as the chairperson for tonight's meeting March 3rd 2025 I'll second that anybody oppos anybody in favor favor Mo curious congratulations uh then I will call this meeting of the cityland Planning Commission to order it is 534 on March 3rd 20125 um first first item on the agenda is a an extension um for the site plan approval from May 22nd 2023 for 37 to39 for Watson Street is anyone here to speak on that that would be me uh so this has been outstanding for quite some time Mr Gallow just out of the blue called me a couple weeks ago and said he'd like to put this back on the agenda whatever if you do vote for an extension it would be retro to win when the last one expired and I would I would say that this should probably be the last exception if you do choose to give it to him he's going to come back to a full review and also have that contingent on that anything any any your approvals of the plans that were significantly approved before they can't make any changes that's that's when I discussed this with the county that's what they said to make sure you guys put that as because it has been so long with a lot of BR year 3 and this was this project

connected with the drri downtown at one time I think it was and he had money but he was having trouble finding the contractor that met the requirements of of the Grant and I I don't so he seems so when I talked to him I said you know this is this is gonna be it that's that's what I told him they'll they'll probably Grant you a a retroactive you know it at be a year from tonight and plus whatever the the retroactive is and that'll be it and then you'll have to come back to uh a full review and again please put a stipulation in there that he is whatever approval is given tonight for that extension it has to be of the of the original plans that were approved at the last meeting no changes can be made okay um any discussion about that the can I hear a motion um to uh approve an extension um retroactive to when the last extension expired and for one year from today um with a stipulation that there be no changes um to the approved site plan without of a full review another full review also that this will be the the last will be the last uh extension U before another full review is required extension just one year yeah and this this this extension is and it'll be retroactive back to

for one paper years is that right since 68 and uh so he was looking to sell of course pursuing the sale it was discovered that the zoning boundary runs through the property so a good portion of the back is residential the front is G2 I believe so um went to the zba once they got the recommendation for the Zone shames then it was referred I believe right the next St that was referred to County Planning they came back with an affirmative recommendation and we went back to the zba last Monday they approved uh the zone change uh from their perspective that this would be regarded as a variance approval so um you're part of the process of course the site plan and the hope is that um you approve uh the application and I guess the next step and Andy and I were talking about earlier today it requires comic Council approval I believe and I'm not quite sure if it would take a local law or just by resolution so that's something we're looking at but this is you know part of that the process going forward um you know it's but it's not going to an approval will not change anything in terms of the operation of the property it's all been operated as a business those 50 plus years so I just want to add like like like I said it could have been one of one of the three R2 gb2 or or general industrial right and gb2 is kind of that mid-range it has more uses but it's not

all right moving on to agenda uh number item number three uh 110 Street plan RW for underground tank replacement yes County Planning and Zoning it's a pretty standard tank Place have the tanks make the whole system newer and safer all right um any questions no I think yeah go through the so you're replacing the existing tank and the new tank will be above ground no below ground in the same yeah it's just the one tank there's um three three going in correct are you g do it stages all three out at the same time so E's here because the canop is going to undergo some changes they're taking out the the fire protection equipment which is no longer required putting in new pumps I imagine the new pumps are going to have different logos on them also they got to put a enclosure on the exist in dumpsters which is also in your privy I see the dumpsters are to the toward the rear of the property on the train track side

uh do the part two of the um Seeker um and I will read out those questions again um I would only I would just caution you to read into those a little bit more for this project because there there there is Haz materials involved um yeah I think this is a that straightforward and there is a table on site that is very near where they're digging so this could have this this could affect water too so yeah I think this goes I think they're taking the proper precautions um I just want to make sure when you do the secet you understand the full scope of the job yeah thank you um there at least is a testing plan in place yeah also counties coil and water will be doing on-site inspections for for the city because they are pumping the excess groundwater into the storm water system okay um that that process was already approved by the dec okay which I have not got a document of approval from DEC for that project so I'm gonna need that document please um s see so they did the core samples and everything that that they're supposed to do and these are not you said they're not the old steel tanks they're tanks are PR GL fi one are the old tanks uh the old tanks I think those are L too at this location so the they're fiberglass so they're not as apt to as deterioration

as the old steel tanks used to be however they're their industry empty which means there's still some residual gasoline in there so in the process of moving them out they could tear or break causing some spillage into the soil and assuming you have a cleanup plan if that happens yes kind over and puts all the Y but just while you're doing the secret please please keep that in mind because there are some potential negative impacts here absolutely all right um question number one impact on land the proposed action may involve construction on physical operation of the land surface of the proposed site yes yes uh one a the proposed action may involve construction on land where depth of water table is less than three feet that's 13 was it 13t at least what I read through so it's I mean it's it's a lot closer than what you would think there but yeah so it's not yeah again I don't know what the depth is maybe there right how that's a good point the tanks are and then they're going three feet below that yeah so they could be that's good point you know the answer to that I'm sorry 15 how much 15 ft just the bottom of the tank excavation okay so we're going to say moderate to large impact may occur with that sure yes this just m the proposed action may involve construction on

on site environmental you mentioned uh counties so and water will be on S testing the they're part of the agency that's going to test the water before it gets pumped in into the storm drains make sure that Situation's all all fixed the the the tankies talking about gasoline floats so it'll probably it'll go into the tank the gas will float and then it'll come out the bottom the water will come out the bottom so it'll keep the residual any residual gasoline that may be in the water at the top will it will never meet that bottom pipe it's called a underflow I think it's called an underflow sounds like an oil set right is the same concept uh so I've written environmental engineer and testing done on site by enviral tract as well as cor County so water new York State DEC regulations

agenda 44 record can we flip that around so Mr Armstrong can since 44 record not here he's representing 43 Union I see so uh we'll uh move agenda item number seven to the next item on the agenda thank right thank you and this is um a site plan review for 43 right 43 unions in a B2 it's residential property um it's gone through a couple stages already as well as similar to the last one on there was an interpretation rendered by the zba that allows it to be used as a for unit then as a result of that a variance application bulk variance application had to be made with CBA because uh there's no room for the 10 foot buer Zone yeah so it's an R4 so I mean it's being used as multi res multi residence need a 10- foot buer between single and two families and there's if you go around the outside of that property there's three or four one or two families there yeah and then also because it is a residential Zone you need a 4 foot vegetative strip and part of the driveway is on the neighbor's property yeah they did not get a variance for the unpaved driveway they're going to have that paved in a year just like we've been doing with everybody else so then I think what the site plan is triggered because of the change in the parking yeah so there's going to be increased traffic because I added a an apartment
