City Council - Regular Meeting

Call this meeting to order. Mr. Tullis. Yes, sir. Mayor and council members, if you'll look at your Q3 goals, there's a couple of updates that I want to highlight in there. Most of them are still actively working, but the parks and rec maintenance facility should be completed next week. The Bellwood TAP project should start this week. So both of those are good updates. Excited to see those finally come to fruition. We still are struggling. I know the mayor tried to talk to school superintendent today. I don't know if he got a chance to talk to him about the old Cottonville agreement, but I know that our city attorney has emailed a couple of times, once last week and once this week, and we haven't received a reply back, so I guess that's still in limbo. Chief Moore is at Chief's Conference, so I would suggest maybe the first meeting in September to have him brief you on those technology solutions. as well as mitigating speed in residential neighborhoods. We are actively working with First Baptist Church on their parking situation to come up with a proposal to bring to you. That would need to be agreed upon but also funded in next year's budget. The Rucker Boulevard Connector, we're actively working on that. We've left it with the various property owners that potential routes might go through to see if they can come up with a Proposal we have about 70 to 80 percent of the route At this point but a couple of property owners We haven't had a lot of movement with The Rucker Boulevard study and plan we plan to introduce that I talked to Tim and we've got a meeting tomorrow at 2 o'clock but we should bring that to you at the next council meeting to approve and And it sounds like our engineering department has some code updates That we would like to bring you as kind of a package As well, and I think what would be prudent is to introduce that since you haven't had a chance to review those If we don't get it to you in time to go ahead and introduce that to you in the work session at the next council meeting If you've got any questions, we can answer that and have time before we actually bring it to you to formalize.

Last meeting, we'll do the quarterly updates on nuisance properties and customer service. My understanding, and I think Councilwoman Rich called at least me, but when you were at your meeting in Birmingham, you heard from a lot of communities that are struggling to figure out how to deal with nuisance properties. I don't know if you want to share that with your colleagues or not, but that I think you were proud of the work that we've been doing, and I know that Barry Mott told me that we're done with phase one and two right now and working on our third phase.

Let's look at some conversations about blight, you know, communities having some difficulty with old properties, you know, getting in contact with property owners and just cleaning up the areas and didn't really know what avenues to really take. And we were one of the few in the room, you know, I'm talking about larger cities, much larger than us, like Bessemer. was having a lot of issues, red tape, doing that. So that was good to hear that we're ahead of the game with a lot of communities with our efforts and what we're doing down here. So they didn't even know about, some council members didn't even know about the grants that we've been afforded to have for demolition and stuff like that.

It certainly made me feel good to hear your comments. You always question if we're doing enough or the right thing. Appreciate you sharing this.

I do have one alibi with that. It's not on the goal sheet, but something that was brought to my attention is the August 11th election. And so why I'm talking about it is a lot of people show up to the rec center because they think that they voted in the municipal election and that's where they need to go vote. So there is some confusion that's out there, as well as helping our local county elected officials that have to oversee those elections. So understanding for the public where to go, that that election's even going on. I recognize that voter turnout was low in the last two. So any help that you can give the public, I know Emily plans to share that. She might have done that today. and then we'll do that again the day of the election, but just wanted to put that out there for all of you.

Then we'll move to the consideration of consent agenda. We have accounts payable for $1,609,944. Contracts billing, $13,950. Kimley Horn & Associates, $13,950 for contract service for Main Street Signal Project. Then we have some travel requests. Are there any questions on the consent agenda? All right. And then the chamber is going to request to have a permit for the Bull Weevil Fall Festival and the Enterprise Christmas Parade. Any questions on that? Any issues with dates on this? All right. Yes, sir. So real quickly, I'll let you know that the FAA grant that we received at $6.8 million worth of construction part was like $7 million total project, which was 97.5% grant, 2.5% local match. This is the construction contract that we went to bid. This is the low responsive bidder that we received. It was a recommendation from the engineer to award it. This is the construction dollars that were put into those grant. However, It wasn't ready to bring to you until tonight, so what I'm asking tonight is for you to allow us to enter into a contract with the construction company, S.A. Graham. They are the last contractor that worked on the road relocation for 606, so this is all covered by that 97.5% grant that you all approved, I think, two council meetings back.

Any questions? All right, then we'll move to new business, and we'll introduce Ordinance 080426 for enacting procedures for broadband fiber providers and their contractors.

Good evening, Council. As you recall a few months ago, we started talking about some of the issues that we were having with broadband fiber and how it was being installed in the city. And then our wonderful, wonderful former city attorney, Rainer Cotter, reached out to the city and proposed this ordinance to us. And so that was the ordinance that you guys had circulated a few weeks ago in that you guys made some suggestions to us for changes which have been incorporated. And then what we did was we took the ordinance and took it back to Rainer just to get his thoughts on it since he kind of started the process and obviously he has a very sound legal mind and he made a couple of suggestions that we incorporated into this ordinance which we have one of which was we initially talked about that there was a 30-day notice requirement for the initial installation and his concern with us using the word initial was the fact that if we said initial if the broadband company were to come back you know a month later and have to adjust something or to work to work next to a similar parcel that the 30-day notice would would have already happened under the previous work and he thought that if we remove the word initial that way it covered those situations like if you have to go back in and do the property next door or something like that that person deserves notice as well and So he thought it would be better to clarify that, which we did. Also, the other suggestion, which is the only other change that we made since then, is in this ordinance, we talked about that the city engineer could deny a permit. However, we didn't put in a process to require a permit. So what we did is we added a process that, okay, now you've got to get a permit from the city engineer so that then the city engineer can later deny the permit should it be necessary. Are there any other questions about any of the changes in this ordinance from the last version you saw? Tonight's just the initial reading, so you'll have a chance to vote on it at the next council. Thank you. Then review and consider resolution 040626 for amending the biweekly payroll period.

So, Council, if I can, I'll try to go through the next, I think there's four resolutions that are on here. So, we had talked about this in the last couple of months as we transition over to PACOM and automate a lot of our processes. It gave us, particularly our HR department, some time to review how we're doing business. One of the issues that we ran into on the pay period, people will still get their checks on the same day that they've always gotten it on, on Friday. But because when the pay period closed, as we transitioned to Paycom, they're having to do a lot of work in a short amount of time on Wednesdays. And so this will allow them to close out the pay period a couple days sooner and have multiple days to work on it, catch any errors that are in there, which will prevent a lot of work and make it easier on our admins across the departments and streamline that process, make it much more efficient for staff. So that's what that first one does. And if you'd like, I can keep going down the list for the next resolutions because they're all kind of interconnected. Is that okay, Councilman Pageant? Yes, absolutely. Okay. So under the FLSA Fair Labor Standards Act, Police and fire have some different rules than what you all may be accustomed to. Our last ordinance that dealt with that, particularly on the fire side, was done in 93, and I think it set a 21-day period for audits. We weren't in practice doing that, so we're setting the new standard for police and fire for those respective audits. Time period says audit periods are allowed up to 28 days. So I think we're doing a 14-day for fire and 28 for police. Is that still correct? Police patrol. So the next one for battalion fire chief, we're going to set them on a salary that, in practice, that's what most communities have. In keeping with that, we looked at the prior pay for the battalion chiefs who also got overtime. And with that, so nobody's pay is going to be cut. In fact, if anything, it's going to be at or above what their prior years have been. But we wanted to make sure that we set those. And our police, to put it in perspective, our police captains were already salaried. And so... It just aligns with the practice of what we're doing, and it fit the job as our HR director looked at it. They met the conditions to qualify as salaried. So I think this has been reviewed with Chief Davis and with Chief Moore for both the police and the fire departments, and I think they concur with the changes that are being recommended. Is that still the case? Okay. And then the fourth one here on the grade and step pay plan for police and fire. Every grade and step will be changed as a process for how we're accounting for hours and changing this pay period as well as the audit period under FLSA. Every grade and step will see an increase in pay. So no one's pay will be We'll go the other way. Every police and firefighter for every hour they work will get paid a little bit more than they were. And it varies by grade and step. But in essence, I know that was one thing that you asked us to do. So do no harm. So everybody's paycheck will be a little bit higher based on the changes that are before you tonight if you approve them. And so we I think those were reviewed as well by our fire and police chief, and no issues. I don't know, Captain Griswold, chief? Okay. So that's what those four represent. And really it's just going to make us more efficient and be able to automate these processes and actually in practice do what the resolutions that we were able to find from 1993 are actually that we're doing what we have approval to do.

I'll let the respective chiefs. I don't know how much they're aware, but I know that this was talked about in the police and fire department.

That'll start tomorrow because one of the things I didn't want to do was give them information and then something in the meantime change, which is a good way to start issues. So we'll be going over all that tomorrow. I have gone over it with quite a few people. Two things firefighters hate is change in the way things are. So it'll be good. Everything I've looked at as the numbers, I think everybody's going to be Happy. At least that's my hope. If I have a black eye next week, you'll know that wasn't the case. Okay. Thank you, Chief.

Good evening. Prior to Chief Moore leaving, he had to sit down and talk with the division commanders and the supervisors, so we're aware of the changes that are coming. We haven't really said anything, kind of like Chief Davis said, That'll be done within the next coming days as to what happens with what respective division and the patrolmen and the detectives it'll affect.

Just to explain this a little bit, we are hosting the Main Street Conference here in a couple of weeks, actually, so it is coming right up on us, but Par and Poor has agreed to be part of the banquet that will be a part of this conference. Each year, there is an alcohol portion to the banquet, and this was just the easiest solution that we had to not only show off our stuff, but also to support a downtown business. but we have gone through the motions. They're very familiar with the process. She's gone through all the hoops with ABC and insurance, but we just wanted to bring this before you to receive that licensure. Thank you.

So the mayor's office has been already getting some requests about what the plan is for Halloween. So we thought we would go ahead and be a little proactive and appreciate Emily for bringing that to my attention. So in past years, it's usually the day of, unless it's on a Sunday. This year, Halloween falls on a Saturday. October 31st is on a Saturday. In years past, we've set the hours from 5.30 to 8.30 p.m. So we're gonna recommend kind of doing that same precedent of the day of unless it's on a Sunday and approving the hours from 530 to 830. And so I guess this is twofold. I don't have anything on the agenda for you to formally approve, but we do want to go ahead and start when we get phone calls or organizations have called down at City Hall, we want to tell them what we think the hours will be. and then we'll bring you something if you like this to approve it at a future council meeting.

A few years ago, didn't we go ahead and just kind of do this for multiple years?

I haven't seen anything. We did?

Do you know what years that went out to you?

Probably through the end of the last council, I would imagine.

Yeah. So Emily has taken time to write out 26, 27, 28, and 29 here, so I assume that was the thought process here. It falls on a Sunday in 27, so the recommendation there would be Saturday, October 30th. In 28, it falls on a Tuesday. We'd recommend keeping Tuesday. And on 29, it falls on a Wednesday. We'd recommend keeping Wednesday. With 530 to 830 hours. So if we do that again and you'd like us to bring all four, take us out through the end of the next council term, we can do that.

I think it worked last time. Was anybody else? No sense in having to come back every single year about something like this.

All right. So now the budget meeting date is scheduled for, I believe it's August 27th, 26th, what is that date? 25th, 20-something, 25th. In spite of all the calendars that I looked at, I inadvertently have double scheduled myself and will not even be in the country on that day. I don't know what opportunities are available to possibly change that date. But if it's possible, I'd like to entertain that idea. But if not, we'll figure something out.

So my recommendation, just off the cuff from a staff perspective, is we had the 26 as a target. If you move it any closer to today, you're probably going to get a degradation in product. Um, so my recommendation would be to, you know, if you're going to move the date, move it, you know, further out closer to October one. Um, I will also note that, you know, in years past, it's not, you know, a mortal sin to approve, end up approving a budget at the first or the second meeting in October. Uh, it's not ideal, but, um, If we need to, we can certainly do that.

Well, I definitely apologize for creating the problem. But I'm pretty much available any time in September for my calendar. I just messed up and agreed to that date, not realizing it was on the same date.

Is it not advisable to do it on the same day of a city council meeting? No.

That's really a question for you. I don't advise it. Okay. How much do you want to be here?

I'm flexible. Whatever the council needs, I'm flexible.

Do we need to have it before the 15th? Is that typically how we've been doing it, trying to have it before at least two weeks before the end of the month of September? No.

I mean, ideally, you would approve the budget prior to October 1st. So the second meeting in September would be the last opportunity you'd have to do that, unless you called a special called council meeting, which is also an option.

So, you know, I don't, you know, I'm available pretty much any time, like I said. So I know we had it on the 25th, which is a Tuesday meeting. a non-council Tuesday, so the 8th of September is a non-council Tuesday. I don't know what everybody else's calendar looks like on that.

Well, I think the concern for me is making sure that anybody that has conflict conflicts has the opportunity to do what they need to.

I would, I would suggest seven 30 or eight. I mean, most of our employees that, you know, especially ones with, with children, um, with school starting back, we'll have, you know, at least to figure out child care or dropping kids off in the mornings. So they were going to be at work by 7.30. So, I mean, that would be the earliest I would suggest.

I mean, is 8 o'clock work for everybody?

I will check on the only other thing is location that I'm going to have to check on, but I'll find a location. Okay. and get that back to you. So we'll try to keep it at the farmer's market. If we can't do it there, we'll try here or other locations until we find something. But we can make it work.

Okay. Hopefully that won't affect anyone that's needing to come and speak to us.

Yeah. Yeah, and we can talk a little bit more about that if you want, but I know this year we've done – kind of the appropriations process. So there should be sort of a fairly robust book of information, whether or not you deem it necessary to have the agencies come in and brief you on that or not. I'll leave that determination up to you, but there, there should be enough supporting, like they're telling us what they, what they want and how they want to use the money. And I know that was a concern for at least some of on the council, was the amount of time we were spending with those respective agencies. So this should streamline that, and whether you want them to come in, we'll certainly do that.

I know I was one of the people that was talking about the length of time. I wasn't bringing up names.

My intent is just to have those organized and sent out to you guys before even the budget books are done so that you have time to go through the information. They did send in a lot of information because on the new appropriations policy, we do require a lot. a lot of things be checked off that checklist. So my staff has gone through and made sure that all of those things were accompanied with their application. I'm not gonna necessarily send you guys every single piece of paper that they sent in to us. We're gonna make sure that they've checked it off though if you would like to see it or would like to see more information than what I send out to you. please just let me know. But the intent there is staff is organizing that into like a document or an executive summary, I guess. Cliff notes. Cliff notes. There we go. Oh, see, great. And I will get that sent out to everybody well before the budget meeting. So that way, if there's questions or there's something we can do to follow up on that prior to the meeting, we have time to do that. Okay.

Good evening. I'm here on behalf of the Downtown Enterprise Business Association, Friends of Main Street. And I have some people joining us today from our local community college, Enterprise State Community College. Danny Long, our president. Shelly Stump, the vice president. And Kevin Ammons, the dean of students. And also on the other end, we have Jenny Brown from Parks and Rec and Lila Falk. see if I don't forget anybody's name, from Parks and Rec, and Lily McDaniel from Main Street Enterprise, our director. Joining me, I have Allie Mackwitt from Par and Poor and Kimberly Pageant, who both serve on our board, and we're here to talk about the Hometown Heroes event that was held in Enterprise. We held this event on June 6th downtown, and as a result of that event, We are able tonight to award $8,000 in scholarships to ESCC. We had a fundraising opportunity through the event and it pulled the community together as we recognized hometown heroes that included first responders, military, and all of those that serve our community while keeping us safe and we can get to enjoy all of that. One of the primary goals of the celebration was not only to recognize those who serve our country and our community, but also to support the families who stand beside them. And that was where we came up with the monetary gifts to be used to provide scholarships for these students. The success of the Hometown Heroes celebration was made possible through outstanding partnership between the Downtown Enterprise Business Association, Friends of Main Street, the City of Enterprise, which we greatly appreciate, our major community sponsors, local businesses, volunteers, and countless community supporters. Friends of Main Street extends its sincere appreciation to many city departments and agencies whose participation helped make the event a memorable tribute to our hometown heroes. A special thank you is also extended to our Enterprise Parks and Recreation Department for hosting the Freedom 5K and Fun Run, which served as a key fundraising element in this event, and those registration fees and proceeds went directly towards the scholarships. That was a nice addition to the event that provided a lot of scholarship funds. And also to our downtown businesses who agreed to do matching funds to provide a total of $8,000 in scholarships. So now we want to recognize those that are receiving those scholarships and celebrate with them. The scholarship recipients exemplified not only outstanding academic achievement, but also a heartfelt commitment to live a life of service to others. And tonight we want to celebrate these recipients. A $1,000 scholarship is awarded to Landon Bailey. A $1,000 scholarship is awarded to Brianna Wetzel. Elizabeth Smith was awarded a $2,000 scholarship and she was unable to be here tonight as she was traveling. And then Alyssa Allen received a $4,000 scholarship. I would note that all of these students are participants in the new nursing program out at the college, and we're very, very excited about that as the college continues to invest in these new programs. And we appreciate their support for these students, and they're very excited to be going into some new facilities and work towards those degrees that are so vital to our community. And the Downtown Enterprise Business Association looks forward to hopefully making this an annual event. a very meaningful event for those that participated, and we look forward to growing that in the future. Hello, good evening. It is my annual plea for street closures for the Bowieville Fall Festival on Saturday, October the 17th, as well as the Enterprise Christmas Parade for December the 3rd. There's nothing really... too different about either of those events or the street closures. I have provided the streets and the information to Chief Moore and Captain Kent. And as they need any more information, they said that we were good to go. So I will leave it to you if you have any questions.

Thank you, Mr. President. As we come to the close of tonight's meeting, I want to leave everyone with a few thoughts as we begin a new school year. This week, students across our community are headed back to the classroom. For many families, it's an exciting time filled with new beginnings, but it's also a reminder that we all have a responsibility to help keep our children safe. You heard me say it before, where there's a ball, there's usually a boy or girl not far behind. Please slow down in our neighborhoods and school zones. Watch out for children walking or riding bicycles. Obey the posted speed limits and follow the direction of the school crossing guards. Some of our schools have adjusted their traffic pattern this year, so I ask everyone to be patient during these few weeks as students, parents, and school staff sell into their new routine. As the school year began, you will notice a new few seasonal changes around the city. Our recreation and the quarter center pool has been moved back to the school schedule and will remain open throughout Labor Day. Construction is underway on the new playground at Johnny Henderson Family Park. New blade signs are now welcoming visitors throughout downtown. Our gateway signs are in place, and we are celebrating National Form of the Market Week by recognizing what makes our market such a special part of our community. You'll also continue to see ALDOT crews resurfacing several of our roadways. We appreciate everyone's patience as these improvements move forward. Enterprise continues to make progress in every corner of our city. These projects are investment in our future and in the quality of life we want for our citizens. Thank you, my fellow council members, our city employers, our school officials, and everyone who helped make Enterprise such a wonderful place to call home. As we leave tonight, I simply ask everyone to keep our children in mind, slow down, stay alert, and help us that this is a safe and successful school year for everyone. Thank you, Lord, for coming tonight. Certainly echo Mayor's sentiments for our students as they prepare for a school year, wishing all our students and our educators a successful year. I'd like to also extend, and the teachers, my wife being one of them, thank you, Ms. Regina, for being here to present the awards and scholarships. It's always nice to see us giving back as a community to those who deserve that recognition. As Mayor said, please be patient with some of the projects going on out there in the city, the paving and whatnot. It's kind of disrupting everyday life, but we'll be better off in the long run for it. And thank you to the staff for everything you do. HR and finance has done a lot trying to get Paycom and some of these new software upgrades up and running. And I think we took one more step tonight towards that to be a little more efficient, a little more effective in our processes. So thank you all for attending.
