And so we are requesting that we can apply for the TOC's and be able to do this in a phased program, in a phased um timeline. And one of the reasons that we're asking for that is because if I try and get all this done as quickly as possible to get back in that building, then I'm not going to be able to do it in a in a in the in the best form for a for a business purpose. Um, and so I'll kind of just try to be putting together what we can just to get us operational. But if I have the time, I can do it right. I can do it correctly and we can go through the city. We can get all the permits. But we're not going to be able to do that in 30 days, even in 90 days. It's just not feasible. We can't even get permits for for 90 days. Um so our request tonight is um our main request is um approval of temporary occupancy certification effective immediately um to allow us to resume operations. Um our second request would be the variance approval for the existing compact crush asphalt um with improvements made in the future if the intensity increases. And then on the the screening, the buffering, um if you guys could allow flexibility where

appropriate, um we have a couple of neighbors that don't wish to have um the the fencing and so they are willing to write letters to the city and and get those bring those up here. Um and so we were asking to if if that is something if the neighbors are not wanting that fencing, do we have to put it up along their property? Is it a safety thing?

It could be both. So, it it's something that's required by the corridor development ordinance, but that is one of the things that planning and zoning controls. So, if it was a gas station, which is something that we talk about quite frequently, then we could understand why you wouldn't want children in your yard or elderly or whatever the case may be having free range onto a property where a gas station may be where there's high traffic. This is a bit of a different situation. So, if there are neighbors that are willing to write letters and have a strong opposition to having that screening there and they're willing to submit that and have it as part of the record and planning and zoning is not opposed to it, then the board does have the commission or the board does have the discretion to make that exception.

But I just I'm just going to read this really quick. Our operation is not a it's not a traditional profit driven business. We're a small self- sustaining facility that provides local coaches with the opportunity to earn supplemental income while serving youth in our community. We operate on a month-to-month basis. Um, generating just enough revenue to cover expenses and maintain the facility. Um, if we're unable to reopen, our teams will have no choice but to relocate to other facilities. Once those teams leave, you know, we we are not going to be able to meet financial obligations. Um, we're not asking to avoid compliance. We're just asking for time. Um, we've already began working with the city to establish a plan. We have the timeline. Our request is for 12 to 18month time frame based on the realistic financial constraints and and also to give us the opportunity to apply for the bear program. Um so we're committed to bringing the property into full compliance. However, without the ability to operate, we will not have the means to compete complete those improvements.

What I'm saying is that the things that are the most important to me are the are the life safety and the sanitation. Those two those need to come first and then I don't know that you're going to be able to qualify for the bear program for a well and a septic because this is still neighborhood commercial. So that means that in some point in time you could put your home here. So then you've received public funds for a well and a septic that the rest of the citizens had to pay.

So one of the um one of the financial resources for us would be our income tax for next year, which would apply a big down payment for most of this. The only thing that we didn't give any of the other businesses when we've had this happen before we work with people but we give them about nine months to come into compliance.
