Okay, Mayor and Commissioners, this is a meeting of the local planning agency. This meeting only has one item, which is 2A, which is a discussion and or action on amendments to the LDRs related to child care facilities.
Okay, thank you. good evening mayor vice mayor and commissioners this is an ordinance to amend the land development regulations regarding child daycare facilities and it has three components to it that I would just want to briefly describe the first is that the existing definition in the code is for child and adult daycare facilities and this ordinance is going to strike the reference to adults daycare and then align the definition with Florida statutes just to highlight a few elements of the definition it states that child day care facilities provide care to five or more children unrelated to the operator that care is provided on a regular basis for less than 24 hours a day and that a fee payment or grant is made to the operator the second component of the ordinance is that it establishes which zoning districts child day care facilities are permissible The ordinance proposes that child day care facilities be a permitted use in the community facilities and recreation open space districts. And then proposes that the use be a conditional use, which requires review and approval by the city commission in the RMF to be one business overlay and TCD districts. Finally, the last component is that this ordinance aligns the physical requirements with Miami-Dade County's ordinance because the county's ordinance preempts municipalities from adopting physical standards that are more or less stringent than theirs. So the ordinance makes reference to Miami-Dade County Code of Ordinances Chapter 33, Article XA. The standards found in there include the minimum outdoor play area requirements, minimum indoor classroom size, Vehicular sacking for pickup and drop off and safety barrier requirements if the property is adjacent to a body of water. And finally, it does not allow the outdoor play areas to be located in the front yard or street side yard unless the outdoor play area has a reinforced barrier.
