I'll call this uh June 10th, 2025 border zoning appeals meeting to order. U David, you want to do roll call? Yep. Pete Saunders. Vicky Gushowski here. Mark Danielson here. Brian Cer, present. Um item number four, uh special exemption use to allow drive-thru. Will the petitioner step forward, please? Hello. Matthew Kirkwood um seeking the uh petition to allow a drive-thru. It's permitted to have a restaurant and we are seeking a uh drive-thru. And so we've met with David and various groups and um we believe we have a plan that's acceptable to everybody. And um yeah, we just seek that 416 J Street be approved for a drive-thru for the restaurant. I I by the way I can answer any other questions if Sure. Certainly. Thank you. David, you want to? Yeah, I'll just go through some brief comments. Item number four is a special exception use 25-02 petition to allow drive-through restaurant on B2 General Commercial District. Address 416 J Street. Um the property is outlined in red at the corner of Fifth and J. Um just to show you kind of the just some of the area around the property. Um the property is split or that block on Fifth Street is split commercial on the right

side of the alley. Um which has gone through the um in the process of going through an alley vacation um for the properties between there. Um and Matthew can answer questions on that if if you need more information. And then on the left side of that alley area there is residential. So it's it's R1C single family residential as you see the the houses there to the left of the the red square there. Just going through the site plan that shows um the general framework for the drive-through restaurant. Um, as the zoning ordinance currently indicates, for drive-through establishments, there's certain criteria within the additional use regulations um, regarding the the stacking spaces for the drive-thru, um, the number of parking spots, landscaping from the frontages along Fifth and J Street is a 5-ft frontage there with landscaping with um, basically one tree per like 40 feet. Um, and then from the west side is a little bit more. It's a 10-ft separation between the residential use to the west or to the the left there. Um, and so with if the alley vacation would go through, that would gain additional space there to accommodate that um, uh, that landscaping area there. This just shows kind of the existing layout of the lot. As you see, um, actually, I'm going to back up really quick. staff went through the site review process with the applicant and um the owner as well um and went through um the entrances and exits from the the property and determined that an exit only onto Fifth Street would be uh uh appropriate for the the use um given only the entrance off of J the one entrance off off of J Street or um State Road 2 um as it's most commonly referred to. And so just

going through the photos here, you can see the existing bank to the north of the property that has a drive-thru on the south side of the building. Um this is looking at that that alley area and then the house to the left in the garage. Um this is showing from J Street, that corner, um the front entrance there. Um the the proposed drive-thru would be located in the sideyard, which currently the ordinance doesn't allow them in the front yard. So this would be a sideyard because J Street is the main frontage there. Um and so it would meet the additional use regulations um as defined. Um again just showing some of the existing uses in the area. This is showing the alignment of the driveways um kind of close to where the proposed driveway would be located as on the site plan. Um and so staff does uh recommend approval of the special exception use 25-02 to allow drive-through uh st restaurant here. um and answer any questions if you have them. Thank you. So, David, this just for those that might be watching, this is where a car wash there was a business already here at one point, correct? Correct. And so, this is not repurposing a residential part for a business. This is just repurposing a uh zoning for a different type of business. Correct. Yep. So, the property is currently zoned B2 general commercial district and it allows a certain number of uses. A drive-through restaurant is currently a special exception use that has to be approved by the Board of Zoning Appeals. Okay. Thank you. Any other questions, comments?
