Thank you. Please be seated. [clears throat] I'd like to say thank you for all those that uh that came out tonight for the plan and zoning commission meeting. Thank you for all the uh everyone here on the day here just kind of hanging out with us. We appreciate you for being here. Um so first I'll open up for the approving the minutes from from Tuesday October 28th. Open the floor for that motion with one amendment to make make sure I was noted that I was present to notate that you were present. Uh, correct. Please be advised the plan and zoning commission is an advisory board that makes recommendation to the city council. Honor approvals are granted by the city council. Thank you, chairman. This is an application for a conditional use permit and site plan approval to operate a gas station and convenience store. This is a change of business ownership only. Due to the sale of alcoholic beverages, the conditional use permit could not be administratively approved and was subject to be excuse me was subject to be presented to the planning and zoning commission for review and recommendation. There are no proposed changes to the existing site and it appears the new business owner intends to operate the gas station and convenience store in the same manner as the previous owner except the hours of operation proposed are reduced in comparison to the previous business. The previous business days and hours were Monday through Saturday 6:00 a.m. to 1:30 a.m. and Sunday from 7:00 a.m. to 12:00 a.m. The proposed business days and hours are 7 days a week from 6:00 a.m. to 12:00 a.m. That's all I have.

Yeah, as Katie said, um this is probably one that would have otherwise been administratively approved, but because of uh part of the nature of the business, including alcohol, it has to come through this uh body and then through the city council. So, if you look at the conditional use itself, um there is a requirement that they maintain, you know, their liquor lensure, uh as we've been doing with people that sell liquor. Now, um other than that, uh there were variances that we flagged in the staff report. Um those just need to be applied for and received with

Thank you, chairman. This is an application to amend an existing conditional use permit. The original conditional use permit was approved with a specific condition that all vehicles that were left on site overnight must be kept behind the front building line. It is my understanding through discussion with the business owner who is also the property owner due to COVID. In part, it takes longer to get needed parts to fix the vehicles than it than it did prior to co. Therefore, the number of vehicles on the lot has increased over the years and it has become difficult to restrict the vehicles to only being placed behind the front building line. I have nothing further at this time. Thank you, Katie. Special counsel.

Uh I I don't know in terms of other automotive repair if it's I think it's usually typically behind the building line, but this is why there'd be a special kind of allowance for that. I I just have a question. Um, with your request, have you taken in consideration what kind of plans do you have for extra security for your um I can't even think right now. It's been a rough day. It's [laughter] all right. It's been a rough week. Students being and it's only Tuesday. Yeah. Um, have you what kind of considerations do you have for the safety of your property? And you haven't had any issues. Okay. Um, just trying to [clears throat] keep it, you know, more presentation up front. You know, some sometimes you get um not so good-looking vehicles, you know, like
um, you know, I file vehicles to I mean, vehicles get ate up really fast. So, that some of those look kind of not so good. Try to put those around back just to make it a little bit more pleasant. presentable. But outside of that, I mean, we've got a um you know, I really stay on track trying to keep good technicians in. Quality of work stays up and I get a customers from all over literally leoo chfield and so just uh just trying to keep workflow going on top of parts on top of just [clears throat] do what we've always been known for. If you could just kind of favor the back as best as you can because I think you know the reason we're here that there are just folks who are uh upset about a lot of things in life and one of those they drive down the street and they just don't want to see a bunch of vehicles there. So full access to everything, but if you can just kind of use those back spots first, we'd appreciate it. Y Mr. Chairman Dave, I told you privately and I want to say it in public. As a car [clears throat] guy, your business comes highly recommended and you're you're a good addition to the city of Overland. Your reputation is stellar. Thank you. Thank you, Ken.
We try to do our best um as far as, you know, like we just did Overland PD vehicle. It took us four weeks to get a part for their vehicle park and a lot of these parts today, we cannot get them other than a dealership. I had a Dodge Ram. It literally took me literally six months with no ETA and it just shows up. This is the problems we're having. And with some of the tariffs, it's actually kind of getting a little bit worse currently. I mean, it was kind of bad, but it's getting even worse. Just getting the parts in. [clears throat] So, we do our best to keep it looking good. And a lot of cases, I'll send the car back when parts show up, we'll come up, you get it back. But we flip probably 10 or 15 cars a day minimum. On top of the major diagnostics, the troubleshooting the computer stuff that we're not just oil change and brakes, we literally I I do circuit board work on the computers in these cars. I'm repairing cars for a lot less than what dealers want them for. And I'm getting cars from the dealer all the time just because they don't have time to do them,
you know, time and the parts are they say they're not there and I'm repairing them that the customer can actually get a car back on the road versus well, we can't fix your car. And to me, that's what we strive for. You're certainly outgrowing the little building at Whismer and Lackland. [clears throat] Yes, you're very much. Thank you, Kim. Thank you, chairman. This is an application for a conditional use permit and site plan approval for a construction contractor's office. The plan review revealed that the site does not meet the current zoning requirements due to front and sideyard setbacks, screening and landscaping, as well as not having sufficient parking. [clears throat] I wanted to point out the four parking stalls indicated on the site plan are at the incorrect angle. if they were coming in to enter off of the alleyway. Access to the parking stalls would have to be gained by entering the neighboring property. Um, the previous business that was located, Top Tree Service, vacated this site and terminated their business license in 2015. Therefore, the site has lost any continuing nonconformity to the code. The applicants were notified of the need, you know, of the the site deficiencies. They're in process of trying to apply for necessary variances to um help that site come into compliance. That's all I have.

So, again, other than the um the variances, I mean, this is essentially a building that's been in use that they're trying to continue productive use of it and we're just trying to clean up the variance issues where we see them. So, uh, on your letter of intent for March 27th, you indicated you need space for three pickups and two dump trailers.
Uh, no, not uh the only thing that So, uh, the only time that there be cars in the parking lot will be during office hours, uh, Monday to Friday from 9:00 to 5. And then there's only two vehicles there. We store any equipment, any pump trailers. Uh pretty much we buy the materials from uh the warehouse and the materials get sent to home office. Okay. Yeah, because you sent a revised letter. I just wanted to make sure you had space for the trucks and dump trailers elsewhere. There's not enough not enough space back there.
