The meeting will be conducted with me reading the request from the agenda. The planning staff will give a presentation and report their recommendations. If the applicant would like to add to the staff's presentation or if someone from the audience has comments, please come to the microphone and state your name and address and the nature of your request. All persons wishing to speak other than the applicants need to fill out a blue Request to Appear form located in the back of this room. The form must be given to a staff member prior to the reading of the agenda item. As required by this board's bylaws, in all cases, the proponents will be limited to 10 minutes. Opponents will be granted 10 minutes as well, with each speaker allowed no more than three minutes. I recommend that a spokesperson be selected if there is a large group wanting to speak on the same agenda item. If four more speaker request forms are submitted, the time allowed for individual speakers will be limited based upon the number of forms submitted. The applicant is requesting a zoning exception to allow an existing single-family residential home to continue operating as a bed and breakfast. Because minimal impacts are to be expected, the staff recommends the request be granted with the following conditions. that the development adhere to the site plan on file, the Division of Planning and Development, provided that the director or designee may authorize adjustments to the site plan in light of technical or engineering considerations discovered during development, that an occupational license must be obtained through the Office of Division of Planning and Development, that no commercial events such as concerts, weddings, block parties, or other large events are permitted, that the occupancy is limited in the maximum of two persons per bedroom plus two additional persons, that all parking must be facilitated on site, that an on-premise sign cannot exceed two square feet, and that the use of the dwelling for the living purposes and does not change the character thereof and have exterior evidence of a bed and breakfast.

Hi, I'm here on behalf of Mr. Thompson. He's my dad, and I kind of manage while he's out of town. He's currently out of the country, so I'm kind of coming in on his behalf. Okay. But kind of gave me some things. Name and address. Madison Thompson, and it's 846 Andrew Mohawk Road. Thank you. So the main thing that he was getting at for this is we're kind of in a different situation than some areas. We're not really under a housing shortage or anything like that. Like he mentioned specifically like Hawaii, you can't really find any homes. Around here it's not really an issue. and the selling market's just not great so it's a really good opportunity for people who do have secondary homes or something like this to kind of offset costs because we did i lived here with him for a little while and he's lived he lived here for many years and then in addition for our larger groups like people who have big families are coming in to visit the casino something like that and they have more than just two to three people Average hotels are around $400 a night, especially the nicer ones closer to the area like this place is. This is a good opportunity for that. We have a lot of sporting families come in and a lot of times a hotel is just not ideal for that situation. So like travel ball, things like that. And then he also just kind of wanted to mention our neighbors have a really good relationship with us with this. We don't have complaints. We are very strict. Parties, anything noisy is prohibited. We follow all the rules that are customary for the area that it's in. And we have especially like our next door neighbor, Ms. Trish Thibodeau, we've talked to her and she said she's had really great conversations and got to know some friends there. but those are our main points to it so far we've not really had any issue and it's off airbnb now unfortunately with this we've been kind of waiting and hoping but um but yeah just it's opportunity to support some tourism here because i always want people to come visit us okay thank you any board members any questions oh yes so the house has previously been on airbnb you've been renting it that way Yes, that was where I think Airbnb and possibly also Vrbo, we had it there until we found out about this situation.
For the staff under the current zoning, that is allowed?
Under the current zoning, no. They're here for the exception to allow.
Okay. So not just for bed and breakfast, but even renting it on Airbnb?
Well, Airbnb and Vrbo are companies that you rent through.

Not a problem. Mary Renette, 2701 Timber Lane, Lake Charles. I live next door to this residence. It has been rented out for the last five years. There are times when there are up to 10 cars in the driveway, boats in the roadside. There are not just one or two people per bedroom. There are more people than that at this facility. And like I said, they've rented this house out for five years without a permit. My concern is safety. I live by myself. Trish lives by herself. There's another lady across the street that lives by herself. We have no idea who's coming and going out of that house. And they not only rent the house, there's another smaller, I guess, workshop area, whatever. It was... parlayed out also to be rented. So there's actually two properties on that property that are being rented. So mine is a safety concern. I don't know of anybody sitting in here who would like to change neighbors every day. I've lived in this neighborhood since 1990. And there's very low turnover. So that is my main concern. Thank you. Board members, any questions?

You can hear me? So can you explain to us what the opposition said about the two properties, the two of this other space? I guess that's located, I'm taking, to the rear of the property or something. Can you explain that?
It was originally actually we had kind of designed it for us to stay in at one point whenever I was a teenager. But it's just basically a building that we've put in a few things for. It's just kind of it's on the property and in addition to it, but it's not exactly it's not rented separately or anything like that. It's just part of the property. It's like a larger shop kind of that's been fitted with a bathroom and things like that for we use it kind of as a mother-in-law suite, I guess is the best way to describe it. But it's just It's in addition to the property because it's there, but it's not like two people can rent out of two different spots, I guess, if that makes any sense.
So it has a bed and a bathroom, and what else does it have in there? Does it have a kitchen facility or...?
Kind of. It's like we keep a fridge in there and it's got like a countertop. But once my husband and I weren't there whenever, like I said, teenager age, it was mostly just kind of we just kind of left it there afterwards.
So what's in there now? So there's a bed in there? Yes. Okay. And is it some type of kitchen, kitchenette, just the refrigerator?
The refrigerator and like a counter and a sink.
A stove? No. Okay. How far apart are you from your neighbor, the neighbor that spoke?
She's behind that part, so, I mean, there's privacy fence and then over, I would say, like, you'd have to look at the property side. She's on, I think, the side with the trees right there, and that picture would describe it. And then you can see the shop shed in the back. There's a shed on one side and then the kind of, um smaller garage because it's got like a big garage door kind of set up to it so it's like a addition to it so typically how many people do you have because you said that you were helping your father rent it out so typically how many people do you have at one time usually it's like a one household family so mom dad two kids most of the time it's families i would say about that we really don't allow big giant groups it's more of Like a couple or a couple with their children. And how long have you been renting it? I can't tell you when he originally started. Five years might be accurate. That was before I was handling it. Whenever he was in town more often. I mean, we moved out of it in 2021, I believe. Short time after the hurricane where I no longer lived there. And then I started managing it more recently since he's been out.

Just looking here in the recent zoning request in the immediate area, I don't see if any other request or anything that we've approved in this area that would change the character of the single family are one. And I guess I asked the question Airbnb, I was just wanting to know how long she's been operating outside of compliance of zoning. So five years, is that what? We had a applicant. I'm not entirely sure when he started. Like I said, it would have been sometimes. I mean, we lived there during the hurricane and within about a year after that. So I'm unsure exactly when that started. I know there's a lot of people that did it and didn't know that it was. We were not aware that it was an issue, I guess is the best way to put it. I have a lot of friends, family in the Calcasieu Lake Charles area that do this and just were not aware that it was allowed.
Yeah, I know it's.
Because it's kind of a, you know, we're like, oh, well, it's not a bed and breakfast. We thought it was a different category, if that makes sense.

I just, general comments, I understand the neighbor's concern. This is an exception that really could or will change the character of the R1 zoning. And I think it's important because this would be the first one in this area that would set the precedent for a transient habitation. I try to look at it. I'm sure the applicant has best of intentions, a little bit of experience with it. They can click that there's four people coming, and when it turns into a party. So I just feel like it would change, again, the character of the area. And then I have a hard time of telling one person yes, and then the next person no. So the next applicant that would come, the neighbor, I would want to tell them yes if we told them yes, the first person. So I just have concerns. Thank you.

Ms. Todd? This property is in Moss Bluff on Rebel Loop. The applicant is requesting a zoning exception to allow a borrow pit 1.1 acres. Approximately 75% of the dirt will be excavated offsite, while the remaining material will remain on the property for future house pad and site grading. Because minimal impacts are to be expected, the staff recommends the request be granted with the following conditions. that the development adhere to the site plan on file with the Division of Planning and Development, provided that the director or designee may authorize adjustments to the site plan, considering technical or engineering considerations discovered during development, that the development shall be in accordance with Section 26.122.1.H.4 of the Parish Code of Ordinances, and that any deviation exceeding the submitted application will require another review by the Division of Engineering.

Warren Vandiver, 1931 North Gabriel Square, Lake Charles, Louisiana, 70611. All right. Appreciate the opportunity to explain. I think a lot of this whole objections to this pit were just miscommunications between me and the other homeowners in the subdivision. And it allowed me an opportunity to get educated a little more on how this process works. Because if I were to bring dirt into my property, wouldn't have been a borrow pit permit, wouldn't have been any issues, same amount of traffic on the road. However, in order to excavate dirt off the property, it's a big ordeal. I had to spend four months with the energy company for the High Line to even get the plan approved by them because you have to adhere to right-of-way access and things like that. Me and Energy sat down and drew up the plans and elevation certificates and things to dig the pit so I could have a pond. I didn't know anything about digging a pond before this research, so I started researching how deep do I have to dig it to keep it clear so alligator grass and what not doesn't grow. And you hit water, sand, so that it keeps the pond clear. So I did that, filed for the permit for that exact. Four months go by with to get the letter of no objection from energy and their biggest concerns where I was not allowed to raise the elevation of the High Line area because of the concerns with the High Line height difference from the ground to the the safety concern between the ground and the electrical lines easy day so I can use maybe 300 loads of dirt on the rest of my property to do my house pad, but there's still going to be an excess of roughly 600 loads of dirt that have to be brought off the site. Initially, the phase three of the subdivision is still under development. I was hoping to get it moved over to there with the owner of that property. But before we got the letter of no objection bag, he said there's really not enough dirt on there to make it worth, you know, his time as a commercial business to set up and move the dirt off. There's not enough dirt coming off there. So I was back to square one. I found another individual in the subdivision who wants the dirt for their property. So it's literally just going to dig my pond, my pad, and then their property with the dirt. Never thought it would cause any kind of, you know, uproar that happened with the HOA and everything. But I'm kind of glad that it did. It let me do some research and find out exactly what goes into it. And I'm grateful that there's people in the subdivision who care about what's going on in their subdivision where I plan to live. Really, there's not too much more about that. I did everything by the book. I didn't know what I had to do, so I came up to the parish, got the list of what I had to take care of, the letter of no objection was first, and then all the permitting process and everything. And that took four to five months. And then I said, well, I want to file the permit once school's back in so that if the traffic is during the day moving it around, the kids are not there, they're at school, and it's going to cause as least amount of disturbance in the neighborhood as possible. So that's what we did. And I don't know very many people in the subdivision, maybe two or three, so I didn't go door-to-door knocking and saying, hey, this is the plan. But I did know that they were putting a sign in the front yard to notify everybody in the subdivision and that they could contact me there afterwards. I'm sure there's some people here that are going to object to it. I would love to have this conversation over a cup of coffee rather than here in the – the parish appeal um but i think a lot of it was um miscommunication on me either explaining better what the uh what we're building or misunderstanding um but yeah that's where we're at i'm really don't have much more to say on that but that's that's essentially what we're doing to clarify it's going from your house to a neighbor's house and that's it all 600 loads if that um i we went and walked the site and roughly to improve where the house pad is going to go it should take about 300 loads don't know exactly how many loads are going to come out but it's going to be less than a thousand so i assumed you know six to seven hundred loads off site because i can't raise the elevation of the the high line any and i don't want mounds of dirt all around my house pad that are doing nothing um so that's essentially what was applied for board members any questions for applicant yet Not yet.

Donnie Northcutt, we haven't built in the subdivision yet, but we do have a lot on 2067 Rebel Loop. I think the main concern was the part where the dirt would be brought to a neighbor's was not made clear, but the concern is the open-endedness of the permit. This is a one-acre permit. What would stop it from being appealed at the end of the one-acre pit to be a three-acre pit? What would stop it from being a one-year permit to maybe to be extended? So the long-term impacts of if it is approved, then what are the long-term impacts? What could we expect as neighbors as to what it could turn into?

I'm Karen Northcutt, and we are building at 2067 Rebel Loop. We're just getting started on it. My main thing was, okay, he said a pond, putting a pond on there. But I looked up before I came, and Webster defines a borrow pit in comparison to a pond. An excavated area where material has been dug for use as fuel at another location. And I'm fine with someone digging a pond to put their house pad, to do their house pad on their property. My concern is the roads, the dump trucks in and out, if it's going to be going, if it's going to be sold and brought somewhere else. I wasn't aware before tonight that it's just going to another, that location and another lot in the subdivision. mapping is with this definition of a borough p and that it has to be that you have to have special approval for it uh... is do we know for sure that's the case and if it ends up getting sold and going to the net neighboring subdivision or things like that happen Is that okay? I mean, he can say that it's just going to those two places, but if it's, oh, well, we have extra dirt, so I'm going to start selling it to go over here, and we've got trucks going back and forth. How do we know that's going to be the case? Do y'all oversee that or what?
That's a question for the staff.

We are not going to be out there every day overseeing this, I can promise you.
I kind of figured that. I kind of figured that was your answer. But anyway, so that's just one of my concerns, is that truly what it's going to be. I just don't want it to become...
It's a borrow pit because under the parish definition, not Webster, it's removing the dirt off the site. And so... To another location. It could be anywhere. To an old site.
Right, right. Yeah. Any location. Exactly. So therefore...
Unless there is a condition placed on... The moving of the dirt on a certain parish road or something like that, we're not going to limit where that dirt goes.
Right. And how many trucks it takes to on the road.
They make an application.

And on the application, they have to put, you know, the number of trips per day and the number of loads that are going to, you know, they have to put all that.

And who oversees that?

Well, the application is submitted and we permit it based on the application that's submitted. And now if they go beyond that and we get a complaint, we have to investigate. We have to investigate that to figure out whether or not they're not complying with that. And then we would enforce it.

Dan Thomas, 2143 Rebel Loop, directly across from this lot. My concern is the same as Herb Ellis' voice. I need to know if there's an opening date and a closing date. this could go on for years you're going to dig a one acre pond 30 feet deep do you have calculations on how much dirt that is somebody does i'm not an engineer but i know somebody does and i like to know if this is a never-ending story there's a dirt pit on north perkins road probably two miles from this location been open for years How long is this one going to be open? So you're saying you're going to count the dirt loads? I don't believe that. I don't believe anybody in here is going to set out there and count the number of trucks that run back and forth on our subdivision roads. I don't believe you're going to count those. So I'd like to know. Do you do, I know somebody, there's a mathematical formula where somebody can investigate and tell me approximately how many truckloads of dirt is going to come out of a one acre pond 30 feet deep. Do you have that number?

I'm sure the dirt contractor and our engineering department would calculate that too.
i know you can if somebody can somebody in our neighborhood did it and they said not 300 or 600 truckloads they said more like 3 000 truckloads that would tear those roads up again i don't know those numbers but i'd like and i have zero problems with him digging and digging at and putting on his lot i have zero problems with him putting some in our neighborhood what i don't like is the fact that you're not going to tell me when there's start and stop date, and you're not going to tell me how many truckloads are going to come out of there. And if it comes out right in front of my house, I have a big problem with that. So, and there's rules in the subdivision. There's an HOH that says you cannot use any lot in the high side of our subdivision to run a business out of. Are you telling me that our rules don't mean anything? Are you saying the HOH has no authority in this?
The HOA is completely separate than the Planning and Zoning Board. So we make decisions based on land use, but your HOA, if they have a problem with it, they deal with that completely separately. We can't enforce your HOA rules.
One of our members called up here and spoke to one of your board members, and they basically told them that our HOH had no, basically had no say in this.
That's incorrect.
So if that's the truth or not truth...

Does that mean I can start a pig farm in the next lot beside him? Is that what you're telling me? My rules don't mean anything, so I can buy the lot next to him and start a farm?
No, you're responsible for enforcing its own rules. The parish does not enforce you.
Okay. Are you saying that our HOH needs to come after him? And, again, I have no problem with him doing what he's going to do to build his house. Zero worries about that. My concern is the never-ending story here. I'd like to know a start date and a stop date.
That's all on the application, though. When he starts and when he has to stop, that's all in there.

I still say there's a dirt pit less than two miles away. It's been running five, six years that I know of, probably not longer. I have no desire to have my house right across the street from a dirt pit.

Good afternoon. My name is Sean Connor, 2114 Rebel Loop. I am to the, well, I don't know, the right of ways east and west. But if you look, on the or if you look on the left hand side that's that's my residence i have two lots there outside of the restrictions i understand you guys you don't want to hear about the restrictions but the one concern that i have is that lot 35 is also part of the army corps engineer permitting process i have two lots that are just to the left of what the highlighted lot is and it's actually got has a It's a lower elevation, so has the parish looked at anything as far as berms or anything like that to prevent stormwater from intruding to down lower elevations or anything like that?

I don't know if that's been looked at at this point, but they do have to submit a drainage plan that our engineering department will review.
Okay. I mean, you're going to hear other concerns, but my main concern is I don't have water back there except for when it rains, and Indian Bayou is just south of that. Just making sure that if I'd had a pond back there, I wouldn't have bought it, right? So as long as there's no impact, that's my main concern. There's no impact for whatever is going on that we actually put protections up and stormwater drainage.

Okay. Delton Ritchie, if you would like to come to the podium. State your name and address for the record. And as a side note, is today your birthday? Because that's the date you put on here, was the year you were born. So I'm assuming today's your birthday.
Yeah. Well, happy birthday. Happy birthday. Delton Ritchie, 2795 Coffee Farms Road in Moss Bluff, same neighborhood. I'm really here just to voice some information to educate our neighbors in the neighborhood. First of all, I have almost a two-acre pond behind my house that's 14 feet deep, and I got a hole in it that's 32 feet deep. I couldn't even move one cubic yard of dirt off of that property where I built my house. I took every load of dirt that came out of the Catholic Youth Center on Bozo Road and put on that property. I am a dirt contractor. Some of you know me in here. But anyway, the dirt that he's gonna dig out of a 1.1 acre pond, I did it based on one acre, one square acre is 208.71 by 208.71. In the state of Louisiana, you have to have a nine foot slope in there for a rescue if an animal comes out of there. That's not a parish ordinance or anything like that. That's ruled by the state for rescue, okay? So this guy is not, I don't know where they came up with their numbers, but you're going to only get 43 560 cubic yards of dirt out of this pond okay we're talking a 1.1 acre pond so he's not going to have enough dirt to keep a pit open for years running okay i don't i can go on here and stand here for 30 minutes and talk about all this stuff if you divide that 17,738 cubic yards. He's only, by 27, you're going to have 656 loads of dirt out of there is what he's going to take out of this pond. Where they got their numbers from, I have no clue. And there's people in here that know the formula for this, and you can calculate how much dirt comes out of this ground. It's loose field. It increases 15% to 30% when it's loose field dirt to go in the back of a dump truck. So, okay. Anyway, if there's any concern about trucks, traffic, thing like that, every house in that place had dump trucks coming in and out of that from the front of that neighborhood all the way to the back. So if they're concerned about trucks, when they finished with the dirt, they brought concrete trucks, pump trucks, lumber trucks. You name it, it all the way down to the end of the closing where they brought furniture trucks in there, port-a-potty trucks in and out of there, vacuuming once a week. So the concern of all this, they're raising opposition for this. I don't understand where they're going with this. As far as the elevation of that, I'm going out there. I did not take my laser there. But he can't go any higher with the dirt. So he can't build a berm any higher than the highest elevation on that property. All he can do is block off one side. And if you take the overflow out of this pond, I have one in mind. It's a 16-inch pipe. That's as much water can be released out of that pond at a time. If there's any water that's through rainwater that comes up and fills that pond up, it's not going to be any additional water that overflows and hits the ground right now other than absorption. So the time frame on this, weather permitting, a guy's, whoever, a dirt contractor is going to go in and be in and out of there and just as quick as he possibly can. So where they fathom this idea of this is an ongoing for years, it's not going to happen.
And in all fairness to the neighbors, it is because sometimes sitting on here for 15 years, I've extended borrow pits and extended borrow pits and extended borrow pits. And so I understand this application, this size, it's going to be get in, get out. I get that.
And the terminology borrow pit comes from, no one probably relates to it in this room, is the definition of a borrow pit. Everybody's driven down the interstate. What if I want to make a three acre pond? Well, I don't even have three acres back there. I've got one acre of dirt to dig, right? So that's what the permit called for. And I just put the longest you could have the application open was for three years. And I didn't know when we were going to start, but I didn't have no intention of pulling dirt out of it for three years straight. So do you still not know when you're starting? Is that still an open date? I mean, we're here right now. So I don't know if it's going to get approved or not. So I don't have a start date.
