This is the location of the current culvers. restaurant, Del Taco restaurant at John Williams Boulevard, Limestone Drive.

Yes. I know we had one about a month ago, and this would be very similar to the same thing. wanting to divide that off for the Del Taco that I've seen that's already almost done over there. And then of course, to bring the Culver's itself onto one parcel, the Del Taco onto one parcel, and then the remaining land be left to be developed at a later date. Right now, we do not have any potential people unless anybody has anyone they'd like to refer to us. But for now, that additional ground will just remain as empty, as a separate piece.

The next is a public hearing for Amaro DeSalva, who's requesting a minor subdivision of property that he owns at 715 25th Street. He's requesting to divide the property into two parcels, each with the parcel being approximately 19,074 square feet. It's zoned R3. Travis Norman is going to speak about this.

Good afternoon. I'm Travis Norman with T&G. We are looking to split this into two tracks. So the original layout here was three city lots that were 62 1⁄2 feet wide that all fronted on 25th Street. We're looking to break it into two lots going east to west, with the front lot having access off 25th Street for the house and the garage, and the back lot would have access off of the improved 20-foot alleyway. And then also it could have a potential access on the 20-foot alley that's not improved on the east side. I did a little research of some of the concerns we had. The fire hydrant is located at the northwest quadrant of 25th and 8th Street. is about 350 feet west of this site and then the sanitary sewer there is sewer in the alley that's right in front of that proposed lot number one and then also we had talked about possibly just not having the one access off the improved alley so we went out looked at the 20-foot alley that's not improved And they could definitely put a roadway in there. There's already an existing driveway there that kind of loops around where that not improved alley is. So they just have to build a road next to that if they wanted to loop it around, tie back into both alleys.

That'd be the city of Bedford. Yeah. So it's basically an alley that was never built when Bellevue Heights was platted back in the early 1900s.

Yeah, and most of the homes through there, it appears, kind of use the alley as their access. Most of them have their driveways off the back in the alley. So I think that's why when the house was developed on 25th Street, they put the roadway around where they had access off 25th and off that 20-foot alley. And, like, if anybody would develop lot number one, I mean, that would definitely be an option, you know, because that is just a 12-foot paved road, but it is a 20-foot wide alley platted that the pavement's only 12 foot. So they could definitely loop it back around into that not improved alleyway if needed.

How wide, Kevin, would it have to be to get a fire truck or an ambulance down through there?

So members had concerns about this last meeting. And if you look in your packet, there's a page that has fire hydrants on it. There it Three fire hydrants in that immediate area, two of which I circled because they're attached to kind of that area. One of your concerns was could a fire truck get down it? I talked to Fire Chief Luke Pinnock. He said that it would be difficult, but they could do it if they needed to. That answers those questions about your fire plug and could a fire truck get there. The platted roadway to the east is available to be used as a drive because if you see on the north end there is a house right here that uses platted out the prided runway of g street as their driveway questions or concerns and it would not have to be brought up to city specs if they're just going to use it for the driveway we have that in various places around town

I do think our ordinance is clear that it has to be fronted by a primary road or a primary street. The thing that I have issue with is that is platted as a street. So technically, I would say it's within the ordinance to approve it, but... Personally, I have a little bit of an issue with it because it is basically an alley. But technically, legally, I think it is platted as a street. So I think it's within the ordinance.

So I did have concerns from the news, and they are this property right here that the butt's up to. There was some confusion initially what is it they're doing, and I said, well, they're separating it off. I don't know what the intent is. There was some confusion that previously they felt like that G Street had, that they had petitioned the city to vacate G Street, and that is not the case. The only thing that was vacated was an alleyway somewhere in this area that joined the alley and the platted G Street. But that was in 2012, and that is the only thing that I found in ordinance. That's ordinance 21-2012 that vacated the alleyway ran east and west. And they're not here tonight. That was their bigger concern.

Lance DeSilva. I'm a realtor with Century 21 Sheets. I've got the property. The property 715 25th Street has been listed by me. And I'm also the son of Numero de Silva. You asked about intention. Well, the intention would be to subdivide it and let someone else figure out a better use of the land. Right now, all the other lots in that neighborhood are basically a half acre smaller. And so when you think about that property, kind of being on the market in that neighborhood on an acre, people were priced out, I guess you could say. And so the idea would be to subdivide the land and have the pre-existing property drop price and be in alignment with the rest of the homes in the neighborhood in terms of price and then let someone else figure out how they would want to develop

One thing to keep in mind here is we are making this lot bigger than what the original three lawns were because they were only 62 foot wide. So now we're going to make it two lots that are 19,000 square feet. And in the past, we've always wanted bigger lots and not the minimum on things. And another thing to keep in mind, the property to the north, I believe that's Larry New, he actually platted his area kind of doing the same thing we're doing here. Mike Arena did that survey, and that's when that alley was vacated. We're kind of looking at the same request as what he did back in the day also. Just to give you a little back history.

I think to do nothing is wrong. We have to either take a stand one way or the other. It seems to me the issue isn't the size of the lot or even where it's at. It's just the access. I had the concerns about the fire hydrants. I think those have been addressed. I understand the concern of the one family. And that seems to be more of a confusion thing. And there's going to be a buffer there. I hesitated to make the motion. I was looking down through the various uses that were allowed for R3 and the special exemptions for R3. And there's some stuff really that in that would be very difficult if If somebody was going to build something that had high traffic, but I think if they did that, they would have to improve that road or their business or their function would just dissolve. With that, to get a decision one way or the other, I'll make a motion that we approve this request.
