Judiciary & Administration Committee - Regular Meeting

All right, everybody.

Thank you for your patience. We excitedly have a new computer system. We're working out the new bits of that. It is 5.34 p.m. on Thursday, September 10th, 2026. I'll call to order this special meeting of the Judiciary and Administration Committee to order. All members of the committee are present in person. We have a number of items. I'm just gonna read them all. And just note that each of the, all of these will go into closed session, so I'm gonna read them all for proper process. 26-0935, appeal of TAC Sitco Incorporated doing business as Sitco Unstate regarding the denial of application for cigarette, tobacco, and electronic vape device license at 1914 State Road. Note the committee and or council may convene in closed session pursuant to Wisconsin State Statute 19.85, parent 1, parent A, to deliberate its decision. And following such closed session, we may reconvene in open session. As well as 26-0781, or 80, pardon, application of TAC Sitco, Inc., doing business as Sitco on State, for class A liquor license and class A beer license at 1914 State Road. 26-0879, complaint in the matter of the City of La Crosse versus Bennett O'Reilly's LLC doing business as Bennett O'Reilly's with notice of intent for revocation or suspension of combination class B beer and liquor license for the premise address 213 3rd Street. South La Crosse, Wisconsin. And finally, 26-0880, complaint in the matter of the City of La Crosse versus Moon China on Vine, LLC, doing business as Dell's Bar. with notice of intent for revocation or suspension of combination class B beer and liquor license for the premise address 229 3rd Street North, La Crosse, Wisconsin. Again, all of these will be addressing in closed session. So at this point, I'll ask for unanimous consent to go into closed session. Is there any objection to going into closed session? Gosh, were we really in there for 45 minutes? Okay, so the first item we'll discuss is 26-0935, Appeal of Tax, Sitco, Inc., Doing Business in Sitco and State Regarding the Denial of Application for Cigarette, Tobacco, Electronic Vape Device License at 1914 State Road. This is a decision of the review board, so it's a little different than the others. This is a final decision. The Judiciary and Administration Committee voted to sustain the clerk's denial of the appeal. All right, second one is 26-0780, application of tax, Sitco Inc., doing business at Sitco Unstate for a Class A liquor license and Class A beer license at 1914 State Road. This, I need a motion from a committee member. Council President. So, I move to not grant a license and they will need to be unable to apply for 12 months from this time. That is, motion is made by Council President Dickinson to not renew, excuse me, to not grant the new application and The applicant is unable to apply for alcohol license for 12 months from the date of decision. Second by Councilmember Weston. Any discussion? All right. Nikki, we're going to use just two thumbs for this one. Okay. So, Attorney Maddie, do I need to read the resolution? I don't think so. What? I basically said it, but I just want to know if you want it recorded that I read the resolution. Okay, let's just do that. So the resolution denying the application of tax that go ink doing business as sick on state for class a liquor license and class a beer license at 1914 State Road. whereas the Judiciary and Administration Committee convened a hearing on the above entitled matter on September 1st, 2026, receiving sworn evidence and testimony from various parties on the companion case found under Legislature 26-0935. Now, therefore, be it resolved by the Common Council of the City of La Crosse that it hereby denies the applicant's request for a Class A liquor license and Class A beer license at 1914 State Road. Be it further resolved that the council finds and determines the city's witnesses testimony and evidence to be credible and the testimony and evidence of the applicant's applicant to not be credible and lacking veracity. Be it further resolved that the council finds and determines that there is insufficient separation between the applicant and the previous license holder for the same premises. Be it further resolved that the applicant is unable to apply for an alcohol license until 12 months time has passed. All right, the motion has been made. Any final discussion? Next, we have 26-0879, complaint in the matter of City of La Crosse versus Bennett O'Reilly's LLC doing business as Bennett O'Reilly's with the notice of intent for revocation or suspension of the combination class B beer and liquor license for the premise addressed 213 3rd Street South. South La Crosse, Wisconsin. Nikki, can I do these both together? Should I do them separate? Okay.

The vote, the recommendation and vote by judiciary and administration was to suspend for 10 days starting tomorrow. Starting tomorrow for 10 days. Tomorrow the 11th. So that paperwork will be provided to the party, and you'll be able to provide objections to the city council tonight. You will want a motion for that in open session. Could I have a motion for that? I move to suspend for 10 days beginning on September 11th.
