So we only have one item on the agenda this evening, and that's a study session to receive verbal testimony on the scope of issues to be addressed in the EIR for the proposed Kaiser Permanente San Rafael Hospital Modernization and Replacement Project. Can we have the presentation, please?

Absolutely. Christina Estadio, principal planner for the city of San Rafael. I just want to take a moment to give some brief introductions. We have several people who will be presenting this evening. Directly to my right is Sean Kennings, who is a consulting planner for the city of San Rafael. And we also have our team here from Environmental Science Associates, who is the environmental consulting firm that was selected by the city. The firm was selected through a competitive bid process. The contract was presented to city council several weeks ago. And their team is here to present as well. Tonight is a little different than our typical meetings. The purpose is for the public to provide feedback to the environment. to ensure that the draft EIR covers all the required topics. With that, I will pass it over to Sean.

Good evening, Chair, members of the Commission, Sean Kennings, LAK Associates. I'm going to give you a brief project introduction, go over the project description, then I'll hand it over to Jill Feichmeine, who is the project manager for ESA. So while the presentation is loading, as Christina explained, tonight is a scoping session for topics to be covered in the environmental impact report for the project. The purpose of the hearing, again, is to receive or to present the project from CEQA standpoint and to receive comments from the public. The ESA consultants will explain that topics and questions for tonight are supposed to be about the environmental issues and not about the merits of the project. ESA will explain the CEQA process. And just a real quick, even though it says direct staff to prepare the draft EIR, it's just basically to close the public hearing and to just say you acknowledge that we will be going forward with the environmental document. So the project area there is highlighted in yellow. It's the existing Kaiser Permanente San Rafael Hospital facility at 99 Monticello Road. It's about 26 acres. It has a general plan designation of office mixed use, and it has its own plan development PD 1566, which will be modified as part of the merits for the project review. uh... currently there's about forty eight hundred thousand four hundred eighty thousand square feet seven buildings uh... throughout the campus including parking structures and existing hospital building total about nine hundred forty six parking spaces And the existing hospital building, the low one-story, two-story in the middle there in the blue area was built in 1966. It does not meet the current seismic standards required by SB 1953. So as part of the project, Kaiser will be reviewing and your body will be reviewing and approving the proposed entitlements, including a planned development rezone, which would include a floor area ratio bonus, an exception for the building height, a major environmental and design review permit, and then reviewing the EIR and ultimately recommending certification by the city council. Kaiser themselves has to go through outside agency review, including the Department of Healthcare Access and Information, as well as OSHPD, which is the health and safety regulatory standards. The project before you is a three phase project. Phase one will be the demolition of the existing general services building. That's the original 1966 structure of a total 19,300 square feet. Phase two will be construction of the new 230,000 square foot hospital pedestrian connector parking reconfiguration generators utilities and landscaping and Then finally phase three a and B will be demolition of the existing hospital tower and then the final site improvements Phase three will also include decommissioning of the existing hospital building which is about take two to five years and then they will have a new drop-off and circulation area and So really quickly, the existing facility has, again, 480,000 square feet of medical center. The current hospital is about five stories, 80,000 square feet. the general services building is about 19 000 square feet currently there's 116 hospital beds 946 parking spaces there are five driveway ingress egress one on nova albion four on monticello and it has an far of 0.3 so the proposed project will replace about 230 000 square feet the new hospital will be six stories and 116 feet tall There will be 24 fewer hospital beds, which is something Kaiser calls right-sizing to bring it up to modern standards. There will be 23 less parking spaces and a total new construction of about 134,000 square feet. The building and all the facilities will be electric, electrified, and LEED-certified, meeting current development building standards. The building form and massing, again, six stories, 116 feet tall. It'll be step massing on the north elevation, which is the elevation facing the residential neighborhoods. Mechanical equipment on the roof will be screened. It'll be a composite metal panel facade, silver tones, with punched window glazing, and again, all electric LEED certified design. This is the existing site plan. If you can see on that, maybe you can't, but sort of on the far left side is the existing parking structure. To the east of that on the bottom hand is the hospital building there, kind of a rectangle at an angle, and it touches the facilities building that looks like kind of an O-shaped. And then to the far east is a medical office building. Phase one will be the demolition of the general services building there in the middle, including site improvements and other site demolition for construction management. Phase two will be complete reimagining, redevelopment of the hospital facility in the middle of the site. This is the proposed elevations. I have silver tones with Kaiser branded signage. This is an axonometric view of phase two, which is the hospital building there on the left, and then phase three where the original hospital building demolished with a new circulation and drop off area. And then here are a couple of renderings showing the building from Monticello looking southeast from the medical office building there in the bottom left corner. And then the two bird's eye views are after phase two completion with the old hospital building still existing. So tonight's meeting, is to go over the requirements for the California Environmental Quality Act. The city and the applicant have determined that an EIR is required for the project. As Christina mentioned, the city has contracted with ESA to prepare the environmental document, and I believe I will turn it over now to Jill to go over the CEQA process. Fantastic.

Thank You commissioners city staff members of public appreciate your time and attention here for this Kicking off a new EIR in the city, which is always exciting to seek with people like me So next slide please SO A LITTLE OVERVIEW OF WHAT I'M GOING TO BE PRESENTING, KIND OF THE PURPOSE OF CEQA AND THE EIR, A LITTLE GENERAL OVERVIEW OF THE CEQA PROCESS, THE PURPOSE OF THIS SCOPING MEETING, GOING TO RUN THROUGH THE ENVIRONMENTAL ISSUES, THE ENVIRONMENTAL REVIEW PROCESS, EIR PUBLIC PARTICIPATION OPPORTUNITIES, AND THEN A NICE WHAT IS A SUCCESSFUL SCOPING COMMENT OVERVIEW, AND THEN WE CAN TRANSITION INTO PUBLIC COMMENTS AFTER THAT. so um just a brief overview of the purpose of preparing an eir and steps in the er process um the um as uh sean said the city of san rafael is as the sequa lead agency for this uh project has concluded there is a reasonable possibility that aspects of the project could have a significant effect on the environment and therefore an environmental impact report is being prepared. And so the purpose of an EIR I'll shorten that to EIR from now on environmental impact report is to provide information and objective analysis to the public and the decision makers on the environmental consequences of a proposed project. So an EIR informs decision makers and the public of the project's potential environmental impacts. It engages the public in the environmental review process. It will disclose potential project impacts on the environment and avoid and or reduce potential impacts of the project with alternatives and or mitigation measures. Next slide, please. So these are kind of like the brief building blocks of an EIR, if you will. And we have highlighted the opportunities for public participation with those blue arrows pointing in there. SO FOR THIS PROJECT, A NOTICE OF PREPARATION IS CURRENTLY CIRCULATING AND COMMENTS MUST BE RECEIVED BY FRIDAY, MAY 29TH. IN ADDITION TO WRITTEN COMMENTS RECEIVED DURING THE NOP CIRCULATION, THE MEETING TODAY PROVIDES AN OPPORTUNITY FOR THE PUBLIC TO PROVIDE INPUT ON THE SCOPE OF THE DRAFT EIR. AND SO ONCE THE ANALYSIS IS COMPLETE, THE DRAFT EIR ITSELF WILL BE CIRCULATED FOR A 45-DAY PUBLIC REVIEW PERIOD AND AGENCIES, THE PUBLIC AND OTHERS MAY SUBMIT COMMENTS ON THE ANALYSIS IN THE DRAFT EIR TO THE CITY. SO THAT WOULD BE THE MIDDLE ARROW THERE, THE NEXT OPPORTUNITY FOR COMMENT DURING THE PUBLIC COMMENT PERIOD AND THAT IS FOCUSED ON THE ADEQUACY OF THE EIR ANALYSIS. UPON COMPLETION OF A DRAFT EIR, THE NEXT STEP IN THE ENVIRONMENTAL REVIEW PROCESS IS PREPARATION OF WRITTEN RESPONSES TO COMMENTS ON THE DRAFT EIR. THAT GETS FOLDED INTO WHAT IS CALLED A FINAL EIR. WHEN THE FINAL EIR IS PUBLISHED, THE CITY WILL HOLD ANOTHER PLANNING COMMISSION HEARING AND A CITY COUNCIL HEARING ON THE PROJECT. BEFORE PROJECT APPROVAL, THE FINAL EIR MUST BE CERTIFIED and certification of the EIR is basically the adoption of a resolution by the City Council that the EIR has been completed in compliance with the California Environmental Quality Act and that the final EIR reflects the lead agency's independent judgment and analysis. And so for your purposes, the final EIR will go before the Planning Commission for a recommendation to the City Council. OK, next slide, please. So the purpose of the scoping meeting today is to provide an overview of the environmental review process, which I just did, and receive comments from the public and agencies regarding the scope of the environmental document, including key environmental issues of concern, potential mitigation measures, potential alternatives for consideration. Basically, in short, what should we be looking at in the EIR? Next slide, please. So onto the environmental issues that are probable and currently being considered. The EIR will describe and analyze a number of environmental issues that may be affected by the project. The city will prepare an initial study to provide documentation to determine which of the proposed project's effects warrant a more detailed environmental analysis in an EIR. As required by CEQA, the EIR will further examine those issues identified in the initial study that could result in potentially significant effects, identify mitigation measures, and analyze whether the proposed mitigation measures would reduce the environmental effects to less than significant levels. The initial study will be published as an appendix to the draft EIR and will essentially the same part of the eir and the initial study and eir together will evaluate and disclose the environmental impacts of the project resulting from construction and operational activities will propose mitigation measures for impacts determined to be significant and identify potential cumulative cumulative impacts as well and so um as discussed in the notice of preparation for the project the key um probable environmental uh topics that are under consideration for review in the eir are aesthetics air quality cultural and tribal cultural resources greenhouse gas emissions land use and planning noise and vibration and transportation And the remainder of the topics are currently under consideration to be studied within the initial study. And so that would be agriculture and forestry resources, biological resources, energy, geology soils, and paleontological resources, hazards and hazardous materials, hydrology and water quality, mineral resources, population and housing, public services and recreation, utilities and service systems, and wildfire. So as you can see, a whole suite environmental issues that will be studied next slide please so here is an overview of the PRELIMINARY KIND OF TIMELINE FOR THIS ENVIRONMENTAL REVIEW PROCESS. SO THE NOTICE OF PREPARATION WAS PUBLISHED ON APRIL 24TH. THAT STEP'S DONE. THE BOLD ITEM, DRAFT EIR SCOPING SESSION, THAT IS TONIGHT'S MEETING WHERE WE'RE RECEIVING PUBLIC COMMENT. And just a reminder for all that the end of the NOP public scoping comment period will be May 29th. It's Friday at 5 p.m. And that is also detailed in the notice. technical analyses and so on and so forth that will be carried into the draft EIR, which is anticipated for publication in September. Then there will be another, as I mentioned earlier, draft EIR comment period where we will accept comments on the adequacy of the draft EIR analysis. And then that end of the comment period, probably somewhere in October range, and then likely publishing a response to comments on the draft EIR by the end of the year and have EIR certification hearings in the first quarter of 2027. And again, that's just a preliminary guess at this point. We'll assess as comments roll in, topics are actually analyzed for the actual schedule. Next slide, please. Okay, so again, just want to reiterate to everyone, the EIR public participation opportunities, because public engagement is a key part of the CEQA process. So again, speak at today's meeting. You can provide written scoping comments via mail or email to the planning department at the address and attention below. then later again in the process you can also provide comments on the draft EIR and you can also participate in the public hearings and comment during during those Next slide, please. Okay, so reminder, what is a scoping comment. So we're really looking for comments regarding the scope of the environmental document, including key environmental issues of concern, potential mitigation measures, and potential alternatives to consider for the project. MY NAME IS BARRY WENGER. I LIVE IN TERRA LINDA WITH MY WIFE AND SON MATTHEW. I'M A LICENSED CIVIL AND STRUCTURAL ENGINEER IN CALIFORNIA AS WELL AS A LEAD ACCREDITED PROFESSIONAL. I'M COMING HERE TONIGHT AS A FATHER. MY SON TURNS FOUR IN A FEW WEEKS AND HE'S GOING TO BE ATTENDING VALASITO ELEMENTARY SCHOOL WHICH IS ACROSS THE STREET FROM THE PROJECT SITE. MY CONCERN IS SPECIFIC TO AIR QUALITY AND THE DUST THAT WOULD BE CREATED DURING THE MOST CRITICAL STAGES OF CONSTRUCTION, SPECIFICALLY EXCAVATION OF THE FOUNDATIONS AS WELL AS DEMOLITION OF THAT OLD HOSPITAL AND HIS YEARS IN ELEMENTARY SCHOOL ARE GOING TO SPAN THESE PROJECT YEARS ALMOST PERFECTLY AND HE DOESN'T HAVE A CHOICE WHETHER HE'S THERE OR NOT. IT'S THE ONLY PUBLIC SCHOOL WE CAN SEND HIM TO AND THERE'S SOME PULMONARY ISSUES IN OUR FAMILY AND I DON'T WANT TO EXPOSE HIM TO THAT SO THAT'S WHY I'M HERE TONIGHT. JUST TO APPEAL THAT WHATEVER THE PROJECT CAN DO TO MINIMIZE THE the effects of those activities and ideally concentrate them during school breaks. If they can dig the basement over the summer, that's a huge win. If they can do any summer activities with the school at a different campus within the school district, they have three elementary schools and a middle school, that would be a huge win. If they can do work over breaks, water the soil, make sure that they're actually doing those activities and it is enforced. It's one thing to put something in a drawing. I've been in in the construction industry long enough to know that things don't always get followed so also having that enforcement aspect of like if we agree that this is what we're going to do holding them accountable and not just a slap on the wrist if they don't do it but know that it's not just it's dollars to them but they're actually little lungs across the street that that need that that clean air to be able to have recess outside and pe classes outside and be a child and have those experiences like we all have thank you thank you

And as you know right now, the Sears is being demolished and there's a lot more noise and vibration than we had anticipated from that. and I'm happy with the work that's gonna be done there but it's a lot more disturbing our rest and our family life than we expected and I'd like to ask that the commission consider not allowing the same thing to happen to the neighbors with what is going to happen with Kaiser. I noticed on the planned drawings that there were several buildings that were going to be done under a different project, and I was curious if those are going to be done during the same period that overall construction is doing, and if so, do we need to include that in the EIR?

So that's a good question. So the city staff is evaluating which projects and permits that Kaiser is proposing to make sure that they don't come in conflict to the EIR process. There's something very specific in the CEQA process called piecemealing. which means you can't, you know, for project activities, you can't submit project A and then later submit project B and expect those to be separate. They have to be combined as one consistent evaluation. So to that point, part of what our review of staff and ESA is to make sure that we understand the balance of what they're doing. And so anything that is not specific to an entitlement that falls under a building permit only, that that can be parsed out as building-specific issues versus something that needs an entitlement, a design review or an environmental design review permit, something that gets folded into the PD.

You can do either. We have all the professionals in the audience, so if there are... If there are comments on environmental topics of concern, air quality, we've gotten a number of comments about the bike path, things like that. So this is your opportunity to be heard. So I would use it.

Through the chair, can I go ahead and provide those comments? Okay. One is really making sure the EIR provides the use for the temporary exit and entrance, whether that is going to be construction or general public and have it be studied as such. We also, it would be good to see ANY IMPACTS ON CLOSING THE PEDESTRIAN WALKWAY BETWEEN MOB 2 AND THE HOSPITAL. THAT MAY REQUIRE PEOPLE ADDITIONAL CARS THAT ARE NOT LIKE TRAFFIC THAT'S NOT COMING FROM OUTSIDE. several trips within the actual property because a lot of people go from that one office building to the hospital and back and forth. So it might be two parking trips. The other comment I had was really clarifying Whether the seismic upgrades included the existing parking garage because I didn't actually see see any indication of that But I know we're trying to provide seismic updates to the entire site The other item that I would like to have included is Proposed location for construction parking and providing that those trips as part of the traffic study. And if, oh, sorry. It looks like in the project plans, phase two includes, or does not, phase two does not include exiting through the service entrance, and that's the only phase that includes not exiting, so if that is the case, just providing for that phase, how that's being handled. And then... confirming that the EIR will include anticipated user counts based on a reduction of beds and future use of the completing projects project because it looks like the program of the hospital is changing and I'm sure it's going to include it but it'd be good to kind of see that and then if we can include duration of excavation I know there are the health concerns and just knowing like how long that may take place And I know we don't have a construction schedule, but we may have like, you know, just like, um, basically, you know, at month at year two, we're going to be excavating during this time so that when we do get future comment and future requests, as we go through the EIR process, we can address that. And then, um, The other things I have are just really about how the project is presented by the architect or designer. And I can just write those in, basically so we can better evaluate the project in the future.

Sure, I have a couple of comments. One that jumped out at me was the utility system upgrades, sort of the extent. I think the EIR should look at what's the system in place now, especially with the additional impact that Northgate's taking on. I don't know anything about hospitals, but it seems like it's gonna be used a lot. So hopefully it's a good discussion on that. The traffic study and traffic analysis during construction. And then again, thinking about the impacts of Northgate in the work. The school comment was really interesting. That seems to be like, there's gonna be a lot of activity there. So I do hope that's considered and analyzed, whether it's a scheduling issue, timing issue, but something that I think could have an impact that should be looked at. And then regarding, Traffic and transportation, just sort of making sure we look at the public transportation. What's that like out there? What are the shuttles? There's a reduction in beds, but how is this traffic in that tight area going to be analyzed? So those are the big things that jumped out at me for the EIR scoping. I would add I'm kind of surprised there's not that much comment tonight. So I'm just going to re-echo great job, staff, of getting it out there. But I really hope we're getting this into the community because this, I don't live near it, but this is a big project. So I really do hope we get a lot of comments.

I have a couple things. My kids went to Valsito and Terralinda High School, so I do appreciate the dust. I did like the suggestion of if wind picks up, that's something that could affect the kids outside in the school, whether you're at the high school, sports. everyday activities, the younger kids, whether that's at Mark Day or at Valsito. So I think that would be a key for me. And then to see how we can best practices for dust and particle suppression would be one of my big ones. So the kids kind of thinking about them more in the three schools in that area.

I'd like to see, I don't know if it's possible, but more of an intersection analysis on level of service considering the sensitivity to our communities of traffic problems in the area and in addition to being Northgate. So that would be like Montecito Road, Noble Albion Way, Civic Center Drive, and Highway 101 ramps.

I literally just slid it in front of you this evening, so I didn't mean to, I wasn't trying to do that. But yes, if for some reason you can only attend partially or you have a conflict, you can still hear, you can still listen to this training. The other item is we're looking into the summer, so the regular meetings of the Planning Commission, as you all know, is second and fourth Tuesdays of the month. We have one current planning project that we anticipate will be for you sometime this summer, and we will have some advanced planning coming, more policy work, more code amendments. That agenda's a little harder to set due to the review times we need to have in-house. But if you know you're going away and you're going to be missing for one of those meetings or a couple of those meetings, please email us and let us know so we can make sure we have a quorum present and be able to do the city's business throughout the summer months.
