But the the receipt and all the water hero replacement receipt are all received. The law director's recommendation [clears throat] was that the the man of the the water man broke and blocked up the basement flooded during that. So the recommendation was a full settlement of the $6783. Any committee member have comment?
Now I spoke with uh Tracy and and went over it. He did submit the sump pump uh receipt which was not included in the original uh claim and uh I'm in agreement with the law director's recommendation. I make a motion to accept the law director's office recommendation. Yes. [clears throat] approved.

Second. The next claim is claim number 13-05 1425 Robert Lambert of 845 Clifford road, Cliffwood Road Avenue, Zensville, Ohio. He was driving past through overpass down on Park Avenue West and uh a construction of somebody doing a Walker cleaning the road and a rock hit his car and it got some damage damage on the wheel and the windshield and the crack. They called into the department and they have the receipts and uh that confirmed that the damage did occur and [clears throat] in the in incident the city has actual liability for claim according to the law director's office. [snorts] After reviewing the photographs of the of the vehicle damage, the law director's office recommended a
settlement of $1,500 while he was asking for $5,9684. A comment. Um, so when you look at this, part of the problem is this happened in I believe it was October of 2023 and it the claim and Tracy if if uh if you want to step up maybe and answer any questions, but the claim was not made until was it May? I believe I have my notes 25
May 14th it was a city worker is my understanding that was using a weed whacker and there he did make a police report on the day that it happened. Um it was not turned into his insurance.
Is there anything that you'd like to add? uh he was he did turn in his claim, but it it took him several months to actually get in any type of receipts for that claim. So that's why it was so delayed his his filing it late and then also not giving any receipts or any kind of estimates for the damage to the vehicle. So [clears throat] based upon the receipt and the information that you have, that's why the recommendation for $1,500. Okay.
Based upon the photographs that were taken at the from the police department, I believe that it was it was a pack. Correct. Yes. the damage wasn't as extensive as the estimates were. Accept the recommendation of the law directors.
I make a motion that we accept the law director's uh recommendation to pay the $1,500 settlement. Second claim number 17-06. 6 0352 Dwayne Price of 261 Green Lawn Avenue, Mansfield, Ohio. And the claim incident is that uh [snorts] he he was driving making a right turn at the light on for 104 West First Street and a construction truck during the The street repair left a jagged piece of metal on the road and he ran over it. So he's claiming $57755 and he's taking this vehicle to t and submitted to receipt for two tires. whereas it was one tire that he reported that was punctured. So [snorts] the law director's office has let that the fee of replacing for one tire
is appropriate of $200 and the plug for $10 and $40 for tire mounting and balancing which brings us up to $250 will be the recommendation. Thank you. [snorts] I'm in agreement with uh with the law director's uh recommendation. So, I'll make a motion that uh we um approve the claim for $250.
Second. If I could chime in, I know that some of the folks um are here too um who have claims. So I thought I would just say that I saw Mr. Price here earlier.
Is Mr. Price here? Oh, do you have anything that you'd like to add, Mr. Price? Only thing I really have to add is the street repairs. Everywhere that you go in the city, everything is completely torn up.
And this was a brand new car that I just purchased, a 2025. So everywhere you go, it it didn't make sense to me. So, I knew it wasn't something that I personally did. But if you if you drive around in the city, you're going to see yourself every street, every alleyway, even the sidewalks. And now they're doing construction, tearing up people's yards to I don't know if they're digging up lines or what, but this is a definite issue in the city. And um I will add that we have no idea where that metal piece came from honestly. Um you know we spoke with the law director on this and uh Reo if you'd like to add anything but um you know we felt that to be fair with it that the settlement for the tire that was damaged in the plug and the balancing was acceptable.
Okay. Um because we didn't we didn't know where that come from. We do understand that there's a lot of construction and a lot of things everywhere. It's very possible. Um so we felt that that on his recommendation that we would accept that. So that was the reasoning behind it. Okay. But we need to keep in mind we're we're tearing up every street in Mansfield and everybody's got to travel these streets and it's not good. It's not for for everybody.
Yeah. Okay. We we know that uh the city is doing a lot of upgrading and in order to build you got to tear down first, right? So it's it's a pain, but it's a pain that we can live with for a little while. It's not going to be forever and we're I told was told a couple weeks ago it's going to be for the next two years before this construction project is even completed. I believe it's October of next year. Yeah, he's gonna get there. Be patient. [laughter] Okay. All right. Thank you. Thank you for your time.
Okay. The next one is claim number 22-071025 check up public and uh the claim is that the gutter was damaged when city was pinging a concrete pad. [clears throat] And as we looked at that, it was they were doing the canine, if I remember correctly, right? The canine um stop slab and then backed into his gutter,
brand new gutters, brand new gutter. So, and it was a city workers. So, there's no dispute in that. and it was asking for $9920.
I make a motion that we approve the claim for $99.20.
Second Claim number 23-07225. Jasmine Lewis not here right. Jasmine Lewis of 213 Shirley Avenue, apartment B, Mount Vernon, Ohio. claiming [clears throat] that she was driving down Main Street and saw a truck that was um spraying uh the salt on the road and it felt it was going fast as she was following behind and rock fell off and damaged her windshield. and she claimed she called into the office and there was a claim filed a report and she felt that the driver was going about 50 m an hour 135. That was why the rocks were flying out. And she called into the office and according to the report from the city worker, work order 42000 service request confirmed that city street department was plowing and
sorting on main street near road that day of the clam. If the citizen statement about truck speeding is correct, it's possible that the city may be actually liable. So law director's recommendation statement is to pay the claim the total of $264.96. Mr. troubleshoot.
Um, in discussing this claim, just to give a little background too, uh, we did confirm, the law director did confirm that that truck, C truck number was, uh, on that road at that time. And, um, it's it aligns to what she is claiming. And that is one reason the law director approved the claim at 20 his recommendation is to improve the repair uh for $265. Her insurance is her deductible a lot more than that.
So given that um we do know that that truck was in the area at that time and what happened it was the law director's recommendation to approve that and I so move that we do so. Second 264 96 approved. Next is claim number 25-2082525 Christoph Norris 21 261 Green Lawn Avenue Mansfield is here.

Okay. at on 8 1925 approximately at 300 p.m. He was driving a main street between First and Second Street where the construction is and there's a gravel road and he was says driving and the rock kick and kicked up and broke his window and shot out his glass. I you know I feel that we need to get a second estimate on this. Yeah,

The claim was that uh there was wall bridge and hole created for from uh cocoin construction that resulted in a large water infestation to your full basement floor flooding your basement. Okay. um I know the law director, we we spoke extensively on this and um Cosine made that cut. They are the contractor for the city. So it's their responsibility is the uh is how the law director believes they were the contractor for it. Even though they were doing it for the city, it was them that created that situation that project. Okay.
