and it's an application for standards variance in a residential zone for Joseph and Rhonda daily. Daily daily daily. Okay. Ronnie, you wanna tell something about it or how are we gonna do this? Yeah. So, what we can do is I'll give a a brief little overview. Um, this is a developmental standards variance they're seeking. Um, what I'll do is I I'll go ahead and I'll talk a little bit about the procedure, what they're asking for, and then we'll invite the applicant up to speak and then open the floor up for public comment. Um, so the applicants, uh, Joseph and Rhonda Deli, uh, the properties located at 150 1502 Lake Celinda Road. Um, it's currently in the RR zone, rural residential, uh, under the zoning ordinance. Uh, currently used for residential purposes. Um they are looking to build a 14 by 20 foot garage which will um encroach into the front setback and side setback by 5t each respectively. Um and for that they are seeking a developmental standards variance. Um just a little overview of developmental standards variances. Um the board of zoning appeals um may approve or deny a variance of a developmental uh of developmental standards such as height, bulk, lot size, setbacks or area. Um, a developmental standards variance may be approved uh when such a departure from the developmental standards is not contrary to the public interest and due

to the considerations peculiar to the property would not result um or not the result of actions of the applicant themselves. The literal enforcement of the zoning ordinance would result in an unnecessary and undue hardship. uh and that's from the zoning ordinance itself. And in addition to uh those requirements, uh the Indiana code also sets forth uh three uh criteria uh on which a uh developmental standards variance may be granted only if the board um determines in writing that the approval will not be injurious to the public health, safety, morals, and general welfare of the community. that the use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner and lastly that the strict application of the terms of the zoning ordinance will result in practical difficulties in the use of the property. Um so with that little overview of the facts and procedure we can invite the applicant up to speak. You want to come up and tell us what you want? So it was just uh sent out certified letters, published in favor of the sign, went through the proper channels and spoke following neighbors. No problem.
