Okay, I'd like to bring this meeting to order for the Town of Brunswick Planning Board for September 17, 2026. If everybody would please rise for the Pledge of Allegiance. Okay, thank you. Our agenda this evening is as follows. This was posted on the town website and the town board. Number one, Brunswick Acres, major subdivision. Applicant proposes a major subdivision with regard to the Brunswick Acres planned development district on approximately 44 acre parcel located along the north side of Brunswick Road, New York State Route 2, just west of Heather Ridge Road. Brunswick Road Development LLC is the applicant. Number two, 810 Hoosick Road site plan. Applicant seeks site plan approval to convert an existing building used for motor vehicle sales into a body shop, including making minor exterior improvements on the property located at 810 Hoosick Road. 810 Hoosick Road LLC is the applicant. I should note in case there's anybody here in regards to the special use permit for Law Field. This was for a ground mounted solar that there was supposed to be a public hearing scheduled for that. The applicant has removed the application and is going to do some other operations. So that item has been deleted from the agenda. So if there's anybody here for that, we're not in. Okay, first on our working agenda is, would be the normally the approval of minutes of a prior meeting. There has been none submitted, so there is no more minutes to review. Moving on to our first item on the agenda, Brunswick Acres, Major Subdivision. Okay, just to review, we did the public hearing. Applicant responded in writing to all the comments made at the public hearing. Once again, this is basically a duplication of a prior application and prior process involving a public hearing. So that's been taken care of. We're at a point now where Chris has put a draft together for a resolution to grant conditional approval on this. So I'm gonna turn the floor over to Chris and he can go through that.

3:51Speaker 3

Sure, so if this resolution looks familiar, it's because it's substantially similar to all the last conditional final approval

4:09Speaker 1

and ranked it

4:40Speaker 3

that we've removed, that we've added,

5:07 – 8:24Speaker 1

Were you afforded an opportunity to look at this before? I mean, we can, we can. Okay, now the board, does the board have any questions on the draft? I mean, like Chris said, they're identical to the prior one. I will give you an opportunity to cruise through them quickly. RUSS, HAVE YOU HAD AN OPPORTUNITY TO LOOK AT THESE? Kevin, are we picking this up on the audio?

8:24Speaker 5

I believe so.

8:31 – 8:46Speaker 1

Okay. Okay. I'm not going to ask you. Okay. Any questions from the board?

8:49Speaker 8

a couple of questions. You're bringing this public water supply in down Brunswick Road or over from Walmart?

8:58Speaker 5

It's tying in on Riccardi and on Heather Ridge.

9:02Speaker 5

It's tying in on Riccardi and on Heather Ridge.

9:06Speaker 8

Okay. And...

9:09 – 9:29Speaker 5

have you secured the easements for the utility and drainage over the lands of benavino you've got that i am all sitting i just i'm not finally everything's okay i'm good all right so now you got me a little confused we're waiting on something from this we finally have signed copies from national

9:45Speaker 1

Mike, do you have any questions? John?

9:51 – 10:14Speaker 1

Don, you're all set? I'm good. Okay, then we can move forward. As Chris mentioned, we do not have to do a secret determination because that's already been made. I'll entertain anyone who wishes to make a motion to adopt this resolution for conditional final subdivision approval.

10:15Speaker 5

I'll make the motion. I'll second.

10:18 – 10:31Speaker 1

Okay. Is there any conditions besides what's on here that we have to put on? I don't think so. All right. So we'll do a roll call vote. Would you do that?

10:37Speaker 3

I'm going to follow your last name. I'm still working on it. Chorn. Chorn. Chorn. What a name. How do you vote? Aye.

10:46Speaker 5

Mr. Minello? Aye. Mr. Henderson?

10:49Speaker 3

Aye. Mr. Oster?

10:50Speaker 1

Aye. Mr. Karloff?

10:52Speaker 3

Aye. Resolution adopted.

10:55 – 11:12Speaker 1

OK. You're all set. Thank you. You're welcome. Moving on to our next is the 210 Luzic Road Cyclone.

11:41 – 13:31Speaker 4

also here with us tonight. So since we saw you last, we had some updates to share. We provided the town a resubmission, including a topographic survey with contours on that. That was submitted to the town. We submitted a CAD site We provided a site lighting plan, a site photometric plan, just based on some of the comments we received at that last meeting that noted, you know, turning off the lights at a certain hour as well as the signs. So we added a note on the trees to the existing foliage that's out there. I'm sorry, where's that going? What's that? The evergreens? The evergreens, so we're adding, so there's a line, there's two existing here, a line of four pine trees, one, two, three, four, and then we're

13:44Speaker 1

So there's this thing.

14:12Speaker 5

Could you take out that loading ramp?

14:14Speaker 4

Yeah, we're showing that. We're showing that just to clean it up, make sure the parking is in alignment, set the goal time by 18 spaces.

14:31 – 14:42Speaker 1

I know we probably asked these questions at our last meeting, but you have enough parking places for customer and employee

14:42 – 15:20Speaker 4

parking where would the employees be parking so we added a gate you know the typical gate with um to kind of separate the retail quarter the retail the customer portion of the parking to the our employees so behind the gate would be our employees parking and in front of the gate but that doesn't stop an employee from parking essentially out in front they have that the closest parking and ADA accessibility to the front door for customers, so we added just the striping to the front door.

15:23Speaker 8

How many employees?

15:27Speaker 4

I believe, Bart, I'll let you speak to that.

15:33Speaker 8

How many parking places do you have for employees?

15:36Speaker 4

In this back portion, I believe we're showing, so we lost one for a turnaround space. for that gate, so here which are one, two, three, four, five, six, seven, eight, nine, 10.

15:47 – 16:06Speaker 5

But again, they won't all be there at the same. I'm sorry? They won't all be there at the same time, so. Okay. Lane, with this change, does the basin need to be fenced in or anything like that? Is there any requirements for that?

16:08Speaker 7

There is no requirement to fence it in. Compared to some other ones, it's fairly flat slopes.

16:19Speaker 1

Do you have any other questions, Wayne, on this?

16:28Speaker 7

There's no other fencing besides that chain link gate. That's the only fencing you're going to have.

16:35 – 16:57Speaker 7

I did notice that some of those, a couple of those catch basins are low. I WONDERED IF YOU'RE GOING TO MAKE ADJUSTMENTS TO THE FRAMES AND GRAITS ON THOSE CATCH BASINS WHEN YOU MILL AND REPAVE THE PARKING AND THE DRIVEWAY?

16:58 – 17:28Speaker 4

YEAH. just some direction to make sure that there's positive drainage away from the building and that the lowest point for these areas are the connect basin. So that means changing the room slightly, a tent or two tents we have.

17:28 – 17:58Speaker 7

The drainage basin, I went out and looked at that as well. I think it needs more than a mow. It has some trees growing out of it. I'm guessing that it's silted in. It may have to be regraded. so that it's operating properly. And those pipes are plugged, so you're gonna have to clean those out.

17:58Speaker 6

You're listing as only three service bays for your parking calculation?

18:05Speaker 4

Yep, that's what's on the building existing.

18:14Speaker 6

WELL, YOU'RE GOING TO HAVE MORE THAN THREE SERVICE BAYS IN THE SHOP, AREN'T YOU?

18:20 – 18:33Speaker 4

YEAH, I MEAN, I THINK WE WERE JUST DOING IT BY THE DOORS THAT WERE BEING SHOWN ON THE BUILDING. IF IT'S CONSIDERED HOW MANY PAINT BOOTS OR HOW MANY MODEL REPAIR AREAS THERE ARE, WE CAN UPDATE THE CALCULATION, I THINK.

18:34Speaker 6

WHAT ABOUT SALES AREA? ARE YOU GOING TO HAVE ANY KIND OF SALES AREA IN THE FRONT?

18:40 – 18:57Speaker 5

We would not, we don't sell anything. We have a customer service waiting area, but there's no typical, there's no sale. We're not selling anything.

18:59Speaker 6

So maybe we could kind of show them, you know, ANTICIPATED SERVICE BASE SO WE CAN GET A BETTER FEEL AND YOU MIGHT WANT TO SHOW WHERE YOUR OFFICE TYPE AREA IS.

19:09Speaker 5

SO WE CAN CALCULATE OR ZERO IN ON THE PARKING A LITTLE BIT BETTER.

19:14Speaker 4

NEW SPEAKER SO WE HAVE FOUR OFFICES ALONG THE THIS CORNER OF THE BUILDING, THE MAIN

19:43 – 19:57Speaker 6

AND MAYBE YOU MIGHT WANT TO DESIGNATE ON YOUR SITE PLAN WHERE YOUR EMPLOYEE PARKING IS VERSUS YOUR CUSTOMER SLASH SERVICE BAY PARKING? YOU'RE SAYING YOU'RE GOING TO PUT YOUR EMPLOYEES IN THE BACK? IS THAT WHAT YOU'RE SAYING?

19:58Speaker 4

NEW SPEAKER Yeah, I THINK BEHIND THE GAMES WOULD BE AN OPPORTUNITY, BUT THAT DOESN'T STOP AN EMPLOYEE FROM PARKING ON THE BROADWAY.

20:04 – 20:16Speaker 6

NEW SPEAKER I JUST WANT TO MAKE SURE YOU HAVE THE PARKING FOR YOUR SPACE. IT'S A LARGE BUILDING. YOU CAN CERTAINLY GET A LOT OF SERVICE BAYS IN THERE, SO TO SPEAK.

20:17Speaker 5

YEAH, I GUESS MY QUESTION WOULD BE, HOW DID THEY DELINEATE SERVICE BAYS BEFORE?

20:23 – 20:39Speaker 1

BECAUSE I THINK WE JUST USED THE STROKE OF WHAT THEY HAD THERE BEFORE. WE USED IT FOR THE FLOOR PLAN. SO REALLY, FROM A PAYING to separate that.

20:39 – 20:58Speaker 5

Are you going to have lifts and stuff in there? We don't use lifts because we're not like a service department. Most of the work will have typically one frame machine that will pre-measure and measure the car on that's movable. But the rest of the floor plan, we need it open floor plan as much as possible because we're moving those vehicles around.

20:59Speaker 8

I thought I heard you say the words paint booth.

21:04Speaker 8

So you're in, you're going to be a you're going to be a body shot?

21:10Speaker 8

I'm kind of made this tire, right?

21:15Speaker 1

No, this is not made this tire.

21:17Speaker 8

This is what?

21:17Speaker 1

This is not made this tire.

21:19Speaker 8

Oh, all right. Disregard. Disregard.

21:36 – 22:03Speaker 4

okay well yeah i think that i think the goal and the overall interpretation for our our site plan was if there's going to be at a maximum shift change 10 employees i've got all the same time but we provided enough parking to delineate for 10 employee spaces and then we have eight including one ada accessible stall with one strike area for uh customers and

22:04 – 22:54Speaker 5

we can definitely eliminate it on the site plan is the request to dedicate those spaces only to employees or no no but i'd like to just make sure you have adequate parking okay that's all yeah no problem that's all i see that the auto repair in front is totally wide open to the front uh i'll say west of the office that could be seen from have a building on central avenue you can't see where is it uh it's 808 central line across the street yeah i think we had discussed that at the previous meeting as well yeah is this no new about the

23:09 – 24:22Speaker 4

so what that is you have no doors going from inside to outside of that area there's man doors just man no service rooms that's right so it's not like you can drive around the building right so yeah if you need if you did need more parking there's a potential for employee parking well that what it does is there was an issue there was a this side in the back so that there would be no vehicle parking at that location. So what we did is we took edge of pavement, made sure that there was adequate circulation from the corner of this building so you could get around here. And what we did is we had a new edge there's 28 feet from the corner of the building to that edge of pavement. And then there's about another eight feet of green space to the property line. So if we brought it back and added that paint, you know, essentially just paved over the gravel, then there could potentially be enough room for more parking gas. And I think that dumps. Yeah.

24:22Speaker 5

So with your other stores, how many customers do you think you have?

24:30Speaker 1

It's not a typical, you know, high traffic area.

24:34 – 25:13Speaker 5

I mean, if there's one to two customers at any given time, that's probably a lot because they're leaving their cars for an extended period of time, typically 10 to 11 days is the average cycle time. So, you know, I would say you might have adjusters coming in and out or DOING ALL THE WORK FOR THE INSURANCE COMPANIES NOW, AND ALL THAT'S DONE REMOTE OR THROUGH PHONE AND VIDEO CALL STATES. AS KEVIN NOTES, IF YOU'RE GOING TO HAVE 10 EMPLOYEES, YOUR WHOLE BACK PARKING LOT IS

25:38 – 26:04Speaker 1

The existing store already has that parking along there. Is that correct? That's correct. So you're not adding any parking. And the only reason I'm asking that is when these plans go to the fire company, I'm sure they already have a footprint of this building and they know where they can go around the back of that building, even come into that recessed area.

26:04 – 26:51Speaker 4

so we uh i talked to wendy this week she did talk to um the fire department and they provide a comment that said that they have no issue that they will work to get a knox box on the building and they'll um they have no comment on the site plan and they'll walk the site yeah during the building permit process perfect yep good um as far as the existing parking that's there we're actually just milling and overlaying it so We're just defining it better, essentially. So we'll do 9 by 18 spaces, fresh striping, clear pavement arrows, stop signs. Pretty typical. Very typical to what's happening existing.

26:51Speaker 1

And earlier in the conversation, you talked about the drains. They'll be corrected with that process. Okay.

26:58 – 27:32Speaker 5

All right. If you have trucks or cars that come in on a flatbed or tow truck, yeah typically they would come in and yeah they're like i'm saying do you need a turnaround or do you have anything they need to turn around most of the stuff that is on a flatbed is typically totally so we don't see them as often you know one out of every four meters it's not like the old days you're mostly no more cosmetic it's more cosmetic changing the fenders and

27:58Speaker 1

Any other questions?

27:59Speaker 8

I said we would make that happen.

28:04Speaker 5

You asked that question. There should be a note on that plan right where your right elbow is that says

28:32Speaker 4

Yep. Are they on all the time? No, they'll go off at the same time the building lights and the sign go off.

28:42Speaker 5

What about Saturdays? Saturdays, I think it would be 8 to 12.

29:08Speaker 1

NOW WE'RE REQUIRED TO HAVE A PUBLIC HEARING ON A SITE PLAN? IS THAT CORRECT?

29:13 – 29:27Speaker 3

IF I REMEMBER CORRECTLY, I THINK THE LANGUAGE IS THAT THE PLANNING BOARD MAY ORDER PUBLIC HEARING. SO YOU'RE NOT REQUIRED TO. HAVING ADVANCED MY EXPERIENCE, THE PLANNING BOARD ALMOST ALWAYS HAS PUBLIC HEARING ON A SITE PLAN.

29:29Speaker 5

WE'RE ON SEVENTH.

29:31Speaker 6

YOU GUYS TYPICALLY HAVE ON SEVENTH.

29:33Speaker 1

OKAY. Wayne, do you have enough material there that could theme this complete? Yes. Or public review?

29:43Speaker 7

My opinion is complete enough for a public hearing.

29:46Speaker 1

Okay. Does anybody have any other questions?

29:50Speaker 7

That would go to the county at the same time.

29:53 – 32:30Speaker 1

Right. And we would be scheduling a public hearing at this time would be the second meeting in October, which would be the 15th. And that would give you plenty of, hopefully, plenty of time for us to have the county respond back. I don't think there should be any issues, but you never know. So we will see you on the 15th. Public hearing starts at seven o'clock. You are first on the agenda. for the public hearing and then you would be the first on the agenda for the meeting. Okay. And you would be, you know, if there's any comments, you'd be required to respond in writing and so forth and so forth. Bowler should be pretty familiar with that. Okay, that concludes our agenda. We have one item under new business, and this is a waiver subdivision application, but it is actually a lot line adjustment. This is for Robert Miner at 82 South Road in Cropseyville. Would you like to come up and tell us what you got to do? HISTORY OF THIS COFFEE. IT WAS CREATED IN 1993. Block one, where the miners live.

34:29Speaker 7

NEW SPEAKERS. NEW SPEAKERS. NEW SPEAKERS. NEW SPEAKERS. IS THAT AN EXISTING PROPERTY CORNER,

35:20Speaker 5

The right-of-way

35:45 – 36:00Speaker 2

as originally done will stay because that's already in the deeds too. Okay, so that won't change. So that just the ownership will go. I believe that, I believe I'm following you.

36:16Speaker 1

So this doesn't affect Andy Gilchrist at all?

36:24Speaker 2

That's why that original location has to stay because that's his access to his property.

36:30 – 36:41Speaker 5

Right. All right. Yes, I see the right-of-way that you're going to transfer. I don't see the rest of the land.

36:42 – 36:58Speaker 2

If you look at the south end or the bottom of the right of way, go off to your left. That's the additional land that's being added to lot one. It says right on it, revised lot line and also original lot line.

37:02Speaker 1

This is the original.

37:13Speaker 2

Mr. Carbox, I agree with you.

37:15Speaker 5

It's just a private driveway. No. There's no change to the right of way or anything like that except just shifting at the end there.

37:46Speaker 7

All right. Are you all set with that? Looks pretty straightforward to me.

37:55Speaker 5

Okay. So the driveway is owned by who?

38:01Speaker 2

It's owned by Robert Miner. Exactly. So we're proposing we want it to be part of lot one now instead of three.

38:17 – 38:53Speaker 1

OK. Anybody have any other questions? Usually, procedurally, we introduce all applications under new business. Give everybody an opportunity. You just got this material. An opportunity to review it further and then schedule hopefully be an approval meeting. Okay.

38:53Speaker 2

October 1st meeting?

38:55 – 39:22Speaker 1

Yes. Okay. Does anybody have any comments on that? Normally we don't do any type of action on it under new business. Okay. Thank you. So we will schedule you for the October 1st meeting, at which point Everybody will have an opportunity to look at this further, have any questions, and then move forward. Okay. Okay.

39:22Speaker 2

Very good. Thank you all.

39:23 – 41:09Speaker 1

Okay. Thank you. And that is the only new business. Is that correct? Is there any old business? Okay. I just want to go through our agenda. I had under... on our own business here. Does anybody have any, you were asked by Mark separately to review the comprehensive plan. I know I haven't really done anything with it, but does anybody have any comments that they'd like to offer on that at this time? Okay. Then moving forward to our next meeting on the 1st, we have The Fisher Minor Subdivision, and this is contingent on Chris formulating a in-depth resolution, a draft resolution. He's in the process of doing that, and hopefully we can move forward with that. So that's number one. We did have a public hearing originally scheduled for that under Lawfield. That was the That was the special use permit for the freestanding solar collector. He has taken that off. SILUS is asked to be on for the 15th. So right now, we only have two items on October 1st. One item.

41:10Speaker 5

Fisher. Fisher and Miner.

41:12 – 42:11Speaker 1

Miner. That's right. And then on the 15th, we have Sillis. And we have the public hearing for the 810 Hoosick Road, which is the body shop. Is there any other items that I'm missing? All right. With that being said, I think the agenda is set. Just as announcement, I am not gonna be at the meeting on October 1st and Dave will chair that. So just so you know that. So everybody should attend that meeting. You need a perfect attendance on that. Anybody have anything else they wanna bring up? Hearing none, I'll make a motion to adjourn. Do we have a second?

42:13Speaker 1

All those in favor? Any opposed? Thank you.
