All right. I'd like to reconvene town board workshop number 20 to order. And again, I have the clerk note that all the council members made it from downstairs to upstairs. I'm going to switch this around a little bit and let the DEC EPA presentation for 630 commence. Somebody here. Yeah, come on in. We'll start with them so we can get those guys moved along and then we can give them the rest of our agenda. How you doing? Good, good. Thanks for coming tonight. We appreciate it. Yeah. Well, Basically, what they ask is, as part of our ongoing project.
Right. Why don't you, for the record, why don't you give us your name? Oh, I'm sorry. It's my first. Yeah, I'm sorry.
My name is Patrick Concanon. I'm with the New York State Department of Environmental Science. And as I'm sure you're all aware, there is an ongoing effort to perform radiological assessments throughout the community. One of the locations that was identified with our aerial survey is Veterans Park here at Grand Isle. As far as I'm aware, it's the only municipal property on Grand Island that we'd like to have access to. So the purpose here is to come and explain basically what we're looking to do and answer any questions you may have relative to that.
Okay. We're hoping, too, that maybe while you're here, you could leave us a... A little bit of a tutorial and maybe a phone tree of when residents come to us with concerns that we can follow up at and make sure that our clerks are clear on that and my office is clear on that so we're not all doing different things. Sure, sure.
And we appreciate that. We've worked very hard to centralize that contact. We do have a hotline that we can provide that to you.

Thank you. Anything else? I have a question. I'm sorry. So what did you see on the aerial survey?
With the aerial survey, that was the planes that I think many people managed to see a few years ago flying back and forth. So what we did with that, that's a degree of detail that has a 500, 600-foot diameter to it. Basically, we saw one point on a map in Veterans Park. It doesn't indicate that there's a problem. It doesn't indicate that there's something wrong along the lines of some of the concerns we've been addressing elsewhere. It's simply a location of interest that we'd like to access with our, what we're calling our phase three folks, which is the boots on the ground that come in and just do a little bit of a reconnoiter and try and make sure that we understand better, more specifically, we better detail what it is we may or may not be seeing.
Do we know where in the park it still came from? We just spent over a million hours.
Yeah, yeah, exactly. And that's one of the things that we have to reckon with with some of these aerial survey dots here. We don't have any other information. We basically would try and centralize our efforts on where the middle of the park is, which is I think where actually that location was identified. There isn't a physical feature or anything to look at to specifically take it with that. and just work around that point and do enough of a survey by hand to get a better understanding of if there is anything there. Frequently, we see things that may relate to understood man-made features. I know with some of the work we've done, we've seen granite curbing, decorative rocks and boulders, materials that are naturally occurring, bedrock, shallow bedrock soils. There's a natural radiological aspect to everything. So we just want to see what is there, how it relates to the information that we have, and see if we have to do any follow-up. And hopefully that we can just say this is pretty easy to determine that we do or do not need to follow this.
I understood that you guys would use utility vehicles.
We may.
With mounted stuff and maybe start to do circles.
Yeah, that allows us to access larger properties a little more easily. We're very understanding that sometimes that's not acceptable to the property owner or the municipality. We don't want to rut up your field. We don't want to take liberties with fields that may be ball fields. We'll work. We'll be certainly conscientious of the paths like that.
maybe so again just by hand we'll do it by hand just to just to step back and be clear that's the only property you're really concerned yes and i as far as municipally owned on grand island yes that is the only property that we're having this ask do you expect us to these uh um inspections to increase in numbers. It seems like a lot of people want to, oh, I want to have them check my property.
I can't say if it would continue to increase. It's been quite an increase right from day one from what we were actually doing. So we are continuing to deal with a significant number of requests.

Once we authorize the test, what's the time frame for having the results?
That's an ongoing discussion. We want to make sure that we don't send results out without them being thoroughly analyzed and digested by our health physics folks. We have staff from all of our agencies taking a look at these things. I think right now we're running in a matter of a time frame of weeks, a couple of weeks. But there's also, while we're there, there's some real-time information that it's your property. Share it with you if somebody accompanies you. It isn't that digested data, but We're not going to keep you away from us long. As far as when we green light inspection, how quick would you be on it? I think in a matter of days. Okay.
As much as you need, 24, 48, whatever you need, we'll work with you. Okay.

No, they I mean some of the changes that were brought up and change the planning recommended that just that I missed when I. That the group that Dan I met with had made that I just missed my. Okay. Oh.
Under unfinished business, number two, in your packet, there's a, we revised the LOI to include some of the conversation from our last board meeting. A couple of you have had conversations with our contact with Verigy. Is there any concerns that he will be at the meeting? Okay.

One thing they wanted us to chat about was the kayak launch on East River.

I think the appetite is that the town board, somebody from the town to speak with the neighbors because it sounds like one of the organizations we'll be applying to for funding has inquired as to whether we talked about it with the neighbors. So the question was, are we going to do it? If so, who is going to do it? I didn't know if you thought that at all.
So what I did, we did, when we worked on the Nike-based trials, is we sent registered letters to all the neighbors that were immediately affected and said, here's what our intent to do is. We showed them a plan and said, please reach out to us and we'll talk about it in person. And that's how we did it, one-on-one. And being that there's two neighbors, I think that would probably be a good process to follow here. If you would like, I will draft something from my office with a schematic of what's going on, send it out. And if they want to come in and talk, I'll get involved with that.
Sounds reasonable to me.
I mean, that's the best way to do it, I think.
And we talked at length about the time that, to some extent, the expectation is there may be neighboring property owners that just don't like change and won't be pleased with it because they wanted to stay as it was. And if that's the case, so be it. These organizations are used to getting that. So let's not wait. If they don't give it a ringing enforcement, it's not going to be an issue, but it'd be better to just say, yes, we've had the conversation, than to say, yeah, no, we're trying to stay quiet.
And I think that should apply. I think we talked a lot about this last year with trails. Yeah. If we're going to, we have a town easement or access, we should.
Yeah. So when we were doing the stuff on Sandy, when we sent out letters to all the properties within such a distance, just so that we were transparent on what we were doing, we weren't certainly trying to hide anything. And I think that's good. I think just when they show up in the backyard, people get a little bit nervous.
So better they know ahead. Yeah. Good on that.

Second item they had was the demolition of that building at the Lincoln Base. Yes, apparently we got somewhere with SHPO.
So SHPO said yes, but you need a moniker stone. And we asked them what that looked like. And they never got back to us. So we just recently sent them a suggestion of what we would do to monitor and memorialize these structures we're going to take down. And we still have not heard back.
So their recommendation with that is if we hadn't heard back or that letter hadn't gone, that a letter go out with... on an example of what we're going to do and just tell Shippo, look, here's what we're going to do. And if we don't hear back from you within 30 days about a suggestion to do something else, we're going to take the buildings down and we're going to do this. You had your chance. So I guess maybe we can have some discussion with Peter, your executive, about how good of an idea that is.
Yeah, it's legally acceptable. It seems reasonable.
Yeah. And last but not least, Pete, was rec fees. It seems as though Ron was working on it. Talk with Ron about it. The recommendation that they made with MEC fees, they tried sending it to that liaison email, and I don't think it made it to us. But the question is whether or not we want to get that on the agenda. I think we should. I had seen it. I think you have.
But it didn't make it to the file. I've been actively in the conversation with them, and it's going to be the board's pleasure whether we want to wait until the reorg and adopt them, or if we want to adopt them immediately. I don't really particularly...

But I mean, they did a bunch, they did, they do do a lot of respecting fees and space. We kind of compared what we're doing to what other times are doing. So they did a lot of work to go.
So just to be clear, the 750 per residential lot and a thousand dollars per contiguous multi. So I'll just put a resolution together for my office. We'll put it on next meeting. It's not a law. It's just, we're changing a few. So that's easy.

They sent me whatever the municipal agreement was. that was one thing and um there was a request for follow-up on the the town tavern concerns over the storm water mitigation issues um engineering did send uh updated uh response to that motion from cab on it came today so i don't know if anyone had a chance to review it i think it's satisfactory it meets the board meets it meets the needs we can decide whether it's acceptable to the board send a notice back to captain it's been reviewed or We want to ask engineering to do more. I was busy, but I was into it a whole lot. So maybe it's something we can deal with on another day, but people want to take a look at what he wrote to Dan some additional information to what has been done over there and what will and should be done.
In the meantime, we can certainly ask Bob to get you back out to the DCM. of their investigation, which is what it recommends.

I'm actually highly interested in their input on that.
That would affect our creek out here in town greatly, what their determination was there. So is that something we want to just wait to see what we hear from the DEC and then make some direction or acceptance of what engineering, either accept or deny what engineering's doing? Yes. That's what CAP's kind of looking for, whether we think it's appropriate or not, where we're at.

I guess everyone's got to read it and think about it. me um so people take a look at it respond and then we can move off of that okay okay um traffic safety canceled and historical just more discussion they were happy that we were able to move along their suggestion to the zoning reform committee right uh they did come up with a sign for the cupola got the estimate it's the proof was sent to uh Jim Linnefelser, he contacted the companies that we ordered so that they can complete that part of the process. Okay.
I did a, we did get a question regarding the secret or the best law. I don't know if it's our place to hand that out or not, or I don't know how that works. Maybe we could talk about that in an exec session.

Right. The determination that it was special use. Well, I mean, the reality is the implementation of the law and these things get approved, there may need to be a pause. Action right now is the passage of the law.

No, no. I'm talking about the existence of the secret for the law. And whether or not we need to pause. The action that will afford this is the adoption of the law, not the obstruction of the law. And that's where...
I mean, I would think there might be some more substance on a particular project than there is on the law itself. That's kind of how I was taking it as well, too. Okay. Well, we want to talk about that in the future. Like I said, I didn't want to offer that up without the board's blessing.

I think we all talked about it. Yeah. the vehicle that highway makes sense to hand it off to the police department saves a ton of money in the long run so police wanted that i talked to tom see if he wanted it. Yeah, I didn't even put it in the budget. But we'd have to think about finances. Right now, it's expensive to save us. You know, if it takes a grant for about a year. So today was the most fun. So, of course, we took it. They transferred to New York. And you could give the city's board, I don't know how the city's board would make sense to the police to implement this. But of course, we could probably get them there.
So we priced a new vehicle for Code Enforcement, which was a Ford Maverick all-wheel drive mini pickup. We could get one for just under $30,000 retail. A police car replacement is probably high 30s, low 40s. But they are a little bit upgraded from what this Explorer was.
That was my thought. Does it meet the specs of the vehicles?
So, as far as a patrol car, I would say no. They have, like, increased bus capacity for power in the dash and different tires, different rims, different brakes. I think what was it? Top brakes, top suspension. Yeah, right. So, that was kind of a true statement. So, but, however, as an ministerial car, I think it would work outstanding for them. And with our... with our public outreach groups going on now and our SROs at the school, we don't need to have a police barracks park there either if we have something like this. So it augments, and I think it's a wide room. So I agree with Dan. I just got there. So anyways, we can work on that if the board is supportive of that. Yeah.
So I would need an approval to do a budget amendment to increase the police budget and the fund balance. And I would need for the 20 grand.

We definitely need to regroup on the budget and work as a team to get this lowered. Me and Pete sat together for a few hours trying to cut as much as we could.

Yeah. So I do have the updated fund balances for what we have. And I think we need to call a workshop. I don't know if we want to combine it with the... engineering department and put both workshops together, but I can't, we need to find quite a bit of money because we can't put this budget through right now.
Correct. At that same meeting, are you going to have the numbers ready for the borrowing for the improvements to be done?
I have the numbers ready and I have the additional bond authorization ready in the budget. And that equals what I will charge for sewer tax. So we just need to pay attention to that.
To be clear, I talked with those guys today. We cannot go into winter the way we're running that plant right now without a digest. So this takes a significant amount of time to get everything through, but We have to be leery of winter. You know, we can't take this plant in the winter the way we're running. No. No, but... We don't have time to do the repairs. So October, the time should be excellent to get enough money to do the repairs.
So if we borrow that additional fund instead of just the base amount that we originally have, sewer alone will be breaking the tax cap.

One of their employees is just deciding to work from home with other employees. It needs to be dealt with. I know we're trying to get in front of and manage it.
The other issue, especially if you talk about union negotiations, it's difficult because not everybody has the ability to. And you're not going to get to grievances and stuff like that. One person has to stay and somebody else who's off that day has to come in, doesn't have the ability to work from home and has to use PTO.
Access is a part of what we need to hold on to.
Everything's about a morality. Some people, you treat everybody the same. Big cities and sites. I want to say, all I hear, not all I hear, but what we tend to hear in our positions is, why does someone get this special care? Why does someone get this special care? So, I think it would be strange to say.

Well, I mean, I guess that's my point. At the end of the day, whether we put it in the department head's purview to make the decision, the reality is there are going to be people in the same bargaining unit, some of which who can work from home and some of which who cannot. And they're going through the nature of the job that we're doing. only you're going to have a different result and that's where i because i think people all the time fashion where sports craze is canceled i can go pick my kids up what's about us i need to be employed i can sit at home and be most of what i do from home and we have some employees in town that can't do that and we have others that cannot even let the stupid guy the heat index in the airport parks guys they were out there we can't send they'll never be able to work from home because they don't have the option to do some of the stuff.
Yeah, that question. In your job, are you as effective when you're chasing your kids around and feeding them and helping them?
I mean, and that's the next level. So at the end of the day, it starts with that income.
You're also a private sector. Your work is poor.

But you guys last year passed a resolution that there's no work from home without town board or supervisor approval. So That's not what's on the table, right, Dan? No. The question on the table is why is there so much remote access when you're not?

It was really discriminating circumstances.
There could be an employee who's on vacation and out of town, and we need them to do something. If they say they can, we've got to allow them to do it. If they do it from the phone, that makes sense.
Someone's going to a conference and wants to work remotely. They ask, we flip the switch, and they get it. It's not a big, I mean, that's not, it's nice to work on it. We can put it on and off. It's pretty easy.

It's worth bringing up to know that we have the option.

I hope some of the new Superfired Farms watches. that we can actually sit down and have some meaningful discussions instead of sit for 10, you're a bad guy, don't worry, no, you're a bad guy, back and forth, stupid bad guy stuff. We can actually look at where there could be some savings, fire protection, fire residents, still maintain the best fire department, Westville, and so on. There is some media coverage.
And I think it's appropriate that we did agree before last year, we have done so, that we should have biannually meeting with them to discuss where they're at, where we're at. How can we do things better? We're still pending the audit. That should be where we could see where we stand. Maybe there is, I don't know, something we're talking about.
We're not going to have a good partnership if we don't work at it. So I think that that's a great idea to get together and have that meeting. Who would set that up? Who's the liaison for that?

We had what seemed to be that's the response times. more cost effective, and then we continue to have a law firm as our litigating firm, which I would suggest we keep Pajamas a litigating firm. But our day-to-day in-house work, I would like to consider an in-house town attorney. I mean, I have talked to a person that I like myself. I think I've introduced him to a few years. And if so, I'll ask to suspend the rules later in the meeting and have that discussion.
