Code Enforcement Board - Special Meeting

Call the order, the 02/04/2026 code enforcement special magistrate hearing. The first matter is CEBD24Dash00524, Mildred h Neary.

Good morning. There we go. Good morning, honor. Daniel P. Lewis on behalf of the City of Venice. This one will actually be pretty quick today. I've had an opportunity to recap you on this one. This there's this case is currently in probate because the title, the property owner is deceased as I believe eleven years ago. I had an opportunity to speak with Mr. Mowry, the attorney on the matter.

Since this is, they are doing a summary administration of the estate based on based on the when based on the fact that the owner again passed away eleven years ago. So unfortunately while again as we discussed last time there's no personal representative being will be named. However they did file an amended petition to declare the property homestead to take it out to the probate, take it out of probate. Mr. Mallory advised that he is anticipating that order to be granted by the end of this month. Okay. And that's he's expressed me that order would actually be work as a deed that would trans that would legally transfer the property to all the heirs including Mr. Neri who's here today.

Unfortunately,

that puts us in the same boat as we are we were in last month. So we are going to request a continuance on this matter just to resolve that for ninety days just because at that point that gives them extra leeway time because if we did a thirty day one, they probably wouldn't have time to actually get the permits issued or anything. If the ultimately even if the judge signs it within the next month. So it gives them more leeway to like actually get the ordering, get the permits and finish the work. Okay.

then based upon the request by the city to continue this for a three month period we will schedule this for the 05/06/2026 code enforcement special magistrate hearing. Then I believe that concludes everything we have for today.

As of right now the only thing the special magistrate hearing is scheduled for March 4 at twenty twenty six at ten a. M. Otherwise, that's it.
