I am the Special Magistrate for this afternoon's hearing. Welcome to North Bay Village Code Enforcement Hearing. It will be conducted pursuant to Chapter 162 of the Florida Statute. Formal rules of evidence shall not apply, but fundamental due process shall be observed and govern these proceedings. I will hear testimony from the code inspector and the alleged violator that I deem to be competent and relevant. All witnesses and parties offering testimony must be sworn in. The village will present its case first and the alleged violator will have an opportunity to present their case as well as cross-examine the village witnesses. At the conclusion of the presentation, I will announce a decision and issue a written order thereafter. If you are found guilty, you will be ordered to comply with the code within a certain time. If you fail to do so, you may be fined up to $250 per day for the first violation and $500 for repeat violations. If you desire to appeal my order, you may do so by filing a notice of appeal with the clerk of courts in Miami-Dade County. You will have 30 days within which to file an appeal. It was found to be in violation and it was ordered to renew the building permit to comply with the violation. 30 days was given with no running fines. The owner stated that the work was already done. and that he had a paperwork that needed to be filled out. However, his contractor was no longer registered to do business with the city and he needed to register again. But as of today, if he still haven't paid the original citation of $250, the violation is still outstanding. So it is our recommendation to renew the building permit to comply with the violation for the fines of $250 to begin running today until it comes to compliance and to come back at the next hearing for a report.

Good afternoon, Your Honor. For the record, Orlando Rodriguez, Code Enforcement Director for the Village. Your Honor, this is the new case. On February 9th, 2026, we received a complaint from the board president of the Observe building that a mini split unit was installed on the property over the weekend. He indicated the owner did not get HOA approval for that installation and also required city permits. Photos were taken of the installation and sent to our village building official, Mr. Pedro Martinez. He confirmed that the work was performed without permits. It required electrical and HVAC permit for that installation. At that point, we did issue a citation of $250. It was posted and sent certified mail to the owner. On March 11, 2026, on their compliance date, We checked the records and we saw the citation remains unpaid and no permit was on file. May 28th this year, we drafted the notice to appear for the staff's and his hearing, certified mail posted at the property. As of today, we have not received communication from Mr. Samota or any emails and no permit applications were on file. Our recommendation at this point is for the property to comply with this as soon as they can. We'd ask for the property to begin fines of $250 per day commencing today and for the property to return for a status report as needed.

Good afternoon again, Your Honor. For the record, Orlando Rodriguez, North Bay Village Co-Director. This is also a new case. On December 16, 2025, a warning notice was sent to the property indicating they had two expired permits. For the record, those are 000-338-2024 and 000-263-2024. The property was provided 30 days to renew those. After 30 days, we did review the records and confirmed the permits remained expired. The property was given an extension for compliance. However, we did review again on March 26th, 2026, that the permits remained expired. We went ahead and issued a citation, $250. On May 27th, I called the owner, Mrs. Schwimmer, and asked her for an update. And she indicated she did have a permit runner working on this issue. However, he has not had much success getting ahold of her. I told her at that point that she wouldn't be scheduled for the hearing today. Following that, on May 28th, the notice to appear was addressed, was drafted, sent to the certified mail to the property address on record, also the property. I also communicated with Ms. Leslie this week, and she stated that she didn't get ahold of that permit runner. However, she's still working on submitting for the renewing those permits. Our recommendation as of today is for the owner to comply as soon as they can, the property should be accruing fines of $250 starting today. And we'd ask for them to come back to the status report as needed.

At that time, fines of $250 per day had been running for 63 days, total $15,750. Defines the order to continue and for the property to return today. As mentioned in the previous hearing, Mr. Peter Graves, who was the contact for that property, indicated they were actually going to demolish the whole structure in order to gain compliance. Currently, the property seems like it's still going through the change of ownership. So we have not have any further updates still till today. So our recommendation is for the property to comply as soon as they can, whether it's getting the permits or demolishing the structure. The property as of today have been filling fines at $250 per day since March 19th, 2026, 98 days, total of $24,500. We'd ask for the fines to continue and for the property to return as needed. The electrical permit was already submitted and previewed, but it's pending a few comments made by the prison inspector. And that's what they're waiting, like the electrical report and the parking illumination. But as of now, they're still not in compliance. So we are recommending for them to continue working, to attend the permit, and to get their recertification. for the fine to continue accumulating until they come into compliance and to come back at the next hearing for a report.

And he just wanted to update me that he's still working on it. So our recommendation is for the property to comply with the violation as soon as they can. The property, as mentioned previously, had commenced a consent agreement with the Department of Environmental Resource Management. The last update from their portal shows that on April 10, the property requested a payment schedule modification. However, we have no further update on the legal structure and the permit. The recommendation at this point is for the property to comply as soon as they can. The property has been accruing fines as of today for 218 days, a total of $54,500. We'd ask for the fines to continue for the property to return.

Yes, Your Honor. Again, Orlando Rodriguez, North Bay Village Code Director. This is the same property owner from the previous case. However, this is a new case, new violation. The property was in process of installing fire sprinklers in order to have their capacity needs approved and a new certificate of use issued to the property. They had an illegal outdoor canopy, which was our previous case. currently in our process and they were not able to install those fire sprinklers on that structure since it's not permitted. The property installed a substructure under the canopy in order to install these fire sprinklers and it was brought to our attention at the village by the sprinkler contractor. I visited the site on March 16, 2024 and I took photos of the structure. The photos were sent to our building official, Pedro Martinez, He determined that the structure did not have a permit and it did require one. On March 18th, we proceeded to contact the property owner. The village manager contacted them and granted them a one-week extension to apply for that permit. If not, we were going to proceed with citation. We reviewed the case again on March 30th, 2026. They had not submitted anything, so we went ahead and issued the $250 citation for work without permit, posted at the property, sent to them certified mail. The case was reviewed again on April 30th. It remained out of compliance, so we granted them a final extension of time before the notice to appear was drafted. We went ahead and drafted that on May 28th, served certified posted at the property. As of yesterday, June 24th, they were able to submit and apply for a permit, which is great news. Just for the record, it's BLDC000441-2026. So now that permit has to go through the review process. Our recommendation right now is for the property to comply with that permit as soon as they can. We'd ask for fines of $250 per day to commence today until they achieve compliance and for them to return as

The work was done. but they did not request inspection to close the permit and the permit was fired. On December 16, 2025, a civil inflation notice warning was sent to the property to renew the permit. For the requisite permit number PLDR-000136-2024, PLMR-000138, 2024 and LER-000137. The notice was sent to the owner through the property address listed on the tax record. On March, 2026, they were still in violation and a $250 citation was issued for failure to renew the permit. As of today, The violation still out and in this citation still funding. So we are recommending them to renew the building permit to comply with the violation of the fines of $250 start today. A daily fine until they come to compliance and to come back at the next year as needed.

And We still, you still didn't pay the citation and the violation is still there. So we are recommending for you to obtain the, to review the permit and to, for the fines, what you heard, those are fines of $250 starting today until you come into compliance.

My name is Helen Victoria Oliveira. I'm the owner of Meisner and Meisner LLC owner. I did pull the permits. I love and always do follow the law. My father is an attorney. 2019, I pulled all those permits. Unfortunately, the HOA did not approve one of my permits. There was nothing on the condo docs that prohibited me to do it, but they fell me in. Now we fight in court. And I would love to ask you for 30 days to fix this. As Ms. Maria Tovar said, she explained to me what I have to do to fix this. I want to let you know that it's a frustration because, Your Honor, I have spent more than 20,000 only on general contractor and permits. The city permits, I believe, is 1,200. Every single time I renew those permits, because we are fighting in court to, you know, to get to see my rights. And every time I have to pay a fee for the general contractor, a fee for the plumber, and a fee for the electrician, and also the fee for the cities. So it's my intention to renew again. I got frustrated, depressed, because I renewed many times, and the HOA You know, for one thing that they lied, they keep denying me and I have to hire an attorney twice for this case. So if you could give me 30 days with no fines, my general contractor already spoke of Mrs. Tovar. I'm going to renew one more time. And if I cannot win court, I'm going to see if I can cancel them. and don't do the job and another thing i want to let you know one of the work was done which was the panel the electrical panel and the reason why i did is because it was very very old and the brake was giving some sparkles and i thought it could get fire on the whole building so that's the only thing i decided to do it and i have to call for an inspection so we can close that one And I'm going to renew them as soon as possible. My general contractor is already working on this. I'm going to pay him and everybody else again, plus the fee for the city. So if you can give me 30 days and allow me not to pay any fee, I gladly appreciate it. Remind me again, is this a new case?
