0:02 – 0:21•Christi Fraga

Good morning, everyone. Welcome to our October council meeting. Today is the 8th of October. The time is now 10.09 a.m. I hereby call this meeting to order. A reminder to please silence your phones and keep a respectful atmosphere as we conduct our meeting. Madam Clerk, please call the roll.

0:31•Christi Fraga

Thank you very much. Please rise for the Pledge of Allegiance led by Councilman Cabral.

0:55•Christi Fraga

Okay, we will now have our invocation, and today the invocation will be led by Pastor Miguel Menendez from Presencia Viva. Thank you for being here.

1:42 – 1:54•Christi Fraga

Amen. Thank you. Thank you. All right, we'll now move into our agenda order of business. Starting with the City Manager's Office, do we have anything to add or delete?

1:59•Christi Fraga

Thank you very much. Council Member Pinedo?

2:03 – 2:34•Maureen Porras

Vice Mayor Porras? Yes. I have a lay down item. Connie, if you can pass it around. It is a donation to Due to Arts. And I would like to take this up first, because based on this, I'm going to determine my poll items as well. You guys have the donation under the memo, the nonprofit letter. And again, this is under the sponsorship ordinance. And with that, I'll make a motion to accept as a lay down item.

2:35 – 3:28•Christi Fraga

OK, there's a motion on the table to lay down this item. A reminder of our charter and our code. Per the city charter, we do have a requirement to notify and to place items on the agenda by a certain time period. Otherwise, a lay down item requires for fifth vote of the council. Additionally, the section of our code that provides for how items will be placed on the agenda, requires that any item with a fiscal impact be done two weeks prior to the council meeting so that staff has an opportunity to review all the documents and make sure that, in this case, the recipient of the sponsorship funds

3:29 – 3:40•Christi Fraga

There's a second on the table. To help someone, yes. Is there any additional comments? Okay, being none, Madam Clerk.

3:51 – 4:02•Christi Fraga

Okay, just a reminder that this item can come back next month with the proper notification of time so that everyone is informed. All right, any other items that you'd like to pull?

4:21 – 4:34•Maureen Porras

For discussion, yes. And I'll be deferring 9B, since I believe we're going to have a conversation next week about property taxes, right?

4:34•Christi Fraga

We will be having our legislative workshop.

4:37•Maureen Porras

Yes. I had a great meeting with legislators this week, so I think it'll be a call for a better discussion next week for this item, so I'm going to defer it for now. So,

4:49 – 5:10•Christi Fraga

I'm not going to be supportive of deferring it again. We are going to have a legislative workshop where we'll have a discussion, and then I'll be bringing an item forward in November based on that workshop that all of us will vote on for a cohesive, unified voice to the state about what our legislative priorities are. So you can bring that to the workshop, but we're not going to defer this to November. Or at least I will not be supportive of that.

5:10•Maureen Porras

So you're keeping it in discussion is what you're saying?

5:12•Christi Fraga

You could pull it, but I won't be supportive of a deferral.

5:15•Maureen Porras

OK. Well, it stays in discussion then. That's fine. I'm OK with that.

5:22•Christi Fraga

All right, anything else? Nope. Okay, just six out. All right, Councilwoman Reynoso? No, Mayor, thank you. Thank you. Councilwoman Cabral?

5:31 – 7:17•Christi Fraga

All right, Madam City Clerk? Nothing. All right, I have nothing as well, so we will now move into our public comments. We will now open the fourth floor for public comments. Each speaker will have three minutes to speak and address any item on this agenda or any other matter related to the city of Doral. Please begin by stating your name and address for the record and ensure that you are registered with the city clerk once you speak before or after. We will first hear from those who have pre-registered. To my understanding, there is none at this time, followed by any walk-in speakers who would

7:21•Christi Fraga

Second by Councilman Pinedo. All in favor say aye. Aye. Madam Clerk, let the record reflect the minutes have passed unanimously. We will now go into the next item.

9:08•Christi Fraga

VANESSA BASAYO. Of course. Welcome. Thank you for joining us, and congratulations.

9:28•Christi Fraga

Thank you. Thank you. Thank you very much. Do you guys still have the warm chocolate chip cookies? Yes. We do. Should have brought us some. Just kidding. Coming up for a picture.

10:37 – 10:53•Christi Fraga

All right. All right, we move on to our discussion items.

11:06 – 12:21•Christi Fraga

All right, my dear colleagues, as you saw on the agenda, I provided a memo. As our amphitheater starts to kick off and in review of some of our code and policies, which I've been doing, it came across the ticket policy, which had been approved, I believe, in 2014. Unfortunately, the policy was not being followed really by any previous administrations or ourselves. So it was very complex, long, and really unnecessary on how much it required of us. So we decided to come up with a new ticket policy. of which I believe is much more straightforward and understanding. There is no ambiguity as to how

12:22•Christi Fraga

Second by Councilman Pinedo. If there's no additional comments, Madam Clerk, please call.

12:39•Christi Fraga

All right. Thank you very much. We'll move on to the next item.

12:58 – 13:28•Christi Fraga

OK, Councilwoman Porras, again, we will be having a legislative workshop on October 16 at 530, of which there has been an agenda prepared. And all council members are encouraged to bring their items that we will transmit to Tallahassee as a unified voice and body. And so we can either take this up at the workshop, of which is one of the top priorities we'll be discussing, or you can go ahead and mention now what you like, and then we'll move forward.

13:28•Maureen Porras

Yeah, I think that's fine. We can take it up at the workshop. Perfect. All right.

13:44•Nicole Reinoso

Thank you, Mayor. I believe through the city manager's office there's an update.

15:34 – 15:57•Nicole Reinoso

Thank you. I just have some comments. So I'm extremely excited about reaching this point. I think this is an excellent opportunity for our community. And just to be able to gather as neighbors on a Saturday coming now in January is going to be great. So thank you for all the effort, all of your department through the city manager's office as well, that this is actually coming to fruition. So I am excited. Thank you again.

16:23 – 16:35•Nicole Reinoso

And please, the only thing that I ask for is a few weeks before, I know with the holidays and everything else that we're promoting, that we start promoting this a little bit earlier, like a save the date or something. Absolutely. That we can really kick this off in the community.

16:39•Christi Fraga

All right. Thank you very much. Super excited for this. Love it. I have a couple questions. Oh, yes. Go ahead, Vice Mayor Porras.

16:46•Maureen Porras

I think that the city used to do a farmer's market, right? Or used to have one? No, we had a private one. Or someone held one?

16:53•Christi Fraga

Yes, we did one on the property where the McDonald's is on 97th Avenue and 41st Street with the Pascal family on their property for a couple of, for like two years. Okay.

17:04•Maureen Porras

And that was in the city held. Okay. What are the costs for the, you know, the vendor contractor that we're hiring to do this?

17:27•Maureen Porras

Every Saturday? Every Saturday. Every Saturday.

17:33 – 17:45•Christi Fraga

All right. Any additional questions? All right. Being none, I don't think we need any motion or anything. Congratulations, guys. I'm really looking forward to this. Council Member Reynoso, great item. All right. Moving on. Next item.

17:55 – 20:11•Rafael Pineyro

Thank you, Mayor. In response to increased community engagement and the growing presence of escape users, including skate clubs, inline skating races, and professional skaters on city streets and public rides right away, there is a demonstrated need for a comprehensive policy framework that ensures both public safety and equitable access for this user group. The reason of this discussion is to certainly request to our city attorney and city manager to see if we can initiate some type of joint review of the city's existing municipal status concerning to skaters. We've certainly one of the follo

20:13•Christi Fraga

Any comments from the administration, I believe, on this?

20:29•Christi Fraga

I think Council Member Reynoso has a comment. Yes.

20:32 – 21:06•Nicole Reinoso

So my comment is that this item is extremely important and I'm so glad that my colleague brought it up and has continued to be so persistent in making sure this is followed through and implemented. At the end of the day, this is really for the safety of our children. There is a need to protect that population within our city. There is a safety that we need to provide and educate for this type of mobility, for lack of a better word. And I think it's a great item that should be implemented within our city so we can protect our children. So thank you. Thank you.

21:07 – 21:21•Christi Fraga

All right, thank you very much. Any other additional comments? All right, we'll see something come back in November then that can be implemented into the code for additional measures. Thank you very much on that item. We'll move on. Do we need a motion or anything? I don't think so, right? Okay, we'll move on to 9E.

21:29 – 24:40•Maureen Porras

Thank you. So this discussion regards the naming or co-designation of a street after the late Osvaldo Muñoz, which I think everyone here knew. He was a great community leader, a key figure in the history of the Venezuelan diaspora in the US, and tragically he, and sadly, he passed away on July 25th of this year after a long battle with cancer. I know that many of us have had different interactions with him. And he was just someone that was very, very supportive of everything that the city was doing. And Mr. Muñoz was actually the founder, for those of you that were not familiar with him. He wa

24:41•Christi Fraga

Thank you, Vice Mayor Porras. So I think there may be comments. Is there any comments? I do have a comment. Councilor Moreno.

24:49•Nicole Reinoso

It's more like a question. Has an application been filed for naming the street?

24:54 – 25:12•Maureen Porras

No, no. This would be a discussion. And then if you all agree to have the city manager and attorney kind of look into the process. To look into the process and see if, one, if it's feasible, what the costs are, and if it's something that can be done. So.

25:14 – 25:47•Nicole Reinoso

The reason why I asked if an application has been filed is because an application should be filed first, and this council discussion should come afterwards. So there's already a procedure for naming, renaming, co-designating a street. And that's in our code, and that's Section 38-61. So if we can follow what has already been designated for us as a method of naming a street, then I can entertain a discussion. But this shouldn't have been the order of how this item should have been brought to the council.

25:49•Maureen Porras

Okay. Any additional comments you'd like to address? You can all comment and I can follow up.

25:53 – 27:04•Christi Fraga

Yeah. So same. I actually went through this process with Max Salvador Way and his family. Is there anybody here from O Faltos Millos representative also? Or is it just you bringing this up? No, just me. OK. So I went through this process with Max Salvador, who was a founder, a true founder of our city. And when he passed and we did the code designation of the street, I did it with the family. We did the application process, went to Public Works, found the street, got the signatures. It's all designated in the code, the process. So I think it's unfair to put the burden on our staff. There is a

27:06 – 27:50•Christi Fraga

So I don't know if you want to write it down or it's section. 38-61 procedures for naming and renaming or co-designating. If you want, we can have it sent to your office so that you can follow that and then work with the family or anyone who would like to support it because you're going to have to get signatures from everyone who abuts that street. All the property owners have to sign off. It's not just the city move forward and do it. I went through it with Max Salvador and his family, and we were able to accomplish it. So I look forward to seeing it come back and that we're able to do this f All right. No, that's fine. Perfect. Thank you. Okay, we'll go ahead and move forward with that. All right, thank you very much. We move on to the next item.

27:59 – 28:24•Christi Fraga

Okay. This is just our advisory boards. I believe there was a couple left with the new process. I think most of them are already meeting and have met quorum. I just need a motion. Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Reynoso. Madam Clerk? All in favor say aye. Aye. Aye. All right. The motion has passed unanimously. All right. We will now go into the item that was pulled, which was item 6M.

28:55 – 30:30•Maureen Porras

Okay, so I wanted to put on record the process for this, right? Obviously, this is not the first time that we submit items for donations through the donation ordinance or the sponsorship ordinance. And this one I submitted, I believe at least within the deadline. And after I realized that I had left out an organization, a couple hours after I submitted it, past, let's say, three, four, I don't know, five hours after the deadline, I resubmitted the memo that included the additional funding that was $2,000, which I brought today as a lay down item, which failed. So I know that the excuse was tha

31:04 – 31:29•Maureen Porras

Yeah, and so just to confirm, again, this was A memo that had been submitted already with all of the financial impacts to all of the organizations and a revision to add an additional organization with $2,000 was rejected because the change was a substantial amount. So I just want to make sure that it's on the record. Thank you.

31:31 – 31:59•Nicole Reinoso

Yes, I have a comment. My question is, for donations, what is the maximum amount we can donate to an organization? I have to review the box. Yes. I'm sorry. It's OK. Through the mayor. What is the maximum amount through our offices that we can donate to an organization? What is it now? I would have to look at the code. It's $5,000.

32:03 – 32:20•Nicole Reinoso

OK. So to me, substantial would not mean, I have to do my math here, $2,000. I have finance here. So $2,000 out of $5,000 is 20%?

32:23 – 33:21•Nicole Reinoso

Yeah, I studied law. I didn't study math. So that's not substantial. When you're considering the scope, the limitation of what you're applying the amount to. When we're talking about bigger things, let's say salaries, capital improvement projects, whatever it may be, $2,000 may not be that substantial in that course. So I think we have to be very careful with how we present our information and make sure it's just fitting into the subject matter and what we're trying to explain. Because when the max amount is $5,000, $2,000 is not substantial when that is our max. And I want to also tell you th

33:24 – 33:41•Nicole Reinoso

I know when I started, the timing of my item was a very, very hot topic. So I think we're just trying to be straight across the board as to what's accepted and what's not and when, especially when it has to do with just the timing offset that we have for this rule of when items are submitted or not.

33:48 – 34:01•Christi Fraga

So are you? I'm done. OK, thank you. So for me, I think that, first of all, Madam City Manager, have you rejected other members' items minutes after the 10 AM deadline?

34:09 – 36:14•Christi Fraga

Yes. So we have rules. We have policies. We have a code that we follow. And the purpose for having these procedures is because there's a lot of work that comes through the desk of most of our directors and our manager. And for us to all be prepared and make sure that the procedures are followed and that items are vetted, especially when they have to do with taxpayer money, whether it's $500, $2,000, $5,000, or a million, it has to go through the right process. We have to make sure that the organization receiving the funds have their licenses, they're not in violation. It's a process that exist

36:14 – 37:45•Maureen Porras

OK, I have some follow-ups. So to Council Member Reynoso, I'm not sure if you understood what I said, but I think you proved my point that 2,000 is not a substantial amount. But anyway, regardless, I wanted to make sure that we had on record that editing an item that was already on the agenda by $2,000 was substantial enough to reject it, which is the first thing. Secondly, we have rules, but we also have exceptions, right? And that is why a laid down item exception exists, which is what I used today, which is what many of you have brought up on the dais and I have supported. So it's very disa

37:46 – 38:49•Christi Fraga

Thank you. Okay, just final comment, because again, I just want to make sure that No one here is trying to play a victim card. We need to be consistent with each other and hold ourselves accountable, because who else holds us accountable than ourselves to the public? So section 4.10 of the city council agendas, section E, which talks about lay downs. The city council shall not consider items that are presented by the city council member at a regular meeting that are not submitted pursuant to this section. There shall be an exemption for city council items that are found to be an emergency by a

38:51 – 39:34•Maureen Porras

So we have approved lay down items that are not emergencies. If you want to start justifying those, then we can go all day, seriously. But I'm letting you all know that I have been very supportive of lay down items because I understand the the complexity with deadlines. And I understand that we need to get these things done. But again, you all have the right to reject it, which you did. And I'm simply putting on the record that a $2,000 change to an item that already existed is substantial enough to reject it. And that's it. With that, I will make a motion to approve.

39:34 – 39:47•Christi Fraga

OK, motion to approve item 6M by Councilwoman, I'm sorry, by Vice Mayor Porras. If there's no additional comments, we need a second. Second. Second by Councilwoman Cabral. Madam Clerk, please call the roll.

39:59•Christi Fraga

Okay. We'll move on now to, I believe we're already on reports, correct? Mayor's report.

40:07 – 43:41•Christi Fraga

All right. So for this month, first, as you may notice, we're mostly all wearing pink. This is in recognition of Breast Cancer Awareness Month. So obviously bringing light to a disease that has taken many and that has advanced tremendously when caught early. So we want to encourage women to get tested. I know, Councilman Pinedo, this is a very close item to your heart, as we all loved your mom very much. And she lost her battle to cancer. So I just wanted to bring recognition to Breast Cancer Awareness Month. And if you'd like to say anything, you're more than welcome to, of course. And then o

43:42•Digna Cabral

Councilman Pinero, did you want to say something about breast cancer awareness?

43:45 – 45:39•Rafael Pineyro

Thank you, Mayor. I just want to thank you for actually making the comment. And yes, as you all know, my mom passed away last year due to cancer. And she actually was a breast cancer survivor for about 20, almost 20 years before I actually got cancer. and had lung cancer. So I just want to thank everyone that is out there helping others, raising money for families. Sometimes families, we have to keep in mind, sometimes families, they don't have not only the resources, but sometimes they don't even have health care insurance. So we're grateful and blessed that there are organizations out there

45:39•Christi Fraga

Thank you, Councilman. All right, I believe we actually have an advisory board report from our Military Affairs Advisory Board.

49:36 – 52:15•Christi Fraga

Thank you, Bill. I just have a couple of comments. And I did speak to Bill previously, and I spoke to some of the other board members to let them know. I have no issue with the $5,000 for the Veterans Family Day. I actually would love for this to become an event that we do every year so you don't have to come and ask every year. It should be budgeted for to the board. I know you guys have really taken and spearheaded this, and I want to recognize other veterans in the room. Peter Spinoza, who's a veteran who does the Veterans Breakfast with you and VetInfo. Alex, too. Thank you very much for e

52:46 – 53:11•Christi Fraga

You are, I would say, I dare to say, our most active board. Yes, Connie? Yep. So we very much appreciate what you're doing. We know it's such an important role that is played within our community, being that we are home to South Com. So I'm very appreciative, not only of the service that you all have given to our country, but the service you give to our city as well, after and making sure that veterans are taken care of. So God bless you. Thank you very much, Bill.

53:14•Christi Fraga

All right. Thank you very much. So do you need a motion for the $5,000?

53:25 – 53:56•Christi Fraga

Yes. However, I do want the board to stay involved. I want this to be their event. So I don't want us to take it over completely. They should be their responsibility. And I think it shows a sense of involvement, encouragement. They go out and get sponsors. I don't want to take that away from them. But I do want to make it a signature that you don't have to come and ask us for the $5,000 every year. You know that it's there. Let's coordinate it and make sure that there's a reserve date for the park. Everything that they do, but don't take it away from them from organizing it. I think it gives t

53:59•Christi Fraga

Anything else? All right. Let's move on. Madam City Manager's report.

56:05 – 56:16•Christi Fraga

Why don't we go down? So the department that's, I believe his department is here too. We can all do a picture. Before we do that, does that conclude your comments, Frank? You're not going to say anything? Come on. You're always so loud over there.

1:00:16 – 1:01:30•Christi Fraga

Edgar, I want to give an opportunity to the council members to wish you the best, but I'm going to usually wait to speak last. But I do want to say I've known you also now for about 14 years. And when Zeta told me that you were leaving, it was really tough because I think that it's a very unique experience. job that you do. And there's a certain temperament that it needs to come with. And I just want to thank you for your professionalism, even in moments where I know we've wanted to, you want to yell through the screen at emails that you get that may be very frustrating because people don't un

1:01:31 – 1:02:03•Christi Fraga

So he answered on Monday. And he's like, I'm sorry I didn't see this, but we'll take care of it. And I said, you're not going to have those weekends off at your new place. So I hope you enjoyed it because there's no weekends off there. I know. But we're very, very proud of you. And happy for you and your family. we know that the challenge is something you're up to taking. So congratulations. We will miss you. I'm sure your department will miss you. And we look forward to your future successes. And as I said, this is not goodbye. Hopefully it's a see you later.

1:02:06 – 1:03:05•Maureen Porras

I just want to say something real quick. I was also very sad to hear of you leaving. But it's a great opportunity. And I think that When we care about people, we're happy for that. So I'm extremely happy for you, for your family. You're a true professional. Honestly, I know we have great, great departments, and we have the best departments in all of the county, yours included. And you have great staff. You were always responsive. Your team is very professional and responsive. And we're definitely going to miss that. I'm sure that whoever's also coming in will do the same. And they've definitel

1:03:05 – 1:04:35•Rafael Pineyro

Thank you Thank you mayor Well, I I also had the chance to I met Edgar about ten years ago now when I actually started working here as well and and let me tell you for the same person that I met ten years ago is the same person that we have in front of us and Always very responsible, very likable. I never actually saw you with a bad face or bad attitude, regardless of the moment. So I want to congratulate you for that. I know you will do great. We're all going to miss you here, that's for sure. But as you heard from the city manager, from the mayor, you never know. It's part of life. Life is a

1:04:36 – 1:05:18•Nicole Reinoso

around anyway so thank you thank you appreciate it thank you yes so i've also seen you develop and be promoted so i want to say that you know it's always hard to lose someone that has been so influential and has been such a part of our history. But we can't be selfish, and we have to let you grow, and professional growth is super important. And I know this will benefit you, the city that you're going to, and your family. So I can only wish you the best of luck, and you always will have a home here.

1:05:21 – 1:05:51•Digna Cabral

All right, anybody else? Councilwoman Gaurat. Thank you. Congratulations. I'm very happy for you. I'm sure that we're going to miss you. I mean, I know you since Adam was here and dealing with a few things when I was just the president of my association as a resident. And I'm glad that God gave me the opportunity to be part of your growth. And among all of that, for me, the best thing was seeing you this weekend. So congratulations on that. I know that that's a big step.

1:05:55•Digna Cabral

All right. Thank you very much. God bless. I think we're going to do a picture.

1:05:58•Christi Fraga

Yes? Okay, we're going to go down. We'll do a picture with us and with the directors and then with your team.

1:11:59•Christi Fraga

Love you, Edgar. We got to get going. All right.

1:12:13•Christi Fraga

I would hope so. Jesus. OK, city attorney's report.

1:12:26•Christi Fraga

No, Renzo, you should have said something, man.

1:13:18•Christi Fraga

All right. All right. City Attorney's Report is exhausted. City Clerk, you're going to say something to Edgar now too, right? All right. Well, I was going to say.

1:13:39•Christi Fraga

All right, anything else on the reports? I believe that exhausts our morning agenda. I need a motion to recess.

1:13:47 – 1:14:29•Christi Fraga

Motion to recess till 6 p.m. by Councilwoman Reynoso. Second. Second by Councilman Pinedo. All in favor say aye. Aye. All right, we'll see you back at 6 p.m. Ladies and gentlemen. Welcome to our regular council meeting. Today is October 8, 2025. It is now 6.09 PM. This is our afternoon session. I hereby call this meeting to order. A reminder to please silence your phones. If you need to take a call, kindly step outside, and let's maintain an atmosphere of respect. Madam Clerk, please call the roll.

1:14:39•Christi Fraga

Please rise for the Pledge of Allegiance led by Councilman Pinedo.

1:14:43•Digna Cabral

I pledge allegiance to the flag of the United States of America and to the republic for which it stands,

1:14:58•Christi Fraga

Okay, agenda order of business. Is there anything that needs to be added or?

1:15:06 – 1:15:19•Maureen Porras

I have a motion to reconsider an earlier item, my sponsorship item from the morning, 6M. One of the donations does not meet the minimum donation of $500 and I need to amend it.

1:15:20•Christi Fraga

Okay, Mr. City Attorney, just for clarification, would it be appropriate to take this up at this time or should we just place it on the agenda and then do it? Take a motion to reconsider and then hear it after public comments.

1:15:33•Christi Fraga

There's a motion on the table to reconsider item 6M from this morning. I need a second. Second. Second by Councilwoman Cabral. We need roll call on this. Madam Clerk.

1:15:55 – 1:17:04•Christi Fraga

Mayor Fraga? Yes. Motion passed. OK. So we're going to go ahead and place that item. And we'll hear it before the item 28, just to dispose of it quickly. But we're going to go ahead and do public comments first. All right. If there is nothing else for the order of business? No? There being none? OK. We will now open the floor for public comments. Each speaker will have three minutes to address any item on today's agenda or anything related to the city of Doral. Please begin by stating your name and address for the record to ensure that you are registered with the city clerk. We will first hear

1:19:35 – 1:19:49•Christi Fraga

Thank you so much for being here. As I mentioned, we'll be in contact and help you with the CBO grants to apply and get all the information. Thank you so much. OK, our next pre-registered speaker is Mr. Richard Glitstadt.

1:23:09 – 1:23:32•Christi Fraga

All right, is there any other public speakers at this time? Please remember to keep your comments towards any item on our agenda or anything germane to the city of Doral. Anything else? Being none, public comments is now closed, and we will go ahead and move into the public hearing. Madam Clerk, would you like to swear in the witnesses?

1:24:06 – 1:24:40•Maureen Porras

Thank you, Mayor. So I need to amend it. I need to remove actually one of the organizations, CEPI, that would be receiving $250 since it doesn't meet the minimum donation requirement. And I'll just add that back to Fundanife so that the first three A SAFE HAVEN FOR NEWBORNS, LATIN AMERICAN U.S. FOUNDATION, AND FUNDANIFE EACH HAVE $1,000, AND AGAIN, ELIMINATING THE $250 AND THE DONATION TO CFPI. AND WITH THAT, A MOTION. OKAY.

1:24:40•Christi Fraga

MOTION TO APPROVE BY VICE MAYOR PORRAS. IS THERE A SECOND? Second. Second by Councilwoman Cabral. Madam Clerk, please call the roll.

1:24:58•Christi Fraga

Mayor Fraga. Yes. Motion passes. All right. Thank you very much. Okay, Madam Clerk. Now, please. Swear on the witnesses and go into public hearing.

1:25:55 – 1:26:24•Christi Fraga

All right. Thank you very much. I'm going to go ahead and open up the public hearing. Public hearing is now open for item 25-6340 or item 28. Anyone who would like to speak on this item and this item alone, please approach the podium. Being none, public comments is now closed. Madam Clerk, at the record of reflection, no one has chosen to speak at this time. Now I'll ask for any exporte communications. Being none, we'll hear from staff.

1:30:30•Christi Fraga

I went through a staff. I don't know if anybody has any questions or would like to hear from the applicant directly. I think that we're good. If we have any questions, we can address them at the time.

1:30:42•Christi Fraga

Thank you. All right, is there any comments? Councilman Pinedo.

1:30:44 – 1:30:59•Rafael Pineyro

Just a quick comment. First of all, Brian, it's good to see you here at City Hall. And I was looking at the faces that are part of the project, and it's a pretty good team, let me tell you. So congratulations. Thank you. Therefore, I place a motion to approve.

1:31:00 – 1:31:33•Christi Fraga

Thank you, Councilman Pinedo. Motion to approve? Second. Second by Councilman Reynoso. Thank you again for being here. I did review the application along with staff. I know you guys did take input from the community, which we really appreciate, as those comments are. absolutely important to us as well. I concur with Councilman Pinedo. I think that this will be a good project, small commercial development in an area that's being redeveloped quite a bit. So we look forward to the opportunities that it will bring to the area. So thank you very much. There's no further discussion.

1:31:45•Christi Fraga

Mayor Fraga? Yes. Motion passes. All right. Thank you very much. Thank you all for your time.

1:32:06 – 1:32:27•Christi Fraga

I'm going to go ahead and open up to public hearing. Public hearing is now open for Item 25-6356, or Item 20B. Anyone who would like to speak on this item, please approach the podium. Being none, public comments is now closed. Madam Clerk, I have the record of no one has chosen to speak at this time. And we will now hear from staff.

1:33:09•Christi Fraga

Jane, I just have a quick question. How do you see this affecting us in the areas of?

1:34:00•Christi Fraga

OK. All right. I was looking for something that I had read also. But all right. Thank you, Jane. Any other questions?

1:34:09•Christi Fraga

Motion to approve by Councilman Pinedo. Second by Councilwoman Reynoso. Second. Madam Clerk, please call the roll.

1:34:44 – 1:37:56•Christi Fraga

OK, I'm going to go ahead and open a public hearing. The public hearing is now open for item 25-6369, or item 20C. Anyone who would like to speak on this item, please approach the podium. Being done, public comments are now closed. This is my item. So as it was transmitted in the agenda, the memo is pretty explanatory. Our city attorney can explain further. Basically, in reviewing the code, as I've said many times I'm doing, section by section, it has come to my attention that when in the use of the seal or the logo on our behalf or when we're using it, there is really no language to protect t

1:37:57•Digna Cabral

There's any questions happy to clarify Otherwise, we'll need a motion to approve.

1:38:07 – 1:38:41•Maureen Porras

Can the attorney or the mayor clarify, let me see, hold on. Section 2-1.1.7, the use of mass communication in the form of bulk emails, and that would be for the city seal. Can you clarify what that means? Does it mean we can't use this? I don't really use the seal a lot, to be honest. But does that mean we can't use the seal on emails, essentially? Is that what it means?

1:38:43 – 1:39:21•Christi Fraga

So the seal is used as the very formal communication by the city. We are allowed to use the logo. The seal is reserved for very official communications. You can, however, use your letterhead. So it has happened in the past where we'll take a position, put it on our letterhead, and you email blast that. That's fine because you're using your letterhead. Got it. But it should not be used as a promotion. Now, if it's on a flyer, for example, the state of the city, because it's a very official event, the seal is used. And you want to put that in your email blast to promote. It's an official communi

1:39:21•Maureen Porras

So it can go on a letterhead. All right.

1:39:24•Christi Fraga

But it still cannot be used to disparage or speak ill

1:39:28 – 1:39:46•Maureen Porras

on a position taken by the city council. And that's actually part of my second question. Now, are we referring to, obviously, disparaging comments as different than communicating our opposition or something that we're opposed to? We're not talking about that, right?

1:39:46 – 1:40:41•Christi Fraga

Yes, so you cannot utilize the city seal or logo to communicate your opposition of an official position taken by the city. You can use your personal logo, and you can use your opinion, but when you use the logo or the seal, it is a form of, I think it can be misinterpreted, and I think it can confuse residents or mislead residents to believe that it is an official position or action of the city. Therefore, I think it's created a lot of confusion, and it should not be utilized. After the city has taken an official position, and we speak in a unified voice, and that's just the way democracy work

1:40:41 – 1:41:13•Maureen Porras

Right. Yeah, I mean, I agree with the disparaging, making disparaging comments, which I honestly don't do. But disagreeing with a position or agreeing with a certain position and not being able to use the logo or the seal, because it goes for both, right? The logo and the seal? Correct. Now, just so I know, and we clarify on the legal side, wouldn't that be limiting freedom of speech? And again, I haven't looked into it. I don't know. I just want your opinion on it.

1:41:50 – 1:42:09•Maureen Porras

No, and I understand the intent. And I'm fine with it. There's other ways to distinguish in my personal capacity, I disagree, et cetera. I just want to make sure it's not, again, You may have already explained it. It's not infringing upon our freedom of speech, is what I'm saying.

1:42:12 – 1:42:27•Christi Fraga

OK. Is there any other comments or questions? Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Reynoso. Madam Clerk, please call the roll.

1:43:01 – 1:44:33•Christi Fraga

OK, opening up the public comments. Sorry, let me just get right back to my position on the agenda. Opening up the public comments for item 25-6318 or item 20E. Anyone who would like to speak on this topic or on this item, please approach the podium. Oh, that's right. OK, so I'm going to go ahead and state that we're going to open up public comments for three items together, because they all do go in one. They all have to do with the same project. So we're going to open up a public hearing for item 25-6318. or 20E, as well as 25-6306, or 20F, and 25-6317, or 20G. All three are now open for pub

1:48:11 – 1:48:56•Christi Fraga

I, for one, feel like we've spoken of this ad nauseum. I don't need to see any more presentation. Does anyone else need to hear it for a second reading? Motion to approve by Councilman Reynoso. Second. Second by Councilman Pina. I just do want to clarify one thing, because I did receive some questions about it, and I know there were some comments at the last hearing. So I just want to clarify, this land, the preserve, really will have absolutely no development opportunities in the future. That's correct. Can you please clarify that a little bit? Because I think there was some concern from the community that because the city wasn't taking it and it was going back to the homeowners association, really, and in control, I believe, of them, for the

1:49:58•Christi Fraga

Right. Okay. Thank you for the clarification. I think that that definitely clarifies it for anyone in Lehman's terms. If there's no other comments or questions, Madam Clerk, please call the roll.

1:50:16•Christi Fraga

Just a reminder, we do need to take the three items. That was just item 20E. Correct.

1:50:44 – 1:51:14•Christi Fraga

Okay, I don't need to open public hearing again. I just need a motion to approve. Motion to approve by Council Member Pinedo. Second. Second by Council Member Reynoso. If there's no additional comments for this item, again, all of the comments made in the last item are incorporated into this one. I will add one additional thing. I do want to thank the applicant for their diligence, patience, and commitment on this item, as well as their persistence. We really appreciate it, and we know it was a long journey to get here, but we're happy it's resolved.

1:51:54•Christi Fraga

Second by Councilman Reynoso. All comments made in previous item will also be incorporated into this one. There's no additional comments. Madam Clerk, please call the roll.

1:52:45 – 1:53:07•Christi Fraga

OK, I'm going to go ahead and open up the public hearing. Public hearing is now open for item 25-63-05, also known as item 20H. Anyone would like to speak on this item, please approach the podium. Being none, public hearing is now closed. And we will hear from staff.

1:53:13•Christi Fraga

Thank you, Michelle. If there's no additional questions, we will entertain a motion. Motion. Motion to approve by Councilman Reynoso. Second. Second by Councilman Pinedo.

1:54:06 – 1:54:27•Christi Fraga

Public hearing is now open for item 25-6297, also known as item 20I. Anyone who would like to speak on this item, please approach the podium. OK, being none, public comments is now closed. Madam Clerk, I want to speak at this time. And we will hear from staff.

1:54:58•Christi Fraga

Thank you very much, Mr. Estrada. Any other comments? Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Reynoso.

1:55:53 – 1:56:11•Christi Fraga

All right, opening up public hearing. Public hearing is now open for item 25-6309. Anyone who would like to speak, please approach the podium. Being none, public comments are now closed. Madam Clerk, let the record reflect. No one has chosen to speak at this time. I don't believe there's been any changes from first to second reading.

1:56:14•Christi Fraga

Yes, motion to approve by Councilman Pinedo. And there's a comment by Vice Mayor Porras.

1:56:20 – 1:56:43•Maureen Porras

Just very quickly, after reviewing it, I don't think I can support penalizing businesses without a valid BTER. I can see how unintentionally it can be not uniformly applied, and businesses complain that they were targeted, et cetera. So I just wanted to put that on record. That's it. Anybody else? Motion.

1:56:44 – 1:57:20•Christi Fraga

Motion to approve by Councilman Pinedo, second by Councilman Reynoso. I would like to clarify one thing and incorporate my comments from the last meeting here. Normally, I would not be in favor of creating fines that, however, for 20 years now or more, we're now going on 25 years almost, there has been no penalty. And to my understanding, this is a one-time penalty. So whether you've renewed your license or you haven't had a license for 12 years, basically, or 20 years, you would get one penalty of $250. It would not be a cumulative or a compounding fine, correct?

1:57:28 – 1:57:50•Christi Fraga

OK, and then additionally, I wanted to also, like I said, incorporate my comments from the first time around. We are currently working on creating incentives for businesses to come and get their BTR, because there is a lot of incentive-driven opportunities in businesses complying with our code. So I just wanted to incorporate that as well. All right, Madam Clerk, please call the roll.

1:58:25 – 1:58:59•Christi Fraga

Okay, this is my item. There are no changes from first to second reading. If there's any questions or comments. Motion. Motion to approve by Councilwoman Reynoso. Second by Councilman Pinedo. I did open public comments first, so I'm going to go ahead and do that now real quick. Public hearing is now open for item 25-6319. Anyone who would like to speak, please approach the podium. Being none, public comments is now closed. Madam Clerk, Director of Reflections, chosen to speak at this time. And now we may call the roll.

1:59:34 – 1:59:53•Christi Fraga

Public hearing is now open for item 25-6321. Anyone who would like to speak on this item, please approach the podium. Being none, public hearing is now closed. Madam Clerk, I have the right to reflect. No one has chosen to speak at this time. This is Councilman Pinedo's item, co-sponsored by Councilwoman Reynoso. Councilman Pinedo.

1:59:53 – 2:00:45•Rafael Pineyro

Thank you, Mayor. There are a few amendments that were made between the first and second reading. However, I would like to also propose another amendment, which it will be to include mandatory reflective gear, such as vests or other items of clothing when riding at nighttime. I think that's the only one that we were missing when it comes to all. But when it comes to protective or equipment, we're including and proposing this amendment. And also, when it comes to identification, I also would like to add student ID as a form of identification. Since we're just adding Florida State ID or some typ

2:00:48•Rafael Pineyro

But I would let our city attorney to cover the changes between first and second, and also including, I would like to propose these two additions as part of the amendments.

2:01:58•Christi Fraga

Motion. Motion to approve by Vice Mayor Porras. Second. Second by Councilwoman Reynoso. Any other comments or questions? Being none, Madam Clerk.

2:02:49 – 2:03:17•Christi Fraga

All right, there was no changes from first to second reading. If there's any questions, happy to address them. Otherwise, we need a motion to approve. Motion. Motion to approve by Councilwoman Reynoso. Second by Councilman Pinedo. Public hearing is now open. 25-6329 is open for public comments. Anyone would like to speak, please approach the podium. Please remember to keep it regarding this item.

2:04:18 – 2:04:51•Christi Fraga

Thank you, Mr. Glitzak. Just to clarify, we did do that in 2023, I believe. We did bring an item forward. International travel is no longer allowed unless it comes to the council for a vote and has to have a specific reason. So that was adopted by this council. I believe the three of us supported it at the time. So it's there. I will happily send you the ordinance. All right. If there's no additional comments, public comments is now closed. And we already have a motion.

2:05:06 – 2:05:35•Christi Fraga

Thank you very much. That has exhausted our agenda for today. Thank you very much for joining us. Please join us on October 16th at 5.30 p.m. for our legislative workshop. We look forward to hearing from you then. Otherwise, Godspeed. Have a wonderful week, and we will see you hopefully at that meeting. I need a motion to adjourn.
