Carefully, please. So I'd like to take this opportunity to welcome you to this meeting for the City of Miami Appeal Hearings. My name is stated as Dawn Grace Jones, and I am the hearing officer assigned to hear these cases today. These hearings are conducted by the city of Miami, and I'm the officer to hear this. The purpose of these hearings is to give the alleged violators the opportunity to appeal the decision of the code enforcement inspector, the issuance of that violation. That's what you would be appealing, right? And that's why we're here. These hearings are conducted in a quasi-judicial manner, and as stated, I'm going to hear the case. My responsibility is to act much like a judge in the court and to hear the evidence of cases presented by the code enforcement inspector and then to hear the evidence presented by the property owner. The hearings are open to the public. So everyone, as you have been, would be placed under oath, including the code enforcement inspectors. everyone and understand that no rules of evidence, no formal rules of evidence are applicable here. So if I find that the evidence is relevant, I might admit it or I will admit it. And if I find that it's reliable, regardless of any common law, I will admit that evidence. But when you have evidence, you're going to need a copy for the file. If you have something that you're presenting and you want the city to look at it and you want me to see it, you need to have a copy for the file, okay? And everybody has the right to call and examine witnesses. And that's for those who are having a full hearing because a lot of you may have settled your cases. That's your right. It's also your right to have a full hearing. But now if you have a hearing, understand my responsibility is to be the fact finder. And when I do that, I'm looking at two things, whether the violation occurred and whether the person named is responsible for that violation. So those are the only two things I really look at, and that's what you'd have to disprove, right? Failure to comply with, once I make a determination, would be a problem. I will give the amount of the civil penalty. I might also add an administrative cost. I might not. Failure to comply within the time will result in referral to the Code Enforcement Board, which may cost additional fines per day. That's when you have that per diem fine and it goes up every day. That's when that happens. You may seek to overturn or the code enforcement inspector may seek to overturn my decision by going to the appellate division of Miami-Dade Circuit Court within 30 days of the issuance of the order. Okay? So after the code enforcement inspector has put on their case at this podium, everyone here will go to this podium one at a time, and you'll put on your case. Now that's provided you have a full hearing, a game. If you are settling, we'll do the settlements first and you'll be called one at a time and you'll go to this podium. That's how that works. And the reason we do that is I need to make sure this is what you've agreed to. And so after you agree, if you agree, or after you do your case, whatever you do there, you're going to come up to the clerk here. The others were waived or whatever else, but this was a series of probably 15 tickets, violations, et cetera. that candidly we just thought were predatorial, and so I'm here out of principle. Both of the cases we'll see today are the same ticket, just one day after the other. The notices through certified mail that I think were in that 39-page exhibit didn't arrive till the 25th or the 20, I'm sorry, the 26th, I believe. I have emails here communicating with Inspector Haynes. The day we received them, the day before we received them, telling him we would cure it because it was the first time we were informed of the situation, and then the ticket came formally thereafter. There's pictures here of the site the day the formal notice was received, clean and clear. Again, I live in the neighborhood. I walk my daughter around here all the time. I want the city to look beautiful. I think everybody in the city should just have proper opportunity to care.
