County Commissioners - Regular Meeting

Meeting the current County Board of Commissioners for the purpose of appointing the new sheriff for Carter County. I think this is an historic event. I don't think a Republican sheriff has ever been appointed in Cora County. Course Acer was won his election outright and so I think it's a first for many of us. Alright, let's get down to business. Like to invite. Clerk of Superior Court Ken Raper to come and lead us in the Pledge of Allegiance. Now I would like to invite Pastor Shad Barrow of Glad Tidings Church and the Corrick County Sheriff's Office chaplain to deliver the invocation.

I promise you I will not preach today. I'd just like to say something before I do pray. I thank God for Sheriff Asa Buck, who asked me about five or six years ago to come and be the chaplain to him and to the deputies. He definitely told me, he said, not to the jail. He said, Chad, I need you, and the deputies need you. So I thank God for that. And God has blessed him and he's going to continue to do great things for the county and the state, I believe that. About three weeks ago, I called John Nyberg to meet with him. And I met with him for about an hour. And I will say this. John is a kind-hearted person. And I shared with him before I left. One of my parishioners several years ago told me when I started to pastor. And that time I pastored an all African American church. And it was hard. And she told me, she says, stand firm, but be gentle. And I did that. And God delivered me from cussing. And I thank God for that. But I'm at a place now, it's multicultural, and it's just as sweet as it could be. It almost blowed my mind. I thought I had died and went to heaven. But John, stand firm. You have to. And be as gentle as you can. Because not only are you dealing with the deputies, you're dealing with the county. And I will continue to pray for you, my brother. Let us pray. Father God, I thank you. for sheriff buck the years that he served and we thank you for him and that you will continue to grace him and be with him but lord we thank you for john nyberg who's standing in the gap sheriff elect and i believe in my heart in november lord he will be the sheriff But right now, he will be the acting sheriff. So we're asking you to be with him, his wife and his children and grandchildren, and to be with this county. In Jesus' name, amen.

Amen. Thank you, Reverend Barrow. In accordance with the State Government Ethics Act, it is the duty of every board member to avoid both conflicts of interest and the appearance of conflict. Does any board member have any known conflict of interest or the appearance of conflict? with respect to any matter coming before the board this evening or this morning. If so, please identify the conflict and refrain from any undue participation in the particular matter. Is there a motion to adopt the agenda? So moved.

Motion by Commissioner Shin. Second. Seconded by Commissioner Moore. All in favor? The purpose of today's special meeting, as previously stated, is to fill the vacancy of the Office of Sheriff. As required by North Carolina law, the board has consulted with the County Executive Committee of the political party with which the former sheriff was affiliated and has received its recommendation. The board will now consider the matters necessary to fill the vacancy, including approval of the sheriff's bond, appointment to the Office of Sheriff, and administration of the required oaths of office. Mr. Clark, we got the bond, and we got the recommendation from the executive committee. We're going to have three separate motions. I'm going to read the motion, and then I'm going to ask someone to say so moved, and then someone to second it. The motion number one is for the bond approval. the Chair will entertain a motion to approve the surety bond and related bond instruments for John Robert Nyberg for the Office of Sheriff of Carteret County in the amount required by law and to adopt the related resolution contingent upon his appointment to the office.

Chair, we entertain a motion to appoint John Robert Nyberg as sheriff of Carteret County to fill the vacancy in the office of sheriff following consultation with the county executive committee of the political party with which the former sheriff was affiliated and based upon the committee's recommendation in accordance with North Carolina law. So moved. Motion by Commissioner Moore, seconded by Commissioner Waldrop. All in favor? Next, we will have the administration of the oath. The Honorable Clint Rowe, Senior Resident Superior Court Judge for District 4, will administer the oath of office to John Robert Nyberg, Sheriff of Carter County.

Do you, John Robert Nyberg, solemnly swear that you will support and maintain the Constitution and the laws of the United States and the Constitution and laws of North Carolina, not inconsistent therewith, and that you will faithfully discharge the duties of the Office of Sheriff, so help you God? You, John Robert Nyberg, solemnly and sincerely swear that you will support the Constitution of the United States and that you will be faithful and bear true allegiance to the state of North Carolina and to the constitutional powers and authorities which are or may be established for the government thereof, and that you will endeavor to support, maintain, and defend the Constitution of said state, not inconsistent with the Constitution of the United States To the best of your knowledge and ability, so help you God. And do you, John Robert Nyberg, solemnly swear that you will execute the Office of Sheriff of Carteret County to the best of your knowledge and ability, agreeably to law, and that you will not take, accept, or receive directly or indirectly any fee, gift, bribe, or duty or reward whatsoever for returning any man to serve as a juror or for making any false return of process

Sheriff, you want to make some brief remarks?

Well, I thought we would do that once in the other room. In the interest of brevity. We'll hold you off right now. OK, I'm going. We're going to turn around and do this all again in the other room with all the other deputies. I'm extremely humbled. It's quite a day for me and my family, and I thank for Carteret County. We've served and had an individual that served us as citizens of Carteret County for almost 20 years. They are big shoes to fill. The one thing that I will not be able to do is talk as long as he has. So the rest of it, I wholeheartedly will pour my whole self into this opportunity and this job and this purpose. So thank you very much.

Thank you. Thank you. Congratulations, John. I would like to invite everyone over to Superior Court Room number one. We're going to have another ceremony there. But the years I've known John Nyberg, he's been a man of great integrity and honor and a hard worker. I told him he was kind of a little quiet for politics. We're going to try to break him out of his shell, but he's coming along, but he is a first-class person, and he does have big shoes to fill with Asa. Asa led in the same matter, and we are certainly grateful to have a quality person as our sheriff to continue on through the many changes that's going to be happening to the jail and the sheriff's office as the county continues to grow. I'll entertain a motion to adjourn.
