Whereas the position of fiscal officer for Miami Township, McGomery County, Ohio, is currently vacant pursuant to the decision and judgment entry in case number 2025 CB 5367 filed March 23rd, 2026 in the common police court of Montgomery County, Ohio. Whereas the board of trustees has reviewed the resumes of those interested in being appointed to the elected position of fiscal officer. Whereas the board of trustees desires to appoint Greg Clingerman to the position of fiscal officer for Miami Township. And therefore, be it resolved, the Miami Township Board of Trustees appoints Greg Clingerman to the position of fiscal officer for the unexpired term as effective April 21st, 2026. and therefore be further resolved, the appointment of Greg Clingerman to the position of fiscal officer for the unexpired term shall be subject to all legal requirements of the Ohio Revised Code for such appointments. Following this appointment, the position of deputy fiscal officer shall cease to exist and the salary allowed by revised code section 507.09 shall be paid to the fiscal officer. Good evening board. Uh we in Miami Township are very happy to be named a America 250 Ohio community. Uh we went through the process to be selected and chosen. You guys passed a resolution uh making us an official community. And among those things that that we'll be doing uh we're doing various projects and things that we're tying into it. Uh we received a beautiful flag recently that we will be proudly flying out in front of our building. You'll see it right here. That indicates that we are in fact a 250 community. So we're happy to have that and be committed to this um this year as the country celebrates its 250th anniversary. We have some other activities that we're also planning this year um to just to make you uh briefly aware aware of as the year progresses on. Um what we're doing right now is we are coordinating and teaming up with the Miami City School District and also the Miami Historical Society. Um, we're conducting an art and essay contest for the kids or four different age groups where the kids can choose whether they want to do an essay or an art of what being an American means to them. There'll be prizes and we'll have the winning kids come and uh uh come to a meeting and be recognized here at the board meeting uh hopefully on the 19th. Um myself and Trusty Barry will be among the judges on May 5th uh when we go through and look at all of our entries and see uh which kids uh shine through in that in that project. Um we would also like to and we are just in

the beginning phases of this. I'm working alongside um John Schwiger to uh possibly have a tree put into one of our parks and named an official America 250 Ohio Community Park uh tree. Uh those those are still kind of in the works of exactly how we're going to work through that, but we hope to have a small ceremony uh and dedicate a tree in the name of the uh anniversary. You will also notice that any any event that we typically have will have a American 250 theme to it this year. And this will go throughout the year. Um, obviously coming up sooner than later is the fishing derby. Uh, that will have the theme. We'll have some giveaways that are all America 250 uh related that we'll give to the kids and hand out. And we're also going to encourage everybody to wear red, white, and blue and be patriotic on the fishing derby day. And of course, the veterans breakfast in November. We'll certainly have the 200 America 250 theme. Um, we'll have a speaker that's going to try to tie in his his story and what he's a he's a veteran. He he'll tie in his story to 250 and talk about the history of our country. So um these are just among the different events. You'll see a lot of social media items popping up. Um each month the state has issued each month as a particular theme. Uh the theme in May is arts and culture. So our art neessay contest really fits in with the May theme. So um we're happy to be part of it. We of course are leading into our very own 200th anniversary in 2029. So, this will be a good way to kick off our efforts here in the township uh to celebrate all of these anniversaries. If you have any questions, I'm happy to answer them, but uh we're we're underway and happy to be

Moving on to new business. The first resolution is number 58-2026, a resolution to approve a three-year collective bargaining agreement with the Ohio Patrolman's Benevolent Association. Chief Nielsen. Yes, sir. We just got uh done with this a couple weeks ago. Um it was a very smooth uh process again, similar to to the one that we we uh brought before you last month. Um you know, very proud to get this done to get our supervisors on on board. We worked very well with with them, with their representatives, with their legal team. Had a lot of help from finance and HR. So big thanks to our team, but happy to answer any question that that you may have about the the contract it itself, but um we're very happy to get it done and get it done very smoothly.

Uh they are the firm that we selected for the Springboroough Pike Pathway project. Uh due to the proximity of a stream that is uh sort of near this project, ODOT has now notified us that we will need an ecological survey. Uh choice one will uh contract this out as a sub uh consultant. Uh, so this would authorize them to do so. Um, but again, our contract would stay with choice one. Yes. Thank you, board. uh resolution before you tonight. Uh something that uh we've had a couple of work sessions on talking with the board of trustees uh about establishing a sister cities program for Miami Township uh both as an exercise to uh advance uh the township really kind of our standing as a a township through arts and culture but also as a um sort of placemaking and identity activity for Miami Township. something we've always talked about as as townships, we always struggle with establishing identity, but uh this creates an opportunity for us to officially name ourselves in partnership with someone else and uh recognize one another as uh common entities. So again, this resolution tonight would allow the township administrator to take necessary steps to join SEI, the sister cities international program. Uh through that, we would get advantage of uh some of their resources to begin uh finding a partner community, some of their other services. uh to uh identify the goals that we have for ourselves as a community who is in this program. Uh and then uh secondarily to that would direct township administrator to begin developing a exploratory committee uh where we could again formalize sort of our goals, framework, objectives uh to bring forward to an international partner to uh find common goals uh in this program. Moving on. Public comments. This is the portion of the meeting where you, the residents of Miami Township, are invited to share your thoughts with the board. Please be no, please know that the time has been set aside for the board to listen to you. Your comments are valued and be taken into careful consideration. The board will not engage in dialogue at this time. Presentations are limited to five minutes each. Is anyone wishing to come forward? Good evening, trustees. Mr. Schneider, uh, Chief Nelson, my name is Robert Jensen. I reside at 6986 Rosecliff Place. Many of you know me before because I'm coming here to talk to you the same thing I've talked about every time I've come here now for two or three years or or longer. First of all, Mr. Posie, I want you to know that I have prayed for you every single day since I heard of your medical condition. Thank you. And I'm very serious about that. Okay. Now, what I'd like to talk about is this problem, no problem that we have on Vienna Parkway. It's my understanding that some in this room seem to think that we don't have any problems on Vienna Parkway. I've heard that. I've heard that it's been put down in writing via email. I've heard it reported to me from other people. Well, let me tell you something. I cut my first of all, you know, I'm a I'm an ideal resident of this community. I take care of my property. I support the police levies. I support the fire levies. I support the school leveies. I keep my house really, really nice, which is one of the reasons why I'm here tonight because I cut my own yard and it takes me three hours from start to finish. And most of that time I'm out in the front of my house on Vienna Parkway. And I can tell you two things happened today. As I was coming to this meeting, 43 miles an hour down Vienna Parkway, but yet nobody says there's a problem there. Yesterday, one of my fellow citizens on Vienna Parkway, he lives on

actually on Rose Cliff, videoed somebody doing 50 miles an hour down that road. Now, I hear there's a rumor that some people think that only happens in the middle of the night by one rogue person. Well, that's not the case in any way whatsoever. And this township has not commissioned a traffic study through the county that actually provides accurate accurate information and data, especially since Vienna Parkway was opened all the way through. Before this whole thing started, there was anformational meeting. This township paid a consulting group to assess what would be the impact on traffic if Vienna Parkway was opened up. that was presented to the citizens of this residents mostly of Vienna Park and the determination was it would significantly impact traffic flow. Now, I don't think we have 9,000 cars a day going up and down Vienna Park, but they did state that it could have been that high. But I could tell you the traffic study that was done last fall, last summer, where it was like just a few hours in one day, that doesn't provide consistent data. And I could tell you the previous studies where they put the monitors right before the main turnoff streets, Rosecliffe, Insbrook, Mohawk, Vienna Woods Trail, people are slowing down to turn on those places and to when they turn on to Vienna Parkway, they start at a slow speed and they have to accelerate. So the placement itself of these speed monitors, traffic monitors so poorly and so badly biases the results of those studies towards slower speeds because it's taking into account the people that are slowing down to turn. Okay? You can never totally eliminate that. There's going to be people turning their driveways. There's going to be people that turn into some of the smaller, less populated side streets. But today I sent Mr. pulp, a suggestion, a recommendation that a real

speed study be done for the benefit of this community in my neighborhood that I live in. And I've driven up and down that street multiple times figuring out where would be the best places to put these speed strips where it's not being impacted by outliers of turning onto the main tributaries that come off of Vienna Parkway. Now, I think the township trustees in the township and Mr. Snider who was involved in the original stuff on this and the police chief should all really support this neighborhood. You know, I'm the only one up here vocal enough to talk about it. But I share feelings. This is a common people walk all the time. The day somebody's driving 50 miles an hour, there was somebody walking their dog on the street that the guy whiz right by. The previous pre police chief when I talked to him about these issues said, "Well, maybe I should give them a ticket for not walking on the sidewalk." Well, that was a really crummy attitude, wasn't it? So, what I'm asking is for a real speed study. Well done. So, then you can see whether it is a problem or not a problem, but to keep pushing it under the carpet, say there's no problem here. Well, yeah, you're not looking for it. I can't tell you how rare it is to see an officer enforcing speed really anywhere in this in this township. The lawlessness in this township is out of control. Out of control. People with their windows tinted so dark. How does that help our police officers when they have to do a traffic stop? I think it puts them in harm's way. How about we start modeling ourselves after Ketering and Centerville and Oakwood where you know you don't speed there, where you know you don't do things that you're not supposed to do instead of having a free-for-all go west society that we have in this township. It's out of control.

Thank you. So, I'm I'm here not as an antagonist. All I want and my and my neighbors around me, all we want is the township to do what they identified needed to be done before the two of you because you both voted on that to open Vienna Parkway. And Mr. Snyder was pushing for as well. I don't think anybody else was here. But all we're asking is to just do what was identified was going to need to be done. Drive down to Sinclair, drive down to Cincinnati. You'll see speed tables in a lot of places. I appreciate your time. A resolution to adopt a zoning a mapped amendment from B4 business district to SPUD special purpose planned unit development district under zoning case number 468-26. I will. Yes. Thank you, board. Uh, zoning case 468-26. Reszoning requests uh has been heard by the zoning commission. I will get to the recommendation of the commission in a moment. Um, first going through my report. Let's see. to familiarize yourself with the location of the property. Uh the former FRES and then uh briefly the former Dolly's uh location has been requested for reszoning from the B4 general business district into a special purpose plan unit development district. Uh specifically uh requesting the addition of a dual use uh dual use cannabis dispensary uh located within the plan development. Um just as a reminder board uh last year we had uh several uh sort of uh long range planning activities discussing this land use within our community uh where it could should be located uh and and what manner would the board like to uh be able to review these applications. and we determined that it would be a prohibited use in all locations except for in a SPUD special purpose plan unit development uh to allow our zoning commission and board of trustees uh the ability to review the the specifics of the project without just allowing it in a general zoning district. Uh so today we'll review some of the specifics of this specific property but also the development standards uh that have been drafted and recommended by the zoning commission. Um couple of highlevel uh items that we placed at the beginning of all of our staff reports. First development schedule. Uh the development is estimated to take about 8 to 12 months uh for renovation of the property. Public health, safety and morals at this time. Uh no new ingress or egress is proposed as part of the development. They would utilize existing access points. Traffic control and access. Uh no changes to the patterns anticipated

uh for uh this retail type use. public service burden. Um again, no new impact is anticipated and at this time the police department has expressed no specific concerns uh regarding the addition of this use arrangement compatibility of structures. Again, existing uh roughly 5,500 square foot building uh with some additional impervious surface parking uh drive lanes and we'll get into some of the landscaping proposals in a moment. But um again, the zoning commission worked with the applicant to identify a number of items um within our sort of standard plan development framework that they wanted to be sure were included um to create the best potential site should the board choose to approve the development. U one sort of small item but to be noted uh the FR's site has a non-conforming pylon sign, one of the larger signs. It's up on a stick pole. We as community have tried to sort of pull that back, have more um you know understated but uh kind of still very legible signage. So they would have to remove that existing non-conforming sign and meet the same standards that everybody else does. Landscaping standards. Uh one item was added. Um we'll review a a proposed landscape plan in a moment, but typically during resoning we don't get a fully sort of developed landscape plan. That typically comes in final development plan. But uh in general, the commission felt that adding the language uh in addition to the requirements of article 45A, landscaping throughout the site shall be of exceptional quality with intent to exceed minimum standards uh gave us some additional guide guidelines to the developer that if they were to come forward, they should uh design their plan with that in mind. a similar comment uh placed on site building um trying to push that we would like high quality materials for all of our developments under article 7 but uh

again trying to exceed minimum standards um and then again restated the sort of corner feature for landscaping. Um, with that being said, the applicant uh sort of took a initial crack at it and we may have additional revisions as part of FDP uh if this uh resoning is approved. But uh wanted to show you briefly some of the renderings that they put together. Again, the applicant has stated that their desire is to come in and meet all of our zoning standards for our elevated building design. Certainly feel that this concept drawing is a a large improvement over the first site. um but we'll withhold uh more detailed comments on materiality and percentages of glass and things like that uh if we get to a final development plan phase. Uh similarly, a landscaping plan. Again, this is sort of a concept level. We would review in greater detail, but uh certainly have put forward a landscape plan uh that meets and exceeds our standards uh and have utilized sort of existing uh grass corner on their uh entry off of 741 to uh lean into a much higher quality entry feature than what we would typically require under our code. A lot of other plantings, flowers, shrubs, etc. U but again feel that they've uh sort of taken our comments and the zoning commission's comments to heart and tried to show that they would certainly support the goals of creating a nicel looking uh site on 741. Um site security. Uh this is one item that uh isn't always the most typical during a reasonzoning request, but given some of the additional uh review powers that the state has granted us and some that they've passed themselves, the applicant provided some additional materials on uh site security measures that they would implement. Um many of them I understand in excess of the minimum standards set by Division of Cannabis Control. But just uh you know quickly looking through these, I believe these are provided to the board, but um you know they they have surveillance

systems, 24-hour live monitoring, um 45day archiving. My understanding is that functionally every square foot of the building is covered in camera in some way uh that is able to be viewed by department division of cannabis control. I won't get too into the weeds on some of these details. If you guys have more questions, I would recommend you ask the applicant on specifics of uh the state minimum standards, but um reading some of the application materials, this all is um my understanding is this is very in line with Division of Cannabis Control standards. Uh public survey, this is one item that our zoning commission specifically requested staff work on. Um there wasn't uh it wasn't not a very well attended zoning commission meeting. So uh our commission asked that we spend a little bit of extra time going around and and polling and surveying some of the neighboring businesses. These are the questions that were provided on a survey. Uh I believe the three responses that we actually received uh were provided to the board your board packets. Um but we handd delivered and mailed but we handd delivered to 19 surrounding businesses. I think the list Excel sheet was also provided, but wanted to be sure that we uh again expressed the timeline and the uh the questions and we we specifically requested that we get these back within the time frame that we provided ahead of zoning commission. Uh but again, we got one in support, one in opposition and one neutral. Uh and then again, we have 16 that we determined were sort of no responses. Uh at the time of zoning commission hearing they recommended approval with no stipulations uh but in a four to zero vote feeling that uh the necessary adjustments to the site layout physical design were uh covered within the uh development standards that were proposed. I just want to show that um our projects that we've have throughout Ohio, Cleveland, Columbus, Springfield. If you want to keep talking, I'll get a

Sure. just um before before construction started and then after I just want to show you that um from our concept to actually making it happen, we do what we say and um we're confident we can put together a pretty site here in Miami Township. While Alex is getting this going, I requested from the city of Dayton is where our main headquarters are located. We've been operating there since 2020. We've been constructing, our construction project started in 2018. Been working with Keith Klein for a long period of time. We also have a a dispensary in the city of Dayton. And I asked Ka uh Keith to write a writer letter of recommendation for us. I'd like to share that with you all. He addressed it to Alex. Um, but it says, "It has come to my attention that Certified Cultivators is seeking to open a new dispensary in Miami Township as the policy analyst and primary point of contact in city hall for cannabis businesses have had the unique opportunity to work with a variety of entrepreneurs in this emerging emerging industry. The company requested this letter of reference as it relates to their operations in Dayton. The team at Certified Cultivators, in my experience, has been a positive addition to the Dayton business community. They've transformed several abandoned and underutilized properties into attractive assets for the area, invested significant capital, and created dozens of new jobs for the community. In particular, Vice President Scott Miller has very been very open and direct in communicating their plans and intentions for growth in Dayton. The company has followed through on their commitments and responsibilities under the law. To my knowledge, there have not been any significant concerns in the community about their Dayton dispensary or their cultivation center. Therefore, I have no hesitation extending this letter of reference for certified cultivators. Please feel free to contact me with any questions.

Yeah, go ahead. Um, this is our our first dispensary is located in in South Uclid, Ohio up in the Cleveland area. It was half a on the right half was a Buger's Bagels and on the left half was a Huntington Bank. This is how we um took over the property. If you go to the middle of the picture, this is a video actually. Yeah, right there. This is as construction was finalizing. Um, but a very similar concept to what we tried to show on the concept drawings for here. Just hit the next slide. Uh, Springfield, Ohio was a former White Castle. It's up on Bectal Avenue. um in the busy uh district up there with Home Depot and Lowe's. And that's what it looks like today. And then 951 Patterson Road is Dayton in the corner of Patterson and Wilmington Pike. It was the former Key Bank building right next to uh Tim Hortons. That's how we took it over. And this is how it looks today. Um 2375 in Silver Drive in Columbus. This is just north of the old crew stadium. Actually exact same build as here in Miami Township, the proposed location on Springrove Pike. That's how we took it over. And that's what it looks like now. Little bit different entrance. Um that one has the glass block entrance. glass block but layout of the building is exactly the same.

Yeah. We're um locally owned uh family and friends business. We started um five six close family and friends. Um you know, Mike Weeper, Zach Wein, the main auto parts descendants infusion. if you know that uh C Fast Casual Sushi Restaurant. Um it's part of that family. Um so we're I grew up in Dayton. Mike uh and Zach grew up in Oakwood or Zach grew up in Oakwood. Mike's his father, but we're Dayton people committed to this uh town community. Um, and we'd love to uh keep expanding our business here and create jobs and be a good community partner for Miami Township.

Anything else? So yeah, the uh structure of the building um and I noticed this in several buildings like you guys didn't really do anything to make it not look like business that was abandoned. Like you intend to keep the advertising for lack of a better description column had there. You don't want to just level it off or something like that.
