What? Jacob said you didn't give him them dates yesterday.

and your testimony is a matter of public record. This is an official proceeding. Any false statement you make may be referred by this board for prosecution for perjury or for false swearing. While these proceedings are less formal than a court of law, the board will consider relevant, reliable evidence and will determine the credibility and weight to be given that evidence. Please do not interrupt while others are speaking. I will ensure that all parties with relevant, relevant, relevant information have an opportunity to be heard. You may not have the opportunity to respond to what someone is saying as they are saying it. Make a note in your head as soon as they're finished speaking, then make the comment that you need to make. If at any time things get out of hand, out of control, I will cease all communication until order is restored. After hearing from both the county and from the appellant, the board will determine whether to uphold the citation and any associated fines. The board also has the discretion, based on the evidence, to adjust the fine or to conditionally discharge it. Each case is decided on its own facts and merit, and prior outcomes do not control the result in any other case. The board, again, cannot and will not provide legal advice to any party. When your case is finished, please wait for a staff member to bring a copy of today's order. If you're appearing virtually, a copy will be mailed to your address of record with the Jefferson County Prop Evaluation Administration. With that, Mr. Abrams, can we hear any pre-conference cases?

10:27 – 12:59Speaker 8

Hearing no additional input relative to these pre-conference cases, I here uphold these pre-conference orders. Ladies and gentlemen, good morning. Again, my name is Chris Waltland. I'll be hearing cases along with Ms. Schneider and with Ms. Waddell this morning. Please make sure that you have signed in when you came in. That's how we call your case. We will call it by your case number as well as the address, so just please pay attention. If at any time you have to leave, go put money in the meter, take a call, so forth. If you'll let... Officer Close, no. So that way, if we call your case, that way we can recall it and don't put you down as a no-show. The way this will work, we'll call your case. You come up to the podium. You'll be sworn in by Ms. Keene. You'll be under oath. It'll be up to the county, which is Mr. Howard, Mr. Spinlaw, and Ms. Barnett to present your case. Once they've presented your case, or their case, then you will have your time to present your case. After that, if there's no rebuttal, then the hearing officer will make a determination on your case. You'll get a copy of it to take with you. Is there anybody here who's here with either an estate, an LLC, or any kind of a company? Do you have an attorney with you? As long as you have an attorney here, we'll hear your case. If not, and it's your first time, we will pass it for 30 days for you to get an attorney. If it is not, then we can't hear any testimony from you under guidance from the Kentucky Supreme Court. So we'll just have to go ahead and decide your case then. So bear with us. Folks, I'll go ahead and make my usual spiel. I say it every week because it is that important, is I am not here to take your money. I don't get any bonus or anything on how much money I take. I am not here to take your money. What I'm here is to get your compliance. And if I can't get your compliance to get your property within the ordinances and up to par, I'm going to get in your pocket. And once I get in your pocket, I'm going to stay in your pocket until I get your compliance and it comes up to standard. I can take it all year long. We can put liens on that property. We can foreclose on that property. So the one that's going to decide it isn't me, it's going to be you. So if you want me to take your money, by all means, don't do what I say. But as long as you're working with me, you're truthful, you're honest, and you're making an effort, I'll work with you. If you're working on it, I'll give you more time. It's when you sit on your butt and do nothing, when you lie to me, you deceive me, or you just absolutely do nothing is when I'll just keep taking your money. So with that, let's go ahead and call our first case.

13:01Speaker 4

ENF-LMPD-26-000.

13:06 – 13:33Speaker 31

0032 7500 outer loop. Do we have anybody here on the street racing case? Ma'am.

13:40Speaker 30

Bernal Collier? Bernal Collier? Online or in the old jailhouse? Anybody?

13:53 – 14:08Speaker 33

We have an agreed judgment that we presented to you all. What we could do is, I don't think there's anything in there that has to be enforced as of today. So give me some, let's just redock it at two weeks out. And by that time, we could probably have it signed and resolved.

14:09 – 14:21Speaker 8

The 7th. So we will go ahead and roll that matter to August the 7th, hopefully for an agreement. Right. Okay, so ordered. Next case.

14:26Speaker 4

ENF-PMNT-24-014962-12, 815 Market Street. Okay.

14:46Speaker 30

Good morning.

14:47Speaker 10

Good morning.

14:48Speaker 27

Can you please state your name, please?

14:49Speaker 10

Tanner Nichols.

14:50Speaker 27

And what's your association with the property?

14:52Speaker 10

The council for the Glassworks building.

14:55Speaker 27

Okay. And who do you have here with you today?

14:59Speaker 27

Is he going to be testifying?

15:00Speaker 27

All right. Can you step to the podium, sir? Please state your name.

15:03Speaker 34

Lee Wayland.

15:04Speaker 27

Raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

15:09Speaker 27

Thank you. Lakin, state your name. Lakin Barnett. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth? Yes, I do.

15:16 – 15:48Speaker 26

Thanks. On 6-12-2026, the 12th visit to the property, a $600 penalty was placed for... No compliance on interior surfaces originally cited since 11-22-2024. We returned to the property on 6-12-2026 and found no compliance on the interior surfaces and I'll get you photos in just a moment.

15:56 – 16:21Speaker 29

Here we have some interior surfaces. This is a ceiling that is in disrepair. Here we have another photo of the same thing. Here we have some more wall surfaces in disrepair. More wall surfaces in disrepair.

16:26Speaker 26

That's all the photos we have at this time.

16:27Speaker 14

And, Laken, is this just a paint issue? Is this something structural here?

16:32 – 16:43Speaker 26

It appears there was a leak, and then the walls just have various holes and items from the leak. This is listed as occupied as well.

16:44Speaker 8

Go back to that first photo, the ceiling photo. That one. And this is an occupied structure?

16:53Speaker 26

Yes, this is listed as occupied. It looks like a major crack. Yes.

16:57Speaker 14

I will submit that these photographs establish the conditions of the citation as they existed at the time of the citation as they still exist, and I'll reserve any questions for the appellant.

17:04 – 17:17Speaker 8

Mr. Spindle, do you have any safety concerns with the amount of, I mean, I'm looking at a massive crack in a ceiling, on a concrete ceiling, and this place is occupied. Are we looking at some structural degradation here?

17:23 – 17:44Speaker 14

Yeah, I would say most likely we were looking at some sort of structural degradation. I don't believe we've had... We don't have anything listed for structural degradation, but this is definitely something that, if not dealt with, could absolutely turn into something.

17:44Speaker 8

No motion to vacate at this time?

17:46Speaker 26

No, we do have this listed as a possible hazard. It's been a little ongoing, so we've been monitoring this.

17:53Speaker 14

With more time, it could turn into something like that. But at this time, no, we do not have a motion to vacate this property.

17:58Speaker 8

All right. Counsel, you got my attention.

18:00 – 18:51Speaker 10

Yes. And so the reason they appealed is it's the wrong party. So this dispute, this is a condo, and this dispute is between the unit owner and the HOA. As you all know... all the common space here is owned by the condo association. And then, so there's a dispute and there's an ongoing litigation between the unit owner and the HOA. Lee and his group, they're just a condo unit owner in the building. And so the notice is going to the wrong party. And so that's why the appeal here is here. Now, I also have... the address for the condo association, this is where these notices should be going.

18:53Speaker 27

I did note in your appeal that you mentioned that the address was previously the same, but it's under new management. When did that happen?

19:00Speaker 10

Lee, when did they start?

19:02Speaker 34

19:04Speaker 30

Okay, when was the date of the citation? Okay.

19:14Speaker 10

So I think, yeah, we're just asking that this be sent to the HOA because that's who the dispute's with.

19:20Speaker 27

You're asking basically to resend the notice? Yes. Okay.

19:24Speaker 10

And then to have the proper parties here. One second.

19:29Speaker 27

Mr. Weiland, you're not an agent or an officer of the HOA?

19:33Speaker 34

I am an officer of the HOA. You are? I am a vice president of the, I don't know my exact title. I think I'm vice president or secretary.

19:43 – 19:58Speaker 10

We also have a report about the safety issue from an engineer saying that it's not a safety issue at this point. I mean, I guess if it went uncorrected, it could become, but we have a report.

19:58 – 20:23Speaker 8

Right, but it looks like it's still sitting there and it's not being corrected, so that just causes me concern that we know about it, and this has been going on since 2024. We're now in 2026, so this has not been addressed, and it's not getting any better, so... Is this inside of a unit or is this in a common area?

20:24Speaker 34

This is inside of an owner's unit.

20:27 – 20:38Speaker 10

And, yeah, their dispute is who's responsible for the repair, too, and is it a roof or is it a window? And so that's ongoing litigation to correct it.

20:38 – 20:52Speaker 34

We've had two structural engineers look at the structure. It's an 11-inch reinforced concrete slab. That is a surface crack, and the structure for the property is still robust, more than enough to carry residential loads.

20:52Speaker 14

I just want to clarify for the record here. You mentioned being a condo owner. Are you the owner of this interior condo or the outside building?

21:02 – 21:17Speaker 34

Well, the condo association owns the shell structure. Right. I do not own this unit, and the structure is owned by the association. I represent an owner of other units within the building.

21:27Speaker 10

Yeah, I'm not trying to. I think if we just send this notice to the HOA, they'll just have to come here and either pay the fine.

21:34Speaker 14

We're going to request that this be pushed out 60 days so we can figure out what's going on and who exactly needs to get the notice and what's happening. Thank you.

21:41Speaker 8

So in the matter of ENF-PMNT-24-014962-12, the address being 815 Market Street, we are going to put this out to...

21:50 – 22:03Speaker 25

They don't need this. That would be September 25th. September 25th. Is that good?

22:04Speaker 8

Mr. Abrams, September 25th.

22:06Speaker 31

28th is on him.

22:22Speaker 8

September 25th? Okay. So we're going to move this to September 25th, and hopefully we can, you know, get you guys out of here and get it to the appropriate party and just take a better look at it.

22:33Speaker 31

All right. Thank you.

22:33Speaker 8

Thank you all.

22:56Speaker 4

NF-ABC-26-00701, 3331 Red Roof Inn Place. Red Roof Inn.

23:06Speaker 27

I'm going to go ahead and get the officer from ABC sworn in. Can you state your name for the record?

23:12Speaker 7

Wesley Barber.

23:13Speaker 27

Do you swear from the testimony you're about to give us the truth, the whole truth, and nothing but the truth? I do. Thank you. And sir?

23:17Speaker 7

May I? Sorry.

23:19Speaker 27

I'm going to have you enter your appearance.

23:20Speaker 7

What's your name? My name is James Konkin, C-O-N-K-I-N. I filed the appeal for this, but we're here today to withdraw our appeal.

23:30Speaker 30

Withdraw the appeal?

23:35Speaker 8

Anything to add, Mr. Pinlaw?

23:37Speaker 14

I don't believe so.

23:38Speaker 7

If they're withdrawing the appeal, I don't think we have an issue with that. Yeah, we've closed the business there, and if we reopen, we'll apply for a new license. Okay.

23:49Speaker 7

There might be two. I know this one came in. The other one was an accident. It's just the one on.

23:58Speaker 27

Just the one on.

24:00Speaker 40

The BRD is a good one. The ABC is a bad one.

24:03 – 24:19Speaker 8

Okay. So the matter of ENF-ABC-26-00701, that one would be dismissed as it was the... Okay, so that would be dismissed in error. In the matter of ENF-BRD-26-00706, Mr. Spindle, what say you?

24:20Speaker 14

We have no objection to it being withdrawn.

24:22Speaker 8

Okay, motion is withdrawn.

24:24Speaker 7

May I ask, on the first one you said, is that under a name of a person?

24:30Speaker 8

It was also under Tranco LLC.

24:32Speaker 7

That's what I thought. I didn't understand why that was here anyway. Okay.

24:38Speaker 8

You're done. Thank you, Councilman. Thank you very much.

24:40Speaker 30

Have a good day.

24:43 – 24:58Speaker 31

Hang on, Mr. Conkin. We'll give you a piece of paper. Okay, thanks. Next case.

25:10Speaker 4

NF dash SWMS dash 26 dash 000158 914 39th Street. 914 39th Street. Corey Robinson.

25:37Speaker 8

What time was this case set for? Was it set for 8.30? Yes. And we're now at 9.01?

25:42 – 26:06Speaker 33

And I would let the board know that he was a no-show for the last time that this was set. And we have an officer here. I don't want to keep him here all morning for someone who didn't show up for the last hearing. Is it still at 2.50? No, it is $500. Okay. Okay.

26:10 – 26:34Speaker 8

So in the matter of ENF-SWMS-26-000158, address being 91439th Street, petitioner is not present at 9.01 a.m., was noticed for 8.30, even asked for this to be redocketed. I did allow it to be redocketed. Fine is $500. I will now uphold that citation, and I will uphold that $500 fine for non-appearance.

26:36Speaker 33

We would ask that any attempt to redocket this be denied.

26:47Speaker 4

NF-SHL-25-000320-3 2500 Muhammad Ali Boulevard. You're up.

27:13Speaker 27

Good morning, sir.

27:14Speaker 13

How you doing today?

27:15Speaker 27

Good. Can you please state your name for the record?

27:17Speaker 13

Bernardo Good.

27:18Speaker 27

Please raise your right hand. Do you swear or affirm the testimony you're about to give us the truth, the whole truth, and nothing but the truth? I do.

27:25Speaker 27

Is this you or is this Mike? Mike. Can you please state your name for the record?

27:32Speaker 39

Mike Wilshire.

27:33Speaker 27

Do you swear or affirm the testimony you're about to give us the truth, the whole truth, and nothing but the truth?

27:41 – 28:06Speaker 17

Yeah, so last information we had was that the still operating as a transitional house without the required permits And we had requested that have an internal inspection To check to see if the house was in fact still being used as transitional housing or not Is that correction yes, and then I think you have a scheduled interior inspection and

28:08 – 30:26Speaker 13

I've been dealing with this for a while and she came, I was out of town when they called me, I allowed them to go in. I have a lease with the two gentlemen that stay there, they're on the same lease. And it was, the way the house was set up is, it was set up the way when I bought it, it's a, apartment upstairs, apartment downstairs, but you could come through. It got two doors in the front. One door was sealed off where you could come through the front door, the left door. And once you come through the left door, it was an opening right here. So she was saying that they occupied the whole building. And I was telling her it was upstairs. She said, need to be sealed off. And I have the picture showing that we sealed it off, put a wall up. So it's a separate entrance for, uh, upstairs and downstairs both of them on the same lease uh so uh i'm trying to figure out what more would y'all like me to do to rectify the situation Because the problem was the downstairs that's empty and the electricity is off. Nobody's down there right now. And I was telling her it's not occupied. She said since that doorway was open right there that they could get the electricity turned on and they put people down there. But I had that sealed off. The electricity is still off downstairs. I haven't leased it out to anyone yet. And I got the lease. I emailed that to... Mr. Devin Abrams, that was Ms. Sylvia Zoning emailed a copy of the lease for the two gentlemen that are staying upstairs. She emailed that to him yesterday evening because I was trying to get... get in touch with Ms. Foree, but she no longer works here, I think. I don't know because I tried to get in contact with her because I wanted to do it virtual because I had to go out of town, so I had to cancel that meeting to make sure that I was here. I've done that three times. This is my third time here.

30:27Speaker 14

With that separation, does that satisfy the requirements here?

30:30 – 30:41Speaker 17

The inspector still feels that the house is possible being used as transitional housing. And again, an interior inspection to confirm that that is the case is what's been requested.

30:42Speaker 14

All right, so I think, do we need another interior inspection? Is that what we're saying?

30:49Speaker 18

It appears so.

30:50Speaker 14

Okay, then I think we would ask to push this out for 30 days to get the inspector back in there to make sure that everything is now up to par.

30:57 – 31:13Speaker 21

Okay, I'm good with that. We'll go out 30 days. We'll give you another 30 days to get that inspection set up. so that we can verify that everything has been done and they're satisfied that it is two separate units and not just one. So we're going to give you another 30 days. What's our 30-day date?

31:20Speaker 31

We just need to get somebody out there to confirm that everything's good now.

31:23Speaker 13

What are we confirming?

31:24Speaker 17

Your intent is to use this house as a duplex or as a single-family dwelling?

31:30Speaker 13

Duplex. There's an apartment upstairs and there's an apartment downstairs.

31:37Speaker 17

Right. There's two separate units. I think you indicated that the property was open. So are there two separate units or one unit? Is it one unit?

31:47Speaker 13

There's two units. The way the house was set up when I bought it, you got two front doors. When you stepped in, the right door was sealed off.

31:57Speaker 17

What I'm asking you is that's what you intend to use it for, is two separate units? Yes.

32:01Speaker 13

That's what I've already done. That's what the pictures I just submitted where we sealed off that door.

32:07Speaker 17

An interior inspection, then, please, would be needed.

32:13Speaker 21

So we're going to go, you're fine with 30 days?

32:15Speaker 14

That is what we would recommend, yes.

32:17Speaker 21

So we're going to go out to August 21st. We're going to try to get an inspector in there. Maybe you can get a hold of her sooner. And if she says, yes, everything looks good, then you won't have to come back on the 21st.

32:28Speaker 13

I just want to make sure that I'm clear because it's the third time, fourth time that I've been.

32:34 – 32:52Speaker 21

So in the case of ENF-SHL-25-000320-3, that is being 2500 Muhammad Ali Boulevard. We're going to take this out for a status on August 21st. So try to get back a hold of your inspector to try to schedule another day so she can get out there and take a look.

32:52Speaker 13

And what she needs is to.

32:55Speaker 21

Physically see. See that the wall. Physically see that wall, yes. Right, correct, Mike? She needs to physically see the wall?

33:01Speaker 17

Yes, please.

33:03Speaker 21

Thank you, sir. He's going to write up your paperwork, and then he'll bring it to you.

33:13Speaker 4

He's already got it.

33:14Speaker 21

He's got it? Then you're good to go.

33:15Speaker 13

Who would I need to speak to? She's on this paper?

33:21Speaker 17

Well, I mean, yeah, Alicia Pedrera, I think you've already spoken with her. That's the inspector that we need to schedule the interior inspection with, yes.

33:31Speaker 13

Do I need to come back, or could I do it virtually?

33:34Speaker 14

You could do it virtually. Yeah, and if that inspector is able to come and sign off on it and everything, you won't have to come back.

33:41Speaker 13

All right. Thank you so much. Thank you.

33:43Speaker 14

Good luck, sir.

33:44Speaker 13

Have a good day.

33:47Speaker 4

NF-PMNT-20-006785-52-2100, Date Street. Oh, that's Ms. Nicholas.

34:14Speaker 25

Good morning, Ms. Nicholas.

34:15Speaker 27

Good morning. Good morning. Can you please state your name for the record?

34:20Speaker 28

My name is Eileen Nicholas. Right, and she is on the deed. Yes.

34:24Speaker 27

Ma'am, do you swear from the testimony you're about to give us the truth, the whole truth, and nothing about the truth?

34:28 – 35:08Speaker 26

Yes, ma'am. Great, thank you. Lakin's been sworn in. On 5-5-2026, the 52nd visit to the property... A $600 penalty was placed for no compliance on cutting and or cleaning originally cited since 4-28-2026. We returned to the property on 7-22-2026 to check that cleaning and it was still found to be in no compliance and I'll get you photos of what remains in just a moment.

35:11Speaker 29

Here we have some growth, overgrowth and debris. More overgrowth, grass, weeds and debris.

35:21 – 35:36Speaker 26

More overgrowth, grass, weeds and debris. more overgrowth, grass, weeds, and debris. And I would like to mention that this has been redocketed multiple times with 64 visits.

35:39Speaker 14

What was the original citation on this? How long have we been dealing with this property?

35:44Speaker 26

This specific violation was cited in April. However, we've had this case open for over six years.

35:52Speaker 14

I'll submit these photographs, establish the conditions of the citation as they exist at the time of the citation, and as they still exist, and I'll reserve any questions if they come up.

36:00Speaker 8

Go ahead, Ms. Nicholas.

36:02 – 36:25Speaker 28

Last week when I came, I showed that the grass has been cut, but we are showing the same pictures. And I have a statement that it was done on Saturday. These pictures were taken two days ago. And I showed those. Pictures last time, so I'll show it again.

36:25Speaker 8

So this grew up like this in two days?

36:31Speaker 28

This is last time from, I'm showing you from June, June 24.

36:37Speaker 8

Okay, these pictures are from July 22.

36:40 – 36:51Speaker 28

July 2, and on Saturday, what date was, 19th? I understand we're on today for total compliance.

36:52Speaker 28

Yeah. It's from here. Yeah. This was June, and then if you go up, they'll show you.

37:05Speaker 26

Oh, sorry. Yeah, I didn't mean it that way.

37:21Speaker 25

Yeah. Yeah. Well, we were there on Wednesday.

37:25Speaker 8

Yeah, that was.

37:28Speaker 25

Any statement she has from Saturday?

37:37 – 37:54Speaker 14

I'm good. I will state that we have had ongoing issues with this property for six years. This is our 64th visit to this property. Yes, we are dealing with cutting and cleaning now, but it's cutting and cleaning that has not been dealt with. we would ask that at least a portion of this fine be upheld.

37:55 – 38:41Speaker 8

Those pictures are from the 24th of last month. These were, which was exactly one month ago. So I guess we cut it last month. Nigel is not the owner. You're the only owner of it. Owners are staring repairs too little, too late, ma'am. Today we're on for total compliance. We've, we've redacted this too many times. We're on our what? 52nd visit at least. 64th visit on this. Those pictures were from the 24th of last month, one month ago. You can't just cut it once and think we're done. This has to be maintained. It is not being maintained. It's being neglected. So you're either going to have to get on the ball or you're going to have to sell it.

38:41Speaker 28

Yes, that's what this letter is for.

38:43 – 39:49Speaker 8

In the matter of ENF-PMAT-20-006785-52, address being 2100 Date Street, I am going to uphold the citation as the conditions did exist and still exist, and I am going to invoke the $600 fine. That is my ruling. And I can guarantee you that probably within a matter of a week or two, somebody will be out there and do a follow-up and we'll start all over again. Okay. And it's going to keep going up and up and up. So it either needs to be sold or it needs to be maintained. You heard my speech this morning that once I get in your pocket, I'm going to stay in your pocket. Well, I'm in your pocket, Ms. Nicholas. So either take care of your property or sell it. Ma'am, that means nothing because the fact we're on today for total compliance. Saying you're going to do something in the future, I'm sorry. Today was the day. And it's not correct. So I'm holding the citation. That's my ruling.

39:51 – 40:03Speaker 28

It took me time to get this letter. I've been working since June. Ma'am, again. And I want to sell the property. That's why.

40:03 – 40:21Speaker 8

Then sell the property. Yes. But realize it's not improving. So until it is sold, and you better make sure that whoever the new owners are, they know about this, that they're going to be, as soon as they buy that property, they're on radar. They better be doing a lot of work very quickly, or they're going to be in the same boat.

40:25Speaker 28

Okay. So I need to sell it?

40:31Speaker 8

Either maintain it, ma'am, or sell it. Those are your options.

40:36Speaker 8

Thank you. Next case.

40:39Speaker 4

ENF-PMNT-23-015764-10, 322 Cecil Avenue.

40:53Speaker 15

Didn't have a chance to talk about this before we started.

40:57Speaker 27

Morning, Mr. Yates, correct? Yeah, sorry. Okay, can you just, yeah, enter your appearance real quick for me.

41:02Speaker 15

Rob Yates on behalf of MTG Investments.

41:08Speaker 15

But I understand he's in at least substantial compliance. He did send me photos while we've been sitting here.

41:15Speaker 27

Do you need to have the, you all present just so that we know what we're on for? Yeah.

41:25Speaker 29

Mr. Gates, just let the county just state what we're on for today and then we can talk.

41:48Speaker 14

We are just now seeing that there's a note in this file that it has been marked as complete. So we would just go ahead and ask that this be dismissed.

41:56Speaker 8

You want dismissed or conditionally discharged?

41:58Speaker 14

I believe we're dismissed, correct?

42:05Speaker 25

It's numbered.

42:09Speaker 14

We we would ask this be dismissed. We don't have any documentation of the actual citation, so we're going to have to ask that this be dismissed.

42:19 – 42:30Speaker 23

OK, in the matter of ENF. PMNT 23015764-10 at 322 Cecil Avenue. We are dismissing this case.

42:34Speaker 27

Mr. Yates, I assume you have no objection?

42:36Speaker 15

No objection.

42:39Speaker 8

Well done, you, sir. Yeah, great job.

42:41Speaker 15

I have one more, please.

42:44Speaker 8

Oh, okay. Which one?

42:46Speaker 15

That is the 3101 Eastwood Fisherville Road.

42:51 – 43:02Speaker 4

It's the zoning case. NF-ZON-24-000074-9, 3101 Eastwood, Fisherville.

43:02Speaker 27

Mr. Yates, do you have anybody here with you that's going to be offering testimony?

43:08Speaker 27

Okay. Then we can go ahead with Mike.

43:10 – 43:21Speaker 17

So today was supposed to be an update on the filing of the formal rezoning application for the property. However, that has not occurred yet.

43:23 – 44:19Speaker 15

The issue on this, and this is when we have been proactive. We've had multiple meetings. I didn't bring the file. You all I drop a kid off and rush from soccer. We met with somebody else from zoning in May. They told us to go get the building permits, then come in. I'm co-counsel on this. Mr. Darren Wolf's the other attorney. He did apply for the Building permits this week, I showed Mr wheelchair the email we got last night that it was incomplete because Darren didn't put the maps in with it. So we got to resubmit those. Mr wheelchair believes from there, and we'll still need to redo the zoning application, which we've talked and we've even shown him the 1 we previously prepare where the other guys to get the building. Permits well, we're, we're working towards it. This is just 1 that's going to be. A while.

44:21Speaker 17

It appears that you need both. Yeah. As well as the rezoning needs to be submitted.

44:26 – 44:41Speaker 15

And I will get on. This is my end of it. Darren's the client contact. So the client contact is in the construction business. Thus, I've farmed that end of it off onto him. And he was a little delayed.

44:43Speaker 14

We would ask switches out for 30 days just due to the nature of it. We want to make sure that this is still going.

44:49 – 45:05Speaker 15

I'm not trying to be rude. I may or may not be able to be here in 30 days. Maybe can we go to that 60 days because I should be good. That's fine with us. I think most people know what's going on with me.

45:05Speaker 8

How's that September 25th date look for you?

45:08Speaker 15

I'll make it work.

45:12 – 45:25Speaker 8

Okay, so in the matter of ENF-ZON-24-000074-9, address being 3101 Eastwood, Fisherville, we're going to pass this for status to the September 25th date with Mr. Yates.

45:26Speaker 15

Thank you all. Have a good weekend.

45:28Speaker 8

Thank you. Godspeed.

45:43Speaker 4

NF-ZON-26-000415-35900, Pendleton Road.

45:59Speaker 30

Good morning, ma'am. Good morning.

46:01Speaker 27

Can you please state your name for the record?

46:03Speaker 19

Wendy Johnson.

46:04Speaker 27

Raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

46:09Speaker 31

Go ahead and make it.

46:16Speaker 14

It should be the last one on the docket there, Mike. Yes, sir.

46:21 – 46:58Speaker 17

$5,900 penalty. Okay. I thought there was some. So, at any rate, you have appealed the citations for the non-permitted use on the property violation. There are numerous parking violations. There's a boat and RV, and I think there's also the tank that was going to be used for a cooking oil recycling business that was proposed for the property. Okay. And as the last inspection, those are still on the property, the tank, as well as the vehicles, the boat and the RV.

47:00 – 48:11Speaker 19

Okay. I just want to respectfully ask that we talk about citation three or the case number three, because I've gotten several different questions. That's what's on the docket violations and it's extremely difficult for me to keep up with everything that's going on a lot of the violations that have been submitted, I haven't even received. So my concern right now is I just ask that. The board speak to the boat that they're referring to run for how it was measured. We're here for 3. there's a picture of the boat if are you asking about are you saying there's not a boat on the property is that what you're referring to currently yes there is the boat itself it is not mine it is just being stored there for a friend and it is go on okay no no i need to know you know how it's how metro alleges that the boat exceeds 25 feet first of all No pictures.

48:11Speaker 17

And the thing that is, they have to be parked behind the front facade of the house.

48:17Speaker 25

On a hard and durable surface.

48:24 – 48:37Speaker 17

Yeah, so again, two medium vehicles will be permitted on the property due to the acres of the property. However, they have to be parked on a hard and durable surface, and they have to be behind the facades of the home.

48:38Speaker 17

Right. And they were parked in the yard, yeah.

48:43Speaker 19

But we're talking about the boat right now.

48:54Speaker 18

Mike. What she's saying is Metro's alleged.

48:56Speaker 27

Sir, I have not sworn you in, so if you're going to testify, I need to do that. Would you like to speak?

49:01Speaker 27

Then please state your name.

49:02Speaker 18

Bradley Tandy.

49:03Speaker 27

Raise your right hand. Do you swear by the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

49:08 – 49:23Speaker 27

All right, thank you. One second. Hey, Mike. Mike. It's okay. I know there's a lot going on. The citation includes the boat, the camper, the trailers, correct? This citation that we're on for. Right.

49:23Speaker 17

And the camper, as I recall, is a dual rear axle, so it's not permitted on the property.

49:31Speaker 14

Can you just run through what the violations are currently so that we can clear that up real quick?

49:37 – 49:59Speaker 17

Well, what started with this was non-permitted use of the property. They had an RV storage business occurring on the property is what led to the initial complaint. And then when inspected, we found numerous vehicles, numerous recreational vehicles parked on the property. And again, the non-permitted use of a RV storage business on the property.

49:59Speaker 14

So there's a parking violation. And for this third citation, is that still for the non-permitted use?

50:05Speaker 25

Is this the parking violations?

50:16 – 50:32Speaker 17

The operation of a recreational vehicle park is prohibited here. So that was on the third. As well as parking in the grass dirt is prohibited. And it lists the numerous vehicles parked on the property and citation that was issued.

50:33 – 50:48Speaker 14

So I'm understanding correctly and we've you've mentioned the two vehicle rule. It appears that there are multiple vehicles as well as a boat and an RV and that would exceed the vehicle rule because that is the boat in the RV would count as well. Yes.

50:49Speaker 18

Does that make sense? None of it's making sense.

50:53 – 51:12Speaker 26

So essentially, there is a requirement on the residential zoning that you can only store so many medium-sized vehicles, and there are too many there. So you can only have up to two, and the two that you are allowed to have do have to be parked on a hard, durable surface, and they have to be behind the front of the house completely.

51:13 – 51:56Speaker 18

It states that it has to be 80 feet from Pendleton Road, 45 feet from Lyons Avenue. Yes. Right. And right now, we're going over things that are on the first part of the citation, and they're saying that it's allowed 80 feet from Pendleton Road and 45 feet from Lyons. I have a video where these campers, and when I say campers, I mean RVs, okay? I'm not saying like people camping. Right. They're 270 feet from Pendleton Road. I'm 60 feet.

51:57Speaker 14

I'm understanding the location that you're describing.

51:59Speaker 18

They have a hard, durable surface under them.

52:02Speaker 14

There are still too many of them is the issue. So you can have two vehicles.

52:07 – 52:38Speaker 18

Can I finish? Can I finish? Go ahead. So we have been in compliance with that. And right before we got our citation, we had purchased 10 tons of gravel to put down. We were cleaning out the barn to put a trailer in there that we were getting citations, or not citations, but violations on. We have since got those in there. From what we understand right now, we're in compliance with the vehicles.

52:39Speaker 14

Do you have photographs of the property without all the vehicles on there? Without all the vehicles on it? Meaning with the proper number of vehicles on it?

52:49Speaker 19

Can I get my phone?

52:50Speaker 18

Yeah, that's fine. See, we were only prepared for the boat.

53:23 – 53:41Speaker 17

If it's a dual rear exit, the RV is not permitted on the property for dual rear exit, but it still has to be parked on the renewable surface behind the front facade of the house. Parking between the street and the front of the house is prohibited for medium vehicles.

53:42 – 54:03Speaker 25

Okay. But then I think the other issue is that they have more than what's allotted, one of which is not even allowed, which is letting them confer.

54:04Speaker 23

But they said they put those in a barn.

54:07Speaker 25

Yeah, they store them now. Storage is storage.

54:13Speaker 8

They're still on the property.

54:15 – 54:30Speaker 25

They're still not allowed. Storage is storage. It doesn't matter. It's on the property. Yeah. I'm not sure I'm understanding correctly. They have too many vehicles on the property. Too many as a person. It's just immediately there.

54:30Speaker 17

You can have either one or two, depending upon the lot size. 20,000 square feet or less, you can have one medium vehicle. More than 20,000, you can have two.

54:40Speaker 25

They have two cars as well as RVs.

54:44Speaker 31

And so that is one issue that we're looking.

54:48Speaker 25

Do they still count once they put them in?

54:51Speaker 17

We don't care if they're enclosed.

54:55Speaker 26

It does not count anymore. Like if it's fully... If you can visibly see it, it counts. Can I see it?

55:36Speaker 14

All right, having reviewed these photographs, can I once again have you all explain what is still not in compliance about this property?

55:50Speaker 17

This photo that was taken on the 21st shows a boat parked between the street and the facade of the home.

55:57Speaker 18

Violation. Excuse me, what date was that? I'm sorry.

56:01Speaker 14

The 21st, which would have been, what was the 21st? Was that Wednesday, Tuesday?

56:06 – 56:22Speaker 18

Tuesday. Yeah, but we're on for the ZON 26-000415-3937193429. That's stating the violations on 6-11.

56:22Speaker 14

Right, and this, so what he's talking about with the photographs that are on Tuesday is to verify the violation is still occurring. That's why he is saying that.

56:32Speaker 26

He was just mentioning the date that our photos were taken.

56:34Speaker 14

That is the date the photos were taken, not the date of your mileage.

56:36Speaker 18

We have since moved. We're trying to move everything and get in compliance. We're doing everything we can.

56:42Speaker 26

I think the issue is that just moving them around does not bring compliance.

56:47Speaker 18

Our issue is that there is no compliance dates stated on these violations.

56:53Speaker 36

Can I tell you what we're going to do? We're going to do 65.

56:56Speaker 14

All right, and then what we're going to do, we would recommend to give them 60 days to try to get into compliance here. That way you've got a date. It'll be 60 days from today. That's what we would recommend.

57:06 – 57:19Speaker 18

We would like to move and have this dismissed for the no compliance dates not being on here. That's an official document, right? And it has to be.

57:19Speaker 14

There is no requirement that there is a particular date to list for you all to get it into compliance. So you don't have to state a date?

57:29Speaker 18

Or at a certain time, you just guess when y'all are coming?

57:31Speaker 14

No, sir, because the violation occurs when it occurs. I mean, when they cited the citation, that is a violation. There isn't a requirement that there be a certain amount of time to fix it.

57:41Speaker 18

So as soon as you all pull up, you hand out a citation? They could. No, that's what's happening.

57:49Speaker 27

If you're in violation of what the land development code requires, then yes, a citation can be issued. They can cite immediately.

57:58Speaker 14

And if that's what they did here, they're well within their rights to do so. Okay. But we're going to give you 60 days to try to get this into compliance. Okay.

58:05 – 58:16Speaker 21

And you're going to give us 60 days to... We want status or you want total compliance in 60 days? We're going to ask for total compliance. Total compliance?

58:16Speaker 18

Okay. With just the zoning, correct? Correct.

58:20Speaker 21

We're only on for this.

58:21Speaker 14

That is the issue that we're on for today.

58:22Speaker 21

Yes, that's the issue we're on for today.

58:25Speaker 14

I understand. I know there's been a lot of stuff thrown around, but yes, you're to be very clear.

58:28Speaker 18

We have done nothing but comply and everything that we're doing. Right.

58:33Speaker 14

And we appreciate you trying to work with us. So we're going to try to work with you as well. So we're going to give you 60 days. Okay. Okay.

58:42 – 59:07Speaker 21

In the case of ENF-ZON-26-000415-3, address being 5900 Pendleton Road, we're going to take this particular citation, we're going to take it out to September 25th for total compliance. If you all happen to get everything, if you feel that it's cleaned up and back in compliance, and if you want to get a hold of your inspector, have them come in, and if they're fine and bless off on it, then you don't have to come back down for this. Yeah.

59:08Speaker 14

be taken care of.

59:08Speaker 21

And you got your inspector's name and number? Yeah.

59:10Speaker 14

Oh, yeah. Okay. Thank you very much.

59:12Speaker 21

Thank you. Thank you.

59:19Speaker 4

NF-LEAD-25-000660-5 442 38th Street.

59:44Speaker 27

Good morning, sir. Hi, good morning.

59:47Speaker 9

Good morning.

59:48Speaker 27

Can you please state your name for the record?

59:51Speaker 27

Raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

59:55 – 1:00:17Speaker 26

All right, thank you. On 1-21-2026, the fifth case, a $500 penalty was placed for not receiving the required lead risk assessment. This has been redocketed twice already, as there was a previous no-show. We still have not received the assessment after the fifth inspection.

1:00:20 – 1:01:10Speaker 9

Okay. The lady gave me a thing to tell me who to get in contact with. And I've gotten in contact with her. On the paper she gave me, it said it was $950. When I called her, they said it was $1,300. And I said, well, I couldn't get your money all the same. So I wrote them two checks. I wrote one, July the 6th, he gave us 650. And I wrote another one, July the 24th, he gave us 650, $1,300. Okay, they have never got back with the people down there and never got back to me. They took the money, the lady up the apartment, I showed her the checks. He said, okay, it's okay. That's when I was just scared of me like a week, a month ago or so. She said, okay, everything's okay. Then I got another thing that said, come back to court again. And so that's where I'm at now. The money has been paid. They didn't have to show up.

1:01:11Speaker 26

Are you saying that you had paid a company to come do the assessment and they never did it?

1:01:15Speaker 9

Never did, yeah.

1:01:16Speaker 26

Do you have any document from the, like, do you have the company's name or information or anything?

1:01:21Speaker 9

Yes, I do. Okay, hold on.

1:01:37 – 1:01:51Speaker 31

I got a lot of junk here. Metric Environmental.

1:01:53Speaker 8

You need to see it or what? Did you get any paperwork from them at all?

1:01:58Speaker 9

I didn't get nothing with them. It was kind of hard. The people at the office gave me that number back in March. I've been calling them ever since. It took me a long time to get in touch with them.

1:02:06Speaker 31

And then when I got in touch with him.

1:02:08Speaker 25

How much time do you want?

1:02:30 – 1:02:44Speaker 14

We can confirm that that company is one that does the lead assessments with Metro. We would suggest that we push this out for 30 days to either allow him to figure out what happened and why they haven't done the assessment or what's going on there. Or schedule a new assessment.

1:02:47 – 1:03:14Speaker 8

I don't doubt that. We've heard that quite a few times. So in the matter of ENF-LEAD-25-000660-5, the address being 442 38th Street, we are going to pass this out to August the 28th. And we're going to do that for a status just to see where we're at at that time. Hopefully by that time they can come out and do your assessment. Once you get your paperwork, make sure you forward it to the health department. This has been going on since March.

1:03:16 – 1:03:34Speaker 9

The people that you call, these people, they don't answer the phone. When I got him that time, I called him about three months. I got him that time. They called me. The lady took the message and told me how much money they sent him. So I sent him the money. And after that, I thought it was all over. I thought they were going to do the inspection. These people ain't easy to find. They do big buildings. They don't do little small buildings.

1:03:35 – 1:03:55Speaker 26

Okay, well, we'll do a 30-day continuance. Essentially, in the next 30 days when you come back, we just need to either see that you have something from them saying, hey, they're going to do it, or hey, this is what's going on with your money, or just something showing that you're going to try to look into another company possibly, an act of good faith.

1:03:55Speaker 14

Unfortunately, the money thing is between you and that company. We can't do anything about that contract.

1:04:00 – 1:04:26Speaker 9

Well, they don't answer the phone. These people don't answer. None of the people that gave me a list of people to call. And you call all these people. All these people take a while to get in contact with all of them. What they're doing is grabbing people's money and running. And they're all opposing it. And they gave me one thing saying it would be $950 on the paper. And then when I got it, it cost $1,300. It's like a scam to me. Yeah. And so I think y'all are helping them. You're telling me to find somebody else.

1:04:26 – 1:05:08Speaker 8

I kind of resent that remark. I mean, well, really, I don't work for them. I don't even know who they are. So don't insinuate that I'm some kind of criminal organization here. Well, I'm upholding the ordinances. Don't interrupt me. I'm upholding the ordinances of this county. I'm following what has been dictated as far as for the property and for health and for safety. So it's on you as the property owner. So I would go there and knock on their door and say, look, they're looking at taking money away from me and I've paid you fools. I need something in writing. Are you going to do the job or not? If you can't get anything from there, you go right over to the Hall of Justice and you go ahead and file a complaint. Whether you file it in criminal division for fraud or you go upstairs to small claims and file a small claim suit.

1:05:08Speaker 9

Do I go to file a complaint now or...

1:05:11 – 1:05:37Speaker 8

When? Just about the day? I would try to work with them. They've got your money. I would try to work with them and say, look, I'm on the hot seat because you're all not moving since March. You've taken my money. I don't have an inspection. So you might have to go knock on their door to find out why they took your money and didn't do the inspection. They don't answer the phone. I said knock on their door, not give them a call. It looks like they're on Taylorsville Road. You got an address for them.

1:05:38Speaker 9

All right. Okay, well, still, okay, I'm not going to do it then.

1:05:43Speaker 8

Say, look, you know, just say, are you going to be able to get me on the schedule? Can you give me a piece of paper showing where you've taken my money and you're going to come out and do this?

1:05:53Speaker 9

The system sent me to those people. They're the ones recommending people.

1:06:00 – 1:06:13Speaker 26

The list that Metro has is literally every company in the area that does those. We can't attest to the companies. It's just a list we gathered of all the companies that offer those services.

1:06:16Speaker 27

What was the name of the one that you mentioned earlier?

1:06:20Speaker 26

We have a lot of good luck out of micro analytics.

1:06:24Speaker 27

No, I was just saying, what was that one specifically? Metric environment. Okay, thanks. I just wanted to write it down.

1:06:35Speaker 30

Okay, we'll see you back on the 28th.

1:06:46Speaker 4

ENF-PMNT-26-004533-6 2820 Kentucky Street. Oh, okay.

1:07:12Speaker 27

Good morning, ma'am. Good morning. Can you please state your name for the record?

1:07:15Speaker 3

Nicoya Mosley.

1:07:16Speaker 27

Raise your right hand for me. Do you swear or affirm the testimony you're about to give us the truth, the whole truth, nothing but the truth?

1:07:22 – 1:08:41Speaker 26

It's been sworn. On 5-26-2026, the sixth visit, a $500 penalty was placed for no compliance for interior floor, originally cited 3-24-2026. No compliance for exterior surfaces on the property originally cited 3-24-2026. No compliance for a window originally cited 4-27-2026. We returned to the property on 7-22-2026 and found no compliance for the interior floor. No compliance for the exterior surfaces. No compliance for the window and I will get you photos of what does remain in just a moment. Here we have the window that does not open or stay open on its own. Here's another photo of the window. And that was done on July 22nd? Yeah, these photographs are from July 22nd, which was Wednesday, I believe.

1:08:41Speaker 3

Okay, just one moment.

1:08:42Speaker 26

This one is showing a crack across the top glass there. This is the flooring.

1:08:49Speaker 3

That's a new one. That window, that picture she just showed, that was never even cited. Whatever window that is, that window has never been brought to my attention.

1:08:59Speaker 26

Windows itself are cited, and it would include every single window on the whole property.

1:09:04Speaker 3

Okay. I'll walk through with the inspector.

1:09:06Speaker 23

Let her finish running through the list. Give us a second. Then you'll have a chance.

1:09:09 – 1:09:41Speaker 26

Here's a photo of the interior floor and dish repair. More flooring and dish repair. Flooring and dish repair. More flooring and disrepair. More flooring and disrepair. This is the exterior surfaces for rotted wood. More exterior surfaces for exposed and rotted wood and chipping peeling paint. More exposed rotted wood. This is a photo taken farther back to show all of that wood. And then that's all the photos we have at this time.

1:09:42Speaker 14

I'll submit that these photographs establish the conditions of the citation as they exist at the time of the citation. As they still exist, I'll reserve any questions for the appellant.

1:09:48Speaker 23

Now it is your turn to speak.

1:09:49Speaker 3

Okay, yes. The window has been repaired. The window was actually repaired on...

1:10:00Speaker 30

I will also note that in Ms. Mosley's appeal that she noted there was an

1:10:06Speaker 27

active eviction case and that there is also a no contact order between you and the tenant because of an assault that took place outside of the courthouse, is that correct?

1:10:15 – 1:11:07Speaker 3

That's correct. And also at her home, she was actually arrested for assaulting me while I was over there to do repairs on the home. I had the... I had a person who did the window, which the window has been repaired. He ensured me that the render was completely done. But at the time I went every time, because when I sent someone there to do repairs on their own, she has attempted to try to attack them. I guess she's got some mental issues that I didn't, wouldn't aware of either. And, uh, she attacked me. She fought me. I went downtown to take a warrant out on her. And, um, Even the police was there. She tried to attack me, even while the police were there. And they arrested her. She got arrested for it. She was charged with assault four. She was charged with menacing. She was charged with... She had four charges.

1:11:07Speaker 27

There is a no contact order between you and... I just wanted to ask.

1:11:14Speaker 3

Here it is right here. I brought it.

1:11:15Speaker 27

What is the status of that eviction action? Because I could not.

1:11:19 – 1:11:40Speaker 3

Yes, I'm trying to get her evicted. Section 8 has sent me something telling me that I'm not allowed to evict her until August 31st. Her lease is up August 31st and I can't do anything about it. And I'm not even able to have like I've sent. Because I don't really have to do it. I'm not doing the work. So I thought I could just send the person there. She attacked them.

1:11:41 – 1:12:08Speaker 14

Right. Ma'am, if I may, I very understand what's going on here with this eviction and all that. And we understand that it's going to be difficult to do any repairs while they're still there. You said that it's going to be until the end of August before you can even try to evict her. So we would go ahead and recommend eviction. This will be pushed out in 90 days, so she's got some time after that eviction can occur to get work on it. We would say to push it out for status, see how things are going after that.

1:12:08Speaker 27

Okay. Thank you. Does that make sense? Yes, it does. Okay.

1:12:16 – 1:12:31Speaker 3

Not to mention she wrote while I was at the police station, she came down to the police station. This just gives you an idea of what I'm dealing with and wrote on my Range Rover, wrote all over it at the police station and tried to attack me in the courthouse. Yes.

1:12:31Speaker 23

This is what I'm dealing with. If we're going to push it out until the 30th and then just for a status, hopefully you are able to get her out.

1:12:38Speaker 3

Once I get her out of the house, I'll be able to repair it. I had a whole list of repairs. I went through all of them every time. I've never had a problem. Yeah, be safe first.

1:12:48Speaker 26

Yeah, safety first. So we'll definitely work with you so long as you're making your strides. Especially with that no contact order.

1:12:54 – 1:13:29Speaker 8

Yeah, I have that. It's not worth your life. It sounds like it's just going to escalate. So my advice to you would be stay away from it. I have not been back to that house at all. Don't send anybody over there. Don't you go over there. But just wait for it to time out. And then once the end of August is here, then you can do what you have to do. You might want to start putting a packet together for Section 8 to show the court proceedings and stuff. Say, look, this woman has attacked me. She's damaged my property. She is... you know, harassing me, you know, so that way you can show where they don't try to extend her lease again.

1:13:30 – 1:13:59Speaker 3

Section 8 actually has told me that my lease that I have with her is the only lease that they have in file. And I've even told her that because of the paperwork that Section 8 sent to me telling me that I cannot evict her, I don't. The city and Section 8 have gotten together and they sent inspectors. I don't know if it's the city inspector or if it's Section 8 inspector, but I've told, I've come every time with them letting them know exactly what's going on with the court case.

1:14:00Speaker 3

I've been in touch with Bjorn who has, I've sent him. Yes, that's the person I've basically been in touch with. And I don't know if he's with Section 8 or if he's with the city.

1:14:10Speaker 8

So that any inspector that goes over there, they don't go alone or?

1:14:15Speaker 26

Yeah, I can put a note in the PM case, but Section 8 cases are completely, they're not even the same system. And I have zero, we don't have access.

1:14:23Speaker 8

Can we get a message to Bjorn then to?

1:14:26Speaker 27

Okay. Put a note in this case too.

1:14:30 – 1:14:45Speaker 23

Okay. So in the matter of ENF PMNT 26004533-6 at 2820 Kentucky Street, we are going to move this to October 30th for a status. Thank you so much. I appreciate it.

1:14:45 – 1:14:56Speaker 8

I would, once August gets here and you can file the eviction, I would leave there immediately and go to the sheriff's office and go ahead and schedule your set out date. So that way you can get, get

1:14:57 – 1:15:10Speaker 3

I actually went trying to do it ahead of time, only to be told that I can't do it. Yeah, I didn't know that. I didn't know. This is my first tenant I've ever had to evict.

1:15:10Speaker 23

Yeah. Yeah, that's crazy. Stay safe.

1:15:13Speaker 3

Thank you. Thank you.

1:15:21Speaker 4

NF-PMNT-26-003945-3, 729 Compton Street. Yes.

1:15:33Speaker 27

Good morning, sir. Can you please enter your appearance?

1:15:35 – 1:15:46Speaker 24

Yes. My name is Gregory Smith. I'm counsel for the estate in which this distressed property is part of an estate action. And so I want to address the violation.

1:15:47Speaker 27

Do you have anybody here with you that's going to be offering?

1:15:48Speaker 24

No, I'm counsel for the estate.

1:15:50Speaker 27

I know, but you don't have anybody else here?

1:15:52Speaker 24

No, I can explain the situation.

1:15:55Speaker 27

Okay, well, let's let the county put on their case then.

1:16:02 – 1:17:16Speaker 26

On 4-22-2026, the third visit to the property, a $400 penalty was placed for no compliance on cutting and or cleaning, originally cited 3-17-2026. No compliance for Z004 for auto repair in residential zone property originally cited since 3-17-2026. No compliance for Z01 non-permitted use of residential originally cited 3-17-2026. We return to the property. on 7 21 20 26 and found no compliance on the cleaning. The zoning codes have previously been found compliant on another inspection. I will get you photos of what does remain for the cleaning. So it appears two of the violations have been corrected. The cleaning is all that remains. Here is a photo of debris being stored outdoors, trash and debris, more trash and debris, and more trash and debris. And that's all we have at this time.

1:17:17Speaker 14

I'll submit these photographs, establish the conditions of the citation as they exist at the time of the citation, as they still exist. I'll reserve any questions for counsel here. Yes, if I may.

1:17:24Speaker 8

Mr. Smith, I'll cut to the chase. You know, you've already hit the ground running. You're handling the estate. Yes, sir. You know, we're just down to the cleaning. Yes, sir. I'm seeing here from the notes that you've got a local company to assist in the cleaning up.

1:17:34 – 1:17:53Speaker 24

Yeah, this is a distressed property. This lady passed. She lived in one. There was another one that was the subject of a notice of violation. There's a neighbor who wants to buy both of them. We've run title on the property. There was a mortgage. I'm dealing with trying to close this property and sell it to the neighbor who wants to have.

1:17:53Speaker 8

How much time do you need?

1:17:56Speaker 24

Mr. Pogue, Commonwealth Title is working on the title aspect for me. I would think maybe 90 days and I think we can get the property sold. I also have a clean out company that I've got to.

1:18:07Speaker 8

As long as you've got a cleanup company, you know, you're doing the effort. You're going through the motions and all this. I have no problem with bumping it out to that October 30th date.

1:18:15Speaker 24

That would be fine.

1:18:16Speaker 8

And if at some point you all get this title changed and it's sold between then and now, if you just call that inspector and let them know, and then you're done.

1:18:24 – 1:18:55Speaker 24

Yeah, 90 days out would be October 31. 30th. Thank you. I appreciate it. By the way, a little story. Mr. Conklin, I started practicing in 1981. I haven't seen him in years. And my first trial was against him, and he thumped me. I just wanted to put that on the record. He's a great guy. He's practicing law at 80, and I'm now 70, so I guess we don't, what's that old joke about lawyers never die, they just lose their appeal or something? Anyway, thank you to the commission. I appreciate it.

1:18:55 – 1:19:14Speaker 8

Hang on, we've got some paperwork for you. In the matter of VNF-PMNT-26-003945-3, the address being 729 Compton Street, we're going to pass this to the October 30th date for his status. Next case.

1:19:16Speaker 4

ENF-ZON-25-000011-8, 4115 Hunsinger Lane. You want it? Go for it.

1:19:31Speaker 27

Good morning, sir. Can you please state your name for the record?

1:19:35Speaker 11

Majdi Abu Dahab.

1:19:37Speaker 27

All right, please raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

1:19:43Speaker 17

Yeah, I've seen that just yet.

1:19:44Speaker 25

Witness has been sworn.

1:19:47 – 1:20:17Speaker 17

Oh yeah, so the property has been cited for operating an auto repair business from the residential property and it was noted that obviously an auto repair business is not permitted from this property. The last inspection recently showed that there were still vehicles parked in the yard and there were still some auto parts on the property back behind some fencing. And there was old lawnmowers and other debris that were in the backyard.

1:20:18Speaker 14

And we have photographs of this, correct?

1:20:21Speaker 14

And they were taken, I believe it was yesterday is when the photographs were taken.

1:20:24Speaker 25

Can we pass those down so they can see them?

1:20:32Speaker 14

And I will submit these photographs, establish the conditions of the citation as they exist at the time of the citation as they still exist, and I will reserve any questions for the appellant.

1:20:38Speaker 25

This was previous.

1:20:41Speaker 21

And July 23rd. This was previous. Oh, much better. Yeah. Improving. Much better, but still. Yeah. Okay.

1:20:51Speaker 14

Yeah, it appears from the photographs that there has been some improvement, but there is still quite a bit of cars and car parts. I've got them all here. Okay. Yeah.

1:21:02 – 1:21:14Speaker 21

Okay, sir, what are we going to do with the rest of these items? Because you have made a great improvement, but there's still stuff that does not belong there. What is your intention to do with those items?

1:21:14Speaker 11

Which items? The items in the front or the end?

1:21:18Speaker 17

Well, the photos from yesterday's inspection show that you still have some.

1:21:23Speaker 11

I can see the pictures, the ones there. I mean, how's he taking the picture? I don't know.

1:21:33Speaker 17

From a neighboring property owner who had granted access because you refused, is my understanding.

1:21:44 – 1:21:56Speaker 11

It's someone who had gone inside the property and he took that picture, or how is that? From a neighboring property who granted access. The neighbor, he take those pictures from my yard?

1:21:57Speaker 17

The neighbor allowed the inspector to take photos from their property.

1:22:01 – 1:22:14Speaker 11

Ah, from it, okay. That's, yeah, that's picture behind my property, behind the garage. Like, we have a fence there, and I don't know who it's like.

1:22:17Speaker 17

If a neighboring property owner allows access, we can take photos from a neighboring property. Yes.

1:22:23Speaker 11

Now, you're saying, like, the neighbor, he can take a picture from my property from in the back? Like, how is that?

1:22:33Speaker 17

Again, the neighbor granted access and the inspector took the photos from the neighbor's property. Yes.

1:22:39 – 1:23:23Speaker 11

Oh, if that picture here, that's a picture, that's the picture is the stuff here. I take, it was a trash and I take all that stuff from my, in a bag. But it's, we have like a few things. We have the cars there. Yeah, you're right. But all that trash there, we keep it to take it out, and I take it out, all that trash. That's been like two or three weeks ago. The photographs were taken yesterday. We have those doors in the back, those behind my garage, and no one can see it. I mean, I have to take it out from there. That's what I'd say.

1:23:24Speaker 14

Right. It still cannot be there. You're not permitted to have all of that back behind there. So we need that to get cleaned up. How much time do you think that you would need to be able to clean all of that up?

1:23:35Speaker 11

It's like two months, three months.

1:23:42 – 1:23:56Speaker 14

I think we'd be okay to give you a month to get that cleaned up. So we'll recommend to get 30 days to get the trash cleaned up and get this debris finished up.

1:23:56Speaker 17

And all vehicles must be parked on a hard and durable surface, on the driveway. They can't be parked in the yard.

1:24:03Speaker 2

Can I talk, please?

1:24:05Speaker 11

She's my wife. My name is Manar Tlaib. Manar Tlaib.

1:24:12Speaker 27

Raise your right hand. Do you swear or affirm the testimony you're about to give us, the truth, the whole truth, and nothing but the truth? Okay, go ahead.

1:24:18 – 1:25:02Speaker 2

Okay, the front yard, we've been here before. It's like maybe four years, five years, about we're barking in the side. And the judge, he explained to us we cannot bark in the mud or in the grass. So we have, it's like a river bridge. rock or something we put it in the front so it's not going to be a mud and there is no grass in that side so i have some picture for it too and the only thing is like we start working there after it's like the judge he explained to us we cannot bark there and there is no problem to work in there and still we have a fine for that problem it's a reoccurring right no so it has to be gravel and

1:25:03Speaker 17

Yes, gravel pavement, and it has to be on an approved driveway. You can't just gravel your yard and park in your yard. No, it has to be on the driveway.

1:25:13Speaker 2

Okay, and what about the cars, the one in the back?

1:25:17Speaker 17

No, they can't be parked in the yard, no.

1:25:19Speaker 2

No, no, I mean it's like in the back.

1:25:23Speaker 14

Right, any cars on the property have to be on the driveway. Okay. They can't be, even if they're in the backyard, they can't be in the yard.

1:25:31Speaker 2

We can't put down river rock and stick them down. It's like in the back, where's the fence? It's like in the back of the house.

1:25:38Speaker 27

But it has to be parked on a hard durable surface. But it has to be gravel or pavement.

1:25:44Speaker 14

The river rock is not allowed. It's got to either be gravel or pavement.

1:25:49Speaker 2

But I mean, it's like the picture, the one you have, it's right here for the car barking in the back. It's in hardwood, in the hard floor.

1:25:59Speaker 14

Like you're barking in the concrete. Okay, then that one might be fine. That vehicle might be okay.

1:26:05 – 1:26:20Speaker 11

But it was, we have a car like barking in the grass. I move it. It was something wrong with it. And I fix it. And I tried to do it and register in my name and I can drive it. And that car, it's not there anymore.

1:26:20 – 1:26:31Speaker 14

If the car is parked on a hard, if it's parked on a hard surface like gravel or concrete, that's fine. It can be there. We still need to get that. That debris needs to get cleaned up, which is why we've asked for 30 days.

1:26:32Speaker 11

Yeah, that's fine. That picture, the one we have the trash right there, already I clean it.

1:26:37Speaker 21

Right, yeah, that's been cleaned up, but there's the stuff that looks like on the side of the garage, looks like a car door, a hood, stuff like that. That needs to be cleaned up also.

1:26:45Speaker 2

All right, that's fine.

1:26:50Speaker 11

And the doors, I mean the stuff, the one behind the garage, just give me a month.

1:26:57Speaker 21

Yes, absolutely, yes.

1:26:59Speaker 11

And just I want to say something, like if we have many, many tickets, it's coming to me, but I pay all, but the last one right here, it's coming like about...

1:27:10 – 1:27:34Speaker 14

about something in the front in my house it's not clean but already i clean it and that's what they look like we can't do anything that's not on the appeal currently we're limited to what's on the docket today which was just the citation having to do with the debris we can't talk about that part we can't talk about that all right okay okay are you all on total compliance or status that's up to you all for cleaning i think we'd ask for total compliance total compliance okay okay

1:27:35 – 1:27:56Speaker 21

All right. In the case of ENF-ZON-25-000011-8, address being 4115 Hunsinger Lane, we're going to take this out to the August 28th date for total compliance. If you do get it all cleaned up prior to this date, call out your inspector. If they bless off on it, then you won't have to come down. All right.

1:27:57Speaker 32

All right. Thank you.

1:27:57Speaker 21

Thank you so much. Thank you. And thank you again for all the hard work on getting everything else done. We appreciate that.

1:28:08Speaker 4

ENF-PMNT-25-014963-5, 919 32nd Street. 919 32nd. Oh, there she is. Okay.

1:28:41Speaker 27

Good morning, ma'am.

1:28:43Speaker 27

Can you please state your name for the record?

1:28:45Speaker 35

Patricia Lusko.

1:28:46Speaker 27

Please raise your right hand. Do you swear or affirm the testimony you're about to give us, the truth, the whole truth, and nothing but the truth? Yes. All right, thank you.

1:28:53 – 1:30:55Speaker 26

On June 19, 2026, our fifth visit to the property, a $600 penalty was placed for... No compliance on exterior surfaces originally cited 10 3, 2025. No compliance for rear porch or balcony originally cited since 10 3, 2025. No compliance for roofing and or gutter material originally cited 10 3, 2025. No compliance for accessory structure for retaining walls originally cited 10 3, 2025. We returned to the property on 7 22, 20 26 and found no compliance on the exterior surfaces, total compliance on the porch, no compliance on the roofing materials. And it appears the exterior retaining wall was found compliant on a subsequent inspection. Let me get you photos of what remains. So here we have a missing downspout here is exterior surfaces, um, on the garage and the siding and chipping, peeling paint. There's also a downed gutter in the bottom of this photo, which is part of the X 50 violation that is on today. Uh, here is more exterior surfaces. This is showing the cornice that is failing more exterior surfaces. This is more exterior surfaces, exterior surface, and then this is exterior surface and the missing downspout. as well as the missing gutter, missing downspout, and the roofing has a small bow to the front left corner there. That's all the photos we have at this time. I would also like to note the significant compliance with the repair of the deck. I know that was quite a big job they took on and they did get that completed. That's all we have at this time.

1:30:56Speaker 14

I will note that there has been significant work. However, these photographs do establish the conditions of the citation as they pertain to the roof and as they still exist, and I'll reserve any questions for the appellant.

1:31:06Speaker 23

Definitely appreciate all the work that you've done so far. So what is your plan for the rest of it to finish it up?

1:31:11 – 1:32:03Speaker 35

We plan to do the rest of it, but right now we're at a standstill because of the fence. So they're telling us we can't do any more work. They're saying that the fence is too high. So I'm in the process of I got to fill out some papers and pay $260 and go to court for them to say the fence can stay the height that it is. So once they said that, because the fence is really not finished, they told us don't do nothing else. So once they said the fence is okay to stay where it's at the height that it is, then we're going to go on and put the gutters, because really it's just the gutters, the aluminum side, and that's the only thing we got left to do, thank the Lord. But then we're going to finish everything else. So that's why we haven't.

1:32:03Speaker 23

So why does the fence hold you up from doing the other work?

1:32:06 – 1:32:27Speaker 35

Because they said it's supposed to be three feet. It's a little bit over three feet because I got a pit bull. So when I went downtown, the lady gave me papers and stuff to fill out to bring back. And then I got to, I think she said some of my neighbors got to say it's okay for the fence to stay the way it is. So that's what's going on.

1:32:27Speaker 23

I understand the fence issue, but how does the fence stop you from working on the other items?

1:32:31Speaker 35

Well, they told us don't do no more work. So I just figured it was for everything.

1:32:36Speaker 23

Who told you to do no work on the house? On the fence, I understand.

1:32:39Speaker 35

They didn't say it. They just said we had to stop our work. So I just figured it was for the house and everything. That's just me thinking. Maybe I figured wrong.

1:32:48Speaker 26

Do you know whom are you referencing when you say they told you not to do any more work? The people. The inspector?

1:32:57 – 1:33:27Speaker 26

Okay. Um, I believe there may have been a little bit of miscommunication, um, cause the fence is a zoning case. The other items are a property maintenance case. So there are two different things. Um, the fencing case does not stop you from doing work on the house. So I think there was just a miscommunication there. Yeah. So I think they just meant don't do anything new with the fence, but you can still do work on the structure, um, as you have been, cause you have done quite a bit on that rear deck. So, um,

1:33:27 – 1:33:38Speaker 17

Is the fence height the issue? The fence is taller than what's permitted, so you're going to try to get a variance approved to keep it the height that it is? Right. So you're going to have to go before the zoning adjusts to do that.

1:33:38Speaker 23

Yeah. The fence, we don't have the zoning. No, the fence isn't on today. We're just through the house.

1:33:44Speaker 14

And because of that miscommunication, we will go ahead and recommend this. We pushed out for 60 days for status to give her some time to work on the house. Now that we've established that you can keep working on that roof.

1:33:53Speaker 26

Yes, just they meant do not do more work on the fence. But as far as the structural stuff, you can keep on working on that. Yeah. So we'll give you some time for that.

1:34:01Speaker 23

So we'll come back in 60 days and get a status on the other repairs. Are you good with that? 60. Okay.

1:34:07Speaker 35

Can I get a little bit further?

1:34:08Speaker 23

Well, it's just for a status. It's not for total compliance. Okay.

1:34:11Speaker 26

Yeah. So in 60 days, we'll kind of come back, see where you are, and then we'll go through this again and just kind of see what progress you can make in those 60 days.

1:34:19Speaker 35

Yeah, because we're almost at the end.

1:34:21 – 1:34:39Speaker 23

And we see the lot of work that you've done. We really appreciate that. You're doing a great job. Yep. So in the case of ENF PMNT 25-014963-5 at 919 32nd Street, we are going to push this out till September 25th for status. Thank you.

1:34:43Speaker 4

ENF-PMNT-26-003057-4630 Lewis Coleman Jr. Drive.

1:35:05Speaker 27

Good morning, sir. Can you please state your name for the record?

1:35:08Speaker 32

Juaniel Watts.

1:35:09Speaker 27

All right, and I will note that he is on the deed. Please raise your right hand. Do you swear to affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

1:35:14Speaker 27

All right, thank you.

1:35:15 – 1:36:01Speaker 26

On 5-7-2026, the fourth visit, a $300 penalty was placed for no compliance on cutting and or cleaning, originally cited 3-5-2026. No compliance for exterior street ID number for the rear of the property. Originally cited 3-25-2026. We returned to the property on 7-22-2026, found the cleaning compliant and the exterior ID number was still non-compliant. And I will get you a photo of that in just a moment. So here we have a photo showing that the rear ID numbers are missing and or not visible from the street. And that is all we have at this time. They did get the cleaning taken care of.

1:36:01Speaker 14

I'll submit that this photograph establishes the conditions of citation as they existed at the time of the citation. I believe this was redocked from two weeks ago to get this all taken care of.

1:36:11Speaker 32

Okay. I thought you told me to take the photo and bring it.

1:36:19Speaker 31

Lakin, can you blow up that picture?

1:36:26Speaker 26

That photograph, is that on this side of the house? Those house numbers that are on your photo, is that this side?

1:36:33Speaker 32

Yeah, right there.

1:36:34Speaker 21

So it would be on the right-hand side.

1:36:36Speaker 32

On this side, the right side.

1:36:38Speaker 21

It's on the right-hand side. According to this picture, it would be on the right-hand side of the door.

1:36:43Speaker 32

The door and the window.

1:36:48Speaker 26

I don't see it in the photo. This photo was from this past Wednesday.

1:36:57Speaker 21

What's the date on that photo?

1:36:58Speaker 8

When did you put those up?

1:37:00Speaker 26

These photos are from the twist.

1:37:01Speaker 8

When did you put the numbers on the back?

1:37:04Speaker 32

I think it was Thursday. Yeah, Thursday. I would say that they was already up before.

1:37:12 – 1:37:28Speaker 26

So the issue is that not that the numbers are missing. It is that they're not, they have to be visible from the road or the alley. And as you see, so this photo, yeah, the brush is the issue. This photo was taken from the roadway. You have to be able to visibly and easily see them from the roadway. So that that's what the issue is.

1:37:28 – 1:37:47Speaker 8

The reason is, If an emergency vehicle, whether somebody called for an ambulance, fire, police, and they come down the alley and they're looking for 630, unless they can see it from the road, they're going to keep on going. So if there is any way you could get those numbers more visible from that alleyway.

1:37:49Speaker 14

I mean, even just trimming that brush back.

1:37:51Speaker 21

Yeah, trim the tree back a little bit. Trim that brush back.

1:37:55Speaker 32

Okay. It's the neighbor's tree that's coming over.

1:38:00 – 1:38:18Speaker 26

Yeah, anything over your property, you have the ability to cut anything back that's hanging on your side. So however you want to do it, just make sure that when you're standing at the alley or the road that you can just see them clear as day. And if you end up needing to paint them or something just to make them brighter, whatever you decide to do.

1:38:21 – 1:38:32Speaker 14

Yeah, we'd recommend this be pushed out for 30 days for total compliance just to get that trim back. And again, if you get that taken care of before that 30-day date, you're more than welcome to call your inspector and have them sign off. And you won't have to come back.

1:38:33 – 1:38:52Speaker 21

Okay. My brain just went completely dead. Actually, we're going to go ahead and conditionally discharge this so you don't have to come back in 30 days. But if we do get another complaint in the next year, then obviously it's going to show back up. But we're going to dismiss it at this point.

1:38:53Speaker 8

Conditionally discharge it.

1:38:54 – 1:39:17Speaker 21

Conditionally discharge, yes. So in the case of ENF-PMNT-26-003057-4... address being 630 Lewis Coleman Jr. Drive, Jr. Drive. We're going to conditionally discharge this for a year. Like they said, I would definitely get a pair of trim, trim those trees where people can see the front door, you know, paint them, make them make it nice and bright so folks can see them.

1:39:17 – 1:39:33Speaker 26

Okay. Yeah. I just wanted to clarify. They are discharging the fee, not the violation. Um, cause this is one of those more minor things. So we're going ahead and getting rid of your fee, but we still would request that you make them more visible. Um, so once you do that, just, do you have your inspector's contact number?

1:39:35 – 1:39:54Speaker 26

I'll give it. Do you need it now? I can give it to you if you don't have it. Okay, yeah. Once you believe that they're visible from the road, just shoot that person a text or a call and they'll come out and sign off on it. And then that would get your case completely closed out. Okay. Thank you so much. Thank you.

1:39:56Speaker 4

NF-LEAD-25-000286-8 3508 Hudson Avenue.

1:40:10Speaker 27

Good morning, ma'am. Can you please state your name for the record?

1:40:15Speaker 27

And what's your affiliation with the property?

1:40:16Speaker 25

I'm the property manager.

1:40:18Speaker 27

You're the manager? Okay. And it's held in an LLC, correct?

1:40:22Speaker 27

Okay. Do you have an attorney here with you today, or are you an attorney?

1:40:25 – 1:40:37Speaker 25

I believe he is online, Greg Daly. We've been talking on the- You say Daniels? Greg Daly, are you online, sir?

1:40:37Speaker 31

Mr. Daly, are you online?

1:40:42Speaker 8

Why don't we recall this case? I'll see if I can get Mr. Daly to pop up on. No.

1:40:48Speaker 27

No, he wasn't. Okay. We're going to recall the case. We're going to see if we can get, you can stay, but we're going to try to see if we can.

1:40:57Speaker 25

Yeah. Take the next one. Okay. Yeah.

1:41:02Speaker 30

Yeah. So just sit tight for a second. Okay.

1:41:12 – 1:41:27Speaker 4

NF-PMNT-25-019512-12110 Outerloop. Good morning.

1:41:27Speaker 27

Good morning, sir. Can you please state your name for the record?

1:41:32Speaker 27

Please raise your right hand. Do you swear, referring to the testimony you're about to give us, the truth, the whole truth, and nothing but the truth?

1:41:54 – 1:42:59Speaker 26

On 6-11-2026, the 12th visit to the property, an $1,100 penalty was placed for no compliance on cutting and or cleaning. Originally cited 10-1-2025. No compliance for rental registration, originally cited 10-1-2025. No compliance for exterior door, originally cited 10-1-2025. We returned to the property on 7-22-2026. The cleaning was totally compliant. The exterior door was noncompliant. The rental registry was also noncompliant. I'll get you photos of what does remain in just a moment. As of this week, the rental registry was still not completed. And then here is a photo of the door. It is somewhat hard to see because the door was open. This door here is completely dilapidated and rotted out. It is not even attached to the hinge on the bottom. So that is the photo we have of the door. And that's all we have.

1:42:59Speaker 14

Do we have, is this still in violation for cutting and cleaning? Do we know about that?

1:43:04Speaker 26

No, that was found previously compliant. So it was just the door and the rental registry is what remains.

1:43:08Speaker 14

I'll submit this photograph establishes the conditions of the citation as it exists at the time of the citation. As they still exist, I'll reserve any questions for the appellant.

1:43:15Speaker 21

Okay, sir. Your turn. What do you have to say? I know I'm... Step up a little bit. There you go.

1:43:24 – 1:44:08Speaker 38

I don't take care of that. Now I go ahead to clean up Andy. I have photo here. But the only thing I can take care of, you know, he come back and you check. I already clean up Andy. But can you give me a... I can renew the payment, something like that, that I want to repay a lot of money. Last month, I paid $500 already, but I talked on the phone with her. She said if I repeal something like that, that's why I go. But I will take care of clean energy, you know. The fancy energy, I already clean up.

1:44:09Speaker 14

So the things that we have left are there's, we need you to sign up for the rental registry. I don't know if we have a, how to do that.

1:44:17Speaker 18

I don't remember what the. It's just all online.

1:44:19Speaker 14

Yeah. And that's online. So if you go online and try to sign up for the rental registry, that'll take care of that issue. And then we need this door to be taken care of. Yeah.

1:44:27Speaker 38

I would buy the one to put on.

1:44:30Speaker 14

Okay. Yeah. Do you think you'd be able to get that done in the next month if we gave you 30 days?

1:44:35Speaker 26

Is anyone living in this address or is it vacant?

1:44:42Speaker 26

Is anyone living here?

1:44:43 – 1:45:07Speaker 38

Yeah, they have my sister and brother. They know English at all. I move out of town, you know. The first note you give, I don't receive. Second, I don't receive until, you know, a lot, a lot like that. Right. But I am proud. I mistake. Yeah, you can give me some payment, some amount to pay, something like that. I will take care.

1:45:07Speaker 14

We'd recommend we push this out 30 days to give him time to replace the door and get on the rental registry.

1:45:12Speaker 38

Yeah, and I'll reorder, you know, the door.

1:45:15Speaker 14

I think for the rental registry and the door, I think we would ask for total compliance for that. 30 days should be enough time to get both of those taken care of.

1:45:22Speaker 38

And the outside already cut. Clean any fancy.

1:45:26Speaker 14

Yeah, we can see that you've cut it and you've cleaned it. We're good on those. We just need you to fix that door and get on the rental register.

1:45:31Speaker 38

I fix that door. I put a new pan on the underground or something. And yeah. Good, you know.

1:45:38 – 1:45:59Speaker 21

In the case of ENF-PMNT-25-019512-12, address being 110 Outer Loop, we're going to push this out to the August 28th date for total compliance. So that means you need to get the door fixed and you need to get the property registered on the rental registry.

1:46:00Speaker 12

Yes. All right.

1:46:01Speaker 21

And if you're able to get both of those things completed, call your inspector. And if they bless off on it, then you won't have to come back down and see us.

1:46:08Speaker 38

Yes, the inspector went in. I don't know inspector's phone number.

1:46:15Speaker 26

I'll put it on there. Give me just a sec.

1:46:18 – 1:46:37Speaker 38

Yes, please. Now I'm out of town. You know, I work on chicken farm. Last night I ride home overnight. Yes. If you cannot review, you know, I'm outpatient. You can take care of yourself.

1:46:39Speaker 25

I know, it's so convenient.

1:46:41Speaker 38

Yes, thank you. Thank you, sir. Thank you all. You have a nice day.

1:46:50Speaker 4

NF-PMNT-24-015009-16, 4301 Cloverleaf Drive. Your buddy. I still want 300 houses.

1:47:12Speaker 30

Mr. Sawyers, will you please raise your... Staff.

1:47:15Speaker 18

Can you please state your name?

1:47:17Speaker 27

Yeah. Raise your right hand. Do you swear, affirm the testimony you're about to give us, the truth, the whole truth, nothing but the truth?

1:47:25 – 1:48:16Speaker 26

On 4-9-2026, the 16th visit to the property, a $700 penalty was placed for no compliance on cutting and or cleaning. Originally cited 3-10-2026. No compliance for vehicles. Originally cited 3-10-2026. We returned to the property on 7-21-2026 and found partial compliance on the cleaning and the other violations were found compliant on a subsequent inspection. I will get you photos of what does remain. We are set for total compliance today and all the cleaning was completed outside from this pile of limbs and some grass needing cut here.

1:48:17Speaker 14

I will submit this photograph establishes the conditions of the citation as they exist at the time of the citation. I will state that we are on for total compliance and I'll reserve any questions for the appellant.

1:48:30Speaker 8

You want that?

1:48:34Speaker 18

I had someone cut the trees down and some of them had blown off.

1:48:40Speaker 8

That was from the recent storms and stuff that came down? Pardon me? Was that from the storms and stuff we just got? All the storms that we've just been having.

1:48:48Speaker 14

If this is the only thing that's left, I will submit this establishes the condition of the citation, but I think this is enough that we can conditionally discharge this.

1:48:55 – 1:49:12Speaker 8

In the matter of ENF-PMAT-24-015-0086-16, the address being 3401 Cloverleaf Drive, I'm going to uphold the citation, the $700 fine. However, I'm going to conditionally discharge that for a period of one year, provided we have no more occurrences at that address. Conditionally discharged.

1:49:12Speaker 18

All right. Thank you, Your Honor.

1:49:14Speaker 26

Just make sure you get that cleaned up out of there.

1:49:16Speaker 8

Get it cleaned up before the next storm hits.

1:49:17Speaker 17

I've already paid somebody to grind it up.

1:49:19Speaker 26

Okay. Thank you.

1:49:23Speaker 18

There's too much to haul off.

1:49:25 – 1:49:36Speaker 4

Yeah. Thank you. Thank you. ENF-PMNT-23-002697-15, 635 Kentucky Street.

1:49:48Speaker 6

Good morning.

1:49:49Speaker 27

Can you please state your name for the record?

1:49:50Speaker 6

Jesse Hargis.

1:49:53Speaker 27

Please raise your right hand. Do you swear, affirm the testimony you wrote to give us the truth, the whole truth, and nothing but the truth?

1:49:57 – 1:50:35Speaker 26

Thank you. On 1-14-2026, the 15th visit to the property, a $600 penalty was placed for no compliance on demolition of the rear of a structure originally cited since 1-14-2026. We returned to the property on 7-22-2026 and found no compliance on the demolition of the rear of the structure. I'll get you photos in just a moment. I would also like to mention that this has been open since 2023 with two redockets and 21 visits.

1:50:38Speaker 14

And we are on for status from last month.

1:50:41 – 1:50:57Speaker 26

Here are some photos of the structure. Let's see if I can spin this one around. Oh, there we go. This is the structure in question that needs to be demolished. That's all the photos we have at this time.

1:50:57Speaker 14

I'll submit these photographs to establish the conditions of the citation as they exist at the time of the citation as they still exist. What's going on with the structure, sir?

1:51:04Speaker 6

May I ask what the 2023, like the original citation, you said it was going on since then?

1:51:12Speaker 26

That was not a citation. That was the open date for the case. Yeah, the whole entire case.

1:51:18Speaker 6

It wasn't the cutting and cleaning?

1:51:20Speaker 26

That was not a date for a violation. That was a date for the initiation of the case itself.

1:51:25Speaker 6

But it was regarding this rear structure that's collapsing, right? So I don't have a copy of it. I was just curious.

1:51:33Speaker 29

Give me just a second.

1:51:47 – 1:52:08Speaker 26

So originally this structure was not cited under the X 94 code. It was cited under individual codes and then it got so, so dilapidated. Everything was then condensed into the demolition. So the case has been open for the structure since 2023. However, this violation we are on for today has not been cited that entire time. It had been condensed.

1:52:08 – 1:54:34Speaker 6

Okay. Okay, so I was here a month ago and I explained how I had a contractor lined up and the building got broken into and People were pilfering it for a couple of weeks before I found out that they were entering through a window unit that they had pushed in and were replacing, so I couldn't tell from the outside. It's not occupied. The building's not occupied. I just go over there to maintain. It's like a storage building about a mile from my house. I go there to cut and clean at the moment. Eventually, I have more plans to deal with the building. But these people looted the property and they took all of the electrical wiring out and scrapped it. And they probably got $100,000 worth of stuff from me. And so last time I was here, I had a contractor there working on it and they stole the contractor's tools. So that was a major setback. And so last time I was here a month ago, we talked about pushing it out six months, provided I acquire a demolition permit in the last month. Well, there's been a hang up with that, too. So I got my contractor to go get a demolition permit and according to IPL, the people that he talked to, he came back to me and he said, you don't need a permit to do a partial demolition. And so I was like, well, they asked me to get one. So I went about trying to get one myself. And I made an account online and started the process. And the technical name, I believe, is a wrecking permit. And that's submitted the application part of it was like I needed to prove how old the building was so we ended up in the deed room doing deed research finding the you know when when this building was built which was 1946 and I did everything that I could to try to get this permit and it's it says it's pending all these different other things that I'm supposed to submit and the more I look at it it's it's this is a permit for demolishing the entire building so As far as I know, there does not exist a permit for partial demolition.

1:54:38Speaker 25

Do you happen to have any documentation of

1:54:50 – 1:55:19Speaker 6

honestly anything that you just said just to uh whitley no but yeah there's a police report um i can sign in and show you where the application is pending um from my phone if you like uh i don't think that would hurt if you could pull that up that'd be great because i will note that my notes say that we wanted proof right of a permit today and i remember maybe the prosecutor was able to look up online so maybe you can see it from your end we're trying to look something up but if you could just pull up i'm yeah i should be able to

1:55:30Speaker 1

Actually, I might have got an email.

1:55:32Speaker 31

He's got an application for me.

1:55:56 – 1:56:40Speaker 25

But the whole question was, how do we find it? It really needs a full-blown demo permit. Right. If we just, you know, there's nothing else. I mean, my readers. I didn't see what they needed. I mean, you're partial now. To tear it down. He's not going to hold him. Keep doing it. So, um, yeah. I don't know if it's true or not that you do or don't need a permit to do a partial RIC.

1:56:40Speaker 26

I feel like you would need one no matter what, because there needs to be documentation by the city that someone in Louisville took something down.

1:56:47Speaker 25

Well, that's also the title.

1:56:48Speaker 26

Yes. So I was going to try to search it, because usually when people apply for a permit, it gets put in the system. But I don't know what to search, because I don't work for construction.

1:56:58Speaker 17

It'll show residential alteration.

1:57:00Speaker 26

Yeah, I don't see that.

1:57:02 – 1:57:15Speaker 25

But I also could be searching it wrong. Let's do 30 days for him to show us proof that he's either getting the phone or friendly.

1:57:15Speaker 27

Yeah, because I have to imagine his effects, the description.

1:57:20Speaker 25

Yeah, so he needs so they would need some reporting. Yeah, it's the alteration. Okay.

1:57:33Speaker 31

Yeah, that's the best that we've got.

1:57:37Speaker 25

Okay. He needs from the. Oh, here it is. Okay.

1:57:42Speaker 14

And I'll put that on the record once we have it. Yeah, I want to see this. Okay. Okay.

1:58:06 – 1:58:47Speaker 6

I think if you click on the link of the it'll tell more about the application. But I don't think this permit is going anywhere because from what I can tell us for the destruction of the entire building, and really the plan with this part of the building is to just take the roof down and have an open air courtyard. Right. But it's a matter of you know, doing this with no electricity. So I've got to reestablish electricity. And then once I've got this taken down, it's got to be secured immediately. Right. Yeah.

1:58:50Speaker 8

So what's the overall plan for the property?

1:58:53 – 2:00:37Speaker 6

Like long-term? I bought this property 20 years ago, and I've had a few compliance issues that I just inherited, and I've taken care of it. Eventually, it is an investment. I did used to work as a contractor. I used it to work out of. It was kind of put on the back burner of having... My seventh child on the way and got my eight-year-old with me here today. He was helping me with the deed research. We got to learn how to use a microfiche. Yeah, their phono. Yeah, that was incidentally, he got to visit the mayor's office. He might be the only kid to ever get to do that. Cause we just happened to run into somebody who was leaving and I got a picture of him behind the podiums. Pretty good. But the long-term plan is there've been a few different iterations of it, but now that there's absolutely no electricity, that means probably like a total overhaul. Um, You know, at one point, I thought about maybe it's urban neighborhood zoning. It was grandfathered C three, but it's there's really no industrial use for the building. but it's a fortress the front of it is it's all it's two stories and concrete place cinder block quarry tile used to be a dairy a dairy it was sort of like the stockyards is uh but for milk you know you people bring their milk here to get it pasteurized and turn into chocolate milk And so it passed a few hands since I think I'm like the fourth owner.

2:00:37 – 2:00:48Speaker 26

I do have one question. It looks like there may be some other structures on the sides of these. Are those occupied homes that are next to this or are those other like commercial?

2:00:48 – 2:01:25Speaker 6

So this is on the corner of Clay and Kentucky. And there is a residence immediately to the right and she does own the home. And she's a... never complained about anything and as far as like the condition of the roof getting worse it hasn't really changed in many years it's it's settled and it's sitting on the top of a box truck that i have inside the building

2:01:26 – 2:01:52Speaker 14

So all right. I think we've got a recommendation ready. We're gonna we're gonna recommend we push this out for 30 days. And the reason we're gonna go with 30 days is because there is a residential property nearby. And this this is somewhat of a safety issue. So we want to make sure that we're staying on top of it. And we know what's going on. But we understand there's gonna be more time to figure out how we even deal with this part of the property. So that's we're gonna recommend to push this out for 30 days for status.

2:01:53 – 2:02:06Speaker 23

Okay, and we do appreciate you bringing the proof that you did work on what we asked you to last time. We can't confirm that's the correct permit or not, but we're asking you to do the due diligence to find that out before the next, within 30 days.

2:02:06Speaker 6

I think I pretty much found out that they've told me flat out that there's no permit required for taking this down. The permits are required for building something new.

2:02:17 – 2:02:34Speaker 26

Right. I made a note I'm also going to do some research on that just to make sure that the information that he's getting and that we're getting is all accurate. So eventually we can move forward. Yes. So we'll do status and kind of keep this ball rolling, seeing where we are.

2:02:34 – 2:02:47Speaker 6

Yeah. We are working toward it. This is the 2026 is the year of the purge. I'm on my fourth 40-yard dumpster. This year. All right. Two of them here.

2:02:47Speaker 23

All right. Sounds good. Thank you for everything you've done so far and just continue at it. We'll get it figured out, right?

2:02:53Speaker 6

And then for status, I can just online? Yeah.

2:02:56 – 2:03:08Speaker 23

Yeah, that's fine. So in the case of ENF PMNT 23002697-15 at 635 Kentucky Street, we're going to bring this back for a status on August 28th. All right.

2:03:14Speaker 4

NF-PMNT-26-000531-4 11900 Oral Road.

2:03:38Speaker 30

Good morning, ma'am. Morning.

2:03:39Speaker 27

Can you please state your name for the record? Victoria Quabel. And what's your affiliation with the property? I'm the property manager. Okay. And do you have an attorney here with you today or are you an attorney?

2:03:48 – 2:04:04Speaker 20

I am not. McGee, Ramon McGee is our attorney. I don't think that he was able to make it today, but I did want to submit because it came in my name. So that's why I thought I did not have to have the attorney. Okay. The appeal came in.

2:04:04Speaker 14

The property owner is what matters for this, unfortunately. So since the property owner is, it was an LLC, we have to have an attorney here.

2:04:12Speaker 20

Okay. So they just maybe wrote it wrong on the paperwork, I guess.

2:04:17Speaker 27

I do have an attorney, though. Yeah. There's an attorney. Let's go ahead and just.

2:04:23Speaker 14

Yeah, that's fine. Assuming unless your attorney is online by whatever chance.

2:04:28Speaker 27

What was his name again? Ramon McGee.

2:04:30Speaker 30

Mr. McGee, are you online?

2:04:40 – 2:04:58Speaker 8

We'll just go ahead and pass it to that 925 date. We'll do a one-time pass. So in the matter of ENF-PMET-26-000531-4, the address being 11900 Orrell Road, we're going to pass this to September the 25th. So we can have Mr. Ramon McGee here to represent the LLC.

2:04:59Speaker 20

Same time, sir.

2:05:00Speaker 8

Yes, ma'am. 830. And you can also appear virtually. Yes, ma'am. If need be. Yes, sir, ma'am. Yes.

2:05:10Speaker 20

Okay. Thank you, ma'am. Thank you. Thank you. Next.

2:05:16Speaker 4

ENF-PMNT-25-014848-8 5511 Elucid Avenue.

2:05:39Speaker 27

Do we have a translator here? Oh, he has to provide his own?

2:05:45Speaker 1

It's fine. If you don't have the translator, I will speak in English. It's not my language, but I could tell you what I think.

2:05:53Speaker 27

Okay. Can you state your name for the record?

2:05:56Speaker 1

My name is Eric Basaro.

2:05:59Speaker 27

Okay. Please raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

2:06:06Speaker 26

We are on for two citations today. I'm going to read both of them in a row, and then I will read.

2:06:11Speaker 27

One second. I'm going to double check something real quick because it says that we're on for both, or we had a continuance for a translator and an attorney. Let me just look real quick.

2:06:22Speaker 30

Yeah, no, that's all right.

2:06:30Speaker 31

See what's going on.

2:06:37Speaker 30

I don't know why I can't hear you. Let me just check the property.

2:06:40Speaker 25

I don't see any reason why.

2:06:42Speaker 31

Unless there's something I'm missing. Absolutely.

2:07:04Speaker 27

It's in his name.

2:07:06 – 2:08:26Speaker 26

Go ahead. Properties in his name. So I'm going to read both of these citations in a row and then I will read our return visit and I will provide photos after that. On 4-13-2026, the eighth visit, a $700 penalty was placed for no compliance on cleaning, originally cited 4-13-2026. No compliance for vehicles, originally cited 8-7-2025. I'm going to now read citation number nine. On 5-7-2026, the ninth visit, a $600 penalty was placed for no compliance on cleaning, no compliance on vehicles. We returned to the property on 7-20-2026 and found partial compliance on the cleaning and all the other violations were found compliant on a subsequent inspection. I will get you photos of what does remain in just a moment. Here we have some items stored outside, some more items and appliances stored outside, and then more items stored outside. And that is all the violations left at this time.

2:08:27Speaker 14

I'll submit these photographs, establish the conditions of the citation as they exist at the time of the citation, as they still exist. I'll reserve any questions for the appellant.

2:08:35Speaker 21

Okay, sir. When are you going to be able to get the rest of this cleaned up?

2:08:40 – 2:09:37Speaker 1

The problem is that... my door room is broke in the floor we are fixed and this is because we put it something is inside my my my house outside for fix it and we are working this now but when i finish i will figure out everything because we are working this i call uh some phone number that a friend gives to me for the trash bag She told me that I had to one time each year free for cleaner, but they don't pick up the phone. I call sometimes again, they don't pick up the phone. I tried to figure out something, but I can't do nothing. I know that it's not good that I'm doing, but I tried to figure it out.

2:09:39Speaker 14

Okay, so it sounds like we've got the debris that's outside is for a project going on inside. I think we would recommend that we push this out 30 days for status to see if it's coming up or not.

2:09:51 – 2:10:29Speaker 21

Okay, so in the case of ENF-PMNT-25-014848-8 and 9, address being 5511 Euclid Avenue, what we're going to do is we're going to take this out to August 28th. Will 30 days be enough to finish everything and get everything moved back in? And we'll take it out to total compliance on August 28th. For status? Yes. Okay. So we'll take it out to 8-28-26 for status. If you do get everything fixed and repaired and get everything moved back in, just contact your inspector. And if they come out and blast off on it, then we won't have to see you again.

2:10:29Speaker 1

Okay. Thank you.

2:10:35Speaker 4

ENF-PMNT-24-000578-15 2622 Rowan Street. Good morning, sir. Can you please state your name for the record? Charles Pendleton.

2:11:03Speaker 27

Okay. And I did note that I believe it was Ashley Todd was the appellant in this case. Is she?

2:11:10Speaker 37

That's my wife.

2:11:11Speaker 27

Okay. Was her name also Ashley Todd? It was. It was. Okay. I just wanted to verify that. All right. Raise your right hand for me. Do you swear to affirm the testimony you're about to give us the truth, the whole truth, nothing but the truth?

2:11:24 – 2:12:17Speaker 26

This also has two citations. I will read both citations in a row and then I will read our return visit and then I'll show the photos. On 4 30, 2026, the 15th visit to the property, a $600 penalty was placed for no compliance on cutting originally cited 4 30, 2026. No compliance for interior surfaces for damaged drywall originally cited 1 22, 2024. No compliance for exterior door originally cited 1 22, 2024. I'm now going to read the second citation. On 6-1-2026, the 17th visit to the property, a $500 penalty was placed for no compliance on the exterior door. We returned to the property on 7-20-2026. We found total compliance on cleaning, no entry for the interior surface wall, and no compliance on that exterior door. And I'll get you photos in just a moment.

2:12:22Speaker 29

Very tiny photo.

2:12:25Speaker 26

So this is showing the exterior door that is dilapidated and in disrepair. And then the interior surface, we were not able to gain entry to check that. So this is all we have for now.

2:12:35 – 2:12:47Speaker 14

I will submit this photograph establishes the conditions of the citation as they existed at the time of the citation as they still exist. And again, we were not able to gain entry to confirm whether or not the other citations still exist. Go ahead, Mr. Finley.

2:12:48 – 2:14:22Speaker 37

Well, the tenant that was originally in there, we had to evict her, and it was several months that we wasn't able to get into the house. So when we got into the house, we found out when we evicted, she left almost like she just walked out the door. and she had all this stuff in the house. We had to get all the stuff out of the house. So the restroom, it was a lot of things in the restroom. So when she got evicted, I wasn't thinking that they would still come back to see a little piece of drywall that they're supposed to be in replaced because now I'm remodeling the restroom inside. Like I had to take the toilet out and take the vanity out, put new vanities. And so I'm remodeling the whole inside of the house and then the inspector called and I get it. Now I'm like, what's going on? She's like, Well, I need to come in and see. At that point, I'm like, well, if you come here now, I'm going to really be messed up. So I told her I would get it done. And then she came back another time and took pictures of the grass, which it had rained a whole lot. And then maybe I missed that week because it rained, the grass came up. But now I have someone coming weekly, cutting the grass and getting that done. The door on the back, I was going to... I thought I had to take the whole entire door off, but... a friend of mine told me that it's like a bondo thing for the door for the metal you can you know that's how you fix it and then i can paint so i mean right now i got drywall back on my truck that's parked outside that i'm going there to start finishing everything up that's inside so i will give her entry i'll probably need i'll say about another couple weeks to a month to have everything

2:14:22Speaker 14

We would be fine with 30 days so we can get somebody in there to just confirm what the violations that still exist are. So 30 days for status.

2:14:30Speaker 8

30 days for status. No problem. Let this man get in his drywall, get down and get back to work.

2:14:35Speaker 27

And one second. I just want to clarify. What day was the tenant? Did the tenant vacate?

2:14:43Speaker 27

Month or do you have an idea?

2:14:47Speaker 37

I've been in there. She's been gone for about two months now.

2:14:51Speaker 27

Keep that clear.

2:14:52 – 2:15:05Speaker 8

Okay, so the matter of ENF-PMAT-24-000578-15 and dash 17, the address being 2622 Rowan. We're going to pass this out to the August the 28th date for status.

2:15:06Speaker 37

So August the 28th, is that something that I could do that virtual?

2:15:12Speaker 8

And again, if you get it finished and you get your inspector down there, then it'll get conditionally discharged and you'll be done. Okay, appreciate it.

2:15:25 – 2:15:46Speaker 8

Negative. I've heard nothing from Mr. Daly, so I guess we're just going to have to roll it also out too. Ma'am, I called Mr. Daly and I text Mr. Daly and I called the office. They said he was not available, so I don't know if he is sick, vacation or a trial, but I will do that. That same August the 28th date, we'll pass it to August 28th.

2:15:47Speaker 14

And you're welcome to, I believe, join that virtually if needed, I think, correct?

2:15:51 – 2:16:13Speaker 8

And that was in the matter of ENF-LEAD-25-000286-8, the address being 3508 Hudson Avenue. We are going to pass that to 82826 so Mr. Daly can show his pretty face. Or appear virtually, or you can talk to Mr. Daly. Mr. Daly might be able to take care of it for you unless he needs you to testify.

2:16:13Speaker 25

Thank you. Thank you. Now online.

2:16:26Speaker 31

If anyone needing to be heard online.

2:16:32Speaker 16

Yes, 1060 with Cherokee Road.

2:16:36Speaker 8

And also another two. I think Cherokee Road get conditionally discharged.

2:16:40Speaker 26

There's two charities. This is 1061. We'll do that. We'll hear this one now. Okay.

2:16:46Speaker 4

Everyone, this is 1061. ENF-PMNT-25-003063-2, 1061 Cherokee Road.

2:16:58Speaker 27

All right, Mr. Alexander, can you please state your full name for the record?

2:17:03Speaker 25

Yes. Frank Lee Alexander II.

2:17:07Speaker 27

Please raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

2:17:14 – 2:17:57Speaker 26

Thank you. On 7-24-2025, the second visit to the property, a $400 penalty was placed for no compliance on exterior surfaces originally cited 3-5-2025. No compliance for roofing and soffits for the box gutters originally cited 3-5-2025. No compliance for exterior stair or fire escape originally cited 3-5-2025. We returned to the property on 7-22-2026. We found no compliance in the exterior surfaces, no compliance on the roofing or gutter material.

2:18:06 – 2:18:19Speaker 26

The previous inspection, the fire escape had been marked as compliant. And if you give me a moment, I will get photos. Just a quick reminder that this has had five redockets already.

2:18:22Speaker 29

Here we have, well, maybe.

2:18:26 – 2:18:51Speaker 26

Here we have a photo of the foundation and the stair with a crack in it. The foundation has cracks and deterioration. Another photo showing the same thing, just a different angle. Here we have some holes in the softening, more holes in the softening. That's all the photos we have at this time.

2:18:53 – 2:19:06Speaker 14

I'll submit these photographs, establish the conditions of the citation as they exist at the time of the citation as they still exist. I will reserve any questions to the appellant, but I will once again state for the record that this is the fifth redocket we have had for status, and we have asked to see some sort of update.

2:19:07Speaker 8

Go ahead, Mr. Alexander.

2:19:10 – 2:21:17Speaker 16

Morning. You know, it is true. It's been, you know, a little while. But I also appreciate the fact that you've given me time to continue making improvements on the property. And I understand that there's photos that are being shown of items that are remaining outstanding. But about six feet to the right of that photo, what I don't see is... one of the items that was the original cause of going out to the property which was a hole which has been fixed that was about you know six feet long approximately that required some repairs up in the box gutter areas when i was here last time one of the things i mentioned too is that a roofer had stated that there was um Repairs to the gutters that needed to be made because that was actually what was causing those holes. So we had actually had all of that work done on the roof, which I don't see any photographs related to that. You did discuss that with me. I did mention that that was all done. That is my representation to you that that was all done and that needed to be done preceding this work. There are some holes. There's a couple of spots. I will tell you that I feel like some of that stuff hasn't gone as fast as I would like it to go. I actually terminated the contractor about a month ago because it's not going at the speed at which that I would like it to be going. And I am hiring a new contractor to go ahead and finish those items up. However, they're all also other areas of the property where some work has been done. So when we say that there hasn't been anything along the front, I was going to point out, I don't know if you can see it in this photo, but you can actually see some of the blue tape around the windows where there's been painting that's been going on around the exterior.

2:21:17Speaker 27

And what was the original dates on these two issues?

2:21:24Speaker 29

March 5th, 2025. Thank you.

2:21:28 – 2:22:01Speaker 16

All of that is approximately 40 feet up in the air and I'm sure you can appreciate just the hazardous nature of the work and also weather taking that into consideration as well. So it has been a little bit of a challenge considering the height of the work and also the weather. Those items that you pointed out down below, I don't see any reason why the next time we come back here that we can't have those done like stairs those areas, that's that's looks like they're fairly simple to resolve.

2:22:04 – 2:22:17Speaker 14

Okay, we've we've had at this point, there's been there's been five redockets, we're all right with one more. And we're going to suggest we put this out for 60 more days for total compliance to get these issues taken care of.

2:22:20 – 2:22:51Speaker 16

I would ask if it's okay that it's not a total compliance, that we do come back in 60 days and see what we can do. We've gone through great expense. We had the stairway rebuilt and back, which that in itself was quite an enormous amount to go through between landmarks. And also going through the permitting process to get that all done and resolved. So I think that's part of the delays as well.

2:22:51Speaker 14

I can appreciate what Mr. Alexander is saying. Metro still needs this taken care of. So we are going to ask for 60 days for total compliance for this one.

2:23:01 – 2:23:15Speaker 8

So in the matter of ENF-PMNT-25-003063-2, the address being 1061 Cherokee Road, we're going to come back on the September the 25th date, and we'll be coming back for total compliance.

2:23:23Speaker 31

Next case. James Moorman, 3530 Grand Avenue.

2:23:35Speaker 4

ENF-PMNT-25-012896-3, 3530 Grand Avenue. Yes.

2:23:45Speaker 27

Good morning, Mr. Moorman. Can you please state your full name again for me?

2:23:49Speaker 5

James H. Moorman, Jr.

2:23:51Speaker 27

Please raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

2:24:00 – 2:26:02Speaker 26

On 10-20-2025, the third visit to the property, a $500 penalty was placed for no compliance on exterior light fixture, originally cited 7-22-2025. no compliance for rental registration, no compliance for exterior surfaces originally cited 7-22-2025, no compliance for porch or balcony areas originally cited 7-22-2025. We returned to the property on 7-22-2026. Everything was marked compliant on previous inspections aside from the exterior surfaces. This is still listed as No compliance. I will give you the photos of what remains in just a second. Bear with me as we do have quite a bit of photographs here. Here is the porch. The light fixture has since been removed, so that is marked compliant. Here we still have some exterior surfaces that are dilapidated. This piece of siding here, this wood was painted but it is still rotted. Again, the wood is painted but it was still rotted. And then here is more unpainted rotted wood. And then the corner of the structure there by the downspout, there is some dilapidated siding there. There is, it looks to be a repair that was made under the window. However, that is not an approved repair. That is still rotted, dilapidated wood that's been painted over top of. And then here is still some more siding that is broken, chipping, and missing. More siding, broken, chipping, or missing. More chipping, peeling, siding. Another photo close up of that. And that's all the photos we have at this time.

2:26:03 – 2:26:15Speaker 14

I will submit these photographs, establish the conditions of the citation as they exist at the time of the citation, as they still exist. I will reserve any questions for the appellant. However, I will once again state that we are on for total compliance today after our fourth redocument. Thank you.

2:26:17Speaker 21

Go ahead, Mr. Mormon.

2:26:19 – 2:27:38Speaker 5

Yes. We've done a lot of repairs, including fence and the whole thing. I just need a little bit more time. Y'all been very generous with, with, with the time that y'all gave me, I live in Savannah, Georgia, and it's kind of hard getting stuff done. With a little bit more time, maybe 60 days, everything will be right with the house. And one other thing, I had a inspector, Kimberly, And she, I think she inspected the house. When did you take these pictures? Did y'all take them this week? These photographs were from Wednesday of this week. Okay. All right. Well, she inspected and said the thing was all right. I know she's not with the code. She got laid off, but 60 days, I think I have everything correct. And y'all been more than generous with the time given to do the repairs. It's just a little difficult.

2:27:40 – 2:27:52Speaker 14

I can appreciate what Mr. Mormon has said. I can appreciate that he has done some work. However, we are on for total compliance today and we are not in total compliance. So the county would ask for at least a portion of the citation or rather at least a portion of the fine to be upheld.

2:27:55 – 2:28:31Speaker 21

Mr. Moorman, I believe that we have given you plenty of time to get this stuff taken care of. We are, like they said, we are on the fourth time that we've redocketed you, and we were on for total compliance today. So at this point, I'm going to uphold the citation, but I will conditionally discharge $250 of the fine. So that will bring your fine to $250. So in the case of ENF-PMNT-25-012-896-3, address being 3530 Grand Avenue, the citation is going to be upheld, and I am upholding $250 of the fine. All right.

2:28:31 – 2:28:48Speaker 5

Thank you for the $200. Thank you, sir. All right. Thank you. And how long is the next 60 days?

2:28:48 – 2:29:05Speaker 21

No, sir. You have no more time. This all should have been done. So at this point, you're going to have to pay the fine of $250. The citation has been up and held. And if they go back out there again, there will be another citation. And if still in this condition, there will be another citation issued. And we will start this all over again.

2:29:06Speaker 5

All right. Thank you.

2:29:13Speaker 5

I guess. I guess.

2:29:16Speaker 8

Mr. Benz, what do you have on today?

2:29:19Speaker 25

I have four on my desk. Can't hear you, Mr. Benz. Can you all hear me now?

2:29:28Speaker 8

A little better.

2:29:29Speaker 25

A little muffled still. Can you mute, Mr. Morgan?

2:29:35Speaker 36

Yes. Wrong microphone. Can you hear me better now?

2:29:39 – 2:29:51Speaker 36

Yep, it was picking the laptop versus my web camera. I got four cases this morning. First one is 636 Gaines.

2:29:57Speaker 8

Real estate. Okay. ENF-PMAT-26-011702-1 636 Gaines Avenue.

2:30:07Speaker 27

Mr. Benz, do you have anybody here that's going to be testifying?

2:30:10Speaker 36

Yes, I do. All right. Christopher Jakewith is still with us.

2:30:14Speaker 27

Can you state your name for the record, sir?

2:30:16Speaker 36

Yes, Christopher Jakewith.

2:30:19Speaker 27

Do you swear? Oh, I'm sorry. Can you raise your right hand? Do you swear or affirm the testimony you're about to give us, the truth, the whole truth, and nothing but the truth?

2:30:28 – 2:31:08Speaker 26

On 6-10-2026, the first visit to the property, a $100 penalty was placed for no compliance on cutting or cleaning, originally cited 6-10-2026. We return to the property on 7-21-2026. and found partial compliance on that violation. It looks like almost everything was removed aside from a few items, which I'm now showing photos of. There was some boxes and debris on the front porch, some inflatables unused in the yard and some toys laying about, and then some weeds. Everything else was removed, so they do just have a little bit left, and that's all we have at this time.

2:31:09Speaker 14

I'll submit these photographs, establish the conditions of the citation as they existed at the time of the citation. As they still exist, I'll reserve any questions for the appellant.

2:31:16 – 2:31:38Speaker 36

Go ahead, Mr. Benz. All right, this is a rental property, and we were under the impression on Mr. Jaquist's last visit they had corrected all of this, so they've redone this and failed to mow since his last visit. If we could pass it for 30 days, Mr. Jaquist will get with them and we'll send a notice of lease violation for them to clean up the property, and if they don't, we'll start the eviction procedures.

2:31:38Speaker 14

We would be fine with 30 days. That's fine.

2:31:40Speaker 8

We're going to pass this for status to the August 28th date for status. Thank you. Thank you. Mr. Benz, what's next?

2:32:02Speaker 36

All right, the next ones I have, I will start with 322 South 43rd Street.

2:32:11 – 2:32:23Speaker 8

Okay, and that is NF-SHL-26-00031-2, 322 43rd Street for 322 South 3rd Street Revocable Trust?

2:32:25Speaker 36

Yes, sir. And we have Clay Smith, the property manager, on with us this morning.

2:32:31Speaker 27

Okay. Sir, can you state your full name for the record then?

2:32:35Speaker 30

Is your camera on? Mr. Smith?

2:32:51Speaker 36

Let me shoot him a text message to tell him to please be on his email walked away from his keyboard.

2:33:03Speaker 8

You're looking pretty normal.

2:33:05Speaker 25

I heard that one. There's a different guy that's asleep.

2:33:09Speaker 29

There's a different guy that's asleep.

2:33:26 – 2:33:37Speaker 25

Hey guys, sorry, my cell phone's not working.

2:33:37Speaker 27

No worries. Can you just state your name for the record for me, please?

2:33:40Speaker 12

My name's Clay Smith. Hey guys, can y'all keep it down for a second in court?

2:33:45Speaker 27

Please raise your right hand. Do you swear or affirm the testimony you're about to give is the truth, the whole truth, and nothing but the truth?

2:33:50Speaker 25

I swear. Thank you.

2:33:55 – 2:34:10Speaker 17

Yeah, so the property has been cited for operation of a transitional house without having the required license. And staff confirmed with an inspection today that the property is still being used as a transitional house without the required permits to licenses.

2:34:15Speaker 25

Ms. Smith, what's going on with this property? They need to...

2:34:22 – 2:34:59Speaker 12

well the last week we had a meeting with you guys um on the code enforcement for a similar case at 4107 river park we were seeking guidance on and the delay was in figuring out are these transitional houses are they not we tried to put together a plan in such a way that they were not transitional housing however the state or the city has recognized them as transitional housing so we were told to move forward with filing the conditional use permits so we filed conditional use pre-application permits On all four of the properties, three of which are up for today's discussion. And we've removed the signage from the properties as well, and we're going through the permitting process.

2:35:00Speaker 14

Ms. Smith, can you confirm which day the application was put in?

2:35:05Speaker 12

Today, this morning, 7.30 or 8 a.m.?

2:35:09Speaker 14

In that case, we would ask for 30 days to see if that, to see what happens with that application, sir.

2:35:16 – 2:35:32Speaker 8

So in the matter of ENF-PMET-26-011702-1, address being 636 Kings Avenue, we're going to pass, oh, I'm sorry, that would be the ENF-SHL-26-000031-2, the address being 32243rd Street. We're going to pass this also to that 828 date for a status.

2:35:40 – 2:36:18Speaker 12

is that the same date as the 4107 river park could we put them all together and we had a 60 day on river park i didn't know if maybe we could put all four of these together we're we're fine with that that's if they if it would be more convenient we don't know what the date is oh well then never mind uh do you know that date off the top of your head play because i do not he's not here otherwise uh i have um I can find out and put it in the net. Let me look at the sellout.

2:36:18Speaker 14

I'll tell you what we can do. We would recommend doing the 30 days and then if he is inclined to redock.

2:36:25Speaker 8

We'll stick with that date. Mr. Benz will be here. Mr. Benz, what's your next case?

2:36:31Speaker 36

The next two are going to be the same things with Mr. Smith. It's 3504 Garland and 3130 Garland.

2:36:40Speaker 17

Right above it. 3504. Okay. It's both a transitional housing.

2:36:45Speaker 14

Well, are we talking about 30? So we need to read into the record first, correct? Yes.

2:36:52Speaker 8

A matter of ENF-SHL-26-000027-3, the address being 3130 Garland Avenue.

2:37:00 – 2:37:30Speaker 14

In this case, we are going to object to this one being called. The reason being is the... Appeal for that particular property for this citation was made on, I believe it was June the 15th, and the citation for this one was issued, let me find the date, was issued April 28th, which June the 15th is quite a bit after the 10-day period for appeal, so we would actually object to this being called as untimely.

2:37:30Speaker 8

That would be faulty on its face then?

2:37:32 – 2:37:48Speaker 36

We would object to the objection because if the board scheduled it, then the argument that it was untimely filed has been waived because it was scheduled for an appeal. The time to note that objection for it being untimely would have been to deny the hearing, not to wait until the hearing date and object.

2:37:54Speaker 14

I mean, the county objects to it being called, what the board does.

2:38:01Speaker 27

The appellant to timely file their appeal, not on us.

2:38:07Speaker 36

If you all scheduled it, the counties, you all granted the appeal.

2:38:11Speaker 8

When was the appeal actually filed?

2:38:13Speaker 14

The appeal was filed, it looks like, on 6-15-26. When the appeal was filed, the citation was issued on 4-28-26.

2:38:23 – 2:38:39Speaker 8

Are you following this, Mr. Benz? Apparently, we've got a citation issued back in April, and then the appeal was not filed until June. So it was not filed. It could not have been entered. If they did, it was a clerical error.

2:38:40Speaker 27

It doesn't say that we waive it.

2:38:44Speaker 36

The county, I believe, as the county and the board are essentially arms of each other.

2:38:50Speaker 27

No, we are not.

2:38:52Speaker 36

We are all divisions of the same corporate entity of Metro government.

2:38:57Speaker 27

No. The board is an independent entity. Its members are appointed. They are not employed with Metro government or are they permitted to be? That's why there's, that's why I'm here.

2:39:09 – 2:39:20Speaker 36

So we have separate council, which is why all the quasi same agency and entity or not. That's a different debate for a different day because you all are operations of the same entity.

2:39:21Speaker 14

Regardless, the county is going to object to this being called as untimely appealed.

2:39:26Speaker 36

And I'm going to have to disagree with that is when the board's granted the hearing date.

2:39:31Speaker 27

No, I'm going to disagree with that. It's the appellant has to file their appeal within a set amount of time. A clerical error and doesn't defeat that.

2:39:40 – 2:40:05Speaker 36

I appreciate not being cut off when I'm speaking. As I was stating, when a hearing date was granted, the proper thing, if the board granted a hearing date, then the board, we have a hearing. If you all did not rule it timely, it was on you to catch that and not grant the hearing date. Because you all made a clerical error is not proper to punish the appellant.

2:40:08Speaker 27

We're talking about a jurisdictional argument at this point.

2:40:11Speaker 25

The clerical error does not engage the violation. He wants us to waive the iron because they didn't. No.

2:40:21Speaker 31

This is for 3130 Garland.

2:40:22Speaker 8

Yes, sir. So the matter of ENF-SHL-26-000027-3, the address being 3130 Garland Avenue, that appeal is going to be dismissed.

2:40:37Speaker 36

And last but not least, we have ENF- You're saying the appeal is dismissed. How does that affect the citation so I can note it from my record?

2:40:46Speaker 8

Citation remains.

2:40:48Speaker 36

Note our objection to that, and we again request you send the findings of that to me in writing.

2:40:53Speaker 8

Okay. And last but not least, ENF-ZON-26-000334-2, the address being 3504 Garland Avenue.

2:41:05Speaker 17

And again, the property has been cited for operation at transitional housing without the proper license permit.

2:41:14Speaker 27

Is Mr. Smith going to be testifying in this one as well, Mr. Benz?

2:41:17Speaker 36

Yes, and as Mr. Smith had indicated earlier, they filed for the permits this morning, but you can swear him in again, please.

2:41:25Speaker 27

He's already been sworn in.

2:41:25Speaker 14

In that case, yeah, we're once again going to recommend the 30-day. Okay. So see how those applications go.

2:41:31Speaker 8

Is that good with you, Mr. Benz? We just put it out to that August 28th date on the same one?

2:41:35Speaker 36

That's fine. I wish we'd have done it for the other one so we could have got them all resolved, but...

2:41:40 – 2:41:58Speaker 8

The matter of ENF-ZON-26-000334-2, the address being 3504 Carlin Avenue. We're going to pass this to the August 28th, 26th date for status. Is that all, Mr. Benz?

2:41:59Speaker 36

That's all I have. I just look forward to getting to the ruling on the one that the county objected to so I can decide whether I'm taking it to district court or not.

2:42:07Speaker 8

Well, I've dismissed it, so it...

2:42:11Speaker 36

You granted me a hearing and then you dismissed it. That's a procedure for a judge.

2:42:18Speaker 8

Next case. Anybody else online whose case has not been called? Yes, yes, yes, yes. Calm down. Calm down. We'll get to you.

2:42:29Speaker 22

I hope so. Oh, that's me. Oh, yes. Agnes R. Matibag. Matibag.

2:42:41Speaker 21

9202 Tiverton Way.

2:42:43Speaker 25

Yes. Second page.

2:42:46Speaker 21

Hang on a second, ma'am. We're going to get you.

2:42:49Speaker 22

Thank you. You're busy this morning. Good morning.

2:42:53Speaker 8

This will be a matter of NF-PMAT-25-04028-4, the address being 9202 Tiverton Way. Correct. All right.

2:43:09Speaker 30

Ms. Matibak, can you please state your name for the record?

2:43:12Speaker 22

Agnes R. Matibak. M as in mother, A as in apple, T as in Tom, I as in igloo, B as in boy, A as in apple, G as in girl.

2:43:22Speaker 27

Thank you for that. Can you please raise your right hand?

2:43:24Speaker 22

Yes. Can you see me?

2:43:27Speaker 27

I see very up close.

2:43:30Speaker 27

Are you able to sit back a little bit? Yes. There we go. I just need to be able to see your right hand. Okay. Do you swear or affirm the testimony you're about to give us, the truth, the whole truth, and nothing but the truth?

2:43:39Speaker 22

Oh, yes, it is. By God, I swear it is the truth. Wonderful. Thank you.

2:43:46 – 2:44:27Speaker 26

On 1-12-2026, the fourth visit to the property, a $300 penalty was placed for no compliance on exterior porch or balcony originally cited since 3-24-2025. We returned to the property on 7-22-2026 and found no compliance on that rear porch or balcony, and I'll get you photos of what remains in just a moment. All right. So we do not have a photo of the rear as we were not able to get entry that day. So we are not sure what the status of it is at all.

2:44:29 – 2:44:44Speaker 14

Give me one segment. We do not have any photographs to establish whether the conditions still exist. We would ask the board for 30-day continuance to be able to get into the property and figure out what is going on. Sounds good. Sounds great.

2:44:46Speaker 22

Can we have 60 days?

2:44:48Speaker 14

This is just 30 days to get an inspector in there just to see if there's anything that's still left to deal with.

2:44:54Speaker 22

Oh, okay. That sounds great.

2:44:55Speaker 27

Can I say something?

2:44:58Speaker 41

He's got to get sworn in.

2:44:59Speaker 27

I need to swear you in first. Can you please state your name for the record?

2:45:03Speaker 41

Jason Matibog, same spelling.

2:45:06Speaker 27

Okay. And are you Ms. Matibog's son?

2:45:11Speaker 27

All right. Please raise your right hand.

2:45:13Speaker 41

I'm the favorite.

2:45:15Speaker 27

Do you swear from the testimony you're about to give us the truth, the whole truth and nothing but the truth?

2:45:23 – 2:45:42Speaker 41

Yeah, I had that 30-day continuum. It sounds great. I had talked to Christopher or Chris, the inspector. I just missed him when he tried to come on Wednesday. And I told him I'd give him a call just so he can come over and take more pictures just to see the progress that's happening.

2:45:43 – 2:46:04Speaker 26

um that's ongoing and whatnot but like the major violations are are getting hammered out right now yes there is another one here from mr christopher monahan that they do have a dumpster on site and they are currently working on that rear deck we just weren't able to get updated photos so it appears work is ongoing yes um i said

2:46:06 – 2:46:26Speaker 23

Okay, so we were in the case of ENF PMNT 25-004028-4 at 9202 Tiverton Road, our way. We're going to move that out for a status on August 28th and give a chance to get the inspector in there to evaluate the work that's being done and get an updated status.

2:46:26Speaker 41

All right, thank you.

2:46:29 – 2:46:46Speaker 22

Can I say one thing? Of course. I appreciated your lawyer joke this morning. Listen, all of you have a very nice day and a blessed weekend. Thank you. Thank you, you too. All right. Bye-bye.

2:46:47Speaker 20

Bye-bye. 1922 Griffiths Avenue.

2:46:51Speaker 25

Can we put her on code?

2:46:53Speaker 21

We need another hearing officer. We need another hearing officer.

2:46:58 – 2:47:21Speaker 4

i know right enf-pmt-25-009319-5 2833 fleming avenue mr childers are you on or childers i think i see you talking i think your mic needs to be on

2:47:32Speaker 29

We can't hear you, Mr. Childers.

2:47:35Speaker 25

Can you hear me now?

2:47:37Speaker 27

There you are. There you are.

2:47:49Speaker 27

Can you say your full name for the record for me, sir?

2:47:52Speaker 39

Clarence L. Childers, Jr.

2:47:55 – 2:48:09Speaker 27

Please raise your right hand. Do you swear or affirm the testimony? Oh, I think that might be your left hand. Thank you. Do you swear or affirm the testimony you're about to give? Is the truth the whole truth and nothing but the truth?

2:48:11 – 2:49:05Speaker 26

All right, thank you. On 5-13-2026, the fifth visit to the property, a $200 penalty was placed for no compliance of cutting and or cleaning, originally cited 5-13-2026. No compliance for vehicles stored on the property, originally cited 5-13-2026. We returned on 7-22-2026. We found partial compliance on the cleaning and no compliance on the vehicles. I will get you photos of what remains in just a moment. Here we have some weeds and debris on the property, some more weeds and debris, and then the vehicle code was for this trailer that is parked in the side yard, and that's all we have at this time. Also, there is a note from the inspector that we have seen some compliance on cleaning, so there is still some that remains, though.

2:49:05Speaker 14

I will submit these photographs to establish the conditions of the citation as they exist at the time of the citation, and as they still exist, I'll reserve any additional questions for the appellant.

2:49:14Speaker 21

Were we on for total compliance today?

2:49:17 – 2:50:59Speaker 39

Okay, what I'm on for is... Hello? Go ahead, sir. Okay, when I was here on the 10th, the only thing that was asked to have completed was the vehicle moved, and the vehicle has been moved. Talked to Mr... Gentry and he's in compliant with that then he it was nothing about this trailer or the trash Which was not there the first time that trash has just been Brought up there because they if you look at the garage door on the up-to-date pictures Let's see can you go to the where the trash is and The door has been replaced there, and that's some of the trash there. But that has all been moved. That and the trailer is in the process of being moved. Now, I'm in Virginia Beach, and I've been in contact with my house. The guy's doing renovation on the house. He's been in and out of town, and the people he has working for him have been doing their job. And so I don't know if I can share a picture with you. i can show you that that trash is all gone uh i received these pictures last night i sent them to miss picture last night i sent it to mr gentry and um he should be able to uphold that that i did send that to him last night um let me see if i can can you see that picture can you see any pictures

2:51:00 – 2:51:21Speaker 26

No. So I think the issue here was there was other vehicles and other debris that got taken care of. However, the code covers every vehicle, previous and current. So he did get the previous trash and vehicles moved. However, there is still different trash and a different trailer.

2:51:21Speaker 39

That trash is no longer there.

2:51:24Speaker 14

And in my understanding, sir, that you're saying that this got cleaned up either last night or today. Is that what you said?

2:51:30Speaker 39

It got cleaned up last night. Yes.

2:51:33Speaker 14

We can't confirm that right now, but I'll tell you what we can do is we can ask to continue.

2:51:38Speaker 39

If you check with Mr. Gentry, if you can check with Mr. Donald Gentry, he can let you know. I sent him a picture last night. Of this area.

2:51:47Speaker 14

Well, Mr. Childers, what we're going to do, we will ask to continue this for 30 days just to confirm with the inspector that everything's taken care of. And if it is all taken care of, Mr. Childers, then you won't have to come back in that 30-day time.

2:51:59Speaker 39

Okay. Now, how will I verify that I don't have to come back? will be sent out to me and written notice.

2:52:07 – 2:52:23Speaker 26

If you get with your inspector and they get the violations removed, the inspector would then be the person that will tell you that you no longer have to appear. But if they do not tell you that, you are still required to appear. So we will call you if we don't need you to come back. We'll call and let you know.

2:52:25Speaker 39

You will call me. Okay. So we're looking at 30 days.

2:52:29Speaker 21

It'll be August 28th, sir.

2:52:33Speaker 14

And I will say, Mr. Childress, the easiest way will probably be to call your inspector and make sure and confirm with them that they're all right with everything that's happened, all right?

2:52:44 – 2:53:51Speaker 39

All right. He didn't submit the new pictures? I mean, besides those three. The three were new ones. All of this has been cleared up. These three pictures showing now, all that's gone. That was gone last time except for the center picture, and that's gone now also. That van is up to date. It was just parked in the yard. so it has up-to-date license plate only even though it looks raggedy as crap and uh like i um talked to my contractor and he's cleaned up all of that got the van out of there because uh i threatened to hold that to a junkyard or something he got rid of it and same thing with the trailer um that's over here in the background i um told him that was going to be hard to trash too so Like I said, he's in the process of getting that moved. I talked to him this morning while I've been online here with you all. And so I hope to have that house rented. He's been working on it for almost four years now. I hope to have him, you know, get that house rented in the next couple of months here and, you know, be done with it.

2:53:51Speaker 14

All right, Mr. Childress. Well, I mean, you've got, if you can reach out to your inspector and get them to confirm that everything's cleaned up, you won't have to come back in that 30 days. All right.

2:54:00 – 2:54:18Speaker 21

In the case of ENF-PMT-25-009-319-5, address being 2833 Fleming Avenue, we're going to push this out to the August 28th date for a status. But like he said, if you're able to get everything taken care of and the inspector blesses off on it, then we won't have to see you then.

2:54:19Speaker 39

Certainly. Okay. And I'll get something in writing, right?

2:54:27Speaker 31

Is that the yes?

2:54:28Speaker 29

Yes. Yes, you will, sir.

2:54:30Speaker 31

Okay, great. Thank you. You all have a great weekend.

2:54:34Speaker 8

All right. Bye-bye. Is there anyone online whose case has not been called?

2:54:41Speaker 25

1922 Griffith Avenue.

2:54:43 – 2:54:56Speaker 30

That is an LLC. That's a company. Yeah, she needs an attorney.

2:54:58Speaker 25
