Good morning, everyone. Welcome to our August council meeting. Today is Wednesday, August 12th. The time is now 10.07 a.m., and I hereby call this meeting to order. Remember to please silence your phones. If you must take a call, we ask you to kindly step outside so that we can maintain a respectful atmosphere. Madam Clerk, please call the roll.
Vice Mayor Lina Cabral. Present. Mayor Christy Fraga. Present. Mayor Huff Quorum. Please rise for the Pledge of Allegiance led by Councilwoman Reynoso.
I pledge allegiance to the flag of the United States of America.
Before we continue, I'd like to ask you all to join me in a moment of silence as we remember some from our team that we have recently lost. We honor the life of Officer Erwin Fernandez and thank him for his service and his family, for service and dedication to our community. We also remember our city of Doral Public Works employee, Carlos Cuba, who has passed away in July. Carlos is a valued member of our city family, and our thoughts remain with him and his loved ones and all his colleagues. Likely, I would like to ask for solidarity as we stand with the people of Colombia as they mourn the l
We now have our invocation led by Pastor Ricky from Dios Con Nosotros. Pastor?
Thank you, Pastor, for those beautiful words. Okay, we will now move into our agenda order of business. We'll go ahead and start with our city manager's office.
I don't have anything, Mayor. Thank you.
Councilman Reynoso? No, Mayor, nothing. Councilwoman Borjas? None. Madam City Clerk?
All right. So we'll go ahead and defer that. All right. Well, we'll now move in to the public comments section of our meeting. Each speaker will have three minutes to address any item on today's agenda or any other matters related to the City of Doral. Please begin by stating your name and address for the record to ensure that you are registered with the City Clerk's Office. We will first hear from those who are pre-registered, followed by any walk-in speakers. Once all have spoken, I will ask if any final speakers would like to use the microphone. reasonable opportunity time to speak. As a re
Thank you. Just to clarify, this is the time for reasonable opportunity if something needs to be put on the record. We don't normally open up public comments and discussion items. We also have Leonardo Betoli.
THANK YOU, MR. RATULI, FOR BEING HERE. I HAVE ALEXANDER RECALDE.
Thank you, Mr. Recalde. All right, that is all I have for the pre-registered speakers. If anyone else would like to speak, now would be your reasonable opportunity. You may speak on anything on this agenda or anything that is germane to this council. Being none, we will now close reasonable opportunity. And I will take a motion on the consent agenda once the city clerk reads the item that has been pulled into the record.
All right. I need a motion. Motion. Motion to approve by Councilwoman Reynoso. Second. Second by Councilman Bineto. All in favor say aye. Aye. OK. Madam Clerk, let the record reflect that the consent agenda has been approved unanimously. I now need a motion on the minutes. Motion. Motion to approve by Councilwoman Reynoso. Second by Councilman Bineto. All in favor say aye. Aye. Aye. Madam Clerk, let the record reflect that the minutes have been approved unanimously. All right. We'll now move into presentations.
Thank you so much. Chick-fil-A always does a great job of keeping their properties clean and wonderful service. Please come up for a photo. OK, we move on to the next presentation.
Madam Clerk, would you like to read the item into the record real quick? Yes.
You can give him a kiss. We won't tell anybody.
Madam Manager. OK. Madam Clerk, next item.
Thank you. Thank you very much. I just want to congratulate you guys for the work that you've done, the entire team. Every year it's been an improvement, more visitors, and exceptional people. artists and galleries. So thank you for your commitment to the city. We really value the partnership. I think it's brought a true meaning to what the cultural center was supposed to really be for for our community. Art and culture is definitely something that we as a community you know cherish and our community enjoys and value and so I think that the art festival has You know really broad significance t
Councilwoman Reynoso? Hold on. There's a comment. Yes.
Diaf, I'm really proud of all the work that you have done throughout the years. I value the continued effort of making it better every year and to include art that is diverse, that is unique. And it's really adding to what the cultural diversity of Doral is and really bringing up what art and the meaning of keeping that alive and present within our community and the importance of doing so. So I'm glad that you all have been tasked to do that. It's a big responsibility because art and culture is something that if we don't do as a city, it's going to be hard for anyone else to do. So thank you f
I have some comments, Mayor. Councilman Boris. I want to thank you guys. I can't believe it's already the fourth edition. And since the beginning, I've always been supportive. It's something that you guys have always done with professionalism. You've given a lot of local artists as well opportunities. You've really, and to reiterate the comments that my colleagues have made, you really have elevated our culture and our art, which is something that residents really wanted to see here in our community. So I want to thank you for that great work. And hopefully, you know, we can continue this and
Thank you, Mayor. I also just want to say congratulations because there has been a before and after when it comes to art in Doral, and you guys as a group have accomplished that. I always like to say this is like our mini Art Basel or our Art Basel of the year. I see the excitement, the opportunities, and the collaboration from a lot of the local businesses and other businesses from other places as well. So I just want to say thank you for everything you guys are doing as a group because it's also your time and we also have to recognize that i mean you're putting a lot of hours every year into
Thank you, Councilman Pinedo. Thank you all again. Thank you. Best of luck.
Thank you, Madam City Manager. Before we open to any questions or discussion, I think the city attorney also has. Go ahead, Mr. City Attorney, and then I'll ask for any expert communication before we discuss.
Thank you, Mr. City Attorney. At the advice of the city attorney, he's asked me to ask for ex parte communication as the protester has taken a litigious approach. So we're going to ask if there's been any ex parte communications at this time before there's any comments or questions and a motion.
There's been communication in my office, but it will not influence my decision.
I also have been contacted by the protesting party, and it should not have any effect on my decision.
Mayor, I've also had ex parte communication, and it will not affect my decision.
Likewise here. All right. Is there any comments, questions, or a motion based on the recommendation?
Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Reynoso based on the recommendation. Yes.
Yes. Okay. Any comments or questions before we call the question? Okay. Madam Clerk, please call the question.
Yes. Mayor Fraga? Yes. Motion passes. All right. Thank you very much for your time and consideration. All right, we move on to the next item.
Okay, thank you very much, Madam Clerk. This is my item. Councilmembers, the item that is before you is something that has come to my attention in the past, not just at the school district. I ran into this issue. I know Councilwoman Reynoso ran into this issue when she was elected here, and what I have experienced and what we have discussed through the administration is in preparation for the budget, it's come to our attention that there is no policy or no really way for there to be a, you know, a barrier for a council member that is outgoing or termed out or in an election process to expend t
I have some quick questions, Mayor. Yes, Councilwoman Porras. I get the intent, and I do agree with it. I mean, I've heard this happening at the county level and, you know, different governments, levels of government. What was done in Councilwoman Reynoso's case? Was her budget replenished? I don't remember, actually.
I think she had to wait for the new fiscal year.
Whatever was spent through the mayor, whatever was spent was spent, and then... I don't remember having funds.
Yeah, it was, I think, promotional items, memberships.
I don't remember, but I know that it was spent and there was no money to replenish that account. Yeah.
No, I agree with the policy. I think it's, again, I've seen it happen in different offices. My only question is, I don't see it including the mayor's office. Is that something that we can add as well?
It is included. Oh, is it? Yes, I'm considered a council member too as far as.
Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Reynoso. If there's no further questions, Madam Clerk, please call the roll.
Yes. Mayor Fraga? Yes. Motion passes. Thank you for your support. All right, move on to the next item.
Councilwoman Reynoso, this is your item.
Thank you, Mayor. So this item would already use an established volunteer program that we do have through our parks, I believe. And it would be using our military affairs advisory board to kind of lead the Doral squad in events of emergency, particularly a hurricane. So during the time of a hurricane warning, I would like, because our community is so strong and we're so united, for even a time of need such as a hurricane to be able to establish a an emergency team based of volunteers led by the military advisory board to Dispatch within our different communities particularly to our silver club
Thank you, Councilwoman Reynoso. Any comments or questions for the Councilwoman? Motion to approve by Councilman Pinedo. Second. Second by Councilwoman Porras. Great initiative. Thank you. All right. If there's no other comments or questions, Madam Clerk, please call the roll.
All right, Council Member Reynoso, this is also your item.
Yes. So the City of Doral has had... some hard last couple of months. But we are resilient. We are a community with heart. The reason why things affect us so closely is because of the close relationship that our employees have with each other, our community has with us. And it's a bittersweet thing. But again, it shows what a great job we are doing as a city, that all these different people and events intertwine us, keep us connected. So mental health needs to be our priority. I know that the city has been doing things but we need to do more and we need to do better. So public service can be d
and I think it's an extremely sensitive item, so I really appreciate your approach on it, because I know that it's something that is extremely deeply personal to people, and so we want to be able to extend that help and that resource, but it is extremely personal, and so I think that we should absolutely have the experts look into it and see how we can continue to improve and and be better and continue to grow and learn from these circumstances. So thank you for bringing this forward. I also want to just piggyback off of it and mention I have been having conversations right after learning abou
Second by Councilman Pinedo. And Councilman Pinedo?
Sure. Thank you, Mayor. And thank you, Councilwoman Reynoso, for bringing this forward. And I would love to co-sponsor as well this item. But I also want to mention just an idea as well, because I think we did something similar when it came to the discussion about the domestic violence as well, that we included a section our website about services local providers or approved institutions that provide these type of services not only for staff but also for residents as well so maybe we can look into that option as well that we can provide information in our website about mental health and And as
So thank you. Thank you, Councilman. Yes, absolutely. All right.
Yes. And I would like for mandatory sessions to be included in whatever the program is because I think if everybody needs to go to a session, whether it's a workshop or whatever it may be, it starts to break down the stigma. It also becomes an avenue that if somebody does need that extra help, they can kind of go through that under the radar and seek that help that they may be needing without a worry of maybe somebody noticing. We just want to be able to provide that resource of help when needed. And to the mayor's point, I love the now extending this to the community. perhaps on a monthly bas
Thank you. All right, if there's no additional comments or questions, Madam Clerk, please call the roll.
Okay, Councilwoman Porras, this is your item.
Thank you, Mayor. This is just a very, very brief discussion on the implementation of a search tool that's going to allow the public to access and view employee salaries for the city. When I was looking into this after the city of Miami Beach and the city of Miami, passed their own. And I emailed the city manager's office about it. She informed me that the city was already working on something like this. And so I just wanted to let residents know that it is going to be happening. And also, it is going to be something that new state law is going to require of cities and municipalities. So I wan
Thank you very much. All right. Thank you very much. Thank you. All right. No action is required. We'll move on to the next item, item 9F.
OK. Do we have a motion? Motion. Motion to approve by Councilwoman Porras, second by Councilwoman Reynoso. On favor, say aye. Aye. Aye. Sorry, do we need a full roll call? That's fine.
All right. Mayor's report. Give me one second. Sorry. So first, I'd like to thank our Parks and Recreation Department and our Doral Police Department for a great National Night Out event. It was a success. People were happy, very well organized, every year better and better. So thank you to the entire team. It was a wonderful evening. and to the police department that always does a great job with their national night out events. And I think our families truly enjoy it. As our students head back to school tomorrow, I want to wish our students a very successful, safe, and educational school year
So not just on helping with the flow of traffic and making sure that people have an easier route and that they feel and see the presence of our police officers. And we get to engage with the kids and things, so it's always wonderful. to see our men and women in uniform out there supporting families. But this year, actually, with the help of Public Works, we requested all active MOTs to be delayed and not obstruct the flow of traffic. And so Carlos and his team did a great job So speaking with the county and making sure that there was no MOTs that had been approved through the county that we ha
Thank you, Trevor. Just to give some information on this, so we have – I've been working with – public works on this, and we have had discussions about expanding it. The question that hasn't been answered and what we're trying to understand better is to what level of capabilities we would allow, whether the writer will be by themselves, accompanied with someone, because we understand the request of going Work and things like that. That's someone who's a little more independent But we have no way of kind of limiting someone putting you know of someone with with less capabilities in a vehicle on
Great. Any additional questions? We'll let you all know very soon. Hopefully there will be a response. But I know Public Works is actively working on it. And they did hear your request that would be coming forward as part of the agenda. Madam Manager, anything you would like to add on that? No? Okay. All right. Thank you, Trevor. Thank you. Thank you so much. We'll keep you up to date. All right, move on to the next item. City Manager's report. Madam City Manager.
Please come up. We'll do it right when we wrap up. Let's finish the reports. Yes. Yes. Anything else, city manager?
Okay. Madam City Clerk, your report's always so... It's very lengthy. It's attached. Okay, perfect. Thank you. Thank you very much. All right. That exhausts our morning council meeting agenda. Do I have a motion to recess? Motion. Motion to recess by Councilman Pinedo. Second. Second by Councilman Reynoso. All in favor say aye. Aye. All right. We'll see you back here for our protocol hour and then our council meeting LPA 530. Thank you very much. See you later. ALL RIGHT. GOOD EVENING, EVERYONE. GOOD EVENING, EVERYONE. GOOD EVENING, EVERYONE. WELCOME TO OUR REGULAR WELCOME TO OUR REGULAR WELCO
May you have court. Please rise for the Pledge of Allegiance led by Councilwoman Porras. OK, agenda order of business, Madam City Manager, Mr. City Attorney, any changes from you all?
I have had some requests to make some arrangements in the agenda since it is a long one. So if you all will indulge some of our requests. We have been asked to hear item 20G, which is the city's comprehensive planning. First reading again. As our first item should be very quick So we'll hear that first and then we're gonna move item 20 Q right after 20 E since the applicant has several items And we'd like to have them all taken up right after the other if there's no objections to that So those will be the changes to the agenda order of business Is everyone okay with that? Yes. Okay, madam cler
OKAY. OPENING UP THE PUBLIC HEARING FOR ITEM 20G, ALSO KNOWN AS 26-6715. ANY Showing no interest. Public comments is now closed. Madam Clerk, at the record, no one has chosen to speak at this time. And we'll now hear from staff, or I believe Ms. Michelle Lopez is here, visiting us. MICHELLE LOPEZ- Thank you, Mayor.
OK, any more comments? I have a quick question. Are we required to do all of the public engagement stuff again? Is that not being affected? So the language that's being updated or changed was more based on what exactly?
But not detrimental to the changes to the comp plan. Not at all. And we're certain that the state will be, I mean, it was in line with what they recommended we review.
Do we have any other questions? No? All right. Motion. Motion to approve by Councilwoman Reynoso. Second. Second by Councilman Pinero. Madam Clerk, please call the roll.
Thank you. Thank you. See you soon. All right, next item, Madam Clerk.
All right, let me go ahead and do the public hearing first. Mr. Magarizo, thank you. Opening up public comments for item 28, also known as 26-6681. I HAPPENED TO WALK IN AND MEET THE APPLICANT AND I KNOW THAT THEY'VE WORKED HARD
Thank you, Mr. Magritte. So would the applicant like to present or have any comments to add? You're not required to, but. I wish I could present the project. It's not. We'll leave it up to our colleagues. Is there any comments or questions about this project?
I think you're good. Okay. If there's no more comments or questions, I need a motion to approve. Motion. Motion to approve by Councilman Benito, seconded by Councilwoman Reynoso. If there's no more debate, Madam Clerk, please call the roll.
Motion passes. All right. Thank you very much. Move on to the next item.
All right. I'm going to go ahead and do public hearing first. Mr. Margarito, opening up public hearing for Item 20B, also known as 26-6682. Madam Clerk, please call the roll.
Yes. Motion passes. Okay, thank you very much. We move on to the next item.
Thank you, Madam Clerk. We're going to go ahead and open public comments for item 20C, also known as 26-6693. Anyone who would like to speak on this item or this item alone, please approach the podium. Please remember that the three minutes do apply for the public hearing items as well. State your name and address for the record.
Okay, thank you very much. Anyone else who would like to speak, please approach the podium.
Thank you, sir. Any other comments? This is the only reasonable opportunity for this item. So if you'd like to speak, please come up to the podium.
Thank you. Anyone else would like to speak?
Thank you very much. Anyone else would like to speak?
Your name, I'm sorry, again? Because we couldn't hear you.
Thank you very much. Any other comments at this time?
Please get a little bit closer to the microphone so that we can hear you clearly.
Thank you so much. Any additional comments?
Thank you All right any other comments or questions All right being no more public comments We will close the public comments portion. And we will hear from our staff and then the applicant.
Thank you, Ms. Kapanis. All right. I need to ask for ex-parte communication, and then we can open up to questions, comments, and debate.
Yes, and did met with applicant and but it would affect my decision.
Okay Thank you Yes, same expertise won't affect my decision and same here.
Okay. Thank you very much I also had communications not just with the residents but with the applicant and will not affect my the outcome of my decision All right, we can go ahead and open up to any questions or comments from the council at this time. I OK, I have a few, through the mayor. Yes, Council Member Reynoso.
OK, I have a question for the applicant. After listening through to the residents' concerns, I want to address this. I DIDN'T SEE IT THIS WAY WHEN I FIRST MET WITH THE APPLICANT, SO I WANT TO SEE WHAT THE THOUGHT PROCESS BEHIND THIS WAS. WE HAVE LOT 1 TO THE WEST AND WE HAVE LOT 3 TO THE EAST. IS THERE A REASON WHY THAT WASN'T CONSIDERED TO PUT THE GAS STATION MORE TOWARDS THE WEST AND MAYBE SWITCH THE NEVARO PROPERTY WITH THE GAS STATION?
Okay, and then my next question is, let's see. I see the buffer, and that's been intentional to keep. THE MOST DISTANCE APART FROM THE PROPERTY AND THE RESIDENTS. I WOULD LIKE TO DISCUSS THE POSSIBILITY OF HAVING A STONE WALL VERSUS THE CHAIN LINK, HEARING THE RESIDENTS TODAY THE SAME. I'M SORRY, THE CONCRETE WALL VERSUS A CHAIN LINK. I BELIEVE THERE'S MORE PRIVACY, MORE PROTECTION TO THEM, AND IF THAT'S SOMETHING THAT COULD BE DISCUSSED.
Okay. Mean other than these two questions which again have been brought through our residents, which I appreciate their input I Think the project is is thoughtful towards the community and There are property rights that we need to respect from both parties Those are my questions for now
Thank you. I have some comments, Mayor. Councilwoman Forrest. Thank you. You know, I'm also in agreement with my colleague. Well, first of all, I want to thank the residents. Thank you guys for showing up. Thank you for coming. It takes a lot of courage. It takes a lot of organizing. But obviously, you're showing that you really care about your community. Many of you have been living there over two decades. And so... You know, it's always unfortunate when we have these cases because we're faced with a community that wants to protect their residents and their people, and then you're also dealin
And just to know, would it be completely detrimental and a big delay to reevaluate that and look at the position of the gas station?
Okay. Okay. Yeah, I mean, I think those were the two. And again, you know, personally, if I were living there, I would also... want the gas station on the other side as well. Again, I don't know when discussions took place or when the meeting with the residents happened, whether it was before the site plan was done or after. But that would have been something that I would have also suggested as well.
Thank you, Mayor. First of all, I also want to thank the residents because as we just heard, it is important. It is important for you guys to get engaged, to participate. We're talking about your community. It's next door to this property. So the fact that you're here is not only because you care about your community, but you also care about the city as well. So I want to thank you for being here and for raising your voice because at the end of the day, In my case, I always try to do what is best for the residents and for the community as well. To the applicant, thank you so much for your time
Reason why I ask you the question, and I have mentioned it to you before, is because, and I want for the residents to understand this as well, when we make these type of decisions, at least in my case, I always try to go with what is going to be the best for the city and for the residents. So obviously having a hotel right behind the property, I will say no. Well, you have the right to do it, but I will say no. but even with this particular project, that I'm 100% satisfied. Of course, I like always to listen to the residents, and I have to say no, but I'm always going to look for the best inte
Thank you. And again, the reason why I ask is- You know I like sparring with you, Lorenzo. But the reason why I ask these questions is especially for the residents to understand when we make or when I make a decision is based on what is actually best for us as a city overall. I mean, I don't take it slightly. I obviously always like to listen from legal. But again, out of all the options, certainly this is the one that it makes sense. Let's put it that way. Now, I just want to clarify a few points that were actually brought up because since we have the residents here. When we speak about our c
Thank you. If I may, thank you for the presentation and for explaining the changes that you have implemented after meeting with the residents and also Reflecting that only 40% compared to the 50% that is the maximum that can be permit by code and also the setback on the property. I do also understand as a resident and I know many of them for many years that they lived there for over two decades. that it will be a great impact for them, an area that has been vacant for so many years and an area that is going to turn from being an empty lot into a commercial one. And I also understand that many
Thank you, Vice Mayor. So thank you. So I have a couple of comments and questions. And first, I also want to thank the residents for coming out and for I actually joined the first Zoom meeting that you all had. I was there for a little while because I had something to get to as well and heard some of it and just wanted to hear the concerns from the residents. I did respond to the emails that I received, and I actually responded to all of you that signed the petition today. And so I thank you for your involvement and your input. I think it's really valid when we have the opportunity to listen t
Yes, and I want to also ask, because I didn't see it when I saw the... The photo with the hawk's nest and the site plan, is there an exit of hawk's nest on 112th?
So I'm assuming one of the main reasons this was considered after listening to some of the input that you made and that your experts look at when developing a site plan is the line of sight of the building for the pharmacy for Navarro is higher. than the gas station. So if we're concerned about building and from second stories, trees being higher so that you can see, putting a higher line of sight on an area that doesn't have homes directly behind it where there's a water and a buffer makes sense to the experts and to the engineers, which is what they've done. They put your highest line of sig
So the stacking for the drive-through, which is on the rear, on the Navarro, correct? Yes. Can you zoom in on the Navarro one? I'm going to zoom in. Yeah, I've got a better one. Sorry, that was the gas station. That one. There we go. So the stacking comes from the east to west. Correct. And then they go back out and there's only right turn. Correct. So if you were to do that on the other side, You would have the problem. Exactly. Of the stacking. And the queuing. Over, right. And the queuing onto 112. Arguably, yes.
Engineering wise, I think it would be very difficult unless you were like to stick it in the middle of the property, which would really disrupt.
to this site so you can see that there i i did want to mention also just as we're on the topic here there was comments and concerns about you know noise and odors and all these things i want to you know reiterate that we have protections of quality of life for all of you on that we have current code that protects for noise if there's we actually have even code that doesn't allow for um dump trucks to come into residential areas to pick up trash at certain hours so you don't hear the beeping of the trucks to back up into your areas at certain times. So all of those things are already built into
And this also includes the improvements for pedestrian crosswalks. Correct. I heard earlier there's concerns. This is now a vacant land that will have not only sidewalk built, so it creates connectivity. And there is now ability to walk safer, but it will include crosswalks.
And those crosswalks have the, where you can push for walking, and it'll have?
Right, not the driveways, but I think the concern was the crossing of 41st Street. Yes, of course.
OK. So that is, and if our staff wants to, address this concern as well. We also look at the traffic analysis, right? Our team looks at, our public works look at the traffic analysis. We don't just take the applicant's traffic studies word for it. We also take a look at the impacts from going from a vacant land to going to its uses and... Yeah, absolutely.
Okay. Perfect. I'm going through some of my notes because there was a lot of comments put, and so I want to make sure we address everything that the residents have stated. I'll go back just real quick before I close to things, to the health concerns, right? The gas stations would not be allowed in a residential area if the transmissions, and I understand that there's particles and things that are transmitted when there's gas. It's the same as our cell phones. We know our cell phones have radiation, and we still use them. We don't get rid of them. Our microwaves, we don't stop using microwaves
OK. Have the residents put any legal sufficient evidence on the record that you feel that we would be able to?
So to our staff that has recommended for approval, the applicant has met all legal requirements, concurrencies, and code requirements for our land use and comprehensive plan within its zoning and land use rights.
OK. All my questions have been answered. Again, I want to thank the residents for coming out. I know it takes a lot to be out here and discussing. I know we all care about the community. I live right down the street. So we want to make sure that the best is being done for our community. And we try and work with these applicants as best as possible. And I want to thank them because they did incorporate the comments that I made in concerns to the property. And I do think that it has been done with all the thought process. It was not trying to shove sardines in a sardine can. There's a lot of ope
Are we okay with six feet? Do we want eight feet? Are we okay with, you want taller? Mm-hmm. So can we go to eight feet?
So we'll stay with six feet. Okay, I'm okay with the wall, with the concrete wall. the residents are OK and understand what that is. Absolutely. So the trees that they're putting are mature trees, and they have to grow. You're not going to get full 20-foot trees. That's impossible. But you will get, I think, plenty of buffer. and vegetation, and then the trees will grow. And we don't allow them to have dead trees on their property. We will come and find them for that. So don't worry. The trees will survive, and they will grow, and the city makes sure of that. Yes, yeah, we have an arborist.
