We need a vote and a second to approve the agenda. Move to approve. A second. We have a motion and a second. All in favor say aye.

1:20 – 2:03Speaker 4

And we need a motion and a second to approve the previous minutes of July 13th, 2027. I move to approve. 2027. Oh, 2026. Hey, let's make that 2026. So we'll restate that we need a motion and a second to approve the meeting minutes from July 13th, 2026. I'll still move to approve. Second. We have a motion and a second. All in favor, say aye. Aye. I need a motion and a second to schedule the date for the next meeting, August 10th, 2026. Second. We have a motion and a second to set the date, August 10th. Item number seven, we have... Do you want to vote on that?

2:03Speaker 2

Oh, we should probably vote on that.

2:04 – 2:21Speaker 4

Okay, all in favor say aye of number six. Aye. Moving on to item number seven, conditional use permit for Rachel, and I'm going to guess and say hazing. So, Mark.

2:21 – 2:57Speaker 1

Rachel has applied for a family residential daycare located at 421 East Fifth Avenue as described legally in the agenda. Notices were sent out to the neighbors, published in the paper, signs posted. There's one response return in favor and one phone call from 414 East 15th that was in favor. She has had a daycare at this location previously. It's been over six months since she's been operating, so she's reapplying because that's one of the conditions that was put on in her last time. She has a fire inspection scheduled coming up, so she has not passed that yet. I can answer any other questions that you have for me.

3:01Speaker 3

I'll move to approve with the three typical conditions.

3:05 – 3:22Speaker 4

Second. We have a motion and a second. Any further discussion or questions? Hearing none, all in favor say aye. Aye. Item number eight, a conditional use permit for Ann Johns. Mark.

3:24 – 3:54Speaker 1

Ann is applied for family residential daycare located at 1108 Sunnyside Court, legally described in the packet. Notices were sent out to neighbors, signs posted, published in the newspaper. There was one response in favor. Applicant has passed a fire inspection already. She's currently operating a daycare over in Mount Vernon and moving to Mitchell, so moving her daycare from Mount Vernon to Mitchell. I can answer any questions that you have for me on this one. Any questions for Mark?

3:59Speaker 4

Looking for a motion and a second to approve item eight, conditional use permit.

4:04Speaker 1

I'll move to approve with the three stipulations. Is there a second? I'll second.

4:11 – 4:26Speaker 4

We have a motion and a second. All in favor of approving item eight, conditional use permit for Ann Johns, say aye. Aye. All opposed? Motion carries. Item number nine, conditional use permit for Amy Thompson. Mark.

4:28 – 5:04Speaker 1

Amy Thompson is requesting a conditional use permit for family residential daycare located at 922 University Boulevard, as described in the packet. Notices are sent out to neighbors, published in the paper, signs posted. There were two responses in favor that made the packet and three more in favor that didn't make the packet. One had a comment of great for the neighborhood. So those are the only comments on there. The owner of the house is here if you have any questions for him. It's his girlfriend that will be doing the daycare. I can answer any questions that you have for me. Or if you have any questions for him, fire inspection has been passed already as well. Any questions?

5:07 – 5:29Speaker 4

Further discussion? If not, I'm looking for a motion and a second. Move to approve with the three conditions. Second. We have a motion and a second. All in favor of approving item nine, conditional use permit for Amy Thompson, say aye. Aye. All opposed? Item 10, a plat for Carolyn Moe. Mark.

5:30 – 5:55Speaker 1

A plat for Carolyn Moe. It's in urban development. It's on the south side of Spruce Street. Legal descriptions in the packet. This is technically outside city limits, but within the ETJ. Therefore, it's city zoning jurisdiction. It meets the criteria for city zoning. The county will have to hear this as well because it's within three miles of city limits. Applicants platting off some land to sell to somebody can answer any questions that you have. It meets zoning criteria.

6:13 – 6:45Speaker 4

Second. We have a motion and a second. All in favor of approving item 10, Platt for Carolyn Moe, say aye. Aye. One abstention. Pardon me? One abstention. One objection. Abstention. Abstention. Thank you. All opposed? Motion carries. Item 11, Platt. Enclosed manufacturing ink and plasma.

6:46 – 7:30Speaker 1

Mark. applicant is requesting the flat their piece of property their part is currently uh described by measurements and they are purchasing some property from jerry clausman illegal descriptions in the packet it's outside city limits but within the etj it's city zoning ordinance for this county will still have to meet it or excuse me county will still have to hear this because it's within three miles of city limits on the flat there was an existing uh egress and ingress to the north, as you can see in the shaded area right here. So they have access to West Stevens Avenue. Hot Rod Road isn't really a road itself. It's private ingress and egress. Applicants here, if you have any questions for them, I can answer any questions that you have for me.

7:35Speaker 3

Who maintains that road? Is that privately maintained?

7:38Speaker 1

It's privately maintained because it's just an ingress and egress. It's not technically a road right away.

7:46Speaker 2

Does the applicant have any additional input?

7:55Speaker 3

How about the fire department? Any concerns from the fire department accessing this property?

8:04Speaker 2

The email didn't actually open for me.

8:11Speaker 2

No, there's plenty of them.

8:13Speaker 3

As long as it's maintained.

8:14Speaker 2

As long as it's maintained, yes.

8:21 – 8:41Speaker 4

Any additional discussion? If none, we need a motion and a second. I move to approve. Second. All right, we have a motion and a second. All in favor of approving item 11, Platt and Close Manufacturing, Inc., and Clausman, say aye.

8:43Speaker 4

All opposed? Moving on to item number 12, Platt, Schumann, and Millen, Land Trust. Mark.

8:53 – 9:28Speaker 1

Applicant. would like to plant a piece of property. They own the west portion of this and they are purchasing the east portion which had their ingress and egress on it. This area was just sold not too long, planted and sold not too long ago. Mill and Land Trust purchased it so they are selling the ingress and egress to Schumann's. It's outside city limits. It is the county zoning jurisdiction but within three miles of the city so we have to hear this as well. I can answer any questions you have. We're caring from the county, so you can have any questions for the county. Questions?

9:31Speaker 4

Move to approve. Second. We have a motion and a second to approve item 12, Platt, Schumann, and Millen Land Trust. All in favor say aye.

9:41Speaker 2

Aye. One abstention on that one as well.

9:45 – 9:57Speaker 4

One abstention. Mark? Yep. Okay, moving on to item 13, plan review for machinery at 2800 West Havens Avenue, zoned highway-oriented business district.

9:58 – 10:33Speaker 1

Applicant has come in for a building permit. They'd like to do an addition onto their building to the south. It does meet setbacks. It'll have to go through the review process through the whole building permit to make sure that it will be built correctly with the proper fire ratings or sprinkler system as required. John Hague will review that once we get the full set of plans. They're just giving us the preliminary because this is zoned highway business. It has to come in front of this board. The land that they're building on is already gravel, so it's not affecting the drainage at all with that. Can you answer any questions that you have for me? Or if you have any questions for John, you can answer them as well.

10:38 – 10:59Speaker 4

Is there a motion to approve? Move to approve. Second. We have a motion and a second to approve item 13 plan review for Titan Machinery. All in favor say aye. Aye. Any opposed? Hearing none, move on to item 14, Platt Van Buskirk Homes LLC. Mark.

11:01 – 11:55Speaker 1

Applicant is plotting their piece of property that they have that is plotted into... five lots I believe currently. They're platting it into one lot and then also creating some extra right way in the alleyway. This is on First Avenue and Foster Street. Alleys are usually 16. This will become a 20 foot wide alley easement for this area and I was wrong. There's six lots. It'll end up going into five houses that will be built at a later date and they're will probably be a PUD that goes along with this. That's why they're going to the big spot first, so that way they can get their setbacks and everything they need in the future. It's zoned R4, so with the five proposed houses that they're going to put on this, R4 allows up to 24 dwellings without a conditional use permit, so we could issue the building permits at this time while they're working through their PUD. I can answer any questions that you have.

11:58Speaker 3

The plan is for houses, though, not apartments.

12:00Speaker 1

Correct. This is going to be for housing.

12:18 – 12:31Speaker 4

Questions? If none, we're looking for a motion to approve item 14. I'll move to approve. Is there a second?

12:39Speaker 2

I'll second.

12:41Speaker 3

I'll second.

12:42Speaker 2

I got a second for you.

12:43 – 13:01Speaker 4

A second? Okay. All in favor of approving item 14, Platford Van Busker Combs LLC say aye. Aye. All opposed? Moving on to item 15, plat for Firesteel Links LLC. Mark.

13:02 – 13:15Speaker 1

This is out at Wild Oak. Legal description is in the packet. It's just off of Quiet Lane. It's following along their master plan. It's all in city limits. It meets zoning requirements for R4 in that location. I can answer any questions that you have.

13:23 – 14:09Speaker 4

Second we have a motion in a second to approve item 15 plat for fire still links LLC all in favor say aye aye all opposed Hearing none we are on to item 16 other business Is there any other business If not, we're moving on to item 17, public input. If you need to address the board on an item that was not on the agenda, excluding personnel items, please come forward to the podium and state your name and your concern. Presentations are limited to three minutes. Items will be considered, but no action will be taken at this time. Any public input? Hearing none, we are adjourned.
