Uh greetings to everyone. Just want to let you know that we would like to have all cell phones silenced during the duration of the meeting. And there are exits, fire exits directly in front of us out the uh to my left and also to the right hand side in case we have an emergency. Welcome to another snowy meeting. Uh that seems to be what we normally have here and uh get used to it, but spring is right around the corner so hopefully uh at least that's what they tell us if you believe the meteorologists. I'd like to have some quick comments here. Um, one thing that I would like to announce is I'm going to be holding uh my first supervisor Saturday. Uh, that will be a time where I'm going to meet with the public uh at Kim's family diner up here on Burton Road and from 8 to 10 in the morning. And I'm going to try to do one of those every uh month on a Saturday, last Saturday of the month. And uh just allow towns people a chance to come in and talk to me. They might not get a chance to come in during the uh the week if they're working, so on and so forth. So, we're going to try our first one. I will buy the coffee. Uh the coffee is on me. So if you want not breakfast, okay? But I will buy the coffee. So please if you want to show up to uh talk things with me, I I would certainly love to. So uh that'll be this Saturday Kim's Diner at 8:00. All right, moving along. Um before we get into any further things here, uh there's an issue here with seating on the town board that's very petty, but anyway, I'd like to at least give you all an update where we are here. Uh, councelor um Hogan is um out of order on this and I have stated to her several times that she refuses to take the seat but she's been signed. So anyway, I would like to read to her and also enter into the meeting minutes uh the town law that says that I may assign those seats. The uh New York consolidated laws town law 63 presiding officer and rules of procedure uh updated current as of January 1st, 2024. The supervisor when present shall preside at the meetings of
the town board. Plain and simple. Let's take a look at Miriam Webster's definition of the word preside. The verb to exercise guidance, direction or control to occupy the place of authority. I am doing that as the uh town supervisor. I have asked her to move and she refuses. That should be noted. she again is out of order and this issue will be addressed one way or another and hopefully we can get it taken care of without going to the next step. So I just want to kind of get that all out there for those of you who have uh been following this. So okay so let's uh move ahead to public input. Each speaker has up to three minutes. Is there any uh town input that anybody would like to speak on any of tonight's agenda items? We look as though we we have some somebody come up. We didn't move the deis up. Uh oh. Well, we're going to have to have you go over there and speak. Your name and uh where uh your address, please.
Uh Mike Smith from uh Schneider Packaging Equipment. Is this proper to speak on that topic now or when it comes up? When it comes up for the public hearing. Okay. You're up here now. Okay. So, I just wanted to address uh the board and our neighbors. So, Schneider Packaging, we've been uh since 1970 a neighbor.
Wait. Okay. Under under. Okay. Public We actually held a public hearing, so it was closed. You're right. Technically, this was closed last week, but uh your your comments were received by the town board. So, we do have those comments, although we can't really um have you go further because the hearing was closed uh last meeting. He can still speak. He can still speak. He can still speak, but because the public hearing is closed, so he can speak now. Go ahead. Yeah, because it's an agenda item. Yep. Sorry for the confusion. Oh, sorry about that. Want to be clear.
Yeah. I just wanted to make sure that we address our neighbors concerns. Uh we did hear what the concerns were. There was uh a couple things with noise from uh what was perceived as a diesel generated refrigerator was in fact electric. It's something we don't typically do. Every once in a while when we're working on a customer that needs refrigerated product, we put that in the uh lot. Uh it was there for a couple months. That is something that the addition we're looking to put on if we do get the zone change would remedy because we could put product inside and not have to do that. I think the other one was traffic. The addition we're putting on would be probably 20 to 30 people that we're looking to expand uh into. All of our traffic is on Guy Young Road and we don't foresee 20 to 30 people being uh any nuisance for Guy Young Road, which is our entrance uh for any other the roads uh throughout the town. Uh and then I think the third one um got my notes. Hang on. Oh, trucks trucks parking overnight. That is something that we actually don't allow in our parking lot. So, uh that's it may have happened where they come in late and overnight. It's something if our neighbors could help us police that and let us know and I'd be certainly glad to give our neighbors our number or card so that as something like that comes up, we can make sure that we enforce the fact that they should not be spending the night in our lot because we don't allow that. But the other thing I just wanted to mention is, you know, we've been a neighbor for over 50 years. We support a lot of the local businesses. Uh you'll find, you know, we have 135 employees. You know, at any given day, they're at our restaurants, the shops in the area. Uh this expansion that we're doing, it is not going to be any work that we're not already doing. It's just as we grow, we want to be able to expand. We really want to keep the
business here in the, you know, Brewer and Cicero area. Uh we do have businesses in Virginia and Toronto. Um but this expansion we'd like to do here in New York. We've been given a New York grant to do it here. Uh as we move business from Montreal uh out of Canada into uh the United States. Uh our business does support local manufacturing throughout the United States. So really what we do is create packaging equipment. So we're an automation company using robotics. And uh if you go into, you know, the [clears throat] store, food, beverage, consumer goods, most of those, I won't say most of those, a lot of those uh businesses get packaged with the equipment that we make. So, uh just wanted to address that. And again, I would invite our neighbors if there's anything that we can do to continue being a good neighbor. We want to be a good neighbor to come see us and, you know, help us mitigate any any issues. So, all right. I think that's it.

Um, I can give the invoice number if we need it, but the mailbox anchors, if someone could give us some more insight on this, what mailboxes they are, they plow hits. It was $559.92. So, it's keeping some in storage for when some break. Okay. And how often do we do we do this? We we make this purchase for this many this weekly. Oh, okay.

The next one is uh the CNY polygraph on abstract number seven uh invoice number 260128. I'm just wondering there was an actual name on that polygraph and I was wondering if someone could give some insight on whether or not that name should be on there because it's public information, who it was, what it was for. Okay. Oh, for new hires. Okay. Okay. Is there um is there do you know if there's any law or anything that says we have to put the name in there? I just know that there's some there might be some HIPPA things because I know that the poly I don't know what this polygraph gained or grasped information wise. So, I just didn't know if there's a law that states we have to make the name public. Okay. Okay. Sure. For a new hire or something like that, I would feel more comfortable with that. But I know that's just one of five opinions. Um, the other one was uh number 3699083 miscellaneous stock um for $64641. I was just wondering what that was for if anyone knows
just says miscellaneous stock literally it. So that's why I was wondering what what that was for. The invoice number is 3699083. Trey, do you know? Uh, I mean, we process like at least 50 invoices a week, so I I would need like an account code or something. I could probably give you more information with that. Okay. Um, I can send you an email. But I'll be um I'll be abstaining my vote for abstract 7 just so until I get more information on that one. Abstract number eight. Uh there's two cell phone charges. One just says cell phones $729. Um, so there wasn't a specific department for that one at the top. Do you know? Uh, I believe the other ones had a department next to it and the first one didn't have any. Um, I mean they're all either parks. Um, I think there's a handful of police. Uh, highway has a couple.
Okay. I would just want more information on that one because one of them just said cell phones and it was the highest one. I believe that's coded as uh 3120, which would be the police department. So, do we have a That's correct. So, it's the police department. So, if we could just put that on there so that we know which department is which for the cell phones.
Um and then I noticed the zoning one was pretty high for 218. Who in zoning do we get gets cell phones? Is that okay? Okay. Um, the other one is January 2026, uh, bank courier. So, I was just wondering in regards to this, it seems a little bit old school to me in my opinion, um, because it was for $661.40. I guess I'm just wondering if a staff member can do this or um, why this is the policy. He's the tax department collects potentially hundreds of thousands of dollars a day and
in checks or cash. It's it's a mix. It can be checks, it can be cash, all sorts of things. Um for employee safety, we've for the last several years we've used a carrier service. It's insured and everything. Okay. [snorts] Chief, do you know if Camila does that? Do they still use a bank carrier? Do you know? Okay. Um, and how often is this done? Um, they're usually here daily. So, how long how often is this charge? I believe that's uh for a month. So, it's about $661.40 per month. Yep. For the bank career.
Okay. I guess maybe I would like to know exactly how much is cash and checks just in regards to safety. It might be a possible savings. That's all. Um, the other one is W AFMCS LLC. There's a charge for $4,948. Just wondering who this is. That's Wayne Freeman's company for his consulting.

I saw the tree removal uh that we had on abstract number seven of $4,825 and I said, "Well, obviously that's one heck of a lot of money to be putting forward in the tree." And I talked to Chris about this and it is a county contract and we're obligated to uh to pay that rate. So, um he he cleared that out for me. So, do we have any other uh discussion on this? not discussion, but procedurally I do know that uh councelor Hogan said uh she'd be abstaining from one of the abstracts. I just procedurally
you have to do both. We could I'm just offering it up. We could separate these or we can just do it as one. I don't
I say if councelor Hog is going to do one, I say we vote on them separately because she has an objection to one which may not be an objection to the other. So I say we we split them. I do have a couple of comments, not questions. Um, so I've been learning a lot, which I guess makes me dangerous in terms of uh what I do. Uh, I'm a CPA, so strong financial background, and that's one of the things that I think is vitally important. Um, so I am not questioning these expenses, but I guess this is more of a procedural matter behind the scenes that when the board passes a budget, it's appropriating those funds and it appropriates a certain amount for all these different lines. Those lines should not be exceeded unless the board makes an action to move funds from one line to another uh to cover those costs. So, in reference, just a couple of items here that I just want to bring to people's attention and we can start behind the scenes working on catching these rather than usually I think what happens is a lot of true-ups happen at the end of the year. And I think it's better for fiscal responsibility and internal controls to stay on top of that progressively throughout the year. So, in regards to that uh tree removal, that was one that jumped out at me. Um, I looked at the budget code line for that, which is under summer solid waste disposal. There's only $500 budgeted to that line. So, what we would need to do is just do a budget mod to
what?
Well, then maybe it's at the wrong budget code. So, I guess that's the other thing is, you know, looking at the accuracy of where things are being budgeted. So, again, not questioning the expense, just was it coded to the right place? And if it was, we probably should do a budget mod to to make a move. Um, one other one I noticed uh was for the police department portraits for officers. Um, $1,200 for portraits. Unfortunately, $0 was budgeted to that line. So, again, I know it's something we do. I think it's a great thing. Just need to either, again, maybe it's in the wrong line or it's a budget mod. Um, but I'll be kind of checking on these things just to little by little kind of push it in the direction of of the uh expected procedural from the state on how we handle our finances and monitor and and control our budget. So, those are my only comments at this time.

This is to cover the portion of parks laborers payroll utilized for buildings and grounds work at the town hall. Do we have a second? I will second. We'll have discussion.
Only comment here is and this was something that I requested. Uh beyond the budget code, there are account descriptions showing here now which I think is fantastic. Um because for even me if I unless I look up the code I have no idea what budget line it's coming from. So I think this is great for transparency to know that we're moving 10 grand from contractual town hall over to a payroll line for facilities in the town hall. So uh I think that's that's awesome. Jamie. Uh we have a discussion on this. We're hoping to keep that bus alive for a while. Uh that was our original thing. Um uh Tony could not be here today and he you know had asked that uh we just kind of say that we're trying to keep the thing going because we have put in for a new bus and we have been granted a new bus. That's going to take a little while for us to get that money from the state. So, right now for the uh the senior center bus, we're going to have to kind of uh you know, duct tape and bailing wire to get that thing going till we can get the new bus. Move for the adoption of a resolution to approve the appropriation of $75,000 of B fund balance to new budget code 002-3120-40000-00001 police department contractual general municipal law 72C. This amount was budgeted in 2025 for police cadet recruit training and was expected to be obligated and encumbered for police lateral transfer bonuses and related GML 72C payments to agencies that train them to be carried into 2026. However, no obligations were incurred by the end of 2025. Thus, the legal incumbrance was not possible. The police department is expecting additional retirements this year and will likely need to pursue additional lateral transfers to maintain staffing. Do we have discussion? I would like I'm sorry. Yeah, I I talked with the chief this afternoon and this was something where they had to spend none of this money in 2025. So, there was a hope to just roll it forward to 2026. Unfortunately, again, technicalitywise, you can't just roll it forward. Um, and we weren't able to encumber it. So this is just to correct that and get that money appropriated appropriately. Well, here's alliteration for this year. Um, so yeah, any other discussion? I will say I also had some questions on this, but I knew the counselor Daniel was going to talk to chief and chief said they had cleared this all up and and we got the explanation, so I was fine with it as well. Okay, we move into findings seeker and decision Roland J and Luan Burke 6668 and 6674 State Route 31 tax map numbers 061.01-15 um.1 and 061.01-515.2 two proposed zone change from agricultural to general commercial plus. So I'm going to read uh the findings in the matter the secret decision in the matter of the application of Roland J and Lann Burke for a zone change from agricultural to general contractual plus on lands located at 6668 and 6674 state Route 31. The Cisero Town Board, pursuant to article 8 of the New York State Environmental Conservation Law, hereby adopts a resolution declaring the town's action with regard to a proposed requested zone change from agricultural to general commercial plus for property located at 6668 and 6674 State Route 31. Tax map number 061.001-15.1 001-15.1 and 061-01-15.2 to accommodate two commercial buildings warehousing to be an an unlisted action for the purpose of seeker compliance. The proposed project has filed a short environmental review form. The town board has also heard and evaluated information from our town engineer and planning department has viewed the site all associated documentation including the recommendations of our planning board that the proposed action involves no other permit manning authorities outside the town state DOT and Anandaga County be it resolved by the board follows based on the foregoing and
examination of the EAF and the criteria contained in 6 NYCRR 617.7 Seven. The board makes the following determination with respect to the action. A, the proposed action zone change will not have a significant negative effect on the environment that cannot be mitigated. B, the town uh Cicero board hereby directs this decision to be filed with the town clerk. We have an update. Got it.
I was out of my order on this and I do apologize for that. So going to be reading the findings. All right. So the subject property under consideration consists of two parcels of underde this is the Burke um underdeveloped land totaling approximately 1.993 plus to minus acres of land locally located generally on state route 31 6668 and 6674. The property is currently zoned agricultural AG with mixed residential overlay. The parcel of land is currently vacant and unimproved with large portions of wetlands. The applicant is proposing a zone change from agricultural AG to general commercial plus to allow for the construction and development of warehousing and distribution facility. The surrounding area is a mix of commercial and residential land uses. In addition, the neighboring Northern Pines Golf Course and Northern Pines Meadows subdivision approved map filed 120. There is some agricultural uses in the area as well as the town highway garage. The map submitted with the zone change application was prepared by the applicant surveying firm Yuzi and Romans dated 1117 2025 shows the location of two proposed commercial buildings, one on each lot with a proposed building measuring approximately 72x36 ft. Public hearings conducted. The town of Cisero properly advertised and conducted public hearings on February 11th, 2026 addressing the applications for a zone change and associated issues. Minutes from the public hearings are available from the town clerk or on the town website. The applicant's consultant, Tim Koyer, explained the project and the request for warehousing needs for Route 11 businesses. No members of the public spoke at the public hearing, either in favor or against the proposal. The town planning board. The town of Cicero planning board conducted a review of the proposed
project and heard from both applicant and the public. On or about February 4th, 2026, the town planning board issued a recommendation against negative the proposed zone change. The planning board noted the proposed development and zone change designation does not fit with the town's comprehensive plan for the character of the area. Additional findings. This application for a zone change is properly classified as an unlisted action for the purpose of secure compliance. The applicant filed an environmental assist uh assessment short form for the project. The town board reviewed the EIF. Number two, the property is not served by public sewers and the applicant has not submitted evidence that an acceptable septic design at the property is viable. Number three, we acknowledge receipt of the GML recommendation report of the Anadaga County Planning Development OCB PB case Z2614. County Planning noted no significant significance adverse intercom community or countywide implications, but noted the proposed designation as commercial plus did not fit with the town goals of reserving this area for residential and agricultural uses. Four, we find the proposed development of the parcels into two separate buildings with separate driveways accessing Route 31 does not represent good planning. The town is consistently strive to combine access points and encourage ring road access where possible. We believe since the parcels share ownership, a joint driveway with only one curb cut to access Route 31 is preferred. We understand the curbcut access issue is also subject to site plan and New York State Department of Transportation review and permitting. We do not want to tacitly approve same. Number five, the general commercial plus district is
designed and intended to provide for no for a coexistence between commercial uses and light industrial uses. The area of the lots under consideration does not have significant light industrial uses and some of the allowable uses if the zone change is granted are not compatible with the area. Examples of allowable uses in GC plus that are not compatible could be parking lots, automotive repair facilities, garages as well as manufacturing and assembly plants. Number six, our comprehensive plan generals calls for the town to reserve this area of the town of future residential and agricultural uses. We believe the general commercial plus designation and its allowed uses are incompatible the town's vision as defined in the town comprehensive plan. A change of the parcel zoning to general commercial plus would allow the applicant to use the property in incompatible ways in the future. Number seven, we also find the proposed project with two large buildings fronting Route 31 does not allow for enough green space in the overall properties. Town of Cicero has been a consistent proponent of the preservation of open space. We find the proposed plan to be far too dense for the size of the subject parcels. Number eight, we find that the proposal does not fit with the mixed residential overday rules and regulations. conclusions. The town board hereby adopts these findings. There's a lot of unanswered questions. Uh the two entrance ways and all just didn't seem to be fitting in what we wanted to do. I do. I can't do it as written, unfortunately. All right. So, uh Chris, just so you know, Chris and I were both in radio at different times, so we uh we're used to these kind of things. And uh so, all right. So, here we go. Uh we are now moving on to the um binding secret decision. The Guy Young Road Schneider packaging applicant 5370 Guy Young Road LLC Schneider packaging type change in zone from agricultural to industrial property at 5370 Guy Young Road tax map number 115.01-06.1. The town of Cicero properly advertised and conducted public hearings on February 11th, 2026 addressing the applications for a zone change and associated issues. Minutes from the public hearings are available from the town clerk or on the town website. Some members of the public expressed the following concerns of note. Number one, noise and light increase. Diesel power, refrigeration, trailer in the driveway running cons uh constantly. Noise levels above the allowable decibel levels. Number two, truck traffic idling and lots when the packaging plant has shipping. Number three, the town received a letter from Gordon E. Perkins on behalf of neighbors opposed to the project. The letter was reviewed by the board and the objections contained therein are duly noted. We note most of the concerns raised in the letter involves site plan consideration that will be addressed by the town planning board if the zone change is approved. County Planning noted no significant adverse intercom community or countywide implications. Number three, we find the proposed change is compatible with the general nature of the area and an expansion of the existing zone. Number four, we find the proposed fits with the newly adopted comprehensive plan and our vision for Cicero. Number five, we take seriously the concerns raised by citizens and those contained in the letter made part of the record. We find the issues related to the diesel equipment and noise can be referred to our planning board or code office for mitigation. Conclusion, the town board hereby adopts these findings. And to be honest with you, I thought it was something that that could be done and if uh there's some issues uh they will be addressed. Um I was informed that, you know, some of the things that were in that report may not have been the way it was supposed to be and uh Schneider will be a good neighbor as they have been. They're a good employer and I think they've uh they've done well to answer the question. So, all right. So, I'm going to motion that we um approve the findings. Uh we have second. I was able to speak with the u actual property owner and they're very um engaged in wanting to respond to the resident's concerns with everything that's going on. And I also spoke with the um owners of Snider Packaging themselves and they were very open, you know, and and willing to do what they need to do. Um and I also was able to speak with some of the residents and they understand and they know they're a business and they're not against the business. There's just some issues that are occurring currently that they would like to see addressed which I believe the planning board can address, you know, during this. And um that's all. And I also looked at the property because with the the trees and stuff, as we know in central New York right now, unfortunately, we're going through a a tree issue where trees are dying left and right and there's a lot
of dead ash trees. So, I look at it within clearing those and if the planning board, you know, with our policies that we have, they add some trees, we're going to gain six years of growth on new trees, which will help versus letting, you know, seedlings and saplings grow, we're going to get further growth on trees. The Cicero Town Board, pursuant to article 8 of the New York State Environmental Conservation Law, hereby adopts a resolution declaring the town's actions with regard to a proposed requested zone change from agricultural to industrial for property located at 5370 Guy Young Road. Tax map number 115.01-06.1 to accommodate a planned expansion of the property as an unlisted action for the purpose of seeker compliance. The proposed project has filed a short environmental review form. The town board has also heard and evaluated information from our town engineer and planning department has viewed the site all associated with documentation including the recommendations of our planning board. The proposed action involves no other permit manning authorities outside the town, state DOT and Anadaga County. Be it resolved by the board as follows. Based upon the foregoing an examination of the EAF with supplements and the criteria contained in six NYCRR 617.7, the board makes the following determination with respect to the action. All right. Discussion on this. Um, yeah, I I um I also visited the property and walked around. I think this is a a positive thing and I I encourage communication on both sides. I think in terms of the concerns, we've heard them and I think they can be addressed by working together as neighbors and working with the planning board, all of the concerns can be mitigated and it can be beneficial to both parties. So, uh, I am in favor of this. Do we have additional discussion?
So, my concern is that there were quite a few neighbors who showed up to the last meeting to showcase their frustration with this business even currently um, where it stands right now. And so my concern is that it seems like there's some promising of changes for the noise after the zone change gets approved, whereas I feel as though it should be before. Um because it sounds like there's already quite a few concerns. So I'm just going to put that out there. I spoke with the owner and part of the one of the noise situations was with the refrigeration unit that resides outside in the because I did specifically ask about that. And with the new addition, they'll have the opportunity because it's it's not a gas powered, it's actually electric powered. They'll have the opportunity to move that inside the building if in the event they need to use that in the future, which will deaden the sound. So that I I totally understand where you're coming from, council Hogan.
Yeah, that's not where I'm coming from. There was just quite a few um neighbors who stood in support of against this. So although uh I come from a background of business and I really want uh new businesses to grow and stay in Cicero, it is concerning when we have a lot of these mixing of zones with residential and commercial. And I feel as though we need to prioritize our residents, our taxpayers. Question for council real quick. Um these concerns about sound and all that kind of stuff, the the planning board has the power to incorporate all of that into the site plan. Correct.
Most of those were site plan issues and issues of noise and so on. The planning department has enforcement that's in your findings. Yeah. Yes. Okay. So, so while I agree with the concern that, you know, it's kind of like it'd be nice to have asurances now, there still is a step that will enforce those insuranceances before the project can even continue to move forward. So, this is not a all right, free-for-all. There's still more procedural things that would have to take place. Great. Thank you.
Just to clarify though, that's for any new building. They don't have to go back and redact or change anything that's currently in existence. Correct. in terms of and issues like that. Those are all those are always the case. We have those those rules. They have to comply with the code.

I'm going to make a comment that since 1970 they've been a good neighbor, you know, and they're willing to become a better neighbor and we've seen it in the town of Cicero. I've been here 51 years. I don't remember all of them cuz I was too young at the time for some of them. But I do know that when you have neighbors and businesses in an area that are willing to do better versus the alternative because when the you know um business owner did speak, they do have other locations and is it worth the risk, you know, to have a business leave the area and get a new neighbor that may not want to be neighborly and comply. So sometimes we got to weigh our risk, but I'm in support of it.

I wasn't going to say anything, but uh when it comes to sound, um when I go doortodoor, there are people that complain about sound. This isn't specific to Schneider, just sound in general. I sound as Steve knows, it's it's it's difficult to to capture, right? It's tell people to record it right in in the moment. So like when the police go out, they can they can they can they can hear it. I I you know drive around there quite a bit. I was there twice last week. I the times I was there I can only speak on there wasn't much sound, right? Um but just just a general message to people that sound is difficult. Like try to record it. Like that's the biggest message that that I can send. But yeah, I was I was there and I didn't like I said, I was there multiple times last week. I was there this week and I didn't I didn't notice any sound that was that was, you know, out of the ordinary. So,

Okay. [clears throat] Presentation of the draft annual report and the draft storm water management program report SWMP in accordance with New York State DEECMS-4 permit requirements will take place at the February 25th, 2026 town board meeting. Hi everyone. Um I'm here for the presentation of the MS4 annual report. MS4 stands for municipal separate storm sewer systems. It's basically a permit to make sure that we as a town operate along with the other activities in the town um happening in the town that we have jurisdiction over without contributing to water pollution. Um it's basically a byproduct of the clean water act. Um if some may remember last year I announced that they there was a new permit. It was really the permit was updated in 2024 um to be much more stringent but it has the same goal which is to improve water quality and recreational use of waterways by reducing the discharge of pollutants to the maximum extent practicable. Um so there are six minimum control measures uh to help uh municipal municipalities achieve the permit goals. They they provide the strategies and metrics. So as I mentioned there's a lot more um new requirements. So they are phasing this permit in within five years. So each year pretty much there's new things that have to be added. We just completed year two. So that year had a lot that had to do uh deal with elicit discharge monitoring, location inspection, and track down. Um and I'll explain that a
little bit more further on. And then we also did a municipal municipal facilities inventory to show where all of our facilities where they drain to. We actually have 34 facilities in the town. um which was surprising, but when you add in we have 12 pump stations, six cemeteries, three park and rides, all of those are considered facilities. Um year three, we are beginning year three, which is going to be a pretty heavy lift. Some of that lift is going to be shared by the CNY storm water coalition. A lot is going to be for the municipal facilities program. So that's going to be working with the highway department, parks department, a lot of stuff. Um we are very lucky that we have a modern highway facility because just by the way it is designed, it takes care of a lot of the requirements. Um but now we have to put all the programs to paper. um the I think everybody pretty much operates correctly, but now we have to have it documented and training and all these other requirements that go along with it. So we'll start with MCM1, public education and outreach. And I always like to start with a map of the town of Cisro just to show the watersheds where everything goes. So the the northern part of the town uh goes into Anida Lake um mostly via maybe Wulmer Creek or other tributaries. The eastern part goes Cicero Swamp area goes into Chitnango Creek then into Onida Lake. The western part of town goes into the Onida River watershed which is for us it goes into Mud Creek first. So to us we think Mud Creek. Um then that little part of green at the southern part of the town is in the Anandaga lake wershed and that's significant. We're we're lucky we only have a little bit of the town in it. Um
it's a polluted everybody knows that it was polluted. There's a lot more requirements on what can be done um in that area. So it adds a lot more requirements to us just because we have a little bit more in that area. Um but most of these requirements for public education is taken care of by the CNY Stormwater Coalition. MCM2 is public involvement and participation. So one thing there's a hotline if anybody were to see something in storm water that they didn't think was right. Aquet provides a hotline number. That is also the same number you would call if you had a sewer backup. Um our local point of contact for storm water concerns is Steve Ricopio, director of codes enforcement. And then me as town engineer will be um taking comments for the draft annual report the storm water pro program plan and comments are welcome at any time um for that this presentation is part of that requirement of public involvement and participation. Also Tracy always does a wonderful Earth Day event. It happened for 2025 on April 26th and it's coming up this April 25th. So we just need a little more public involvement in that. [laughter] So um MCM3 is elicit discharge um monitoring, detection, and elimination. What an illicit discharge is is stuff that's not supposed to be in storm water. So if you were to see soap or oil or sewage, that would flag it and to where we'd have to go look to see it's been detected. Now we have to go find out track it down and then eliminate it. And that's where um codes department is involved in the elimination of it depending on who what the problem is.
MCM4 is construction site storm water runoff control. That's the one probably everyone's the most familiar with that. Um if it more than an acre of land is disturbed. A SWIP which is a storm water pollution prevention plan needs to be developed. Um it things go before the planning board, it's reviewed. Um there's pre-construction meetings. The developer is responsible for weekly or twice weekly inspections depending on the size of the project. Uh the codes department goes out once a month to verify that all that is um taking place correctly. Um and the town is tasked with inventorying all the active construction sites. Um we had 14 construction projects that were authorized. Only nine were active in 2025. Um there were five verbal warnings issued to a developer. Okay. MCM5 is post construction storm water management. That that's the facilities that we have that are built and now treating the um storm water in all the neighborhoods and different facilities. So there's publicly owned ones that we as the town are responsible for. We have 52 of them and there's 76 private ones within the town and the private property owner is responsible for inspecting and um maintaining those. But in year five, the town will be responsible to make sure private inspections and maintenance are are being are happening. So, we're going to have to follow up with every private owner to make sure that they have done their inspection. We might have to get the inspection in hand. So that's going to be probably a pretty heavy lift. Um but so that's coming.
Um MCM6, this is the storm water management for municipal operations. So this is the big one for us as operators for highway garage parks department. Um, like I said earlier, there's just a lot of writing that's going to have to happen and making sure we have all the um, procedures written down, SOPs and all that that we follow everything. But in general, because I'm there, pretty much everything I I mean, I observe it. I don't do it, but they it's pretty much set up pretty well at the um, highway department, which is really good. So the storm water annual report that goes into um DEEC actually it goes in twice a year. It's called an annual report but there's also an interim report that goes in in October and that's because we have a little bit of land in the Anadaga Lake wershed. So we have to do the twice a year. So that gets submitted electronically. There is a storm water management program plan that there's a copy in the codes office and there's a copy in my office. So, anybody is welcome to come look at those at any time and offer any comments. I will be submitting I will be taking comments on anything by March 13th if they have them now and then I'll be submitting the report. Um, so that's it. It's kind of dry, but um, thank you for your time.

The amount of public storm water facilities, 52 and then 76 private stormwater facilities that have to be that we have to make sure that they file these. I mean, is that going to be going through zoning or how's that work?
Um, we haven't tackled that yet. That's a year five thing and that we're just trying to keep up, but we'll figure it out. We've got to get the names. Um, we already have an inventory of all those facilities, but the one thing we need to add is who the owner is. They change hands a lot. So, that's that's one of the difficulties. So, getting that proper contact because it's not always the person who's right there. Um, so we will be tackling that. And actually, I might be retired by then, but someone will be tackling that. I think this is fantastic. Um, an audit um is a critical part of internal controls and making sure that a town is operating properly. I'm so glad to see that this is happening for a second year and um it's required because of the ARPA funding um which has kind of pushed us towards it. I hope that we are able to continue this in the future because it really does give u our residents assurance that things are being done and there are no material misstatements in our finances um and that there are appropriate internal controls around these things. And I'm also familiar with Bonado. They are a great auditing company. They have a lot of experience with municipalities. So, I think that's uh excellent that they're going to be doing that for us this year.

And be it further resolved that such payment shall be made from budget code 00231204000000001.

Uh you're going to be able to travel northbound on the South Bay Bridge, but you're not going to be able to travel south bay uh southbound on that bridge starting March 2nd. Uh, I contacted the DOT directly and talked with them and I was given a tentative date and again remember when you get a tentative date from the state of New York that the the T is capitalized for tentative and they gave me a tentative date of of May 15th that this will be done. So our fingers are crossed that we will be able to be traveling north and south on May 16th of this year. But we will we will see and um we're going to be meeting with the DOT on a regular basis and we will get updates on this. Trust me when I tell you, the town will know if if they're not going to hit their number, the town will know about this. We will definitely keep uh keep everyone uh in in the discussion. Okay. Uh I just wanted to add to that um the Association of Towns in um in conjunction with the uh New York State Office of the State Controller, they put on some really great training programs. Uh town finance school is coming up. I believe it's miday this year. Um I encourage everyone on the board, department heads, whoever wants to go to uh try and go to that. It's uh it's great for, you know, learning about all sorts of different aspects that you might not hear about otherwise.
I concur. Having gone to the training earlier with Council Daniel, I think it was fantastic. I learned a lot and I would recommend anybody consider going. You'll be better for the experience. Hi, Lance Hogan, 6128 Cut Drive, Cicero. A couple thoughts on the previous meetings. Um first of all, if a woman wants to sit in a particular seat, she should be allowed to do so. Period. She's the only female on the board. She's more tenure than the three new folks. She wants to sit next to the person that she ran with. All those are good enough reasons. It's the courteous thing to do. It's the right thing to do. It's the chivalous thing to do. I'll ask this. Have we forgotten how to treat a woman? And this is directed specifically at Councelor Partardee and Supervisor Sanuchi. I I was taught to give my seat up for a woman. Yeah, it's unfortunate that you guys weren't taught that as well. In fact, you did the opposite. You pointed your finger at her and demanded she move her seat. Do we also with everything that happened with the previous town supervisor and a female, do we think that this is the optimal course of action and your limited time on the board? I'll switch gears. In the previous few meetings, you guys have, and this is directed at councelor party and supervisor Sanucci, you've focused on controlling when the board can talk, when they can be quiet, when they should be silent, when they can discuss, and you've dis and you've focused on the seating several times. You including you guys running around in the back looking up rules on where people should sit. Um you you guys have shown that you're more interested in the control and the power than in doing a good job for this town. Like you don't need to control every single thing. You know, this is your job. Everyone here was elected by the people and works for the town. If you focus on doing a good job and doing the right thing, that's that's your part. Do your job. Last thing I'll say, um you know, for one, it's it's a it's a redeemable start for you two. It's a
poor start, but it's redeemable. I I got to say I don't have high hopes. Uh lastly, you know, Supervisor Sanushi, you did threaten my wife and you said there if you don't move, there will be issues. I'm happy to discuss those issues with you in the back on or off the record after this at your choosing. So, in the meantime, you know, if I were you two, I would choose my words more carefully when you address my wife or just in general. I think that'd be helpful for you, too. I would like to follow up on a couple of comments on that. Um I volunteered myself to run an election to become elected up here by the people. And this is a legislative body that operates under parliamentary procedure. And I took an oath in office to follow the the local laws and the state laws. And there is local law 63. And there's also open meeting laws. And I appreciate your comments. I'll take them into consideration, but by no means am I attacking any individual person. I'm just following the laws and doing what I, you know, was elected to do. Thank you.

I [clears throat] didn't really want to get involved with this um conversation. I'll be I'll be polite, but I think it's about time that people understand that it's the uh supervisor that decides who sits where. This isn't about you're a man or you're a woman, you're a kid or whatever you are. It's his decision. We've had women on boards with us. We had no problems when we asked them to sit in certain positions. Never. 16 years. Not one year, two years, three years. 16 years. If you look back in the records, you're going to find out that's the way it works. You, Mr. Supervisor, make that determination and nobody else. If they don't want to go by your determination, you have a right to ask them one, two, three times. I don't care how many times you ask them. If they refuse to do what you asked them to please do, you and you have all rights to make a decision through your attorney on what you do with that that situation. But I can't sit in the back of this room meeting after meeting and just sitting up here and looking at this mess. And I'm being polite when I say mess because after all the years I had the honor and you can sit there and look at me all you'd like. We never had anybody act the way some people on this board are acting. It's an embarrassment. You either take this job serious or decide to do something else in your
time. That's how it should work. But I'll leave that up to you, Mr. Supervisor. I'm out of this mess. I enjoyed it. I was here.
Thank you. Additional comments from the audience. Good evening. Judy Boy, Mosrap Bay. Um just to follow up first of all about the courier. Um few years ago when I was on the council uh there was an issue because the town trying to save money and doing the right thing uh they would take the money to the bank from the tax receiver or from courts. Um it was brought to our attention that that was totally unsafe and illegal. That is why a courier was hired and they are bonded to take the money. So whether it be daily when there's thousands of dollars or weekly when there's a few hundred, um there are several areas where there's money taken in. Clerks take money in in the courts and our tax receiver and sometimes in the zoning department. So that shouldn't be an issue and it's certainly not saving the town money. It is protecting the town. Um, let's talk about open meetings. The law, councelor Hogan, you may think it's cute with your smirk, but it isn't. You're sitting there to follow and do the procedure that you were elected to do during the meeting to pay attention
and when you vote you vote on something you don't even know what they're talking about. um reading the abstracts for the last two years, you read the abstract every single time for uh a resolution and you never commented on it for two years. Um I find it interesting now that you ask the questions at the meeting when the abstracts are posted. I read them all. I contact Trey when I have a question because it saves time and then if you have a comment or something after you spoke to him then you would bring it up. As far as sitting I have six years. I was the only female for those six years. I was elected. I made it a point to represent the people and not play musical chairs. I respected the supervisor's decision and everyone else on that board. Passing notes. Why didn't you pass a note to uh Chris or Jamie or even the supervisor? This has been going on since it started. I think along with Mr. Dazinski that it has to stop. I sat on the end where Jamie sits for six years. It didn't matter where the hell I sat during co we sat down below or we sat a far from everyone.
take this job seriously and first of all show up since you had over five meetings now in the past year and a half or year and three months two months so that you're here first of all to represent the people thank you thank you do we have any additional comments from the audience at this point before we close the meeting I'll take that as a no like Okay.
