I am the Special Magistrate for this afternoon's hearing before North Bay Village Code Enforcement. This hearing is conducted pursuant to Chapter 162 of the Florida Statutes. Formal rules of evidence shall not apply, but fundamental due process will be governed and observed. I shall hear testimony from the code inspector and alleged violator that I deem competent and relevant. All witnesses and parties offering testimony must be sworn in. The village will present its case first and the alleged violator will have an opportunity to cross-examine the village as well as present its own evidence. If you are found guilty of the violation, you'll be ordered to comply with the code within a certain time. If you do not do so, you may be fined up to $250 per day for the first violation and $500 for repeat violations. If you desire to appeal my order, you may do so by filing a notice of appeal with the clerk of courts in Miami-Dade County. You have 30 days within which to file an appeal. Thank you. Case number 08638, property address 7904 West Drive, Unit 910. In violation of Code Section 105.4-5 of the Florida Building Code, building permits become null, void, and expired after six months are in violation. Inspector, on this case, Maria Tovar.
Good afternoon, Maria Tovar, court officer. This is a new case. On December 15, 2025, a civil infraction notice warning was sent to this property for failure to renew fire permit. Those permits for the records are BLDR-000471-2024, and PLMR-000472-2024, a four-barrel reward. The notice was sent to the owner of the property as listed on the tax record. On March 2026, the property was still in violation. and a $250 citation was issued for failure to renew those permits. And so today the violation is still outstanding and no communication with the owner. So we are recommending all the property to renew those building permits to comply with the violations and the property shall begin accumulator fines, so $250 per day until it's come into compliance. And in order to retain As needed. Okay.

Yeah. So I had two permits, a master permit and a plumber's permit. And the contractor did the work. There was an initial inspection. And then when everything was done, the person that came in to do the inspection did an inspection. And then they were supposed to have another person to come in. But apparently, I just called my contractor. That person was fired by the city of North Bay Village for use of drugs. You can go back and see who came in and looked at the property, but there was an inspection. There was a video of the inspection with the walls open and everything. But the person who did the initial inspection was fired by your city. And I never had a follow-up inspection to close the case. So this is an investment property for me. I've owned it for many years. I don't have a mailbox there and I don't check the post office. And that's why the initial email or the letter that was left there in December or January, I did not get. I did get the notice mailed to me and I got a notice on the board and I called in and I've spoken to my contractor. I've gotten two copies of... Let me ask you something.
Are you aware of what needs to happen now?
Well, I spoke to a gentleman by the name of Rodolfo, I think, at permitting, which he explained to me that I needed to... get my contractor or I needed to fill out a document to get those permits open back up. And then once they're open back up, the contractor then needs to have somebody to come in and inspect the property to close the case.
And I said, how much time do you think that would take?
Well, I have the documents and I've started to fill them out. And the gentleman also said that the contractor is no longer, um, a license to sit in North Bay Village. So he would have to, which I got that form for him to get renewed his license to be able to then- For your contractor, correct? My contractor who did the job in 2024.
So how long?
If I had 60 days, Your Honor, this would be done over. Everything's done.

I just don't want to upset the city. You know, the way I have to get this contract to get him licensed again and so forth. I'm going to pay all of the things this contractor should have told me this had happened. But the person who did the initial inspection, I guess, no longer works for the city.

So the contract, what he needs to do is come and register because it's not registered with the village. So he needs to bring his driver's license and just do a registration. That's what he needs to do. in order to be able to do the permit, yes.

I just don't wanna have it end because this contractor, He didn't tell me that this happened. I only talked to him like two days ago, and I'm pretty upset with him. I'm willing to pay all the fees, but I just, you know, I've been living in Market Village for 30 years.

Case number 08591, property address 1441 South Treasure Drive, owner Jonathan Offerman, in violation of Code Section 105.1 of the Florida Building Code. Work performed without the required permits installed a new half-moon canopy roof on the north side of the home. I expect on this case, Orlando Rodriguez.
Good afternoon, Your Honor. For the record, Orlando Rodriguez, Code Enforcement Director here for North Bay Village. This is also a new case. On December 29th, 2025, during a routine patrol, we observed that a half-moon style canopy was installed in the front yard of the observed property. I called our building department clerk at that time and I asked her if that property had any permits for a roof. She did indicate that a representative from that property had visited her a couple of times with permitting questions about the roof. However, they never submitted a formal permit for it. So I advised her at that time that it was installed already. So we proceeded to issue a citation for $250. We posted it at the property and sent it out certified mail. Approximately two weeks later, January 14th, the owner, Mr. Offerman, who's here this afternoon, did pay that citation, was paid in full January 14th. However, that permit was still outstanding. When the owner of the property, Jonathan, began to apply for the permits for this canopy roof, it was discovered that the roof was actually built in a setback. It was too close to the neighboring property as far as zoning codes. So Mr. Opperman was told at that time, unfortunately, he has two options. He could either demolish the roof, uninstall the entire thing, or he can apply for a variance at the village, which would he have to go before the Planning and Zoning Board and then ultimately our commissioners for approval for the extra three feet that he needs where those poles were installed in the setback. So Mr. Offerman did begin the variance process. He's been in communication with me, with our zoning official, Craig, various city folks here, and he's actually on track to be heard at the zoning hearing this coming July because the June hearing was canceled. So he's making some good progress. So he will need to come in July. He'll get the recommendation from there and then ultimately come before commission, hopefully that same month or perhaps in August. So he's got a few months to go on this. Our recommendation at this point is for the property to obtain a permit for this and comply with the violations as soon as they can. We'd ask for fines of 250 per day to commence today until compliance is achieved. And we'd like to have a property back for a status report update. And the owner, Mr. Jonathan, is here. This is his first time here.

It's been a lot of paperwork, and I finally... got the information over to, you know, I had to, you know, hire, you know, get a plan done and all sorts of stuff done. And I'm trying to do it as quickly as possible. And I was hoping since this is the first time sort of appearance, I can get an extension with no fines until I can get in front of the board, which everything's pretty much done on my behalf. I just have to wait until they can meet with me. So I was hoping that we could get an extension.

SO ANY ITEMS THAT GO BEFORE ZONING CAN JUST BE TRANSFERRED ON TO THAT SAME MONTH TO THE COMMISSION. I ASSUME THAT MONTH WILL BE THE SAME. SO HOPEFULLY HE CAN GET IN FRONT OF THE COMMISSION THAT SAME JULY, AND THEN ONCE THEY DECIDE, HE COULD START THE PERMITTING AND HE'LL HAVE ESSENTIALLY UNTIL AUGUST 20TH OF THAT HEARING IF THAT'S WHAT. And Your Honor, I mean, I don't know, it might be irrelevant, but I, you know, I have went and, you know, given the town the deposits and the fees and everything I need to do in order to get this move forward, which was a lot more than... and putting up the driveway cover. And of course, I'd like to get this done and get the town satisfied as soon as possible.

Jessman, in violation of Code Section 105.1 of the Florida Building Code, were performed without required permits, new kitchen at the rear property, and a screen porch was installed, a roof, and electrical work done. Inspector on this case, Maria Tawak.
Good afternoon again, Maria Toward, Court Enforcement Officer. This property came before you last on April 23rd, 2026. It was given 30 days to come to compliance. The property has been accumulated fines of $250 per day since June 26th, 2025 for 330 days for a total of $82,500. On May 1st, 2026, all the permit applications have been reviewed and approved. But due to a change of contractors, the permit application needs to be updated before the permit can be issued. So we are recommending for them to obtain the permit, for the fine to continue accumulating until they come into compliance and to come back as needed.

Cassidy, and again, Your Honor, Orlando, from the record, South Bay Village Co-Director. This case is also before you, last hearing, March 19th, pardon me, April 23rd. The property is ordered to obtain their building certification. At that point, fines have been running on the property 1,128 days, total of $282,000. Fines are ordered to continue for the property to return for status report. The property continues to work on the exterior of the building and concrete restorations with the balcony restorations. They still got the swing stages in place, and we're basically just monitoring their progress for now. Our recommendation is for the property to comply as soon as they can, finish the work. Fines, as of today, have been running for 1,156 days. Total of $289,000. This applies to the chief and for the property to return at a later date. I did speak with the property board member who's usually on these hearings, Ms. Mona Issa. She did mention to me she had a conflict this afternoon and wouldn't be able to make it.

All right, Your Honor. We're also happy to report that all three of these buildings complied. They all got their permits and we were able to reach a settlement for their fines. Each building agrees to pay the village. a one-time fee of $2,500 to mitigate their fines, payable within 60 days from today. Good afternoon, Maria Tovar, Code Enforcement Officer. This property also came before you last on April 23rd, 2026. It was given 30 days to come to compliance. This property has been accumulated fines of $250 per day since October 23rd, 2025 for 210 days for a total of $52,500. On March 12th, 2026, a permit application was submitted for the repair of the building. The application was reviewed and approve on May 11, 2026. But to obtain the permit and notice the commencement is required and the notice had to be recorded from Miami-Dade County. And after the notice is recorded, need to be submitted back to the building department in order to get the permit. And that's what they waiting now. I have been in communication with the representative, but as of now, That's the only thing that is that they waiting to get the permit. So we are recommending for them to obtain this permit. And I'm finished with them with the recertification. I'm sorry, with the fees in the building, and for the fine to continue accumulator on to the common to compliance. And

Properties were ordered to comply as soon as they could with the permits. At that point, fines have been running for 35 days, a total of $8,750. Fines were ordered to continue for the property return. As mentioned in the previous hearing, The representative, Mr. Peter Graves, I've been working with for the property, indicated that they were going to look into demolishing the building as a way of complying. Currently, the property is going through change in ownership. So we're kind of just pending to see what happens with that. Once they settle that, we have no further updates. So our recommendations for the property to comply as soon as they can. As of today, fines have been running for 63 days, total of $15,750. THIS CASE ALSO CAME BEFORE YOU LAST ON APRIL 23, 2026, FOUND TO BE IN VIOLATIONS WITH ORDER TO ATTEND THE NECESSARY PERMIT TO ATTEND THE CERTIFICATION OF THE BUILDINGS AND COMPONENTS. AT THE LAST HEARING, YOU SUGGESTED MEETING WITH THE BUILDING DEPARTMENT. WE MET WITH MR. PEDRO MARTINEZ, BUILDING OFFICIAL FOR NORBAY VILLAGE AND LEILANI CALZADILLA, BUILDING DIRECTOR. At that meeting, they went over all the permits that they had. They explained everything, every one of them, and what was needed to complete it. They are continuing doing the repair of the building for the recertification, but they still don't have all the permits and all the work to finish to get the recertification. We are recommending for them to continue working to get their certifications and for the fine that has been accumulated on the property to continue accumulating until they come to compliance. They've been accumulating fines since April 23rd, 2026 for 28 days for a total of $7,000. And we would like to see them back at the next meeting.

The property continues with the parking garage repairs. either they're estimated to finish maybe in june july and after that they'll have the exterior concrete restoration though to finish here on the actual building i did speak with mr richmond through text earlier he says he does have a conflict this afternoon he wasn't going to be able to be here for the meeting i told him that was okay i give the update on his behalf so our recommendations for property to comply as soon as they can finds out that today I've been running for 1,433 days total, $358,250. For the record, the permit number BLDR-000189-2024 for the second and the third floor of balcony and stair railing. The notice was sent to the owner and to the registry agents to the address listed on the tax record. On March 2026, the property was still in violation and a $250 citation was issued for failure to renew those permits. As of today, violations still outstanding. We haven't had any communication with the owner. We are recommending for the property to renew the permit for the fines of $250 starting today until they come into compliance and to come back at the next meeting.

Yeah, I've seen it again. Your Honor, Orlando, for the record, Code Director. This case is also before you, April 23rd, last hearing. Property was ordered to comply, removing the lifts or obtaining permits. At that point, they're collecting fines, $250 per day for 218 days, total $54,500. Property was ordered to return today and for the fines to continue. We have not received any permit applications for this property. We did get a call from the owner's wife, Ms. Naive. She called our office about two weeks ago asking questions about the violation and her different options for compliance. And I gave her all the information she needed, which is basically the same I had provided to her husband, Silvio, a few months back. She mentioned that she would speak to him and see what path that we're going to take. So as of now, we have nothing further. Our recommendations for the property to comply as soon as they can. As of today, fines have been running for 246 days, total $61,500. We'd ask for the fines to continue and the property to return as needed.

Good afternoon, Maria Tova, Court Officers. This property also came before you last on April 23rd, 2026. It was found to be in violations. The property has been accumulated fines of $250 per day since February 19th, 2026 for 91 days for a total of $22,750. They are working, continuing working to obtain their certification on May 18th, 2026. They submitted an electrical permit application to repair or replace all the electrical equipment needed to obtain their recertification. For the record permit process number, ELER-000365-2026, the application is still under review process. So we are recommending for them to continue working to obtain the permit to obtain the recertification for the fine to continue to accumulate until they come into compliance and then to come back at the next hearing.
