Over and harder. Okay, on the PFE Commission, several items. Last Wednesday, Officer Aiden Keenan was sworn in as a police officer. We are thrilled to have Aiden join our team. With this addition, we are officially at full staffing levels for the first time since 2018. coffee with the cop and the mayor on the morning of Tuesday, August 11th at a location to be determined. Please check into the website and follow us on social media for updates on the location. And then at the last PFE meeting, and that was actually on June 22nd, the committee reviewed and provided feedback to make clarifications regarding the city ordinances governing bicycle basically updating them and getting in line with the state. Bicycles, motorized bicycles and motorcycles and all that, electric scooters. Unanimously approved the recommendations, which we're going to see later on this evening. And hoping for a double reading as well. And they have a good campaign plan for educating the community. And we're also launching a fraud academy. And that's going to be Wednesday, September 9th from 6 to 8 at CBC High School. Right now it's room 122, but if the response is so great, we can always expand. We do go on the website. You can register if you need to know how many people are going to be there. This is an excellent opportunity because one thing I've noticed, the older you get, the more phone calls you get, the more emails you need to screen. And then finally, Our next meeting of the PFE will be August 4th. It is a Monday at 4 30 in the over there and everybody's invited and no one will show up and that's okay.

Thank you, Mayor. The Ways and Means Commission met on June 19th to review our annual report that was provided by Clifton Larson Allen. And we received a clean, unmodified opinion together with praise for our finance staff for an excellent job. So kudos to the staff who did the work and pleased to note that We're in good financial condition, and our books are even better. Our next Ways and Means Commission will tentatively meet on September 9th at 8.30 a.m. in the Municipal Center, and it's open for anyone who would like to attend.

Thank you. Thank you. Alderman Murphy. Thank you, Chairman. Parks and Transport Commission report. The construction has begun on the Longview parking lot project. I saw it today. There will be some minor detours into the house and the parking lot over the next three months. The park will remain open throughout the construction. We also, the Parks and Trails Commission, also wants to express their appreciation to all those people that attended the July 1 event over at Grace Park celebrating America's 250th. Really fun event. Families were able to enjoy a spirited reading from the Declaration of Independence. It's very good. It's cool treats. Special thanks to the Alderman. mayor for also attending that the parks and trails commission is also asking the public to reserve some upcoming dates for events in the city including october 3rd to attend the fire and ice event at longview park activities food music by whiskey morning band all capped off by a drone show another drum show this year Finally, we'll also be celebrating our 25th Turkey Trump on Thanksgiving Day. In addition, the Winterfest team is preparing plans for the holiday celebration at Town Square Park to be held on December 5th. We ask that the community pull out their calendars, mark those dates, and please be sure to come to those events. Thank you.

Thank you, Mayor. At the June 17th Planning and Zoning Meeting, the Commission recommended 7-1 to accept the dedication of streets for the estates at Town and Country Crossing. Prior to review by the Board of Aldermen, however, there are further repairs that are required, as well as a final evaluation by the Public Works Director. The Planning and Zoning Meeting for July have been canceled for lack of due business, and the next Planning and Zoning Meeting then is scheduled for Wednesday, August 19th at 7 p.m.

And then if you don't mind, I got one more question that you may be able to help me with. There was an electrical outlet added that will be for $2,318. It seems expensive for an electrical outlet.

Was that to support the thing? So that we are... putting in a fitness room in the Longview Farmhouse, and that is a dedicated circuit required for the treadmill.

I would now invite our finance director, Karen Mann, to the podium for a presentation on the 2025 audit.

Good evening, Board of Aldermen. I have to introduce myself. I'm Derek Mann. I joined several weeks ago. Again, you've seen some of the outputs we had, and I got to close some books easy. Thanks to everybody for having a good, smooth transition for me. But tonight, we're going to talk about the 2025 financial statement audit that Alderman Sawyer talked about that was discussed on the, what was it, June 19th meeting. So it is available right now. We can go to the townandcountry.org slash 130 and you can click there to see it. Again, clean, unmodified opinion. Award the Certificate of Achievement by the GFOA is expected to chain the award again. This will be the 10th one for the city of town and country in a row. Kind of some quick facts on that. It's very common in our area, but maybe not in the country. We're only one of 53, 54 in the state of Missouri that have achieved that award, which has additional reporting attached to it. We'll talk about that just for a second here in a bit. But reiterate, management report, no recommendations or no difficulties. Some highlights, the management discussion and analysis on page four. Good high-level bit of information about the city itself and then where we are financially. Some highlights that are listed there, 61.3 million in government-wide net position. That would be a full accrual set of books that most people are used to looking through in their business. 14 million of that is unrestricted, which means we can use it for whatever we'd like. 23.1 million if we switch over to, it's called modified cash basis, but it's for us mostly a true cash basis. 23.1 million in governmental fund balances. This is important because this is what we do most of our budgeting on, is government-wide, sorry, governmental fund balances. That is an increase of 3.37 million from 2024, so a good healthy increase. Then maybe most importantly, they're one of the major funds we look at for budgeting and for general purpose uses in the general fund. That has a fund balance of 14.2 million, which represents 127% of general fund expenditures for the year. This is exactly kind of what you'd expect going into a big capital project. And that's what is the additional reporting required, the majority of the additional reporting required for the certificate of achievement. In there, we'll see not just one year, but we can see 10 years worth of financial statement components over time, along with debt demographic and indicator information. Again, in the back is where you get more of this trend analysis that we were going to look at here in a second. With that, here's the trend itself. So in our general fund, what we just talked about, Revenues are on the blue line, plus transfers here, and then expenditures in the red. You can see over time there, big bump with the revenues quite a bit higher than that red line, and a nice steady red line. Again, general fund mostly operating. Then most notably here we would see in the FY26, going to other funds to pay for the capital purchases. So with that, it's a little bit difficult to say, this might look strange. If we were to take that transfer out, you can see what this chart would look like, which is a pretty good looking chart for our general fund. Again, general fund, unrestricted, we can use it for whatever we want. And then if we look at this over time with that fund balance attached to it, fund balance now in orange, You can see that it has increased over time as those blue line was above the red. And then you see a little bit of a decline. What you wouldn't see in those previous charts, it looks like it oscillates quite a bit. This is zero base at the bottom. So it is not quite as dramatic as it looks like in those other charts over time. So if we move on, add from our general fund into Road Fund, Capital Improvement Fund, and then the Stormwater Parks Fund, you can see what happens when the transfers come in and out of that general fund, you can see now that it more or less kind of evens out. And so those revenues up on top in the blue, and then expenditures in the red, and then exactly what we can expect when we're going into a big capital push, you can see that red line kind of extends up. So if we extend that out to add the orange for fund balance totals between all of those funds, you can see a decrease there, but overall a healthy lead up into this budgeted decrease. So at the highest level, if I were to look at the 25 audited financial statements, the audit report, it does provide good confirmation of the fund balances used to go into budgeting. This shows a strong balance sheet. These fund balances are poised for the capital projects, which have been budgeted this year. And then we couple this with those ongoing financial, monthly financial reports. You can see everything's kind of going as expected on the revenue and expenditure side. With that, I'll hand it over to Mr. Shelton, and he'll update us on some of the

introduce you as our new cfo i've got a chance to meet you a few times in the process and having you on board and i feel like we're in very good shape and with great leadership i'm thrilled to see another audit like the 10th in a row shows that the city is in sound shape financially i also want to throw some kudos out to oldman sawyer he's head of our ways and means committee and to the men and and ladies who serve on the committee of citizens in our community they are very actively engaged in the finance of this city extremely engaged and i cannot tell you how happy and relieved i am that i'm not the mayor of kirkland I feel roughly 100% confidence that kind of situation can never happen in the city. So I just want to give you kudos to you, kudos to Ways and Means and the engagement. It's not surprising to me that when we get audited, that we turn up fine. A little before I became mayor five years ago, we had a petition that led state audit, which was an extraordinarily expensive use of city funds. look at our finances to see where the miners going is done at a very high level so thank you but why do you go ahead and i just had to go no i said nobody don't disappoint any questions for any other questions for darren he said he's glad he's got finance director perfectly that's right that's right we're glad to have darren i'm happy to be here so just a couple of uh facility updates as darren said as the board

has strategically designed to invest in our city resources, our facilities that we operate out of and provide services. Phase one, our salt dome renovation and the construction of the maintenance annex are underway. The construction sign is up out there. And just last week, they completed framing in what will be the break room for the plow drivers. This will also be an area Other times, police can use a substation. It connects to the restrooms. It has a front entrance off the front of the building into the office, a very small office there. So that work is well underway. And then also, they've done the demo of the concrete road, what used to be that old, what we call Salt Mill, Old Woods Mill. And then they've got in the saltation. But as you can see here, they're already breaking out the street. It did require that we close that path that's used by bicyclists and pedestrians until we get it all finished and open, just because it is an active construction zone. So that's all underway. And as planned, and as you all are aware, we allocated 3.7 all in for this. Right now it's tracking at about 3.4, 3.5, so under what our budget is. And with good prudent management, as you all again are aware with how to navigate to assist us and be sure we help stay on track, which we've been doing. So one other thing with the city hall, we met a couple of weeks ago with our engineers. I informed all of you, we've had some settling down in the basement. And again, before we start getting into the building and the remodel, we want to determine anything that's wrong. And they had determined there's some soil, doing that they have come forward and just presented we don't have details yet so this is kind of breaking news but we're looking at the opportunity to actually we're going to have to build a separate ada restroom shower spot well they've come back and said just make your men's and women's police Anyway, we're going to meet again on Thursday this week, get some pricing, get the engineers, make sure all the utilities and everything can fit in. More to come on this, but this is something we're looking at right now. So any questions for me?

Exhibit number two is email from Stacy Hasty, 555 South Mason Road, dated July 13th, 2026, with a letter of opposition and several attachments included relating to an intended protest petition, an area map, and the aforementioned letter that was sent to Joseph Yang, consisting of eight total pages, Item number three is a letter in opposition from Edwin and Susan Hofstetter dated June 15th, 2026, consisting of two pages. And lastly, item number four is an email response with attachments dated July 13th, 2026 from city planner Ryan Spencer to Alderman Ben Schwer pertaining to various easement questions posed regarding street access. And that consisted of 11 total pages.

I was gonna address several questions that came up throughout the course of the day.

I'll just address them and then I can sit down.

There was a question earlier about a carport that was in place at the site. is illegal, I notify the property owner. He stated in an email to me that his contractor will move it tomorrow morning and he'll send me proof that that's taking place. There was a question about chain link fencing on the property. The property is 65 years old. The property owner informed me that the chain link was present when he Staff's opinion, it's legal non-conforming. There's quite a bit of legal non-conforming chain link that's around town. There was a question about commercial vehicle parking. The applicant will have a passenger van, large passenger van for her use in her residence. the course of conduct of any other business that she may have i think she alluded to a adult daycare business that's considered a commercial vehicle whether or not it's commercially licensed or not by our code which means that it has to park according to the commercial vehicle regulations in a residential area so it needs to be either a garage or screened the driveway is well screened with evergreen materials so if a commercial van by our code is parked at the end of the driveway tucked behind the house it would meet that regulation and then there's the question of access to make support by the original owners of 541 South Basin when they split the joint property. When they sold that property to another couple called the Farrings, a easement was recorded in perpetual for heirs and assigns for access. So there's a 30-foot ingress-egress access um easement in place also for utilities for all three properties so when it comes to the question of can this applicant access that street they have the right to access that street via this easement so those are the points i want you to address thank you alderman murphy

sure i would motion i would make a motion to continue this topic until the meeting of august 10th the reason for the continuance would be um give us some time to understand the impact of a 15 passenger vehicle on that private road in terms of erosion impact on the road itself as well as making the turns onto mason road and into the driveway of said property 541 south mason also um neighbors what their perspectives are on the whole topic and then um i'm glad that you mentioned mr spencer that the carport is being taken down i would actually like to revisit this after it's actually completed that takedown so again motion to continue this until august 10 those reasons

Yes, that property is in Ward 2, so I was out there this morning to take a look at it. And what I noticed in the plans that we got is that what the developer is doing is taking a chunk out of the usable space, they're taking a chunk of the forest that's in the actual usable space, and they're moving that protected space over into the easement of the property. Now, I know I've talked to some other owners, and I know that's not illegal to do that, but to me, that's kind of defeating the purpose of the thing, because the easement can't build anything in there anyway. And so to move protected space into the easement, we're not gaining a bunch more um is is actually protected actually there's only a little sliver of the of the new section it's not in the it's not easement it's the setback thank you it's the setback um so when it was said that we're gaining 20 i would i'm not happy with that i i i feel that really what we're doing is so um that's i'm i'm not in favor of this um

Mr. Spencer, can I ask a question about that just to be sure that this is clear? Inside an easement, someone can take down all the trees they want. You mean easement or setback? Setback. It's not a setback. So it's in their property, but it's on the setback. Correct. Ten trees there.

And there's also different structures that can go into the encroach into setbacks, such as pool, decking, and mechanical equipment. I would also offer that every property that has permanent open space, large sections of that open space are within setbacks because they follow the boundaries of those properties, just like setbacks do.

Yeah, I didn't. You realize that a lot of it's already in setbacks. I also wanted to point out that they're taking down a large tree, at least one, I think. I went out there, I looked like more than one myself. And they said they're going to put up three viburnum and something else. The viburnum are bushes, so I'm not sure that, I'm not happy to see if that's what they're discussing, you know, big trees and bushes. So that's definitely the answer.

What concerns me is Summer schedule, I guess We've had two meetings in a row and we've had over well roughly four hundred thousand dollars now added, take more out of the reserves. My concern was we're, and I understand the problem. I mean, NSD costs as long as the parking lot overage. This one here, the engineer, which was HR Green I found out, underestimated by 57% the cost of this project, which kind of hurt us on the, so it's not that we, can't do it but the concern is we're every meeting we're running that a couple hundred thousand dollars and I don't want us to run short in case there is an emergency This kind is too thin.

No, and part of the reason with this particular project is that the majority is funded by both DNR grants and the OMCI. And the OMCI is collected in Ward 1. They pay additional tax to MSD. So these funds are restricted and have to be spent there, and we're getting reimbursed. So the out-of-pocket for the city... We're paying, yeah, the city out of pocket's $175,000 on this product.

So originally that whole thing was supposed to have been covered by those two funds.

Correct, correct. Yeah, yeah. But the bottom line, again, we kind of looked at it. Still, our fund balance in Park Stormwater is still healthy. So we're still in good shape. And Darren and I, we'll get together tomorrow and make sure we're all good.

Okay, I mean, that was the biggest concern. Yeah.

when we're gonna come out, a couple hundred thousand ahead. I think these things have a way of evening them out, but it's a, I would say it's an exact science, for sure. Okay, good point. I'm with you, I just assumed I'd have any more surprises. At this point, then I'd ask the city clerk for a roll call vote.

And I was reading through them. the memo that we were given um there was talk about changing certain rules from 17 to 18 years old or something and then it also mentioned something about 16 years old can you straighten that out for me what is the actual absolutely ultimate i can tell you this is a very this is convoluted legislation at the state level and i prepared for this as i wouldn't defend dissertation

The 18 has to do with something we actually just caught when we were reviewing this ordinance. You may or may not remember that until a few years ago, you were considered an adult criminal in Missouri at the age of 17. They've since changed that and they've made it more consistent. Now it's 18 for everything. So we saw that in that ordinance and we updated that. As far as the 16, that has to do with state statute and not to get too far in the weeds, but Some of these vehicles, you have to be 16. Some of them, you have to have a motorcycle license, depending on where they fall in this matrix of legislation. But that's mainly where the age difference is coming.

Thank you. In the state's legislature's infinite wisdom, I find it fascinating that they rescinded the obligation to wear a helmet if you're on the

I could not begin to fathom their reasoning behind a lot of things, of course, but that is in fact true.

It also is true that if you're involved in a motorcycle accident and you are in the motorcycle and you survive, but you're perfectly disabled or brain damaged, roughly that person pays one-tenth of 1% of their own building bills.

in very rare instances very rare they have adequate insurance but almost never no thank you all the men can sell i think you're set next yeah thank you mayor um chief it sounds like the big element of this uh proposal was to change the definitions or help uh better define what each of these vehicles is right correct and then you've got a where they can be operated as now part of the legislation But there's no requirement. I'm assuming that our city can't dictate whether there could be lights or reflective material on the vehicle because, as the mayor pointed out earlier, not seeing one of these vehicles is the biggest concern. Whether they wear a helmet or not is their own noggin. But I worry that if a child is coming along and I can't see them, I wouldn't want to hurt them.

Sure. So consistent with state law, if they go over a certain speed or if they're over a certain size, then they do have to adhere to certain things such as reflections, speedometers, and things of that nature. But until that time, they're much looked at like a bicycle. So I would say that in my interpretation it's characterized more on this day for sure yeah i don't envy the police about dealing with the child who goes through one of our sidewalk stop signs into a street to have solutions or anything in the way and they don't get seen that would be worse yeah i just would like to take a moment thank the board for considering the double re because this is a public safety concern we we're appreciative to be able to get that messaging out in a timely manner while it's still summer along with the update

Thank you for doing all this stuff, making sense out of this hash, if you will. So bicycles are obviously a big topic that comes up quite a bit. I'm kind of curious, do you have a ballpark number of how many citations you actually issue for people in violation of the current codes for bicycles?

Oh, just this code overall? Yeah. Rarely do we issue citations, honestly. persistent problem people, we can deal with those on a case by case basis, but most people, when they're informed that they're not acting within the boundaries of ordinance or law,

to be put in place, it's on everybody's radar, I'll tell you that. So I'm glad we're getting our brains up to date.
