yes King yes Ry singer yes Miss Jackie em have you come up and talk to if if you guys haven't been into the mpb lately all new floors and they have they have went in and did a poly U what's that stuff called aoxy with the shark skin so we had a lot of slips Falls now it's much better and it looks so much better so she's going to talk about the one piece we didn't get done and that's the showers which is going to be the hardest and most expensive part okay so um yes there are lots of projects going on at the npv everything's getting updated and refreshed um so we figured that's a good time to bring this to guys um our B on the Aquatic side are haven't been updated in several years um I think the last time they updated the problems we having still haven't been resolved but easy to clean slip resistant and and that thing so we are looking at doing um a poxy floor just like what's going in the lobby go ahead and extending that into the bathrooms um and then of course in the shower walls and the shower STS for again easy to clean surface and hopefully offer some slip resistance um you'll see three estimates I brought to you one of them is from industrial restoration so when you look at these estimates I want you to take close attention so on the the first one with industrial rest restoration um at first they included this non-slip clear coat that was going to be in the lobby area which we don't have to worry about anymore because the lobby area was included in part of the MPV project and so you'll see at the bottom where I kind of just wrote a new Total and also to include taxes because they didn't include taxes um so with just the

bathroom flooring and the showers with your taxes that industrial restoration is uh $29,800 42 cents the next estimate you'll see similar story Den meal reserving this was when they were bidding the job as far as uh being a combined project with the lobby and the showers in bathroom area um so again I did did the math refigured the taxes in the total for that one 26 92906 and then tops decorative um theirs did just include the bathrooms and obviously there's a high they did not include tax on that one so the bottom number on that one is 37 785 um what about the second they figure the taxes in no so on the den Neil they did yes but that included taxes for the $30,000 in the lobby area and that's not accurate because we're not doing the lobby area so instead of $5,000 taxes it's 23 so um you'll see the total list that is the 26 92906 um they're the low bid and then tops decorative with the high bid industrial restoration is is in the middle and it and it beats the little bit just by a couple thousand I would recommend that we go with the industrial restoration they are currently the crew that is on site um working with Van Horn construction to do our lobby area um so I told them you know if this goes through in his chest they said that they would not have to Le s that they could roll into the next job given that we can get the site ready in time so again they are not little but they aren't far from it and they already on site work for us if

we quick question um on that low bid the the dentist Neil um what would be an ETA for them would it be a week out month out six months that's a good question I don't think it'd be a month but I don't think it'd be a couple weeks um probably probably two three weeks um normally their busy time is in the summer time when they're getting School ready uh to open up but I think they're a little bit SL now scho back in S I don't have Ana on okay is this something that's just really pressing or could we wait to or three weeks I think it's necessary to move forward since we have the um crew on site and we've already have traffic routed and people are kind of used to using the outdoor bathroom right now and that sort of thing with pool and whenever we were doing the lobby area for the pool the the members were using the outdoor restrooms in the morning and so it's we've had to pece Mill it together because we've had the roof the roof is torn off the roof is now back on the walking Track has been torn off it's already down the new one's down so we really disrupted things trying to expedite that as fast as we can but as good as we can if you go out there and see the job that they did on the current floors you're gonna be impressed so it's like you said I mean it it' kind of I think be inconvenient to reopen totally and then come back a couple months or next year and say sorry we're closing the B again and have to re out and get get them out of think it's incon way we're kind of already doing it right [Music] now short answer yes but but with some consequences would be saving

$2,000 what budget does this come out of what F Reserve I would say aquatic maintenance aquatic maintenance yeah that's right d because that that side is the Aquatic [Music] aquatic he G say okay that's so we have a motion I make a motion we approve the $29,800 2 cents from industrial restoration systems from aquai second second Miss Barber Baker yes Bradley yes Edens yes King yes Ry singer yes Thompson yes thank you Council uh 6f lighting estimates will IND P this is um part of that that incident that happened when the electricity went off and we had the issue up there and what happened was that the pool basically turned into this giant terrarium chlorine Cloud terrarium and it and it fried the lights and so Jackie has been on the search for some that were actually designed for that type of setting and the reason that there're more pricey is because she's done due due diligence to find the kind of lights that are designed for that type of environment they know the the Li up there were like typical industrial lights meaning the connections weren't coated in epoxy didn't have any of those saf to save guards the light she's found U are the ones that I think I'll let you explain it Jackie but I think you did a pretty good job breaking down yeah this this is a replacement for the lights that were

damaged um if you go in the to the pool in the morning you'll see in one corner there's like two lights that are so on trying to light the entire pool area of course in the water there's there's lights in the pool if you're on Deck it's really hard to see anybody in the water it's kind of dangerous um I have lifeguards there we're not required to have lifeguards but just as an extra safety precaution we have people there um watching the swim team in the morning of course have people that come into laps in the morning um but again it's dark you can't see people in the water very well um so it's definitely something that needs to be fixed that being said finding something comparable is difficult to reach up several the companies to try to find something that's going to solve that problem given the environment that's it's in and Havey with v and electric some of those lights are battery back up the power goes out they are made to stay on and then course the other are just Reg so 18 just most of the time Council we have to do go back with like comparables this time we didn't we went back with something better it's the reason it's a little more expensive is because it won't be affected by any shutdown which causes this terrarium effect in this out indoor pool so I'm really proud of the work she she's done this leg work the research the scientific method behind it so um this include installation and all everything does got installation right that's them installing them you're not going to put them iny we will have a we'll have a lift so you can get up there and do it if you need to um that's a really good question I'm not sure on this estimate it doesn't say but I think my

email Cody do you know on this quot the lights that that include installation you're Morgan you want know there's nothing on here for installation toon could we move this to a little bit lower in the agenda give her a chance yeah want you go call M come back to you had something new oh yep might as well stay there okay so um I'm here to request uh shredding of some records that we have in the pool I've been going through the facility and cleaning out closets pool of junk um so that we can have areas to store our Recreation items um that being said I found boxes of point of cell records and reservation records that aren't necessary I spoke with bar and she informed me that we had to keep records from up to four years from our last audit but we need a detailed list I need it for the minutes yes I have that I need it it's in theold it's in the packets it is okay I didn't see it earlier just so um that being said the records are there's one box it's January through June 2015 another box is June 2015 July 2015 two boxes are July 2015 August 15th through September 30th September October November December of 2015 and there's one box at 2015 reservations and then uh August of 16 through September of 16 float reports um so they're all stocked in a pile in my office and I'd like to be able to tread them so that we can clean up um so far that's all I've found but I

ordained by the city council of the City of Clarksville Arkansas that section one the following described land shall be reson from Zone classification R2 to C1 description exhibit a all of said property being located at 13 14 15 and 16 Taylor Circle in Clarksville Arkansas section two all ordinances or parts of ordinances in Conflict here with are hereby repealed we open up for questions or comments I think we have is Kathy here yep do you guys want to come up and address the councel yeah any questions for us or I need explain to Y what we're trying to do would you please explain community room and office space okay the library is in the process of try to do Renovations and so what we've come up with if you're not familiar with the library in aeac which is not induced for parking for not just a library but for anything um we purchase these two duplexes that are east of the library one will be turned into a office space for the Arkansas River Valley Regional Library System the other one will be used for a community meeting room programming and story time um we will connect them to our our current Library uh with the walkway and the cover Parkway which will kind of give it a a campus fill and then um the uh the entryway right here we are asking to open it up about five I think it's 575 square feet which is a little bit it's going to be past the variance that y'all require and then there will be a parking lot over here that in even that's just the future that we're going in but we just need we need that zoning change and that variance change thank you you're just changing

King yes Ry singer yes Thompson yes Baker yes thank you Council I don't see an for this one an appe there is an ordinance I think it's an appeal oh decision is the appeal letter where's the appeal letter yeah I saw it it's in here Madison yep yeah all right it's Miss Madison here do you want to come up and address the council let me give me a second here just to get you started have you readyy looking at purchasing 1106 road we initially asked for an R3 zoning um before we came to the Ping and Zoning meeting we had um decided we just needed an R2 um I think the planning and zoning committee R2 but because it's l restrictive anyway there seem to be a bit of confusion there um we looking to build a duplex specifically for student housing um there's many Lots in the area R2 already um I have some pictures here of the zoning map if you're interested in looking at those I also have a copy of my build um I also have a copy of the survey um the hman are presently the owners of this um we have a signed contract with ear to purchase this um and I have recently built a house in the county

that would be very similar to this just this would be a little bit larger um and it would be a duplex I also visited the city's um plan for Clarksville City plan 2040 um talking about out um there's very little new rental housing in the Clarkville Market um the occupied housing has increased by 10% um there's just several things here that I think the city is wanting to um you know increase housing space for people um in the town um I understand there was some some tests to this um I think mostly that was because they were afraid it was going to be an R3 or a multiplex facility and I could understand that um but like I said my plans are to just be a duplex if anyone would like to look at a picture of what I've already built it looks very nice I also own a couple of properties near this and we keep them up they are well maintained they look very nice and had them for many years now and so anyone question I have a question you said you're looking at going back to the Planning and Zoning to try to have it rezone to R2 it wouldn't have to go back to Planning and Zoning because Cody our be more restricted from R3 R2 you can't go up go down did the did the plan zoning tell you why they uh turned it down um I think there was a neighbor nearby that are there houses there next to it yeah so here's a picture of for five

years you say can I see what you're planning to build picture what picture so it's not it's not a two or three story Multiplex no there's a copy of r2s and r3s that are nearby potenti yes are they metal buildings all that would have to be appr through the not your exterior does understand does not only the size only the size of the lot actually and the lot the lot technically was big enough for an R3 but I there was thank [Music] you my understanding was that there was a concern that there was going to be a like a three level or Multiplex built there right isn't that what we were well what I'm what I'm looking at is on my paper say from from one to three and then you saying from

one to two that's that's that's where I'm lost at Cody you want to come Cod um she want to go to AR but the Zone code said that they can be more restrictive and go to a R2 which is more restricted than R3 we did the same thing for gar place out on cord he wanted a C3 but they end up going to a C2 I think was actually part of that at the time went to a C2 which is more restrictive than what the how commercial C3 allows so you can go from an R32 and R2 for our code without having to take it back for another variant or another zoning so I heard it say someone in area system about it do these people know that it's going from one to two whoever that person was that was that complained about it so let me ask you this did did you put the sign out not notifying that there was going to be public hearing announce the date time you did that you had you had the meeting planning zoning put that out opened it up nobody showed up to complaint at that meeting or they did yes they're here tonight okay how come they didn't sign up are they are y'all want okay so but you can be more restrictive go to an R2 which only allows a duplex not a a multiplex or anything along those and that lot is limited to size so I mean it it's not a very big lot and the way it's shaped I mean it's they actually gave her variance for the setback requirements from 25 to 15 in the rear de they already did approve that which be next on Cody did they say why they turned it down uh I talked to a couple of P people afterwards they didn't understand that they could have went to an R2 at the time they thought that that she would have to repetition to reone it again so but in R it does

say that they can be more restrictive and go to an AR in the same meeting so they didn't understand that so she can go back to p z no y'all can do it here tonight we don't have an ordinance we don't have an ordinance we can do one well coming from Planning and Zoning uh I realize uh what your request is but you know and I I do know some of the ones that are on the Planning and Zoning now I think there's one or two members in here already but I I really I fully recommend that we um highly consider what they have suggested and if if that means you need to go back and reapply for an R2 that's I'm I apologize but that that would be what you would need to do because at this time I like I said coming for I was on Planning and Zoning for a while and there are some hard decisions that have to be made but um I I feel that we as a as a council should take the recommendation of the planning zone which that would be not to approve your appeal in my opinion yes sir real quick I think with that included something in your packet about this and really the council has three options with this appeal one is to approve it two is to send it back to the Planning Commission or three is to take no action if I remember correctly um If you deny the application have to wait 12 months before they can resit for the for the R2 yes sir okay if you

I actually actually make read it no I had it reported an ordinance authorizing rates and fees to be charged by Clarksville connected utilities delegating authority over certain fees and for other purposes whereas the City of Clarksville Arkansas is the owner and Regulatory of a municipal utility providing electric water Wastewater and Broadband Services whereas honor about the 8th day of May 2023 the city created a commission known as the Clarksville connected utilities Comm of the City of Clarksville Arkansas for the purpose of operating and managing the city's Municipal utility in accordance with Arkansas code 14201 20101 and the authority generated by the city whereas the city withheld from the commission the authority to establish rates and standard fees except to the extent that the commission charges less than the amount authorized by the city whereas the commission has determined that certain electric rates charged by the commission are inadequate to cover the cost of providing Electric Service and that a rate adjustment is necessary to maintain Financial stability within the electric utility whereas the commission has determined that certain utility service fees are inadequate to recover the cost related theto and seeks authority to establish fees that reflect actual cost whereas the commission has requested the city to adopt the rates and delegate authority over fees as describing this ordinance now therefore be it ordained by the city council of the City of Clarksville Arkansas that section one residential electric rates Clarksville connected utilities is hereby authorized to charge for residential electric service amounts that did not exceed the rates described on exhibit a electric 2024 which is attached to this ordinance and Incorporated here and as if it is set forth word for word for purposes of this ordinance residential electric service shall mean service that is provided to a home for household purposes Clarksville

connected utilities May assign an appropriate commercial rate to a any home where the predominant use of the premises not separately metered is used for commercial or purposes as determined by Clarksville connected utilities B any home with commercial or other activity that causes average electric consumption or Peak demand to exceed the average electric consumption or Peak electric demand or other residential electric customers in the City by more than 100% for more than three months in any calendar year see a home that has an electric Peak demand greater than 50 kilowatt at any time section two singlephase commercial electric rates Clarks will connected utilities is hereby authorized to charge for a single phase commercial electric service amounts that do not exceed the rates described on exhibit B Electric 2024 which is attached to this ordinance that incorporated here in as if it is set forth word for word for purposes of this ordinance single phase commercial electric service shall mean electric service other than residential electric service exhibit a electric 2024 or special electric service exhibit F electric 2024 that is provided to a location that has a peak demand that is less than 50 kilowatts through a singlephase electric connection section three three-phase commercial electric rates Clarksville connected utilities is hereby authorized to charge for three-phase commercial electric service amounts that do not exceed the rate described on Exhibit C colle Electric 2024 which is attached to this ordinance and Incorporated hearing as if set forth word for word for purposes of this ordinance three phase commercial electric service sheling electric service other than special electric service exhibit F electric 2024 that is provided for a location that has a peak demand that is less than 50

following rate schedules are just and reasonable and hereby directs Clarksville connected utilities to charge and collect from the customers an amount that do not exceed the amount shown for electric services provided to the customer classes described below as soon as administrative practic but not later than December 31 2024al Electric Service rate showed on exhibit a electric 2024 B singlephase commercial electric rate shot on exibit B Electric 2024 c 3as commercial electric rate shot on Exhibit C Electric 2024 D large commercial industrial electric rates shown on exhibit D Electric 2024 E power cost adjustment shown on exhibit e electric 2024 F special electric service rate showed on exhibit F electric 2024 until such time that the rates and charges described in this section are implemented Clarksville connected utilities shall continue to charge and collect rates according to right schedules that were effective immediately prior to the approval of these rates all previously approved electric rates and charges in conflict with this section shall be repealed upon the implementation of the rates and charges described in this section the rate charge exhibits described in this section shall not be cified as part of the Clarksville Municipal Code rather Clarksville connected utilities is directed to maintain a copy of all applicable rates and charges on its website in a manner that is available for public inspection Section 8 amendment to Clarksville Municipal Code section 10.04.13 section 10.04.13 of the Clarksville municipal code is hereby deleted and replaced with the following 10.04.13 establishment of fees the Clarksville connected Utilities Commission May adopt charges and fees which may include a fees to recover costs related to the city's

pre-treatment program B fees to monitor inspect and maintain surveillance of Wastewater discharge and Wastewater control facilities C fees to review accidental discharge procedures and construction D fees for permit application e fees for filing appeals F fees for consistent removal by the city of pollutant otherwise subject to Federal pre-treatment standards G fees for Wastewater discharge permits and Wastewater contribution permits and H other fees as the commission may deem necessary to carry out the requirements contained herein fees established pursuant to this section shall not exceed the amount that generally reflects the the average cost incurred by Clarksville connected utilities to provide the services Associated therewith the fees described in this section solely relate to Wastewater Services provided by Clarksville connected utilities and are separate from all other fees chargeable by the city or Clarksville connected utilities section nine amendment to Clarksville Municipal Code section 10.04.13 the first three sentences of section 10.04.13 currently misnumbered as section 10 10.2.1 14 of the Clarksville Municipal Code are hereby amended to read as follows 10.04.13 permits required all significant users proposing to connect to or to contribute to the pow shall obtain a Wastewater discharge permit before connecting to or contributing to the pow users required to obtain a Wastewater contribution permit shall complete and file with the commission an application in the form prescribed by the commission and a by the fee established by the commission the remainder of section 10.0 4.14 shall be preserved within the city Clarksville Municipal Code as currently stated section 10 amendment to Clarksville

Municipal Code section 10.8.4 subsection a of section 10.08 4 is hereby deleted and replaced with the following a fixed fee charges for Wastewater Services shall be applied for water meter connection excluding sprinkler meters and other met meters that do not fall flow to the Wastewater system on a monthly basis regardless of consumption quantity based on the customer class section 11 amendment to Clarksville Municipal Code section 10.08 6 subsection h of section 10.08 6 is hereby deleted and replaced with the following H fixed fee charges for water services shall be applied for water meter connection on a monthly basis regardless of consumption quantity based on the customer class section 13 amendment to Clarksville Municipal Code section 4.0 4.21 section 4.0 4.21 of the Clarksville municipal code is hereby deleted and replaced with the following section 4.04 point21 connection to the electric distribution system except for service provided under rate schedule L security light service all connection to the city's electric distribution system shall be metered all load connections and connections of generators operating in parallel with the city's electric distribution system shall comply with the safety and operational standards of Clarks will connected utilities existing customers repairing storm damage or upgrading should contact Clarksville connected utilities for actual cost according to what is required all new connections and reconnections shall be subject to the fees indicated in the table below which includes the cost of one a meter box to be installed by the customer's electrician to a standard meter installed by Clarksville connected utilities and three up to 300 feet of overhead singlephase primary service extension electric service connection reconnection fee schedule 200 amp

service $450 320 amp service $800 $320 amp service $800 CT metered service $950 other connection Services if required shall only be provided at the customers expense including without limitation necessary distribution system upgrades additional primary or secondary line extensions Underground Service non-standard metering non-standard switching and the like for a CT metered service the customer shall additionally provide a Unistrut rack to mount the meter base and a ditch with 1in conduit from meter base to Transformer Pad contact CCU for pad dimensions and conduit locations section 14 severability the provisions of this ordinance are declared to be severable and if any part of this ordinance is declared to be unlawful or unenforceable the remainder of this ordinance shall continue to be effective section 15 conflicts repealed the ordinance number 23- 914 and all other ordinances and parts of ordinances in Conflict here with shall be repealed to the extent of the conflict upon implementation of this ordinance section 16 effective date this ordinance shall be affected 30 days after Passage you're going to miss that no not a bit just like it you're going to miss that you know it okay we'll open it for discussions questions or comments yeah yeah if you want to come up address Jason attorney Municipal Association I work with connectedu issues this is being presented to you today because uh CCU has insufficient gr that's what we notice notice to you are the regulator you are the the rate authority over CCU

like that need to be brought to your attention with a solution uh to solve that problem at least in the short term right we trying to put a Band-Aid on the wound you believe that they're operating in the red at the moment and want to not operate in the red I think that's important because you have contracts right where you buy wholesale power and within those contracts there are things called R covenants where you promise right that you will charge rates that are sufficient to operate your utility in a businesslike fashion right to pay for your contract obligations right and uh and you won't operate in the red right that's part of your Covenant to be able to do that relates to your bond ratings and and everything else so it's really important it's an important issue U these the work that we're bringing you right now is not based upon a rate study ex of rate study right a rate study takes more time time and cost more money to get that done and when the CCU board looked at that they uh said hey we don't want to do that right now we want to try to uh solve the problem patch the problem right now and we'll worry about a more robust rat study have proper cost assignment we'll worry about that later we'll overcome that hurdle later um in regard to the or I feel like I have to apologize like that was so long [Laughter] so long you just offer to read it next time and and I would I have say Jack Duncan's here with me Roy Young's here with me but I think that I can run through this pretty quickly and tell you what the changes are and I know it's a lengthy document we can cover pretty quickly um with section one you can just split to exhibit a right and and we tried to update our language regarding residential electric service right that's what we're talking about in section one and the the main change that

you're going to see is the base customer charge uh currently $10 a month $20 a month right so um you know it's a a not insignificant increase but it is in line with what we see other Utilities in the area Char right and it's handy to have that from a from a fixed charge standpoint resent of all volumetric predictable cash flow you're going to see that theme follow through in the next ones with section two that just you know just turn the page to uh the uh single phase commercial rate schedule so that would normally be a $20 a month number for uh a single phase commercial rate schedule $40 a month uh charge if you'll turn the page to the three phase commercial rate the way that it's organizing race right now is that uh you know these uh these commercial customers have uh get charged a a $20 fee if you're three- phas you get a $30 addage a three-phase customer right now gets $50 charge we're proposing that charge would be $100 in uh for the large commercial industrial uh rate schedule that's on exhibit D there are two changes one is to the base customer charge right now it's $250 a meter that would go to 500 and with the filling demand is currently $4 what that go 4 qu so that kind of walks you through uh one through uh you know those uh rate changes

that are being made uh the power cost adjustment which is generally narrated within the rates right now that's added as an exhibit you'll see on E right and it's to incorporate uh total power cost power cost that the that CCU incurs as a base amount of 4.75 cents for k so they they obviously have the mission to try to keep that number as low as possible if they can get that below 4.75 pushes back to the customer however the cost go above 4.75 right and that shows up as a PCA on the bill and then uh I think we have no changes to what we're calling special electric breakes and then of the city as now there are other changes in this document as well uh because I've walked us scre out where we're kind on Section seven and on Section seven talks about hey these are the new rates that are being adopted that were adopting those schedules we have attach and U and the language that follows that says you know as as you read earlier uh until these and charges are implemented they'll continue to charge the rates that are currently in effect and then we're not going to codify this this would be a whole lot to try to put so we're going to have them adopted they will be in the official records of the city as if they but CCU would be required to post on their website so it's always transparent about what the been

charged with Section Eight removing uh I want you to see Section 8 and section n as kind of a theme that is together and uh the the primary change is being made is uh in section A if you'll look at at subsection G so it's fees for Wastewater discharge permits and Wastewater contribution permits uh currently in the code those are uh established by city council they are not established by CCU right so the other a through F and H are described in in uh in your code right now that you have delegated authority to CCU to set these fees meaning it's a it's a service that is performed for a customer that should set that fee at the approximate cost of providing that that's not a profit center it's just a a assment for what can be done but they want to add to that this are the fees for was for discharge permits and water contribution permits it's been $50 for a long time meaning decades and decades and uh uh the cost to uh to perform the services related to that permit dramatically exceed $50 you don't see raising that immediately to a cost point because there would be kind of a a rate shot so it will they anticipate any increase over time to uh to approximate FS that's where the authority if you'll look at the bottom of Section 8 that one paragraph the feed established per section shall not exceed the amount that generally reflects the average cost incurred by CCU to provide the services so they can't charge an amount in excess of that they can charge a lesser amount and that's what they intend to

do so that's eight and nine together deals with those permits I think that there's a handful of customers in have them uh but we're just trying to get proper cost assignment sections 10 and 11 uh deal with uh how we assign fixed fees for Wastewater services and Water Services right now they are not applied for they are applied for customer and the utility Staffing the issue leaves us more appropriate to assign those based on meter connections because the meters cost right and the connections cost money right so to try to recoup those cost per connection makes more sense to them with the Wastewater side you'll see that there's made an exception for sprinkler meters and meters that don't flow into the Wastewater system right we we don't meter waste water we only meter water but we shouldn't attribute Wastewater services to sprinkler systems or things that don't system one other change in that section 10 U is that how do we calculate water flows in the Wastewater system your current rules have Wastewater flows that are calculated during four winter months rather than every month where they're calculated every month the problem with that is if someone had a zero consumption winter month that they left for the winter and they come back don't take away measurements their water measurements would have been zeroed out those Mon and and then that would carry out through the entire year so we didn't feel like that was appropriate but like and and typically the way that waste water services are done they measure water consumption every month so it's kinding of moveed to a more typical

system um so that's that's the way section 10 Works section 11 also is to apply those fixed charges per water meter connection uh and then we have connection fees uh uh which apologize bar again read that entire long paragraph but but I think it's kind of self-explanatory to show you uh what someone has to pay you know for and what do they get out of that's what we're trying to communicate to customers so that's the ordinance in its entirety U but I'm I'm here to answer whatever question you may have I know we had a sidebar question about implementation uh while uh while we were hearing the ordinance read an earlier version of that document said something about implementation not later than a date in in November no November in November yeah and U that's because work had been done on this ordinance for a while there been with different theories about how do we properly you know try to recapture the money that the utility needs what's the best mechanism to do that there's been a lot of debate and and I think it's good faith debate about what's the best way to handle this uh but because of that you know that makes the clock run right the downside is that it causes the problem to works over time right but it's uh but that's just the nature of the be as that time has progressed we probably need some more time to be able to implement it so within within these rate schedules you'll see that there's a uh a no sooner than date right when rates should be implemented we wait 30 days right and then we Implement as soon as as we can administrativ Implement after that within this document too we're also

saying so there's also a no so that would be you as a as a council I'm giving you a window telling CCU I'm giving you a window to work this out administratively on buing perspective you need to uh implement the rate change within that window of time so uh that summarizes I believe all of our points Mr Carter there's nowhere in here that there is a rate increase for residential is that correct there's not a it's going to cost every residential customer an extra $10 a month yes sir and that's all it's going to cost yes sir okay now and and the other question I had is can is there anywhere in here and and I didn't read it but uh there was there's I've seen about three or four of these documents before there was one that said something about that the the commission could charge uh could raise the rates without city council approval is is there anywhere in here that that state no sir okay this council is the regulatory Authority okay over CCU where the they are asking to be delegated additional authority over one fee that's in here and that fee has to do with the Wastewater that's we found that there's testing that has to be done and things have A Little Rock and it's it and we're charging $50 fee for this when we've got we got more than that in gasoline and right and the approval process so it's uh so we've got to get a better fee

struct for that and we're asking to be delegated that authority to set that fee and to a level that does not exceed our cost so it's approximate you have m okay thank you thank you for all your work I just want to say it's as painful as it was listen to read I had write it too true J Jason I I have one question on Section seven uh there's something I think needs to be stricken from this and it says the rate in charge exhibits described this section shall not be codified as part of the Clarks Municipal Code yes now that's I know what your intent was there but when you and I are gone that becomes a problem so it's an ordinance it should be codified and that needs to be taken out if that is your discretion if uh if you want really my Approach in that yeah save you ink I know because uh the uh what if they you know but when you being ordered to post this ordering them to post this on their website but when you and I are not here they say well that's not really the law go and do it anyways they didn't they didn't codify it so it don't really matter think about the world I come from okay so I'm just telling that probably needs to come out there and I discretion on that okay this is this is uh ordinance and and this is your Authority and wherever you feel like that that needs to be posted for the most

transparency then certainly uh that's acceptable if you if you want to post it on your uh website you because I know you try to cify and post that to make that available yeah the only thing that we need to be diligent about is to make sure that uh that you know what they say man you watch know what time never match right so we got to make sure that we're same same we're getting different signals for the citizens but other than that then I have no person I think anybody else either so it was just a point of convenience I think for City it is right now so you're just suggesting to scratch the word not right I would highly encourage the council to make sure that this is codified and it is law in Clarksville codification just means it's in our book that black book no it means it went to the municipal league and it's on it was in that black book you've had the legal set of eyes and L rock look at it too so not just putting it on a website saying it is law it's it's different anal you vote on it it's law yeah yeah once it's passed it's law well then then why are we putting in there anything any commment at all about codifying it just take the whole paragraph out yes you could you could so we can approve it minus that paragraph we'd be okay if there's no question to it being law right just take that out there is no question about once this once this Council votes the if if you would like to cify it then I would say

uh scratch that out uh and uh just remove that parag I like the part in there where the the the utility uh has to maintain you know for public inspection the the website I think it's a good idea for that's where they're [Music] transpar you'll find that people know you know they can look at their bill and they can do the math themselves they can see if they're being charged right now I would delete that first paragraph first sentence of that paragraph right here the rate charge exhibit the rate and charge exhibits described in this section shall not be codified as part of the Clarks Municipal Code I would just start with CCU C for connected utilities is directed to maintain a copy of all applicable rates and charges on his website in the manner that is available inspection then no matter who's in the mayor seat no matter who's in the commission seats you know what your law it's gonna be followed right there no games being played it is the law so on that paragraph just start off with Conn connected utilities is directed to maintain a copy yeah the only thing I I saw in it really it I would like to make a statement if I could I've gone to several of the CCU meeting seen him a lot really and he had hair when you started you're probably right but um in a lot of those meetings um you know as a community actually as a country we've experienced a lot of inflation and that has really affected uh utilities and I I was shocked at some of the cost that this

that we have incurred their ccu's incurred that they have not passed along to the public and it has got us into a little bit of a bind uh for lack of a better term but I I encourage anyone that has any questions about CCU or or worried about CCU to go to those meetings because uh it is eye openening at what can be what you can hear what you can see and I know Susan was at the last one or two and uh they do have coffee at the back if you make it but uh it is it is a a good thing for you to go to and listen and because you would be amazed at what what our SE what our utility goes through on a daily basis to provide us with Power and Water and Sewer that they have not passed on as far as a cost to us so I I I applaud them for the work PL you for the work because you have put in a lot of hours well and I can just tell you there's other cities in Arkansas who struggling their way through it just like you are right now and it's not easy but we're trying to work better together every month trying to figure this out and help each other you know help each other reduce our cost help each other be smarter about how we think about things and I'm very optimistic about thank you for your work I just got I got a couple of questions for before we move on um just based on your customer account in each category I see a based on the the fee changes that you're asking for I I estimated it to be a net revenue of 8627 3394 based on your current customer load with the exception of the three-phase commercial I don't I have I didn't know the number of

customer there extra and stff million okay so with you add the the three-phase commercial that it's going to push you up over and your last your last audit reported you where was it five 497 at a loss so it's going to make you plus around 600,000 so what my point is it's not egregious you're not out here just you know trying to Pat everybody's salaries you're just trying to keep the thing aoat right you got to turn it around one for repair and replacement one for there's no account that start there needs to be that that wire out switched we got's and it ca more more damage than thank you Jason sir ready are you making the motion do we have a motion to the rules you want to move it to next month or you want to move no moot is is there anyone is there is there anyone who wants to speak out raise your hands so hang on Council we have some people here that want to speak about this and need a vote from the council to allow them their

time motion have a motion to approve the the speaker second Miss Barbara ringer yes Thompson yes Baker yes Bradley yes Edens yes King yes okay come up Sir Mr Aubrey you start speaking on I I will start the clock and then we'll go from there I'm not going to I'm not going to slam my phone at you and I'm just I'll raise my hand and say that's it my only concern about this is all this all this commission as dep I don't say anything trying to work on something cut these CS no we can cut these CS that's not in this ordin to me if you give the then this Authority do this you'll never get it back and you know that's $10 Fe on your me that's not nothing unless you retire on fixed and this pretty pretty heavy all I request should be done to cut well I'm I'm going to tell you I think uh I may put Jason on the spot for a little bit I know as far as cutting cost what you're thinking of is like maybe laying off people that's equipment but he's taking even bigger steps because he's looking at his power supplier and just a comparison by switching power suppliers for example the power he bought in 2023 compared it if we' have went to

this other power supplier same power load we paid $3 million more for it he's going to switch that but he has to break that contract takes 18 months after 18 months he can switch over this other power supplier buy the same power $3 million savings the man is actually thinking down the road just not anybody it's just been a mess you know absolutely there was four years there where it was just a mess and we we're trying to recover from that we need to recover well that's pretty and this Council nothing's permanent this Council sets the law here if he gets the ship right they can come right back in with another ordin set that back well I know good job he's try stuff could have been done years ago I know I know now it's all come down to this lot be my only grapple them is that he didn't listen to me soon enough that's it my only grapple with them is they didn't listen to me soon enough you know this right here got out of time you got we congrats you I won't do that to you thank you Aubrey Micah M Morris got some homes and some business thank you coun for hear me out today see I think that Jason your preparation for this was imaculate I think it's a whole lot to unpack and I think that the council should consider that I think that also uh the public didn't have proper time to listen here digest like maybe you have you're making decisions that are affecting people that are living in 2024 is hard so it's a whole

lot of terms and Mr Jason's good wor for other purposes for other purposes a little bit little bit of gray area a little bit of leeway I too believe that you know operating in the red is something that nobody should do municipality shouldn't do but there a lot that do and I believe that there should be a rate study done that properly analyzed I have over 18 different offices that have internet service that are throughout multiple States m c in this state M States across the country nowhere else is there a $500 commercial deposit to have commercial internet turned on that isn't ever applied back towards the principal balance or gets credited back to the account AKA if you new business comes to Clarksville they have to pay $500 piracy fee have their internet turned on and until they close their business Doors Down 25 years later they don't see return of that $500 this is just one of many examples of inefficiency when they first came in and said that they wanted to self-govern without the council's approval to self-govern their rates as you mention Mr K I had two small children that were hungry in the back and I went and I grabbed my kids and I carried them out here because that's trash I'm glad to see it remove with that being said there I I I felt a little embarrassed apologize to the counsel people in here because it wasn't most professional while I was driving up Highway 21 on my way back to my house there was CCU truck pass me with a family of four and it headed south dressed up to dinner I don't think they going to work on some lines when you go to the gym in Ozark you see CCU trucks regularly sometimes we go to the beer store in Scranton or in oun CCU trucks in the parking lot there's a lot of loopholes inefficiencies and redundancies there could be fixed I don't think that doubling the

rates for meters helps anything with economic development Mr how was not here L he was here you know 50 to $100 10 to $20 yes most of your consistant are going to care about $10 a month $10 H hard nowadays now that milk you know cost $5 a gallon seven if you want to board so just please about I don't think this should be voted on I don't think it really I think get walked into the back door of this city I I think thank thank you can I make up yes ma'am absolutely um I appreciate your comments Micah and Aubrey I I have like Rob said I've been able to go to a CP of the recent commission meetings and I've you know feel like I've been a little more educated in there and um yeah we where I sit I'm thinking I know nobody wants to pay a little bit more but as Jason alluded and as I've talked to Roy um I think your historical analysis for me Roy went something like um we were charging more in 2014 than we are today and look at where we are with those costs that you alluded to today and how could we possibly make up for that and so just having a Band-Aid today I do appreciate that but I also feel like we would like I I would like for you to come and say what you really need um because I think if you come back a year from now even though you're open about saying it's a Band-Aid you're going to have to ask for some more and I know people don't want to hear that but

when you understand where we are with it it it's going to cost more and what's worse in my mind increments are better not doing anything and having a Snowball Effect is really going to hurt people and that's that's what I don't want and I'm not saying I'm against the Band-Aid but I feel like I should lay out my perspective so it's valid yeah I'm I agree um I would really like to have enough money to do a true rate study for all departments through CCU then other could actually see what we need then people like my actually see where we're at and if you see CCU trucks if you got that and you give me a truck number and stuff I'll take care of that think some of this has been okay okay all right all right all right hey comment up here comment up here would to see comment up here I can fix these problem how much would the rate study cost Roy I I don't know for sure I'm know I've heard that $6,000 out there I'm gonna ask Mr Duncan step up to the podium real quick 20,000 Mr Duncan I know you quoted a price for R study what was it last we heard chair of the commission is that right just for people y out there you're chair of the CCU commission yeah make sure they know who you are commissioner commission chairman of the CCU commission we we had some information not long ago that was going to be from JK 18 to 20,000 takes about three months so if we did that we're still a

little further out but to address your comment one of the things that would be a big help instead of let's say add to the Band-Aid is changing our supplier that we purchase from just like what David said so that you know if we do a knee jerk and really raise it to what we need then we change suppliers within 18 months and find out oh well we can back it down there so we don't want too many generations up and down in other words so Jack my question was I guess where I was trying to get to since utility is so closely tied to Economic Development could Economic Development and the CCU split that bill and do a rate study possible but there's there's one other thing that I would add council could could allocate N9 or 10,9 out of Economic Development you come up with the other half of it boom done y'all pass this for three months and if it comes out with something different we turn it around and and terminate this in December we've got a new project that we're working on right now which is one that royam which is a software component that just I think it's implemented all the way yet they still working on because Department it's literally basically show you where everything was this what you showed at the last commission meeting was this what you guys showed at the last meeting I was at one yeah that was pretty impressive that and I'd say 95% all by itself stud plus it also gives us the ability to build in projects like we got a lot of a lot of projects not been redone not been updated we can put the cost those in back up just you did you just say that this program replaces rate

studies for municipality replace it I wouldn't say replace mention that at all I wouldn't mention that at all if it don't replace it don't say it it puts everything in perspective see how it's tracking well they they need to make a decision based on what's solid facts true not part facts not because it's a good good close it's like an artillery it gets close but it ain't solid rate study gets you there and they need that information to make the right information to make the right decision why I'm telling you I'll make the offer again the council we have Economic Development dollars if they'll approve N9 or 10,000 from that you match 9 or 10,000 say around where did you get your 18 to 20 you don't think JK is gonna get it done what's the difference is it the forecasting or the depth or what's the difference there's do it correctly there's good ones B good who is it actually teach who is it people teaches the the r study classes who is it Jason yeah I've worked with some people in the past who this is what they do four cities all over the nation it's their it's their business model that's what they do I think I'm not gonna say JK can do ital rate I haven't seen this product I say anything about it I'm just more familiar with like Mar and utility Financial Solutions from ufs so overall in the United States there's 2,000 Public Power cities and uh you know we have a a trade Association American Public Power Association that represents all 2000 right in in front of the

federal government uh ufs does the Financial Training it's a painful class I've been through it it a spreadsheet I mean it leaves right about how their methodology even because I want to know what's your methodology how are you going through and I mean they get into everything right age out your system and say how much should you be putting aside for future repairs how are you funding depreciation yeah right so I would uh be a little concerned about having that in-depth of a rate study at the moment you got to write the ship so that's what I would encourage you to do is to write the ship tonight it's about stabilizing that's all we're trying to do is just to write the ship right and and get things get us a little bit more on smooth water and then let's get a a good rate study done right when we have time to breathe get a little room to breathe get a good rate study done and then I would say uh look at the recommendations that come back think about what we can reasonably manage and in small Jason here here's the thought process it just popped in my head I think the council needs to consider this it's very important as you deliberate the only way we are Tethered to the utility is through a bond they're fin we're not we don't back stop them in any way we're not responsible for the reserves supporting them their back stop is the TA the rate payer however we are tethered through bonds and the bankers get to see these audits as they're turned in there was a clause in each of those bonds particularly one in 2019 it said that if the if your revenues don't exceed a certain percent right of the principle and payment of that Bond they

have every legal right to come in and tell you congratulations Mr Young here's your new electric rate here's your new sewer rate and so that is a legal that is the road we're on and we've had three four three negative law years in a row it's called Debt Service so minimum Mike I hope you understand that I didn't think about that till this now but that is a legitimate concern that we have to one thing I want you to think about too an average consumer has about a th hour mon right on average right so when you think about so what's the difference between cents or fixed charges and how you're trying to allocate that I mean part of it is you're you're trying to align your variable cost with your customer variable rate right and your fixed cost with fixed rates that they so get those two pieces in alignment but in general if you're if you're using a th000 k hours a month right $20 equal two cents on your rates right so you can look at that every year I go through everyone's rates in Arkansas it's a report that comes out of Energy Information Administration eia.gov you can look it up all right I extract those and provide those to utility managers to let everybody see this is exactly where your rates turned out and you can't gain the system you put in a fixed charge or it's in a power cost adjustment or it's in a kilowatt charge rather than a kilowatt hour charge you can't gain the system right they say how much is it per kilowatt hour that you sold and uh the rates from my report that went out last uh December the numbers will come out in November I published my report in December so it was for the year 2022 the rates had gone up significantly for every utility out there uh I think about uh you know one of the best

utilities best run Utilities in the state and possibly in the country is Jones bity Water and Light they are on it they own generation resources natural gas coal hydr power you name it solar power they own a huge mix of more power than they need and they' planned it over decades to get there uh their rates went up in 2022 24.5% in 22 it did from 2021 to 2022 their kwh rates for their residential went up 24.5% was their increase and uh so uh you know the amounts that you're charging uh are very affordable when you try to compare it that's where I think you're concerned there's obviously things that we need to be aware we need to watch for for fraud wasw to every corner we need to watch for that at every turn and never take our eye off that ball right but when you think about are we an efficient utility or are we an inefficient utility you are far on the efficient side right that's that's not where you're going to make up ground right now right so uh it's just the cost of everything has gone up everybody's facing it the best run Utilities in the country are facing it and you're facing it to I can Mr man just a quick comment one thing everybody should know 2023 AIT but compared to the 2022 audit loss was $1.2 million less there's a lot of savings cost cutting that's already been we're going in the right direction yeah we are abely my my granddaughter and her husband just moved

you've got a report just want to say that the guys and G now have been super busy with training put lots of fires as you can imagine now literally figuratively and everything else hey I got asked a ton of questions about what happened up up here this morning when we were in staff meeting can you kind of let them know what happened so the electrical fire yeah so Mr Roy since you pointed out earlier there was a guy wire steel cable that supports and connects the tops of the transmission line that runs uh East and West right here at the trail head and the cable that supporting cable broke and when it fell it shorted out across some high voltage lines started a small grass fire that wasn't that was in a mode area so it wasn't hard to take care of yeah we've had fires what see big danger had fires break out if you hadn't been down to Interstate lately there's burnt spots every 5 miles Chief Ross I think Chief Ross is up right now fighting the fire off of his cabin on strawberry Bluff so it's it's you know if you're a prayer the type that pray we certainly could use some rain in a bad way spread the word about burn we had a lot of unau burn get that word out that's yeah yep I want on that if you're hooking up a trailer and has a chain with a hook give it a few turns and then hook it so it's not dragging the ground causing Sparks and catching the world on fire cuz we don't get some rain pretty soon it's going to get wor so good than youas thank you Stanley oh no no come on not

tonight back and the ball fields Prett much rough in get those hyd bed bar cleaned up have that as well hope we get a r a lot of differ guys got socer Prett much everything in there busy as so I was having I had a conversation with a councilman at beginning of the meeting every weekend um Stanley gets at least four or five texts from me from Council Members or members in the community about there's a problem in town the last one was North Hill Street and before he could even respond back to um he or she could respond back to the complaintant you were up there with your crew and the hold was pick I I mean it was that fast what I want everybody to know is that you're the face that goes on and fixes those things day night rain he it don't matter Stanley has been in that street in the in the park absolutely the most responsive bunch of people over sing my L we're fortunate to have them um just I want you to know that we've got some excellent workers in our city I agree well I sent him I sent him a text while he was working on that hill and I said man that just it bu so much better it's amazing all that tree garbage is gone now that's gonna be the best place to sit and watch the Christmas parade the kids can be rolling down the hill be so nice it's gonna be fun apprciate you thanks sir I have just a few more things um some closures

coming out for the npv um this weekend is the NRA banquet um and then safe trur is on the 26 so if you have anybody that wants to participate any businesses friends um please have in give me a call uh it's from 5 to 8 and then we're going to be closed for election set up is on the fourth election on theth and then we got the Holiday Market November 15 17 just some things to keep an eye out for Girls Club started their basketball season tonight too so they'll be very busy and enjoying the new exting see thank you so Jack you're wait wait you're another one you're not getting away um there was two weekends ago and I'm trying to remember we had the general auxiliary we had a softball tournament at the same time we had we had a soccer tournament right now we had Stan how many Morgan how many parking spots at the at the soccer complex 4 50 total I think there's about 450 total parking spots there was so many kids and so many people in that complex that that was full down 164 was full the road to the Armory was full and we had to move keep moving people around because there were so many people out there at the same time there was what 798 people to 790 to 820 people at the softball complex and at the same time there was 250 people in the mpb thinkt team from so I want I want the world to know we manag all that with five people so as you get on on this you see this stuff on social media about what ain't being taken care of I challenge you to go find five people who can do more than her and Stanley can do I'm so stinking proud of you and Stanley and your Crews for what y'all do people don't know that but I'm going
