I am here. We have five present this evening. Thank you, sir. Before we start, I have to read off our normal script. The board met in executive session prior to the start of this public meeting. During this confidential session, board members addressed and reviewed topics concerning legal matters, personnel issues, and land related concerns. These discussions were conducted to ensure the sensitive nature uh subjects were handled with the appropriate level of privacy and attention. I would like to remind all present that in accordance with township policy, every public meeting is tape recorded. Notices of this procedure are displayed within the meeting room. The purpose of this recording is the produce is to produce accurate minutes and to ensure that all comments made during the meeting are thoroughly documented. In addition to audio recordings, we have recently begun live streaming these proceedings providing broader access and transpar transparency to the community. For the benefit of the record, please speak directly into the microphone sharing your full name and address so that your remarks are clear captured clearly. Each participant has three minutes to provide comments. If additional time is needed, it may be granted at the discretion of the chairman. With that being said, our first open session for comment is now available. You'd like to get up and say something.

Good evening. My name is Janice Rian and I live at University Manor East in Hershey, Pennsylvania 17033. I'm here on behalf of a group of residents who have spoken at these meetings over the past several months about how the township handles federal civil immigration matters and protects residents. In previous comments, we have spoken about dairy residents who are immigrants, workers, neighbors, health care professionals, and researchers, and about the real harms that can occur when immigration enforcement operates without appropriate local safeguards. The board's consideration along with plain language summaries. These ordinance do not change federal immigration law. They cannot and they do not try to. What they do is protect Dair Township residents at the local level by setting clear guidelines for how township police engage with civil immigration matters, protecting township license plate reader data if ever if ever such data is collected from being shared with federal immigration enforcement and affirming the town's local decisionmaking authority under the secondass township code with federal and state authorities that the law requires. Three Pennsylvania municipalities, Philadelphia, Pittsburgh, and Lancaster, already have similar ordinance in place. Carile also has one. Our quest tonight is straightforward. Please place one of these ordinances on a future agenda, and please direct the township solicitor to review them. We are prepared to attend a workshop, support the solicitor's review, and answer any questions the board may have. Thank you for your time.

Uh, as I stated before, uh, the question about immigration, whether illegal, legal, uh, I've been looking into this. uh vast again if these people are so afraid let's set up a forum bring these people in let's identify and see what their fears are uh in investigating this I just learned that Dur Township has several members of the community that might be beyond their legal stay under visa particularly J visas so I think it's something every every meeting we're hearing about this and So why don't we get these people in here that are afraid sit down with a police chief sit down with this board sit down in a public forum and identify what these fears are and what their status is. So another issue again is the extended visas who expired are these part of people that are afraid. Thank you.

Thank you Mr. Gamble. Anyone else? My name is Katherine Burns and I reside um on Governor Road in Derry Township. I would like to read a statement from the Dolan County Bail Fund supporting these ordinances described by Denise and submitted to the board. The Dolphin County Bail Fund supports the proposed ordinance limiting ICE collaboration in Dair Township. ICE operates most effectively when they are able to leverage local relationships and data access. While Derry Township Police Department does not have a formal 287g agreement with ICE, there are still various gaps that expose our immigrant community to further harm and limits their ability to access government services. In a review of data on Dolphin County ICE apprehensions through the deportation data project data set, there were 215 instances of people being apprehended by ICE. 65 of those incidents involved Dolphin County courthouse, prison, and probation. We are just one year into an aggressive federal campaign to restructure citizenship, leaving immigrant communities struggling to feel safe in their own homes. To reassure the community's confidence in the safety of their home, a welcoming county policy must be adopted. Such a policy would promote inclusivity and unity, expand economic opportunity, enhance public safety, and protect the township from legal liability associated with ICE collaboration. Federal law does not require localities to to participate in or enforce federal immigration law. To the contrary, immigration regulation and enforcement are squarely federal functions. This is per Arizona v. United States. The Bucks County Sheriff lost

re-election due to his stance on the department's 287g agreement. A contract that the incoming sheriff terminated upon taking office. The time to take a stand for our neighbors is now. Across Dolphin County and the Commonwealth, communities are coming together to support their neighbors and to push local governments into adopting policies which realize their will for a safe and welcoming community for all, irrespective of one's immigration status.

Uh Derry Township has been invited to participate in commemorative events associated with the memorial park housing project, including the exhibition on the history of the Battle of the Bulge and the unveiling of a national monument honoring soldiers of the 28th United States Infantry Division. These events are scheduled to take place from May 5th through May 10th, 2026 in Hosington Hosinganin, Luxembourg. Supervisor Zamuda is interested in attending as a representative of Dair Township. The municipality of Park Hosingan has agreed to cover all costs associated with travel and lodging, resulting in no expense to Dair Township. This resolution will authorize Supervisor Zamuda to represent Dair Township in official functions, ceremonies, and related activities associated with this event and to further discussions regarding a potential sister city relationship.

"Yeah, uh Steve Kendzel, assistant director, got some background on the resolution. Uh public works is requesting to standardize and update the township's policy, procedures, and reimbursement cost for damaged mailboxes. The current pol policy established in October 19th of 1994 provides minimal guidance and sets the reimbursement amount at only $30 per mailbox. After more than three decades, the policy no longer reflects modern mailbox construction, current material and labor cost, or contemporary public works practices. As a result, the outdated reimbursement amount does not adequately cover reasonable replacement expenses and the lack of detailed procedures has led to inconsistencies in how claims are reported, reviewed, resolved. Updating the policy will ensure fairness to residents, improve administrative efficiency, and align the township practices with the current operational and financial realities. Currently, when the township is notified of a by a resident that their mailbox has been damaged, staff simply inform the resident of the reimbursement amount and documentation required to receive payment. This process, while functional, lacks clear standards and does not define when the township is responsible for the damage. The proposed update dated policy will establish a comprehensive framework that identifies the reasonable party, outlines eligibility requirements, and

set standards reimbursement cost. By formalizing these procedures, the township will ensure consistency, fairness, transparency for both residents and the township. Resolution number 2026-14 establishes clear eligibility criteria for reimbursement of damaged mailboxes. Under the updated policy, a resident is eligible for reimbursement only when township owned and township operated truck, snowplow, or other piece of equipment physically strikes the mailbox. Damage caused solely by force of weight of the plow wash, such as snow, ice, slush thrown from the plow, is not eligible for reimbursement. To qualify, residents must report the damage within 72 hours of the incident and must provide photographic evidence of the damage or video footage of the incident along with the date and time the damage occurred. Mailboxes must follow United States Post Office placement guidelines which are a part of this policy update. Payment will not exceed $100 per mailbox. These requirements ensure a fair, consistent, and well doumented process for elevating or evaluating claims. Uh the financial impact reimbursement expenses associated with damaged mailboxes will be paid from the public works general fund 01-43-221.

Thank you. What's before you is a stipulation and settlement agreement between High Hotels, the zoning hearing board, and the Dair Township Board of Supervisors. Uh, this applicant uh went before the zoning hearing board for a hotel at the property located at I just had it 12:45 Coco Avenue uh back in the fall of 2025. Uh the zoning hearing board uh denied the application uh given the fact it found that it was a residence hotel not a regular hotel. A regular hotel is permitted on the property. A residence hotel which was not. The applicant has since uh appealed that to the quarter of common please of Dolphin County. Uh this settlement agreement is put together and it provides for the applicant we removing certain pieces of equipment and/or appliances from each of the rooms uh that the township's position uh qualified it as a residence hotel. They have since removed those and those are set forth in the stipulations settlement agreement before you. The applicant has also agreed to extend the pathway along the front edge of the road offsite uh u past two uh additional properties uh from the proposed sidewalk on the property as well as provide uh the township of Derry with a payment of $50,000 to be used towards the acquisition of any right ofway or easements that would be necessary for the additional uh pathway. And in the event that there there is no additional right ofway that's necessary, that money can be used for other public purposes as deemed appropriate by the township. Uh they will be posting the requisite financial security associated with that additional uh pathway extension. Uh and this is like I said this is a stipulation and settlement agreement proposed to resolve uh the current land use appeal before the court of conflict of telephone county. Uh, are there are there questions or concerns for me at this time with

So, Chief Warner has been so gracious to uh submit this request every year for the annual uh Memorial Day ceremony at Chocolaton Park. Now, in our court of honor the last couple of years, um we usually submit this request due to the sound and the noise um with the the ceremony events. So, doing this just kind of helps with that so that everyone can focus on what's going on um and kind of buffer the sound a little bit um along with also contracting with the sound company so that we can make sure the everyone in attendance is able to hear everything. But I'll let Chief kind of go into the the closure details.

Yeah. Uh so in addition to the mitigation of uh sound around the the event, um it's also going to increase the safety for the guest attendees and participants, uh the Memorial Day ceremony uh at the east side of Chapel Town Park. Uh we're going to limit motor vehicle traffic around the site of the event. Uh it is proposed that state route 743 from 422 to Caracus Avenue be totally closed and the eastbound right straight through lane and right turn lane of State Route 422 from Lynen Road to to State Lane of 422 eastbound will remain open for eastbound traffic. Uh the closure will take effect around 9:30 and remain in effect until the end of the event and the clearing of pedestrians of the roadway. It's usually around 12:00 noon uh when we can open that up. Uh the traffic control points will be uh staffed by police department personnel. Uh we usually can make some scheduling adjustments to reduce the amount of overtime so there's less of a budget impact for the event. Uh um but uh we'll man those posts with uh department personnel have signage up barricades uh and so forth to complete that closure.

Yes. So, you'll you approve it here at the township meeting and then uh I uh fill out and submit a T300 to PennDOT for their permit uh to be able to uh conduct that closure. Um and uh usually um I think with today's technology, it used to be about a month to two months till we get that approval back. I think it's now about a week, week and a half. Uh so uh we'll be able to and being that we have done this closure at least three times before um I don't think there'll be any issue with it. Thank you.

Thank you, Mr. Chairman. Uh request was received from uh Dale Forchy. Uh he's with us uh in the audience uh here tonight of Love Inc. to hold the fifth annual Love Inc. 5K run on Saturday, June 27th, 2026 starting at 8 a.m. The event starts and ends at Spring Creek Church of the Brethren. Roadways involved in this race will be East Reba Avenue, Parah Avenue, Meadow Lane, Crest Lane uh which is MHS property and Golf Lane which is MHS property. Roadways will be closed during the event for the safety of the participants and all closure points will be staffed. Any of the involved township roadways will be closed for approximately 30 to 45 minutes. Once all runners are on Crest Lane, any involved township roadways will be opened. Um, this race route is easily managed. We've done it uh for several years now. Uh, residents and others looking to access or leave places uh within the race route. Uh, they'll be allowed to do so when it's safe. So, usually a break in the runners uh groups of runners and so forth if we can get people in and out of the uh the race area. Uh we do that uh with our staffing. Um the posts are planned to be manned by special fire police uh from local fire departments and Milton Hershey security. Uh if overtime coverage is required by our department, the event organizer is aware of the township's reimbursement policy and has indicated their understanding and acceptance of the policy. If police assistance is required, it was requested that at least two weeks notice be provided to the Dair Township Police Department. We've got it on our radar um to uh see if we're going to need to assist with that and our traffic safety unit is aware of that and they'll kind of monitor if we're going to need to uh uh post anybody at any of the traffic control points. But uh it's been a well

Okay, our next order of business, construction of a new accessory structure at 19 East Chocolate Avenue within the downtown core overlay zoning district. Mr. Jackson, I'll take this one, too. Take Chuck's place. I will try and try and fill the void.

It's going to be a tough one. They're big shoes to fill. Uh the downtown area of Hershey has had specific regulations and design standards since the adoption of the 1993 zoning ordinance. The use of this overlay and regulations were also supported by the most recent comprehensive plan. The current zoning ordinance includes a robust section related to the downtown core design standards. The board of supervisors has sole approval authority for any new construction of a principal building, principal structure, accessory building, or accessory structure lo located within the downtown core overlay. The applicant, the Hershey Company, proposes to inol install cooling towers, a mechanical shed, a visual screening wall, a security fencing for mechanical infrastructure improvements. The applicant's March 13th submission information is attached to your agenda item. The applicant has provided renderings of the proposed improvements which you can see on the screen uh for the board's consideration. It appears to be intentionally located to be well screened from view and the board needs to make a determination as to whether the new accessory structure is designed in a similar style and pallet to the primary buildings to which they are accessory. And we do have the applicant here this evening to answer any questions that the board may have.

Good evening members of the board. My name is Gregor Regolski. I'm with Penoni Associates. We're the design engineer for the project. Uh with me tonight is Andy Hawk and Kenny Heinball from the Hershey Company as well. Uh here to present this evening. As Mr. Jackson indicated, a relatively straightforward application related to an accessory structure for the construction of a new cooling tower. It is located in the downtown core uh uh board area. Um, it's proposed to be located uh in the rear of the 19 East property, which is the primary office building for the Hershey Company. Uh, back along the railroad tracks. Uh, it is, uh, only marginally visible from Chocolate Avenue. Um, and the actual topography in the area pretty much screens it from, uh, any viewshed from the north looking to the south, which would be Trinidad Avenue across the railroad tracks. Um we did uh approach the design review board where we did uh receive a recommendation for approval. Uh the project also required a zoning variance for the height of a screen wall. The actual equipment itself is about 20 ft tall has a railing around the top of it. So the total height of that um package if you will is about 23 feet 6 in. So the screen wall will is intended to screen that equipment on two sides and then the other side faces the railroad tracks and the old silos. So um on this particular uh document for have a pointer but if you see the oh if you can go go back uh the Hershey kiss shaped pathway in the upper left corner um to the left there um it is proposed to sit up in that area in the back immediately adjacent to the railroad tracks in the area of the old power plant. Um that's all I have at this point. Certainly here to answer any questions you may have. Any questions from this board?

Uh, I I have a couple questions. I'm just trying to get a feel for how this changes what's currently there. You know, a lot of people in town have been here a long time. They're used to seeing the smoke the stacks and everything else. It appears that there are still going to be there, albeit with a different appearance. Correct. This project is is mechanical of water uh routing. Um this does not have anything to do with the actual power plant or the stacks themselves.

And although these towers are uh the modern towers are 20 feet tall which is considerable height because of the distance from the street you're not expecting them to be very visible. Correct. I I don't think anybody short of having a drone or a helicopter will be able to see much of this particular thing. and and of course you uh will plan on continuing to care for and maintain the trees that you have to help shield correct those uh what about the water that's directly behind the current um uh power plant I guess we'll call it Spring Creek

Uh my my question is how much steam do you think will be coming out of these cooling towers? like will be constant.

So, it is mechanical equipment. It is um it's not a steam generating facility. It actually is a cooling tower. So, it's it's it's condensate essentially. Um it Andy, do you want to help me in that a little bit? I I don't know how to kind of maybe describe it. You're certainly going to see something coming off of there. Three mile island. Yeah. It's not like level forceful steam emission.

So, I think that's a fair statement. Andy Hawk, the Hershey Company. Um, I don't know if any of you ever drive past the Reese plant on a cooler morning. Uh, the cooler the weather, the more you can see the the evaporative water coming off of it. Um, however, as the temperature rises, that visibility disappears. Um, you wouldn't expect to see this more than 15 or 20 feet above the tower on a worst case scenario, unless there's fog already in the area. What about um noise there? So they've replaced all the chairs. Um, and then looking at their statistics, they've had an average of 11,562 visits over the first quarter and 36 meetings averaged as well. So, they're things are hopping over there. That's great. That's great.

I also want to mention that I think all of us on the board here except for Mr. Curado who's uh incognito so to speak right now uh went to PATS which is our annual uh township board meeting. There's hundreds and hundreds thousands of people at that thing. Uh we're all smarter for it because we all attended different different types of I call them TED talks. Um, so we're excited about that and looking forward to seeing everybody this Saturday. Uh, additionally, the new attack engine is here. It is at Glick still getting the equipment done. It's almost finalized there and then it will u make a debut at the Harrisburg or actually it's the Lancaster County Fireman's Expo that's being held at um up at Harrisburg at the Farm Show complex. So that's May 6th, 15th and 16th. That's a huge fire show or emergency services show. So it'll be there for those two days. Then it uh I believe it will come to the firehouse directly from there. Uh lastly, uh firehouse activity. Uh the firehouse was uh provided mutual aid this this past two weeks to two significant fires. Uh one was in Palmyra for a structure fire. This the second was last evening up in Grantville for a barn fire. Uh they operated overnight there for about two two and a half hours. Um so it's been a we have a busy week. The only thing to add to the uh discussion from this morning's meeting. Uh, the intersection of Hershey Park Drive and Louderdermilk Road has been approved by PennDOT for the left turn arrow change. Uh, that's turning from Hershey Park Drive. If you're coming away from Trogues to make a left on the ladder milk north, uh you'll see that signal that that pendot's processing the permit once that's issued and installed, uh the signal head there will be changed to a flashing yellow arrow instead of what's there now. And certain times of day, you'll only be able to make the left turn on the arrow and won't be able to. Otherwise, there were a lot of crashes that were occurring there uh specifically in the afternoon. So, from the hours from 1 to 9 in the afternoon, you'll only be able to um make a left turn on the arrow and not other times.

Um and I had one question for maybe HRG and the those who attended the transportation because it's relating to the bikes. Um the change of the slow or the site distance on Aribba and Hawkersville.
