally, I am upset at the process that we have on this dais of not enforcing what we vote on. Everything that we vote on, we find an excuse as to, oh, let's give them another two months. Oh, let's give them another two years. Oh, let's do this for this. Come on. Enough of this bullshit.

3:16:28•Rachel Streitfeld

Andy, I think you've gotten quite a bit of feedback.

3:16:30 – 3:16:54•Andy Daro

Yeah, I mean, I'm having a tough time making a specific, like, emotion or direction to carry out here, though. I mean, I'm listening, like I said. I do think it would be in the best interest to go the whole nine yards, go loss and open up the iron market. That's what we have to do. You know, is there a better solution though, that we can come to this agreement? I don't know.

3:16:54 – 3:18:06•Rachel Streitfeld

I mean, you know, I really want to be clear. Getting to court, you've got two streets that'll take you to court. Street number one is through filing a complaint in the circuit court. They have 30 days to answer. And then once they answer, we can... you know, file discovery requests, and that will be depositions and production and documents, and it goes back and forth. And then you're in litigation doing the discovery for a year or two years. Actually, it's expedited, but the rules have changed. But it's two years before you get a judge to make a decision about who has the right to do what, rig

3:18:06•Andy Daro

I have no problems with the second road. Commissioner Schiavone, am I missing something that that second road can't?

3:18:11 – 3:18:42•Richard Chervony

At 6.20 p.m., I received an email from our legal department. It says, North Bay Village Commission, your BCC. Brief update on the Javits appeal. There has been no activity since November 2025, and the matter is pending the court's actions. We continue to wait for the court to advise whether they will grant Javits' request for oral arguments or render a decision. If there are any significant updates, we will be certain to share them with you. As always, if you have any questions, please let me know. How long has the debit case been going on?

3:18:42•Rachel Streitfeld

I don't know. It's a really good point that you just made, though.

3:18:49 – 3:19:05•Rachel Streitfeld

Well, okay. So you make a good point. Let me just say this. The expenses in a code enforcement appeal versus the village's expenses in filing a complaint are significantly different, right?

3:19:06 – 3:19:21•Richard Chervony

All you need is one. Once you file the first one, the others are going to fall right in line when they see that we're not messing around. That's all you need is one. Have the gonads once to go the full nine yards.

3:19:26•Goran Cuk

Andy, Richard, are you guys open with the code direction? Is that an acceptable resolution? No.

3:19:36•Richard Chervony

If we're going to enforce it, we're going to enforce it.

3:19:38•Goran Cuk

But if the special magistrate agrees that they have to, then they get cited daily, right?

3:19:43 – 3:19:57•Andy Daro

I can talk. I can also get on... with the court enforcement, but I have to say I'm a little ignorant on the process. I'm listening to you explaining both roads that could eventually lead to the same solution. I don't understand the timelines really of either.

3:20:00•Goran Cuk

The process... Well, I don't understand either. I don't see why the second option isn't

3:20:04•Richard Chervony

because we're still waiting on the Javits option.

3:20:06 – 3:21:04•Rachel Streitfeld

Yeah, so what happened in the Javits case is that he not only appealed the order of the special magistrate, he appealed the decision of the circuit court, which found in the village's favor. He appealed to the third district court of appeal. So he did his second tier appeal, right? And then he requested oral argument, missed oral argument, got an assessment. That was at the circuit level. That was at the circuit level? Okay, so he's appealed to the third DCA and requested oral argument. So they are very deliberately taking every opportunity that they can to... I mean, I have a sense that they'

3:21:06 – 3:21:39•Doris Acosta

That's what she's saying, that it's the same. We're all back to the same. Oh, right, right, right. I personally think it should be a direct conversation. Yeah, let's start with that. We all have a direct conversation and impose real deadlines. We all here, we've heard them say their reason. Nobody here is a secret what they feel or they don't feel like. They talk like security rules. They don't want to take away their privacy. I think the privacy angle, it's honestly null because to me, that's an agreement that was presented.

3:21:39•Richard Chervony

It's what's in the paper. Correct. But the security, the liability, the cleaning, these are things that if we have them on their side... The paper says you've got to open it.

3:21:47•Doris Acosta

Richard, screaming doesn't change what we're talking about.

3:21:56 – 3:22:21•Doris Acosta

For us to be able to move on, we have to come up with something here. And I truly believe that you need to meet with the residents from 360. Tell them if we don't have an answer by the next meeting. And this is what we want. Not only opening the island walk, but what do you want? Put it in writing. You have a deadline to put it right. If the answer of them is to say, you know what? I don't care if you offer me the sky. The answer is no. Then we can come here and have a real decision. We've made the decision. I haven't.

3:22:27 – 3:22:43•Doris Acosta

I want them to put in writing what they want. I want them to put in writing what they want. For what I've heard from the neighbors. They're divided at 360. They're having a lot of other issues. It's not just the island walk that they're divided by. It's really hard to put all these people together and make a decision, but we need to push it.

3:22:43 – 3:22:55•Goran Cuk

All right, look, we waited this long to get to this point. I don't think delaying it one more month is going to be a big deal. Let's just try and get in front of them, try and get a deadline to open it and see what they say and come back with.

3:22:55 – 3:23:08•Andy Daro

Okay, I would, as of tomorrow, be happy to try to get into... If 360 has monthly meetings, I don't know, but I would like to be before the next commission meeting. Our board doesn't meet every month at my condo.

3:23:09 – 3:23:25•Rachel Streitfeld

No, I don't know. I don't know what their schedule is either. I don't know what their schedule is either. You can try. Look, you've got two votes for litigation. I think two votes for code enforcement. Vote for conversation over here. Well, hold on.

3:23:28 – 3:23:50•Andy Daro

i mean doris richard i could get on board with the code enforcement just because i think it moves it a step in the right direction so then tell so then when you have the discussion you could say no you're at the when you have the discussion with them you could tell them that there are enough votes to move forward with a code violation okay i mean i i uh

3:23:50•Richard Chervony

Don't you have to give them a written notice if there's a code violation?

3:23:55•Rachel Streitfeld

No, of course a code violation has to be properly noticed.

3:23:58•Richard Chervony

Do you have to answer the Hager Law letter by telling them there's a code violation?

3:24:19 – 3:24:32•Andy Daro

Yeah, so let's send an offer that I would be happy, I mean, I will attend. So you can send out the notice and I would attend and in the meantime, be happy to start with the code violation.

3:28:50 – 3:29:13•Richard Chervony

you know code enforcement versus complaint and this conversation will be had for the rest of the remainder of this term every month that we have a commission meeting please put on the next agenda discussion on you're you're probably right commissioner shivoni but we don't have a third for litigation right so it's not going to work so i will bring it back up at

3:29:13 – 3:30:11•Andy Daro

And I appreciate it because I think you are right, but we need a majority. And I do want to say the last part on it is that 360 actually I was at the property this week with a friend. They do have a fence between their Island walk and their property. So it's not even open, right? So, I mean, they have their property privatized on the, on the opposite side of the Island walk, which Moda doesn't even have. So they have the full capability. They already have it with fobs and gates. It exists, uh, to have the Island walk open from both streets, um, and connect, you know, from East drive to West dr

3:30:11 – 3:30:24•Rachel Streitfeld

You cannot, like, I wanted to go over to the 360 for their holiday party, I remember. And I was like, okay, I'll just walk over there. You can't get into the 360 for the sidewalk. It's a fortress.

3:30:30 – 3:30:42•Andy Daro

And there's plants that are on it. That gate is actually there on both sides. One goes into the allot and one the planters roll so you can't even tell it's a gate. They put plants all over the thing.

3:30:42•Richard Chervony

Could you put a deadline on when they must answer that they are going to meet with us? Like give them two weeks? Of course we can.

3:30:50•Andy Daro

We requested 30 days, right? Before the next commission meeting, ideally.

3:30:56•Richard Chervony

Yeah, but I won't leave it open before the next commission meeting. I want to give you the opportunity to have a chat with them.

3:31:06 – 3:31:41•Rachel Streitfeld

The next commission meeting is the third Tuesday. It's June 23rd. It's the fourth Tuesday. Great. It's the fourth Tuesday, right? And Commissioner Acosta is out of town and asked to change it. I don't know that that's feasible at this time. It's already noticed. So what I was going to recommend is that the June commission meeting be must do items only and that most of our stuff be handled in July. I don't think we can change the June commission meeting at this point.

3:31:43•Doris Acosta

I rather than things keep moving. I don't want to be the reason why it's delayed. I thought we could adjust to the June 25th and move that around the budget.

3:31:53 – 3:32:26•Rachel Streitfeld

um i i will not be here on june 25th at all so for the budget meeting no no i'm gonna be at my nephew's high school graduation on june 25th so it's i don't want to delay the I would think that on June 23rd, we should be able to move this forward one way or another.

3:33:03 – 3:33:28•Richard Chervony

i don't want that to stop our progress um so to the extent we can get a meeting with them we'll report back at the june 23rd meeting and then we will now there's several there's several associations or direct uh there are four different associations at 360. there's 360 community association with each one of them for the meeting

3:33:29•Doris Acosta

They should have all of them. The master, the doc one, they have like five.

3:34:07 – 3:34:32•Doris Acosta

would make sense but the master is the one that has the requirement that then extends to everyone i know they got building b and so i think you should if you really want to get an answer you should get an answer from all of them if you if you really want to get to somewhere here because we're going to be back to but why do you know i didn't hear i wasn't part of it the neighbors need to be given the chance I mean, what's the worst? They don't show up. They say they don't want to.

3:34:32 – 3:35:24•Andy Daro

No, I mean, with anybody that wants to have the conversation, the Highland Walk is in the best interest of North Bay Village and keeping it private is only in the best interest of a few. I mean, it's not in the best interest of our community. It's in the select interest in a couple of a few, which isn't even probably even the majority of their building doesn't care. So. we'll take the baby steps i guess so we'll take that step on 360. um but we will have this conversation again next month there are other associations that we need to respond to and follow up with would you like anybody who woul

3:36:12 – 3:37:02•Andy Daro

We'll be at the meetings, hopefully. Hopefully we get the meetings. And you'll send out the notice and let me know. We will coordinate it. The next one I'll take right into with the electric charging stations. I was just currently even considering electric vehicles myself, got the plug-in app. I know we've discussed this before. I saw that we don't have a single public use charger in North Bay Village, except for the two, maybe at Vogel, which get tied up for our community car. I was approached by a company, Chargers To Go, who offered to install the electrical vehicles at zero cost to the vil

3:37:05 – 3:38:01•Andy Daro

It runs a similar thing where they could install the chargers and then give us a minimal profit share to the village. So instead of having, then I was talking with Frank, the logistics of multiple locations, I would... I think there's also a power issue. this is what we were saying so that he's thought that, you know, bringing FPL to it, you know, so it wouldn't be, in my opinion, we're going to have one on treasure Island or one here. I think, you know, the best interest would try to be if you could pick one general location, whether downstairs at the, you know, the building here or at our ne

3:38:01 – 3:38:15•Rachel Streitfeld

Are they installing the, I don't know the difference between level one and level two chargers. One is faster. Are they installing the superchargers where it's like a couple of hours or is it the regular where it's eight hours?

3:38:15•Andy Daro

It was explained to me. I'll try to bring this back or send more information to the commission.

3:38:21 – 3:39:47•Rachel Streitfeld

I support this initiative and moving forward on it. There's a lot of details to work out. One is the power supply for an EV charger requires a significant amount of space for the transformer and for FPL to literally situate the power source for those chargers. So that is a thing that needs to be evaluated. Two is if we're doing superchargers and it's a couple of hours, that's less of a concern. If we only have the basic chargers and it's an eight-hour charge... We need to think through that. I also want to remind everyone and the village manager that there are, I think, 19 EV charging spaces i

3:41:13 – 3:41:27•Andy Daro

Correct. There's a charge. And then the company, at least in this case, they have the model that is they charge you zero dollars to bring the charger in. And then they take like 90 percent of the revenue. I mean, they have different models where you can pay for the charger and get a higher charge.

3:41:27 – 3:42:23•Rachel Streitfeld

i support adding more chargers throughout the village generally speaking and i'm giving you at least my blessing to go forth and get more proposals and figure out more details especially on the power issue but for the logistics of allowing residents to charge evs at village hall I think that we can accomplish this with some very basic governing, right? I mean, this means signage that says you have to be out by 9 a.m. or you're going to be ticketed or towed. You know, we could physically... tow cars away from the EV spaces into some other location so that our staff can park and then charge peop

3:42:49 – 3:43:54•Rachel Streitfeld

Right. So somebody who charges there, you know, the eight people who are charging on Monday are going to be a different eight people than the eight people who charge on Tuesday. Right. I spent a lot of time with our architect and our staff ensuring that there were many EV chargers available to the public so that we could offer this service. A lot of people who don't live in single family homes are would like to have evs but they live in older buildings that don't have the capacity and this is a service that we can provide because it requires us to create procedures and rules and enforcement i'

3:44:17•Rachel Streitfeld

I don't think anyone made that promise. But again, if you're hearing rumors in the community, then notify our communication staff that they need to get a clarification out to the community.

3:44:37•Rachel Streitfeld

Commissioner Darrow, are we good on 14D? Okay. Commissioner Trevone, the next item is yours.

3:44:49 – 3:47:08•Richard Chervony

I want to read a paragraph of the minutes from the last meeting. Action. Commissioner Trevone made a motion to defer the item until August at the latest to research further the financial impact the new resolution or formula will have for property. Commissioner Acosta seconded the motion and added comparable formulas from other municipalities to be added to the research. Upon roll call vote, the motion passed 4-1 with Mayor Streitfeld voting against. Mayor Streitfeld instructed each commission member to email the village manager with research parameters to delegate to the staff. Mayor Streitfel

3:47:33•Richard Chervony

They're closing in June 15 on the property.

3:47:54•Richard Chervony

There's two that have purchased TDRs. That have not submitted plans.

3:48:01 – 3:49:15•Richard Chervony

Related has presented plans. So there's two that have not presented plans, and that's why I'm saying that we should abide by the rules that were established and are still established as of today. One is ASAP, and the other one is Urbanica, who paid the 2.5 or 2.4. And we're very willing in accepting the 2.4 and selling it to them. And then all of a sudden we want to really slam it into them by raising the prices 10 times. That's why I'm saying that's the first step that I want to propose is for those two properties to receive the current setup, the correct The way they purchased the property a

3:49:16 – 3:50:05•Rachel Streitfeld

Yeah, they also have been shot down by the Planning and Zoning Appeals Board of the City of Miami. So that's in flux as well. But I will say, for the property owners who purchase TDRs with the expectation that fees for height would be at a certain level, i can agree with what commissioner trevony is saying in terms of the fees that they bargained for when they invested in the tdrs it should reasonably remain those fees so i would like to make that motion commissioner if i can just clarify a couple points when you say that they've purchased tdrs as of april 30th the one that we just stood they

3:50:10•Richard Chervony

So we will have to end the date to May 19th.

3:50:23•Rachel Streitfeld

I agree with you on that. I'm happy to second that motion.

3:50:26•Richard Chervony

Is there any discussion on that portion? No.

3:50:39 – 3:50:50•Richard Chervony

Gran Vida is going to be presenting a shop. To the extent that they don't. It would apply to them as well. They want to abide by the RM70 rules.

3:50:50 – 3:51:36•Rachel Streitfeld

And let's remember that a SAP does not create height where it does not otherwise exist. It allows existing height to be moved around. And so if they were to acquire... or to want additional height to accomplish their development program they would still have to pay for the height that they want and then move it around in an sap and the rate that they would pay for the height would be the rate that they anticipated when they purchased the tdrs and and as we did with related if they create a park with of x amount of acreage they get a credit on the height payments there was a formula that was cr

3:51:37•Richard Chervony

That's what I'm saying. Basically, we will abide by the rules.

3:51:44•Rachel Streitfeld

I think related paid... I will have to refresh my recollection, but that sounds right.

3:51:52•Richard Chervony

Tony created the formula that we had to give him a credit for the park.

3:53:01 – 3:53:58•Richard Chervony

I came up, we needed to come up with a formula, so I came up with my own version. This is my second version of the formula. The first one was really bad. I'm not saying that this is the right formula, but it's a beginning. If you want, I mean, I don't know how many of you have read it, and if you want to discuss it, we can discuss it. If you want to defer it to a different time to get different formulas, we can. You know, game with whatever you people want to do. Basically, the formula reads the cost of purchasing this bonus site, $10,000 per vertical lineal foot of bonus due within 60 days of

3:54:02 – 3:54:54•Richard Chervony

Pretty much. But only for 72 feet of the bonus that you purchased with TDRs. The second 72 feet of bonus of the TDRs are at $25,000 per linear foot. So basically what I'm doing is I'm enticing them to buy height, but not go all the way up. If you buy TDRs and you're allowed... 144 feet extra the first half at 10,000 a foot and the second half at 25,000 a foot that was my idea to increase the price and have them not go all the way up that's all all it was

3:54:59 – 3:55:18•Rachel Streitfeld

If you purchase the maximum number of TDRs allowed for the project, you're allowed an additional 30% to 312. That's already in our code. Actually, our code just says if you purchase any TDRs. It doesn't have to be the maximum TDRs. If you purchase TDRs, you can go to 312.

3:55:18•Richard Chervony

Well, you have to have the proper height to build with TDRs as well. Why are you going to buy TDRs if you're not going to have the height?

3:55:27 – 3:55:45•Rachel Streitfeld

But that's already in our code that you can go up to 312 if you have TDRs. And so the cost of bonus height charge of $10,000 per linear foot of bonus due within 60 days of site plan approval.

3:55:45 – 3:56:29•Richard Chervony

Or the other option is $25,000 per linear foot for the TDR bonus height. You have a choice. We can increase it. We're charging $10,000 right now in T6 for the extra height, up to three stories, I believe it is. So what I'm doing here is the same $10,000 per linear foot, if you want to do it. If you want to do it, that's $2.4 million. Or the other option is if we're hungry for money, bring it up to $25,000 per linear foot. That's more money.

3:56:30 – 3:56:54•Rachel Streitfeld

I really appreciate that you worked really hard on this. I want to give it more thought on the numbers. This is a solid proposal. It's thoughtful. Thank you. I'm not prepared to approve it tonight, but I would like to take a look at it if you're okay to discuss it in June and hopefully approve it in June.

3:56:55 – 3:57:26•Richard Chervony

We can discuss this in June. I mean, the original motion is bring it back before, no later than August. So we have time for this. But since we wanted a formula to discuss and we didn't want to go, or at least I didn't want to go to 10 times the amount, I said we can either match the T6 or we can increase it a bit to the 25,000 level per linear question. Yeah. ideas one gets by looking at what other city does.

3:57:29•Richard Chervony

So we're deferring option two to the next meeting. Would you put that on the agenda, please? I mean, option two, the second portion.

3:57:54•Richard Chervony

This was done on Tuesday that the agenda came out.

3:58:46•Richard Chervony

That's right. There's no meeting. We're taking August off.

3:58:52•Richard Chervony

We're bringing it back in June, but the original motion was no later than in August, so we have to break it to no later than September.

3:59:02•Richard Chervony

for the new proposed height structure. For the proposed height structure.

3:59:10•Richard Chervony

What am I missing? At the last commission meeting, I understand the motion was no later than in August. Yes. We need to do it in July. If we do it in June or July, even better.

3:59:22•Richard Chervony

But if not, since we don't have a meeting in August, it's no later than September.

3:59:34•Richard Chervony

We resolve it in June, it's resolved in June, it's over.

3:59:46•Richard Chervony

No later than September instead of August, because there's no meeting in August. That was a slip.

3:59:52 – 4:00:48•Richard Chervony

All right. And part three is the TDRs. We have, as of today, Eight TDRs left, of which two are going to Gran Vita. A match of two can go to Gran Vita. If we take too long, so I cannot say one, and then we're short one, where do we get it from? You have to say two. So we really have six. When Tony does his formulation and all this good stuff on Sunbeam and it's official, whatever, whatever. Yeah, we're at about 40. We're going to get approximately 40. Correct. 46. About. So we have 46 CDRs left, and that's it. Correct. We have people that are interested in buying and building in the village. Th

4:00:54 – 4:01:13•Richard Chervony

This is like a fire sale. This is all that's left. Once this is over, it's over. We can't make it up unless we buy property and we have a high. You need some time to digest this also and bring it back next month?

4:01:18•Richard Chervony

So we'll defer it for June as well. Give him some time to digest.

4:01:28 – 4:03:31•Rachel Streitfeld

I will say that... 6.9 million. I will say that I generally have a little bit of hesitation assigning... dollar amounts and values to air rights and density. I know that this is the way that we have done it and the way that we have been doing it. But what I liked about the Miami Economic Associates was that it was a formula based on the value of the land. And I know that we obviously really got into this at the last meeting on the formula. But one of the biggest reasons why the L-ADD cost of height was so significant if we had applied the formula was because they bought a property that had rec

4:03:32•Richard Chervony

We should actually say that once you sell the property, all these entitlements come back to the village.

4:03:40 – 4:04:31•Rachel Streitfeld

But that's not how that works. The whole reason it's called entitlements is that once the commission approves the site plan or approves the density or approves the development agreement, whatever it is, the property is now entitled with those approvals. Now, The approvals can disappear and we can, Heidi, we can be specific in our development approvals and our development agreements and in our resolutions that the entitlements disappear after a certain time. Can we not? If someone doesn't submit a building permit application within 365 days or two years or whatever, they can lose that site plan

4:04:31 – 4:04:49•Richard Chervony

We do that. This is something that we really explore before we even go into these two sections in June to see if we want to do that. And then we know that, hey, you're paying this price, but you have to do it within this time frame.

4:05:00 – 4:05:11•Rachel Streitfeld

Mm-hmm. I don't think we have the ability to do that. You can't get around state law on that. We don't even have the right to confirm how much time they have to toll.

4:05:17 – 4:06:20•Rachel Streitfeld

Let's talk about it. Let's explore that. I think if the idea is because state law provides that if there is a state of emergency, which there is every year during hurricane season, if the governor declares a state of emergency that affects your county municipality or a radius of municipalities, Your approval is told. So if you had a building permit that was going to expire in six months, now your building permit doesn't expire until the emergency order is lifted and you get another couple of months after that and you can extend and extend and extend your deadlines. I've seen site plans that we

4:06:20 – 4:06:31•Richard Chervony

Well, this is something that we should explore and discuss before we take a vote on these two items as to the new hype. cost and the new TDR costs.

4:06:40 – 4:06:55•Richard Chervony

I understand. But it's something interesting. If we can get projects built faster or quicker, you know, you have to balance them out.

4:06:55 – 4:08:04•Rachel Streitfeld

So, so I, I, exactly. I agree with you. We all want to see projects up and Craig, this is no shade to you at all. But when we initially conceived of, I almost just said Miami 21 and I hate that for me. But when we initially conceived of NBD 100, we were trying to incentivize developers to come in, get their site plans, and break ground. And we did not accomplish that through what we ultimately approved in NBD 100. And I don't know how we missed that. I was a freshman commissioner at the time. I wish that I had pushed more. I wish that I had questioned more. I remember in those public meetings

4:08:05 – 4:08:27•Doris Acosta

And that was the question I had all along through the planning and zoning. And I was very much against all of that exactly for that reason. And that's why I was kind of kicked out of planning and zoning for voicing exactly those questions. And those values went up for the people who flipped the properties or increased their value of the property overnight because of the code changes.

4:08:28•Richard Chervony

But being fair to Andy, he's been very good to us.

4:08:32 – 4:09:29•Rachel Streitfeld

This is not about Sunbeam. But it's about the fact that we as policymakers, it's our job to set forth what we want our code to do. Now, we're really fortunate. We have a lot of professional experts and really smart people on this dais. But it is our staff. who are supposed to take those policy ideas and convert them into regulatory frameworks that work and make sense and that achieve those policy objectives. And I just think we've really missed the mark on the T6 regulations and the bonus incentives. We didn't do it the right way because we're not, I mean, look, thank God we have cranes going

4:09:33 – 4:09:58•Richard Chervony

The thing that I'm looking at also is I know for a fact that As most of you here know for a fact, there's certain properties that are still being looked at and negotiated on. And they're going to be coming up in front of us sooner rather than later. And I want to be ahead of the game by having whatever figures we decide on sooner rather than later.

4:09:59 – 4:10:13•Rachel Streitfeld

So we want to amend our fees, but we also want to take a closer look at the language and how actual building permits are incentivized and sitting on an entitlement or flipping an entitlement is disincentivized.

4:10:21•Rachel Streitfeld

So let's take items two and three for discussion again in June.

4:10:25•Richard Chervony

Sure. Um, we may not come to solution in June and defer it against the July, but at least keep it alive.

4:10:32 – 4:10:55•Rachel Streitfeld

Yeah. And I would like the commission to agree to provide direction to the village attorney and the village planner to do a review of how the code actually operates in terms of these, you know, milestone timelines and provide recommendations for how we might strengthen the code to achieve our stated objectives.

4:11:00•Rachel Streitfeld

Can I, I'm, I'm, you know, that's, I'm moving that specific direction. Are you seconding my motion? Madam Clerk, can you call the roll on that motion?

4:11:21•Rachel Streitfeld

Commissioner Trevone, you want to talk about RM40? Yep. Okay.

4:11:25 – 4:11:38•Richard Chervony

Okay. RM40 is strictly inside Treasure Island. Mm-hmm. Except for the place across the street from you. I don't even know the name of it anymore. The behind-the-scenes station. Most of the buildings are old.

4:11:39 – 4:12:31•Richard Chervony

Most of the buildings are old on RM40. Mm-hmm. Some of them may have difficulty in the near future passing their 40-year, 50-year, 60-year inspections. RM40 is the only thing that we have not evaluated in our rezoning of RS1, RS2, T6 district, T630 and 24, and RM70. Mm-hmm. So I want to agree that we're going to give the direction to planning. First, since you're relatively new, take a look at what RM40 is here, what suggestions he can bring forward, host the town halls that are needed for RM40, and progress from there. See what changes we need to make to the RM40s.

4:12:31 – 4:13:34•Rachel Streitfeld

So I'm going to object to this on two grounds. One is a strictly practical ground, which is that the state has prohibited us from passing and enforcing any land development regulation or amendment to our comprehensive plan that would be more burdensome or restrictive on property owners. And that would include revising the RM 40 zoning regulations. We cannot make changes to our code until the SB 180 preemption lapses. Because any changes that we make to RM 40 could be perceived as being overly burdensome or restrictive. And anyone can file a lawsuit against us to challenge those regulations. Yo

4:15:56•Richard Chervony

So we need to speak to our representative to change it for the next legislative session.

4:16:01 – 4:16:59•Rachel Streitfeld

So this is something I actually lobbied on pretty aggressively when I was in Tallahassee. It's something that I've been following very closely. Fabian knows how I feel about it. In fact, the night before the House voted on the UDB bill, Fabian and I were on the phone drafting alternatives that would relieve SB 180. So he knows how we feel about this. And the 10 or so members of the House of Representatives also know how we feel about this. And Toby, not Toby Overdorf, but Nick Deseglia did have a glitch bill. He was the sponsor of SB 180 in its original passage. He brought a glitch bill and it

4:16:59•Doris Acosta

Are you pro-changing it so that they can change RM40 regulations, or you're against it so that RM40 doesn't get used?

4:17:07 – 4:19:53•Rachel Streitfeld

So hang on a second. Let me answer the question. SB 180 preempts us. It restricts us. We cannot improve anything. So I am opposed to SB 180. We want that preemption lifted. We want to be able to regulate land development and amend our comprehensive plan. We cannot do anything to improve our flood risk while this bill is in effect. Even though the state wants us to improve our flood risk, we cannot make the amendments to our code that would improve our flood resilience even if it changes the rm40 area rm40 is a different issue and i'm about to get to the second part of my comments in terms of t

4:19:56 – 4:20:16•Richard Chervony

I understand what you're saying, and I'm not saying that I'm changing density or height under the RM-40, but let's be realistic. The whole north side of North Treasure Drive was RM-40. The only thing that's left there is debris.

4:20:18•Rachel Streitfeld

The KLA. And the Treasure Island Care Center.

4:20:25 – 4:20:45•Richard Chervony

Townhomes in the corner. They're not even townhomes. They're a little park, whatever you call those. It's one story. We have devastated that whole We didn't, though. Some people bought all the properties on 40 and destroyed them.

4:20:48•Richard Chervony

Those were on 40, the two buildings that he bought and he gave us?

4:20:50 – 4:22:07•Rachel Streitfeld

Yeah, but that's it. I mean, that one acre is bookended by a thriving condominium association. 1555 is locked in. They're good. They're in the black. They've been maintaining their building. They're stabilized. They've got it. updated i mean they're good kla is kla i don't know what to do about the treasure island care center i mean that's just a mess of a parcel and then when you come down and you're around galleon street along south treasure drive these are again stabilized older condo associations that we should be helping those people stay in their homes it's architecture that we don't hav

4:22:08 – 4:22:33•Richard Chervony

residents who are living in older units are fielding calls from brokers you know multiple times a day but you have to also realize that anybody that is fielding these calls because i get them at my house anyway uh they were started by somebody that didn't want to get out of their property and make a relatively decent amount of money in comparison to what they paid for

4:22:34 – 4:22:58•Rachel Streitfeld

for instance not really no yeah absolutely commissioner i just just i don't want actions by this commission to further destabilize an area of the city that is is already sort of reeling from developer interest in their in their corner of the island um i will accept your sb 180 uh

4:23:00 – 4:23:28•Richard Chervony

excuse once that is eliminated i will be bringing back arm 40 for review and there is town halls and there's residents who want to talk about it i i'm happy for us to entertain that when it's appropriate to do so okay i mean your first excuse is very valid 14g is a discussion on the proposed agreement and amendment to the agreement with the treasure island care center frank

4:26:45 – 4:30:14•Doris Acosta

I'm very pleased for the option with the parking. I'm a little concerned about people moving now into our streets to park there. But nevertheless, I mentioned before how my number one concern, obviously, is the pedestrian access to the park. So I have a couple of options here, if you don't mind passing those along. Thank you, my lord. It's not a perfect drawing here, but I think it gives an idea of what I mentioned, which is I went up to the area, measured, looked at what it is there now. Removing those four parking spaces will be, of course, ideal. The first option, the first... I'm so sorry.

4:30:14 – 4:31:47•Rachel Streitfeld

this area right here it's a broken chain link fence it should be removed and just used as with a buffer of the sidewalk and plantings in between that so i don't know if you have questions from that so this is really great thank you for working on this thank you for bringing it the point about um people walking behind park cars to get to a park is a really big problem i want to go ahead and move to approve the manager's amendment with the Treasure Island Care Center so that we can keep this moving, amend our agreement, lock in the use of the parking lot. So that's going to be my first motion is

4:31:51 – 4:32:10•Rachel Streitfeld

Does anyone have any thoughts or objections or questions on my two motions? I will second both. second to the first motion both both yes okay okay well let's take the first one does anyone have any objections to approving the village manager's recommended amendment amendment Okay, Madam Clerk, call the roll on that.

4:32:20 – 4:32:52•Rachel Streitfeld

And on the second motion to direct staff to explore Commissioner Acosta's options and to come back to us relatively quickly in terms of what's feasible. And I'm not going to ask you on the day who's going to pay for this, but it's really exciting that you've Explored the option of funding, so I, the motion is to explore this and in some way, shape or form, move it forward. Seconded by commissioner Costa, any discussion please call the roll.

4:33:00 – 4:33:50•Rachel Streitfeld

14 ages discussion and appointment to the sustainability and resilience task force. So we got three applications to the SRTF. Neil Krasner has resigned, by the way. Look, guys, obviously we have elections in November, and we're going to be appointing new board members across the board. But for now, we have a vacancy on SRTF. Three applicants, Jessica, Sylvia, and Michelle. I will just say that Jessica is a new name and I see that she's already been really active in organizing cleanups around Treasure Island. And so I'm going to nominate Jessica Alessio to the Sustainability and Resilience Task

4:33:50•Richard Chervony

I was going to say Sylvia, but I have to tell the dog at that point.

4:34:15 – 4:34:37•Rachel Streitfeld

June is complicated and I am really sorry. Yeah. I'm really sorry about about your conflict book. I don't know. Yeah, we can't move the June meeting. Unless we can.

4:34:40 – 4:35:03•Doris Acosta

My hope was going to be to not make it too much farther away. If we can just, within the next two weeks, which will be the next, when is the July meeting? Because it's almost at the end of the month, isn't it? So we... July 28th. I don't want to cause a delay on things either.

4:35:03•Rachel Streitfeld

What if we did the commission meeting in June on Monday, June 29th?

4:35:14•Richard Chervony

Right now I have no idea whether I want to be in town or not.

4:35:33 – 4:35:54•Rachel Streitfeld

Yeah, look, the budget workshop... I feel really... you know, badly about the budget workshop. Let's deal with the commission meeting first. Can you guys do the 29th, Monday the 29th? I can, definitely. Andy? I'll be back. Thank you.

4:35:54•Goran Cuk

You don't know? 29th, it should be fine. All right.

4:36:03•Doris Acosta

Thank you so much. I really appreciate it.

4:36:05•Rachel Streitfeld

We're going to do the June meeting on Monday the 29th.

4:36:08•Doris Acosta

Very great. Thank you. Thank you. Thank you.

4:36:11 – 4:36:51•Rachel Streitfeld

The budget workshop. I had planned to be here for the budget workshop on Thursday, June 25. And then I tried to book flights to be in the Hudson Valley for my nephew's graduation from high school and I couldn't get a flight on Friday so I'm leaving on Thursday. I'm going to be in New York with my family. I would prefer not to be running a budget workshop from Zoom in New York. Will I do it if I have to? Yes, I will. But we also don't have to do the budget workshop that day. So this is our first budget workshop, right?

4:37:05 – 4:37:51•Richard Chervony

I know things come up totally unplanned, but we choose dates early on in the year. And because a wedding, your nephew's graduation, whatever, vacation plans, we cannot be changing our schedule so frequently. People are used to us meeting a certain date. We have published those dates. You know, we have to keep track. Not only that, now, Our village clerk has to go back and see who has a meeting and that day that's a major conflict for us so we cannot hold it, whether it's the school board, the county, whatever. We can't be changing like that.

4:37:53 – 4:38:33•Rachel Streitfeld

I don't think school board or county meetings are an issue for us and I appreciate, Commissioner, that there is a consistency and a reliability and I wouldn't I obviously wouldn't ask to change a commission meeting unless it was to accommodate something that was really important. Like I said, I will run the budget workshop. I will either run the budget workshop from Zoom or decide that my time with my family in that particular moment is more important and the vice mayor can run the budget workshop. And I will put in my budget request with the village manager separately. I mean, that's just goi

4:38:33•Goran Cuk

Sorry, what is the budget workshop again?

4:38:53 – 4:39:16•Rachel Streitfeld

We don't have to do the budget workshop until July. We don't have to do it that week. We also have a new finance director starting. Maybe giving that person an extra week might be helpful.

4:39:19•Doris Acosta

I agree with that. I'm okay with that. We can always have preliminary numbers.

4:39:24•Richard Chervony

The finance director is already working on the budget, but that's besides the point.

4:39:44•Rachel Streitfeld

A budget workshop could be during the day if we wanted it to be, yes.

4:39:50•Doris Acosta

How would that affect? We've actually held it on Zoom.

4:39:56 – 4:40:16•Doris Acosta

Yeah, but the point is she wants to be here too. So if you leave the 24th, you say you're leaving the 24th. Yeah, I'm not. I mean, I could do a Zoom if you want to be in person on the 24th. Or even the 23rd, switch those, you know. Because I mean, you're the mayor.

4:40:21•Rachel Streitfeld

How do you feel about this? Because you're going to, if I'm, if I bow out on the 25th, you're doing it.

4:40:27•Doris Acosta

Why don't you do it on the 23rd then? Like instead of the commission meeting.

4:40:34•Doris Acosta

No, but then we're back to square one here.

4:40:40 – 4:40:51•Rachel Streitfeld

The whole thing could be on Zoom. I can do it. Let's keep the budget workshop on the 25th. The budget workshop is scheduled for the 25th.

4:41:05•Doris Acosta

I don't mind in person because to me, it's always in a whole fashion. I just need direction. Hybrid.

4:41:15•Doris Acosta

If somebody wants to come in, they can come in.
