Afternoon. Today is the March 12th, 2026 meeting of the Unsafe Building Hearing Authority. Hearing authority members are Gretchen Cheeseman, Mayor Dan Rydenower, James Heimlick, and Councilman Jeff Green. City staff members here today are Taylor Reid. Um Rebecca Moon is on her way but late. Uh Melinda Coffee, Caressa Sanders, and Danny Hine Han and Richard Rawlings acting as administrators. RI Aubrey Chris and John Moahan are city at our city attorneys. And I am Courtney Walker acting as recording secretary. The unsafe building law IC36-7-9 is hereby entered into the record for new cases set for hearing today. A reasonable effort has been made to notify the owners of this hearing and the orders being reviewed. The owner of record and any entity with a recorded substantial property interest was notified by posting on the property certified mail and published in the Star Press. A notice of this hearing for status hearing cases was set via regular mail following the last hearing at which action was taken. We will call each case set for the hearing today and take action on the cases in order listed on the agenda. Starting with the properties that have an owner and or representative signed in. If you are not the owner but wish to testify about a property on today's agenda, please identify yourself as an interested party when the property is called. City staff members as agents of the enforcement authority will present the city's evidence about the condition of the property. You will then be asked to present your evidence. We ask that you stick to the issue of the current unsafe order when presenting your case by providing plans and a timeline to become compliant. Both the city and the property owner will be allowed to question witnesses and summarize their positions. The authority
will make findings of fact and act accordingly and or set the case for a status hearing at a later date. Findings of fact and action taken will be mailed to the property owner via regular mail and filed in the Delaware County Reporters office. If civil penalties are assessed today, an invoice for payment of the civil penalty will be included with the hearing record. You have the right to appeal any action taken at this hearing. Appeals must be made to the Delaware County Circuit Court and must be initiated within 10 days of today's hearing. All who expect to participate in the hearing today, please stand and raise your right hand and be sworn. And uh collaborately we working together to uh help this uh young man who uh is a a brother of ours that uh unfortunately has lost his house to fire damage and uh and a group of us has come alongside of him to help him get to the next level in terms of getting his house turned back around and back online. The electrical is underway. You know, we have a temporary pole out there. S Mills, he's doing the electrical on it and the wiring is pretty much uh started just about complete. Uh the uh cleanup is going pretty good. We're waiting on some good weather for that. We do have a a heating contractor to replace the heating unit in there. So, all that work is scheduled and that was on the building permit, the work that we anticipated to do. So, it'll take a little more warrant and then he's talking about just replace the roof. There's more than that. Okay. Is there you got a like timeline for how long you think it's going to take? Are you you can't live there now? Is that right?

Hi, my name is Alex. I'm just a concerned neighbor. Uh, this property is attached to my property line and has a a staircase along the back that's about to fall on my property. I'm just more or less here to observe and see what the outcome of it is going to be and how we're going to move forward.
Well, unfortunately, the property owner didn't show up. So, and I haven't received any contact from them prior to today. So, if they plan to make any repairs, I do not know of them. That's Middletown. Yeah. Um, then I guess I would entertain a motion for a $2,500 civil penalty and continue for 30 days. Can we affirm it too, please? It's Oh, it is a new, isn't it? I'm sorry. Okay. We tagged this um back in February due to sewage leaking into the apartment from pipes and holes in the ceiling. Um, yes, it was a result of the upper units flushing a combination of items, uh, feminine hygiene products, uh, like wipes, and we even pulled some dish towels out of there. All the necessary repairs have been made, and I've got photos and invoices. Okay. Yeah. Are these copies for us? Yes. Thank you. Everything came out today. Okay. That happens sometimes. But if I can get just kind of a scope of it, I can check with our maintenance and see exactly if that was done. Okay. I'd like the building commissioner to take a real good look at this photo and uh have them confirm what that is because there's there are standards you have to go by to remove that stuff. Okay. Okay.

Good afternoon. Sean Brady, uh, 4218 Cornelius Avenue, Indianapolis, Indiana 46208. And are you the owner or representing the owner? I owner.
We were um reached out the fire department reached out to us um, uh, saying that there had been a fire on the structure and the awning was collapsing and on the verge of falling and hurting someone. So the um it would the fire was in the wood piles that are stored out back. Um working with we're also working with the Indiana Department of Environmental Management on this as well. Uh due to weather, we didn't get to start working on it until later uh in the 60-day period that we were given. Um we have removed 12.4 tons of material. I do have pictures kind of before and after of what we've been able to get to do. The awning, there was no fire on the building itself. The awning has a um um air conditioner unit on it that's kind of weighing it down. We're going to remove that, take the weight off of it. It should be fine. It's anchored into the concrete structure of the building, so I don't think that it would it would fall on its own. Um so, uh with that, I I would ask for I think we can get this done in 45 days. We've got we've gotten a lot already done uh to get the wood and debris taken care of. We've also removed three derelict vehicles that were on the property. So, we've gotten a lot a lot taken care of. So,

And you say you got a building permit for Actually, there's not an out building. There's a garage and a house. I think there might be confusing that with the other property. That's the house. This is the house.
That's the house. Okay. So, you got a bu a building permit. It looks apply for it. Okay. Looks pretty bad. It's It's going to take a little bit of work. A little bit. Okay. I'm going to look it up on the map so I can see where all the buildings are.
Um his his permit hasn't quite been approved yet. Um we're still needing a little bit more information. Trying to get on the same page about what's going to be done. Um, but he they do have plans to fix it up. Do you have a timeline? I I hadn't quite gotten an idea of how long you think everything would get started and um well, once the permit gets approved, but we we started closing up everything that we could um and getting it all secured.
Um and now that's why we're asking for the permit is uh so that way like the uh any of the the um the sheeting on the outsides that need um repaired cuz some of it's gotten water damage where it's swelled up. Um we're going to re, you know, go around the outside and get it all all secured up and then do the house wrap on it. The uh the front the uh there was a piece where the wind had tore up the metal roof. That's also has to be under the the permit. But right now, we want to work on the house first and then go back to the uh the garage. Yeah. Front to back.
Okay. So, the house is is uh better chance at, you know, being salvaged. The uh the garage in the back, uh we're still looking at that. We want to shore up shore it up. Um and uh also that's why we're getting the permit for that is to um see about uh the front the front of it. Uh we need to secure all that and the some of the raptors need to be replaced. So, you've owned this property since 2014. I did. Yeah. Okay. Um, so when you say they have a uh Are you think this place is salvageable?
They want to put the work and money into it. What's your timeline look like? How much time is it going to take you to get it in shape?
Um, I mean, right now, um, we're we're securing the outside of it. Um there's things on the inside that we need to get out. That's why we're going to get the the dumpster so that way, you know, it's hard to work around things. So, we're just clearing it out. Um I can tell you that, you know, doing the outside, um once I pull things off and I see it needs insulation, then I'm going to have to insulate. So, I mean, I can't really tell you how long it's going to take. And that's why I asked them about the the permit. It's going to have to kind of be one step at a time. So like six months, a year, year and a half.
I'm I'm hoping no more than a year. And what's your like what are you thinking budget-wise?
I can't tell you. I mean, I'm I'm just now getting into it. So uh and and what that's the other thing is right now I mean uh once we start tearing into everything um that's when you can find out what's what's under everything. you know, everything right now looks solid as far as the foundation um structure um like on the housewise, but um once we start tearing into it, that's when we would know what's you know if if it's even feasible to even go forward or just to stop. I want to give them 60 days to figure to evaluate the building and come back.
30. I mean, she's owned it for 11 years. Yeah. Yeah. With a plan and a timeline of what they expect to do.
Um, so if we have you come back in a month or so, you think you'll know more? Well, I mean, I've already taken days off to meet the inspectors and and and to do the things that I have now. I mean, you know, by coming in here in a month, that's taken away two of two days, you know, taken off to come here. Um, I mean, if we could get more time, that would be great. But, I mean, we've I mean, we right now we're we're uh you know, we took off and and started getting on on this. I mean, I wouldn't go I wouldn't start stepping forward on this if I didn't have, you know, the plans to go forward on it. So, you do have plans?
Yes. Okay. So, did they share the plans with you?
Um, we need to look over it, tear into it, see if we're going to try to finish doing rehab or it's going to turn into a demo. But at this point, we've not gotten that far into it to see how much money it's going to take. And yes, I have owned it since 2015. Um, it was my father's home. It was my childhood home and he turned it over to me. Unfortunately, you know, grief is a real thing. Mental health is a real thing. And I all my family has passed away. So, I am going through stuff in the house of four people that's passed away. And it's it's hard. It's been hard. So I apologize that yeah it's been since 2014 but you know I have had deaths since then as well and it is very hard but I am doing it. So can we go with 60 days?

Well, I will say that this um house, it has power on it. Um all the debris from the outside's been cleaned up. um is secured. Um the garages have power. Um the garages are secure, too. Um but what I've been doing, um to be honest with you, I've been concentrating on 923 South Persian. So, I just been doing one of them at a time because I I usually come in here and try to do two or three of them and get overwhelmed. So, um I contract I contacted on one and I think I got that one handled and then I want to come back and and get this one next. What's that? How where are you on persing? What percent complete?
Well, I would say probably about 80%. I got pictures also. Um, it's got some sighting. We got some roof. So, this this 923 South Ping, that's the next house on the agenda. Yes. Yes, ma'am. Um, why don't we pull that one up and then come back to Elm? Okay, weird. You want to do that? Doing one or the other. I mean, now Okay. Uh, number 19, 923 South Ping. All right. And I I didn't have it then, right? I know. I know.

All right. She uh had been waiting on insurance to finish their investigation. And I did call the day before the last hearing. Mhm. Yeah. Mhm. Yeah. And what's the status with the insurance?
I I finally got a check that was right because they missed, you know, they missed a a letter on my last name and the bank wouldn't cash it. So, I've gotten that all taken care of. I went to Remax. I had a guy, this is a purchase agreement, and he called me an hour ago and cancelled because he said somebody on on the board or something wanted to try and buy it for 5,000. But I do have the information. I He could be lying. I no idea. I just know what he said an hour ago. But I do have the purchase agreement with me. But he it's not valid anymore because he's cancelling it.
He called an hour ago. All right. So, you have your insurance money. I do. You either need to tear it down or fix it. I'm going to fix it. You're going to what? Fix it. All right. What's your timeline look for that? Like for that? What I'm looking for right now is a contractor. Um it do you guys have a list of contractors that my allows or um as far as general contractors in the city limits we do not require them to be registered within the city. I mean general contractors have to be licensed with the state and go through that process, right?
Um but they don't have to be registered with our office. Um so we we do not have a list of registered general contractors. Okay. because in Anderson, you know, yeah, they have to be approved, but yeah, in the county they have to be approved, but in the city limits they don't. Um, so you can reach out to the county building commissioner's office and they may have a list. Um, I would just recommend googling, you know, local contractors and you can get a list and you can always call us for reference. Can I ask for questions? How much your insurance settlement was? 70,000. That'll be enough to fix it. That's what I'm hoping. Yeah.

Um, and we're here on his property that he had purchased from the land bank. He has done the demo portion of it, and I do have pictures of that. um and started to lay the foundation and then JJC Excavating is a concrete company I'm assuming um said they wanted to wait until spring broke before they lay the rest of the found like they have like the edging done and then the whole inside of the house has to be poured. I don't
see I don't know what that's called, but um Jiren, I think that's the owner of JJC Excavating, said that uh it'd be best to wait until spring to do that because it's such a large area. Uh it's not just little, you know, like a step or something. It's half a house essentially. Okay. So, are there any permits?
Yeah, he has his he has his permits. He needs to update his building permit, which I've spoke to Courtney about that already and have the application. Um, he was just waiting until it came closer to time, which probably within the next, I don't know, 30 days or so, cuz spring is like what, March 22nd, April 22nd. Um, so he's had the building permit since for a year or more. Yeah. and he's taken down all of the walls and half of the h like the whole back of the house completely sunken in.
Um, did he get an inspection prior to the hearing? He not prior to this hearing. No, I check in monthly with Courtney and give her an update. Um, I do know that he has like a $150 fine uh for maybe not attending a hearing and that was maybe in December for January's here. That's for not getting an inspection. Okay. $150 for not getting an inspection. And that was because her and I were playing phone tag for like I think almost the whole last two weeks of December. Um, yeah. We Yeah, we couldn't
I think it might have been because of the holidays. All right. So, he has applied for his renewed permit. Yes or no? He has not applied for it yet. I do that. I mean, I want to take care of it. All right. And when is that going to happen? Um, well, I would say in the next couple weeks because like I said, J uh Jiren said he wanted to wait until spring to lay the foundation. So, he was just trying to get every day out of that building permit as possible. 60 days.

There was a fire in a garage that was she wasn't familiar with and she's dealing with that and she paid someone $9,000 to have the sighting done and they took her money and left. So, she is asking for 90 days to get in compliance with um the current building codes and I think she'll make some good progress. She just needs some better weather. Don't we all? Yes.

Um, since last month, um, you have gotten the electrical turn back on. Um, so that's been repaired. Um, has there been any other updates or progress?
Yes. So, over last month, so we have, uh, our power back on. Uh and then uh we have also paid the invoice for clearing the uh the glass windows which are kind of broken by somebody and uh the we got we have ordered the parts the glass they have been uh reached our vendor the contractor it is scheduled to repair on 16th of March which is like next Monday.
So it it is scheduled to repair all the glasses and with the the two outstanding thing that we have is the roof repair. So we are working with the contractors now with the snowstorm everything cleared out and now the weather is getting better. The contractors are comfortable climbing the roof roof now and get the uh estimate and get that done. And the second thing is like there are some uh hbacks vandalized. We are working with insurance to see how can we uh get those compensated and also uh you know what do you say uh use the wooden things to you know secure them so it won't fall off. That's one thing. So these are the two major things that we have to do uh for us uh to you know to come back to where we were before. But we are making progress. We are kind of on online in the in the path to complete all the works that were planned.
Did you get a did you call for to schedule an an inspection before the hearing? Uh no, we did not. Okay.
Because uh the the actual work which was supposed to be done is scheduled for 16th. So we didn't want to you know them to waste the time. So for the next time we will once we have these works complete we will schedule an inspection. But we have like three more weeks because we have to schedule inspection 10 days before. So in a month it'll be only only have 3 days 3 weeks from now. Right? So uh that would be too short time for this month. So if you can give a 60-day time we will fix all those two issues and get the inspection and uh submit it before the hearing today. The um this electrical service inspection was what I was thinking would cover their inspection that they needed because
did they get electrical service inspection? Okay. Yeah. All right. And yeah, we had inspect it before a will come out and turn it on. Got it. All right. Okay. Yeah. And looked at the lots because there was uh people were dumping behind the building and in front of the building and everywhere. They still are. They've done it again. Yeah. The dumpster. Yeah. People are dumping. Yeah. I travel that road twice a day. Yeah. I'm always seeing cars backed up to it throwing stuff. Yes.
I mean uh we are not having a way to control that because you know uh and we we tried to remove the dumpster so people will be you know reasonable not to dump there and people are like still dumping on the empty parking lot. So I had to call the the dumpster companies okay we are not using it but still you know be nice to community right but still the community is taking leverage to the maximum. Mhm. Yeah. So somewhere that was there was cleaned up. It was the cleanest I've seen that lot in several years.
Have you done anything to put lights up in the parking lot? Yeah, that is electric that that's something which we are waiting for the electrician to figure out which meter. So one one complex thing is that uh we do not know which which so what is the source for the lights. So that is something you know it was broken when when the city was doing the front part right so those those light those power lines were broken at that time and they are they are trying to identify how to know secure that back and do it. So that is also there is also an effort to put the lights back on. That might help as a deterrent from dumping at night
if you get the parking lot lit up and even some behind the building. Uh you do have another issue in the front where we have the the grassy area now. You have a like a pond out front. There's water standing yet today. And I know that if that's not drained and tapered the ground, so it'll drain into the storm sewer, you're going to have infestation, mosquitoes and things of that nature coming very quickly. Last year we had I think cattails growing up out of it and that needs to be addressed as well.
Yes. So we we have we are we have we'll be doing landscaping uh very frequently now this year to not to have that situation and that water thing is not a kind of a pond but when we when we dig that area right the city when when the when they dig that area it they left it little bit uneven so we hope that once the uh grass comes starts coming in. So uh if it has to fill with some some sand or some dirt, we will we will have to procure that dirt and then level it up. That was supposed to be a green area. I mean but when there is no like you know uh when when the land is not leveled up and the rain coming in it is it'll try to come to a place and slowly it becomes like a small pond kind of thing.
We will have to level it up and see. Yeah, we will. I mean this summer we will once the uh winter once the winter is gone once we we know the complete once it completely leveled up we'll see if it is completely leveled up or if we have to put some dirt and level it up so we don't run into the same issue again next year when the when the rain start coming in because we had a very uh severe rain I think couple of days back right a very severe rain so that might be a reason for that one to but but we we will slowly we kind of you know once we get it get in get to the summer we will make sure it is addressed. What's your plan for tenants? Yeah. So tenants
have you been working on getting new tenants to come in?
Yeah. So we are we the Coldwell Banker. So we have a leasing uh agreement with them to show the properties but unfortunately I mean we haven't have had any showings but we are most like you know open for any kind of businesses at that time that I want to do business there in the south side of the city. So we have also from my side personally we have renovated one of the unit to open a pizza store. The renovation inside is complete. That's the last one which is 3853. The interior renovation is complete. We are trying to, you know, put some money in to procure the equipment to open a a decent uh piece of store to at least bring people to that space. But that isn't the plan that we are doing it from our side as a investors and the owners. But if to bring tenants, we are still open. We are giving like six months free rent and lowest possible rent in the town just to make sure the building is maintained right so we're not trying to look make money out of the tenants but still if it covers the building maintenance that would be great so yeah we are but unfortunately we are not seeing so many inquiries at least that I am aware of

Uh, we are aware of that. The property was scheduled for share. This was actually set for a hearing back in January. Uh there was a pending sheriff sale on February 11th. Uh unfortunately for as the city's concerned and we're concerned, the sheriff said was canceled because there is a pending insurance claim and the bank is still waiting to find out what they're going to be paid if if they're going to be paid. Uh we were requested to postpone the sale date for at least 90 days. So that would just in the May 11th. We have not filed a new recipe because it's just timing matters. Uh we have to wait till we know we're going to be after May 11th before we can file the new recipe for sale. So, uh the status is it's in foreclosure and there's at some point going to be a sheriff sale possibly depending on what happens with an insurance claim that unfortunately I have no other information on other than it's pending and they're waiting for more information.
Has it been sealed? Excuse me. Yeah, it's it is I believe it's been boarded. Yes, it is. The bank did board it and remove some external debris according to what we were advised um
because they have I guess there were some there may have been a squatter issue in the property. The borrower is deceased so there was no heirs or anything taking care of it. So, uh the squatter issue delayed getting into it, securing it and getting the insurance claim filed. Uh the bank has it secured now. So, it is on their they're regularly inspecting it to make sure it stays secured. Um, we would request more time so we can get the insurance claim resolved and get to a share of sales so the bank can actually do something or if it's going to get sold, somebody else will have the property to do something with. I presume they will um the bank will mow it. Uh, I can make sure that they do maintain.
Yeah. Do you can you let Courtney know who the property you know who do are you already know who the prop the property management company is? the people that are taking care of it. I do not or nor do we. Unfortunately, banks are so segmented with this. We're dealing with forclosure department. I could try and get that information. Well, I was uh had a grant to get the h uh roof and stuff done on it and I started calling the contractor to find out they got the money to get stuff done when the weather started breaking. They haven't received the money yet. So, I called the insurance company I went through that that I had and they said my grant was denied simply because I got switched over to Medicare at the first year. So I lost the grant because I had to switch insurance companies because why? Because I switched insurance companies. Oh. Cuz I was forced to go from state to federal insurance. Okay.
So I lost that grant. So when I got my check yesterday, I get paid every second Wednesday of the month. I started plan B. I started buying materials up to get the roof done. So I got a receipt right here where I bought some materials. We believe you. Okay. Yeah. You're under oath. We believe you. So, um, I'm starting to doing that and unfortunately the I didn't get the inspection done, but I did start calling middle of February, Miss Coffee, they left several messages to get the inspection done. Finally got a hold of her yesterday and she sat there and said they did do a drive by and see nothing was done. All right. Have Have you because you own this house, right?
Yes. Have you ever thought about talking to Habitat and see? They're helping me with some things, but for the roof part of it, they don't have the money for the roof part yet. I'm talking about like just a whole rehab. That's why I'm trying to get them to do or tear the house down and build a new house. Well, actually, the house just needs rehabitat. It's got good bones, good everything else. It's just the roof and some windows for ventil needs replaced. And everything else is is interior. which is cosmetic, which is what I'm working on. I am working with Habitat. They're supposed to help me put a new furnace in soon as I prove to them that my taxes is up to date. I've been talking to Ryan about that. Property taxes. Yeah. I'm just a couple hundred dollars behind.
Okay. I'm working on that, too, cuz like I said, I'm on disability. It's so much out of time. Okay. All right. Um, so you're you got your roof. What if we go out? When was my timeline with my disability? I'm hoping within 90 days I have enough material to start putting some type of roofing on top of the house. That's getting material built up.
