Welcome to North Bay Village's Code Enforcement Hearing. This hearing is conducted pursuant to Chapter 162 of the Florida Statute. Formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern the proceedings. I will hear testimony from the code inspector and alleged violator that I deem competent and relevant. All witnesses and parties offering testimony must be sworn in. The village will present its case first, including the presentation of photographs, reports and other documents. And the alleged violator will have an opportunity to examine all the documents presented at the hearing, as well as to cross-examine the religious witnesses. At the conclusion of the presentation, I will announce a decision and issue a written order thereafter. If you are found guilty of the violation, you'll be ordered to comply with the code within a certain time. If you do not do so, you may be fined up to $250 per day for the first violation and $500 for repeat violations. If you desire to appeal my order, you may do so by filing a notice of appeal with the clerk of courts at Miami-Dade County. You will have 30 days within which to do so. This case was before you last hearing, May 22nd, in which you ordered the property, obtained their business tax receipt as soon as they could, and for the property to begin accumulating daily fines of $250 per day. And they were also ordered to return back for this hearing for a status report. Since then, Mr. Cordero and the building manager are working on getting the paperwork for their business tax receipt. The only document missing is the fire inspection. So once they have that, we can submit to DERM and they can get the CU approval so we can move forward and issue the license. At this point, Your Honor, our recommendation is for them to comply with this violation as soon as they can. Fines of $250 per day have been running since May 22, 2025. Total 36 days for $9,000. We'd ask for the fines to continue and for the property to return for status report next hearing. Usually, Mr. Richmond is online for this case. I do not see him this afternoon.

Good afternoon, Maria Tovar, Code Enforcement Officer. This is the new case. On December 6, 2024, around 4.45 p.m., I found this property doing work. They had several trucks with heavy equipment blocking the street, like they were ready to do a big demolition. I spoke to the contractor in charge. And he stated that they were only doing landscaping, putting some trees so they only can park. I explained to him that if he was doing a driveway, the apartment was required for that work. But he insisted it was only landscaping and he would be finished by five. On January 28th, 2025, I noticed the facade of the house had been changed, doors and side windows were replaced, and the driveway was enlarged. The property was cited for the work commenced without a required permit for the entrance door, side window replaced, the driveway enlarged. A $250 citation was given. The citation was paid on April 4. And I have been in communication with the owner, and ever since then, they have obtained two permits for the window and the door. For the record, permit number BLDR-000115-2025. and permit number BLDR-000105-2025. But they have not submitted any permit for the driveway. So we are recommending that they obtain the necessary permit to comply with the violations for the property to start accumulating $250 per day until they come into compliance and for the property to come back as needed at the next year.

When I told him that he needed to pull a permit, he couldn't find the guys to pull the permit before the work that was already done. and he already paid him.

Your Honor, this case was also before you last hearing, May 22nd, where the property was ordered to go ahead and obtain those permits for the repairs necessary to the exterior of the building. The property was ordered to begin accruing fines of $250 per day at that point, and they were asked to return for a status report. As an update, Mr. Diaz, the property manager who's here again this afternoon, has been able to submit a permit application. For the record, it is pending a building review, but that number is BLDR-000290-2025. So they're making great progress. And this permit is for the exterior concrete restoration. I spoke with Mr. Diaz this week again, and he advised that he was on vacation last week. However, he'll be resubmitting those documents to the building department, which I'm sure he's done already, so they could go ahead and begin the review process so we could get that permit issued and the work started. Our recommendation at this point is for the property to continue to accrue daily fines. At this point, they're at a total of 36 days, $9,000, and we'd like the property to return for a status report. On December 24, while inspecting a pile of construction debris on the right-of-way in front of the property, we noticed some working on the property. We contacted the owner, and he allowed us to inspect the outside of the property. The first thing observed was the metal roof on the south side. The roof extended all the way to the property lines, and the rear of the home, they had a screen porch with a kitchen, with a full kitchen. They also had a door leading to a laundry room. The owner admitted that it was done without a permit. On December 16, 2024, a $250 citation was given for commencing the work without the required permit. for the new kitchen and the rear, the porch, the roof, the electric and plumbing. Citation was paid, but no permit application has been submitted for the rest of the work. So we are recommending for the property to obtain the necessary permit to comply with the violation and to start accumulating the fines of $250 per day starting today until they come to comply and to come back at the next hearing for a salary report if needed.

On December 23, 2021, for the property manager for the observed property, Ms. Martha Santil, contacted our building clerk to verify that a permit that she had received from my property owner was actually in the system at the village. The building clerk was able to verify that we did not have that permit card in the system. So she contacted my department and we went to the property to investigate. Once I entered the apartment, I confirmed that two bathrooms were remodeled on the property. They were basically done. Just a few items were pending for the final touches. Case number for the record, the building department also filed a police report based that the permit card that was submitted to the property manager and to the village was actually forged. for the record that case number for the PD is 202400070129. At that point, I did issue a citation of $250 that was sent certified mail and also posted at the property. On May 2025, I did do a search of the records and saw that the property had not applied for any permits yet and that the violation remained outstanding. At that point, I did issue the notice to appear for today's hearing. Everything was sent to the property owners on file, certified mail posted at the property. This week, I did speak to the property owner, Ms. Jill, and she stated that her contractor is actually working on the plans now to submit to the city to go ahead and get those bathrooms legalized. It would be an after-the-fact permit. Her contractor, Mr. Denny, who was online today, She gave authority for him to speak on his behalf, and we have those records. He stated he would be at the village actually next week to submit for those permits. So our recommendation right now, Your Honor, is for the property to go ahead and comply with this violation as soon as they can, obtaining those permits. We'd ask that the property begin accruing fines of $250 per day beginning today until they have achieved compliance, and we'd like to see them back for a status report. Mr. Lopez is here.

So she makes sure that all her tenants send her a copy of their permit before they begin construction. She got a copy of the permit, but she went ahead and did her diligence and sent it to our building clerk to make sure that it was valid. Once our clerk analyzed the document she saw that there were various discrepancies for instance the permit was valid for eight months instead of six which is against building code the logo on the permit was old we had updated the permit with our new village logo little things like that we observed that and she and it wasn't in the system they actually the permit number on there was for an older permit um so she went ahead and alerted us um She filed the police report, asked for the building official's direction. And, you know, when I went to speak with the owner, she was kind of surprised that that was the case. It seems like maybe they presented it to her, you know, as a valid permit as well. So she let them proceed. Now, I don't know if Mr. Lopez has anything to do with that, was involved in that previous work, but it seems like he is the gentleman retained now to take care of it. But I'll let him speak on that.

And on that moment, I tell her, we need to do everything in order to get the permit, the right permit for the electrical plumbing and building.

So I spoke to the building official, and he did determine that for that kind of work, they needed to get a permit. So a citation was given to them for $250 for commencing that work without the required permit. Citation was paid. The owner has been trying to get the permit. They got all the documentation to submit a permit. And finally, yesterday, they were able to submit the permit application. For the record, permit process number PLDR-000316-2025. So they have submitted, but now it's in the process of review. And we are recommending to obtain the necessary permit to comply with that violation for the property to start accumulating $250 fine starting today until they come into compliance and to return to the next hearing.

While on the property addressing another matter, I observed that the building was doing some extensive work in the elevator room. At that point, I spoke to one of the crew members on site, and they confirmed that they did have Miami-Dade County elevator permits. However, the property did not obtain permits from the local municipality from North Bay Village to do the items on the elevator. Besides the controller and the hydraulic unit installed in all four buildings, also they had a mini split AC system installed to go ahead and keep those rooms cool. They did not have a permit for those. At that point, we moved forward with issuing a citation to each one of the folios because these four buildings, those were posted and mailed out, certified mail to each of the property representatives. Mr. Leonardo is on the board for the Master Association. We also made him aware of the violations. I communicated with Mr. Leonardo this week again, and he did indicate that American Elevator International was working on getting now these permits updated with the village. I did speak with Mr. Joel, who's online also today, and he did have one of his representatives actually come to the village and meet with our building clerk to make sure that he had all the proper documents so they could start moving forward with getting these permits. So it looks like they're moving along. Our recommendation at this point is for the property to comply with these violations as soon as they can. We'd ask for fines of $250 per day to commence on all the properties until they've achieved the compliance, and we'd like to see them back just for a status report next year.
