We'll move on to public hearings, personal appearances this evening. First item on the agenda this evening is a public hearing to receive public comments regarding proposed water and sewer rates based on the comprehensive water and sewer utility rate study performed by HDR presented on our January 20th, 2026 meeting. The public hearing is being held to receive public comments regarding proposed water and sewer rates based on the comprehensive water and sewer utility rate study prepared by HDR Engineering that was presented on our December 15th. And following feedback, additional information revisions were presented on January 20th. An open house was then held on February 3rd. Notice of this public posting public hearing was posted at city hall in January 16, 2026 as required by state statute. Information was also shared through the city's website, social media platforms, our city newsletter, utility bill postcards, and our local paper, the Courier Tribune. A resolution to accept the utility rate study was adopted. Excuse me. [clears throat] A resolution to accept the utility rate study and adopt the five-year rate schedule will be considered by our board of aldermen at an upcoming meeting in March. The fee schedule and budget ordinances and the budget ordinances this evening incorporate the financial year 2027 rates needed to continue providing safe and reliable water and wastewater services. give residents the option to select winter average sewer billing and continue our senior discount for volumebased sewer billing customers. Hi, I'm Jill Buyers. I live at 1802 Patricia Drive. And I understand in corny that means how much I'm going to be listened to based on my address. That's pretty standard with city services. I think it's unreasonable to raise our water and sewer rates again. It's doesn't make any sense. We have it's blatant that the city does and the alderman don't actually want people's comments on this or on our information night. We would also take public comment. We intentionally don't have information here tonight and we didn't take public comment on the night where there was information. That doesn't make sense. That shows it. We don't actually care what our constituents think that we're going to raise the rates anyway. [clears throat] That's how utility rates in Missouri are standardly raised. There isn't a vote. It we only have one choice for water. So whatever our alderin tell us are going to be our rates, that's going to be our rates. We've been promised lots of things here in Carne and we don't always get those services. Repeatedly we've been told that we will have different things come to Carney that the city provides. I understand the difference and it doesn't happen. So when we ask why are our rates going up? we have we pay a company to come in and do some sort of study. Well, maybe if we take that into consideration, the cost of having that study got done yet again. I've lived in Carne for 23 years. This isn't the first time that our rates have been raised and we can't go off. There's so many more people using the water. Well, that's simple math. More people use water, they pay for the water. Unless we're not getting things for

other services we provide. Maybe if we quit having tiff areas that don't pay taxes, we wouldn't have to do things like raise our water rates and raise the money that we had pay taxes just to go to school. So we need to look at these things how it actually makes our town less affordable. We have less people of childbearing age moving into Cornney over and over. We have more people in retirement age coming in. Why is that? It's not affordable to live here. Raising our rates. When I first moved in and had more service, more water, it was half of what I'm paying now. And I understand certain things go up, but not at this rate. Not at this rate at all. This is ridiculous. We can't keep just oh well raising things here and raising things there if if there's not an actual reason. When you look at it, more people buying the water, you get more money. You don't you don't need to raise a rates. That's my public comment. Even though I know based on my address, it won't be listened to. Would anybody else like to address the board this evening uh under the public hearing?

Whereas engineers provide the talents and skills necessary to analyze and solve complex problems and create the infrastructure essential for the high quality of life which citizens of Carne Missouri enjoy. And whereas the support of an understanding and informed citizenry of Carne, Missouri is vital to the efficient planning, design, construction and operation of the public infrastructure which includes water, sanitary and storm sewers, streets and highways, bridges, public buildings, communications and electricity and natural gas distribution. And whereas the health, safety, welfare, comfort, and economic vitality of this community as well as the success of various citywide construction projects and whereas engineers address the major technological challenges of our time from rebuilding towns devastated by natural disasters to designing infrastructure that will take the city of Carney through the 21st century. And whereas the Kansas City metropolitan area is one of the nation's largest collections of engineering firms known and recognized worldwide as leaders in their profession. And whereas the western chapter of the Missouri Society of Professional Engineers in partnership with the Eastern Chapter of the Kansas Society of Professional Engineers are celebrating the 75th annual Engineers Week through a ceremonious lunchon at the Marriott in downtown Kansas City on February 19th. And whereas the week of February 22nd, 2026 has been designated worldwide as the 75th annual National Engineers Week. Now therefore, I, Randy Pog mayor, do hereby proclaim the week of February 22nd, 2026 as Engineers Week in Carne, Missouri, and call upon all citizens and civic organizations to acquaint themselves with the issues involved in providing quality infrastructure, and to recognize the significant contributions which our

Star Development is proposed to construct a 2500 square foot Chipotle building um out in front of Price Chopper, the grassy area where there's firework stand usually where be located. Um, planning and zoning commission recommended unanimous approval. Though they did recommend that some of the parking spaces be removed from the site plan uh because it's adjacent to the overflow parking. So there's parking [clears throat] greatly exceeds what's needed out there. Site plan drawing that's in your packet includes the updated drawing that removed some uh parking spaces for the site in the site plan. Um planning zoning recommends approval. Uh basically what David said, we there was lots of discussion about the number of parking stalls for the size of the restaurant and Chipotle um [clears throat] is represented by Mr. Calgary who's in the audience. Um, as you stated, Don is before you tonight is the first amendment to the K53 plan policy and guidelines in an effort to be more user friendly to citizens and builders, as well as increase transparency. This amendment would move the hard-coded specified dollar amounts out of the policy and into an all new uh into a new all-inclusive city of Carney fee schedule which lists all fees throughout the city in one consistent and easy to find place. Currently in the policy and guidelines, there are six six references um to specific [clears throat] dollar amounts and that word which is is going to be replaced with as referenced in the city's reschedule.

So over the years, individual fees have been adopted in many different places through ordinances, resolutions, and motions, which make it difficult for residents, businesses, and staff to easily identify what fees apply and when. This ordinance creates a single centralized fee schedule to improve transparency and consistency. It removes hard-coded dollar amounts from various code sections and policies and places them into one adopted fee schedule. The fee schedule reflects the fees incorporated in the proposed fiscical school year 27 budget and begins to move toward fees that better support the cost of providing services. This ordinance doesn't create new authority to charge fees or change how fees are set. All fees must still be approved by the board of aldermen. This change simply makes fees easier for the board to review and supports more regular intentional review by the board and transparency and clarity for everyone. Uh it's been upgraded from Klay County uh sheriff's department for our to be able to house detainees at the sheriff's office in Liberty. Um we have very small percentage of a chance that we're going to utilize them. They're too expensive and I think it's a waste of resources from the city of Carney to house people there. We have other alternatives. We go to Cwell County uh where it's much more reasonable and we also go to Ray County if we need to. This is more a chance a chance to uh set up the MOU so that we have that ability when and if we absolutely need to.

this ordinance um would approve three cyber security grant awards. Uh probably the most important thing, we had planned for this in the budget um and the award just was delayed a little bit. Um, but the most important thing that I want everyone to know about this is that if when we accept these grants, it requires the city to transition to a.gov domain, which is a federal cyber security standard. It actually provides a higher baseline level of security, authentication, and trust to do that. Um, it reduces fishing risk and strengthens email and system security. But sometimes it can cause confusion because we are going to be changing our domain and people are used to going the the old way. And so it's just something that we're going to have to do a really good job of communicating when we get to that point.

For sure. Yeah. When we look at our annual insurance renewal every year, we continually see that our biggest increase to no surprise is typically on this cyber security coverage. And so I for one I mean I'm [clears throat] excited to to give the the security updates and and what a better time than when we have some some grant dollars to help us cover cover that expense. so [clears throat] this uh resolution is the second of two routine administrative budget amendments that we do every year. It doesn't authorize new projects or policy decisions. Um, it aligns the fiscical year 26 budget with actions the board has already approved and prepares the fiscal year to be closed by ensuring funds are in the correct accounts. Specifically, this amendment reflects previously approved actions, including the purchase of 108 East Washington, setting aside funds for legal fees in the potential judgment in the Davis stormwater case, adjustments related to the shops at Carne Tiff, consistent with the developer agreement, and the annual true up of shared administrative costs and in lie of tax payments that we complete annually following the annual audit each year and also internal transfers to cash flow budgeted architect fees. Uh the adjusted line items that are shown in exhibit A, you might notice they're slightly different in a slightly different presentation this year. And that revised final budget amount for each year. Each line item is shown um rather than only the change that we were previously doing. And this format change was intentional to try to improve um transparency and clearly show the final budget amount.

So um we are nearing the end of our fiscal year. So this is a pretty good indicator of how things are going to end up. The most significant thing in this report is that if you look at revenue taxes, we are at 92.61% finally. So, a huge jump from um where we were. I've been saying all year long that we're waiting on property taxes and clearly they're showing up. So, um that's a good indicator um that we are at 92.61%. Um, that's probably the only most significant thing that I saw. Our sales taxes are still trending a little bit down. Um, again, probably 2 to 3% is what it looks like it's going to end up at the end of the year. Um, but didn't if you guys have any questions or any additional information. thank you board. Um, Lauren Snider, CF Carne, city engineer. I also serve as the city of Carne, Missouri uh municipal separate storm sewer system manager or MS4 manager. Uh tonight I want to give you a brief update on the city of Carney's MS4 program. Next slide, please. So the city of Carney MS4 permit requires the city to develop a a storm water management plan. Development of this plan began in 2023. The plan includes goals and interim milestones that must be met to comply with Missouri DNR in 2026. This year is a permit renewal year for the city's MS4 permit. This permit authorizes public entities like the city of Carney to discharge storm water collected by its storm sewer systems to the waters of the United States. This permit renewal requires the city to facilitate a 30-day public review and comment period. Public notice was provided on Wednesday, February 11th, 2026 to begin the 30-day comment period. In the following slides, I will provide an overview of the city's storm water management plan and where the city of Carney currently is in that plan's development. Next slide. So, the city's storm water management plan is developed to address six minimum control measures or MCMs. They include public education and outreach, public participation, elicit discharge detection and elimination, construction site runoff control, post construction site runoff control, and pollution prevention and good housekeeping. Next slide, please. So, the first MCM is public education and outreach. And to address this [clears throat] MCM, the city identifies target audiences, pollutants, and follows up with outreach such as flyers, website postings, and social media

posts. The city also posts our annual MS report that's due every February on the city website so that our progress is transparent to the public. Public involvement includes offering public education sessions and coordinating stream cleanup events. The city is required to track its participation level in these programs uh to measure their effectiveness. Next slide, please. MCM number two is public participation and it's addressed through gathering comments during this MS4 permit review providing an annual board of alderman update which we're doing right now and responding to comments on city communications. The public may always submit comments to the city MS4 manager, myself, or through the report a problem feature on the city website. Here again, we track and report comments as part of our compliance with our MS4 permit. Next slide. MCM3. Um, this year, the city will be hitting a planned milestone in in its storm water plan development. This milestone is an adop is adopting an elicit discharge ordinance that will require monitoring, investigation, tracing, cleanup, and enforcement. City staff is already monitoring outfalls. Um, you may see these little discs below if I can grab it. Showing up on your storm water inlets around town. That's just a reminder the public that of where their storm water goes when it goes down. uh the drain. So, city staff's already doing those outfall inspections. Um we also monitor public and private development projects. Um any concerns regarding elicit discharges should be reported through the city's report of problems feature. Next slide. MCM number four. Again, this year, the city's hitting a second planned milestone in its storm water plan

development. This milestone is adopting an erosion control and construction site runoff ordinance that will require monitoring, investigation, tracing, cleanup, and enforcement. The city already requires land disturbance permits for most construction activities, and this ordinance will authorize staff to enforce storm water pollution prevention [clears throat] requirements on behalf of the Missouri DNR. Concerns regarding active construction sites should be reported through the city's report aer problem feature on the website. Next slide. MCM number five. In 2028, the city will hit a third planned milestone in its storm water plan development. This milestone will be to adopt a post construction water quality design criteria ordinance. The ordinance will require a maintenance and inspection program of water quality facilities for owners, private owners and the city maintenance agreements and enforcement. Our city code currently does not require water quality design criteria for development. This new ordinance will likely adopt u mark and APWA best management practices for storm water quality. This ordinance will also require the city to maintain an inventory of private storm water facilities. Next slide. Um to address the last MCM MCM number six, yearly training is being developed for city staff regarding preventative measures. One of those measures actively being developed is the city's response to Missouri DNR audit findings at the city's composting area where I designed a containment BM that will that was accepted by DNR in December. These operating plans are part of improving city staff awareness for storm water maintenance and mitigating illicit discharges. So with that, that concludes this annual

Okay. Looks like I am starting out. So, this is the um well, first of all, good evening again, and I'm happy to share the city city hall Q3 update for fiscal year 2026. City Hall includes legal, administrative services, human resources, communications, economic development, finance, and IT. And together, these teams support every department keeping city operations running smoothly. Before diving into initiatives, there's a few key metrics from this quarter that are on the slide. Um, finance onboarded three new employees, processed [laughter] 510 payroll checks and 985 accounts payable checks, issued more than 11,500 utility bills, representing just under 68 million gallons of water sold, issued 11 business licenses, renewed four, and processed seven delinquent water shut offs. Across city hall, staff completed just over 39 hours of professional training and logged just over 15 hours of overtime. when we closed the quarter with budget to actual operating expenses at 72.5%. This quarter, city hall advanced a wide range of operational, organizational, and community focused initiatives. We developed the proposed fiscal year 27 budget and created a consolidated schedule of fees to improve transparency and accessibility. Staff finalized and presented the fiscal year 25 audit and completed a comprehensive utility rate study. Operational improvements included refining the business licensing process with a new online application op option, completing all W2s and 1099s and enrolling employees in 2026 health benefits. We also continued building a formal onboarding process through staff input and cross departmental collaboration. Preparations for the World Cup remain underway, including coordination and communication efforts

Thank you. I am reporting for Shannon Smith, um our one full-time employee for the municipal court. Um we also get assistance from Jeremiah Gartney. Um he assists Shannon on court nights as well as taking payments whenever she is away from her office due to sick or whatever reason. um they had no overtime in the third quarter and their budget to actual spending was at 66%. Um again this is through December 31st. Um in the third quarter they had 367 new cases filed. They held six court sessions with a total of 1,361 cases on the docket for those sessions. And of those, 71 were dismissed and 379 um were pled guilty. Revenue, they collected $37,5 in fines and $3,940 in clerk fees with $11,890 in bonds and $1,100 of that forfeited to the city. They issued 160 warrants and recalled 87. and they issued 137 summons. Um, an other highlight for the porter, um, with the help of their party school district intern Natalie, they started cataloging closed cases for record retention and instruction. Um, those include all cases closed over the past 20 plus years. So this is going to be a large time-consuming project, but they are hoping that it will be completed by the end of calendar year 26

Community development David Pavich community development director speak on behalf of that department. Um, this past quarter we issued 51 building permits at $2.5 million investment compared to 36 permits with over $6 million of investment last year. So, our permits went up, the investment went down. Reason for that is we saw a lot of permits for fences and decks and re-roofs, especially this past uh quarter and this year. Um, we did however perform 412 inspections, which is up 7% over the same time period last year. In code compliance, we investigated 99 code compliance issues, almost 50% more than we did the same time last year. Reason for that was uh Kathy, our code compliance officer, was part-time for the city until December of last year. So now she's full-time all the time. So we expect an increase [clears throat] as a result of that. On animal control, we issued 82 dog licenses last quarter, which is almost three times as many as we did the previous year, and we responded to 58 dog calls, about three times as many as we did the same time last year. 90% of the dogs that we pick up are returned home within 24 hours. So, we don't hold dogs very long because we have an idea who they are and where they belong. And so, we get them home as quickly as possible. And we processed seven planning and zoning submitts during the quarter which included the AutoZone site plan, cell tower along Jesse James Farm Road and code amendments related to short-term rentals and the use of sidewalks downtown for outdoor merchandise display and what we're going to see in the coming months. Uh we're going to see a lot of construction. I think that's what we'll see. So auto we expect to issue permits for Autozone Chipotle Hoffman Custom Homes building and innovation Mr. Bell's expansion, the new cell tower along Jesse James Farm Road, um probably

Um, some of the metrics that I'd like to point out, um, up on our board up here, uh, comparing the same quarter last year to this quarter, we had a couple of, uh, uh, metrics that went down and, and I have an explanation for that. Our citations went from 495 to 383. Our traffic stops went from 1,52 to 939. These correlate with the our calls for service which were about a 500 more this quarter than they were uh in the previous quarter last year, same quarter last year, I'm sorry. Um and then um anytime you have that that big of a increase in calls for service, we also have a big increase in reports. Uh 311 to 252 arrests, 102 arrests versus 67 uh this time last third quarter, uh we had 41 crashes compared to 29. And then our detectives investigated 61 cases this quarter as opposed to 41. So, it's kind of a trade-off when you have uh guys that are out on calls and and making um proactive cases and everything. You're uh not going to have as much time to write tickets, I guess. So, and we also uh when we talk about traffic stops um that's going to be down a little bit as well. It's just what we only have so many people to do this and we're busy. We're busy. So, um some of the topics I wanted to bring up real quick. Uh we had five pursuits with uh c custody felony charges filed. We had five impaired drivers that were arrested and removed from the streets. Uh we uh completed our shop with a cop which was a huge uh effort on a lot of people's parts. Uh not to mention the fundraising

efforts that we do prior to that. We brought 37 kids to shop this year. Um and uh made a really good great Christmas for them. It's a a lot of fun and a lot of folks from uh city hall staff also helped us out on that day. It was great great community effort. Um we participated in the donkey basketball game. I don't think anybody got hurt um that I heard about uh um we increased our social media traffic getting our name and positive image out there even more. Um, one of the posts that we posted about the fundraising efforts that our officers did for our Shop of the Cop involved a Nerf gun war at one of the local u uh martial arts places. It got over a million hits, which is crazy. We got phone calls from Connecticut, Montana, all over the country from police departments saying, "How did you guys do that?" and and we were able to kind of brag a little bit that we you know we went out in the community and we kind of partnered with these guys and went out and had some fun and and with the kids and and parents liked it too. So they they're all in and I think we should have named it after Carney I think somehow but we we just shared what we had so it was pretty cool. Um uh we have uh we're also looking forward uh we've been teaming up with Carney High School with some interns uh that have been coming in and helping us out a little bit. Uh we have two officers that we're proud that were awarded the culture champion awards for saving the driver of a tractor trailer on the interstate that had, believe it or not, been bitten by a spider and had gone septic. Is that I'm saying that word correct? Sepsis. I [clears throat] always mess it up. um and he was about to die. Um we were able to recognize that he was not intoxicated even though he was driving as if he were intoxicated. We were able to catch him, get him stopped and get him some medical

They share uh also a th000 hours during the fiscal year and they also uh did not have any hours this quarter and those hours are complete for this fiscal year. We had no overtime in the third quarter and we stand at 75.8% um at the end of the third quarter. We had 42 hours of mowing during the months of October and November. Um, we still collected 276 trash bags in the parks and along the trail at the pet way stations. Uh, we removed eight trees um by park staff along the trail and out at the amphitheater. Uh, we had six playground inspections during uh this time and we had a couple of incidents of vandalism. We don't like those, but uh we did have two of them resulting in 12 hours of cleanup and repair. Um had a great fall season regarding sporting activities. 700 participants um were were there. Uh most of those were being pickle ball, but we um also offered a new T-ball league. shelter reservations naturally gone one uh way down during the cold months, but we still had a few. Um we had one community event that we helped out with um the October Fest event in Lions Park and we continue to offer training hours to staff and those were at 20. Looking ahead, uh we're selecting our fitness um equipment vendor for the Hall Park

Um Lauren Snider, I'm going to cover the public works report for Sher Daniel. Um the city hall public works team has five full-time employees. We ended the third quarter with our budget to actual at 75.2% had no overtime hours and logged 142 training hours. We delivered 70 solid waste containers and we had no additional grant awards this quarter. We did map 19,779 data points and had 12,272 views our GIS database. We currently manage 24 active projects and issued four right-of-way permits. Those 24 active projects are in various stages ranging from planning, design, and construction to project closeout. Uh during the third quarter, we successfully bid the water treatment plant filter media project and completed the basin 5 infiltration project. The new water tower along I35 was placed into service with just the lighting and demolition to be completed in the in the next quarter. Next, um in the third quarter, we had six employees in our streets department. We completed 19,300 lineal feet of crack sealing with 2.27 tons of asphalt patching, no overlay operations, and had a pavement condition index of 58.9. Staff completed 16 hours of street sweeping, 276 hours of roadway beautifification, 30 lineal feet of ditch repair, and 74 hours of mowing. Staff completed 91 square ft of sidewalks and 40 lineal feet of curb replacement. We responded to two weather events. Um, no storm pipe cleaning was done, but we did replace 80 lineal feet of storm piping. Street department budget to actual is at 56.6% 6% with 41 overtime hours and 35 hours of training. In the next quarter, as weather improves, crews will be begin mowing operations, sidewalk replacements will

ramp up, and we'll also continue patching pavement. [clears throat] For the water department, we had eight employees in the third quarter. There were no there were no water breaks and we performed seven water shut offs and completed six water taps. The department treated 64 million gallons of raw water, sold 67 million gallons of water, and purchased 19 million gallons of water. The plant operated 1340 hours, uh performed 8,290 treatment tests, 66 distribution tests, and flushed 51 hydrants. Staff investigated 456 locate tickets to replace 13 meters, no mains, and operated 28 valves. The water park department had a budget to actual 66.7% um with 26.5 overtime hours and 35 training hours. In the next quarter, the plant will have two filter basins out of service while we replace that filter media. Um and then we will also be bidding the water main replacements along [clears throat] Clark Street. That going out here in the next quarter. Next slide. the wastewater department in the third quarter, the sewer department was having issues with our um measuring equipment. So, our metrics reflect the fact that we know that our total flow was not accurate. The flow meter at the plant was measuring a higher amount than our pumps were running, but we knew that we were running at our normal amounts. Um, we fixed this issue by recalibrating the system. Um, and then we UV treated 37 million gallons of water and processed 186 dry tons of sludge. Staff performed 70 lid inspections, 1,038 tests, 60 lift station inspections with with no lift station clogs. Budget to
