Good evening, council. Uh most of you know me, but uh for those that don't, I'm Richard Kennedy. I'm the president of the August Railroad Club, and I'm just fulfilling uh my annual appearance for you guys and answer questions you might have of the railroad club. How's it going? And how have you had a people going through?

Uh we've had a couple new members. Um we've got a couple actually um residents of Augusta um that have joined the club in the past year. Um other than that, uh I'm going to coordinate with Connie Hmel of Augusta. We're going to try to be involved with the 250th anniversary um Fourth of July leadup um celebrations. Um, not quite sure what that's going to look like yet. I'm going to bring it up our next meeting, which is the first Thursday of May coming up. So,

I know I say this every year. I sound like a broken record, but I sure would like for you to put a train model train uh model train track put together and show it off for your club downtown in a in a window up front window every Christmas time just so you can brag on yourself, you know, let people know about you. I would like to see that. I'm sure there's places out there that would be glad to allow you to do that. But, you know, I don't want you be nobody know about you. I'd like to see if you could bring some some visitors to our town.

We've we've come to the conclusion that if we don't start planning it about now, it's extremely difficult to get it. uh you know when it when everybody's thinking about it come the holiday season it's already way too late to undertake an endeavor on that. Um but if there's anybody else that's interested I think in the last couple years we've provided one for um the Redbird Brewery and for Miller's 5. Um so if there's anybody else that'd be interested um by all means reach out uh and uh we'll be in contact and we'll see what we can do. But yeah, if we if we don't find out about it in about the next month,

Powers 1923 Meadow Lake. Um good evening. I'm coming to talk about uh 114 Lakerest. It's the lot just north of me. Um variance meeting two weeks ago, I think. Um and man, uh wanted to bring to the council the fact that my understanding there's a a light pool that's going to be located um and that the property owners providing city with a um easement um and possibly a power line or power pole be moved behind the house or at the zooming in there um to the west side on the lakeside. Um, and so my understanding is that the city electric department is going to do all that stuff for free. And so just my take on it is if all that stuff needs to happen to build this home, I think that the city should not be the one, you know, making ends meet for the builder. So that's just my comment and my thought. So

for clarity, you're thinking the builder should pay for that, not not our tax. who came I talked to him earlier in the week about this and the way he was he was sure because there's a street light pole right by the house on to the right and then there's power pole in the back and he was not sure if the city was taking care of responsibility of trimming the trees and stuff on that left hand side plus moving the poles or that was something that was going to be done later or this project with electric distribution. We had them go out and look at the pole. It shouldn't have been built that way with right there because the line is coming through not the middle of the property, but almost all of the property. So, it makes it undevelopable having that electric line installed the way it was installed however many years ago. It only feeds white people in the front. Um, so electric distribution has said that they would relocate just that pole and that line for the light and and we are obtaining an easement along those trees. Um, our intent conversations I've had with Davis to stay out of the trees will still be in the ement but not be pulling a line through the trees. Um, so there's I don't think there's any intention to take the trees completely out. Um the other poll in the back corner that just came up as discussions for future improvements um to the electric utility and that that pole may need to be replaced in the future and they would pull it out a little bit further to make sure it wasn't on the property line. Um but they're not redoing everything. They just that pole may need to be replaced in the future and they would make sure to move it out further.

It not the pole in the rear, the hole in the front of the property that feeds the light, the street light electric distribution is going to and the electric utility is going to incur those costs. This is where the line was originally installed. Was it on the property line or even near the property line? I guess I can't remember how far. It's like 30 50 feet into the property.

Yeah, I understand what you're saying. I just you drive around town and that's the condition all over. So I don't I hear what you're saying that you know he can't develop well he can't develop it to a certain footprint that he's wanting but doesn't mean that he can't do something and there's there's lots like that all over town where the lines coming across and all too same. So, and they might be private rather than a public portion of the line, which this one is more of a public portion of the line. Um, and I'm just sharing the conversations I've had. Um, can definitely follow up with elector distribution if we need to get more information.

It went through the board of zoning earlier this month for a variance to the front step back. Variances that go to the board of zoning appeals do not come to city council. I just see that going across there and I can't tell how much that is. if that's enough to put a house on or what and they requested a variance to the front setback.

Their concern was the house is coming forward and now you've got really no place to park there for whoever's going to move in there. Is that going to end up being a problem for the residents in that neighborhood if you're moving the driveway and everything up another what 10 feet? We don't have any regulations that regulate street parking as far as planning and zoning go. Um each subdivision has different stages developed to a certain a certain level to allow on straight parking with it being in the curve. I there is a concern a safety concern for me. There's kids in the neighborhood and I if they can get all their cars in the driveway and in their garage, great. Don't want to up with a problem and the house is already built and

there's no action for the council to take on the variance the setback that was by the board of zoning. Okay. So, you're saying you got to make it simple for me with a coloring book and crayons. So you're saying to me that uh council what happens on that on variances. Interesting. So there's the planning commission and the board of zoning appeals but they have their own regulations to follow. So if he has an issue, does he take it at the plane to the planning or or are we telling him? Well, he he went to the meeting already.

Um, but I just don't have a relationship like that with the city. But still, I mean, it's one thing if we're we're building a hotel right there and you want to bring some business into town or something, but uh just just a house. So,

Seeing none, we'll move on to our business portion. All right. First item of business tonight is amendment number one to facility use agreement and fundated February 2nd 2020 staff. Yes. Uh mayor council Katherine I might just ask you did you have any issues with this uh as it was drafted? No. And I'm sorry it took me so long to get back to that. I was out of town. So it was it wasn't your

Yes. We were able to read through it background for council. Um, we have a an agreement with Flatwater Fitness Fund for Santa Fe Lake and that agreement was brought to you, I think, back in February. And during that discussion, Katherine had asked about a backup option at Augustus City Lake if uh if Santa Fe was ever shut down for like blue green algae or something like that. And we said that there's a couple different ways we could proceed. One of those ways was to go ahead and approve that agreement and then bring back an amendment later that has the language for City Lake, which was the option that was selected. And then I think I forgot about it. Katherine sent me an email reminders that Sean an email reminder. We're like, "Yes, we were supposed to bring that back." So, we got that drafted and uh as long as Katherine's okay with it. I think it's a similar provision to what we had in past contracts to allow them to use City Lake as a backup if Santa Fe is shut down. So, uh, that's what happened. It should have come back to you earlier, but I don't think it's caused any disruption. I don't know how I don't think we've had any issues with Santa Fe Lake to date. So, we're getting it done before it created any issues for them. So, with that, I'll turn it over to you for consideration of this amendment. All right, we'll move on to item number two. Ordinance number 2263 approving a zoning classification from C commercial to I1 industrial at 529 North Long.

Good evening. We're going to spend the next three items together. So um so the applicant who is here this evening has requested reszoning of approximately 54 acres located at 529 North Walnut to allow operation of a towing business. The proposed use includes limited outdoor storage of impounded vehicles and indoor storage within an existing structure. This use is not permitted in C3 which is the current zoning um but is allowed by right in the industrial district zoning. The planning commission heard and approved the case on April 6 um with a vote of six to zero. The subject property is located within a corridor characterized by a mix of commercial and industrial and development. The comprehensive plan designates the property for commercial use. Staff finds the request is not inconsistent with plan goals as the area already exhibits industrial characteristics and the proposed use is low in intensity. Existing infrastructure and public services are adequate to support the use and no additional demands on city are anticipated. There is limited scale again to the business operations and screening reduce potential negative impacts. Staff also note that the applicant provides towing services for Augusta public safety and is currently the only local provider on establishing the local tollyard supports emergency response efficiency reduces officer weight times. Um, no public comments were received by staff prior to the public hearing and no comments at the public hearing that the planning commission held. Um, as you can see, this property is located just to the west of DJ Engineering, which is all zoned industrial. Um, the property on the north corner is also zone C3, but then the properties further west are

zoned industrial. I will note that there are some residential uses um within that zoning district, but it is zoned industrial for future development. Um any residential housing structure and the closest one is 800 ft away from this property. So I will stand for any questions. I said the applicant and business owner is here as well and the property owner Kelly Monlin's here. So, we're happy to answer any questions you may speak to or anything. I'd appreciate your consideration for reasonzoning, but we're happy to be part of Augusta.

yes. The applicant, who is also here this evening. We're we're doing good today. Request approval of a conditional use permit to place two 40 foot storage containers on a 1.6 acre property. The property is located in the city's growth area and according to our future land use maps will be zone C3 general commercial. The containers will be used for equipment storage and site organization with a temporary canopy structure proposed between them. The planning commission heard and approved the case on April 6 with a vote of six to zero. The proposed use is most consistent with a contractor yard and accessory storage which is allowed in C3. The surrounding area consists primarily of commercial and vacant properties with limited rural residential nearby. The proposed containers will be located more than 100 ft from the highway center line. Staff finds that enclosing currently materials may improve site organization and reduce issues related to trespassing and theft. Public input was limited. Um, and these were just phone calls received by staff prior to the public hearing with no opposition expressed following clarification of what the request was. Um, and there were no comments at the public hearing. There should be a site map kind of further down in the site. Oh, keep going. There we go. So this is just west of Santa Fe Lake Road and for and south of 400.

Also in conformance um with the conversations that we had um we put some we talked about the covered area in between the containers and it shall be limited to a temporary canopy or similar structure. It shall not be enclosed without review and approval by the city. So they can't enclose completely enclose that space between the two structures without coming back for review and approval. um exterior appearance. Um just maintaining it in good condition, free of rust, pulling paint or visible damage. Um siding and aesthetic um treatments. If the siding or exterior padding is installed on the storage container, if it's installed, um it will also be kept in good condition. Storage limitations. Um this is just making sure that it's for commercial use and it's not being used um for habitation office space or other occupied uses.

All right. We'll move on to item number four. Public hearing establishing a reinvestment housing initiative at district RH and approval of development plan for Redbud Ridge. One more time. I would like to say we're three for three followers here this evening as well. So this item is a public hearing and consideration of an ordinance to establish a reinvestment housing incentive district or RD for the Redwood Ridge development and to approve the associated development plan. The purpose of the public hearing tonight is to receive any public comment regarding the proposed district and development plan as required by Kansas statute. Following the hearing, the ordinance before you would formally establish the RHID and authorize the use of tax increment financing to support the project. Redbud Ridge is a 4.4 acre infill residential development located east of Ohio and south of D. The project includes approximately 22 units across 19 lots consisting of a mix of single family and paired housing products. The development has completed all prior approvals including reszoning, plan development overlay, final plat and drainage. The RH represents the final step in the approval process and as a financing tool that allows the developer to be reimbursed for related project costs and is stated infrastructure expenses using only the incremental property taxes generated by the project. It does not increase tax rates and does not impact existing revenues. The project aligns with the city's housing needs assessment and comprehensive plan by adding needed housing options and supporting infill development. Staff finds the RHID is appropriate necessary to support project feasibility and recommend ordinance following the public hearing. Following council's action tonight, the next steps will include

finalizing a development agreement between the city and the developer, preparation and approval of the required petitions, and completion of detailed engineering design for the infrastructure. I'm Cliff Shiggley, 10640 Southwest Ashley Road, uh, managing partner, 10 Investments, the developer for Red Bridge. Want to take this opportunity to come and speak to you if there's any type of questions we can answer. We're excited about this. bring an opportunity to bring some housing to us to an incremental process that we hope to continue on to some other projects as well. This will be the first of few other and hope. So we're excited about this uh project. It's a great opportunity to take something that's been sitting there for close to 40 years is like starting to realize I think it was 30 it's like 40 years and it just kind of came to us and it was an opportunity to take something that really was never going to be anything else but maybe this we can make something of it. We're excited about it. We'll answer any questions. I want can answer the work on the leg work on the financial as well as the design of the lot and the housing.

We live just outside. We're still part of 67010 is how I say it. We're not in the town. We are here. We bank here. You know, we do things here. We thought it was, you know, this is an opportunity. Like I said, I I explained to the city manager one day, I said, "There's some opportunity here. Can I explore it?" Said, "Yeah, let's do it." So, we're excited.
